Mayor Larry Fournier will call meeting to order: Mayor Fournier called the meeting to order at 6:33 PM. a. Roll ll- Mayor Larry Fournier; Councilmembers: Vern Heidner, Virginia Wendel, Mark Berning. Suzanne Ackerman arrived at 7:08 PM. Staff: Mike Robertson, City Administrator; Elaine Beatty, City Clerk/Zoning Administrator; Judy Hudson, Deputy Clerk; Andrew MacArthur, City Attorney; Dan Licht, City Planner. Absent: Larry Koshak, City Engineer. Mayor Fournier led in the Pledge of Allegiance. 2. Consider agenda approval. Mayor Fournier requested to add under Item 9.a. Set an Administrative Sub -committee Meeting. CM Berning motioned to adopt the April 24, 2000 City Council Agenda as amended. Seconded by CM Heidner. All in favor. Motion carried. 3. Page 2. 6. Dan Licht, City Planner7 6.1. Consider Richard and Patricia Lefebvre 9244 Parrish Ave, NE Applicant Kenneth Nathe, 19080 Lincoln St. NW k River. MN PID #118-500- 143200, property is located E. of State Hwy, #101 and N of Co Rd #39 (,#10 I Market) Dan Licht presented the Planner's Report. Mr. Nathe asked to increase the retail space area for non -produce goods from 5% to 10%. He also asked if he could continue the business if the land is developed. CM Heidner stated he would like another condition added that if the land is rezoned or subdivided than this business wouldn't be able to continue since the majority of crops sold wouldn't be grown on site. A. An Amendment to the Zoning Ordinance to allow an Interim Use Permit in A-1 ( eneral Agricultural District) CM Berning motioned to approve Ordinance 00-07 amending Section 20-26-8 of the Zoning Ordinance to establish non-farm related seasonal produce sales as an Interim Use within the A-1 Zoning District. Seconded by CM Heidner. All in favor. Motion carried. B. An Interim Use . Permi CM Heidner motioned to approve an interim use permit to allow non-farm related seasonal produce sales within the A-1 District at the Highway 101 Market located northeast of CSAH 39/T.H.101 subject to the 10 conditions listed in the Findings of Fact and to include in Condition #9 the Interim Use Permit shall also expire at such time as the subject property is subdivided or a change in Zoning classification is approved. Seconded by Mayor Fournier. All in favor. Motion carried. CM Ackerman arrived at 7:08 PM. 6.2. Any Other Planning Business CM Heidner motioned for the Planning Commission to review the Zoning Ordinance part regarding building materials for the higher standards commercial area with consideration if wood materials should still be included in the allowed building materials. Consideration of Amendment of ISTS Ordinance Der State Regulations Mr. MacArthur reviewed the amendment and after talking to Jerry Olson asked to table this until the wording in Subdivision 9 is clarified regarding alternative systems. CM Heidner motioned to table consideration of this Amendment until clarification is received regarding alternative systems. Seconded by CM Ackerman. All in favor. Motion carried. Set Administrative Sub -committee Meeting_ A meeting was set for May 16, 2000, 4 PM to discuss City Hall staffing needs. 9.2. Mike Robertson, City Administrator - date* A. Discussion of Albertville Sewer Use Proposal Mike went over his proposed letter asking for 100,000 gpd for sewer from the City of Albertville. CM Heidner motioned to approve sending the letter to the City of Albertville. Seconded by CM Ackerman. All in favor. Motion carried. B. Proposed Change Order - CTridor Construction -Wastewater Treatment Plant Mike Robertson reviewed the Change Order. The Council did not approve the Change Order but directed Mike to let Bonestroo know their concerns of holding this Change Order for a year and to write to the City of Dayton who must approve Change Orders per contract. C. Discussion of Weekend Hall Rental Problems Mike went over his memo of April 18, 2000. CM Heidner motioned to put a moratorium on weekend and evening rentals requiring a building supervisor until a cost analysis is done by the City Accountant. Seconded by CM Ackerman. All in favor. Motion carried. D. Discussion of Tree Stump Removal Mike went over his memo of April 19, 2000 outlining the bids he had received. Council directed Mike to find out if this cost can come out of the Park Dedication Fund. If not, it will come from the General Fund. CM Berning motioned to award the Tree Stump Removal bid to Tri -Co Tree Movers for $1,050 and not to exceed $900 for clean up. Seconded by Mayor Fournier. All in favor. Motion carried. 9.3. Elaine Beatty. City Clerk - update Elaine had no updates. 9.4_ Judy Hudson,Deputy Clerk - update Judy reminded everyone of Clean Up Day on May 6th. 9.5. Consider Claims List for approval CM Ackerman motioned to adopt the Claims List as presented. Seconded by CM Heidner. All in favor. Motion carried. City Council Meeting of April 24, 2000, cont'd.
