BACKGROUND: Tom Stodola called and said he is in a club where they- reenact Ci -,A1 IvVar scenes. He would like to obtain special permission from the Council to discharge blanks when they are reenacting the war scenes and practicing at his home at 14100 - 96TH ST NE. Elaine Final Revision 6/6/95 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA ORDINANCE NO: a S _21 AN ORDINANCE ESTABLISHING REGULATIONS PERTAINING TO THE DISCHARGE OF FIREARMS AND HUNTING IN THE CITY OF OTSEGO, MINNESOTA THE CITY COUNCIL OF THE CITY OF OTSEGO ORDAINS. Section 1 Chapter 7 of the Otsego City Code (Police and Public Safety) is hereby amended to add the following: SECTION 1 FIREARM AND HUNTING REGULATIONS SECTION: 7-1-1: Discharge and Carrying Firearms Regulated 7-1-2: Definitions 7-1-3: Permitted Use of Firearms within the No -Discharge Zone 7-1-4: Permitted Use of Firearms outside the No -Discharge Zone 7-1-5: Prohibitions 7-1-6: Dangerous Weapons 7-1-7-A: Designated No -Discharge Zone 7-1-7-B: Map 7-1-8: Penalties 7-1-1: DISCHARGE AND CARRYING FIREARMS REGULATED 7-1-2: DEFINITIONS: CARRY: The handling or transportation of a firearm concealed or otherwise outside a person's domicile. DANGEROUS WEAPONS: Slingshot, clubs, blackjacks, spring guns, brass or metal knuckles or any knife with a switch blade which opens automatically under spring pressure with a button or release mechanism or by any other mechanical contrivance. DISCHARGE: The firing or shooting of any firearm DISMANTLED FIREARM: Any unloaded firearm or bow which is dismantled in such a manner so as to prevent discharge. ENCASED FIREARM: Any unloaded firearm or bow, placed in a case which is tied or otherwise secured in the manner provided. FINE SHOT: Shot sizes F through No.12 inclusive. FIREARM: "Firearms" shall mean any device from which may be fired or ejected, one or more solid projectiles by means of a cartridge or shell or by the action of an explosive substance; or for which the propelling force is a spring, elastic band, carbon dioxide, air or other gas or vapor. LANDOWNER: Any person, group, firm or corporation owning, leasing or legally controlling any lands within the territorial limits of the City. SINGLE PROJECTILE: Any single projectile, whether contained in a metallic, paper, plastic or other cartridge including any method of loading a muzzle loader which results in a single projectile being discharged. SUITABLE BACKSTOP: Any natural or manmade barrier of sufficient mass, size or construction to wholly contain the projectile being discharged. WRITTEN PERMISSION: The following information must be included: The full name. address, date of birth and signature of the person authorized to hunt or discharge a firearm; the full name, address, and signature of the landowner. 7.1.3: PERMITTED USE OF FIREARMS WITHIN THE NO -DISCHARGE ZONE. The discharge or carrying of firearms that are not encased or dismantled is permitted under the following circumstances so long as no innocent party is endangered unless otherwise prohibited by State or Federal law. A. By law enforcement officers in the line of duty or military personnel in the line of duty or persons with a lawfully issued and currently valid "permit to carry a pistol" as defined by Minnesota Statute 624.714. B. By any person to resist or prevent an offense which that person reasonably believes exposes himself or another to great bodily harm or death. C. By a certified Firearms Safety Training Instructor while Participating in a Department of Natural Resources approved Firearms Safety Program. D. By any person while participating in a Department of Natural Resources approved Firearms Safety Program. E. By any person authorized to do so in writing by the Wright County Sheriff for the destruction of diseased, injured or dangerous birds, animals or reptiles. F. By any person on a rifle, trap, archery or target range established in accordance with the City's Zoning Ordinances or as part of a City - sponsored activity. G• By any person possessing, transporting or carrying handguns as specifically allowed by State law. H. By any Person slaughtering farm animals which they own or with the permission of the owner. I• By any person target practicing with a bow and arrow with target tips only, BB or pellet gun with parental supervision under the age of 18, against a suitable backstop, at least two hundred (200) feet from all buildings, unless the buildings are owned by them or unless they have the owner's permission carried on their person. Bow and arrow target practice may also take place within the confines of a building if a suitable backstop is used. J. By any person participating in a special hunting season, which season may not conflict with State law or regulations. established the City Council for the purpose of wildlife management. The season shall be established by the City Council when, based upon competent professional advice such as a conservation officer, a season is needed to reduce an animal population. The Council may authorize the use of single projectiles as part of the special hunt regulations set forth in the resolution. 