The prime contractor is Gridor Construction. The following is a progress report for the month of November. November, 1999 - Significant work accomplished in November included metal siding, chain link security fence, interior plumbing, louvers, ductwork, heaters, and buried electrical conduit. In November, the contractor received deliveries of the second blower, two mechanical aerators for the oxidation ditches and lab equipment. Most exterior work has been completed and only minor items remain. Excavation and backfill, concrete, buried process piping, rough grading, masonry, roofing, and siding are complete or virtually complete. The only significant exterior work items remaining are fine grading, turf establishment, painting (concrete tanks, metal), and sidewalks. Some piping remains to be pressure tested. The requested payment amount is S 171,107.00. I recommend approval of this pay request by the City. Effective with the previous pay request (No. 6), Gridor Constr. is utilizing an alternate form of retainage that is authorized by Minnesota statute. To date the contractor has earned $1,548,828. Based on, this earned amount, the standard form of retainage (5%) would equal $77,441. The alternate retainage consists of a S 100,000 certificate of deposit (CD) pledged to Otsego. Note that the $100,000 CD exceeds the required amount of retainage. Please return one signed copy of the approved pay request to our office. Send two to the Contractor along with his check, one for him and one for the Bonding Company. Keep one final copy for your files. Thanks, i Elaine RESOLUTION NO. 99-45 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA A RESOLUTION SETTING A FINAL TAX LEVY OF $838,883 FOR 2000 BUDGET APPROPRIATIONS WHEREAS, the Otsego City Council is required by State law to establish a final tax levy for 1999 by December 28, 1999. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO, MINNESOTA: 1. That there is hereby approved for proposed expenditures from general taxes the following sums for the purpose indicated. COP #98.04. We recommend payment of $224,566.47 to Barbarossa & Sons. The work completed to date is approximately 97% and the 5% retainage is $105,989.30. The contractor is doing clean up and restoration. The gravity lines are being flushed and cleaned, after which we will televise to sewer lines. Work continues on the installation of the pumps and electric controls for the main lift station. ITEM 5.3 CONSIDER APPROVAL OF ATTACHED PAY ESTIMATE #2 FOR THE 78th STREET, QUADAY AVENUE AND PAGE AVENUE ' SANITARY SEWER, WATERMAIN, STORM SEWER AND STREET CONSTRUCTION PROJECT. COP #99.02. We recommend payment of $597,205.70 to LaTour Construction. The work completed to date is approximately 63% and the 5% retainage is $42,338.85. The contractor will, by council meeting, be within a few days of completing all of the underground work. As this is being completed, the subcontractor is shaping the street and placing gravel. With the weather remaining good, the street with gravel should be complete before Christmas. Concrete curb and pavement will be installed next year. Per your request, we have reviewed Ms. Backes inquiry in consideration of Section 37 of the Zoning Ordinance and offer the following comments: Section 20-37-2.0 of the Zoning Ordinance prohibits non-government signs from locating within the right-of-way. Locating non-govemment signs in the public right- of-way is a liability issue and a matter of public safety. The type of sign proposed is defined as a real estate development sign. Section 20-37-5.B of the Zoning Ordinance deals with the location of such signs in residential districts. Each subdivision is allowed one real estate development project sign with a maximum area of 64 feet. These signs must be located within the subdivision the are advertising. Section 20-27-5.6 of the Zoning Ordinance allows for off -premises directional signs for subdivisions. One 16 square foot, double -sided sign is allowed for each major arterial approach to the property by conditional use permit. The Zoning Ordinance provisions are related to the proposed sign are specific that this type of sign is not permitted. The Zoning Ordinance does not provide the City Council any latitude in this matter. The appropriate course of action would be an application either to amend the existing sign provisions or a conditional use permit for the off -premises development sign, which could be located in the area adjacent to CSAH 42 or Highway 101 with a conditional use permit. Such an application must be processed in accordance with the established procedures of the Zoning Ordinance. Comment: The neighborhood is fully developed with single family dwellings consisting of a mix of manufactured housing and stick built structures. Comment: Provided the structure has a similar assessed value as adjacent dwellings, and conforms to all applicable performance standards, no depreciation is anticipated. D. The relocated structure shall be similar to the market valuation of adjacent principal structures as determined by the City or County Assessor. Comment: The structure was valued at approximately $75,400 by Anoka County. For comparison, the existing structure on the lot is valued at $48,300 and the dwellings on the neighboring properties have an assessed value of $45,400 and $60,400 ($52,900 average). The value of the property following relocation of the structure is therefore likely to increase to level at least consistent with values of neighborhood properties. E. The relocated structure shall be ready for occupancy within six (6) months from the date of location on site. Comment: This requirement should be made a condition of any approval. Lot Standards. The following table illustrates required performance standards for single family lots and dwellings in the R-3 District. The detached accessory building exists as a legal non- conforming use as it exceeds the maximum 1,500 sq. ft. size for a single structure. The attached garage is within the 1,000 sq. ft. area limits for such accessory spaces. Access. Access to the subject site is provided via a driveway from 85th Street. This driveway provides access to a parking area and the detached garage. As part of the project, the applicant has proposed to add a second curb cut and driveway to access the attached garage. According to Section 20-22-4.H.11 of the Zoning Ordinance, single family uses are to be limited to one curb cut unless a conditional use permit is approved. The Comprehensive Plan designates 85th Street as a collector street. In recognition of this classification, curb cuts are to be limited. As such, the site plan should be revised such that there is