Council of this application for CUP W/conditions in NAC's Report, to allow a move in
home. (See NAC's Findings of Fact)
6.2. Dan Licht's Report of May 18th, 1999 explains the P.C. discussion and information
needed. After review at the Planning Commission Meeting of May 17, 1999. (See

noted that the septic system is being updated.

Findings of Fact
& Decision
Applicant's Name: Frank and Annick Muller
Request: Request for approval of a conditional use permit to allow relocation of an existing
single family structure to Lot 3, Block 1 Vassuer's Oak Grove Estates, 3rd Addition
City Council Meeting Date: 14 June 1999
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact and recommendation:
The legal description of the subject property is:
Lot 3, Block 1 Vassuer's Oak Grove Estates, 3rd Addition
2. The subject property lies within the Long Range Urban Service Area as identified in the
1998 Comprehensive Plan Update.
3. The subject property is zoned R-3, Residential Long Range Urban Service District
(General).
4. Section 20-4-2.F of the Zoning Ordinance directs the Planning Commission and City
Council to consider seven possible adverse effects of the proposed conditional use The
seven effects and findings regarding them are:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The proposed building relocation may be viewed as a positive improvement
by providing a dwelling unit that is larger (with a basement), in better condition and
likely has a higher value than the existing manufactured home. The following
policies support the applicant's request:
The character of individual neighborhoods shall be reinforced, maintained and
upgraded. (Policy Plan, pg. 40)
A high quality residential environment shall be maintained through
rehabilitation or where necessary, redevelopment of substandard units via
private means and/or public action, when feasible. (Policy Plan, pg. 46)
B. The proposed use's compatibility with present and future land uses of the area.
Finding. The area is developed with low density single family residential uses, which
are planned to continue by the Comprehensive Plan. As such, the proposed use will
be compatible with present and future land uses.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding. As noted above, the subject site and relocated structure conform with all
applicable performance standards.
D. The proposed use's effect upon the area in which it is proposed.
Finding. The relocated dwelling and single family use of the property will not have
a negative impact to the area.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: The relocated structure will not generate any additional traffic.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Finding: The proposed use is not anticipated to have a negative impact to the City's
service capacity.
5. The planning report dated 1 June 1999 prepared by Northwest Associated Consultants, Inc.
is incorporated herein.
6. The Otsego Planning Commission conducted a public hearing, at their regular meeting on
7 June 1999, to consider the proposed conditional use permit, preceded by published and
mailed notice. Upon review of the application and evidence received, the Otsego Planning
Commission closed the public hearing and recommended by a 5-0 vote that the City
Council approve the conditional use permit based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested
conditional use permit is hereby approved based on the most current plan and information
received to date, subject to the following conditions:
1. A building permit is applied for and approved by the Building Official prior to relocation of
the structure.
2
2. The relocated structure shall be ready for occupancy within six (6) months from the date
of location on site, subject to approval of the Building Official.
3. The existing septic system and well are evaluated and subject to review and approval of
the Building Official.
4. A security as required by Section 20-19-3 of the Zoning Ordinance as determined by the
building official is posted.

EXECUTIVE SUMMARY
Background
Frank and Annick Muller are proposing to relocate an existing single family dwelling to
their property at 8416 Oakwood Avenue (Lot 3, Block 1, Vasseur's Oak Grove Estates, 3rd
Addition). The proposed building relocation would replace an existing mobile home
located on the subject site. The one acre subject site is zoned R-3, Residential - Long
Range Urban Service District (General). Single family uses are a permitted use in this
District. The relocation of existing buildings to lots within the City requires consideration
of a conditional use permit (CUP) as per Section 19 of the Zoning Ordinance.

Recommendation
The proposed relocation of an existing single family dwelling to Lot 3, Block 1, Vasseur's
Oak Grove Estates, 3rd Addition is generally consistent with the requirements for building
relocations, as well as Comprehensive Plan policies supporting neighborhood
improvements. As such, our office recommends approval of the requested CUP, subject
to the following conditions:

1. A building permit is applied for and approved by the Building Official prior to
relocation of the structure.
2. The relocated structure shall be ready for occupancy within six (6) months from the
date of location on site, subject to approval of the Building Official.
3. The existing septic system and well are evaluated and subject to review and
approval of the Building Official.
4. A security as required by Section 20-19-3 of the Zoning Ordinance as determined
by the building official is posted.
5. Comments of other City Staff.
ISSUES ANALYSIS
Building Relocation. The relocation of existing structures to lots within the City of Otsego
requires compliance with the performance standards outlined in Section 20-19-2, below.
A. Upon relocation, the building shall comply with applicable requirements of the State
Uniform Building Code.
Comment: Building relocations require a building permit prior to moving the
structure. Conformance with the Uniform Building Code should be made a condition
of any approval, subject to review and approval of the Building Official.
B. The proposed relocated building shall comply with the character of the
neighborhood in which it is being relocated as determined by the City Council.
Comment: The neighborhood is fully developed with single family dwellings
consisting of a mix of manufactured housing and stick built structures. The existing
structure to be located to the subject site is a one level structure consistent with this
character.
C. The relocated use will not result in a depreciation of the neighborhood or adjacent
property values.
Comment.- Provided the structure has a similar assessed value as adjacent
dwellings, and conforms to all applicable performance standards, no depreciation
is anticipated.

D. The relocated structure shall be similar to the market valuation of adjacent principal
structures as determined by the City or County Assessor.
Comment: The structure was valued at approximately $65,500 (including a
detached garage) by Anoka County. For comparison, the existing structure on the
lot is valued at less than $20, 000 and the dwellings on the neighboring properties
have an estimated market value of $30,600 and $76,600 ($53,650). The value of
the property following relocation of the structure is therefore likely to increase to a
level consistent with values of neighborhood properties.
E. The relocated structure shall be ready for occupancy within six (6) months from the
date of location on site.
Comment. This requirement should be made a condition of any approval.
Lot Standards. The following table illustrates required performance standards for single
family lots and dwellings in the R-3 District. As indicated, the subject property and
proposed location of the relocated single family house will conform with applicable
performance standards.
Single Family Dwelling Standards. Section 20-17-11 of the Zoning Ordinance outlines
minimum design standards for single family uses. These standards apply to the existing
dwelling to be located on the subject site. The basic requirements are for a perimeter
foundation, minimum dimensions of 30 feet by 24 feet, a shingled roof, and minimum
overhangs of 1 foot. Based upon the information provided by the applicant, the existing
structure is in conformance with these requirements. Additionally, the structure has lap
siding consistent with the requirements of Section 20-17-4 of the Zoning Ordinance.
CUP Criteria. In considering CUP applications, the Planning Commission and City
Council must also take into consideration the possible adverse impacts of the building
relocation based upon (but not limited to) the following factors outlined in Section 20-4-2.F
of the Zoning Ordinance:

Comment. The proposed building relocation may be viewed as a positive
improvement by providing a dwelling unit that is larger (with a basement), in better
condition and likely has a higher value than the existing manufactured home. The
following policies support the applicant's request.
• The character of individual neighborhoods shall be reinforced, maintained
and upgraded. (Policy Plan, pg. 40)
• A high quality residential environment shall be maintained through
rehabilitation or where necessary, redevelopment of substandard units via
private means and/or public action, when feasible. (Policy Plan, pg. 46)
2. The proposed use's compatibility with present and future land uses of the area.
Comment. The area is developed with low density single family residential uses,
which are planned to continue by the Comprehensive Plan. As such, the proposed
use will be compatible with present and future land uses.
3. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Comment: As noted above, the subject site and relocated structure conform with all
applicable performance standards.
4. The proposed use's effect upon the area in which it is proposed.
Comment: The relocated dwelling and single family use of the property will not have
a negative impact to the area.
5. The proposed use's impact upon property values of the area in which it is proposed.
Comment. Although no study has been completed, the proposed use is not
anticipated to negatively impact area property values.
6. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Comment: The relocated structure will not generate any additional traffic.
7. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's
service capacity.
Comment. The proposed use is not anticipated to have a negative impact to the
City's service capacity.

