Re: Preliminary Estimate for 1999 Sewer
& Water Bond
I have enclosed a copy of a preliminary cash flow
analysis Tom Truszinski of Juran & Moody has done
for the City's upcoming bond issue. Tom will be at
the Council meeting on Monday, April 12 to discuss
the bond issue and answer any questions the Council
has.
The cash flow analysis is based upon a bond issue
of $2,500,000. This would mean that the City will
have borrowed $7,000,000 total to build a sewer
plant, water tower, two wells, and to install a
sewer and water system. This $7,000,000 estimated
cost is based upon a review of all previous
expenditures which include all the studies;
planning, legal, engineering, and permit costs; the
costs of obtaining the sites for the wells, sewer
plant, and water tower; the estimated costs of the
pumphouse; the estimated costs of finishing the
condemnation process to obtain all necessary
easements; the estimated cost of further developing
Well #1; the bids we have recently received for
construction of the sewer plant, water tower, sewer
lines, and water lines; the estimated costs of
construction engineering and inspections; and a 5%
construction contingency cost.
At this point, staff is suggesting that the Council
set its regular meeting of May 10, 1999 to
establish a final amount for the bond sale. Then
the City would receive and approve bids at its
regular meeting of Monday, June 14, 1999 and the
money would be available in early July, 1999. We
suggest this schedule because there are still
several issues to be decided which could impact the
amount of money borrowed.
Those issues are;
1) STREET OVERLAY IMPROVEMENT. The Council needs
to decide whether to go ahead with the Street
Overlay Improvement and how much it wants to
borrow. The estimated cost of the total project is
$1.7 million and we had discussed borrowing that
entire amount this year, even if the improvement
would be done across two years.
2) DEVELOPMENT IMPROVEMENTS (78TH STREET/TRUNK
SEWER & WATER). Another issue is should the City
go ahead and borrow money for its portion of the
costs for the construction of 78th Street and the
extension of the 78th Street trunk sewer and water
lines in the absence of a developer's agreement
with the proposed developers.
In addition to these issues, staff is still
scrutinizing all of the listed and estimated
expenses to make certain that nothing was
overlooked or underestimated.

Dear Mayor Fornier and city council members,

April 1, 1999
I am sending along two photos that illustrate a concern I have regarding a problem in our
city. Since we were required to move our mailbox to allow for a new road, postal
deliveries have created mud, mud and more mud strewn across the end of our driveway
and street. There is now a deep, unsightly path in front of our mailbox and those of our
neighbors.
The answer may seem we should just move the mailbox closer to the road. Just prior to
the blacktopping the post was closer, but the city told us we needed to move it again. We
moved the mailbox back, to where it is at its present location.
I am concerned about the appearance of these ugly tracks in Otsego. Could you please
allocate funds to expand the blacktopped "pads" you placed in front of our boxes? The
mail carriers apparently need more room to reach our boxes. I would be happy to address
the council in person about this, if it would help my appeal.

AN ORDINANCE AMENDING THE OTSEGO ZONING ORDINANCE TO RESPOND TO
DIRECTIVES OUTLINED IN THE COMPREHENSIVE PLAN UPDATE REGARDING FARMS AND
FEEDLOT REGULATIONS, INCLUDING ESTABLISHING PROVISIONS FOR RESGISTRATION
OF EXISTING FEEDLOTS IN THE RURAL SERVICE AREA WITHIN SIX MONTHS OF THE
EFFECTIVE DATE OF SAID ORDINANCE FOR THE PURPOSE OF ALLOWING LIMITED
EXPANSIONS AND ESTABLISHMENT OF A ONE THOUSAND (1,000) FOOT SETBACK
REQUIREMENT FOR NEW RESIDENTIAL DEVELOPMENT.

or more, or two (2) or more abutting parcels under the same
ownership having an area of at least ten (10) acres, measured from
the centerline of abutting roads, ususally with a house and other

buidlings, which is principally used fof commercial agricultural
activities such as raising cash crops and/or livestock in numbers
which do not constitute an animal feedlot, unless the operation is
allowed to keep a larger number of animal pursuant to rights as
specified in Sections 15 and 38 of this Chapter.
Section 3. Section 20-26-2 of the Zoning Ordinance (Farms -
Building Permits) is hereby amended to read as follows:
20-26-2: BUILDING PERMITS: The construction of any building or
structure on a farm as a part of the farm operation shall
require administrative review and approval of the City
Building Official. All other structures, including
residential dwellings and residential accessory structures,
shall require a building permit and be in compliance with the
Uniform Building Code.
Section 4. This Ordinance shall be in full force and effect upon
its passage and publication.

CITY OF OTSEGO

A RESOLUTION TRANSFERRING $145,000 IN
1998 GENERAL FUND BUDGET SURPLUS TO
THE CAPITAL IMPROVEMENT REVOLVING FUND
WHEREAS, the 1998 General Fund budget shows a
surplus of $220,000; and
WHEREAS, the City Council, based on the
recommendation of its financial consultant and
auditor, has determined that $75,000 of this
surplus should be placed into fund balance in order
for the City to maintain adequate financial
reserves; and,
WHEREAS, the City Council has determined that a
sizable portion of the surplus was generated in the
Street Department and was due to unspent street
improvement funds.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF OTSEGO, MINNESOTA:
1. That the 1998 General Fund Budget surplus in the
amount of $145,000 is hereby transferred to the
Revolving Capital Improvement Fund, where it is
intended to be spent on improvement projects which
cannot be 100% assessed, but which are determined
to have a benefit to the City.

funds are deducted from the Park & Recreation cash
balance to determine the actual surplus.

