1. Mavor Fournier call the Meeting and Public Hearing to order
Mayor Fournier called the meeting and Public Hearing to order at 7:05 PM.
Roll Call and introductions: Mayor Larry Foumier; Councilmembers: Virginia
Wendel, Vern. Heidner, Jerry Struthers and Dan Scharber.
Staff: Mike Robertson, City Administrator; Judy Hudson, City Clerk; Ron Wagner, City
Engineer; Shane Nelson, Design Engineer; Jeff Elliott, Design Engineer; Andrew
MacArthur, City Attorney; David Wendorf, City Attorney.
Mayor Fournier led in the Pledge of Allegiance.
2. Present the Project Design.
A. Ron Wagner, City Engineer
Ron Wagner presented a general introduction to the project.
B. Jeff Elliott Design Engineer.
Jeff Elliott went over existing conditions and over all design of 85`h Street and Page
Avenue. Mr. Elliott also explained the construction; materials, design and bike trail for
the west half of 85`h Street project.
C. Shane Nelson Design Engineer.
Shane Nelson went over the Stormwater system and design of the east half of 85`h Street
and also Page Avenue from 85`h Street to CSAH 39.
City Clerk Judy Hudson attested that all proper noticing and publishing was done.
3. Andrew MacArthur, City Attorney discuss assessments easements
Mr. MacArthur explained the process for assessments and easements, stressing that only
an estimate of assessment is given at this hearing. He explained that the issue at this
hearing is for the City Council to decide to proceed or not to proceed with the project.
Mr. MacArthur also explained that if the project were done, the City would hold another
hearing, which will be noticed with the amount of the assessment. At that hearing,
property owners will have the right to appeal the assessment. Mr. MacArthur stated that
only approximately 7% of the total project cost would be assessed. He also explained the
process of acquisition of easements for the project and these costs are project costs and
can affect the assessment amounts. Mr. MacArthur said the property owners that the City
needs easements from will be contacted.

4. Ron Wagner City Engineer presents Feasibility Report
Ron Wagner explained the estimated construction costs on a typical urban roadway
section. He also showed the estimated assessments and how they are calculated
according to the Otsego Assessment Ordinance. Mr. Wagner also went over the proposed
project schedule. Mr. Wagner noted that the proposed improvement was feasible.
5. Individual lot discussion (informal).
A. Engineers to discuss individual property questions with residents
(One on one basis using plans or poster board assembled around the
room).
At 7:56 PM Mayor Fournier called for a break for the property owners to discuss their lot
with staff. Mayor Fournier called the hearing back to order at 8:28 PM.
6. Open the Public Hearing for comments
Mayor Fournier opened the Hearing for Public Comments at 8:29 PM.
Sheila Louisiana, 8773 Page Avenue. Mrs. Louisiana read a statement, which stated she
doesn't support the project. She requested the Council to scale down the project as she
feels the proposed road and shoulders are too wide. Mrs. Louisiana questioned the
benefit of the Page Avenue Improvement to her as she feels the lost of landscaping will
decrease the value of her home.
Mr. Wagner explained the design requirements for collector streets. Mr. Wagner
explained the benefit to the property owners would be getting rid of the ditches separating
the bike path from the street, and that curb and gutter usually increases the value of a
home.
Jeff Bartheld, 14018 85`h Street NE. Mr. Bartheld stated support for the project as 85`h
Street needs fixing and also a bike path is needed. His concern was the availability of
more than just residents getting in and off of 85a' Street as his wife has a daycare business
and her clients need to get to and from his residence.
Patrick Moonen. 8757 Page Avenue NE. His concerns were also getting in and out as his
wife also has a daycare business and the street needs to be open all day long not just
morning and afternoons. He has no objections to the project as he feels Page Avenue
needs to be done but questioned the wide shoulders and storm sewer. Mr. Moonen feels
the water will still continue to run into his property because of the elevation. Mr. Wagner
explained that a small stormsewer catch basin would be put in to deal with stormwater.
Earl Lieske, 15216 85`h Street NE. Mr. Lieske stated concern with the stormwater runoff
catch basin. He said with the construction of Page of 85`" intersection he has more water
in his yard. He is concerned with how the Stormwater pond will be maintained. Mr.
Lieske also is concern with hydro seeding and that his driveway will be ripped up again.
He also requested a water table probe be done in the spring.

Ron Wagner explained the Stormwater on the north side of 85`h Street always ran into his
yard and a catch basin was installed. If the project goes through there will be a curb
basin, the pond will be dug 1.5 feet deeper and water shouldn't stand too long with the
type of soil in this area. Also, the area where the pond is located is a drainage and utility
easement according to the Final Plat.
Richelle Kern, 8955 Page Avenue. She is concerned with the drainage pond, especially
in the spring with water standing until the frost is out, taking up too much room in her
yard and the mosquitoes. She would like to see the width of the shoulders scaled down.
Mike Louisiana, 8773 Page Avenue. Mr. Louisiana asked what the life expectancy of the
new road would be and what would happen to Page Avenue when water and sewer goes
through. Mr. Wagner said the life expectancy is 20 years. CM Heidner said the City has
no plans and no capacity to run sewer and water there.
Virginia O'Neil, 8825 Page Avenue. Ms. O'Neil requested to keep the speed limit at 30
MPH and asked for more patrol on Page Avenue. She also asked for a "Stop Ahead
Sign" to make people aware of the stop sign.
Tim Larson, 8939 Page Avenue. Mr. Larson stated the City has done a good job keeping
costs down and said that something need to be done with these roads. His major concern
was if the State withholds State Aid and the City will get stuck with the whole bill.
Mike Robertson explained he has received assurance that the MSA money is
constitutionally dedicated and it would take a major amendment to change that. He also
noted that Otsego receives very little Local Government Aid and that any reduction would
not affect this project.
Doris Lieske, 15216 85`h Street. Mrs. Lieske stated this would be the fourth time their
driveway will be torn up since 1992. They also have a driveway off of 87`h Street and are
concerned that will be washed out by water. She also asked if the project would be done
in phases.
Ron Wagner introduced his on-site project manager, Charlie Chenier, and explained the
ways the residents will be able to contact him - an on-site trailer, cell phone and a
comment box.
Ron Wagner explained the project would probably be done in different sections.
7. Close the Public Hearing.
Hearing no further comments, Mayor Fournier closed the public hearing at 9:15 PM.

CM Heidner stated he would like to see the 10 -foot shoulders scaled down to a 6 -foot
width and to reduce the separation of the bike path from the street down to 2 feet for Page
Avenue. The Council directed the City Engineer to give them an alternate design for the
January 27, 2003 City Council Meeting for Page Avenue.
CM Wendel motioned to adjourn. Seconded by CNI Scharber. All in favor.
