The of residents of Lin -Bar Estates petition the Otsego City Council to change the City ordinance to
increase the maximum driveway width from 24 feet (less flares at curb) to a maximum width equal to the
maximum width of an attached garage (less flares at the curb) on residential properties of one acre and
larger. Lin Bar Estates is a development consisting of 391+acre lots. There are 14 occupied homes -and 3
more currently under construction.
Paragraph 7 of the DeElaration of Covenants, Conditions and Restrictions recorded in Wright County on
May 201997 restricts outdoor storage on the lots. Paragraph 7 reads, "No motorhome, camper, trailer,
boat, motorcycle, snowmobile, all -terrain vehicle, racing car, hobby or junk car, or any other form of
recreational vehicle whether motorized or not, shall be parked, placed on blocks, stored or permitted to
remain on any lot unless it is located inside the garage, dwelling or attached, screened enclosure
constructed of building material matching that of the dwelling and approved by Lin -Bar Estates II committee
as hereinafter provided." This type of restrictive covenant is becoming the standard. Home owners are
building larger garages to store their recreational vehicles. Typical garage set backs for Lin -Bar Estates are
40 feet from the property line. The City of Otsego maintains a 10 foot easement. It is within this easement
that the 24 foot maximum driveway width applies. This leaves a 30 foot long maneuverable area in front of
the storage bays of a garage. A standard cab pickup truck with 8 foot bed towing an 18 foot fishing boat is
about 41 feet long. The restrictive driveway widths imposed by Otsego City Ordinance increase the
difficulty of backing trailers and RVs into the storage bays of the garage.

In recognition of planning by cities the EQB allows the mandatory EAW threshold to be raised from 100
SF detached units to 250 units Raising this mandatory threshold eases the regulatory burden without
reducing City authority. The city will still have authority to direct optional preparation of an EAW for
any development that exceeds the exempt threshold (20 units) -

4410.4300 MANDATORY EAW CATEGORIES.
Subpart 1. Threshold test. An EAW must bepr�ared for
projects that meet or exceed the thres o o any o subparts 2
to 37, unless the project meets or exceeds any thresholds of
part 4410.4400, in which case an EIS must be prepared.
Subp. 19. Residential development. An EAW is required for
residential development if the total number of units that may
ultimately be developed on all contiguous land owned or under an
option to purchase by the proposer, and that is zoned for
residential development or is identified for residential
development by an applicable comprehensive plan, equals or
exceeds a threshold of this subpart. In counting the total
number of ultimate units, the RGU shall include the number of
units in any plans of the proposer; for land for which the
proposer has not yet prepared plans, the RGU shall use as the
number of units the product of the number of acres multiplied by
the maximum number of units per acre allowable under the
applicable zoning ordinance or, if the maximum number of units
allowable per acre is not specified in an applicable zoning
ordinance, by the overall average number of units per acre
indicated in the plans of the proposer for those lands for which
plans exist. If the total project requires review but future
phases are uncertain, the RGU may review the ultimate project
sequentially in accordance with part 441 .1000, subpart 4.
If a project consists of mixed unattached and attached
units, an EAW must be prepared if the sum of the quotient
obtained by dividing the number of unattached units by the
applicable unattached unit threshold, plus the quotient obtained
by dividing the number of attached units by the applicable
attached unit threshold, equals or exceeds one.
The local governmental unit is the RGU for construction of
a permanent or potentially permanent residential development of:
A. 50 or more unattached or 75 or more attached units
in an unsewered unincorporated area or 100 unattached units or
150 attached units in a sewered unincorporated area;
B. 100 unattached units or 150 attached units in a
city that does not meet the conditions of item D;
C. 100 unattached units or 150 attached units in a
city meeting the conditions of item D if the pro3ect is not
consistent with the adopted comprehensive plan; or
D. 250 unattached units or 375 attached units in a
city within a. even-coun y win i ies me ropo1 an area that
has adopted a comprehensive plan under Minnesota Statutes,
section 473.859, or in a cit not located within the
seven -county Twin Cities metropo itan area that llaS filed with
comore ensive n an containing the o owing elements:

First, I would like to thank all who helped me and allowed me to serve the City of Otsego
over the past four or five years. It has been a rewarding experience, and I am grateful for
the opportunity.
As most of you are aware, I have been attending law school forever, but the time has now
come that I will graduate, and begin my next career. My family and I will be relocating to
the Phoenix, AZ. area, to start a new chapter in our lives. It is with this notion that I must
tender my resignation as second alternate to the Otsego Park and Recreation
Commission. My resignation should be considered as of this date, as I have and will
continue to be very occupied until our leaving, which will occur on or about the 17th of
May, 1999.

