Mayor Fournier called the meeting to order at 6:38 PM.

CM Wendel added under Item 9.c. Community Rec. and River Rider Discussion.
CM Ackerman motioned to adopt the June 14, 1999 City Council Agenda as
amended. Seconded by CM Berning. All in favor. Motion carried.
3_ Consider Minutes:

CM Berning motioned to adopt the Minutes. Seconded by CM Wendel. All
in favor. Motion carried.

C. June 1. 1999 Odean Avenue Hearing Minutes
CM Berning motioned to adopt the Minutes. Seconded by CM Ackerman.

4. Onen Forum:
4.1. Any Open Forum.
Stan Schuster of 13984 85th Street stated he would like to split his property. He owns 6
to 8 acres with a street entrance on the backside.
Mayor Fournier directed Mr. Schuster to contact Mike Robertson or Elaine Beatty to set
up an appointment to discuss his request.

CM Wendel motioned to award the $2,595,000 General Obligation Sewer and
Water Revenue Bonds of 1999, Series A, providing for their issuance to US Bancop,
Piper Jaffray Norwest Inv. Serv. Seconded by CM Ackerman. All in favor. Motion
carried.
Mayor Fournier motioned to award the $1,800,000 General Obligation
Improvement Bonds of 1999, Series B, providing for their issuance to US Bancop,
Piper Jaffray Norwest Inv. Serv. Seconded by CM Berning. All in favor. Motion
carried.
2. 1999 Cash Flow Projection - Gary Groen. City Accountant_
This item will be on the next City Council Meeting.
5. Consent Agenda

6. Dan Licht. City Planner:
Mr. Licht presented the Planner's Report.
6.1. Consider applicant Frank P and Annick C Muller. 8416 Oakwood Ave

a. A Conditional Use Permit to consider relocation of a building
(residential dwelling) in an R-3 Residential Zoned Area.
CM Berning motioned to approve the Conditional Use Permit to allow relocation of
an existing single family structure to Lot 3, Block 1, Vasseur's Oak Grove Estates,
3rd Addition subject to the conditions listed in the Findings of Fact. Seconded by
CM Ackerman. All in favor. Motion carried.

Dan Licht presented the Planner's Report. Larry Koshak went over the Engineering
Review and Comments.
a. Comprehensive Plan Amendment re: Lower Density,
CM Berning motioned to adopt Resolution No. 99 amending the
Comprehensive Plan Land Use Plan Map to designate change the Land Use
Designation from medium/high density residential to low density residential land use
for the purpose of subdividing single family lots as part of the Prairie Creek
Preliminary Plat. Seconded by CM Wendel. All in favor. Motion carried.
h Rezone from A-1 General Ag Rural Service District to R-4
Residential - Urban Single Family District and R-5 Residential -
Single and Two Family District.
CM Berning motioned to adopt Ordinance No. , amending the Zoning

Ordinance of the City of Otsego to provide for a change in Zoning Classification for
property included as part of the Prairie Creek Preliminary Plat. Seconded by CM
Wendel. All in favor. Motion carried.
C. PUD/CUP (Manned Unit Development/Conditional Use Permitl
to allow unit and base lot subdivision.
CM Berning motioned to approve the PUD/CUP Concept Plan for the development
of residential twin home dwellings subject to the conditions listed in the Findings of
Fact. Seconded by CM Wendel. All in favor. Motion carried.
d. Pre iminary Plat.
CM Berning motioned to approve the Preliminary Plat entitled "Prairie Creek"
consisting of 118 single family lots and one outlot conceptually planned for
development of twin home residential dwellings subject to conditions listed in the
Findings of Fact. Seconded by CM Ackerman. All in favor. Motion carried.
7. Larry Koshak City Engineer:
7.1. Consider Resolution ordering the improvement of Odean Avenue,
CM Berning motioned to adopt Resolution No. 99 - ordering Improvement and
Preparation of Plans for the Odean Avenue Project. Seconded by CM Ackerman.
All in favor. Motion carried.
7.2. Consider Resolution ordering Overlays of City Streets,
CM Berning motioned to adopt Resolution No. 99 - ordering Improvement and
Preparation of Plans for Otsego 1999 Bituminous Overlay Program Seconded by
Mayor Fournier. All in favor. Motion carried.
7 Consider approval of partial 12ayment to Barbarossa & Sons in the,
amount of S 166,107 50 for Trunk Sewer and Water Project,
COP 98.04,
CM Wendel motioned to approve partial payment of $166,107.50 to Barbarossa &
Sons. Seconded by CM Ackerman. All in favor. Motion carried.
Mayor Fournier requested for review and updates of the project when partial payments are
presented to the City for payment.
7.4. Consider approval of final I)ayment to Traut Wels in the amount of
$3.805.19 for construction of Well #2 COP 98.01.
Mayor Fournier motioned to approve final payment to Traut Wells in the amount of
$3,805.19. Seconded by CM Wendel. All in favor. Motion carried.
7.5- Any other EngineeringB us�_in_ess (Discussion of 78th St. EAW).
The City Council agreed for Mike Robertson to write a letter to water tower contractors
regarding construction. CM Wendel requested to find out where the steel was
manufactured.
Larry Koshak estimated the cost for a EAW for 78th Street and Page Avenue, as required
by State Statute, at $2,500.
CM Berning motioned to authorize the City Engineer to proceed with the EAW for
78th Street and a portion of Page and Quaday Avenues. Seconded by Mayor
Fournier. All in favor. Motion carried.