7.1.4: PERMITTED USE OF FIREARMS OUTSIDE THE DESIGNATED NO - DISCHARGE ZONE. In addition to the conditions set forth is section 7.1.3, the discharge or carrying of firearms is permitted under the following circumstances so long as no innocent party is endangered unless otherwise prohibited by State or Federal law. A. By any person using projectiles for target practice provided that the projectiles are stopped by a suitable backstop and provided further that the discharge occurs at least five hundred (500) feet from all buildings, unless owned by them or with the owner's written permission carried on their person. B. By any person hunting with a single projectile in accordance with State and Federal regulations and provided further that the discharge occurs at least five hundred (500) feet from all buildings, unless owned by them or with the owner's written permission carried on their person. C. By any person hunting or target shooting with a shotgun using fine shot at least five (500) feet from all buildings, unless owned by them or with the owner's written permission carried on their person. 7.1.5: PROHIBITIONS: Except as specifically allowed in Section 7.1.3 & 7.1.4. A. The discharge of a firearm is prohibited. B. Hunting using a firearm with a single projectile or with a BB gun is prohibited. C. Carrying or discharge of a firearm by any person under the age of fourteen (14) is prohibited except when accompanied by parent, adult guardian or certified safety training instructor. D. The aiming of any firearm, whether loaded or not, at or towards any human being is hereby prohibited. E. The carrying of an uncased firearm in a motor vehicle, in a place or area open to the public, or in any private place or area unless the private place or area is owned by the person carrying the firearm or with the owner's permission is prohibited. F. No person shall discharge a firearm while traveling on or using a wild, scenic, or recreational river, except for the purpose of hunting during those times and in those areas in which hunting for protected animals is allowed. 7.1.6: DANGEROUS WEAPONS: A. Weapons Prohibited: No minor under the age of 18 shall wear under his clothes, conceal about his person or within a motor vehicle, display in a threatening manner, or sell, offer for sale or carry or use any dangerous weapon. B. Exceptions: The prohibition of this Section shall not be construed to forbid any law enforcement officer from carrying or using dangerous weapons in the proper discharge of his or her duties. 7.1.7.A: DESIGNATED NO DISCHARGE ZONE: The City Council shall cause to be published a map designating the areas within the City where no discharge is allowed. Such map shall be published no later than 1 September on an annual basis. Discharge in areas not designated on the map for discharge is prohibited. 7.1.7.B: MAP: See attached map 7.1.8: PENALTIES: Any person who violates provisions of this Ordinance upon conviction shall be deemed guilty of a misdemeanor and shall be punished in accordance with the provision for misdemeanor penalty under State law as amended, plus costs of prosecution, for each offense. Section 2. This Ordinance shall be in full force and effect from and after its passage and publication. Adopted by the City Council, this 24TH day of July 1995. ATTEST: Norman F. There will be no live ammunition involved. As a volunteer with the First Minnesota Infantry,a Civil War reenactment group at Fort Snelling I,Ineed to keep in practice on loading and firing my weapon. One to six of fellow volunteers would also be practicing skirmishing at my residence. We would all use the same non -projectile firing weapons. No comments from the general public were received. In considering the broader issues of the Zoning text amendment and rezoning applications, the Planning Commission was comfortable that the proposed language to allowtemporary structures as an interim use provided sufficient protection to protect the long term desired character and quality of Otsego's industrial areas. During the meeting, the current property owner addressed the issue of the NSP easement, which has apparently been vacated. Documentation of this vacation will need to be provided. The applicant addressed the need for a berm and the fact that the mix tower was 50 feet in height. The Planning Commission was agreeable to addressing the 15 feet of additional height under the CUP provisions of the Ordinance allowing such increases based upon a finding that there is a demonstrated need for the additional height. The Planning Commission, in three motions, recommended approval of the Zoning text amendment, Zoning Map amendment, and IUP/CUPs by 7-0 votes. These requests will be considered by the City Council at their meeting on June 12, 2000. Findings of fact consistentwith the Planning Commission recommendations have been attached for review. The intent of this industrial area is to mirror the Otsego Industrial Park, with high quality, dry or minimum impact industrial uses. The proposed temporary structures are somewhat outside of this intended purpose. The Comprehensive Plan further outlines that the area should not develop until sanitary sewer service is provided to the area. (Policy Plan, p. 40) B. The proposed use's compatibility with present and future land uses of the area. Finding. The area surrounding the subject parcel is of rural or agricultural character. The MNRoad facility exists to the west and south of the subject parcel. Areas north of the site are agricultural fields. The principal concern in terms of area impact would be to the existing residential units to the east, which also front 70th Street. These parcels are also planned for future industrial or commercial uses, although no time line has been established. The potential impact to these residential properties is likely limited to traffic to and from the subject site. C. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Finding: The proposed use of the subject site would be expected to conform to all of the applicable performance standards of the 1-2 District, including those developed for temporary structures. D. The proposed use's effect upon the area in which it is proposed. Finding. The proposed text amendment and rezoning may have the effect of encouraging industrial development in the area. Such development would likely strengthen the City's tax base and may not be expected to have any negative effects provided that adequate facilities such as roads and water/on-site sewer can be provided. E. The proposed use's impact upon property values of the area in which it is proposed. Finding: Although no study has been completed, the proposed use is not anticipated to negatively impact area property values. F. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Finding: Jalger Avenue/70th Street adjacent to the subject property have been designed to the level of the City's collector/arterial street standards by MNDoT as part of the MNRoad facility. Jalger Avenue/70th Street is also connected to the City's higher order Streets to move traffic from the site out of the community. This was one reason that the subject parcel was designated for industrial use by the Comprehensive Plan. As such, these streets have adequate capacity to handle traffic generated by the site. G. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Finding: The proposed use is not anticipated to have a negative impact to the City's service capacity, provided adequate provisions are made foron-site septic and water services. 5. WATER USE.ORDINANCE SECTION 1. WATER AVAILABILITY AND USE CHARGES. The City Council has determined that in order to pay for the cost of construction, reconstruction, repair, enlargement, improvement, maintenance, operation, and use of the City water system; the cost of State and Federal regulations; and the principal and interest to become due on obligations issued or to be issued, it is necessary to impose just and equitable charges for the use and availability of said water system pursuant to Minnesota Statutes, Section 444.075, Subdivision 3. A. Usage Charge. From and after hookup of any premises to the City water system, the owner or owners of said premises shall pay for water used each month at rates fixed by resolution of the City Council, and any rates so established may be amended at any time by duly adopted resolution of the City Council. B. Penalty Charge and Interest on Unpaid Bills. The monthly water consumption charges shall be deemed delinquent if not paid on or before the due date. Bills will be mailed approximately two weeks before the due date. All delinquent accounts shall be subject to penalty calculated as follows: 1. A bill paid in full within 30 days after the due date shall pay a penalty of 10% of the balance due. 2. Beginning 30 days after the due date all unpaid balances shall accrue interest at a rate established by resolution of the City Council. Said interest will be on top of the penalty charge. C. Availability of Water Service. Owners or users of any property may not use a non -municipal water system without specific agreement with the City within those areas where City water service is available. SECTION 2. WATER LINE CONNECTIONS. All connections to the municipal water system shall be in conformity with the following rules and regulations, except that the City Council may, by resolution, waive the same upon showing of special conditions justifying such waiver. A. Separate Connection. Every premises served by a water hookup shall have a separate connection and a separate meter. B. Permit Required. No person, firm, or corporation shall hook up any water connection or meter to the City water line without first obtaining a permit therefore from the City. The initial connection and turn on operation for any water system connection shall only be performed by a City employee or authorized agent. C. Licensed Plumber Required. No person, firm, or corporation may hook up or service, or assist therein, any water line connected to the City water system, unless such person, firm, or corporation is a plumber duly licensed under the laws of the State of Minnesota or the ordinances of the City. D. Connection Charge. The connection charge imposed by the City for hookup of premises to the municipal water system shall be set by a duly adopted resolution of the City Council. E. Residential Equivalent Connections (REC) will be established for non-residential users. The number of REC's per use will be as per the current version of the Metropolitan Council Environmental Services Procedures Manual. F. No person shall connect to the City sanitary sewer system without connecting to the City water system, except by resolution of the City Council. SECTION 3. METERS. All water sold shall be measured by a City approved meter. Every customer shall provide a suitable place where a meter can be installed. The customer shall obtain and pay for an approved meter from the City and pay for all costs of meter installation in an approved location. For the purpose of reading or maintaining meters, shutting off or starting service, or other emergency situations, duly authorized employees or subcontractors of the City shall have authority legally to enter upon any premises at a reasonable hour. SECTION 4. ACCOUNTS IN NAME OF PROPERTY OWNER; DEPOSIT; LIEN FOR DELINQUENT ACCOUNTS. A. Account Name. All accounts shall be carried in the name of the property owner who personally, or