It is no secret that for the last 6 to 8 months the EDAAC members as a group have
become extremely disenchanted with the deteriorating relationship between the EDAAC
and the EDA/City Council.
Recent events have made it clear to me that no useful purpose would be served by
continuing as a member of EDAAC. Therefore, I hereby resign - effective immediately!
I will miss the various on-going relationships that were part of being a committee
member, but life goes on!

BACKGROUND:
6.1. The above request came before the P.C. for Hearing on April 5, Mon. 1999 at
8PM. There were not many issues. Staff recommended approval of the request
and the P.C. voted unanimously to recommend approval to the Council of the
accessory building being higher than the principal structure. Attached is the
planning report and the findings of fact by NAC for Council review.
6.2. Dennis Havel CUP for over 2-1/2 acre one per 40 subdivision came before the
P.C. for Hearing on April 5, 1999 at 8PM. After discussion and recommended line
change of the subdivision, and a revised survey showing the line change by the
applicant, the P.C. recommended approval of the CUP for over 2-1/2 acre
parcel being subdivided. Attached is the planning report and findings of fact by
NAC for Council review.
6.3. This item is for any other planning business that should arise.
RECOMMENDATION:
This is for Council consideration and Staff recommends approval of both items 6.1 and 6.2
above.

EXECUTIVE SUMMARY
Background
The Otsego City Council approved a conditional use permit (CUP) on August 10, 1998 to
allow Mr. Keith Knutson to construct a pole building that was larger than 1,500 square feet
and resulted in more than one detached accessory structure and total accessory area for
a single family use greater than 2,000 square feet on his property at 6630 Odean Avenue
NE. The subject property is zoned A-1, Agricultural -Rural Service District.
One of the conditions of the CUP was that the height of the proposed 3,000 square foot
structure not exceed that of the single family dwelling, as required by Section 20-16-4.F
of the Zoning Ordinance. The reason this was made a condition of approval and not
verified as part of the original staff review was that no information was provided by the
applicant regarding the height of the single family house. The City Building Official has
determined that the single family dwelling has a defined height of 12.5 feet. The proposed
detached building has a defined height of 19.0 feet. The height of the proposed building
is due mainly to the use of a gambrel roof versus a pitched roof.
Section 20-16-41 of the Zoning Ordinance states that the height of residential accessory
structures in the A-1 District are limited to the lesser of 45 feet or the height of the principal
building, except by conditional use permit. The applicant is therefore requesting an
amendment to the approved CUP to allow the height of the proposed building to exceed
that of the principal structure in the A-1 District.

Please note, this CUP exception was not eliminated as part of the recent Ordinance
amendments because it is intended to address unique or unanticipated situations. Since
1991, there has been only one such CUP applied for and approved, which was for the
antique windmill on Mr. Knutson's property.

Recommendation
The applicant is requesting a CUP amendment to allow the height of an accessory
structure to exceed that of the principal structure in the A-1 District as allowed by Section
20-16-4.F of the Zoning Ordinance. The applicant's request generally satisfies the criteria
outlined for such a conditional use as outlined herein. If the Planning Commission and
City Council make a similar finding, our office recommends approval of an amended CUP,
subject to the following revised conditions:
1. The building is constructed in substantial conformance with the following plans on
file with the City of Otsego, except as modified herein:

Building Floorplan
2. No commercial or home occupation activities, except as expressly permitted by and
in accordance with the Zoning Ordinance, are conducted on the property. This
restriction shall include the storage of materials and equipment which are unrelated
to the on-site residential use and activity.
3. The three detached accessory structures approximately less than 250 square feet
in size are removed from the property within sixty (60) days of building permit
issuance. To ensure compliance, the applicant is required to post appropriate
escrow for the removal of said structures, subject to review and approval of the City
Building Official.
4. The same or suitable quality exterior finishing materials be used for the proposed
building, subject to review and approval of the City Building Official.