only one access to 85th Street. The applicants have the option to relocate the existing curb cut to provide more direct access to the attached garage or utilize the existing curb cut and extend a driveway to the attached garage. CUP Criteria. The Planning Commission and City Council must also take into consideration the possible adverse impacts of the building relocation based upon (but not limited to) the following factors outlined in Section 20-4-2.F of the Zoning Ordinance: The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. Comment: The relocation of the stick -built dwelling is a positive improvement by providing a dwelling unit that is larger and likely has a higher value than the existing manufactured home. The following policies support the applicant's request: The character of individual neighborhoods shall be reinforced, maintained and upgraded. (Policy Plan, pg. 40) A high quality residential environment shall be maintained through rehabilitation or where necessary, redevelopment of substandard units via private means and/or public action, when feasible. (Policy Plan, pg. 46) 2. The proposed use's compatibility with present and future land uses of the area. Comment. The area is developed with low density single family residential uses, which are planned to continue by the Comprehensive Plan. As such, the proposed use will be compatible with present and future land uses. 3. The City requires this security primarily to cover any costs that may be incurred due to damage of public facilities or infrastructure during the transportation of the structure. Such a security as determined by the building official must be required as a condition of approval. CONCLUSION The applicants' request to replace their existing manufactured home with an existing stick - built single family unit relocated from the City of Ramsey generally satisfies all applicable performance standards. Additionally, the Comprehensive Plan encourages improving the quality of the existing housing stock and neighborhoods within the community. The relocation of this structure to the subject lot will be a valuable improvement, which will also benefit the neighborhood, consistent with the goals of the Comprehensive Plan. The drai1nage in the ditch in that area does not allow positive drainage assuming the elevations shown as accurate. The existing crossroad culvert has an invert of 961.5feet the same elevation the west end of the culvert under present entrance. Further obstruction of the flow of storm water by placing a culvert underthe proposed access will cause the ditch to not function as intended. There is a flat area in the ditch now. Unless the culvert under present entrance can be lowered to provide position flow our objection to a second entrance remains. There appears to be adequate room on the site to maneuver truck & trailer through one access. Another possible alternative is to widen the present access by approximately 10 feet, • Water Quality The addition of a fueling facility raises questions of possible fuel spills in the fueling area. The fuel facility consists of automated diesel and gasoline pumps to service associated trucks, which are controlled from the main building. It is not, according to the applicant, intended to be a retail location. The subject site is zoned 1-2, General Industrial District. The existing truck terminal, which includes truck service, wash and a leasing operation, is a conditional use with this District under Section 20-68-6.1 of the Zoning Ordinance. The fuel facility would be accessory to the truck terminal use of the property, which was previously granted a CUP. Because the fuel facility represents an expansion of an existing conditional use, an amendment to the existing CUP. Planning Report - Long Haul Trucking CUP Amendment Page 3 Comment: The proposed use is not anticipated to have a negative impact to the City's service capacity. Fuel Storage. Section 20-16-19 of the Zoning Ordinance requires that gasoline, diesel fuel and other flammable liquids be stored in compliance with the Minnesota Pollution Control Agency and/or State Fire Marshall's regulations. Documentation is required indicating compliance with said agency regulations. This requirement was imposed on the original 1997 CUP and will be included as a condition of approval with this amendment. Access. The subject site presently has one access to Jensen Avenue. To facilitate on site traffic circulation through the fueling facility, a second access has been proposed. Section 20-22-4. H.11 of the Zoning Ordinance allows for at least one access, plus one additional access per 125 feet of street frontage. The subject site has approximately 250 feet of frontage. As such, the second access may be permitted, subject to the City Engineer's review and approval of the proposed location. Additionally, Section 20-22-4.H.7 limits the width of curb cuts to 24 feet, unless approved by the City Engineer. The existing access measures 32 feet wide at the right-of-way. The proposed access is also designed to 32 feet wide. The additional width is necessary to allow semi -tractor trailers to circulate to and from without crossing the centerline of Jensen Avenue. Because the need is based on traffic safety, the additional width is appropriate, subject to the City Engineer's comments. Setbacks. Accessory uses within the 1-2 District are required to meet ,the setback requirements applicable to a principal use within the District. The following table illustrates the relevant setback requirements and the proposed accessory use's relationship. As shown below, the location of the fuel facility is within are required setbacks. Height standards for accessory uses within the 1-2 District are the District limit of 35 feet, but not higher than the principal structure. According to the may 30, 1995 Planning Report regarding the initial development of the site, the principal building has a height of 26 feet, 4 inches. As such, the height of the canopy may not exceed that same height. Planning Report - Long Haul Trucking CUP Amendment Page 4 Lighting. The submitted plans indicate that their is to be a light under the canopy, but no specifics are provided. Any overhead lighting mounted to the canopy should be flush with the underside of the canopy to reduce outward glare. Specific information regarding the type and location of lighting to be installed must be submitted and is subject to City Staff review and approval. Signage. No plans for additional signage have been submitted in association with the fuel facility. If any additional signs are to be provided, a complete signage plan will be required for staff review and approval for consistency