Septic System. The City's policy for relocated structures requires an evaluation of the
existing septic system and well. These element are subject to review and approval of the
Building Official.
Security. Section 20-19-3 of the Zoning Ordinance requires that a security escrow be
posted for the relocation of existing structures. This security is required primarily to cover
any costs that may be incurred due to damage of public facilities or infrastructure during
the relocation. Such a security as determined by the building official must be required as
a condition of approval.
CONCLUSION
The applicants' request to replace their existing mobile home unit with an existing single
family unit relocated from another lot is generally consistent with all applicable
performance standards. Further, the applicant's request is, in our opinion, a valuable
improvement to the property that will benefit the neighborhood as well. Such
improvements are encouraged by the Comprehensive Plan as a means of improving the
quality of the existing housing stock and neighborhoods within the community. Our
specific recommendation is outlined in the executive summary of this report.

The engineering issues are reviewed in Larry Koshak's report of May 13, 1999
(See Attached). Mr. Koshak noted that most of the issues are solvable and he can
recommend approval. He explained the issues in his report, including the statement that
the County would not allow an access to County Road #42.

Greg Strommen - 8433 Palmgren Ave NE - Questioned why the twinhomes.
Maybe should have all single family units.
Mr. Licht stated that portion of the land was guided in Otsego's Comprehensive Plan for
medium density development.
Mr. Robertson noted that a Comprehensive Plan amendment is needed because this plat
actually has less density than called for in the Comprehensive Plan.
Hearing brought back to Planning Commission.
Mr. Goenner - Would like the City Engineer's comments on setting up an
emergency access to County Road #42.
Mr. Koshak said that in most cases it is not practical. The other option is an emergency
route from 78th Street to the cul-de-sac. Two accesses to the subdivision are needed for
safety and traffic circulation. As the density of the twin home area is higher, it should be
connected to the other neighborhoods. He suggested an access to the N. cul-de-sac by the
multi -family twin home area. He said that widening the entrance with an entrance median
is also worth looking at.
Christian Mbanefo asked if a 4 -lane entrance was appropriate for this density?
Mr. Licht noted that an emergency access is common but the width is the safety concern.
Mr. Robertson said he met with the school district regarding trail access to the
south side of the school and no decisions have been made yet. He thought the trail would
go from the north road between two lots.

Mr. Plowe - Some areas of the back yards are being used for stormwater treatment
and nerp ponds at a 10 to 1 slope grade and so would be unsuitable for a trail.
Eugene Goenner - Has a concern whether the high density and low density areas
should be connected. He also was concerned with the amount of cul-de-sacs and would
like some eliminated.
Mr. Licht said they could recommend a connection as part of approval.

Dennis Ulmer, Developer, felt strongly that the design should not be changed. He
also indicated he didn't want a road connection between the single family and multi -family
areas as it would have a dramatic affect on both sides of the creek due to topography and
ponding concerns.

Discussion: Cul-de-sac issue has to be resolved, along with a decision if the high-density
area is to be connected to single family residential area, and how to provide a second
entrance into the high density area.
Mr. Goenner noted that there are viable options other than connecting the two
uses. They could use a divided entrance or emergency entrance on to County Road 42 if
it is OK'd by Wright Co.
Mr. Nichols - Did not feel with this plan we should connect the two uses. Planning
Commission members were in consensus to not connect the two areas.
Mr. Ulmer was told that a cul-de-sac length change could be a variance and that it
would be a public hearing before the Planning Commission.

Elaine Beatty noted that the proper publishing, postings and mailings had been
completed.
Dan Licht reviewed NAC's Planning Report dated May 12, 1999 (See attached).
NAC is not recommending approval at this time.
Larry Koshak reviewed his report dated May 3, 1999 (See attached). He noted
that he could not make a recommendation due to lack of information.
Mike Robertson gave the Parks and Recreation report in which they recommended
a sidewalkfbike trail be put on Kadler from County Road 39 to the north.
Chris Bulow gave an overview of his project. The parcel is 82 acres plus. There
are 20 single family lots proposed. There are some dramatic topography changes which
put limits on development, but are good for a golf course. Kadler Ave. will be improved
by them from their lot line south to County Road 39. He met with the Park Board and
they recommended a trail (bike/walking) on the west side of Kadler. A park next to a golf
course is extremely dangerous and not realistic. He is on a fast track schedule to
construct the golf course. He would like to grade and seed by the middle of August in
order to open in June 2000.

Ulmer Construction Inc. has submitted a preliminary plat for a 186 unit subdivision entitled
Prairie Creek, consisting of 118 single family units and 68 twin home units. The 83.7 acre
parcel is located south of CSAH 42 and west of Quaday Avenue, to the south of Otsego
Elementary. The subject property is within the Sanitary Sewer Service District and is
zoned A-1, Agricultural Rural Service District. This project is intended to be serviced by
municipal sanitary sewer and water systems. Development of this project will require the
following approvals:
1. Comprehensive Plan amendment re: density
2. Zoning amendment to R-4 District for urban single family uses.
3. Zoning amendment to R-6 District for urban twin home uses.
4. PUD -CUP to allow unit/base lot subdivision for twin home units.
5. Preliminary Plat.

