Mr. Chris Bulow was present to represent the project. Mr. and Mrs. Jon Standard spoke about their problems with stormwater drainage, which they believe were made worse when the golf course originally developed. Mr. and Mrs. Standard live in the Island View Estates subdivision on a lot abutting the Mississippi River. There is a stormwater drainage pipe put in at the time Island View Estates was developed that outlets at their property. The location of the outlet is such that stormwater drainage has eroded away the bluffline and much of the riverbank leaving a deep revene that is getting larger in the direction of their home. The City Engineer has been made away of the issue and inspected the property. It is anticipated that there will need to be a public improvement project to correct the issue, which is traced back to the original development with Island View Estates. There was one other comment related to stormwater drainage between the existing golf course and an adjacent lot, not directly pertinent to the issue of the two proposed lots. City Staff explained the City's requirements for stormwater drainage in terms of rate control and water quality. The City Engineer may provide more information on this subject at the City Council meeting if necessary The Planning Commission had a brief discussion of the project, mainly focusing on the stormwater drainage issues raised by the public. Following their discussion, the Planning Commission closed the public hearing and voted 6-0 to recommend approval of the application to the City Council. The application will be on the City Council meeting agenda for 13 October 2003 at 6:30 PM. A. The property lies within the Rural Residential Preserve and is guided for rural residential land uses by the Otsego Comprehensive Plan, as amended. C. The property is zoned R -C, Residential Rural Open Space Cluster District with an overlaying PUD -CUP. D. The applicant submitted a preliminary/final plat for subdivision of two single family lots from Outlot A of Grenins Mississippi Hills. Outlot A was set aside in satisfaction of open space requirements for a golf course use in conformance with the requirements of the R -C District. Subdivision of the two proposed lots requires amendment of the established PUD -CUP. E. Consideration of the application by the Planning Commission and City Council is to be based upon, but not limited to, the criteria outlined in Section 20-4-2.F of the Zoning Ordinance: The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. The proposed use's effect upon the area in which it is proposed. Finding: The addition of two lots in this developed area will have negligible effect, except to add two additional home sites with amenity viewsheds of the existing golf course. 5. The proposed use's impact upon property values of the area in which it is proposed. Finding: Although no study has been completed, the proposed use is not anticipated to negatively impact area property values. 6. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Finding: The proposed use is anticipated additional traffic characteristic of single family uses, which can be accommodated by existing Kahler Avenue. 7. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Finding: The proposed use is not anticipated to have a negative impact to the City s service capacity. F. The ability to construct the Rogers or future Otsego facilities would depend on the referendum. The Planning Commission's discussion recognized the need for these facilities as part of a growing community. There were no public comments. Mr. Robert Fields and Audie Tarpley of Landcor Construction, Inc. attended the meeting to represent the project. The applicants described the project and presented new information on the proposed residential uses not previously submitted or reviewed as part of the planning and engineer reports. The applicant's also reviewed their plans to address impervious surface issues for the project and provided a comparison of the parking fields for their project with that at Arbor Lakes in Maple Grove showing similar overall areas. The Planning Commission's discussion focused on aspects of the project and also the condition of the submitted plans related to a preliminary plat approval. City Staff advises against approval of the preliminary plat at this time due to significant unresolved issues related to the design and location of interchange ramps with TH 101, submission of grading and drainage plans incorporating low impact development techniques to address impervious surface issues, and completion of the mandatory environmental review currently in progress. City Staff did indicate that a concept plan approval would be appropriate based on the submitted information. Following further discussion with the applicant concerning their necessary timeframes and project schedule, the Planning Commission voted 5-1 to recommend approval of a concept plan subject to the 24 conditions outlined in the Planning Report from this office. The Planning Commission subsequently voted 6-0 to continue the public hearing on the rezoning, PUD Development Stage Plan and preliminary plat to their meeting on 3 November 2003 with direction to the applicant to continue working with staff to resolve the identified issues. Consideration of a PUD Concept Plan for the proposed Waterfront East development will be scheduled for discussion by the City Council at their meeting on 13 October 2003 at 6:30 PM. A. Motion to approve a PUD Concept Plan for Waterfront East, subject to the following conditions: 1 • Approval of the preliminary plat does not guarantee sanitary sewer capacity. Sanitary sewer capacity shall only be allocated to approved final plats with executed development contracts to assure the City of timely development. 