with Section 37 of the Zoning Ordinance, prior to issuance of a sign permit or erection of any signs. Hours. The present 1997 CUP limits the hours of the truck wash and service uses to 7:00 AM to 11:00 PM. The primary concern for limiting hours is potential noise generated by the mechanical wash and service. Noise from the fuel facility would be limited to that generated by tractors idling or circulating the site. In that there is no time limit placed on the terminal use, it may be appropriate not to extend the hour limits to the fuel facility. However, the City reserves the right to limit the hours of the facility should there be a future issue. Parking. As part of the project, the applicant is proposing to add 52 additional truck parking stalls and 5 automobile stalls. Staff had noted that vehicles were parking on grass areas of the site during a recent drive past the site. In review of the site plan at the time the site was developed, concern was noted about a lack of peak demand parking on-site for trucks. Under the 1997 CUP, the City may require additional parking be installed if there is a demonstrated need. The additional parking is therefore, generally positive. The existing CUP also allows limited outdoor display and leasing of trailers. The trailer sales area is limited to 7,750 square feet or 50 percent of the gross floor area of the principal building. The site plan must be revised to indicate the designated leasing display area. Any display over the 7,750 square foot area is prohibited and a violation of the existing CUP. The applicant is not proposing concrete curb as part of the parking lot expansion. Curbing was not provided for the original site at the time of development. Section 20-22-4.H.15 requires perimeter concrete curb for all parking lots. The function of curbing is to delicate parking and circulation areas, which is an issue for this property, and control stormwater drainage. Given the significant expansion of impervious surface, the City Engineer should comment on the need to provide curbing for stormwater purposes. The City has required other uses in the Otsego Industrial Park to provide curb and gutter, as well as other expanding businesses in the City when curb wasn't previously provided. Therefore, our office would recommend that concrete curb be provided around the expanded parking area at a minimum. Planning Report - Long Haul Trucking CUP Amendment Page 5 Grading and Drainage. The applicant has submitted a grading plan in association with this site expansion. These grading and drainage plans are subject to review and approval of the City Engineer. CONCLUSION As an accessory use, the proposed fuel facility is not anticipated to create any significant changes in site operations which would cause a negative impact to the area. Provided that all performance standards for fuel storage and track service uses, including the conditions of the 1997 CUP, are adhered to, the accessory use is appropriate. According to the applicant, It would be easier and safer for trucks to enter the site from the proposed southerly entrance and back-up to the loading docks. The reason for this preference is that the driver would be on the inside of the turning arc, with a clearer view of where they are guiding the truck. The Planning Commission recommended that this issue be subject to further discussion with the City Engineer. The only other issue discussed was a question regarding the staff recommendation that the asphalt curb installed when the site was developed be replaced with concrete. You will recall that the City Council allowed asphalt curb to be installed along the west edge of the parking area because the original site plan provided for a future parking lot expansion along the west property line and behind the building. The expanded site plan no longer requires the proof -of -parking area proposed on the original site plan. So as to be consistent with the approval of the original site plan, the asphalt curb should be replaced with concrete. A copy of the original site plan has been attached for reference. The Planning Commission voted 7-0 to recommend approval of the applications. Findings of fact consistent with the Planning Commission recommendation are attached for review. As a matter of procedure, the City Council is conducting a public hearing to vacate the easements on the existing lots. The expansion of the Apex building will expand the site to include Lot 1, Block 1 of the Otsego Industrial Park. The existing Apex building has an area of 70,560 square feet of office and warehouse space. The subject property is within the Long Range Urban Service Area designated by the Comprehensive Plan and is planned for industrial use by the Comprehensive Plan update. Both Lot 1 and Lot 1, Block 1, Otsego Industrial Park are zoned 1-2, General Industrial District. Warehouse uses are a permitted use within the 1-2 District. The submitted site plan does not accurately illustrate existing conditions. The configuration of the parking areas at northeast comer of the property does not include the connecting driveway, as shown on the plans. The site plan should be revised to correctly illustrate existing conditions. Lot Area. Lots 1 and 2, Block 1 of the Otsego Industrial Park currently existing as conforming parcels within the 1-2 District. The combination of the lots will result in a Lot Area of 7.9 acres, which exceeds the minimum 2.0 acre lot size required in the 1-2 District. Lot Width. The minimum lot width required in the 1-2 District is 200 feet. The proposed combination of the existing lots creates a parcel with a defined "front" lot line to CSAH 37. The width of the proposed lot, measured at the setback line, is 400 feet. Setbacks. The table below illustrates required setbacks for the subject property and proposed building. As shown on the table, all setback requirements are satisfied. Because the south lot line is the defined "front" of the lot, the required setback from the west property line is 20 feet, not 25 feet as indicated on the preliminary plat. The preliminary plat should be revised to illustrate the correct setback. Planning Report -Apex Building Center; Expansion/SUM Page 3 Building Height. Building height within the 1-2 District is limited to 35 feet. The submitted plans indicate that the height of the existing building and expansion will be 26 feet. Building Coverage. Developments within the 1-2 District are limited to 50 percent building coverage on a lot. Based upon a lot area of 344,269 sq. ft. (7.9 acres) and building footprint of 131,104 sq. ft., the subject site has a building coverage of 38 percent. Building Materials. The submitted building