ITEM 7.1 CONSIDER ORDERING IMPROVEMENT AND PLANS AND
SPECIFICATIONS FOR THE 1999-2000 BITUMINOUS STREET
OVERLAY PROJECT.
As per the last Council meeting, the Council ordered a second public
hearing for the second phase of the program. The hearing date was set
for Tuesday, May 5, 1999 at 7:00 p.m. at the City Hall.
We would recommend that council allow our staff to proceed with the
design so that should the second phase be approved after the hearing, we
could conceivably go out for bids early in June.
ITEM 7.2 UPDATE ON ODEAN AVENUE
Since the last Council meeting, we have received approval of our
submittal on the Hydrology (Storm water drainage). The local share
based on ou - cost estimate is 30% of the total cost of the storm drainage
facilities, or $ 186,000.
The State Ald Engineer for District -3 called to tell us that there is money to
proceed with the project in 1999. The maximum Federal funds available
will be $1.3 million.
Based on oijr estimate and Do..t, on actual bids, the following is the
construction cost breakdown:

This does not include right-of-way acquisition costs, engineering fees,

The next step appears to be providing the State Aid office with assurance
that all right-of-way and easement acquisition - is either under
condemnaJon or acquired. We are awaiting this assurance from the City
Attorney.
It is possible that this project could be bid as soon as mid-May. However,
we will tale one step at a time in dealing with the State and Federal
process.

W received and opened bids for Pumphouse #1 at our office on April 23, 1999 at 10:00
a.m., as per council direction.
We received three bids, end they are listed below in order of the lowest bid first:

Gridor Construction, Inc. $443,176
The lowest responsible bidder is EnComm Midwest, Inc., who is currently constructing a
pumphouse and water treatment plant in Elk River, and a pumphouse in White Bear
among other similar type projects. Even with the bid exceeding our previous projection,
we feel the bid is appropr ate.
As we reviewed the bids, it was felt that most items were priced about as we estimated.
The exception was the Electrical and Control, and the SCADA system. There is
considerable difference between our pre-bid estimate in this area and the actual bid.
However, we did our pre -yid estimate without the consultation of our electrical engineer.
After he reviewed the pri -,e and breakdown, he concluded that items 31 and 32 in the
bid form were within rew;on. All three bidders were very close in the total of items 31
and 32.
The SCADA system was bid at $84,920. This amount is more than we anticipated. It is
the communication system for all of the City's utilities. It is current technology and the
base equipment and program designed for the future. This system will be used in future
when adding wells and water tower, lift stations, and adding more functions at any one
location.

Of the projects bid recertly for the City of Otsego Wastewater and Water facilities, this
project is the first to be over the proposed budget. We did add a third future well
location to the system and other minor changes to the building. We didn't fully establish
and finalize our wishes on the SCADA system until we put the final plans together in
March of this year.
We recommend that the --ouncil consider awarding the contract to EnComm Midwest as
bid. Delaying the award Evill only set back the schedule to order the equipment. Should
we anticipate an October startup, it would be important to move on this project as soon
as possible.
Enclosed is a Bid Tabulation and a copy of Kaeding and Associates breakdown
estimate of the work required in Item 31 and 32 for Electrical, Control and SCADA
systems.
Should further discussion be needed before this award can be made, I recommend that
the electrical engineer bE! available.

Pumphouse and SCADA Construction Cost Estimate
Enclosed you will find a construction cost estimate for the Otsego project. While preparing the cost
estimate, I deliberately left out the totals at the end of the spreadsheet until all entries had been made
so that I would not be influenced by the bid amounts. As you can see, the estimates for the electrical
and SCADA subtotals vary somewhat from those listed in the bid tabulation but the grand total comes
within a couple per cent. I also reviewed several recent projects of similar scope that we have
worked on, and found similar construction costs.
Therefore, I feel that the electrical and SCADA cost estimates in the bid tabulation are reasonable.

RE: Draft Septic Ordinance
Dear Council Members:
Please find enclosed a draft sewage and wastewater treatment ordinance for review by the
Council, City Engineer and building inspector. I am not recommending any action at this
meeting, but am providing the draft ordinance for Council review.
The proposed ordinance is a simplified version of the existing ordinance which makes
changes required by recent law changes. Rather than making local rules that are
somewhat inconsistent with 7080, the new ordinance generally adopts 7080 standards.
The section regarding alternative systems has been left for comment by the City
Engineer. The City Engineer should also comment on warrantied systems.The inspection
portion of the ordinance has to include a protocol, in case that timely inspection cannot be
made. The City Building Inspector should comment upon what should be included within
that protocol.
I have also enclosed for your information a copy of the proposed changes to the Wright
County ordinance.

meeting on Monday.