5. All grading drainage and utility easement issues should be subject to review and
approval of the City Engineer.
ISSUES ANALYSIS
Building Height. The definition of building height in the Zoning Ordinance measures the
height of structures with a pitched, mansard or gambrel type roof from grade to the mid-
point of the roof. The basis of this measurement is that angle of the roof minimizes the
visual impact of the structure. Based upon this definition, the proposed pole building with
the gambrel roof has a defined height of 19.0 feet (Exhibit B).
The applicant's single family dwelling is a one story rambler with a walkout basement on
the east side of the building. The Zoning Ordinance anticipates measuring building height
where the grade surrounding a building changes. In such cases where the change in
elevation from the lowest grade to the highest grade is less than 10 feet, the building
height is measured from the highest grade to the midpoint of the pitched roof. If the
change in elevation is greater than 10 feet, then the building height is to be measured from
10 feet above the lowest grade to the mid -point of the pitched roof. As illustrated on
Exhibit C, the change in elevation surrounding the single family dwelling is less than ten
feet. The resulting building height as measured from the highest grade to the midpoint of
the roof is 12.5 feet.
CUP Criteria. 20-17-3.A of the Zoning Ordinance specifies allowable height increases in
excess of district standards by CUP provided that:
Demonstrated need is established for the increase in height and said increase will
not violate the intent and character of the Zoning District in which the structure is
located.
Comment: The requested height increase is necessary to accommodate the
proposed gambrel roof of the proposed building while allowing sufficient clearance
for the overhead doors to accommodate an RV and other equipment owned by the
applicant. The applicant desires to utilize this roof style to suggest the architectural
style of a traditional barn common to agricultural areas.
2. The site is capable of accommodating the increased structure size.
Comment: The topography of the site and proposed location of the building will
minimize the impact of the increased structure height. According to information
provided by the applicant, the building will not appear physically higher than the
single family dwelling or existing detached accessory structure when viewed from
Odean Avenue (Exhibit C). Likewise, the site topography will minimize the view of
the structure from the residential uses to the west.

3. The potential increased intensity and size of use does not cause an increase in
traffic volumes beyond the capacity of surrounding streets.
Comment. No increase in traffic will result from the increased building height.
4. Public utilities and services are adequate.
Comment. The proposed building height will not effect public utilities or services.
5. For each story over the district limitation or for each additional ten feet above the
maximum allowed per district, front and side yard setback requirements shall be
increased by ten (10) percent.
Comment: The increased height is less than ten feet above that allowed by
Ordinance. However, the location of the proposed building greatly exceeds required
setbacks by at least 70 feet.
6. The construction does not limit solar access to abutting and/or neighboring
properties.
Comment. Due to the topography of the site and increased setbacks, the proposed
building height will not limit solar access to adjacent properties.
7. The provisions of Section 20-4-2.17 of (the Zoning Ordinance] are considered and
satisfactorily met (listed below).
A. The proposed action's consistency with the specific policies and provisions
of the official City Comprehensive Plan.
Comment: The 1991 Comprehensive Plan suggests continued agricultural
use and character of the area where the property is located. The proposed
building is characteristic of agricultural areas and is therefore consistent with
the Comprehensive Plan in effect at the time the original CUP was
processed.
The 1998 Comprehensive Plan suggests rural development in this area until
such time as sanitary sewer service may be expanded to this area. in that
only the height of the structure is at issue (not the construction type or size),
accommodating the proposed gambrel roof style may be considered
appropriate.

B. The proposed use's compatibility with present and future land uses of the
area.
Comment. The proposed conditional use is characteristic of a traditional barn
design common in rural areas. Again, as the height of the proposed
structure is the only question of this request, the conditional use is anticipated
to be compatible with present and future land uses.
C. The proposed use's conformity with all performance standards contained in
the Zoning Ordinance (i.e., parking, loading, noise, etc.).
Comment: The proposed use will be constructed within all applicable
performance standard as a condition of approval.
D. The proposed use's effect upon the area in which it is proposed.
Comment: The proposed conditional use is not anticipated to have a
negative impact to the area as applicable performance standards are
satisfied.
E. The proposed use's impact upon property values of the area in which it is
proposed.
Comment. Although no study has been completed, the proposed use is not
anticipated to negatively impact area property values.
F. Traffic generation by the proposed use in relation to the capabilities of
streets serving the property.
Comment. The proposed conditional use will not generate additional traffic.
G. The proposed use's impact upon existing public services and facilities
including parks, schools, streets, and utilities and its potential to overburden
the City's service capacity.
Comment: The proposed conditional use will not have a negative impact to
the City's service capacity.

CONCLUSION
The applicant's request for a CUP amendment to allow the height of an accessory
structure to exceed that of the principal structure in an A-1 District generally satisfies the
criteria outlined for such a conditional use. The increased building height is necessary to
accommodate the proposed gambrel roof on the building, which was proposed as an
architectural amenity to the building as part of the original CUP application.
The original CUP application was processed and approved under the 1991
Comprehensive Plan, which designated the subject property as being within the Rural
Service Area. This application is subsequently processed under the 1998 Comprehensive
Plan Update that guides that this area should be planned for future urban expansion as
part of the Urban Service Area Reserve. While not a typical urban accessory structure
design, the proposed gambrel roof design is characteristic of the existing area and still
should be considered an architectural amenity. Further, the increased building height is
not anticipated to be a negative impact to adjacent properties due to the topography of the
property and increased setbacks.
Our office's specific recommendation is outlined in the Executive Summary of this report.