elevations indicate that the proposed building expansion will be constructed of precast concrete wall panels. This material is consistent with the requirements of Section 20-17-4.B.2 of the Zoning Ordinance. The exterior will be painted to match the exterior of the existing building, which is constructed of the same materials. Landscaping. A landscaping plan has been submitted for the expanded portion of the subject property. The landscaping plan provides boulevard trees consistent with the other landscaping along Jensen Avenue. The planting should be continued along the south property line adjacent to CSAH 37. A intensive planting cluster consisting of Black Hills Spruce and Burning Bush has been provided at the southeast corner of the property to screen the loading areas from'view of CSAH 37. Spruce trees have also been provided at the west side of the southern parking area. Concern exists regarding the proximity of the plants to the proof -of -parking and potential damage to these trees if the parking were to be installed. These plants should be relocated farther to the west to ensure their protection should the proof -of -parking need to be constructed. Page 4 The proposed building expansion results in a loss of 55 existing parking stalls. However, additional parking is provided to the east and south of the expansion, resulting in a net gain of 85 parking stalls and a total supply of 216 stalls. As with the initial development of the Apex site, the applicant is proposing that 46 of the parking stalls be provided as "proof -of -parking". A total of 7 disability accessible stalls, each van accessible, have been provided which is one more than required by ADA standards. Provided the applicant provides employment information illustrating that the provision of 170 stalls on site will be adequate, the proof -of -parking arrangement may be appropriate. The proof -of -parking will require a development agreement that allows the City to cause construction if it makes a finding that there is a need for the additional stalls. The submitted site plan indicates that concrete curb is to be provided around the perimeter of the parking area, as required by Section 20-22-4.H.15 of the Zoning Ordinance. At the time the Apex Center was first developed, asphalt curb was allowed along the west edge of the northern parking area, to minimize costs should the parking lot be expanded to include proof -of -parking spaces shown on the original site plan. As these proof -of -parking stalls are not included on the present site plan, the asphalt curb should be replaced with concrete. It must be noted that the row of parking along the southern lot line is within an NSP utility easement. The applicant should provide documentation to City Staff indicating that NSP will allow use of the easement for off-street parking areas. Loading. Section 20-23-7 of the Zoning Ordinance requires industrial uses larger than 10,000 square feet to provide at least two loading berths. The subject building has a total of 12 loading docks and a drive-in door for tractor -trailers. As such, the Zoning Ordinance requirements are exceeded. Lighting. The submitted site plan illustrates the provision of wall pack lighting on the proposed building expansion, as well as the illumination field of said lights. The wall pack lighting should be downcast and so directed to not create glare to the public right-of-way. Based on the illustrated illumination fields, the proposed site lighting is appropriate. Signage. No additional signage plans have been submitted. Before any additional signs are erected on the subject site, a comprehensive signage plan should be submitted for review and approval of City Staff for consistency with Section 37 of the Zoning Ordinance. Planning Report - Apex Building Center, Expansionl Subd. Page 5 Trash. No exterior trash storage locations are illustrated on the submitted site plan, indicating interior storage. If exterior storage is planned, all refuse containers must be within an enclosure approved by the Building Official. Grading Plan. A grading and drainage plan with the application. All grading and drainage plans are subject to review and approval of the City Engineer. Preliminary/Final Plat. The applicant has submitted a preliminary and final plat for the combination of Lots 1 and 2, Block 1 Ostego Industrial Park as Lot 1, Block 1 Otsego Industrial Park 3rd Addition. As noted above, the proposed preliminary/final plat conforms to the applicable performance standards of the 1-2 District. The only issue with the preliminary/final plat is the vacation of existing drainage and utility easements for the existing lots. In vacating the easements, the City Council must make a finding that the vacation is in the public interest. New drainage and utility easements will be required around the perimeter of Lot 1, Block 1, Otsego Industrial Park 3rd Addition. Other drainage easement needs are subject to review and approval of the City Engineer. Septic System. No alteration of the existing on-site septic system is proposed as part of the project. Any issues with the existing septic system or other utilities is subject to review and approval of the City Engineer. CONCLUSION Based upon a review of the submitted plans in consideration of adopted Ordinances, Plans and Policies, the proposed expansion of the Apex Business Center is generally appropriate. Further, the proposed Preliminary/Final Plat of Otsego Industrial Park 3rd Addition satisfies applicable performance standards and requirements. Upon review of the above items we have the following comments & concerns: Access NAC refers to the fact that based on the ordinance the third access to the complex is allowable. From a traffic stand point we prefer that the third access not be installed for reasons related to traffic management. Vehicles that enter Jansen Ave. from CSAH37 and wish to turn at the first access could limit the available stacking space and cause traffic to wait on CSAH37 until the northbound land on Jansen Ave. cleared. With the volume of potential traffic during a work shift change at APEX, stacking distance will be very limited with the proposed entrance. The potential for vehicle movement during peak time could be cause for problems at the intersection of Jansen Ave & CSAH37. If this entrance only served a few vehicles it could be acceptable. We strongly recommend that the present entrance directly north of the proposed remain as the principal access to Jansen Ave. for the given parking area. Stuart Stephens DATE: December 6, 1999 RE: Otsego, MN Security Concerns for Water Treatment Facilities There have been some vandalism problems during the construction