SEWAGE AND WASTEWATER TREATMENT ORDINANCE
The City Council of the City of Otsego hereby Ordains as follows:
SUBDIVISION 1. PURPOSE AND INTENT
The purpose of the Sewage and Wastewater treatment Ordinance is to provide
minimum standards for and regulation of individual sewage treatment systems
(ISTS) and septage disposal including the proper location, design, construction,
operation, maintenance and repair to protect surface water and ground water from
contamination by human sewage and waterborne household and commercial
waste; to protect the public's health and safety, to protect the natural environment
and to eliminate or prevent the development of public nuisances. This Ordinance
is adopted pursuant to the authority granted under Minnesota Statutes Chapters
115 and 145A and Minnesota Rules Chapter 7080 pertaining to sewage and
wastewater treatment, as the same may from time to time be amended.
SUBDIVISION 2. GENERAL PROVISIONS
2.10 SCOPE AND APPLICATION. This Ordinance shall apply to all existing
and future individuals sewage treatment systems located within the City of
Otsego.
2.11 STANDARDS ADOPTED BY REFERENCE. The City hereby adopts
by reference Minnesota Rules Parts 7080.0010 to 7080.03 15, as the same
may from time to time be amended, relating to minimum technical
standards and criteria for individual sewage treatment systems. Any ISTS
constructed and installed within the City subsequent to the adoption of this
Ordinance must comply with these provisions adopted by reference, unless
otherwise approved as an Alternative Experimental Septic System pursuant
to Subdivision of this Ordinance.
2.20 PERMITS. No person shall install, alter, repair, extend or relocate any
individual sewage treatment system in the City of Otsego without first
applying for and obtaining a permit as provided in Subdivision of this
Ordinance.
2.30 LICENSE REQUIREMENTS. No person shall engage in the evaluation,
inspection, design, installation, construction, alteration, extension, repair,
maintenance or pumping of on-site individual sewage treatment systems
without first obtaining a license to perform such tasks from the Minnesota
Pollution Control Agency as required by Minnesota Rules §7080.0700,
except as may otherwise be provided therein.
2.31 ADDITIONAL SOIL TREATMENT AREA REQUEREMENTS. For
all lots created after January 23, 1996, the ISTS system design shall identify
and designated at least on alternative soil treatment area, in addition to the
primary soil treatment area, which can support a standard soil treatment
system.
SUBDIVISION 3. PERAUT APPLICATION REQUIREMENTS AND
PROCEDURES.
3.10 Application Information. Each permit application required by
section above shall be presented as follows and contain all of the
following information:
3. I I Application Form. Applications for permits shall be made on forms
approved and furnished by the City. The application must be signed by the
applicant and shall be submitted to the City Clerk.
3.12 Legal Description and Name of Installer. Each permit application shall
contain the legal description of the property for which the permit is
requested. The application shall also disclose the name of the Person who
will perform the work for which the permit is required.
3.13 Site Plan. Each permit application shall be accompanied by a site plan,
unless such requirement is waived in writing by the City's Building
Inspector, showing the following:
a. The location of any proposed or existing building on the subject
property.
b. The boundary lines of the subject property.
C. the location of water supply facilities.
d. the location and ordinary high water mark or any streams, ponds or
lakes located on or within 150 feet of the subject property.
e. that the proposed ISTS meets all setbacks as required by Minnesota
Rules Chapter 7080.
f. topographic contours at two (2) foot intervals.
g. ,_ the location of any ISTS or wells on adjoining lots within 150 feet of
the subject property.
3.14 System Design Data. Each permit application shall include a complete
design plan showing the size and location of all parts of the ISTS and
provide a design certification as to the adequacy and location of the ISTS in
relation to the requirements imposed by 7080.
3.15 Other Data. Each permit application shall contain any and all additional
information necessary to show that the conditions of 7080 will be met.
3.20 Permit Approval Procedures. Permits shall be approved or denied as
hereinafter provided.
3.21 Submission of Application. Permit applications shall be submitted to the
City Clerk, along with the pernut fee. The Clerk shall forward all
applications to the Building Inspector. The Building Inspector shall
determine whether a submitted application is complete. Incomplete
applications shall be rejected and returned to the applicant along with an
explanation of why the application has been rejected.
3.22 Technical Review. Once a complete application is received, the Building
Inspector shall review the application to determine whether it meets the
requirements and standards of this Ordinance and of Minnesota Rules
Chapter 7080. The Building Inspector may, in his or her sole discretion,
submit the permit application to the City Engineer for review, comment
and/ or a determination as to whether the application meets the
requirements of this Ordinance and Minnesota Rule Chapter 7080.
3.23 Approval by Building Inspector. Once a determination is made that the
application meets all applicable requirements, then the application shall be
returned to the City Clerk who shall issue the ISTS permit. If, however, it
is determined that the application does not meet the requirements of this
Ordinance or Minnesota Rules Chapter 7080, then the clerk shall give
notice to the applicant that the application has been rejected and state the
reasons for such rejection as provided by the Building Inspector and/ or
City Engineer.
Neither the issuance of a permit, nor the any subsequent inspection of a
ISTS shall constitute any warranty or guarantee that said ISTS will operate
or function properly.
SUBDIVISION 4. INSPECTIONS AND CERTIFICATES OF
COMPLAINCE
4.10 General Inspection Requirements. The Building Inspector shall make
such ISTS inspections as are necessary to determine compliance with this
Ordinance, Minnesota Rules Chapter 7080 and/ or any conditions contained
in permits issued hereunder. The following events shall trigger an ISTS
compliance inspection:
a. a permit is granted under section above.
b. a permit or variance is granted for the addition of a bedroom or bathroom
on property served by an ISTS.
c. for all new ISTS construction, or any ISTS replacement, repair,
maintenance or operation.
d. Granting of request for change in system design or change in permit
conditions.
4.20 Time and Manner of Inspection. Inspections shall be made by the Building
Inspector and/ or City Engineer to ensure compliance with the requirements of this
Ordinance, Minnesota Rules Chapter 7080 and any permit conditions. No part of
the ISTS shall be covered until it has been inspected and accepted by the Building
Inspector and/ or the City Engineer. It shall be the responsibility of the permit
applicant to notify the Building Inspector that the project is ready for inspection.
4.30 Certificate of Compliance; Notices of Noncompliance. No ISTS shall be
place in operation until it has received a Certificate of Compliance as hereafter
provided. Upon completion of the ISTS inspection as described in section 4.20
above, the Building Inspector and/ or City Engineer shall make a determination as
to whether or not the ISTS has been construction, repaired, extended or relocated
in compliance with the requirements of this Ordinance, Minnesota Rules Chapter
7080 and any permit conditions. If the ISTS is found to be compliant, then a
Certificate of Compliance shall be issued to the property owner. If, however, the
ISTS is found to be out of compliance, then a Notice of Noncompliance shall be
issued. The Notice of Noncompliance shall state which portions of the ISTS are
not compliant and shall further state a reasonable period for the property owner to
bring the system into compliance. Once the necessary changes are made the ISTS
shall be again inspected as provided above.
SUBDIVISION 5. ENFORCEMENT
5.10 Any. person who violates any of the provisions of this Ordinance or who
makes 'any false statement on a Certificate of Compliance, shall be guilty of
a misdemeanor, punishable by imprisonment or a fine or both as defined by
law.
5.20 In the event of a violation of this Ordinance, in addition to other remedies,
the City Attorney may institute appropriate actions or proceedings to
prevent, restrain, correct or abate such violations.