2. The property is zoned A-1, Agriculture Rural Service District. The property is also within WS, Wild, Scenic Recreational River Overlay District. D. The project is to be developed under a PUD, Planned Unit Development District. The information submitted in support of the application is sufficient for concept plan review only in accordance with Chapter 36 of the Zoning Ordinance. E. The Comprehensive Plan acknowledges the current Mississippi River Wild, Scenic and Recreation River management plan, implemented through Section 95 of the Otsego Zoning Ordinance, as restricting commercial use of the site. However, the DNR initiated an update of the management plan in 1998 and released a draft document that would potentially make allowances for commercial land use in this area. Although not formally adopted, the City of Otsego intends to utilize the performance standards outlined the draft management plan through a PUD District in order to implement its Comprehensive Plan. The City seeks to realize a project consistent with its goals for commercial development of the subject site while at the same time N C! 5 consistent with the intent of protecting the Mississippi River corridor as a valuable natural resource. The proposed development plan includes 60 residential units in 13 buildings along the Mississippi River. Although not anticipated by the Comprehensive Plan, the Proposed residential uses offer a land use more compatible with the natural river corridor, create immediate market support for the proposed residential use and take better advantage of the site's amenities than the commercial usesoriented towards TH 101 based on market factors. The proposed use's compatibility with present and future land uses of the area Comment: The subject site is situated between TH 101 and the Mississippi River in the northeast part of the community. The only adjacent use is the Highway 101 Market, a garden and landscape supply store. The proposed mix of commercial and residential uses is ideally oriented to take advantage of the amenities available to both land uses. Furthermore, the proposed development provides an opportunity to buffer the Mississippi River corridor from the impacts associated with traffic on TH 101. The initial sentences of response to the traffic section state that 13,210 trips will ultimately be generated by this proposed development on a daily basis, 415 trips during the AM peak traffic hour and during the PM peak traffic hour. However, the text fails to reference Appendix E where the supporting documentation for this trip generation data is provided. 2. Specifically regarding Appendix E: A. The trip generation rates for each land use should be provided for the daily trips, the AM peak traffic hour trips and the PM peak traffic hour trips as -well as the percent of trips inbound versus outbound for each of those time periods; B. The trip generation rates for the condominium/townhouse units are not consistent with those found in "Trip Generation — 6`h Edition" as published by the Institute of Transportation Engineers; C. The commercial/retail square footage in this table totals 258,290 s.f. as compared to 271,000 s.f referenced in the response to Item #4; the 232,000 s.f. listed in the second paragraph of the response to Item #6b; the 270,000 s.f. identified in the third paragraph of the response to Item #6b; and the 225,750 s.f. listed in the response to Item #7; E:\MunicipallAotsego2xxx12272\ot2272rwmemodoc.doc D. What is the purpose of the three (3) columns entitled "method" and what do the letters E, R and N found in those columns mean or represent; and E. At the bottom of the table, "gross" and "net" trips are estimated on a daily basis as well as during the AM and PM peak traffic hours, but no rationale is provided to explain the size and justification for such a reduction in the number of trips. 3. Regardless of whether TH #101 is being upgraded to a freeway and a grade -separated interchange is being proposed at the intersection of TH #101 with CSAH #39/90` Street, a traffic impact analysis of the development area streets and intersections needs to be prepared. That traffic impact study should include the following information in addition to the trip generation data found in Appendix E. A. A trip distribution model; B. The estimated background (without development) traffic volumes on the area streets and highways (including TH #101, CSAH #39, 90th Street, CSAH #42 and the east frontage road to the south of the development) for the first and ultimate year of development; C. The estimated background plus development traffic volumes on the area streets and highway in the initial and ultimate years of development; D. An analysis of the level -of -service on the area streets, highways and intersections, both with and without this development's traffic, for the initial and ultimate years of development; E. Recommended improvements on the area streets, highways and intersections to provide an acceptable level -of -service (level of service D or better recommended). This data and information is needed for the following intersections at a minimum. I. 90th Street and Quantrelle Ave. 2. TH #101 and CSAR 39/90th Street if at -grade or at TH #101 ramps with CSAH #39/90'h Street intersections if grade separated; and 3. CSAR #39 with CSAH #42. 