of the new wellhouse, and more recently someone apparently broke into the base of the elevated storage tank. Larry Koshak at Hakanson Anderson Associates requested that I send you information about security measures to protect against future problems. Once the project is complete, the System Control and Data Acquisition (SCADA) system will monitor operational status of the various facilities, and a personal computer with alarming software will call out via telephone to alert City personnel in the event of alarm (for instance, high water level in the elevated storage tank or a pump failure in the wellhouse.) Some security measures are already built into the SCADA system: The pump house will be monitored for unauthorized entry. Entry switches will be installed on both doors to the building, and the switches will be monitored by the control panel. If either door is opened and an "Building Entry Acknowledged" pushbutton on the control panel is not pressed within a configurable time period, a "Building Intrusion" alarm is generated and the SCADA system will call out via telephone. 2. The lift station will be monitored for unauthorized entry. Entry switches will be installed on the control panel enclosure door and the wetwell hatch, and the switches will be monitored by the control panel. If either door is opened and an "Lift Station Entry Acknowledged" pushbutton inside the control panel is not pressed within a configurable time period, a "Lift Station Intrusion" alarm is generated and the SCADA system will call out via telephone. Door entry switches were not included in the original design for the elevated storage tank, the existing submersible well pump control panel located near the school, or the wastewater treatment plant, but could be easily added if desired: 3. The wastewater treatment plant will have the capability to be monitored for unauthorized entry. The SCADA panel that will be installed under this project will have an input for an intrusion alarm from the WWTF control panel that will instruct the SCADA system to call out via telephone in the event of unauthorized entry. However, since construction of the WWTF is under a separate contract, installation of entry switches on building doors and related modifications to the WWTF control panel would have City of Otsego Attn: Mr. Mike Robertson December 6, 1999 Page 2 to be done separately from this project. I did discuss the issue with Chad Westbrook at Bonestroo Rosene Anderlik and Associates (who did the electrical design for the wastewater plant), so he is aware of the City's concerns. He agreed with me that installation of door entry switches would be easy to add to the project, if desired. 4. Modifications to the elevated storage tank would include a door switch, cable and conduit from the door to the SCADA panel installed inside, installation of an "Entry Acknowledge" pushbutton, and software modifications. It is estimated that these modifications would cost $400.00 or less. 5. Modifications to the existing submersible well pump control panel would include door switches, installation of an "Entry Acknowledge" pushbutton, and software modifications. It is estimated that these modifications would cost approximately $250.00 or less. However, the well pump is located in a highly visible location next to C.S.A.H. 42 and has not had vandalism problems in the past, so modifications at this location may be considered optional. Using the SCADA system to monitor the various facilities for unauthorized entry should provide the City with an adequate level of security. I have also enclosed the original Proposal which is referenced in the proposed contract agreement. Please note that on Page 2 of the proposed contract agreement, there is a statement that the City and Wright -Hennepin will mutually agree on the date that these fees will begin. At this point I am anticipating that the City water system will be activated in late March of 2000. While the City Attorney will comment on any legal issues involving this proposed agreement, I have one suggestion for change. On page 2, item V, Fees For Services, requires payment in 15 days. That should be changed to 30 days because the City can not always make a 15 day payment schedule due to the timing of Council meetings. AGREEMENT This Agreement is made on the day of , 1999, between Wright - Hennepin Cooperative Electric Association of Rockford, Minnesota ("Wright -Hennepin") and the City of Otsego of Otsego, Minnesota ("City") Recitals Wright -Hennepin is a cooperative utility furnishing electric service to its customers primarily in Wright and Hennepin Counties; Wright -Hennepin has the capability to provide certain billing services to cities that own and operate sewer/water utility systems; City will own and operate a sewer/water utility system for certain of its residents which will require billing services; and City desires to engage Wright -Hennepin to perform certain services for its residents for sewer/water services. IN CONSIDERATION OF THE MUTUAL PROMISES AND AGREEMENTS CONTAINED HEREIN, the parties agree as follows: I. Definitions. The terms meter reading, billing, cash collection, and management of delinquent accounts shall have the meaning set forth in Wright-Hennepin's proposal to the City to provide these services dated June 10, 1999. The definitions of these terms are incorporated herein by reference. II. Services. Wright -Hennepin will provide meter reading, billing, cash collection, and management of delinquent accounts (to the point of disconnection) services for the City's sewer/water customers in new residential developments served by the City's wastewater treatment plant & potable water infrastructure. There will be approximately 1,500 customers in developments when completed. The City will be responsible for purchase and installation of remote reading systems compatible with Wright-Hennepin's meter reading devices. III. Billing Information. The City will provide Wright -Hennepin with necessary billing information including late fees, and disconnection rules. The City will give Wright - Hennepin reasonable advance notice of any changes to this information. IV. Sharing of Payments. Any payments received from customers on delinquent accounts or payments received from customers for less than the total amount of the bill for Wright-Hennepin's and City's services will be shared on a pro rate basis. V. Fees for Services. City will pay Wright -Hennepin a base fee of $200.00 per month. City will also pay Wright -Hennepin a fee of $1.75 per month per customer for the services provided. City will pay these fees to Wright -Hennepin within 15 days after receipt of Wright-Hennepin's