A public hearing was also held because a minor Zoning Map amendment is necessary to allow attachment of additional land to the subject site for the proposed expansion. The only public comments were received in a letter from Randy and Deborah Carron (tenants of the existing building) who were concerned about on site circulation. After reviewing their comments, a slight adjustment to the drive aisle at the south end of the building is necessary. The applicant indicated that they would work with City staff on this and the other issues raised in the Planning Report. The Planning Commission had no further discussion. After closing the public hearing, the Planning Commission voted 7-0 in separate motions to recommend approval of the applications. Findings consistent with their recommendations are attached for consideration at the City Council meeting on 13 January 2003 at 6:30 PM. Decision 1 - Zoning Map Amendment A. Motion to approve a Zoning Map amendment for that property to be added to the F&F Foodmart site rezoning it from R-3 District to B-3 District. B. The applicant is requesting the property be rezoned to B-3, General Business District to allow for an administrative subdivision to attach it to property already zoned B-3 District for the purpose of expanding an existing commercial building. D. The Planning Commission and City Council must take into consideration the possible effects of the amendment with theirjudgement based upon (but not limited to) the criteria outlined in Section 20-3- 2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. Comment: The Comprehensive Plan encourages in-place expansion of existing commercial uses, which the rezoning will accommodate. The expansion of the commercial site is of such a limited scale so as to remain consistent with the boundary between the commercial and low density residential uses identified on the land use plan. 2. The proposed use's compatibility with present and future land uses of the area. Comment: The pond on the abutting property to the south ensures that the desired separation of commercial and residential use occurs and that the rezoning will not negatively impact land use compatibility in the area. 3. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). 1 Comment: The use of both parcels will conform to applicable requirements of the Zoning Ordinance. 4. The proposed use's effect upon the area in which it is proposed. Comment: The proposed rezoning will have the effect of expanding commercial location opportunities within the City of Otsego which is a primary goal of the Comprehensive Plan. 5. The proposed use's impact upon property values of the area in which it is proposed. Comment. Although no study has been completed, the proposed use is not anticipated to negatively impact area property values. 6. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Comment. The proposed use will generate additional traffic that will be within the capacity of CSAH 42, which is the primary access to the subject site. 7. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Comment: The proposed use is not anticipated to have a negative impact to the City's service capacity. E. The applicant was in attendance and indicated only that there may be some minor adjustment to the area of the two outlots shown on the plat. Otherwise, they were comfortable with the recommendations of City Staff. City Staff emphasized that construction of the west waste water treatment plant and subdivision of the two other outlots will be subject to further public hearings. The meeting was well attended by the public, but only two residents spoke. Both of the residents were concerned about the impacts of development to existing flooding issues and Otsego Creek. City staff responded that development of the area would be addressed by a Stormwater Management Plan prepared by the City Engineer. At a minimum, new development cannot increase flooding off of the site. However, it is expected that new development will actually improve area drainage as Otsego Creek is cleared with acquisition of easements and stormwater impact fees to complete the work. After closing the public hearing, the Planning Commission had no additional comments. The Planning Commission voted 7-0 to recommend approval of the preliminary/final plat and rezoning of Lot 1/Block 1 for future development of the City's west waste water treatment plant as outlined below. Findings supporting the Planning Commission's recommendation are attached for consideration as part of the City Council meeting agenda for 13 January 2003 at 6:30 PM. The proposed use is an essential service necessary to allow for development of the land uses guided by the Comprehensive Plan. The selected site was chosen based the functional needs of the waste water treatment plant and its relative isolation from existing development in the area. New development of the land uses surrounding the waste water treatment plant will need to consider its location, but no significant impacts are anticipated based on the type of facility planned. Measures taken in the design of the facility to ensure compatibility with surrounding land uses will be more fully explored during the required CUP process. 3. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Finding: The use will conform to all applicable performance standards, which will be subject to review as part of a subsequent CUP process. 4. The proposed use's effect upon the area in which it is proposed. Finding. The proposed use is anticipated to have a positive effect on the area in that it is essential to allow for development of the urban land uses guided by the Comprehensive Plan. 5. The proposed use's impact upon property values of the area in which it is proposed. Finding. Although no study has been completed, the proposed use is not anticipated to negatively impact area property values. 6. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Finding. The proposed use is not anticipated to generate significant additional traffic. 7. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Finding. The amendment allows for such fences to be constructed to the front line of the principal building, whereas the existing performance standard limits the fence to the rear line of the dwelling. The Planning Commission was directed by the City Council to review this issue in response for comments received by a resident. The Planning Commission's finding was that such fences could be constructed to the front line of the principal building without impairing visual openspace or traffic visibility. Allowing construction of the fences also has the benefit of improving property security and screening vehicle storage, which often occurs along side the garage. No comments were received from the public. After closing the public hearing, the Planning Commission voted 7-0 to recommend approval of the Zoning Ordinance amendment attached hereto. A. Motion to approve a Zoning Ordinance amendment in the form attached as Exhibit B based on a finding that the change will not negatively impact traffic visibility or visual open space along major roadways and at intersections. The City Council of the City of Otsego hereby ordains: Section 1. Section 20-16-645 (Fences) of the Zoning Ordinance is hereby amended to read as follows: 5. Required Front Yards and Side Yards of Corner Lots: a. Fences extending across required front yards or a required side yard that abuts a street on a corner lot shall not exceed forty-eight (48) inches in height and shall be at least seventy- five (75) percent open space for the passage of air and light, except as provided for by Section 20-16-6.J.5.b of this Chapter. b. A fence with a height greater than forty-eight (48) inches and/or less than seventy-five (75) percent open space may be constructed within the required rear yards and side yard of a corner lot abutting collector or arterial street by administrative permit, provided that: 1. The fence does not exceed six (6) feet in height. 2. The fence is setback ten (10) feet from the lot line abutting a collector or arterial street right-of-way. 3. For interior lots, a gate or other opening is to be provided in the fence to allow for maintenance of the street side boulevard. 4. The fence along a side lot line abutting a collector or arterial street right-of-way shall not extend into a required front yard and be no closer to the front lot line than a point intersecting the front line of the principal building. 5. On lots where no bufferyard has been established pursuant to Section 20-16-7. D of this Chapter, the yard on the street side of the fence shall be grass and landscaped with plant materials that will grow to the height of the fence, subject to the following standards: (a) Plant material centers shall not be located closer than three (3) feet from the fence line or property line, and shall not conflict with public plantings, sidewalks, trails, etc. (b) Deciduous shrubs shall not be planted more than four (4) feet on center, and/or evergreen shrubs shall not be planted more than three (3) feet on center. (c) Deciduous trees shall be planted not more than forty (40) feet apart. Evergreen trees shall be planted not more than fifteen (15) feet apart. C. Construction would like to make a formal request for Sanitary service for Riverwood Conference Center, Timothy's Restaurant, Vintage Golf Course and the proposed Championship Golf course Club House, Restaurant, single and multi Family development. Riverwood and Timothy's currently has 11,600sq. ft of banquet facility and 59 guest rooms with an immediate need of 9754 gallons per day. In additon, Riverwood is looking to possibly expand in the near future 8100 sq. ft of additional banquet facilities and reconfigure the existing facility to accommodate 4 additional guest rooms with an approximate need of 1206 gallons per day. This would all be considered commercial use. Vintage Golf Course and the future Bed and Breakfast as well as the new Championship golf Course/Restaurant will have a need of approximately 4384 gallons per day for commercial use. The single and multi family development surrounding the Championship Golf Course has been approved for 157 lots and will have a need of approximately 44936 gallons per day. This type of use of sanitary service would ensure health and safety for the existing residence and the public, without any expense to the City for any right of way, sewer main, lift station or any other expense for this service to be connected. This would also insure that in the future any potential ground water contamination of Island View Estates could be resolved with minimal cost to the residence or the City by supplying a gravity line to their border. The Cooperation from this many different entities is where the strength lies to make this a viable project which the city will see immediate and future benefits from the commercial uses and the relatively small number of high end homes. The sanitary sewer capacity is to be used the Otsego Meadows Golf Course development, Vintage Golf Course, and Riverwood Conference center. Exhibits: A. Area Map ANALYSIS Requested Capacity. The table below outlines the requested sanitary sewer capacity for each of the entities involved with the request, as estimated by the applicant. Use Estimated GPD. RECs 1 REC/250GPD. Riverwood Conference Center 10960 gpd. 44 RECs Vintage Golf, B&B, and Otsego Meadows Golf 4384 gpd. 18 RECs Residential 44,936 gpd. 180 RECs TOTAL 60,280 gpd. 242 RECs Based on the applicant's figures, 75 percent of the requested capacity would be used for new residential development. Sixteen percent of the requested capacity