Attached are the proposed revisions to the Sewage Disposal Standards for Wright County. The
current code is being eliminated and replaced by the new one. Chapter 7080 State Rules are
being adopted by reference. This is required by the Pollution Control Aaency (PCA). The PCA
also requires language beyond just simple adoption.
Text that is not underlined or in bold comes from Chapter 7080 and Minnesota Statutes 115, and
are required by the PCA to be included and addressed in our code. Items that are in bold differ
from Chapter 7080, but have already been adopted in other parts of the Wright County Zoning
Ordinance, or our current sewer code. Underlined items also differ from Chapter 7080.
However, these items are mainly sizing requirements for on-site sewage treatment systems and
have been an accepted practice. These differences were arrived at between our office, site
evaluators and installers.
The Environmental Health Department believes that this is a fair and reasonable code, aimed at
protecting public health and safety, while still allowing for flexibility in designing and installing

716 Sewage and Wastewater Treatment and Disposal Standards
716.1 Purpose and Intent
The purpose of the Sewage and Wastewater Treatment and Disposal Standards shall be to
provide minimum standards for and regulation of individual sewage treatment systems
(ISTS).and septage disposal including the proper location, design, construction,
operation, maintenance and repair to protect surface water and groundwater from
contamination by human sewage and waterbome household and commercial waste; to
protect the public's health and safety, and eliminate or prevent the development of public
nuisances pursuant to the authority granted under Minnesota Statues Chapters 115 and
145A and Minnesota Rules Chapter 7080 as amended that may pertain to sewage and
wastewater treatment.
716.2 General Provisions
(1) Standards adopted by reference. The County hereby adopts, by this reference,
Minnesota Rules Chapter 7080 and Minnesota Statutes Section 115.55, along
with any future amendments.
(2) Permits. No person shall install, alter, repair or extend any individual sewage
treatment system in Wright County without first applying for and obtaining a
permit from the Environmental Health Office (EHO) and at the same time paying
a fee as listed in the fee schedule determined by the County Board of
Commissioners. Staff will notify the permittee of an incomplete application,
when the requirements are met a permit will be issued. Such permit shall be valid
for a period of twelve (12) months from the date of issuance. A full design must
be submitted before a permit for new construction is approved. When weather
does not allow a Rill site evaluation to be completed, a design of the worst case
scenario shall be submitted. Worst case scenario shall be a mound system, septic
tank(s) and lift station. If Wright County Soil Survey is consulted and research of
neiahboring systems indicates that an in ground system is appropriate, that may
be designed. Verification is required when weather permits.
(3) Inspections. The permittee shall notify the EHO prior to the completion and
covering of the ISTS. The installation and constriction of the ISTS shall be in
accordance with the permit requirements and application design. Inspections will
be made at least once during the construction of the ISTS at such time to assure
that the system has been constructed per submitted and approved design.
(A) No part of the system shall be covered until it has been inspected and
accepted by the Inspector unless prior arrangements have been made.
(B) Proposals to alter the permitted construction shall be reviewed and the
proposed change accepted in writing by both the designer and the EHO.
(C) It shall be the responsibility of the property owner or authorized agent to
notify the Inspector on the workday preceding the day inspection is
desired.
(D) If proper notice is given and the Inspector does not appear for an
inspection within two hours after the time is set, the permittee may
complete the installation. The permittee shall then file a signed As -Built,
including photographs of the system prior to covering, with the EHO
within five working days. The As -Built shall include a certified statement
that the work was installed in accordance with submitted design and
permit conditions and that it was free from defects.
(E) Upon satisfactory completion and final inspection of the system the
Inspector shall issue a Certificate of Compliance. If upon inspection the
Inspector discovers that any part of the system is not constructed in .
accordance with the minimum standards provided in this Ordinance, the
Inspector shall give the applicant written notification describing the
defects. The applicant shall be responsible for the correction or
elimination of all defects, and no system shall be placed or replaced in
service until all defects have been corrected or eliminated.
(4) Neither the issuance of a permit nor the inspection of a system shall constitute any