Larry Koshak reported that he and Building Official, Jerry Olson, reviewed several
properties last week. There have been two wetlands that have been drained. One was the
Larson property across from Quale Avenue and the other on the Winter property.
Mayor Fournier motioned for staff to proceed with the appropriate action to restore
these wetlands. Seconded by CM Ackerman.
Voting For the Motion: Mayor Fournier, CM Ackerman, CM Berning.
Voting Against the Motion: CM Wendel.
Motion carried three (3) to one (1).

CM Berning motioned to approve payments for Odean Avenue Easements.
Seconded by CM Ackerman. All in favor. Motion carried.
8.3. Discussion of HRUA Permit Application/Resolution,
Both Andy MacArthur and Mike Robertson went over the options.
Mayor Fournier motioned for Otsego to petition for a Public Informational Meeting
and support Rockford's contested case contingent upon reviewing Rockford's letter.
Seconded by Cl✓I Ackerman. All in favor. Motion carried.
8.4. Discussion of Darkenwald Meeting
Mayor Fournier moved this Item under Item 9.5.C.
R.S. Any other Legal Business_
Mr. MacArthur stated the Condemnation Commissioners will be reviewing the properties
this Thursday and Friday (Water and Sewer Easements).
9. Council Items:
- 9.1- a_ Discussion of Utility y .ost.s_
Mike Robertson went over the Elk River Municipal Utilities letter of May 21, 1999.
CM Berning motioned to approve the cost of $9,000 to Elk River Municipal utilities
for replacing service lines along County Rd 42 as outlined in their letter of May 12,
1999, subject to completion of project. Seconded by CM Wendel. All in favor.
Motion carried.
CM Benning would like to table this until he can review and discuss with the Parks
Commission.
C. Update by CM Wendel (Post Office. Albertville -Otsego
)Water/Sewer and Otsego Creek)- Also discussion of
Community Rec, and River Rider_
Post Office: CM Wendel went over the June 2, 1999 letter from US Postal Service
regarding Otsego residents using Otsego in their mailing address and the letter from
Senator Ourada regarding the same.
River Rider: CM Wendel stated the River Rider Board is talking about allowing
advertising on the buses for revenue. Also discussed was using volunteer drivers.
Otsego Creek: CM Wendel talked to Patty Stalberger, Albertville City Council
Representative. Previously discussed was Albertville helping pay for cleaning the creek all
the way down to the Mississippi. Other council members of Albertville didn't agree with
this.
Water/Sewer Service from Albertville: There are Otsego landowners who want sewer and
water service in order to develop their land. CM Wendel suggested a joint meeting with
Albertville and Otsego to discuss this. The Council agreed for Mike Robertson to contact
the City Administrator in Albertville to set up a meeting.

Community Rec. wants to know Otsego's position on the Community Rec. Program.
CM Bernina stated Otsego needs a Recreational Program. If Elk River takes the program
over he feels that is fine but he would like to see help with the Winter Fest and with the
Halloween Fest. Elk River could also schedule Otsego's ballfields. Otsego could help pay
the difference in higher fees. CM Bernina want Otsego residents to have access to the
activities.
Mike Robertson said he will write a letter to the Community Rec. Board stating Otsego is
interested in staying in the program as long as costs continue to stay similar. If the Joint
Board want to expand, Otsego will want to remain a part of it and the same goes if
Community Ed. takes over. The Council agreed with this.

9.2. Mike Robertson, City Administrator - update:
a. Wastewater Treatment Plant Operator Draft RFP
Mike suggested to place this Item on the next City Council Agenda.
9.3. Elaine Beatty, City Clerk - update
Elaine had no items.
9.4. Judy Hudson, Deputy City Clerk - update
Judy stated the 1999 Clean Up Day Report will be distributed.
CM Berning motioned adoption of the Claims List. Seconded by Mayor Fournier.