is to be used for the existing uses at Riverwood Conference Center. At the time the Otsego Meadows PUD Development Stage Plan and Preliminary Plat were processed staff strongly recommended against allocating capacity outside of the designated sewer district for new development based upon anticipated demand within the sewer district, inconsistencies with the City's policies for expanding sanitary sewer service outlined in the Comprehensive Plan, and precedence issues. The Planning Commission concurred with this recommendation and the application was approved by the City Council subject to conditions including the following: 16. Sewage treatment and water service shall be provided via an on-site system subject to an agreement with the City and MPCA regulations. Water treatment shall be provided via an on-site communal water system designed to municipal standards. All utilities shall be installed at the applicant's cost. All utility plans are subject to review and approval of the City Engineer and the City Council. Riverwood Conference Center emphasizes that their existing on-site system is functioning properly and is maintained regularly. Further, the City Building Official confirms that there have been no septic system failures at Riverwood Conference Center that the City is aware of. The need for sanitary sewer is related more to expansion plans and the long- term viability of the existing on-site septic system. Provision of sanitary sewer service to prevent environmental damage remains one of the primary reasons these utilities have been constructed, as does economic expansion. City staff would support extension of sanitary sewer service to Riverwood Conference Center based on environmental concerns and economic development provided that the extension of service is undertaken in such a manner as to remain consistent with the City's established plans and policies. Anticipated Demand. The City has received approval from the MPCA for a 600,000 gpd. wastewater treatment plant. Based upon the Comprehensive Plan policy that 30 percent of the available capacity be reserved for commercial and industrial uses, 420,000 gpd. or 1,680 RECs. are available for residential uses. The 600,000 gallon per day capacity of the Phase 1 west wastewater treatment plant can serve approximately 60 percent of the land area within the designated sewer district. The Comprehensive Plan update and facilities plan for the west sanitary sewer service district was based on an anticipated a rate of growth of 97 dwellings per year. City Staff has been meeting with developers with land interests in the west sanitary sewer service district. Based on these meetings, City Staff is highly confident that the residential development in the west sanitary sewer service district will greatly exceed projected growth. As shown above, the City can expect preliminary plat applications within the next several months for 2,594 dwellings (equal to 2,594 RECs). This number exceeds available sewer capacity for residential uses within the first phase west sewer plant by 914 RECs (and does not include the full number of residential units within the Farr project west of CSAH 19). All of these units will obviously be phased in, but we would predict a maximum five year -build out based on the developers involved. There is an additional 560 acres east of CSAH 19 that the City has not received information about potential development. The City does not have adequate capacity with the first phase of the treatment plant to fully serve the anticipated projects within the sewer district, much less all of the residential areas within the sewer district, or lands outside of it. The issue of potential limits on sewer capacity has been one of the primary issues raised by the developers working on projects within the sanitary sewer service district. Allocating sanitary sewer for projects outside of the designated district absent an immediate need or lack of demand within the initial district compromises the Comprehensive Plan as a reliable guide as to the City's future for landowners and developers. Comprehensive Plan. The Comprehensive Plan establishes a concept for how the City will develop overtime, which includes designation of the two sanitary sewer service districts, future expansion areas, and areas likely to be permanent rural areas based on gravity flow limits. Landowners and developers rely on the Comprehensive Plan as the basis of their business decisions as to where growth will be allowed, the type of development to be constructed, and an indication of the facilities that will be necessary to 3 support planned development. The designated sanitary sewer districts are the areas to where the City intends to make sanitary sewer service districts immediately available. To protect its financial investments, the City only allocates sanitary sewer capacity on a "first come first serve" basis to those subdivisions that have final plated and entered into development contracts with provisions for payment to receive service. As discussed when the east sanitary sewer district was first implemented, these policies would allow for the City to expand the district boundaries if the rate of development fell below anticipated levels and potentially compromised funding obligations. Expansion of the district boundaries under such circumstances would still be subject to the policies of the Comprehensive Plan: 11. Expansion of the sanitary sewer service district boundaries shall only be permitted when all of the following have been satisfactorily met: a. Land to be included in the sanitary sewer service district is not "green acred" or enrolled in an agricultural preservation program. b. The land lies within one-quarter mile of the sanitary sewer service district boundary or presents environmental problems that can be