warranty or guarantee of operation of the system.
(5) Existing System Compliance Inspections. An ISTS shall require a compliance
inspection when any one of the following conditions occur:
A. Any time that a permit is applied for in a Shoreland Management Area
(1000 feet of a lake, pond or flowage: or 300 feet of a river or stream or
the landward extent of a floodplain).
B. No owner of a tract of land on which a dwelling is located, or tract of
land on which a structure which is required to have an ISTS is
located, shall sell or transfer to another party said tract of land unless
requirements as stated in the Wright County Point of Sale
Certification Ordinance for On -Site Septic Systems are met.
C. Addition of a bedroom on the property, or variance issued in accordance
with Minnesota Rules Chapter 7080.0305 Subp. 3 (General Requirements
for Local Units of Government).
If a request for an additional bedroom or variance is received
between November 1 and April 30 the County may issue a permit
or variance immediately with the requirement that a compliance
inspection be completed by the following June 1 and the applicant
submits a certificate of compliance by the following September 30.
If a system constructed between May 27, 1989 and January 23,
1996 does not comply with applicable requirements, and is not an
imminent public health threat, a property owner applying for a
zoning permit to construct a bedroom addition has five years from
the date of issuance of such zoning permit to bring the system into
compliance.
D. If an existing system (constructed prior to April 1, 1996) is not an
immediate public health threat, the tank is watertight and provides at least
two feet of soil separation, the system need not be upgraded, repaired or
replaced or its use discontinued, as long the system is not located in the
shoreland area, wellhead protection areas (200 feet from any public water
supply well, that is any well serving 25 persons or more for sixty days of
the year) and serving food/beverage/lodging facilities. The three foot rule
applies in those circumstances.
E. Certificates of Compliance or Notices of Noncompliance shall be issued
on the Minnesota Pollution Control Agency's Inspection Form for
Existing Septic Systems. Copies shall be provided to the property owner
and County within 30 days.
(6) Failing septic systems must be properly abandoned according to part 7080.0176
within the following time flames:
A. A failing ISTS shall be upgraded, replaced or its use discontinued within
one (1) year. The Environmental Health Office will give consideration to
weather conditions as it establishes compliance dates.
B. An ISTS posing an imminent threat to public health or safety shall be
abated within 10 days of notice. The system shall be upgraded, replaced;
or repaired or its use discontinued, within 6 months.
(7) License requirements. No person shall engage in the evaluation, inspection,
design, installation, construction, alteration, extension, repair, maintenance or
pumping of on-site individual sewage treatment systems without first obtaining a
license to perform such tasks from the Minnesota Pollution Control Agency,
except as provided under part 7080.0700, subpart 1. An individual may be
permitted to install or repair an ISTS on their own property if the system is
designed by a licensed Designer and said Desianer oversees their work
Pressurized systems cannot be constructed by anvone other than a licensed
installer.
(8) Additional soil treatment area requirements. On lots created after January 23,
1996, the system design shall include at least one designated additional soil
treatment area which can support a standard soil treatment system.
(9) Holding Tanks
(A) Holding tanks shall not be used as a sanitary system for new
residential construction or for improvements greater than 50% of the
assessed value of the structure at the time of the application for the
improvement. Subsequent improvements shall count towards the
50% value limit for improvement.
(B) Holding tanks shall only be used as a corrective action for sewage disposal
for pre-existing uses when a standard treatment system cannot be
installed.
(C) Undeveloped lots of record on which a holding tank is the only
practical means of sewage disposal are unsuitable for residential use.
(D) Holding tanks shall not be installed on undeveloped lots of record for
recreational uses unless the lot has been found to be suitable for a
dwelling and can support a full septic system.
(E) Holding tanks must have a visual or audio alarm for the prevention of "
overflow.
716.3 Standard systems shall take priority for new construction and on upgrades where those
systems can be reasonably installed.* Systems classified as other, performance, and/or
experimental shall meet the requirements of Chapter 7080. Warrantied systems are
allowed if sized according to Tables 1 and 2. If a non-standard system is installed on a
site where more than one sewer site is available and a standard system could be installed.