The Planning Commission considered the above referenced application at a public hearing
as part of their.meeting on April 5; 1999. In review of the staff, report and brief comments
from the applicant, the Planning Commission voted 4-0 to recommend approval of the
requested conditional use permit. There were, no comments from the public_
A findings of fact reflecting the recommendation of the Planning Commission has been
prepared for consideration by the City Council_ This application has been placed on the
April 12, 1999 City Council agenda for action. If the City Council agrees with the

IN RE:
FINDINGS OF FACT
AND DECISION:
Mr. Keith Knutson (the °Applicant") has made application for a conditional use permit
amendment to allow construction of an accessory structure with a height greater than that
of the principal structure within the A-1 District (the Application") for the property located
at 6630 Odean Avenue(the °Property'). The Otsego City Council met at its regularly
scheduled meeting on 12 April 1999 to consider the aforementioned application. Based
upon the application, the recommendation of the Planning Commission and evidence
received, the City Council now makes the following findings of fact and decision.
FINDINGS OF FACT
1. The legal description of the Property is as follows:

2. The Property lies within Urban Service Area Reserve defined by the 1998
Comprehensive Plan Update.
3. The Property is zoned A-1, Rural Service District.
4. The Otsego City Council approved a conditional use permit on August 10, 1998 to
allow the Applicant to construct an accessory pole building that is larger than 1,500
square feet and results in more than one detached accessory structure and total
accessory area greater than 2,000 square feet for a single family use.
5. A condition of the approved conditional use permit is that the height of the
accessory structure not exceed that of the principal structure, subject to review and
approval of the City Building Official, as required per Section 20-16-4.F of the
Zoning Ordinance unless allowed by conditional use permit.
6. The existing single family detached dwelling on the subject property has a defined
height of 12.5 feet.

7. The accessory structure has a defined height of defined height of 19 feet.
8. The Applicant is requesting approval the Application, persuant to Section 20-16-
4.17 of the Zoning Ordinance to allow the height of the accessory structure to
exceed that of the principal structure in the A-1 District.
9. Section 20-4-2.F of the Zoning Ordinance directs the Planning Commission and
City Council to consider seven possible adverse effects of the proposed conditional
use The seven effects and findings regarding them are:
A. The proposed action's consistency with the specific policies and provisions
of the official City Comprehensive Plan.
Finding. The 1991 Comprehensive Plan suggests continued agricultural use

6. The planning report dated 23 March 1999 prepared by Northwest Associated
Consultants, Inc. is incorporated herein.
7. The Otsego Planning Commission conducted a public hearing, at their regular
meeting on 5 April 1999, to consider the Application, preceded by published and
mailed notice. Upon review of the Application and evidence received, the Otsego
Planning Commission closed the public hearing and recommended that the City
Council approve the Application based on the aforementioned findings.
DECISION
Based on the foregoing considerations and applicable ordinances, the Application for a
conditional use permit to allow the height of a residential accessory structure to exceed
that of the principal structure in the A-1 District is approved subject to the following
conditions:
1. The building is constructed in substantial conformance with the following plans on
file with the City of Otsego, except as modified herein:

2. No commercial or home occupation activities, except as expressly permitted by and
in accordance with the Zoning Ordinance, are conducted on the property. This
restriction shall include the storage of materials and equipment which are unrelated
to the on-site residential use and activity.
3. The three detached accessory structures approximately less than 250 square feet
in size are removed from the property within sixty (60) days of building permit
issuance. To ensure compliance, the applicant is required to post appropriate
escrow for the removal of said structures, subject to review and approval of the City
Building Official.
4. The same or suitable quality exterior finishing materials be used for the proposed
building, subject to review and approval of the City Building Official.
5. All grading drainage and utility easement issues should be subject to review and
approval of the City Engineer.

EXECUTIVE SUMMARY
Background
Mr. Dennis Havel is proposing to divide a 4.955 acre parcel from his property located at
9115 Nashua Avenue N.E., north of the City Hall property. The existing parcel is
approximately 74.96 acres in size. The purpose of the subdivision is to divide the existing
farmstead residence from the balance of the property. The larger remaining portion of the
property is may potentially be further subdivided under the higher density allowed by the
Comprehensive Plan at such time as the moratorium ordinance applied to this area of the
community is repealed or expires.
The subject site is zoned A-1, Agriculture - Rural Service District. Residential parcels with
lot sizes created by a one per quarter -quarter split greater than 2.5 acres in size may only
be allowed with approval of a CUP

Recommendation
Section 20-51-5.F.2 of the Zoning Ordinance allows residential lot sizes within the A-1
District greater than 2.5 acres but less than 10 acres provided that:
1. Existing buildings occupying an area larger than the lot size minimum; or
2. The land involved in the subdivision is non -tillable and marginal for use in
agricultural production.
The location of the existing structures on the subject parcel in relation to the adjacent
parcel to the north are such that a 2.5 acre parcel may create future area and access
issues. Regarding the second criteria, the Wright County Soil Survey identifies that the
soil of the subject parcel is "severely limited" and productive only for small grains or
pasturing agricultural uses. Therefore, the proposed CUP generally satisfies both of the
criteria for allowing a lot size larger than 2.5 acres. As such, our office recommends
approval of the following:
• Approval of a Conditional Use Permit to allow a residential lot size larger than 2.5
acres as part of the "one per quarter -quarter" section division, subject to the
following conditions:
1. The applicant apply for and receive approval of a minor subdivision under
Section 2 of the Subdivision Ordinance.
2. The west lot line of the proposed parcel is redrawn to intersect the south lot
comer of the adjacent parcel to the north, subject to approval of the Zoning
Administrator.
3. A deed restriction is recorded on both parcels to prohibit further subdivision
until such time as the properties are eligible for rezoning.
4. The City Engineer and/or City Building Official determine that there is
adequate area on site to support the existing septic system and a future
alterative site.
5. The Certificate of Survey is revised to include easements required by 21-7-
15.A of the Subdivision Ordinance, subject to approval of the City Engineer.
6. Park dedication requirements as determined by the Parks and Recreation
Committee are satisfied.
7. Comments of other City Staff, the Planning Commission or the City Council.