by their authorized agent, shall apply for such service. Said owner shall at all times be personally liable for water service consumed upon the premises whether they are occupying the same or not. 2 B. Deposit. The City also reserves the right to demand of each and every customer, before the said service is turned on, a deposit with the City Administrator in an amount established by resolution. C. Lien on Property. All accounts, charges, and interest imposed by and pursuant to this ordinance are hereby made a lien upon the premises served by the water hookup. All such accounts and charges which are, on the lst day of October of each year, 30 or more days past due, and the same having been properly billed to the owner or occupant of the premises served, may be certified by the City Clerk as unpaid and delinquent to the County Auditor by the 1st day of November of each year. The City Clerk, in so certifying such accounts and charges to the County Auditor, shall specify the amounts thereof, the description of the premises served, and the name of the owner thereof. The amount so certified shall be extended by the County Auditor on the tax rolls against such premises in the same manner as other taxes and shall be collected by the County Treasurer and paid to the City Treasurer. SECTION 5. TAKING WATER WITHOUT AUTHORITY. Any person, firm or corporation who takes water from the municipal water system without complying with the provisions of this ordinance, or without other authorization, or who assists any other person in so doing, shall be guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a fine of not to exceed Seven Hundred Fifty ($750.00) or by imprisonment not to exceed ninety (90) days, or both. Violators are also responsible for the City's costs for prosecution or in seeking injunctive relief. SECTION 6. RIGHT TO DISCONTINUE SERVICE RESERVED. The City shall have the right and authority to discontinue water service to any property that is delinquent in payment or is in violation of water service rules or other City ordinance. A. The City or its subcontractor shall notify each sewer and water user/owner who have sewer/water accounts thirty (30) days past due. The notification shall include: 1. The amount owed the City including interest and other appropriate charges. 2. Date by which the account must be paid. 3. Service shut-off date. 4. If the user/owner does not contact the City within ten (10) days, the City shall hand deliver a shut-off notice to the delinquent party. 3 B. Shut-off. Services will be discontinued to the accounts who have not made arrangement with the City regarding the payment of delinquent account. The City shall also have the authority to shut-off service immediately without notice pursuant to any action against the property. C. Charges. The City shall charge service fees as established by resolution to discontinue services and to reinstate services to a delinquent account. Any charges incurred by the City in discontinuing service shall be assessed to the property. D. User/Owner Shutoff Request. The user/owner may request that their water be shutoff. The City will then shutoff the water with a service fee as established by resolution. Turning on the water and reinstalling the meter will cost an additional service fee. While the water is shutoff the owner/user will not be billed for the minimum charge. SECTION 7. RESPONSIBILITY FOR REPAIRS. The cost of all repairs and replacement of any plumbing between the residence or structure and the municipal water main line, shall be borne entirely by the owner of the premises affected, and if such repair or replacement work is performed by the city, the cost of time and material shall be assessed against the owner of the affected premises. SECTION 8. REPEAL OF INCONSISTENT ORDINANCES. All ordinances or parts of ordinances in conflict with this ordinance are to the extent of such conflict hereby repealed. This ordinance shall take effect and be in full force from and after the date of its publication. SECTION 9. PENALTY. Any person violating any provision of this ordinance shall, upon conviction therefor, be punished by a fine not exceeding Seven Hundred Fifty and N0/100 Dollars ($750.00) or by imprisonment not exceeding ninety (90) days, or both. A separate offense shall be deemed committed for each day the violation shall continue. The City is also allowed to seek injunctive or other relief and assess penalties as part of that process. 4 CITY OF OTSEGO COUNTY OF WRIGHT ORDINANCE NO. 00-?? SEWER USE ORDINANCE SECTION 1. PURPOSE AND OBJECT. The City Council has determined that in order to pay for the costs of construction, reconstruction, repair, enlargement, improvement, maintenance, operation, and use of the City sanitary sewage system and treatment plant; the cost of new State and Federal regulations; and the cost of principal and interest to become due or to be issued therefore; it is necessary to impose just and equitable charges for the use and availability of said sanitary sewer treatment system pursuant to Minnesota Statutes, Section 444.075. SECTION 2. SEWER USAGE CHARGES. A. Usage Charge. The sewer charge levied and assessed against the property in the City as aforesaid shall be established by resolution of the City Council. 