716.4 Site Evaluation and Design Requirements.
(1) Chapter 7080 must be followed.
(2) A minimum of two soil borings are to be conducted within the primary treatment
area and one soil boring in the secondary treatment area.
(3) The larger soil sizing factor must be used when there is a discrepancy between the
soil texture and percolation test or a justification for a smaller sizing shall be
submitted with the design report.

716.E Setbacks and Placement of Building Sewer
(1) The building sewer pipe extending from the house to the tank shall not be
less than four (4) inches in diameter and must meet the strength
requirements of Schedule 40 plastic pipe. The pipe shall be supported in
such manner so that there is no deflection during backfilling and subsequent
settling of the soil between the building foundation and the inlet to the septic
tank. Construction of the line shall provide a grade of not less than 1/8 inch
per foot for minimum grades as recommended by the Minnesota Pollution
Control Agency. No 90 degree ells shall be permitted, and where the
direction of the sewer is changed in excess of 22 1/2 degrees accessible
cleanouts shall be provided.
(2) The -building sewer pipe extending from the tank to the first drop box shall
not be less than four (4) inches in diameter and must meet the strength
requirements of Schedule 40 plastic pipe. Sewer pipe lines, manholes and
other appurtenances shall be constructed in accordance with the State
Plumbing Code and Minnesota Pollution Control Agency requirements.
716.6 Septage Disposal. See Section 770.8 Item 6 -Land Application of Septage.
716.7 Enforcement
(1) Any person who violates any of the provisions of this Ordinance or who makes
any false statement on a Certificate of Compliance, shall be Quilty of a
misdemeanor, punishable by imprisonment or a fine or both as defined by law.
(2) In the event of a violation of this Ordinance, in addition to the other remedies, the

716.8 Subject to Change
The requirements of this Ordinance are intended to be comparable to the Environmental
Protection Agency and Minnesota Pollution Control Agency standards. Should this
Ordinance differ from other agency standards or should EPA or MPCA standards change,
the more strict standards shall apply.

Dear Ms. Kolze:
This letter is the City of Otsego's official
comments for the proposed Darkenwald Real Estate,
Inc. Wastewater Treatment Facility EAW permit. The
City of Otsego respectfully requests that the MPCA
find the EAW provides insufficient information at
this time to make a determination whether or not
significant environmental impact will occur because
of the project. The information needed for such a
decision can be reasonably obtained from the
applicant. Therefore, the City respectfully
requests postponement of any decision pursuant to
Minnesota Rule 4410.1700, Subp 2a, B.
The following comments list our reasons for this
request.
1) LAND USE & WWTF EXPANSION. The City believes
that the proposed expansion of the Darkenwald WWTF
is intimately tied to the proposed use of their
undeveloped land on the west side of State Highway
101. The land uses and densities the Darkenwalds
intend to develop within any expanded service area
will have a direct correlation to the necessary
capacity of their WWTF. As such, the City of
Otsego has stated that any expansion of the WWTF
capacity or service must be reviewed by the City in
conjunction with a development proposal to fully
evaluate consistency with adopted policies, plans,
and development regulations. DRAFT
The draft EAW includes several references to the
Darkenwald's intent for "residential, commercial,
and industrial development they propose to build",
including specific references to numbers and
densities of residential uses. Item 18.b states
that 150 acres west of State Highway 101 would be
developed in part with 450 dwelling units, whereas
Item 30 outlines a multiple phased development
including the expansion of the existing mobile home
use and development of medium to high density
residential uses in the area between State Highway
101 and Quaday Avenue.
Development of any of these land uses will require
approval from the City of Otsego including, but not
limited to, Comprehensive Plan Amendments, Zoning
Ordinance Amendments, plat approval, and the public
review and input required by State law. Any use of
private facilities to serve these lands will also
need a separate City approval, since the City has
established sewer and water utilities. The brief
descriptions of potential development of the
Darkenwald properties emphasizes the City's
position that the proposed expansion of the WWTF
and land use issues are interrelated. The
potential second phase of the development plan
outlined in the draft EAW conflicts with the
adopted Comprehensive Plan, which designates that
area for commercial use. The addition of 450
dwelling units described in the draft EAW would
surpass the threshold for a second mandatory EAW
pursuant to Minnesota Rule 4410.4300, with the City
of Otsego as the Reviewing Government Unit.
Consideration of the proposed expansion of the WWTF
service area or capacity is a moot issue if the
Darkenwalds do not apply for and receive necessary
Zoning approvals.