4. The above analysis is needed to evaluate the layout and geometrics of the area streets and intersections (i.e. — number of thru and auxiliary turn lanes, intersection spacing, traffic control, etc.). As an example, the spacing between the 90th Street/East Frontage Road intersection and the 90th Street/Northbound on-ramp to TH #101 (in the southeast quadrant of the interchange) intersection appears to be woefully inadequate as shown on Exhibit CZ -1 in the "Figures" section of the EAW. However, this corridor study does not appear to be particularly useful for this EAW other than to document that TH #101 is proposed to be vraded to a freeway with a grade -separated interchange at TH #101 — CSAH #39/90 Street intersection. In particular, the projected traffic volumes thru Otsego, as found in Table 2, appear suspect when compared to the projected volumes to the south (in Rogers) and the north (in Elk River). I would not encourage the use of those projected year 2015 and 2025 volumes thru Otsego. Maplewood Development, Inc. has submitted a revised concept plan consisting of 64 office townhouse uses and 224 residential townhouse units on 121 acres of land located along CSAH 37 and south of 1-94 in the "Golden Polygon" area. Exhibits: A. Findings of Fact B. Revised Concept Plan ANALYSIS The applicant has submitted a revised concept plan incorporating 64 office townhouse buildings on the southeastern portion of the property. The area occupied by commercial uses is roughly 23 acres or 19 percent of the 121 acre site. However, the composition of the unit types has changed significantly. The original plan included 40 percent single and two family dwellings, which would be considered to be characteristic of low density residential uses. The revised concept plan eliminates the single family dwellings and significantly reduces the number of twin homes. The new plan provides approximately 50 percent of the units in eight unit back to back style buildings. These types of structures are considered appropriate for areas planned for higher densities and do not offer units well suited to high amenity areas due to the number of units without side or rear windows. The revised concept plan 4IPM does not change City Staffs opinion that the proposed Comprehensive Plan amendment is inconsistent with the goals of the Comprehensive Plan for industrial development in areas near 1-94 given the limited scope of office use space. City Staff continues to support industrial or office campus type uses of the entire property consistent with the current direction of the Comprehensive Plan. Furthermore, City Staff believes the request to change the land use plan is premature for the following reasons reiterated from previous reports: 1. Sewer and water service extension likely cannot be feasibly extended to the property within the near future. Practical considerations such as the necessary minimum flow from the pipes to be extended to the subject site create significant functional issues. Potential capacity issues within the Phase 1 service area also suggest that it is premature to over -extend trunk service lines at this time. 2. On-going planning efforts related to the 1-94 corridor identify a potential overpass and/or interchange of 1-94 by Kadler Avenue allowing CSAH 37 to bypass the City of Albertville. Such a regional transportation corridor has significant land use and property acquisition issue to be considered as part of that planning process. 3. The housing supply within the City and the west sanitary sewer service district is becoming heavily weighted towards townhouse uses. The City plans to study the issue as to the appropriate balance of housing unit types within the City as part of a Comprehensive Plan update next year. Changing the land use plan to add more townhouse uses until the Comprehensive Plan update is complete is premature. 2 CONCLUSION Actions for the City Council to consider are outlined below. Approval of the application requires four positive votes from the City Council in accordance with Minnesota Statutes 462.355, Subd. 3. City Staff recommends that the application be denied consistent with the recommendation of the Planning Commission and the attached findings. A. Motion to approve an amendment of the Comprehensive Plan changing the guided land use of the subject site from industrial to low density residential consistent with the policies of the Comprehensive Plan, subject to the following conditions: 1. Residential land uses in the area west of CSAH 19 north of 1-94 and the area south of 194 within the west sanitary sewer service district shall be limited to not more than 504 RECs of sanitary sewer capacity from the phase 1 west waste water treatment plant. 2. Approval of the Comprehensive Plan amendment or any subsequent concept plan or preliminary plat shall not guarantee access to sanitary sewer service capacity. Sanitary sewer service shall only be allocated to approved final plats with executed development contracts to ensure the ity of timely development. 