statement itemizing these fees. City and Wright -Hennepin will mutually agree on the date upon which these fees will begin. VI. Liabilily. Wright -Hennepin agrees that it will use its best efforts to perform the billing services under this Agreement in accordance with the standards that it uses in performing these services for its own customers. Wright-Hennepin's liability to the City shall be limited to its failure to comply with those standards. VII. Independent Contractor. Wright -Hennepin is performing the billing services under this agreement as an independent contractor, and nothing herein shall create any association, partnership, or joint venture with the City nor any employer/employee relationship. VIII. Indemnitv and Hold Harmless. Each party shall indemnify and hold the other party harmless against losses, claims, liabilities, and damages, including reasonable attorney's fees and costs, to the extent that the same are sustained as a result of the negligent acts, errors or omissions of the indemnifying party. IX. Term. The term of this Agreement will be for a period of two years beginning 1999, and ending on .12001. X. Termination. Either party may terminate this Agreement for the other party's failure to perform its obligations under this Agreement, provided that the other parry has failed to cure any such failures after having received 30 days written notice identifying such failure or failures. XI. Sole Agreement. This Agreement constitutes the sole agreement between the parties, and no amendment, modification, or waiver of any of the terms and conditions shall be valid unless executed in writing by both parties. XII. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota. IN WITNESS WHEREOF, the parties have executed this Agreement on the date first written above. CITY OF OTSEGO Its: WRIGHT-HENNEPIN COOPERATIVE ELECTRIC ASSOCIATION Its: City of Otsego Proposal Backaround Information 21999 Wright -Hennepin Cooperative Electric Association (WH) is an electric distribution cooperative, formed in 1937. Currently, W -H serves over 26,000 members in the counties of Wright, Hennepin, Stearns, Meeker, Sherburne and Carver counties. The cooperative is consumer owned, and governed by local citizens. Services other than electricity provided by WH include: Home Security, Security Response, Wireless & Land Line Communications, Electric Installation and Contracting, Pager, 24 hour Electric Dispatching, Internet, Appliance Warranty, and Surge Protection. This proposal concerns an additional service, where W -H would provide water reading/billing services to the City of Otsego. W -H's proposal is related to the City's current construction of a new wastewater treatment plant & potable water infrastructure, which will initially serve a 1,000 — 1,400 home development. Otsego City administration projects that the development will be complete in five to ten years, assuming that 150-250 homes are built per year. The wastewater treatment is scheduled to be operational by the fall of 1999, and is sized to add future systems beyond the development at issue. W -H Services Proposed services which Wright -Hennepin would provide to the City for the water/sewer project include the following: • Meter Reading • Billing • Cash Collection Management of Delinquent Accounts • 24 Hour Dispatching (Optional) Meter Reading Wright -Hennepin currently has the equipment and software, to accommodate meter reading of the water/sewer project. Wright -Hennepin would be responsible for physically collecting the meter data, provided that the City purchases & installs the Itron remote reading system (ERT) into the city's choice of water meter. Since the new homes will also be W -H customers, WH would also install the ERTs into their electric meters at the time of installation. W -H currently has handheld meter reading devices which have the capability of reading the ERTs by radio frequency, therefore the meter reader does not have to go onto the customer's property. Page 1 W -H's contracted meter reading service, RMR Services, Inc, would read the water meters simultaneously with the electric meters (under WH/RMR's current contract). Not only would this create efficiencies for both entities, it would also eliminate the redundancies created by two meter readers reading the same residence. The City of Otsego area meters are read the second week of the month or around the 10th of the month. RMR currently reads 36,000 of WH meters on a monthly basis. RMR Services would have the ability to install the ERTs into the city's choice of water meter. W -H would be responsible for calculating the billing based on the meter data collected. WH would print and mail the statements. Proposed pricing includes paper, outer envelope, reply envelope and postage and management of the receivable. The water and sewer billing would be included as a separate line item on the customer's electric statement. WH would set the water and sewer billing up as a separate receivable. The water and sewer billing would be included on WH's statement, but displayed as a separate service. The customer would see the total of their water and sewer service as well as the total to be remitted for all services on the statement. See sample of statement (attached). The City of Otsego is currently billed for electric and other services the third week of the month (approximately the 21St of each month). Payment is due the 8th of the following month unless the customer chooses the EZ Pay plan (ACH) which provides the customer with additional payment choices of the 1St 8th or the 15th of the following month. Cash Collection W -H would be responsible for collecting and posting all payments, and remitting payment to the city on a monthly or semi-monthly basis. W -H is flexible regarding timing and related arrangements. Delinquent Accounts W -H would be responsible for collection of delinquent accounts, through the City's standard disconnect period. WH's current software system has the capability of putting a reminder on the bill, and sending out disconnect notices etc. for individual services. W -H would send out the disconnect notice, but it would be the City's responsibility to physically disconnect the customer. Pricing includes reminder statement and disconnect notices, as well as coordination with the City for payment arrangements and disconnects. Page 2 24 Hour Dispatching (Optional) W -H provides 24 hour dispatching services. WH could provide the City the following dispatching services: • Around the clock personal response. • Disconnect and reconnect customer call handling. Please note that pricing for the above dispatch services are not included in this proposal, but could be added at the City's request. Proposed Pricing W -H's proposes a monthly package fee for the City, to include the services of meter reading, billing, cash collections, and delinquent account management. Developer shall construct and maintain a office/warehouse building and other improvements in substantial conformance with the plans submitted to the City by Developer. Construction of the building and improvements shall be completed by December 31, 2000. Developer agrees to promptly pay all ad valorem property taxes levied against the Development Property as provided by law. As a condition of receiving assistance Developer further agrees to abide by all statutes, ordinances and regulations applicable to the Development property. 