alleviated by delivery of City water and sewer service. C. The land is located within the designated urban service area reserve. d. The potential sewer discharge of the land area to be included is within available capacity limits. e. The developer shall hold the City harmless should limitations on sewer hook ups be imposed. f. The developer and/or benefitting property owners assume the significant majority of improvement/service costs. g. The land does not qualify as a premature development or subdivision as regulated by the City's Subdivision Ordinance. h. Inclusion of the land in the sanitary sewer service district is necessary to achieve a five year supply and respond to a shortage of land to which service is available. Absent an immediate environmental need, the request for service outside of the 0 designated boundary is at best premature. The lands within the sanitary sewer service district should be given the first opportunity to utilize the available capacity in accordance with the direction of the Comprehensive Plan. City Staff is highly concerned about the precedence of extending sanitary sewer service beyond the designated sewer district boundaries as is contradicts the City's stated growth management policies. There would appear to be no clear distinction as to why this request should be approved to extend sewer past other developable properties also not presently within the sewer district, while not allowing connection. Related to the Land Use Plan is the goal to provide facilities and services necessary to meet the needs of new development. These facilities and services must be planned in a coordinated and economically feasible manner consistent with the pace of development. The purpose of such growth management efforts is to minimize costs and undue expenditures by encouraging full utilization of existing or new infrastructure and services. The request for allocating sanitary sewer outside of the designated district, particularly for new residential uses, compromises the infrastructure plans for supporting development: 1. Oversizing trunk sewer and water lines and lift stations are costs carried by the City and recovered through SAC and WAC fees. Without full development within the sewer district the capacity within these lines is under utilized. 2. Under utilization and reduced payment of WAC fees for the water system being constructed to accompany the sanitary sewer system. 3. The City collects road access fees from properties abutting planned collector and arterial streets. Within the west sewer district, upgrading of MacIver Avenue and 70th Street are of major importance to the local and regional transportation. The City needs to have sewer capacity for lands adjacent to these roadways to develop in order to collect these impact fees and also utilize the roadway when constructed. 4. Development within the district is necessary to provide land or cash fees in lieu of land for development of neighborhood parks which have been planned and funded based on sub -district designations. 5. Projects within the sewer district contribute stormwater impact fees necessary for improvements within the Otsego Creek Watershed. The Pointe development within the east sewer district was approved as somewhat of a leap -frog project. However clear distinctions may be drawn between the two situations. First, the Pulte Homes, Inc. property was within the designated sewer service. Second, the developer extended trunk sewer lines of sufficient size to serve The Pointe and abutting properties (also within the east sewer district) at their own expense and continue to carry these costs. Any extension of sewer beyond the current boundaries of the sewer 5 district, if allowed, should likewise be done in such a manner as to provide future public benefit beyond the subject properties. Processing. If the City Council is inclined to allow extension of sanitary sewer capacity to the subject properties and number of formal applications and approvals are required: 1. Comprehensive Plan amendment to include the subject properties within a sanitary sewer service district. 2. Amendment of the PUD Development Plan for Otsego Meadows Golf related to use of public sewer capacity. 3. A PUD amendment for Riverwood Conference Center for expansion of the facility and extension of sanitary sewer capacity. 4. Execution of a development contract including provisions for payment for sanitary sewer service capacity and a phased schedule for residential and commercial use allocation. Of these steps, execution of a development contract with provisions for payment of the capacity and allocation for commercial and residential uses is the most critical. The partnership of residential and commercial user is being used to improve the financial basis for extending sewer. The City would seek to ensure that the commercial portion is fully realized before making full allocation for the residential uses. CONCLUSION The decision as to whether the subject properties should be extended sanitary sewer service from the planned west waste water treatment plant is ultimately a policy issue for the City Council to resolve. However, our interpretation of the request is that is contrary to the provisions of the Comprehensive Plan for the City's development concept and managed expansion of urban development. Inconsistency with the established policies of the Comprehensive Plan or at a minimum lacking an immediate need to correct environmental issues, the proposal weakens the Comprehensive Plan as a policy document used by the City and landowners or developers by establishing a precedence for extending service when the criteria for such improvements are not met. The proposal also may negatively impact the financial basis of the City's planning efforts or result in under utilization of various facilities. As