3. The applicant shall extend trunk sanitary sewer collection and water distribution to service the project in accordance with the City's sanitary sewer service and water utility plans. The cost of extending sanitary sewer and water utilities shall be that of the applicant. The applicant may potentially be reimbursed for costs incurred for construction of the trunk sewer and water infrastructure if the City collects SACNVAC fees from other benefiting properties. Any and all costs incurred by the applicant for the acquisition of easements for the trunk sewer and water lines shall not be reimbursed. Development of the subject site will remain subject to the full SAC and WAC fees per unit in effect at the time of final plat approval. B. Motion to deny the application based on a finding that the request is inconsistent with the following policies of the Comprehensive Plan: 1. Once established, geographic land use designations and related zoning classifications shall be changed only when it can be demonstrated that such modifications are in the best interest of the community. Such changes shall occur only when they will promote land use compatibility and pre -determined goals and policies of the Comprehensive Plan. (Policy Plan, p. 38) 2. CITY COUNCIL MEETING: 25 August 2003 tabled to 13 October 2003 FINDINGS: Based upon review of the application, the recommendation of the Planning Commission, and evidence received, the City Council of the City of Otsego now makes the following findings of fact: A. The legal description of the property is attached as Exhibit A. B. The property lies within the West Sanitary Sewer Service District and is guided for industrial land uses by the Otsego Comprehensive Plan, as amended. C. The property is zoned A-1, Agriculture Rural Service District consistent with the Interim Land Use Plan provisions of the Comprehensive Plan. D. The applicant submitted a concept plan entitled Vetsch Farms consisting of 57 single family lots, 58 twin home units, 64 townhouse dwellings in four unit buildings and 104 townhouse dwellings in eight unit buildings with an overall density of 2.3 dwellings per acre. E. The applicant requests amendment of the Land Use Plan map within the Comprehensive Plan to change the guided land use for the 120 acre property from Industrial to Residential use for development of the concept plan with sanitary sewer and water services. F. The planning reports dated 30 July 2003, 20 August 2003 and 8 October 2003 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. G. The Otsego Planning Commission conducted a public hearing at their regular meeting on 4 August 2003 to consider the application, preceded by published and mailed notice. Upon review of the application and evidence received, the Otsego Planning Commission closed the public hearing recommended by a 6-1 vote that the City Council deny the request based on the aforementioned findings. H. At their meeting on 25 August 2003, the City Council tabled action on the request to allow the applicant to further investigate extension of sanitary sewer and water utilities and consider a mixed use development plan. DECISION: Based on the foregoing information and applicable ordinances, the request for a Comprehensive Plan amendment is hereby denied based on the most current plan and information received to date and a finding that the request is inconsistent with the following polices of the Otsego Comprehensive Plan: EXHIBIT A Once established, geographic land use designations and related zoning classifications shall be changed only when it can be demonstrated that such modifications are in the best interest of the community. Such changes shall occur only when they will promote land use compatibility and pre -determined goals and policies of the Comprehensive Plan. (Policy Plan, p. 38) 2. Immediate, short range market potential and demand of activities which are not suggested for a site or area by the Comprehensive Plan or allowed by the Zoning Ordinance shall not be the sole justification for a change in activity. (Policy Plan, p. 38) 3. Industrial (and commercial) development shall be strongly encouraged to create new job opportunities and expand the local tax base to assist in paying for needed service and reduce tax impacts on housing costs. (Policy Plan, p. 49) 4. To the extent possible, the provision and maintenance of a balanced variety of development types and areas to satisfy the needs, desires and income levels of all people shall be encouraged. An over supply of one type or variety of development shall be avoided to the extent possible. (Policy Plan, p. 36) 6. A balance in the types and quantities of housing units available throughout the City shall be maintained,, emphasizing higher value, single family units/lots, medium/high density multiple family and elderly housing developments to balance with existing residential development. (Policy Plan, p. 43) 6. Residential development shall be protected from adverse environmental impacts, including noise, air, and visual pollution. New residential development shall be prohibited in areas where noise and/or pollution exceed accepted standards and the negative impacts are not correctable by construction, site planning or other techniques. (Policy Plan, p. 43) 7. A balance in the availability of quality housing choices throughout the City shall be maintained. The final plat consists of 88 single family lots and two outlots. The subject site is located one-quarter mile east of CSAH 19 and one quarter - mile north of 70th Street within the