ISSUES AND ANALYSIS
Zoning. The subject site is within the A-1, Agricultural - Rural Service District. The
purpose of this District is, in part, to preserve and maintain the use of land for commercial
agricultural purposes and prevent scattered and non-farm growth.
Subdivision. The applicants are proposing to divide 4.955 acres from their existing
74.955 acre parcel for the purpose of separating the existing farmstead residence from the
balance of the property. The balance of the property is anticipated to be developed further
at the higher densities allowed by the Comprehensive Plan at such time as the subdivision
moratorium is lifted.
Lot Size. Lot sizes within the A-1 District for residential parcels created by a quarter -
quarter division must be between 1 acre and 2.5 acres. Section 20-51-51 of the Zoning
Ordinance allows residential lot sizes greater than 2.5 acres and less than 10 acres as a
conditional use provided that the lot size expansion is the result of one of the following:
Existing Buildings occupying an area larger than the lot size minimum.
Comment: There is a two acre parcel that was divided from the subject parcel
previously in the northeast corner of the property. The proposed lot is designed to
include the existing structures and abut the existing lot such that there is no remnant
between the two that would be difficult to further subdivide or utilize due to area and
access issues. As such, the proposed lot size may be considered necessary due
to the configuration of existing structures in relation to adjacent parcels, which
satisfies this criteria.
2. The land involved in the subdivision is non -tillable and marginal for use in
agricultural production.
Comment: The applicant has provided no information regarding the suitability of the
soil for agriculture production. The Wright County Soil Survey identifies the soil on
the subject property as being in the Hubbard Series, with slopes of U to 2 percent.
According to the Soil Survey, these soils have very low moisture supplying capacity
and are susceptible to wind erosion that "severely limits the use of this soil' (Wright
County Soil Survey, page 23). The soil survey further states that the soil is fairly
suitable for pasture or small grains, but lacks moisture for corn.
CUP Criteria. In addition to the qualifications discussed above, Section 20-4-2.F of the
Zoning Ordinance outlines specific review criteria to be used in consideration of a request
for a CUP. The judgement of the Planning Commission and City Council is to be based
upon, but not limited to the following factors:

1. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Comment. The Comprehensive Plan designates that this property is within the Rural
Service Area and is guided for continued agricultural use as part of the Agricultural
Preserve. The Comprehensive Plan allows for limited residential development at
a density of 4:40 for street frontage 40 acre parcels and 1:40 for back forties. The
proposed subdivision is within these density allowances.
2. The proposed use's compatibility with present and future land uses of the area.
Comment. The property to the north, east and west are guided for continued
agricultural use; The City Hall property to the south is guided to continue as a public
use. The continued low density residential use of the subdivided parcel will be
compatible with these surrounding land uses.
3. The proposed use's conformity with all performance standards contained herein
(i.e., parking, loading, noise, etc.).
Comment: The proposed subdivided lot will be required to meet all applicable
performance standards as discussed in later paragraphs of this report.
4. The proposed use's effect upon the area in which it is proposed.
Comment: The subdivided parcel is anticipated to be compatible with future land
uses in this area and will not have a negative effect on the area.
5. The proposed use's impact upon property values of the area in which it is proposed.
Comment: Although no specific study has been completed, the subdivided parcel
is not anticipated to have a negative impact to area property values.
6. Traffic generation by the proposed use in relation to capabilities of streets serving
the property.
Comment: The proposed lot size of the subdivided parcel will not impact traffic
volumes on streets serving the property.
7. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's
service capacity.
Comment: The proposed lot size will not have a negative impact on the City's
service capacity.

Subdivision. The actual subdivision of the property may be approved administratively,
if the lot size CUP is approved by the City Council. However, the following issues were
identified in review of the proposed subdivision and are provided for reference:
• Irregular Lot Shape. The proposed west lot line of the subdivided parcel intersects
the shared lot line of the abutting parcel to the north at a point that is off -set 75 feet
from the corner of the north lot. This configuration will likely result in an irregular
lot shape for a parcel created when the remaining 70 acre parcel is subdivided. As
such, the west lot line of the proposed lot should be redrawn to intersect the
abutting parcel at the south corner of that lot (Exhibit D).
• Re -subdivision. Section 21-7-5 of the Subdivision Ordinance requires that
oversized parcels be arranged to allow for potential future street extensions and re-
subdivision of large parcels. The applicant will need to provide a concept plan for
how the parcel to be created could be re -subdivided in the future, as well as a
concept for dividing remaining 70 acre parcel prior to approval of the lot split.
• Lot Width/Depth. In the A-1 District, lot are required to be at least 150 feet wide
and 150 feet deep. Both the proposed parcel and remaining larger parcel would
exceed this requirement.
• Setbacks. The following table indicated required setbacks for the proposed lot.
The only setbacks in question with this review are those for the west and south lot
lines that would be established with the proposed lot split. As noted below, all of
the existing buildings are outside of the required setbacks.
• Deed Restriction. A deed restriction will be required both parcels preventing
further development without approval of a rezoning that allows for higher densities
provided for in the Comprehensive Plan.
• Septic System. The City Engineer and or City Building Official must determine that
there is adequate area on site for the existing system and a potential alternative
site.