2. Amount of Assistance. The EDA agrees to provide assistance to Developer in an amount equal to 3.75% of the market value of the building addition, as determined for property tax purposes for assessment year 2001 (i.e. the value of the building as of January 2, 2001, as determined by the Wright County Assessor) in installments as provided in section three (3) below. The economic assistance relating to the building addition which is the subject of this Agreement is in addition to the economic assistance which was the subject of the Agreement dated December 15, 1998 for the building on Lot 2, Block 1, Otsego Industrial Park. Beginning in 2002, and continuinc until such time as Developer has received all of the assistance allowed under this section, the City of Otsego agrees to make an annual levy, pursuant to and subject to the limitations contained in Minnesota Statutes § 469.107, on behalf of the EDA in an amount estimated to be 30% of the property taxes it received from the Development Property. Contributions will be made in November of each year, after all property taxes have been and received by the City. If in any year no property taxes are collected from the Development Property, then no contribution from the above-described levy will be made by the City to the EDA. 3. Payment of Assistance. The EDA will reimburse Developer for costs incurred incident to constructing the warehouse/ office building and other improvement son the Development Property. The parties acknowledge that a bank or banks ("Developer's Bank") is providing substantial financing to this project in the form of a loan and, further, as security for such financing Developer will give a mortgage in the Development Property to Developer's Bank. In the event that Developer's Bank forecloses on the above -referenced mortgage, the City and the EDA agree that the assistance provided for in this Agreement shall be paid to Developer's Bank, provided Developer's Bank continues to pay property taxes on the Development Property and until such time as either the full amount of the assistance is paid or Developer's Bank sells the Development Property. Developer's Bank shall not assign or transfer any interest in this Agreement and any such purported assignment or transfer shall discharge the obligation of the City and the EDA to perform under this Agreement. Neither the City nor EDA is obligated to provide the assistance contemplated in this Agreement to any successor in interest of Developer's Bank in the Development Property. The City and EDA agree that this Agreement is subordinate to the above -referenced mortgage to be given to Developer's Bank by Developer. Any such transfer without consent shall render this Agreement null and void and shall discharge any obligation on the part of the EDA or City to perform under the terms of this Agreement. 7. Failure by the Developer to timely pay ad valorem real property taxes assessed with respect to the property herein described. b. failure of the Developer to observe or perform any other covenant, condition, obligation or agreement on its part be observed or performed under this Agreement; C. assignment of this Agreement by Developer; d. sale of the Development Property without receiving the consent of the EDA as provided in this Section six (6) above. e. any transfer of a legal interest in the Development Property which shifts the burden for payment of property taxes from Developer to another party, except in the case of mortgage foreclosure by National City Bank as provided in Section (5) above. f. petition or application by Developer for detachment from the City under existing law, or any amendment thereto. 8• Flection of Rnme-dion. Upon default by Developer, as provided in Section six (6) above, the EDA may elect any one of the following remedies: a. the EDA may cancel and rescind this Agreement, upon thirty (30) days written notice of default an intent to cancel to Developer and failure of Developer to cure its default within that time. b. the EDA may Suspend its performance under this Agreement until it receives assurances from the Developer, deemed adequate by the EDA, that the Developer will cure its default and continue its performance under this Agreement. C• the EDA may take any action, including legal or administrative action, at law or in equity, that is deemed necessary or desirable to enforce performance and observance of any obligation, covenant or promise of the Developer under this Agreement. 9. N Remedy Exalusivil, No remedy contained in this Agreement and reserved to or conferred upon the City is intended to be exclusive of any other available remedy. Waiver of Remedie$. Waiver of any right, remedy or breach of this Agreement by either party will occur, if at all, in writing signed by the waiving party and delivered to the non - waiving party. All such waivers are limited to the particular right, remedy or breach so waived and shall not be a deemed waiver of any additional right or remedy, nor any other past, present or future breach. No delay or omission by the City in exercising any right, power or remedy accruing upon any breach of this Development Contract or Event of Default shall impair the City's ability to exercise such right, power or remedy, nor be construed as a waiver thereof. All rights, powers and remedies of the City under this Agreement may be exercised from time to time and as often as may be deemed expedient by the City. 11. Job Creation- Both the City and Developer acknowledge and agree that Minnesota Statutes §116J.991 requires that Developer create at least one additional job within two years of receiving the first installment of assistance provided under this Agreement. Developer agrees to create at least one job in addition to any jobs presently existing in relation to Developer's business within two years of signing this Agreement. Developer agrees to provide proof, deemed adequate by the City, that the job has been created. Developer's receipt of the assistance provided under this Agreement is conditioned upon the above -referenced job creation. As per the above-cited statute, Developer must repay the assistance received hereunder if at least one job is not created within two years of receiving the assistance provided for in this Agreement. 