west sanitary sewer service district. A rezoning of the subject site to R-6, Residential Townhouse, Quadraminum and Low Density Multiple Family District and preliminary plat was approved by the City Council on 28 July 2003. Application for final plats are processed in accordance with Section 21-3-3 of the Subdivision Ordinance and do not require Planning Commission recommendations. Exhibits: A. Site Location B. Preliminary Plat C. Final Plat ANALYSIS Preliminary Plat Consistency. The proposed layout of the final plat is generally consistent with the approved preliminary plat. As directed, the applicant has revised the street layout to slow traffic speeds along the east -west roadways. This has been accomplished by revising the intersections of the streets at the west side of the plat such that a turning movement is required to move east. City Staff will monitor traffic in this area and if necessary, a stop sign could also be placed at one of the four-way intersections near the center of the neighborhood. The other change to the plat is the cul-de-sac at the northwest corner of the development. The cul-de-sac allows the applicant to gain seven lots in the area of Block 1. All of the proposed lots meet the requirements of the R-6 District and Shoreland Overlay District and we have no issue with the additional lots. The other changes to the street layout resulted in the loss of one lot in the area of Block 7. Access. Access to the property must be provided with dedication of land and construction of 73 Id Street one quarter mile to the west of the west plat line. The property from which the right-of-way is being dedicated must be deed restricted as a zoning lot prohibiting separate development of the parcels until such time as the site is rezoned and platted. The design of all streets is subject to review and approval of the City Engineer. The location of the roadway intersecting CSAH 19 is subject to Wright County review and approval. Landscaping Plan. The applicant is required to provide a landscape plan for the landscape areas to be provided at the neighborhood gateway and as a buffer yard along the realr of lots 1 -3 of Block 1. The landscape plan and a cost estimate for the materials and installation is subject to review and approval of City Staff. Park and Trail Dedication. Section 21-7-18.1 of the Zoning Ordinance requires dedication of 10 percent of the gross area of the project or a cash fee of $2,100 per dwelling unit in satisfaction of park dedication requirements. Based on an area of 59.4 acres, the required land dedication is 5.94 acres. The applicant is to dedicate Outlot A to provide a southerly access to future Beaudry Park, which was dedicated as part of the Arbor Creek subdibision to the north. The area of Outlot A is 0.33 acres or 5.6 percent of the required dedication. As such, park dedication requirements will be satisfied with a combination of Outlot A and a cash fee of $1982.40 per dwelling. The cash fee in lieu of land for the proposed final plat is $174,451.20 to be paid at the time the development contract is executed. The construction plans must be revised to extend the temporary terminus of 75th Street approximately 110 feet to the east such that Outlot A has full frontage to a public street. Sidewalks are also shown on the development plan. The sidewalk on 75th Street should be on the north side of the street to avoid having pedestrians cross at the intersections with the north -south streets. Finally, the preliminary plat approval required sidewalks on both sides of 73rd Street to provide access to the future commercial area to the west. Grading Plans. All grading and drainage issues are subject to review and approval of the City Engineer. Some wetland mitigation is required for the wetland area at the rear of Lots 4-6 of Block 1, which must be addressed on the grading plan. 2 Utility Plans. The developer has submitted plans for extension of sanitary sewer and water utilities, which are subject to review and approval of the City Engineer. The City is limiting occupancy permits as part of the development contract until the waste water treatment plant and water tower facilities are on-line to provide necessary services. Development Contract. Upon approval of a final plat, the developer is required to enter into a development contract with the City. The development contract specifies terms of approval, security requirements and performance requirements. The development contract is subject to approval of the City Attorney. CONCLUSION The proposed final plat is consistent with the requirements of the City's Zoning and Subdivision Ordinance. The final plat also addresses the conditions of preliminary plat approval, including implementation of traffic calming measures to discourage vehicle speed within the neighborhood. We recommend approval of the final plat as outlined below. A. Motion to approve the Sunray Farms Final Plat, subject to the following conditions: 1. Right-of-way for 73rd Street shall be dedicated from the parcel west of the final plat and this parcel shall be deed restricted to prohibit construction of additional principal uses until the property is rezoned and/or final platted. 2. The design of all streets is subject to review and approval of the City Engineer. The intersection of 73`d Street with CSAH 19 is subject to Wright County approval. 