Not withstanding the possibility of a mandatory or
discretionary EAW on any proposed development after
the WWTF EAW, consideration should be given to
requiring all information pertaining to the
development in this EAW since the environmental
affects related to the plant expansion appear to
clearly come under the definition of a phased
action in Minnesota Rules 4410.0200, Subp. 60.
Minnesota Rule Subp. 4. indicates that all aspects
of a connected or phased action must be considered
in the EAW. In this case, the resulting
development and its environmental affect is a
phased or connected action. DRAFT
The City believes that since it has not received a
development application documenting proposed land
uses, service areas, and WWTF capacity from the
Darkenwalds that it is unable to fully evaluate the
proposed WWTF expansion. Lacking a complete
development application the City feels that the
Darkenwald's are unable to show a need for
expansion of their existing WWTF, which is related
to an existing land use which has been found to be
consistent with the City's Comprehensive Plan and
Zoning Ordinance. Until a land use and a service
area for the Darkenwald WWTF are established
through approval of a development application by
the City of Otsego, the EAW is substantially
incomplete in that it does not properly address
Item 9, Land Use; Item 19.a., Water Quality -
Wastewaters; Item 23, Vehicle -related Air
Emissions; Item 28, Compatibility with Local Plans
& Regulations; Item 29, Impact on infrastructure
and public services; and Item 30, Cumulative
Impacts.
Minnesota State law requires that a local
government make a decision upon a development
application within 60 days (or 120 days with an
extension) of the submission of a completed
application. This means that a finding by the MPCA
that the Darkenwald's EAW permit application must
be completed will not unduly delay the Darkenwald's
plans. The City of Otsego has ended its moratorium
on new subdivisions so nothing precludes the
Darkenwalds from making an application immediately.

2) 1970's CONDITIONAL USE PERMIT. The language in
the draft EAW infers that the Darkenwalds are
entitled under the 1970's Conditional Use Permit
(CUP) to proceed with development of their
undeveloped lands. This is a misrepresentation in
that the City of Otsego does not recognize and
there are no development rights associated with any
past CUP for the Darkenwald properties.
Development of the Darkenwald properties is
required to conform to all current Policies, Plans,
and Ordinances of the City, subject to review and
approval of the City Council. DRAFT
3) LOWER COST ALTERNATIVE. Economic considerations
ought not to be used as the basis for determining
the service area and capacity of the Darkenwald
WWTF as it is not a criteria outlined in the EAW
and cannot be used as a basis for land use
decisions. Further, the Darkenwalds have claimed
that they can provide lower cost sewer service to
their property. This may or may not be true, but
is not relevant to the land use and planning issues
that are at the heart of the question for WWTF
expansion need. Provision of sanitary sewer within
a community is not a service that is awarded to the
low bidder. The City has established municipal
sewer and water utilities and any extension of
utilities cannot be done without City approval.
4) EXPANDED SERVICE AREA. If the City does not
approve the expansion of the Darkenwald sewer
service area, the City sees no reason why the
Darkenwald WWTF expansion and additional discharge
levels should be approved.
5) NO ACTION ALTERNATIVE. The City does not
understand the basis for the statement that
reliability and flexibility in operating the WWTF
would decrease under a No Action alternative. The
Darkenwalds have maintained to the City that the
WWTF is capably operated and never had a problem.

statement. Please also provide justification for
the statement that there would be increased
opportunities for "operational failure" and a
decrease in "effluent quality" under the No Action
alternative.
6) LOCAL SEWER SERVICE PLAN. The Darkenwald
property not currently served by the existing
Darkenwald WWTF is included in the Otsego Sanitary
Sewer Service District. The City has received all
necessary MPGA approvals and is in the process of
constructing municipal sanitary sewer and water
systems to provide service to lands, including the
Darkenwald properties, within the said Sanitary
Sewer Service District. The Otsego sanitary sewer
and water systems are expected to be operational by
fall, 1999.
The proposed expansion of the Darkenwald WWTF
service area will effect the City of Otsego's
Sanitary Sewer Service District by overlapping
planned service areas. In this regard, the
proposed expansion of the Darkenwald WWTF and
service conflicts with the local sewer plan. As
noted above, the City has established municipal
utilities and must approve any expansion of other
utilities into the City's designated service area.
The City of Otsego is unable to evaluate the
conflict between the municipal Sanitary Sewer
Service District and the expanded Darkenwald WWTF
in the absence of a development application. As
such, the EAW is incomplete with regard to the
consistency of the project with the local sewer
service policy plan in that resolution of this
issue is undetermined. Throughout the EAW the land
on both sides of Highway 101 is referred to as the
"Darkenwald property" even though it is owned by
various entities and irregardless of the fact that
ownership can be transferred at any time. This
raises a substantial issue as to whether or not the
facility is "private" or "public". The City
remains the local authority for utilities within
its boundaries and must approve any expansion of

"other" utilities within its boundaries whether
public or private. DRAFT
Pursuant to the above, the City of Otsego
respectfully requests that either a positive
finding of significant environmental impact be made
based upon the issues raised above, or,
alternatively, that a determination be made that
insufficient information has been provided for
review and any declaration be postponed for a
thirty day period pursuant to Minnesota Rule
4410.1700, Subp. 2a.