1. For residential users, the sewer charge shall be determined using the average of the winter months water use. 2. Sewer charges for non-residential users shall be determined in the same manner as for residential users where practical. Where this is not practical, the monthly sewer charge shall be based on the monthly water usage for the affected premises. B. Penalty Charge and Interest on Unpaid Bills. The sewer usage charge shall be billed to the owner or occupant of the premises served by said sewer monthly and shall be payable to the City within fourteen (14) calendar days from the date in which the statement is issued. All delinquent accounts shall be subject to a penalty calculated as follows: 1. A bill paid in full within 30 days after the due date shall pay a penalty of 10% of the balance due. 2. Beginning 30 days after the due date all unpaid balances shall accrue interest at a rate to be established by resolution. C. Availability of Sewer Service. Owners or users of any property may not use a non -municipal sewer system without specific agreement with the City within those areas where City sewer service is available. SECTION 3. SEWER CONNECTION CHARGES. 5 All connections to the municipal sewage treatment system shall be in conformity with the following regulations, except that the City may, by resolution, waive the same upon showing of special conditions justifying such waiver. A. Separate Connection. Every premises served by the municipal sewage system shall have a separate connection. B. Permit Required. No person, firm, or corporation shall hook up any sewage connection to the City sewage collection system without first obtaining a permit from the City. C. Licensed Plumber Required. No person, firm, or corporation may hook up or service, or assist therein, any sewage line connected to the City sewage collection system, unless such person, firm or corporation is a plumber duly licensed under the laws of the State of Minnesota or the ordinances of the City. D. Connection Charge. The connection charge imposed by the City for hookup of premises to the municipal sewage collection system shall be set by a duly adopted resolution of the City Council. E. Residential Equivalent Connections (REC's) will be established for non-residential users. The number of REC's per use will be as per the current version of the Metropolitan Council Environmental Services Procedures Manual. Any charges so established may be amended at any time by a duly adopted resolution of the City Council. F. No person shall connect to the City sewer system without connecting to the City Water system, except by resolution of the City Council. SECTION 4. ACCOUNTS IN NAME OF PROPERTY OWNER; LIEN FOR DELINQUENT ACCOUNTS. A. Account Name. All accounts shall be carried in the name of the property owner who personally, or by their authorized agent, shall apply for such service. Said owner shall at all times be personally liable for sewage treatment service used upon the premises whether they are occupying the same or not. B. Lien on Property. All accounts and charges imposed by and pursuant to this ordinance are hereby made a lien upon the premises served by the sewage treatment hookup. All such accounts and charges which are, on the 1st day of October of each year, 30 or more days past due, and the same having been properly billed to the owner or occupant of the premises served, may be certified by the City Clerk as unpaid and delinquent to the County Auditor by the 1st day 0 of November of each year. The City Clerk, in so certifying such accounts and charges to the County Auditor, shall specify the amounts thereof, the description of the premises served, and the name of the owner thereof. The amount so certified shall be extended by the Auditor on the tax rolls against such premises in the same manner as other taxes and shall be collected by the County Treasurer and paid to the City Treasurer. SECTION 5. USE OF SEWER WITHOUT AUTHORITY. Any person, firm or corporation who uses or connects to the municipal sewer system without complying with the provisions of this ordinance, or without other authorization, or who assists any other person in so doing, shall be guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a fine of not to exceed Seven Hundred Fifty ($750.00) or by imprisonment not to exceed ninety (90) days, or both. Violators are also responsible for the City's costs for prosecution or in seeking injunctive relief. SECTION 6. CLASSIFICATION AND CHANGE OF RATE. The City Council shall have the power by resolution, to classify all types of sewage discharged into the sanitary sewer system of the City based on the quantity, concentration, cost of disposal and other pertinent facts, and to fix, increase, or decrease the rates charged for the use of said sanitary sewer system on any equitable basis the City Council may deem appropriate as the proper basis for measuring the use of said sanitary sewer system. SECTION 7. RESPONSIBILITY FOR REPAIRS. The cost of all repairs and replacement of any sewer service lines between the residence or structure and the public sewer main line, shall be borne entirely by the owner of the premises affected, and if such repair or replacement work is performed by the City, the cost of time and material shall be assessed against the owner of the affected premises. This ordinance shall take effect and be in full force from and after the date of its publication. NO 716 ;� WAGE AND WASTEWATER TREATMENT AND DISPOSAL STANDARDS 716.1 Purpose and Intent The purpose of the Sewage and Wastewater Treatment and Disposal Standards shall be to provide minimum standards for and regulation of individual sewage treatment systems (ISTS) and septage disposal including the proper location, design, construction, operation, maintenance and repair to protect surface water and groundwater from contamination by human sewage and waterborne household and commercial waste; to protect the public's health and safety, and eliminate or prevent the development of public nuisances pursuant to the authority granted under Minnesota Statues Chapters 115 and 145A and Minnesota Rules Chapter 7080 as amended that may pertain to sewage and wastewater treatment. 