3. A landscape plan providing for a gateway treatment at the residential neighborhood entrance from CSAH 19 and landscape bufferyard on Lots 1-3 of Block 1 shall be submitted subject to review and approval of City Staff. 4. The applicant shall dedicate Outlot A as partial satisfaction of park and trail dedication requirements. The balance of the park and trail dedication requirements for this and future additions shall be a cash fee in lieu of land equal to 94.4 percent of the cash fee in effect at the time of final plat approval. The cash fee for this addition is $1,798.40 per dwelling or $174,451.20 based on 88 lots. 5. The construction plans are revised to extend 75th Street the full width of Outlot A. 6. The construction plans are revised to relocate the sidewalk on 75th Street to the north side of the roadway and provide a sidewalk along the south side of 73rd Street from CSAH 19 to Lambert Avenue. 7. All grading, drainage, utilities and easements are subject to review and approval of the City Engineer. 8. STREETS Where adjoining areas are not subdivided, but may be subdivided, the arrangement of streets in a new subdivision shall make provision for the proper projection of streets into adjoining areas by carrying the new streets to the boundaries of the new subdivision at appropriate locations. A principal building setback of 40 feet from the delineated edge of all wetlands or 20 feet from the protective buffer easement, whichever is greater, shall be provided. The collector streets requested to be constructed are MacIver Avenue from 80th St. to 60t' St. and 70th St. from MacIver Ave to '/4 mile east. A report on collector road access fees was completed by Hakanson Anderson Associates in February 2003. That report set a road access fee to be used throughout Otsego based on soil type and general vicinity to a collector road. The fee determined and adopted by City Council was $1,140/lot for clay soils and $960/lot for sandy soils. That report was revised August 25, 2003 due to the City of Albertville informing the City of Otsego it would not cost share in the construction of MacIver Avenue. MacIver Avenue and 70th St. both have portions which are on the border between the two cities. The funding evaluation assumed no current participation by the City of Albertville. A new fee of $1,450/lot was determined for the MacIver Avenue/70t St. region but retained the $1,140/lot for all other clay soil areas. This report uses both the $1,140/Lot and the $1,450/Lot fees which will be generated from final plats east of CSAH 19 in the west sanitary sewer district. FEASIBILITY Exhibit #1 shows the location of the proposed road construction and the plats and their corresponding lots. The total number of lots preliminary platted east of CSAH 19 is just over 2650 lots and the total amount of money generated from road access fees is $3,660,960. The money will be collected by the City as the developers final plat the lots. The final platting of these lots is estimated to take 5 to 7 G:\Municipal\AOTSEGO1518\ot518feasibil ityreport.doc years. The current wastewater plant can serve 2400 homes. An expansion of the wastewater plant will be needed to continue to collect road access fees beyond the current 2400 lot limit. It appears that with the increase in the road access fees for lots shown on Exhibit 1 and the increases in density of some of the developments, the City would be able to finance the construction of MacIver Avenue and'/4 mile of 70th Street. The city could expect to collect the road access fees needed to pay for the construction of MacIver and the'/4 mile portion of 701h St in 4 to 5 years. The construction cost of the rest of 70th Street could be funded by a combination of more plats with road access fees east of CSAH 19 and in the sewer district, possibly State Aid, possibly the City of Albertville, and/or other city funding options. RECOMMENDATION We recommend the City move forward with plans to construct MacIver Avenue from 80th Street to 60th Street and 701h Street '/4 mile east of MacIver Avenue to facilitate efficient, safe access from the new developments to the primary arterial road in the area (I-94). We have determined the project is technically and economically feasible and is a benefit to the public. Therefore the contractor had to cut the 16" trunk water main and insert the 16" x 12" tees and 16" valves on a time and materials basis. (2) The profile of the deep sanitary sewer for Kittredge Crossing Subdivision was not determined until after the trunk water line construction had begun. The 16" trunk water main had to be installed three feet deeper than planned to avoid a conflict with the sanitary sewer. (3) The use of the 8.5' -bury hydrant was less expensive than paying $ 348 for a hydrant extension. (4,5&6) The contractor for the lift station advised us that his excavation will extend approximately 40 feet from the wet well. The 20 -foot sections of 24" DIP pipe would provide better joint restraint over the wet well backfill material than the 24" RCP. The manhole base had already been fabricated with a hole for the bigger outside diameter of the 24" RCP. To maintain a watertight connection for the smaller outside diameter 24"DIP, a new base was necessary. I appreciate the response of the Mayor on the night of the hearing. Before I can accept an offer, there are some questions that, in fairness, should be addressed. First, what was the basis for the assessment? Our property is not commercial as