They can give their address as Elk River, Albertville, Rogers, etc but they should state
Some place that they live in Otsego.
Dayton wasn't too sure if they would continue in the program. Their new mayor is
cutting back on expenses, even the police, and they may not have the money to continue.
They did say if they do drop out next year that a few years down the road they may be
back again. Dayton pays $3,000 yearly and the rest of the board felt the rest of us that
stay in would have to pick up that cost.
Jeff did have a list of things that he thought we should be thinking about, such as adding
another staff person and expanding some of the programs. Also a better computer
program so they can set up the programs in the different areas or schools without sending
the people to those schools to register.
This year they will be having more outdoor field scheduling so the ball fields, etc will be
available when they want them for the pre -season practice. I believe Judy will have the
list here for Otsego.
Attached is a Resolution of the Community Recreation Board: I did not know about this
as I missed the last meeting. This is just and "idea" that they wanted passed. If they
build someplace it would cost 3.5 million and all communities will be expected to pay
along with the school district. I told them Otsego would have to see this first before we
would commit to anything like 3.5 million.

Resolution of the Community Recreation Board:
Whereas there has been a joint powers agreement between District 728 and several municipal
and township governments in place since 1992 to provide a jointly funded comprehensive
recreation program known as Community Recreation, and
Whereas each member entity has representation on the Community Recreation Board which
provides governance of Community Recreation, and
Whereas since its inception, the Community Recreation program has been housed at the
Community Education Center, 1230 School St. Elk River, and
Whereas the Community Education Center needs approximately $500,000 in renovations to be
compliant with current building codes, and the Community Education Advisory Council has
recommended that the building be abandoned rather than remodeled at a cost of $500,000, and
Whereas Early Childhood Special Education (ECSE)programs housed in K-12 schools have an
on-going history of relocation and loss of spaces to other K-12 programs, and
Whereas the Early Childhood Family Education (SCFE) program housed at Handke has lost
space to the growing K-12 population, and
Whereas as the population growth in the district continues at 4-5%, the populations served by
early childhood programs will grow by 40% in the next seven years, and
Whereas SCFE now serves more than 50% of all families with early childhood children, and
population growth will result in greater participation interest, not less, and
Whereas Community Education and Community Recreation programs serve the entire district
population (now over 37,000), not just a portion. Many of these participants have no children
in public schools but derive benefits from the facilities through their participation in
Community Education and Community Recreation programs, and
Whereas construction of a joint facility for Community Education, Community Recreation,
ECFE, ECSE and Head Start could be more economical because co -location grants from the
Minnesota Dept. of Children Families and Learning of up to $500,000 may be available for
new construction or for renovation provided a local dollar for dollar match is provided, and
Whereas such a joint facility may increase the likelihood of partnerships with municipalities
with the connections of Community Education and Community Recreation, and
Whereas there are several examples from Minnesota communities of municipal/ school district
partnerships on school and community facilities, and
Whereas staff from Community Recreation, Community Education, Early Childhood Family
Education and Early Childhood Special Education have developed a proposal for a Family
Center which would meet the long-term facility needs of all these programs in an effective,
joint way, and
Whereas Independent School District 728 has been and continues to be involved in a
comprehensive facilities study which will lead to a bond issue to solve urgent space needs in
the district, and
Whereas the Independent School District 728 School Board's Facilities Assumptions (May 20,
1998) includes partnership language: "the district is open to all community partnerships...",
Therefore, the Community Recreation Board resolves that it endorses the provision of a 30,000-
40,000 "Family Service Center" in the central part of the school district which would
provide/ include:
•majority of SCFE, ECSE staff offices, central reception function for Community
Recreation, Community Education, ECFE, ECSE and early childhood screening
*multiple rooms designed for early childhood programs (SCFE, ECSE, Head Start)
*adult rooms/meeting spaces for parent discussion, adult enrichment, ABE, computer
lab
*spaces for school age child care including school day care for kindergarten
• large motor (gym) area for pre-school to adult programming
*indoor play area, outdoor play area
• daytime meeting spaces for curriculum, staff development, speakers, events, etc.
*large meeting space for daytime/evening school board and other meetings
It further resolves that it endorses construction of smaller service centers in the north and
south of the district consisting of approximately six rooms in conjunction with school
construction/ renovation or municipal construction projects. These centers would provide
long-term dedicated space for Early Childhood, Community Education and Community
Recreation programs well into the future.
It further resolves that any of the following approaches to providing the Family Service Center
and the two smaller service centers:
-new construction of a stand-alone facility
•new construction included as part of other public/private partnerships—swimming
center, arts center, community center, Minnesota Sports Federation facility, City
Hall, etc.
renovation/ addition at a current school (provided spaces are designed for this use
and protected long-term)
•new construction --as part of a new elementary or secondary school (dedicated long-
term space)