12. Recording of Agreement. The parties agree that this written Agreement shall be filed for record against the Development Property above-described in the Office of the Wright County Recorder. Recording of this Agreement shall give any subsequent purchaser, or successors in interest, of the Development Property, or any portion thereof, constructive notice of the terms of this Agreement and their application to the Development Property. 13. Severabil Should any section, paragraph, provision or term of this Agreement, or lesser part thereof, be found invalid by a Court of competent jurisdiction, then all remaining sections, paragraphs and provisions of the Agreement shall remain in full force and effect and be binding upon the parties hereto. 14. We have requested assistance in the past, but at this time we would suggest a contract be signed so there is a clear relationship of moneys paid for services provided. We can now give specific information as to how much we spend in each city and will continue to report each year on our activities. In 1998 we began receiving law enforcement arrest and incident reports from the Wright County Sheriffs Department, (as we do with other law enforcement agencies), with the agreement that we will immediately notify the victim/s of a domestic assault and offer services. We maintain a 24-hour crisis line available to both law enforcement and victims. Our agency also supports staff and volunteers who work and coordinate efforts with area school districts, counseling centers, county social/human services, health providers, criminal justice agencies, court services, attorneys, hospitals and medical clinics focusing on services in four primary areas including advocacy and support, criminal justice intervention, community education, and youth violence prevention and intervention services. We recognize that those who live with the daily threat of domestic abuse clearly need accessible, supportive, educational and comprehensive local programs. Rivers of Hope provides a vital service to the families who come to us with hope for safety and help in breaking the cycle of domestic violence. Rivers of Hope is unique in that we provide services to everyone in Wright and Sherburne Counties and are able to secure funding from a variety of sources. (See attached statement). None of those sources can cover the entire cost of services however. We keep our costs extremely low spending an average of $182.24 per person served in 1998. Unfortunately we are finding we cannot continue current efforts without increased financial support. The number of victims coming forward, the number of domestic assault arrests made, and the number of residents moving into our cities all work together to heavily tax our capacity for service. We are asking each city in our service area to pay 15% of the actual amount spent by Rivers of Hope in that city. 2% of the population receiving direct services in 1998 reside in Otsego. Based on the 2%, we anticipate spending $5,796.46 serving your city in 1999 and would like 15% of that, or $869.47, from the City of Otsego. P.O. Council had asked me to determine the effect on the budget if two positions were given an additional increase of .50/hour to keep them more competitive with surrounding communities. Although this intersection does not meet the criteria for funding, as outlined in the County's Street Lighting Policy (see attached sheet), the County Board has decided to fund a street light at this intersection, per the policy funding guidelines. There are no reported nighttime accidents at this location. The County Board decided to waive the criteria for the following reasons: 1. The close proximity of the Riverwood Conference Center to the intersection. 2. An increase in the amount of traffic, due to the opening of the Vintage Golf Course, approximately % mile to the west of the intersection. 3. A belief that there will be increased traffic due to the opening of the outlet mall in Albertville. 4. A perception that the intersection is difficult to see at night. The County's funding policy would require the City to pay 50% of the installation costs and pay all future maintenance and power costs. Since this request came from the City, we would look to the City, for taking the lead in the installation of the street light. Prior to any action taking place though, it would be necessary for the County and the City to sign a cooperative agreement. It is our understanding that a breakaway light pole can cost as much as $2,100. We have learned that Mn/DOT uses two poles at similar intersections. Free: 1/800/657-3971 The Central Minnesota Area Transportation Partnership is presently soliciting candidate projects for developing its draft 2001-2003 Area Transportation Improvement Program (ATIP). The draft ATIP is a prioritized list of transportation projects that the Partnership recommends for inclusion in the State Transportation Improvement Program (STIP). Once in the STIP, projects become eligible for federal transportation funding. The Partnership will be accepting new project nominations for State Fiscal Year 2003 (July 1, 2002 to June 30, 2003). The categories of projects being considered for this solicitation include: Urban and Rural Road, Urban and Rural Bridge, Hazard Elimination Safety (HES), Transportation Enhancement Activities. It will also be considering changes to cost estimates or scopes of work for projects previously programmed in the 2000-2002 STIP. These should be requested through a separate letter. Applicants wishing to nominate a project for any of the above categories are required to follow the application procedures contained in the attachments. Please note all applicants must ensure that their project meets the minimum qualifying criteria specified in Attachment A. The applicants must also ensure that they address any special criteria and complete the appropriate project nomination form pertaining to their proposed project. Eligibility guidelines and project nomination forms are enclosed. Mike Robertson said he received a phone call from Greg Lefebvre complaining about the dewatering process in Crimson Pond at 78th Street. This dewatering has flooded ponds which in turn has ruined his Pheasant Hunting Business and he would like compensation. CM Wendel motioned not to compensate Greg Lefebvre.