716.2 General Provisions (1) Standards adopted by reference. The County hereby adopts, by this reference, Minnesota Rules Chapter 7080 and Minnesota Statutes Section 115.55, along with any future amendments. (2) Permits. No person shall install, alter, repair or extend any individual sewage treatment system in Wright County without first applying for and obtaining a permit from the Environmental Health Office (EHO) and at the same time paying a fee as listed in the fee schedule determined by the County Board of Commissioners. Maintaining the system as originally designed and installed is excluded from the previous requirements. Staff will notify the permittee of an incomplete application, when the requirements are met a permit will be issued. Such permit shall be valid for a period of twelve (12) months from the date of issuance. A full design must be submitted before a permit for new construction is approved. When weather does not allow a full site evaluation to be completed, a design of the worst case scenario shall be submitted. Worst case scenario shall be a mound system, septic tank(s) and lift station. If Wright County Soil Survey is consulted and research of neighboring systems indicates that an in ground system is appropriate, that may be designed. Verification is required when weather permits. (3) Inspections. The permittee shall notify the EHO prior to the completion and covering of the ISTS. The installation and construction of the ISTS shall be in accordance with the permit requirements and application design. Inspections will be made at least once during the construction of the ISTS at such time to assure that the system has been constructed per submitted and approved design. (a) No part of the system shall be covered until it has been inspected and accepted by the Inspector unless prior arrangements have been made. (b) Proposals to alter the permitted construction shall be reviewed and the proposed change accepted in writing by both the designer and the EHO. (c) It shall be the responsibility of the property owner or authorized agent to notify the Inspector on the workday preceding the day inspection is desired. (d) If proper notice is given and the Inspector does not appear for an inspection within two hours after the time is set, the permittee may complete the installation. The permittee shall then file a signed As -Built, including photographs of the system prior to covering, with the EHO within five working days. The As -Built shall include a certified statement that the work was installed in accordance with submitted design and permit conditions 122 CAI IU d1L It wds [fee rrom cerecis. ` , ~'�•.Qe) Upon satisfactory completion and final inspection of the system the Inspector shall issue ' a Certificate of Compliance. If upon inspection the Inspector discovers that any part of the system is not constructed in accordance with the minimum standards provided in this Ordinance, the Inspector shall give the applicant written notification describing the defects. The applicant shall be responsible for the correction or elimination of al, defects, and no system shall be placed or replaced in service until all defects have been corrected or eliminated. (4) Neither the issuance of a permit nor the inspection of a system shall constitute any warranty or guarantee of operation of the system. (5) Existing System Compliance Inspections. An ISTS shall require a compliance inspection when any one of the following conditions occur: (a) Any time that a permit is applied for in a Shoreland Management Area (1000 feet of a lake, pond or flowage; or 300 feet of a river or stream or the landward extent of a floodplain). (b) No owner of a tract of land on which a dwelling is located, or tract of land on which a structure which is required to have an ISTS is located, shall sell or transfer to another party said tract of land unless requirements as stated in the Wright County Point of Sale Certification Ordinance for On -Site Septic Systems are met. (c) Addition of a bedroom on the property, or variance issued in accordance with Minnesota Rules Chapter 7080.0305 Subp. 3 (General Requirements for Local Units of Government). If a request for an additional bedroom or variance is received between November 1 and April 30 the County may issue a permit or variance immediately with the requirement that a compliance inspection be completed by the following June 1 and the applicant submits a certificate of compliance by the following September 30. If a system constructed between May 27, 1989 and January 23, 1996 does not comply with applicable requirements, and is not an imminent public health threat, a property owner applying for a zoning permit to construct a bedroom addition has five years from the date of issuance of such zoning permit to bring the system into compliance. (d) If an existing system (constructed prior to April 1, 1996) is not an immediate public health threat, the tank is watertight and provides at least two feet of soil separation, the system need not be upgraded, repaired or replaced or its use discontinued, as