Easements. A minimum 10 foot utility easement is required around the perimeter
of the proposed lot. The easement is allowed to overlay the side and rear lot lines.
All proposed easements are subject to approval of the City Engineer.
Park Dedication. As the subdivision results in a new lot, a condition of subdivision
approval should be that park dedication requirements, as determined by the Parks
and Recreation Committee, are satisfied.
CONCLUSION
Lots created as part of a quarter -quarter division in the A-1 District are limited to a
maximum lot size of 2.5 acres as a means of preserving productive farm land. Lot sizes
larger than 2.5 acres may be allowed by CUP if the applicant demonstrates that there is
no physical way to accommodate existing structures on a 2.5 acre parcel or the land is
marginal for continued agricultural use.
The location of the existing structures on the subject parcel in relation to the adjacent
parcel to the north make warrant a lot size larger than 2.5 acres. A 2.5 acre parcel would
leave a remnant between the proposed lot and the adjacent parcel that would raise area
and access issues. Further, the Wright County Soil Survey identifies that the soil of the
subject parcel is "severely limited" and productive only for small grains or pasturing
agricultural uses. Therefore, the proposed CUP generally satisfies the two criteria for
allowing a lot size larger than 2.5 acres. Our office's specific recommendation is outlined
in the Executive Summary of this report.

The Planning Commission considered the above referenced application at a public hearing
as part of their meeting on April 5, 1999. The applicant presented a revised Certificate of
Survey at the meeting that revised the west boundary of the proposed. lot consistent with
the comments outlined in the Planning Report. Comments from the public were limited to
questions regarding the maximum development density allowed for this parcel. Staff
explained the development densities guided by the Comprehensive Plan for the
Agricultural Preserve, The Planning Commission voted 4-0 to recommend approval of the
requested conditional use permit.
A findings of fact reflecting the recommendation of the Planning Commission has been
prepared for consideration by the City Council, which is to be placed ori the April 12, 1999
City Council agenda. If the City Council agrees with the recommendation of staff and the
Planning Commission, the follovring 'motion should be made:
• Motion to approve the application for a conditional'use permit to allow a residential
lot size larger than 2.5 acres as part of a one quarter -quarter section division in the
A-1 District based upon the considerations outlined in the findings of fact and
subject to the six conditions outlined in said findings of fact

FINDINGS OF FACT
AND DECISION:
Mr. Dennis Havel (the "Applicant') has made application for a conditional use permit to
allow a residential lot size greater than 2.5 acres as part of a one quarter -quarter section
division within the A-1 District (the "Application") for the property located at 9115 Nashua
Avenue N.E. (the "Propertyn). The Otsego City Council met at its regularly scheduled
meeting on 12 April 1999 to consider the aforementioned application. Based upon the
application, the recommendation of the Planning Commission and evidence received, the
City Council now makes the following findings of fact and decision.
FINDINGS OF FACT
1. The legal description of the Property is as follows:

2. The Property ties within Agricultural Preserve Area defined by the 1998
Comprehensive Plan Update.
3. The Property is zoned A-1, Rural Service District.
4. The Applicant is proposing to divide 4.955 acres from the existing 74.955 acre
parcel.
5. Residential lot sizes greater than 2.5 acres as part of a one quarter -quarter section
division in the A-1 District requires consideration of a conditional use permit
pursuant to Section 20-51-5.F of the Zoning Ordinance.
6. Section 20-51-5.F.2 of the Zoning Ordinance requires that the proposed residential
lot size greater than 2.5 acres as part of a one quarter -quarter division satisfy, one
of the following criteria:
1. Existing Buildings occupying an area larger than the lot size minimum.