Recommendation
The decision as to the appropriate use of land as guided by the Comprehensive Plan and
implemented through application of the Zoning Ordinance is a policy issue that must be
determined by City Officials. Therefore, our office makes no specific recommendation
regarding the Comprehensive Plan amendment or Zoning Ordinance amendment
applications. The requested Comprehensive Plan amendment and Zoning Ordinance
amendment are generally consistent with the specific provisions of the Comprehensive
Plan for development of a range of housing types within the Sanitary Sewer Service
District. If City Officials make a similar finding in consideration of the established policies
of the Comprehensive Plan and adopted Ordinances, the respective applications may be
approved.
If the City Council approves the Comprehensive Plan amendment and Zoning Ordinance
amendment, the Prairie Creek Preliminary Plat and PUD -CUP twinhome concept plan
applications may be considered. The submitted preliminary plat and PUD -CUP twinhome
concept plan generally satisfies the applicable performance standards of the Zoning
Subdivision Ordinance. Therefore, our office recommends approval of the Prairie Creek
Preliminary Plat and PUD -CUP twinhome concept plan subject to the conditions listed
below under items A.4 and A.5. The Planning Commission and City Council have the
following options for action on the submitted applications:
A. Approval (each approval should be made as a separate motion):
Motion to amend the Comprehensive Plan to guide the east 43.7 acres of the
subject site for low density residential development.
2. Motion to rezone the single family residential portion of the Prairie Creek
Preliminary Plat from A-1 District to R-4 District.
3. Motion to rezone the twin home portion of the Prairie Creek Preliminary Plat
from A-1 District to R-6 District.
4. Motion to approve a PUD -CUP Concept Plan for development of 68 twin
home units in a base lot / unit lot configuration, subject to the following
conditions:
a. Approval of a PUD -CUP Development Stage application
5. Motion to approve the Preliminary Plat for Prairie Creek, subject to the
following Conditions:

a. Proposed access to CSAR 42 is subject to review and approval of the
Wright County Highway Department.
b. The proposed access to Quaday Avenue shall be subject to review
and approval of the City Engineer.
C. The preliminary plat is revised to designate lot and block numbers for
the proposed twin home units.
d. The preliminary plat is revised such that all cul-de-sacs are not longer
than 500 feet.
e. All park and trail dedication requirements are satisfied at the time of
final plat approval.
f. The proposed street names shall be revised in accordance with the
County naming pattern and City Policies, subject to review by the
Planning Commission and approval of the City Council.
g. A landscape plan be submitted for all proposed ponding areas
providing appropriate low maintenance plantings in areas subject to
intermittent flooding.
h. An EAW is prepared (if determined to be necessary) and processed
pursuant to Section 39 of the Zoning Ordinance.
A phasing plan is submitted for anticipated development of the
subdivision.
Comments of Other City Staff.
B. Motion to deny the proposed Zoning Ordinance amendment based upon a
finding that the proposed use is inconsistent with the provisions of the
Comprehensive Plan and adopted Zoning and Subdivision Ordinances.
C. Motion to table the application (specific direction should be provided to the
applicant regarding necessary information to be submitted for the Planning
Commission and/or City Council to act on the application).

ISSUES ANALYSIS
Comprehensive Plan. The Comprehensive Plan guides the east 43.7 acres of the
property for medium-high density development, with the west 40 acres designated for low
density residential development. The Comprehensive Plan defines medium -high density
development as at least 5 d.u./ac. The proposed density of the twin home portion of the
project is 3.24 d.u./ac. As such, a Comprehensive Plan amendment is necessary to
designate the entire parcel for low density residential use. Although the twin home
element does not qualify as medium-high density, the Comprehensive Plan identifies this
type of dwelling unit as an intended development in this area. The addition of twin home
units is highly positive in that it introduces a new dwelling unit type into the housing stock
in Otsego, which is promoted by the Comprehensive Plan. The following policies from the
Comprehensive Plan should be cited either in support of or against the requested
Comprehensive Plan amendment:
• The development of patio homes... to supplement existing conventional single
family homes shall be recognized giving due consideration to local market
demands. (Policy Plan, pg. 45)
• The City Shall provide housing opportunities which attract persons of all ages and
income levels and which allows them the ability to maintain residence within Otsego
throughout the various stages of their lives. (Policy Plan, pg. 46)
• A balance in the availability of quality housing choices throughout the City shall be
maintained. (Policy Plan, pg. 46)
• A mix of housing types in a manner consistent wit the City's land use plan shall be
developed. (Policy Plan, pg 46)
Zoning. The subject property is zoned A-1 District. Platting of the single family portion
of the plat requires rezoning to R-4, Residential - Urban Single Family District. The
development of the proposed twin homes requires a rezoning to R-6, Residential -
Townhouse, Quadraminium, and Low Density Multiple Family District. In considering
requests for rezoning, Section 20-3-2.F of the Zoning Ordinance directs the Planning
Commission and City Council to consider the following factors as part of their decision:
1. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Comment. The Comprehensive Plan guides the subject parcel for urban density
development. Provided the City Council approves the requested Comprehensive
Plan amendment, the rezonings are consistent with the Comprehensive Plan. The
same policies noted above may be cited in support of the requested rezonings.
2. The proposed use's compatibility with present and future land uses of the area.

Comment. This area is planned for urban density residential development. Adjacent
parcels are anticipated to develop with similar land uses. In the interim, the urban
density development is anticipated to be compatible with the rural land uses guided
by the Comprehensive Plan.
3. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Comment: The preliminary plat's consistency with applicable performance standards
will be evaluated in subsequent paragraphs.
4. The proposed use's effect upon the area in which it is proposed.
Comment. The proposed development will not have an negative impact to the area
in that the use is anticipated and will be developed within all performance standards.
5. The proposed use's impact upon property values of the area in which it is proposed.
Comment: Although no study has been completed, the proposed use is not
anticipated to negatively impact area property values.
6. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Comment: The preliminary plat is to be adequately served by public streets serving
the property.
7. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's
service capacity.
Comment. The Comprehensive Plan anticipated the development of the proposed
use. Therefore, the preliminary plat is not anticipated to have a negative impact to
the City's service capacity.
Preliminary Plat. The following paragraphs outline issues specific to consideration of the
single family portions of the preliminary plat. In general, it should be the City's philosophy
to allow cul-de-sacs only when physically necessary. Cul-de-sacs are discouraged from
the perspective that they reduce neighborhoods to small groupings of lots, while adding
to service needs. To this end, the applicant has been encouraged by the Planning
Commission and City Staff to reduce the number of cul-de-sacs. Revisions to the
preliminary plat consist of eliminating one cul-de-sac to provide a connection to the
property to the west. Our office would recommend that more of the existing cul-de-sacs
could be eliminated from the proposed plat.

