03-24-03 CCITE" 3_2_ CITY OF OTSEGO MINUTES OF MARCH 13, 2003 6:OOPM COUNCIL -PARK & RECREATION WORKSHOP REVIEW OF PARK BIDS Roll Call: Mayor Larry Fournier, Councilmembers Jerry Struthers, Vern Heidner, Dan Scharber, and Virginia Wendel were present. Park & Recreation Commission: Chair Jeff Bartheld, Commissioners Terry Long and Mark Thorsted. City Staff: City Administrator Michael Robertson, City Engineer Ron Wagner, and City Planner Dan Licht. Review of Park Bids Mayor Fournier welcomed everyone to the workshop. Ellen Stewart and Tom Wittlock of Damon Farber Associates were present to help review the bids. Administrator Robertson noted that the City had approximately $1,240,000 in Park Dedication Funds available. The low bid was $1,410,000. Robertson said that the Park & Recreation Commission had reviewed the bids and had two recommendations to the City Council. A) The Commission had cut approximately $250,000 from the bids. They would like the Council to go ahead with all three parks, plus add irrigation to the ball fields. If the costs run over, the Commission would like the City to borrow ahead against future Park Dedication Funds. B) If the Council does not agree with Option A, The Commission would like the Council to construct Prairie Park and School Knoll Park, after still cutting $250,000, plus add irrigation to the ball fields. Then the Council could wait for a year or two until there were enough Park Dedication Funds to build Lily Pond Park. Ellen Stewart reviewed all three park plans. Councilmember Scharber suggested that the City should have four ball fields instead of three because Rogers had difficulty renting three fields for tournaments. After discussion Council agreed and said they would settle on a location for a soccer field later. There was discussion of whether the western part of Prairie Park should be part of the park or whether it should be reserved for future City facilities such as a Public Works building. Councilmember Heidner asked that the purchase prices for Prairie Park and School Knoll Park be calculated. He thought Park Dedication funds should be used to reimburse the City for the purchases because they were paid for from taxpayer funds. Council and Commissioners reviewed all the line items. Ellen Stewart said that Damon Farber had selected park equipment that was of sufficient quality that it would not be expensive to maintain. Tom Wittlock said that Damon, Farber estimated that construction inspection and lighting would add another $100,000 to the costs. They will review all the deductions made this evening and send revised costs to the City Council for a decision at the March 24, 2003 meeting. Sewer & water Issues West WWTP Plant Phasing Schedule - Council discussed with Bonestroo establishing a phasing size to aid future design. Council was in consensus that sizing the tanks for 600,000 GPD expansions made sense. Ted Field stated that he had reviewed the site and there is more than enough land at 22 acres to treat the 5 million GPD necessary to handle all development on the west side of Otsego. East WWTP Site Recruirements - Ted Field indicated that he would review the East Otsego WWTP site to see how much more land would be needed to handle sewage treatment for the projected build out of the east side. West WWTP Lift Station - Ron Wagner reviewed the reasons why the location of one of the lift stations has been changed. The developer was not present at the meeting. There was also no comment from the public. Council Member Heidner pointed out that although paragraph 6 b. of the EAW states that the sanitary sewer will be served by an on-site septic system owned and maintained by the golf course, the City Council made it a condition of preliminary plat approval that the ownership and operation of the system is subject to an agreement with the City. Staff's comment is that the EAW is an information document and the conditions of the preliminary plat approval govern and supersede it. After closing the public hearing, the Planning Commission voted 6-0 to recommend a motion that Otsego Meadows does not have potential for significant environmental effects and that preparation of an EIS is not to be required. Findings consistent with the Planning Commission's action are attached. These applications are to be considered at the City Council meeting on 24 March 2003 at 6:30 PM. City staff will provide an update at the City Council meeting as to whether any comments were received during the 30 - day comment period. None have been received to date. A. CITY COUNCIL MEETING: 24 March 2003 FINDINGS: Based upon review of the application, the recommendation of the Planning Commission, and evidence received, the City Council of the City of Otsego now makes the following findings of fact: A. The legal description of the subject site is attached as Exhibit A. B. The project lies within the Rural Residential Preserve and guided for rural residential land uses by the Otsego Comprehensive Plan, as amended. C. The project is zoned PUD, Planned Unit Development District to allow for development of an 18 - hole golf course and 157 residential units on approximately 245 acres. D. The project requires preparation of a mandatory EAW pursuant to Minnesota Rules 4410.4300 Subp. 36.A. E. The EAW was approved by the Otsego Zoning Administrator for distribution was published in the Environmental Quality Board Monitor on 17 February 2003. The 30 day comment period ends 19 March 2003. F. Section 20-38-3.D.4 of the Zoning Ordinance required the City Council to base its decision on the need for an Environmental Impact Statement (EIS) and the proposed scope of an EIS on the information gathered during the EAW process and on the comments received on the EAW. Pursuant to Minnesota Rules 4410.1700, in deciding whether a project has the potential for significant environmental effects, the following factors shall be considered: a. Type, extent and reversibility of environmental effects. b. Cumulative potential effects of related or anticipated future projects. C. The extent to which the environmental effects are subject to mitigation by ongoing public regulatory authority. d. The extent to which environmental effects can be anticipated and controlled as a result of other environmental studies undertaken by public agencies or the project proposer, or of EISs previously prepared on similar projects. G. The EAW dated 2/99 prepared by Manley Land Development, Inc. is incorporated herein. H. The planning reports dated 30 May 2002 and 13 March 2003 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. I. The engineering review dated 6 June 2002 prepared by the City Engineer, Hakanson Anderson Associates, Inc., is incorporated herein. J. The Otsego Planning Commission conducted a public hearing at their regular meeting on 17 March 2003 to consider the application, preceded by published and mailed notice. Upon review of the application and evidence received, the Otsego Planning Commission closed the public hearing and recommended by a 6-0 vote that the City Council make a finding that the request does not have the potential for significant environmental effects and preparation of an EIS is not necessary based on the aforementioned findings. K. No comments regarding the EAW were received during the 30 -day comment period ending 19 March 2003. DECISION: Based on the foregoing information and applicable ordinances, the proposed Otsego Meadows does not have potential for significant environmental effects and that preparation of an EIS is not to be required based on a review of the submitted EAW and evidence received, subject to the following condition: 1. The project shall proceed in conformance with the preliminary plat and applicable stipulations approved 8 July 2002 by the City Council. Access to Mr. and Mrs. Beaudry's home site is provided by easement via a driveway within a 66 foot by 1,200 foot parcel owned by Mr. Lloyd Beaudry. The driveway parcel also provides access to at least two other parcels without direct access to a public street. A condition of the CUP was that Mr. and Mrs. Beaudry would surrender their easement rights fee free if the City were to acquire this parcel for roadway or utility purposes. With the approval of the preliminary plat of Arbor Creek, Mr. and Mrs. Beaudry are requesting that this requirement be waived. The Arbor Creek preliminary plat provides a street stub to the west end of the driveway parcels for a future extension. However, the location of street intersections to MacIver Avenue from the Arbor Creek Plat and the 500 foot intersection requirement means that the driveway easement cannot be used as a public street access to MacIver Avenue. The public street access will occur to the south within the Martin property being developed by JMS/Insignia to align with 77th Street on the east side of MacIver Avenue. A connection to MacIver Avenue at the east end of the driveway parcel is also difficult because of the proximity of Otsego Creek. As such, the City will not need to acquire this parcel for street purposes. The Sanitary Sewer System Plan for the west sewer service district had proposed that trunk lines would be installed within this driveway parcel in order to serve the areas east of Maciver Avenue. The approval of the Arbor Creek preliminary plat will require dedication of easements for the installation of these trunk facilities as part of their first final plat. Further, the driveway parcel is not necessary to provide lateral service to the Martin property, which will move sewer to the lift station east of MacIver Avenue. As such, the driveway parcel is not needed for utility purposes once the utility easements have been received with the final plat of Arbor Creek. The City will not likely require acquisition of the Beaudry driveway parcel for street or utility purposes because of how the development of surrounding parcels is to occur. As such, condition requiring dedication of easement rights related this parcel is no longer necessary. The City Council may waive the requirement of the CUP subject to acquisition of necessary trunk sewer easements required of the Arbor Creek Final Plat. This issue is to be discussed as part of the City Council agenda at their meeting on 24 March 2003 at 6:30 PM. A. Owners shall provide access to the Subject Property at all reasonable times to the City or its representatives for purposes of inspection or to accomplish any necessary work pursuant to Section 1(A) of this agreement. In the event that the City must perform any work pursuant to Section 1(A) of this Agreement, the City may assess the costs of such maintenance against the subject property. If any portion, section, subsection, sentence, clause, paragraph or phrase of this Contract is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Contract. C. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Contract. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Contract shall not be a deemed a waiver or release of any City rights under this agreement. D. This Contract shall run with the land and shall obligate Owners heirs, successors and assigns and may be recorded against the title to the property. 