practical issue, the City simply does not have surplus capacity that will not be utilized within the sewer district to provide. Options the City Council may consider at this time include: A. Motion to direct the applicant to make formal application for Comprehensive Plan amendment and PUD approvals for extension sanitary sewer capacity. B. Motion deny the request based upon a finding that the request is inconsistent with the policies of the Comprehensive Plan. C. Motion to table the issue. PC. During earlier discussions by City Council and staff there was some talk of having city services (water and sewer) available to developers in the fall of 2003. Although the Wastewater Treatment Facility will not be completed until 2004 (as outlined in Mr. Ted Fields recent letter to council) it is proposed that during the initial low flow period (<10,000 gpd), the wastewater would be hauled by trucks from lift station(s) in the west to the existing East Otsego plant for treatment. Initial wastewater flows in late 2003 and early 2004 would most likely be insufficient to operate the facility with any efficiency or within MPCA Standards so trucking of wastewater is required regardless if the west facility is operational or not. The water tower will be the most difficult trunk facility to complete in time to supply city services to developers. I have spoken to contractors who bid water towers in the region and they say a water tower can not realistically be completed by the fall of 2003. A July 2004 completion date is a realistic time line. A recent water tower bid in southern Minnesota had alternate completion dates of either October 15, 2003 or July 1, 2004. The cost difference was $60,000 or a 8.4% surcharge (see bid tabulation attachment). If the City is committed to supplying Developers water by fall of 2003, the options are to either allow Developers to install temporary wells w/individual pneumatic tanks in homes until city water service arrives with the extra costs to be born by the Developer or install a temporary large pneumatic tank on the municipal well in the pumphouse much as River Pointe has. Estimated additional cost is $50,000. All other trunk facilities needed for city services can be completed in a single construction season. A sketch of which trunk facilities required to be installed is attached. Partnership, Darrel Farr- Pleasant Creek Farms Development- Developer's Agreement and Land Acquisition Dear Gary: Enclosed please fins a draft Developer's Agreement for Pleasant Creek Farms, the plat recently submitted to the city of Otsego by your client. The land was platted into two outlots and one lot. The lot was established for purposes of conveyance to the City for construction of the wastewater treatment facility which will service the Plat and surrounding properties. It was also platted to facilitate conveyance of the east Outlot to another Developer. The City of Otsego has just received its NPDES permit for the wastewater treatment facility. The City has already ordered plans and specifications for the facility. If everything proceeds smoothly the City should be able to commence construction this spring or summer. MPCA will not allow any work to proceed on the plant until we can show good title to the property. Please review the proposed Developer's Agreement and let me know if you have any comments, concerns or questions. The agreement provided is a shortened version of the City's standard development agreement. The City is also ready to commence construction on its water system in order to service that area of the City which includes your client's properties. The proposed location of the City water tower is located upon another parcel of your client's property, lying west of Letter to Attorney Eidson January 9, 2003 Page 2 Wright County Road 19. The proposed location is on a parcel of property proposed for future development by your client as Kittredge Crossing. Assurance that the City can obtain this small parcel is crucial for the engineer to commence plans and specifications for the water system. We will need clarification from your client as to whether he intends to donate this one acre site to the City or is expecting compensation for the site. This issue will factor into the Engineer's cost analysis for the overall water system and computation of area fees. The engineer also indicates that the City will need to acquire from your client additional right of way along Kadler Avenue for construction of the water system. I have enclosed for your reference a map and general description of the water tower site as well as the additional road and utility easements required. The parcel containing the water tower site has not yet been platted. Finally, if there is a value for the land conveyed for tax purposes that you want the City to acknowledge in its resolution receiving the donated land, please let me know. As I indicated over the phone, the Otsego City Council will be reviewing the draft Developer's Agreement and the final plat on Monday. Partnership, a Minnesota General Partnership ("Developer"). 1. Request for Plat Approval. The Developer has requested that the City approve a plat entitled PLEASANT CREEK FARMS (referred to in this Agreement as "the Plat") and legally described as follows: See attached Exhibit A. The Plat contains one lot and two outlots. The subject site is currently zoned A-1 except the Lot 1, Block 1 has been rezoned to INS. The remainder of the subject parcel is guided for medium- high density residential uses and low density residential uses. 2. Conditions of Plat Approval. The City hereby approves the plat on condition that the Developer enter into this Agreement, furnish any security required by it, convey to City Lot 1, Block 1, and record the Plat with the Wright County Recorder or Registrar of Titles within one hundred (100) days after the City Council approves the final plat. 3. Right to Proceed. Within the land to be platted, Developer may not grade or otherwise disturb the earth, remove trees, construct sewer lines, storm sewers, water lines, streets, utilities, public or private improvements, or any buildings until all the following conditions have been satisfied: no construction activity will commence until requested re -zonings have been granted and final plats have been approved for OUT LOT A and OUT LOT C. Notwithstanding the above, City may, at its discretion allow limited preliminary site grading or other work to proceed prior to granting final plat approval. 