• Access. The twin homes are to have access via proposed intersections with CSAH
42, designated as a minor arterial, and Quaday Avenue, designated as a collector
street. Section 21-7-7.N of the Subdivision Ordinance requires at least 500 feet of
separation between intersections to arterial and collector streets. The distance
between the street access to Quaday Avenue and future 78th street is slightly less
than 500 feet and will need to be approved by the City Engineer. There are to be
two accesses with future 78th Street to serve the single family units In addition,
there is one connection made to land west of the subject parcel, which is planned
to develop with single family lots. The school property to the north is a physical
barrier that prevents any connection in this direction.
• Blocks. In order to provide for traffic circulation and an integrated development
pattern, Section 21-7-3 of the Subdivision Ordinance limits block length to 1,200
feet. Block 1 exceeds this requirement. A through street could be provided in the
area of the proposed cul-de-sac, although there are ponding areas that could justify
the longer block length. Proposed Block 2 has a length over 3,500 feet, which is
due to the school property and drainage ditch, which are physical barriers
warranting a longer block length.
The preliminary plat does not include a block designation for the proposed twin
homes. The preliminary plat should be revised to indicate that the twin home units
are Block 5 of the Prairie Creek Preliminary Plat, with lots numbers for each lot.
The common open space should be plated as an outlot.
• Right-of-ways. The streets illustrated within the preliminary plat provide a 60 foot
right-of-way and cul-de-sac streets are provided 60 foot radius, as required by the
Engineering Manual. Section 21-7-6 of the Subdivision Ordinance limits the
lengths of cul-de-sacs to 500 feet. Two cul-de-sacs illustrated on the preliminary
plat exceed 500 feet, including "Fisherman's Court" and "Prairie Creek Alcove".
The preliminary plat should be revised to reduce the length of these cul-de-sacs or
eliminate them by extending the street through.
• Lot Performance Standards. For the single family developments, the R-4 District
requires a minimum 12,000 sq. ft. lot size and minimum 75 ft. lot width at the
setback line. Section 21-7-6 of the Subdivision Ordinance requires that the
minimum lot width is increased to 94 feet for lots on the turn around of a cul-de-sac.
The proposed single family lots range in size from 12,021 sq. ft. up to 60,386 sq.
ft., with an average lot size of 17,139 sq. ft. All of the proposed lots meet the
minimum 75 ft. lot width requirement and all lots on the radius of a cul-de-sac are
at least 94 feet wide. All of the proposed single family lots also meet the minimum
100 foot depth requirement.

The R-6 District requires a minimum 7,500 sq. ft. of lot area per unit for the twin
home portion of the project. Based upon 20.95 acres and 68 units, there is
approximately 13,420.3 sq. ft. per unit. Therefore the lot area per unit requirement
is satisfied.
• Setbacks. The setbacks of the R-4 District and R-6 District are illustrated below.
Within the twinhome portion of the project, the setbacks apply only at the periphery
of the project. Internal setbacks for the twinhome project are based upon structure
height. All proposed lots have sufficient buildable area within required setbacks.
Front/Side Corner: 35 feet (local street)
65 feet (collector/arterial street)
Side: 10 feet
Rear: 20 feet
• Twin Home Concept Plan. The preliminary plat includes a concept plan for
development of 68 twin home units. The proposed layout of the units is generally
appropriate at a concept level. The only concern is the proximity of second
structure on the east side of Farm Road and a unit on Prairie Creek Alcove. The
rear of each unit face each other and the separation between these two units is only
50 feet. In order to provide greater privacy, one or both of these units should be
reoriented or a landscape buffer provided at the time of General Plan application.
More detailed plans will be expected as part of a development stage PUD
application, which will allow a more detailed review.
• Parks and Trails. No dedication of parkland is proposed as part of this plat. The
applicant will be required, therefore, to make an appropriate cash donation in lieu
of land to the City's Park and Trail fund at the time of final plat approval as required
by Section 21-7-18 of the Subdivision Ordinance.
• Street Names. The preliminary plat includes proposed street names which are
inconsistent with the City's street naming pattern and policies that are outlined in
Section 21-7-7.Q of the Subdivision Ordinance. Street names should follow the
County naming pattern. North -south routes are to be designated as "avenues" and
east -west routes as "streets". Cul-de-sacs less than 300 feet should continue the
street designation of the intersecting street.
• Ponding Areas. The preliminary plat includes several stormwater ponding areas
for which a landscape plan should be provided. A landscape plan should be
submitted for planting materials within the drainage easement. The landscape plan
should provide low maintenance vegetation in the areas subject to intermittent
flooding to ensure that the area does not result in a negative visual impact.

• EAW. An EAW may need to be processed for this project depending on the
Environmental Quality Board's certification of the City's Comprehensive Plan. If
required, the EAW shall be subject to the provisions of Section 39 of the Zoning
Ordinance.
• Grading, Drainage and Utility Plans. These plans have been submitted and are
subject to review and approval of the City Engineer.
• Phasing Plan. If the project is to be developed in phases, the applicant will be
required to provide a phasing plan. Although subject to market conditions, the
phasing plan will aid the City in its service and infrastructure planning efforts.
• Development Contract. The applicant will be required to enter into a development
contract with the City and post all required escrows, subject to review and approval
of the City Attorney.
CONCLUSION
The decision as to the appropriate use of land as guided by the Comprehensive Plan and
implemented through application of the Zoning Ordinance is a policy issue that must be
determined by City Officials. The requested Comprehensive Plan amendment and Zoning
Ordinance amendment are generally consistent with the specific provisions of the
Comprehensive Plan for development of a range of housing types within the Sanitary
Sewer Service District. If City Officials make a similar finding, the respective applications
may be considered appropriate.
The submitted Prairie Creek Preliminary Plat and PUD -CUP twinhome concept plan
generally satisfies the applicable performance standards of the Zoning and Subdivision
Ordinances. Outstanding issues that must be addressed are limited to cul-de-sac length
and approval of grading, drainage and utility plans. Additionally, it is our recommendation
that the plat should be further revised to eliminate cul-de-sacs by providing through streets
where feasible. Our Specific recommendation is outlined in the Executive Summary of this
report.

LOT BUILDABILITY

STREETS
1. Soil borings need to be performed for the site to verify street design. A soils report

road onto CSAH 42. A grading plan must be submitted and sent to the County for
their review. City policies on intersection spacing for collector and arterial streets
require wider spacing for CR 42.
COMMENT 5/13199: In a meeting with the County Engineer, it was determined
that the distance for an access to CSAH 42 must be 1320'
away from any other street entrance, so the entrance shown
will not be allowed. Farm Road must end as a cul,de-sac
unless connected with Prairie Creek Alcove. We request the
revised layout be submitted.
ADDITIONAL TRAFFIC/ACCESS ISSUES (5113/99);
3. Prairie Creek Alcove does not meet the 500' minimum cul-de-sac length
requirement.
4. Farm Road cut -de -sac's at Sta 13+00 to 14+00 will not meet 500' length cul-de-
sac. An option would be to extend Prairie Creek Drive across the creek to Farm
Road. This also gives the townhome phase of the plat two access ,points. Two

The Planning Commission held a public hearing at their meeting on May 17, 1999 to
consider the above reference plat. It was clarified at this meeting that the applicant is not
seeking preliminary plat approval of the twin home concept at this time.
As such, our office recommended that the requested Comprehensive Plan amendment and
rezoning requests only be considered for the single family portion of the project.
Maintaining the medium density designation for future land use and interim A-1 District
zoning will protect the City's review authority with regard to the twin home project to ensure
that it is consistent with the Comprehensive Plan. The Planning Commission was
generally supportive of the proposed subdivision in terms of Comprehensive Plan
consistency and rezoning the single family portion of the project to R-4 District. Motions
to recommend approval of these applications were approved unanimously by a vote of 7-0.
The Planning Commission also considered the PUD -CUP Concept Plan application for the
twin home portion of the project. There will need to be modifications to the concept plan
because the access to CSAH 42 needs to be eliminated. However, the Planning
Commission was favorable to the concept and the opportunity to resolve the access issue
as part of a development stage application. One item that was discussed regarding
access was a preference of the Planning Commission not to have a connection between
the two elements of the Preliminary Plat.
The Planning Commission discussed several elements of the proposed preliminary plat,
including the number of cul-de-sacs, the need for a trail access to the school property and
length of the Fisherman's Court" cul-de-sac. The majority of the Planning Commission
was comfortable with the layout of the preliminary plat. The trail connection to the school
property is an issue that is still being discussed with School Officials. This issue may
ultimately need to be resolved at the time of final plat consideration.