Finding: There is a two acre parcel that was divided from the subject parcel
previously in the northeast corner of the property. The proposed lot is
designed to include the existing structures and abut the existing lot such that
there is no remnant between the two that would be difficult to further
subdivide or utilize due to area and access issues. As such, the proposed
lot size may be considered necessary due to the configuration of existing
structures in relation to adjacent parcels, which satisfies this criteria.
2. The land involved in the subdivision is non -tillable and marginal for use in
agricultural production.
Finding: The Applicant has provided no information regarding the suitability
of the soil for agriculture production. The Wright County Soil Survey
identifies the soil on the subject property as being in the Hubbard Series, with
slopes of 0 to 2 percent. According to the Soil Survey, these soils have very
low moisture supplying capacity and are susceptible to wind erosion that
"severely limits the use of this soil" (Wright County Soil Survey, page 23).
The soil survey further states that the soil is fairly suitable for pasture or small
grains, but lacks moisture for corn.
7. Section 20-4-2.F of the Zoning Ordinance directs the Planning Commission and
City Council to consider seven possible adverse effects of the proposed conditional
use The seven effects and findings regarding them are,
A. The proposed action's consistency with the specific policies and provisions
of the official City Comprehensive Pian.
Finding. The Comprehensive Plan designates that this property is within the
Rural Service Area and is guided for continued agricultural use as part of the
Agricultural Preserve. The Comprehensive Plan allows for limited residential
development at a density of 4:40 for street frontage 40 acre parcels and 1:40
for back forties. The proposed subdivision is within these density
allowances.
B. The proposed use's compatibility with present and future land uses of the
area.
Finding: The property to the north, east and west are guided for continued
agricultural use; The City Hall property to the south is guided to continue as
a public use. The continued low density residential use of the subdivided
parcel will be compatible with these surrounding land uses.

C. The proposed use's conformity with all performance standards contained
herein (i.e., parking, loading, noise, etc.).
Finding: The proposed subdivided lot satisfies all applicable performance
standards.
D. The proposed use's effect upon the area in which it is proposed.
Finding: The subdivided parcel is anticipated to be compatible with future
land uses in this area and will not have a negative effect on the area.
E. The proposed use's impact upon property values of the area in which it is
proposed.
Finding: Although no specific study has been completed, the subdivided
parcel is not anticipated to have a negative impact to area property values.
F. Traffic generation by the proposed use in relation to capabilities of streets
serving the property.
Finding: The proposed lot size of the subdivided parcel will not impact traffic
volumes on streets serving the property.
G. The proposed use's impact upon existing public services and facilities
including parks, schools, streets, and utilities and its potential to overburden
the City's service capacity.
Finding: The proposed lot size will not have a negative impact on the City's
service capacity.
7. The planning report dated 26 March 1999 prepared by Northwest Associated
Consultants, Inc, is incorporated herein.
8. The Otsego Planning Commission conducted a public hearing, at their regular
meeting on 5 April 1999, to consider the Application, preceded by published and
mailed notice. Upon review of the Application and evidence received, the Otsego
Planning Commission closed the public hearing and recommended that the City
Council approve the Application based on the aforementioned findings.

DECISION
Based on the foregoing considerations and applicable ordinances, the Application to allow
a residential lot size larger than 2.5 acres as part of a one quarter -quarter section division
is approved subject to the following conditions:
1. The applicant apply for and receive approval of a minor subdivision under Section
2 of the Subdivision Ordinance.
2. The west lot line of the proposed parcel is redrawn to intersect the south lot corner
of the adjacent parcel to the north, subject to approval of the Zoning Administrator.
3. A deed restriction is recorded on both parcels to prohibit further subdivision until
such time as the properties are eligible for rezoning.
4. The City Engineer and/or City Building Official determine that there is adequate
area on site to support the existing septic system and a future alterative site.
5. The Certificate of Survey is revised to include easements required by 21-7-15.A of
the Subdivision Ordinance, subject to approval of the City Engineer.
6. Park dedication requirements as determined by the Parks and Recreation
Committee are satisfied.

PROJECT.
The City Attorney will provide a resolution for the ordering of the
improvements.
A public hearing was held for the first phase (1999 program), therefore at
this time all that could be ordered is the 1999 project unless another public
hearing was held for the 2nd phase or year 2000. The attorney should
advise the Council on this matter. If ordered at this council meeting, the
project could be bid near the end of May. We recommend bidding as
soon as possible.
ITEM 2 DISCUSSION OF FUTURE PLANS FOR CSAH 36 EAST OF TH 101
This item was requested to be on the agenda from the Engineering
Manual Workshop. We would recommend that a letter be sent to the
County Board of Commissioners or your local Commissioner with a copy
to the County Engineer stating that the City is requesting that the road
improvement for this highway be considered in the County's
Transportation Plan as soon as possible.
It also would be appropriate, if the Council wishes, for staff to meet with
the County Engineer on this matter.

a) For your information:
Mn/DOT District 3 State Aid Engineer informed us that he has set
aside approximately 1.3 million dollars for the Otsego Avenue
Project FY 99 funds.. The project therefore could proceed with
bidding probably in May 1999. Two problems ahead to be solved
are: 1) the acquisition of property for easements needs to be
escalated so that the project can break ground in July 1999. A later
start date could limit ability to complete the construction this year.
2) The purchase price or acquisition cost of the Wilson -Berge
property could be a significant amount, therefore this matter needs
to be approached as soon as possible with perhaps alternative
purchase approaches.

Bids were received on March 23, 1999 for the trunk sewer and water project. 13 bids
were received as shown on the attached tabulation. We recommend award of contract
to the low bidder, Barbarossa & Sons, Inc. The appropriate action would be a motion to
adopt the attached resolution that accepts the bids and awards the contract.
The construction cost estimate for this work as contained in the February 1998 sewer
collection and water distribution system design report was $2,412,100. The low bid of
$2,173,560 is about 10% under the estimate. Barbarossa and Sons is a well
established construction company with a history that spans several generations. They
are well equipped to handle a project of this type. We have worked with this company
in the past with excellent results.