indicated in the assessment notice. It is a rural residential parcel and should be assessed as such. What is the assessment for our parcel as residential? Secondly, why is our property treated differently than our neighbors? We are a rural residential parcel subject to building restrictions. Based on the current guidelines, I believe we can only build one home on the parcel. As such, our parcel is no different than the neighboring parcels which were assessed around $6,000. What is the justification for the difference in treatment? Thirdly, how did you determine the benefit we are receiving from this project? Being acquainted with this process, I know that we can not be assessed more than the benefit the project brings to our property. Since we have only one building lot, this project will not raise the value of that lot any more than it will our neighbor's lots. As proposed, this is quite an expense which we can not bear without corresponding value. Fourthly, did the City pay us less for the land taken for the road than the value being used to support the assessment? The City took some of our land for the road. It appears that you valued the land taken for the road differently and less than our land for assessment purposes. Please explain. Finally, I ask that you consider that the golf course has lost a substantial amount of business due to the road construction project. Our portion of the road has been torn up longer than any other part of the road and many patrons simply could not get to us during the construction. The project could have been planned so that access to our property on a paved road could have been maintained longer than it was. I can share with you the loss of revenue we have had this summer which shows this project has been a detriment to us and not a benefit. I would like to resolve this amongst us, and so I appreciate the response to date. However, these questions need to be answered so I can really assess the situation. If you would rather resolve this quickly, we are willing to pay the $6,000 assessment that our residential neighbors are paying. I wanted to make Council aware of the upcoming meeting in case they wanted to send a written statement of the City of Otsego's position on the proposed bridge. Corridor and River Crossing Study Public Scoping Meeting - Open House Wednesday, October 22, 2003 Time: 5:00-7:30 PM Location: Dayton Senior Center Address: 18461 Dayton Street, Dayton Format: Open House -style meeting The Public Scoping Meeting is a great opportunity to learn more and submit your official comments on a possible new Mississippi River crossing and north -south highway corridor, as studied in the Northwest Metro Corridor and River Crossing Scoping Document and Draft Scoping Decision Document. The open house format allows attendees to participate at their convenience during the meeting hours. Staff from Mn/DOT, Anoka County, Hennepin County, and the consultant project team will be available to answer questions, receive comments, and provide information. Why are highway improvements needed in the study area? Tremendous population growth and increasing congestion and delays—especially at Mississippi River crossings—are key reasons for this study. Improving existing highways is a top priority for Mn/DOT. This commitment is shown by several current or recently completed Mn/DOT studies on highways in the northwest metro area (Interstate 94, and Highways 10, 101, and 169). At the same time, it is also important to plan for a potential new north -south highway now—before the opportunity to is lost. Planning for such an improvement today can help communities create a long-term growth/development vision. Studies of the existing highways indicate that a new highway corridor would: Add capacity for expected future traffic, Provide a more efficient transportation network in the northwest metro area by developing a system of appropriately spaced highways, and Create new opportunities for transit and other multimodal transportation options. What does the Scoping Decision mean? The work completed to -date clearly demonstrates a need for more highway capacity. The "Scoping Decision" helps to guide further planning by identifying a just few possible new highway routes. Scoping is one of many steps needed prior to any construction. Another major step to be completed is the preparation of an Environmental Impact Statement (EIS) to evaluate potential social, economic, and environmental impacts in detail. At this time, Mn/DOT has no schedule to start an EIS, and the timeframe for any construction is at least 10 to 15 years in the future. Still, the Scoping Decision is an important step toward identifying and preserving a corridor. Public comments will be considered before a Scoping Decision is finalized and any schedule for an EIS could be determined. What are the next steps? The public comment period for this study will end on October 29, 2003. Following the comment period, a Final Scoping Decision Document will be prepared, which typically serves as the basis for determining which alternative(s) will be analyzed in detail in an EIS. However, as mentioned above, Mn/DOT does not have immediate plans to begin work on an EIS and any construction would not happen for many years. How can I provide input? To provide an'official comment, you must give your name and address. The official comment period ends on Wednesday. October 29 2003.