The Planning Commission was of the opinion that the length of the cul-de-sacs should
adhere to the 500 foot limit. Unless the preliminary plat is revised to provide the revised
cul-de-sac length, a variance will need to be processed in advance of a final plat
application. Variance from the Subdivision Ordinance requires the applicant to
demonstrate the same physical hardship as required in a zoning variance. In that this is
a new plat, it is difficult to conceive a physical hardship that would warrant variance.
In review of the preliminary plat, the Planning Commission voted 6-1 to recommend City
Council approval, subject to the conditions outlined in the planning report. As part of any
City Council approval of the preliminary plat, our office and the City Attorney are also
recommending that an additional condition be included stating that preliminary plat
approval does not guarantee sanitary sewer service capacity. Such service capacity is
only to be guaranteed for final plats or with a financial commitment. It is anticipated that
developers may elect to make such a financial commitment as part of the development
contract.
In considering the applications, the City Council has the following three options. Option
A, approval of the applications, reflects the recommendation of the Planning Commission
and City Staff. Appropriate Resolutions, Ordinances and/or findings of fact have been
attached as exhibits.
A. Approval (each approval should be made as a separate motion):
1. Motion to approve a resolution amending the Comprehensive Plan to guide
the entire single family portion of the subject site for low density residential
development.
2. Motion to approve a Zoning Ordinance amendment rezoning the single
family residential portion of the Prairie Creek Preliminary Plat from A-1
District to R-4 District.
3. Motion to approve a PUD -CUP Concept Plan for development of 68 twin
home units in a base lot / unit lot configuration, subject to the following
conditions.-
a.

C. The proposed access to Quaday Avenue shall be subject to review
and approval of the City Engineer.
d. The preliminary plat is revised to designate the proposed twin home
units as Outlot A.
e. The preliminary plat is revised such that all cul-de-sacs are not longer
than 500 feet.
f. All park and trail dedication requirements are satisfied at the time of
final plat approval.
g. The proposed street names shall be revised in accordance with the
County naming pattern and City Policies, subject to review by the
Planning Commission and approval of the City Council.
h. A landscape plan be submitted for all proposed ponding areas
providing appropriate low maintenance plantings in areas subject to
intermittent flooding.
An EAW is prepared (if determined to be necessary) and processed
pursuant to Section 39 of the Zoning Ordinance.
k. A phasing plan is submitted for anticipated development of the
subdivision.

B. Motion to deny the proposed Comprehensive Plan amendment and Zoning
Ordinance amendment based upon a finding that the proposed use is
inconsistent with the provisions of the Comprehensive Plan and adopted

Zoning Ordinance (i.e., parking, loading, noise, etc.).
Comment: The preliminary plat is consistent with applicable performance standards..
D. The proposed use's effect upon the area in which it is proposed.
Comment: The proposed development will not have an negative impact to the area
in that the use is anticipated and will be developed within all performance standards.
E. The proposed use's impact upon property values of the area in which it is proposed.
Comment: Although no study has been completed, the proposed use is not
anticipated to negatively impact area property values.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Comment: The preliminary plat is to be adequately served by public streets serving
the property.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Comment: The Comprehensive Plan anticipated the development of the proposed
use. Therefore, the preliminary plat will not have a negative impact to the City's
service capacity.
6. The planning report dated 10 May 1999 prepared by Northwest Associated Consultants,
Inc. is incorporated herein.
7. The Otsego Planning Commission conducted a public hearing, at their regular meeting on
17 May 1999, to consider the proposed conditional use permit, preceded by published and
mailed notice. Upon review of the application and evidence received, the Otsego Planning
Commission closed the public hearing and recommended by a 7-0 vote that the City
Council approve the conditional use permit based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested Zoning

• A mix of housing types in a manner consistent wit the City's land use plan
shall be developed. (Policy Plan, pg 46)
B. The proposed use's compatibility with present and future land uses of the area.
Comment. This area is planned for urban density residential development. Adjacent
parcels are anticipated to develop with similar land uses. As such the proposed land
use will be compatible with the uses guided by the Comprehensive Plan.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Comment: The concept plan is generally consistent with applicable performance
standards. A more detailed evaluation of compliance will be made at the time of a
Development Stage PUD -CUP application.
D. The proposed use's effect upon the area in which it is proposed.
Comment. The proposed development will not have an negative impact to the area
in that the use is anticipated and will be developed within all performance standards.
E. The proposed use's impact upon property values of the area in which it is proposed.
Comment. Although no study has been completed, the proposed use is not
anticipated to negatively impact area property values.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Comment: The preliminary plat is to be adequately served by public streets serving
the property.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Comment: The Comprehensive Plan anticipated the development of the proposed
use. Therefore, the preliminary plat will not have a negative impact to the City's
service capacity.
6. The planning report dated 10 May 1999 prepared by Northwest Associated Consultants,
Inc. is incorporated herein.
7. The Otsego Planning Commission conducted a public hearing, at their regular meeting on
17 May 1999, to consider the proposed conditional use permit, preceded by published and
mailed notice. Upon review of the application and evidence received, the Otsego Planning
Commission closed the public hearing and recommended by a 7-0 vote that the City
Council approve the PUD -CUP Concept Plan based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested Zoning
Ordinance amendment is hereby approved based on the most current plan and information
received to date, subject to the following conditions:
Approval of a Comprehensive Plan amendment to guide the subject parcel for low density
residential development.
2. Approval of a rezoning from A-1 District to R-6 District.
3. Approval of a PUD -CUP Development Stage application

Request: Request for approval of a preliminary plat for entitled Prairie Creek" consisting of
118 single family lots and one outlot conceptually planned for development of twin home
residential dwellings on the property legally described by Exhibit A ("the property").
City Council Meeting Date: 14 June 1999
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact and recommendation:
1. The legal description of the property is:
See attached EXHIBIT A.
3. The property lies within the Sanitary Sewer Service District as identified in the 1998
Comprehensive Plan Update.
4. The portion of property described in EXHIBIT B is guided for low density residential
development by the 1998 Comprehensive Plan Update and is zoned R-4, Residential
Urban Single Family.
5. The portion of the property legally described in Exhibit C is guided for medium/high density
residential development by the 1998 Comprehensive Plan Update and is zoned A -I,
Agricultural - Rural Service Area.
6. The Prairie Creek Preliminary Plat consists of 118 single family lots and one outlot
conceptually planned for development of residential twin home units.

action follows the public hearing held for the above mentioned project.
Item 7.2 Consider Resolution ordering the Improvement Project for the entire
Overlay Project of the City streets.
Refer to the packet for the appropriate resolution.
Item 7.3 Consider approving partial payment #1 for Barbarossa & Sons on the
Trunk Sewer and Water Project, COP #98.04.
The amount is $166,107.50 and the partial payment Is approximately 7.6%
of the original bid amount.
The project is on schedule.
Item 7.4 Consider approving the final payment for Mark J. Traut Wells
The final payment is $3,805.19.
We are asking to approve the payment but not disburse the check until the
three items listed on the bottom of the pay estimate form are received.
We need to release the contractor as the pumphouse contractor is starting
to build the structure.
Item 7.6 Any other Engineering Business
a) Environmental Worksheet for 78th Street and Page Avenue
We have estimated that the EAW preparation, mailings and review
of comments will cost about $2,500 In fees. The time spent on the
work will depend on comments after the publication of the
document.