8. Violation of Agr m n Should Owners breach of any of the terms of this Contract in such a manner that the City believes merits revocation of the Conditional Use Permit granted under this agreement, the City shall give the Owners seven (7) days mailed notice of City's intent to revoke said Permit, and if such default is not cured within said seven (7) day period, the City may hold a revocation hearing at which time the City may reconsider the Permit pursuant to City ordinances and determine whether said Permit should be revoked. If Owners fail to correct said breach by the time the revocation hearing is held the City may revoke said Conditional Use Permit if it reasonably finds that said breach warrants revocation. If the Owners remedy said breach after the expiration of the seven day period but before said revocation hearing is completed the Owners shall pay all City expenses (including, but not limited to planners, engineer's, attorney's and other professional fees) related to the breach and revocation hearing. 9. Indemnity. Owners shall hold the City and its officers and employees harmless from claims made by Owners and/or third parties for damages sustained or costs incurred resulting from the granting of the Conditional Use Permit and/or development of Said Property. The Owners shall indemnify the City and its officers and employees for all costs, damages or expenses wluch the City may pay or incur in consequence of such claims, including attorney's fees. Third parties shall have no recourse against the City under this Agreement. 10. That list was not comprehensively updated. Attached you will find a more comprehensive update including actions taken by this office relative to certain described nuisances. The City Planner's office which initiates many of the violation letters has also gone through and provided an update and summary of some response to their correspondence. In various staff meetings we have tried to come up with the most effective and least expensive method of dealing with these various violations. A couple of years ago it was determined that some selected enforcement matters would be undertaken as civil or injunctive matters rather than criminal prosecutions. This decision was based, in part, on the Cities experience with criminal prosecution, which often ended up in long delays and continuances. City ordinance violations are often viewed as relatively unimportant at the District Court level. The City Council has also previously discussed the idea of dealing with most matters as non -criminal civil violations or as petty misdemeanors. Once the penalty involved only involves money, and there is not any possibility of imprisonment, many of the procedural considerations afforded for criminal convictions go away. However, the City still owes a person charged or cited who denies guilt some sort of due process. In the case of some of the larger suburbs, the City has actually created its own judicial process and where particular persons contest fines or penalties the City has created its own hearing process, Letter to Otsego City Council March 20, 2003 Page 2 in some cases using lawyers as hearing officers. Obviously, such a process is expensive and is dependent upon a volume of penalties being paid without contest. At the time it was discussed, the Council generally concluded that the City was not yet at the stage where they could consider such a procedure. Our staff discussions led us to the conclusion that we would select random cases to be pursued civilly, with an eye toward taking forward the cases that would create the best opportunity for relatively short and successful compliance. Partnership, a Minnesota General Partnership ("Developer"). 1. Request for Plat Approval. The Developer has requested that the City approve a plat entitled PLEASANT CREEK FARMS (referred to in this Agreement as "the Plat") and legally described as follows: See attached Exhibit A. The Plat contains one lot and two outlots. The subject site is currently zoned A-1 except that Lot 1, Block 1 has been rezoned to INS. The remainder of the subject parcel is guided for medium- high density residential uses and low density residential uses. 2. Conditions of Plat Approval. The City hereby approves the plat on condition that the Developer enter into this Agreement, furnish any security required by it, convey to City Lot 1, Block 1, and record the Plat with the Wright County Recorder or Registrar of Titles within one hundred (100) days after the City Council approves the final plat. 3. Right to Proceed. Within the land to be platted, Developer may not grade or otherwise disturb the earth, remove trees, construct sewer lines, storm sewers, water lines, streets, utilities, public or private improvements, or any buildings until all the following conditions have been satisfied: no construction activity will commence until requested re -zonings have been granted and final plats have been approved for OUT LOT A and OUT LOT C. Notwithstanding the above, City may, at its discretion allow limited preliminary site grading or other work to proceed prior to granting final plat approval. 4. Further Agreements Required. Any further development, beyond that permitted by the current zoning of Outlots A and C, is contingent upon approval of rezoning of the parcel and approval of a final plat. A Developer's Agreement, security, payment of applicable fees and escrow will be required prior to development of either Outlot. 5. Sanitary Sewer Service Allocation. Approval of this Final Plat does not guarantee sanitary sewer service to the Plat. Rezoning and approval of final plats (and meeting all required conditions of approval) on both outlots will trigger allocation of sanitary sewer service to the area final platted. 