long the system is not located in the shoreland area, wellhead protection areas (200 feet from any public water supply well, that is any well serving 25 persons or more for sixty days of the year) and serving food/beverage/lodging facilities. The three foot rule applies in those circumstances. (e) Certificates of Compliance or Notices of Noncompliance shall be issued on the Minnesota Pollution Control Agency's Inspection Form for Existing Septic Systems. Copies shall be provided to the property owner and County within 30 days. (6) Failing septic systems must be properly abandoned according to part 7080.0176 within the 123 following time frames: (a) A failing ISTS shall be upgraded, replaced or its use discontinued within one (1) year. The Environmental Health Office will give consideration to weather conditions as it establishes compliance dates. (b) An ISTS posing an imminent threat to public health or safety shall be abated within 10 days of notice. The system shall be upgraded, replaced, or repaired or its use discontinued, within 6 months. (7) License requirements. No person shall engage in the evaluation, inspection, design, installation, construction, alteration, extension, repair, maintenance or pumping of on-site individual sewage treatment systems without first obtaining a license to perform such tasks from the Minnesota Pollution Control Agency, except as provided under part 7080.0700, subpart 1. An individual may be permitted to install or repair an ISTS on their own property if the system is designed by a licensed Designer and said Designer oversees their work. Pressurized systems cannot be constructed by anyone other than a licensed installer. (8) Additional soil treatment area requirements. On lots created after January 23, 1996, the system design shall include at least one designated additional soil treatment area which can support a standard soil treatment system. (9) Holding Tanks (a) Holding tanks shall not be used as a sanitary system for new residential construction or for improvements greater than 50% of the assessed value of the structure at the time of the application for the improvement. Subsequent improvements shall count towards the 50% value limit for improvement. (b) Holding tanks shall only be used as a corrective action for sewage disposal for pre- existing uses when a standard treatment system cannot be installed. (c) Undeveloped lots of record on which a holding tank is the only practical means of sewage disposal are unsuitable for residential use. (d) Holding tanks shall not be installed on undeveloped lots of record for recreational uses unless the lot has been found to be suitable for a dwelling and can support a full septic system. (e) Holding tanks must have a visual or audio alarm for the prevention of overflow 716.3 Standard systems shall take priority for new construction and on upgrades where those systems can be reasonably installed.* Systems classified as other, performance, and/or experimental shall meet the requirements of Chapter 7080. Warrantied systems are allowed if sized according to Tables 1 and 2. If a non-standard system is installed on a site where more than one sewer site is available and a standard system could be installed, a design for a standard system must also be included and that site must be reserved for that sewer. *Standard systems shall be defined as systems constructed in unaltered soils and are drainfields, pressure beds, at -grades, and mounds 124 (1) Chapter 7080 must be followed. (2) A minimum of two soil borings are to be conducted within the primary treatment area and one soil boring in the secondary treatment area. (3) The larger soil sizing factor must be used when there is a discrepancy between the soil texturF and percolation test or a justification for a smaller sizing shall be submitted with the design report. (4) Include the percent and direction of slope on site evaluations along with elevations of the trenches, corners of the pressure bed or rock bed of the mound. Infringement on property line setbacks requires written permission from affected property owner(s) using Wright County's Property Line Administrative Form, written agreement on location of property lines between affected parties and approval by the EHO. 716.5 Setbacks and Placement of Building Sewer (1) The building sewer pipe extending from the house to the tank shall not be less than four (4) inches in diameter and must meet the strength requirements of Schedule 40 plastic pipe. Construction of the line shall provide a grade of not less than 1/8 inch per foot for minimum grades as recommended by the Minnesota Pollution Control Agency. No 90 degree ells shall be permitted, and where the direction of the sewer is changed in excess of 22 1/2 degrees accessible cleanouts shall be provided. (2) The sewer pipe extending from the tank to the distribution medium must meet the strength requirements of Schedule 40 plastic pipe: Sewer pipe lines, manholes and other appurtenances shall be constructed in accordance with the State Plumbing Code and Minnesota Pollution Control Agency requirements. 716.6 Septage Disposal. See Section 770.8 Item 6 -Land Application of Septage. 716.7 Enforcement (1) Any person who violates any of the provisions of this Ordinance or who makes any false statement on a Certificate of Compliance, shall be guilty of a misdemeanor, punishable by imprisonment or a fine or both as defined by law. (2) In the event of a violation of this Ordinance, in addition to the other remedies, the County Attorney may institute appropriate actions or proceedings to prevent, restrain, correct or abate such violations. 