OTSEGO 1999 BITUMINOUS OVERLAY PROGRAM
WHEREAS, a resolution of the City Council adopted the 8th day of February, 1999, fixed
a date for a Council hearing on a bituminous overlay program including improvement of
all existing roadways within the following described areas: Halls let, 2nd & 3rd Additions,
Vasseurs Oak Grove Estates 1"t, 2nd 3r & 4th Additions, Hidden Valley Acres, Deerfield
Acres and Walesch Estates 1 et & 2nd Additions, which hearing was held on the 18th day
of March, 1999, and;
WHEREAS, a resolution of the City Council adopted the 12th day of April, 1999, fixed a
date for a Council Hearing on a bituminous overlay program including improvement of
all existing roadways within the following described areas: Otsego Acres 10 and 2nd
Additions, Great River Acres 1�, 2nd and 3rd Additions, and Mason Ave. (CSAH 39 to
83rd St. N.E.), 83rd St. N.E. (Marlowe Ave. N.E. to Mason Ave. N.E.), Marlowe Ave. N.E.
(83rd St. N.E. to 801h St. N.E.), 801h St. N.E. (Marlowe Ave. N.E. to CSAH 19) of the City
of Otsego, which hearing was held on the 4th day of May, 1999; and
WHEREAS, the City Council may order construction of all or parts of the bituminous
overlay program within the areas described above and desires preparation of plans and
specifications on said improvement areas.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
OTSEGO, MINNESOTA:
Hakanson Anderson Associates, inc.' is hereby designated as the engineer for this
improvement. The engineer is hereby authorized and directed to prepare plans and
specifications for such improvements within the two areas described herein.

Re: EAW - Collector Roads
Staff has been reviewing the State laws governing
preparation of Environmental Assessment Worksheets
(EAW's) for new development. This review was
caused when we heard from some developers that Paul
Jacobs of HRUA has been showing up in some
communities around here and claiming that cities
are illegally allowing development to proceed
without State required EAW's.
One of the requirements to do an EAW is when a City
constructs more than a mile of new collector
street. Our plans for the construction of 78th
Street and Page avenue extensions seem to meet this
requirement. The City Attorney will be ready to
discuss this issue at the next Council meeting. I
have also asked the City Engineer to have an
estimate of time and cost to prepare an EAW for
those streets.

Dear Mike,
We would like to thank you and John Harwood for the time spent with us addressing our concerns
for your water/ waste water project. As we discussed, your project will require the Elk River Municipal
Utilities (ERMU) to expend a considerable amount of time and effort to accommodate this
construction along CSAH 42. This is particularly disconcerting considering we have permits from the
Department of Highways of Wright County for our facilities in this right-of-way and the heavy handed
approach taken by some of your representatives.
Please keep in mind this electric line is the only source of electrical power to our portions of Otsego
and Dayton. In permitted right-of-way situations, the "utility facility and installation shall not interfere
with any existing utility facility on the county highway right-of-way ". The interfering utility typically
reimburses the existing utilities for costs incurred to do the new construction. This is the case at hand
when Otsego requires other utility owners to move to make way for this project. During our
discussion, you made the case that all effected utility companies will benefit by Otsego installing a
water/ waste water system. Therefore these effected utility companies should be willing to relocate
their utilities at no cost to Otsego.
Although we do not totally agree with this agreement we will accept it in the spirit of cooperation
except for two instances. The Bank of Elk River and a private residence on the east side of CSAH 42
and 85th Avenue will require new electric service lines to accommodate your construction project. The
service line serves only these two customers. The cost to replace these two service lines is estimated
to be $9,000.
We request Otsego to reimburse ERMU the cost of replacing these two electrical services for a cost
not to exceed $9,000, and in turn ERMU will absorb the remaining costs incurred by us to
accommodate construction of your water/ waste water project.

Re: HRUA Permit Request before the MPCA
The HRUA has requested a State Disposal System
(SDS) permit from the MPCA. This permit would be
for the entire Mississippi River headwaters
(everything north of Anoka) an area that includes
the City of Otsego. This permit request, a copy of
which you received last week, has been put out for
a 30 day public comment period which ends
Wednesday, June 23, 1999. I have listed below
several different options for responding to this
permit, along with what I see are the pros and cons
of each option.
PERMIT RESPONSE OPTIONS
1. DO NOTHING.
Pros - The law creating water quality cooperatives,
which is what the HRUA is, prohibits them from
working in a City where they do not have an
agreement with the City. Therefore, the City
Council can keep them out of Otsego if it does not
want to deal with them.
Cons - I would like Andy's opinion on whether there
is any language in this permit that would over rule
the State law governing water quality cooperatives.
2. PETITION FOR A PUBLIC INFORMATIONAL MEETING
Pros - This would be a meeting held by the MPCA
Commissioner. This would be a forum in which to
discuss our concerns about this permit with the
MPCA. It would probably delay issuance of the
permit and would allow more affected governments to
be informed about the proposed permit, analyze it,
and express their concerns. It would also be a
forum in which to suggest alternatives to the MPCA
and HRUA.
Cons - There would be a certain amount of staff
time spent in preparing materials for the
informational meeting, contacting other interested
parties, and staff time to attend the actual
meeting. In addition, The HRUA has admitted that
there is a "list" of people and organizations that
it regards as impediments to the establishment of
water quality cooperatives in Minnesota. Further
objection to their plans by the City of Otsego
would probably move us higher up the list.
3. PETITION FOR THE PERMIT TO BE HEARD BEFORE
THE MPCA BOARD
Pros - This is a viable option if the informational
meeting doesn't address the City's concerns. The
MPGA Board may be less subject to political -
pressure on this issue than MPCA management is.
Cons - There will be a certain amount of staff time
required to prepare information for this meeting
and to attend the meeting. Also, you never know
what the decision of the MPCA Board could be.
4. PETITION FOR A CONTESTED CASE HEARING
Pros - This is a formal evidentiary hearing before
an administrative law judge. It is my
understanding that the cities of Annandale,
Rockford, Maple Lake, and Milaca have asked or will
be asking for a contested case hearing. I have
enclosed a copy of Annandale's resolution which
they are also asking us to support.
Cons - A Contested Case hearing is supposed to
focus on just disputes of material issues (facts),
not on policy issues. The cities would have the
burden of proving that one or more of the facts in
the permit is wrong. I think that what Otsego and

other cities are concerned with here is more a
policy issue than a fact issue.
In addition, this would require a great deal of
time to develop information for the hearing, and a
certain amount of time just being at the hearing
and making presentations. Andy could give us a
much better idea of the time and estimated cost for
this.
Also, I have never observed the HRUA staff do a
good job of presenting to elected or appointed
officials. It is possible that their style of
presentation would be better received and
understood by an administrative law judge.
RECOMMENDATION
At this point I would recommend asking for an
informational hearing, and reserving our right to
ask for a hearing before the MPCA Board. Andy may
have a different recommendation, and we should hear
from him.