6. Conveyance of Lot 1, Block 1 to City. Lot 1, Block 1 has been identified as the site for a wastewater treatment facility for which the City has received a permit. Developer shall convey fee title by warranty deed Lot 1, Block 1 to the City for one dollar and other good and valuable consideration. Developer acknowledges that the dedication serves as an inducement to the City to construct a wastewater treatment facility on the lot conveyed, which may serve to benefit and increase the value of nearby properties in which Developer has an ownership or other interest. Further, Developer acknowledges that conveyance of the Lot described is made solely for the possibility of increases in land value and that receipt of this donation by the City in no way assures approval of any subsequent proposed development by City, nor does it assure any allocation of sanitary sewer capacity. The City acknowledges that the fair market value of the land conveyed is one million dollars ($1,000,000.00), based upon appraisals of the developer and sales of other properties within the general area. 7. Right of Entry. Upon execution of this document, Developer grants to the City, it agents, employees, officers and contractors an irrevocable right of entry to enter Lot 1, Block 1 to perform any and all work and inspections necessary or deemed appropriate by the City in order to construct the wastewater treatment facility, water system, storm drainage system or other utilities. 8. Fees Reserved. All applicable fees imposed by the City upon a Final Plat are specifically reserved to subsequent Agreements. Said fees include, but are not limited to Sewer Availability Charges, Water Availability Charges, Park and Trail Dedication Fees, Storm Water Impact Fees, Trunk Sewer and Water Fees, pennit fees and City Administrative fees and expenses. 2 9. Responsibility for Costs. A. Except as otherwise specified herein, Developer shall pay all costs incurred by them or the City in conjunction with review of the Plat, drafting of this Agreement, including legal, planning, engineering and administrative costs. B. Developer shall reimburse the City for any costs incurred in the enforcement of this Agreement, including engineering fees, attorney's fees, an costs and disbursements. C. Developer shall pay in full all bills submitted to it by the City for obligations incurred under this Agreement within thirty (30) days after receipt. 10. Miscellaneous. A. Third parties shall have no recourse against the City under this Agreement. B. If any portion, section, subsection, sentence, clause, paragraph or phrase of this Agreement is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Agreement. C. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Agreement. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Agreement shall be a waiver or release. D. This Agreement shall run with the land, shall be recorded against title to the property, and shall be binding on all parties having any right, title or interest s in the Plat or any portion thereof. In the event that Lot 1, Block 1 is conveyed to the City by warranty deed prior to the time of further transactions regarding the Plat, the Developer's Agreement will not be recorded. In the event that the Developer's Agreement is recorded due to transactions occurring prior to conveyance of Lot 1, Block 1 to the City, upon said conveyance City shall deliver to Developer a certification that the conditions of the Developer's Agreement have been satisfied and a release from the Developer's Agreement. E. Each right, power or remedy herein conferred upon the City is cumulative and in addition to every other right, power or remedy, express or implied, now or hereafter arising, available to City, at law or in equity, or under any other agreement, and each and every right, power and remedy herein set forth or otherwise so existing may be exercised from time to time as often and in such order as may be deemed expedient by the City and shall not be a waiver of the right to exercise at any time thereafter any other right, power or remedy. 3 11. Notices. Physical Requirements: 1. Sight: Must be able to see sufficiently to read plans, blueprints, and other technical data, and to conduct necessary on-site inspections. 2. Speech: Must be able to communicate effectively with contractors, general public, and staff. 3. Movement: Walking, standing sitting, twisting, kneeling, crawling, squatting, reaching, grasping, pulling, pushing, and grappling while conducting inspections; manipulating tools and equipment, retrieving maps and blueprints, etc. 4. Level of Exertion: Lifting of equipment and tools as necessary, exerting 20 pounds of force occasionally 5 or 10 pounds of force frequently. Mental Requirements: 1. Reading Ability: The ability to read text of considerable difficulty requiring the understanding of complex laws, rules, code, technical procedures, and specifications. 2. Writing: Writing skills are required to write reports and to correspond with permit applicants, builders, contractors, and developers. 3. Math Skills: The position requires the ability to perform intermediate level math and statistical calculations. 4. Reasoning Ability: The ability to solve complex problems using individual initiative and group process where appropriate. Minimum Employment Criteria: Minnesota Building Official certification, Minnesota Septic System Certification, experience in the building trades, municipal experience as a building inspector.
