MINUTES
1 Mayor Larry Fournier will call meeting to order,
Mayor Fournier called the meeting to order at 4: IOPM.
ROLL CALL:
Mayor Larry Fournier, Council Members Virginia Wendel, Vern Heidner, Mark
Berning. Suzanne Ackerman - Absent.
Staff: Mike Robertson, City Administrator, Elaine Beatty, City CIerk/Zoning
Administrator, Larry Koshak, City Engineer and Andy MacArthur, City Attorney
2 Review and Discussion of proposed Developers Agreement with the City- Attorney
and City Engineer,
Larry Koshak and Andy MacArthur reviewed with the Council and Staff the Memo from
Dan Licht dated February 17, 1999 and the January 20, 1999 and February 16, 1999
letters from Andy MacArthur Re: Proposed draft Developer's Agreement. (see attached
letters and Proposed Developers Agreement).
Discussion of City Development Fees
Administration Fee - For work which would be handled by Mike Robertson and Elaine
Beatty.
City Construction Administration Inspection - ( City's Administration of Construction
actuals).
Trunk Sewer and Water Access Fee (Part of the WAC/SAC for number of lots in the plat.
Trunk Stormwater Impact Fee
Collector Street Trunk Stormwater Impact Fee
Park Dedication Fee
Street and traffic Control Signs
There was discussion of collector street fees and Andy MacArthur explained a
court case to the Council. The Council did not want it called collector street fee. Mike
Robertson suggested Street Access Fee.
Mark Berning questioned if this fee covers the cost of a new road.
Larry Koshak noted they will study Page and 85TH ST area and determine what
portion benefits the developers. We will not be able to get the developers to pay for the
entire road. The area that will be developed will need the access road.
Andy MacArthur - Our goal is to have a standard agreement for developers. This
is primarily for residential property development now.
Vern Heidner felt there are four fees as follows:
1. Sewer Plant
2 Water Tower
3. Sewer Trunk
4. Water Trunk
Sewer and water trunk should be paid up front suggested Mr. Heidner.

More discussion of having a time limit on the fees and between 1/3 to 2/3 up
front, the rest being with the building permit. Discussion of how to charge fees for
WAC/SAC and split up the costs into four separate fees.
Discussion of surrounding communities and how their fees vary on each
development. Mike Robertson will check on City administration fees in other Cities.
Park Dedication Fees should be paid up -front as per Dan Licht's Memo. The street and
traffic control signs are paid for by the developer - The City contracts to install them.
Landscaping - developer will pay the fee. (Current ordinance is two trees with
sod or seeding). The Subdivision Ordinance should be changed to one tree and sod the
front yard.
Larry Koshak suggested that in the first year, one lift of bituminous is placed on
the road. The next year the final lift of bituminous is placed - then the one year warranty
starts. Sewer and water and all utilities have a two year warranty period. Discussion of
the different kind of water meters.
City needs to approve a meter style.
The oversizing reimbursement to the developer will be paid upon the Engineers
acceptance of Sewer and Water. The policy will be put into the Engineering Manual for
Council approval. Discussion of billing for street lights and street lighting policy.
Staff was directed to incorporate this discussion into the Developer's Agreement
and bring it back to the Council for a decision.

Discussion of the Otsego/Dayton Agreement for sewer capacity.