Dear Mike,
We would like to thank you and John Harwood for the time spent with us addressing our concerns
for your water/ waste water project. As we discussed, your project will require the Elk River Municipal
Utilities (ERMU) to expend a considerable amount of time and effort to accommodate this
construction along CSAH 42. This is particularly disconcerting considering we have permits from the
Department of Highways of Wright County for our facilities in this right-of-way and the heavy handed
approach taken by some of your representatives.
Please keep in mind this electric line is the only source of electrical power to our portions of Otsego
and Dayton. In permitted right-of-way situations, the "utility facility and installation shall not interfere
with any existing utility facility on the county highway right-of-way ". The interfering utility typically
reimburses the existing utilities for costs incurred to do the new construction. This is the case at hand
when Otsego requires other utility owners to move to make way for this project. During our
discussion, you made the case that all effected utility companies will benefit by Otsego installing a
water/ waste water system. Therefore these effected utility companies should be willing to relocate
their utilities at no cost to Otsego.
Although we do not totally agree with this agreement we will accept it in the spirit of cooperation
except for two instances. The Bank of Elk River and a private residence on the east side of CSAH 42
and 85th Avenue will require new electric service lines to accommodate your construction project. The
service line serves only these two customers. The cost to replace these two service lines is estimated
to be $9,000.
We request Otsego to reimburse ERMU the cost of replacing these two electrical services for a cost
not to exceed $9,000, and in turn ERMU will absorb the remaining costs incurred by us to
accommodate construction of your water/ waste water project.

However, the residents will not be able to change their city line of their addresses with any of their

Postal Service. She has informed me the criteria used for the establishment of additional
locations of local post offices is based on delivery needs. They see no problems with the
delivery service in Otsego, MN. A new local post office would be more convenient for
Otsego residents, but the United States Post Office is an operating business and needs to
act accordingly. Because the postal service is run at the federal level, I have forwarded
your letter to Congressman David Minge. His office would more appropriately be able to
deal with your request.
Cynthia Larson is also checking further into the idea of using the Otsego city name along
with the current zip codes for a mailing address. She has agreed to inform me of the

Request for Proposals
I have enclosed a copy of a draft of a Request for
Proposals (RFP). This will be advertised and
mailed to companies who have indicated an interest
in serving as Otsego's Wastewater Treatment Plant
operator.
The RFP is a generic RFP that has been used by
several communities. I got a copy from St. Michael
and made some minor modifications to it. Council
should review the RFP and let me know if there are
any areas that they would like changed.
At this point in time we have received calls from
three companies that are experienced in operating
wastewater treatment plants on a contract basis. I
hope that I will be able to locate more companies
at the League of Minnesota Cities conference. The
three companies that have said they will bid are
Professional Services Group (PSG), America's Water
Services, and PeopleService, Inc.

The City of Otsego is requesting Statements of Qualifications and Price Proposals
(SOQ/PP) from firms interested in providing operations, maintenance and management
services to the City's wastwater treatment plant. The City expects the SOQ/PP to address
all activities of the wastewater treatment plant.
It is understood that the SOQ/PP and the innovative approaches, guarantees and
experience demonstrated therein shall be the general basis for selection of a firm to
provide these professional services. The City expects to select the highest scoring firm
based on a structured point scoring evaluation of first, the Statement of Qualifications
(SOQ) and then second, the Price Proposal. The scoring evaluation (Section VIII) shall
consider the innovative approaches, ability to make financial and technical guarantees,
experience, technical expertise and price of services of each competing firm. After the
City has selected the highest scoring firm, the City will immediately begin negotiations.
Should the negotiations fail to result in an executed agreement, the City may elect to
terminate negotiations with the first -ranked firm, begin negotiations with the second -
ranked firm, and so on, or cancel the process.

not be much of a facility to tour and we would skip this part of the RFP. **********
The City will conduct a pre -proposal conference and tour of the facilities on
to begin at a.m./p.m. at Otsego City Hall, located at 8899 Nashua Avenue NE,
Otsego, Minnesota.
Attendance at the pre -proposal conference and tour is mandatory. The purpose of the
pre -proposal meeting is to answer questions regarding the Request for Qualifications and
Price Proposals (RFQ/PP). All contractors interested in submitting an SOQ/PP should
contact City Administrator Mike Robertson by no later than to indicate
their intent to attend the pre -proposal conference. Fach interested contractor should
ensure that they meet or exceed the Required Standards set forth in Section III of this
document_
To ensure that each firm has sufficient information to submit a proposal, the City will
make available on the day of the tour construction plans and specifications, design reports,
NPDES compliance reports and shop drawings, operating budgets and other pertinent
data.
At the time of the tour, each firm will have an opportunity to schedule a maximum of three
consecutive eight-hour days for an independent evaluation of the facilities in order to
familiarize themselves with the current operation and maintenance practices and to
research additional records that will be made available at the time of the individual facility
evaluations. Arrangements for the inspection and/or copying of documents shall be
coordinated through the City Administrator and a fee of $.10 a page will be charged for
photocopies of any documents not already printed for distribution.
All questions concerning the RFQ/PP shall be submitted in writing to:

Contact with other City officials is prohibited and can be considered as grounds for
disqualification from the selection process.
Questions must be received at least 10 days prior to the SOQ/PP due date. Copies of all
questions and answers, and any addenda to supplement the RFQ/PP, will be sent to each
firm no later than three days prior to the SOQ/PP due date. Only formal written responses
to properly submitted questions will be binding.