4. Further Agreements Required. Any further development, beyond that permitted by the current zoning of Outlots A and C, is contingent upon approval of rezoning of the parcel and approval of a final plat. A Developer's Agreement, security, payment of applicable fees and escrow will be required prior to development of either Outlot. 5. Sanitary Sewer Service Allocation. Approval of this Final Plat does not guarantee sanitary sewer service to the Plat. Rezoning and approval of final plats (and meeting all required conditions of approval) on both outlots will trigger allocation of sanitary sewer service to the area final platted. 6. Conveyance of Lot 1, Block 1 to City. Lot 1, Block 1 has been identified as the site for a wastewater treatment facility for which the City has received a permit. Developer shall convey fee title by warranty deed Lot 1, Block 1 to the City for one dollar and other good and valuable consideration. Developer acknowledges that the dedication serves as an inducement to the City to construct a wastewater treatment facility on the lot conveyed, which may serve to benefit and increase the value of nearby properties in which Developer has an ownership or other interest. Further, Developer acknowledges that conveyance of the Lot described is made solely for the possibility of increases in land value and that receipt of this donation by the City in no way assures approval of any subsequent proposed development by City, nor does it assure any allocation of sanitary sewer capacity.. 7. Right of Entry. Upon execution of this document, Developer grants to the City, it agents, employees, officers and contractors an irrevocable right of entry to enter the plat to perform any and all work and inspections necessary or deemed appropriate by the City in order to construct the wastewater treatment facility, water system, storm drainage system or other utilities. 8. Fees Reserved. All applicable fees imposed by the City upon a Final Plat are specifically reserved to subsequent Agreements. Said fees include, but are not limited to Sewer Availability Charges, Water Availability Charges, Park and Trail Dedication Fees, Storm Water Impact Fees, Trunk Sewer and Water Fees, permit fees and City Administrative fees and expenses. 9. Responsibility for Costs. 2 A. Except as otherwise specified herein, Developer shall pay all costs incurred by them or the City in conjunction with review of the Plat, drafting of this Agreement, including legal, planning, engineering and administrative costs. B. Developer shall reimburse the City for any costs incurred in the enforcement of this Agreement, including engineering fees, attorney's fees, an costs and disbursements. C. Developer shall pay in full all bills submitted to it by the City for obligations incurred under this Agreement within thirty (30) days after receipt. 10. Miscellaneous. A. Third parties shall have no recourse against the City under this Agreement. B. If any portion, section, subsection, sentence, clause, paragraph or phrase of this Agreement is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Agreement. C. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Agreement. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Agreement shall be a waiver or release. D. This Agreement shall run with the land, shall be recorded against title to the property, and shall be binding on all parties having any right, title or interest s in the Plat or any portion thereof E. Each right, power or remedy herein conferred upon the City is cumulative and in addition to every other right, power or remedy, express or implied, now or hereafter arising, available to City, at law or in equity, or under any other agreement, and each and every right, power and remedy herein set forth or otherwise so existing may be exercised from time to time as often and in such order as may be deemed expedient by the City and shall not be a waiver of the right to exercise at any time thereafter any other right, power or remedy. 11. Those applications are due Thursday, January 16, 2003. What follows is an update on the members of each commission. PARK & RECREATION COMMISSION The terms of Chair Mike Day and Commissioner Tom Constant were up at the end of 2002. They have both stated to me that they have resigned effective the end of 2002. The remaining members are Tom Baillargeon, Jeff Bartheld, Rose Cassady, Jim Gaikowski, Terry Long, and Jessica Stockamp. I recommend that letters of thanks be sent to Mike Day and Tom Constant. Tom Baillargeon has only attended one meeting since February, 2001 and I would recommend he be removed from the commission. That would leave room for two more members and one alternate. As of this moment we have received one application for this commission. PLANNING COMMISSION The term of Christian Mbanefo was up at the end of 2002. Christian has asked to be reappointed. The current members are Richard Nichols, Steve Schuck, Carl Swenson, Jim Kolles, Christian Mbanefo, Ken Fry, Dave Thompson, and Alternate Pam Black. That means there is room for one additional alternate if Council wants a second alternate as they have occasionally in the past.