RESOLUTION NO.
A resolution accepting bids and awarding a contract, City Project 98.04, Trunk Sanitary
Sewer and Watermain.
WHEREAS, pursuant to an advertisement for bids for the construction of the Trunk
Sanitary Sewer Collection System and Potable Water System, a total of 13 bids were
received and tabulated,
AND WHEREAS, the firm of Barbarossa and Sons, Inc., P.O. Box 367, Osseo,
Minnesota 55369 is the lowest bidder with a bid in the amount of $2,173,560.25.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OTSEGO, MINNESOTA:
1. The Mayor and Clerk are hereby authorized and directed to enter in a contract
with Barbarossa and Sons, Inc. in the name of the City of Otsego for the
construction of the Trunk Sanitary Sewer and Watermain Improvement, City
Project 98.04, according to the plans and specifications therefore approved by
the City Council and on file in the office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return forthwith to all bidders
the deposits made with their bids, except that the deposits of the successful
bidder and the next two lowest bidders shall be retained until a contract has been
signed.

On several occasions we have discussed water meters and automatic meter reading
systems. At the March 31St City Council workshop, you requested that we prepare a
Scope of Work and proposal whereby meters and a meter reading system can be
acquired via competitive bidding. Attached is a memorandum from that meeting with
added information on radio read meter systems.
In response to the discussions and your direction, we propose the following Scope of
Work at a cost not to exceed $3,500.
1) Discuss meter reading systems with other metered utilities (gas and electric).
Determine if there is any potential for shared metering whereby those utilities
could pay some of the costs so as to reduce the City expenses. Discuss meter
reading- systems with the telephone company. Confirm or refute the current
perception that the phone system is not the best answer even though a phone
based system is the only current technology that can be fully automated.
2) Solicit and review detailed data and specifications from manufacturers and
suppliers on various systems. Review the history, current state of technology
and likely prognosis for various systems with special input from Kaeding and
Associates, our electrical and electronic subconsultant.
3) Provide a report to the City Council on the evaluation and findings. Discuss the
proposed specifications and the systems that will be allowed under the proposed
specifications. Recommend bid proposal items including the initial number of
units. Review purchase and bidding options for the City equipment. Recommend
a duration in years of the proposed contract.

Prior to issuing the first building permit for a structure served by municipal water, we
need to select a water meter and a system of water meter reading.
Water meters ultimately have to be maintained and replaced by the City. We
recommend selection of a single supplier of meters for ease of maintenance. Normally,
the City purchases meters and "sells" them to builders as part of the permit fee.
We have discussed and evaluated alternative meter reading systems. The most
automated is a telephone based system. A data sheet from one potential supplier
showed a basic meter cost of $104 plus an extra cost per unit of $107 for the meter
telephone interface equipment and $65 for installation. In addition, the City will have
costs of about $20,000 initially and an as yet undetermined annual cost to set up,
support and operate the meter reading system. This is a cost of $276/unit plus $20,000
for City equipment and software.
Attached is data on two radio read systems. The Sensus meter, transceiver and
installation has a cost of $274/unit. The City equipment and software cost is $14,360.
The Badger meter and transponder has a cost of $224/unit. The added City equipment
and software has a cost of $11,000. It would appear that radio based systems will
have an initial cost of somewhat less than $15,000 with per meter cost in the $230 to
$270 range.
Based on Council directions and after specific authorization, it is the intention to put
together a specification by which the City would select and purchase a system along
with an initial number of meters and meter interface units. The City would also enter into
a contract at a fixed price to purchase added units on an as needed basis.
We would expect 3 or 4 manufacturers to submit bids to supply meters, and would
anticipate very competitive bids for the City's initial project. Everyone will want their foot
in the door under the theory that once we buy a type of meter and interface along with
the software, we will be very reluctant to switch in future years.

Dear Mayor Fournier:
Last week I attended the Governors Emergency Management Conference and
had a conversation with someone from the city regarding additional Outdoor
Warning Siren coverage.
The city purchased a used Model 5 siren from the city of Avon in 1995. We
provided the radio control unit back to have this siren activated from County
Sheriff Dispatch. I do not have it in our file where the siren was installed. If you
could give me a street address I could provide a coverage map for your records.
The Model 5 siren is a smaller siren that covers 1,500 ft. radius, which is not
providing the needed coverage to a city the size of Otsego. The individual I
spoke with at the conference said that a noise barrier wall was recently put in
along the highway that is blocking the sirens output.
Mr. Thompson did an on-site survey in 1994 with Mr. Ron Black and proposed
the installation of a Federal 2001 at 901h/Packard to cover the main populated
area of the city. I have included a siren survey map showing the coverage that
would be received by (2) Federal 2001 Sirens. The 2001 is a 127 db rotating
siren that covers 5,200 ft. radius with 70 db at the outer perimeter. If you could
indicate the areas of concern we could design a system around the existing
siren.
I hope this information may be helpful. If you have any questions regarding your
outdoor warning siren system please do not hesitate to give me a call.