Each selected Contractor must respond to each of the following requests/questions in a
clear and comprehensive manner. Failure to do so may result is disqualification.
Provide the full name, tax identification number and main office address of
the entity (hereafter referred to as the "Contractor") which would
ultimately enter into a contract with the City.
2. Identify when the Contractor was organized and, if a corporation, where
incorporated and how many years engaged in providing Contract
Operations Services under that name.
3. Provide a listing of all full-service contract operations, maintenance and
management contracts which the Contractor has currently, including the
gross annual amount of each contract; the contract start date; the
anticipated completion date; the name, address, contact person and
telephone number of the owner; and the size and type of facility. Full
service operations, maintenance and management contract means, at a
minimum, providing all labor and management, paying all O & M expenses,
guaranteeing a maximum cost, and guaranteeing regulatory agency
compliance.
4. Does any councilman or other officer, employee, or person who is payable
in whole or in part from the City have any direct or indirect personal
interest in the Contractor? If so, describe the circumstances.
5. Identify the firms that you intend to subcontract or otherwise use to
perform work on this project.
6. Contractor must furnish a copy of a fully executed contract with another
community for services similar to those requested by the City.
This section establishes certain standards of experience and financial capability that the
City requires for a Contractor to be considered qualified. The City, in its sole discretion,
will decide if a Contractor meets the standards. Scoring of the qualified firms will be as
described in Section IX.
Contractor must have been in business of providing contract operations,
maintenance and management of water and wastewater treatment facilities
for at least five (5) years.
2. Contractor must operate at least five (5) or more water and/or wastewater
treatment facilities of similar or larger size to the Otsego facility.
3. Contractor must furnish liability and property damage insurance of not less
than $10,000,000 combined single limits for bodily and/or property
damage.
Enclose an insurance certificate.
5. Contractor must demonstrate the ability to provide a performance bond of
at least $5,000,000.
All land, buildings, improvements and permanent equipment which are presently in place,
or new facilities which will be added by the construction projects, shall remain or become
the property of the City. Should the contractor fund the implementation of any facility
improvement at the request and approval of the City, such facilities shall become the City's
after the completion of a repayment schedule. All existing facilities shall be made available
to the contractor for his use in providing the services under the contract.
Expendable supplies and spare parts which are on hand on the day and date of the contract
execution shall be inventoried. The Contractor shall have access to these materials during
the duration on the contract, but shall maintain the inventory such that at the end of the
contract period, the City inventories shall be replenished for materials used or substituted,
with City approval, during the term of the contract.
The Contractor shall maintain all land, buildings, improvements, vehicles and permanent
equipment that are within the scope of the agreement. Equipment and vehicle
maintenance shall be performed by the Contractor in accordance with manufacturer's
recommendations or good industry practices and the Contractor will be required to
provide proof thereof to the satisfaction of the City.
Separately, the City and the Contractor may arrange for the contractor to purchase,
maintain, and replace the rolling stock and transportable equipment currently in use by the
City. Such purchase prices shall have buy-back provisions to enable the City, upon
contract completion or early termination, to buy back the same or similar inventory, if
such equipment is still in use or being used under conditions similar to those under which
the Contractor purchased same from the City.
The purpose of this project is to operate, maintain and manage the City's wastewater
treatment facilities more cost effectively and more cost efficiently. The objective is to save
the City money, operate in compliance, improve maintenance, consider innovations to
lower the capital and operating costs of any and all aspects of utility operations and
continue local purchases of supplies, consumable and services, wherever practical.

Draft Contract
The SOQ shall identify any and all non -monetary terms and conditions associated with the
services included in the SOQ. After selection of the highest scoring firm, the scope of
work shall be clarified, any changes shall be negotiated along with the Agreement,
beginning with the Draft Contract submitted in the SOQ.
Following are further discussions relative to the content of each of the suggested chapters
of the SOQ.
Executive Information/R_egnired Standards -- Responses to questions contained in
Sections III and IV of this Request.
Qualifications/Related Experience -- A brief discussion of contractor's experience in
similar type and size of projects.
Oneratin4 Plan -- The Operating Plan should discuss the following topics:
a. Provide a listing of the specific individuals assigned to the Management
Team and to Technical Support that the Contractor will assign to this
contract during the transition and operation, and provide the background
and experience of those individuals.
b. Provide a detailed staffing plan indicating the type and quantity of the
various positions the contractor feels is necessary to provide the services
requested.
C. Discuss the transition procedure and the impact of any surplus employees
and the Contractor's plan to accommodate them.
d. Provide an operating plan for the facilities and other responsibilities that
indicate how the Contractor will provide operations, maintenance and
management services.
Provide description of any deficiencies observed in operations and
maintenance of the City's facilities.
Business Approach -- Discuss contractor's position on such business issues as assumption
of risk, future years' price adjustments, capital versus repair issues and guarantees.
Draft Contract - Include a draft contract for City review.
The City is requesting a Draft Contract as a part of the SOQ/PP. However, a summary of
some of the general provisions the City will expect to see in any final contract are as
follows:
Provision of liability without any dollar limit for the payment of fines and/or civil
penalties levied against the Contractor and/or the City by any regulatory agency
having jurisdiction, as a result of failure to comply with the terms and conditions of
any duly authorized permit, court order, administrative order, law, statute,
ordinance, etc. for reasons resulting from the Contractor's negligence during the
period of the contract.
Provisions for compliance with State of Minnesota and other EPA & OSHA
regulations regarding treatment and reporting requirements and a process control
system which furnishes complete and accurate records. System should be capable
of readily providing historical data and trends.
Provision of indemnification and hold harmless of the City and its agents, officers,
assigns, employees, etc. from any loss or liability for claims, damages, lawsuits for
reasons resulting from the Contractor's negligence during the period of the
contract. Such indemnification shall include indirect, consequential and pollution
damages.
Provision of comprehensive liability insurance policies naming the City as
additional insured for bodily injury and/or property damage in an amount of not
less than ten million dollars ($10,000,000); a certificate of such insurance shall be
submitted to the City upon signing of the Contract.
Provision of a fixed dollar value for Repair and Replacement such that the
contractor's obligations will be explicit as to maintenance of the City's equipment
and facilities. Such Repair and Replacement limit will not include Contractor's on-
site labor. A specific method of decision making concerning the use of funds for
repair and replacement should be outlined.
Provision that the Contractor shall be responsible for maintaining all
manufacturer's warranties on new equipment purchased by the City and assist the
City in enforcing existing equipment warranties and guarantees.
Provision that the Contractor shall provide a sufficient number of certified qualified
personnel, including management, administrative, operational, technical, laboratory
and clerical, who meet relevant State of Minnesota requirements and certifications
regarding wastewater treatment operations and maintain the facility.
Provision for termination of the contract if performance is unsatisfactory.

Re: Darkenwald EAW
I would like direction from the City Council on
whether I should attend the MPCA Board meeting on
Tuesday, June 22, 1999 to oppose the proposed
Darkenwald EAW permit.
I have had several discussions with MPCA staff
about the Darkenwald EAW. I told them that I
thought that the City of Otsego would not contest
the Darkenwald EAW if MPCA provided a direct and
unambiguous statement that they would not issue a
Discharge (NPDES) permit to the Darkenwalds until
such time as the City approved their development
plan. The lower level staff of the MPCA wanted to
send this letter. They were overruled by upper
level MPCA staff who were worried about the legal
ramifications of sending such a letter.
If we do decide to oppose the Darkenwald EAW, we
have to decide what strategy to take. Our comments
on the Darkenwald EAW call for an Environmental
Impact Statement (EIS) to be done. The MPCA staff
response to our comments is that they don't think
an EIS is needed. If directed by the Council, I
will push for an EIS before the MPCA Board.
Another option would be to ask the MPCA Board to
direct staff not to issue the Discharge (NPDES)
permit until such time as the City has approved a
development plan of the Darkenwalds. Clearly this
is what some of the lower level MPCA staff want.
It was also a request of the DNR in their comments
on the EAW.
Another option would be to not oppose the
Darkenwald EAW permit, and to wait to see what the
conditions are on their Discharge permit before
deciding whether or not to oppose that permit.