716.8 Subject to Change The requirements of this Ordinance are intended to be comparable to the Environmental Protection Agency and Minnesota Pollution Control Agency standards. Should this Ordinance differ from other agency standards or should EPA or MPCA standards change, the more strict standards shall apply. 717. DWELLING UNITS PROHIBITED No garage, tent, trailer, motor home, accessory building, nor any vehicle or building not specifically approved by the Building Inspector shall at anytime be used as a dwelling. The basement portion of finished home or apartment may be used for normal eating and sleeping purposes provided it is properly damp -proofed, has suitable fire protection and exits, and is otherwise approved by the Building Inspector. One travel trailer or motor home (not to include mobile homes nor park trailers) is permitted for seasonal use on any lot provided that the following conditions are met: (1) Only one such unit is allowed per lot. (2) Sewage must be properly treated or hauled away. On lots which have been declared by the Board of Adjustment to be unacceptable as a building site, the unit shall have a self- contained holding tank and sewage shall be hauled away for treatment and disposal. (3) The travel trailer is for guests or recreational use only. It may not be occupied on any lot for more than 90 days in any one year. (4) The unit must have a current license attached in accord with state law. L STRUCTURE - The proposed building is a Butler® structural steel building system engineered and fabricated by Butler Manufacturing. The structure is 30' x 60' with an eave height of 10' high. The columns are straight, and are located on the perimeter of the structure, with no interior columns, to provide a completely open area under the roof. Please refer to the enclosed Floor Plan, Front Endwall (FEW) and Right Sidewall (RSW) Perspectives. The structure will be built according to the MN - 98 Building Code. H. ROOF - The roof is a Butler® ButleRib IITM roof system, with a 6:12 double slope pitch. EQUIPMENT PURCHASES The subcommittee recommends the purchase of the following equipment; Item Estimated cnst 3/4 ton truck, $28,000 Loader $170,000 ($19,000 per year on a lease) Tractor Mower No estimates received yet Water Truck No estimates. The 3/4 ton truck and the tractor mower have been listed on the proposed equipment list for several years. All of that list was approved for purchase last year because there were enough funds in the Capital Expenitures Fund to pay for them. The Subcommittee wanted to seek official Council approval of these two items. The Loader is being requested because it is a versatile piece of equipment that can clean out cul-de-sacs; move dirt, gravel, or other materials for minor projects; and do minor grading jobs. There is a Bobcat listed on the approved equipment purchase list. The Loader would replace it and be more versatile than it, but would be more expensive. This equipment would be purchased with funds from the Capital Expenditures Fund, which has adequate funds for the purchase. FACILITY IMPROVEMENTS The Subcommittee recommends the improvement of the Public Works garage by cementing the dirt floor in the back part of the garage. This would expand the working space and storage space in the facility. Dave Chase is in the process of obtaining bids for this. This improvement would be paid for from the Capital Expenditures fund, which has adequate funds for the purchase. DON MASS SALARY INCREASE Don Mass has finished his probationary period and has been recommended for a salary increase by Dave Chase. At his interview we had talked about an increase of $1.00 per hour after his probationary period was up. Due to his high quality of work, the fact that our maintenance worker salaries are lower than surrounding communities, and because people are continually trying to hire Don away from us, Dave Chase and I are recommending a $2.00 an hour increase. This would put Don at $14.00 an hour. This increase would be funded through the General Fund, which currently has adequate funds to accommodate it. 2 MEMO qi /I A Date: June 7, 2000 To: Mayor & Council From: City Administrator Mike Robertson Re: Gridor's Change Order Requests Waste Water Treatment Plant I have enclosed a letter from Bonestroo describing two change order requests from Gridor for the treatment plant. Change Order #2, for $8,000 is the change order the Council discussed and approved one month ago. This is just the official paperwork for the change order. Dayton has approved this change order. Change Order #3, for $4,585, is for the extra costs Gridor occurred as part of making certain that the treatment plant did not suffer damage by the City's decision to delay startup from January 2000 to October 2000. Startup was delayed because development, both in Otsego and in Dayton, did not occur as fast as we had originally thought it might. I have faxed this information to the City of Dayton, which meets next Tuesday (June 13, 2000). I would recommend approval of Change Order #3, contingent upon Dayton City Council's approval. Change Order No. 2, installation of base -bid non -clog pumps, was approved by the City Council last month and only requires a signature to finalize the paperwork. This change order is for an $8,000 add to the contract amount. Change Order No. 3 addresses additional Contractor effort for winter protection of concrete tanks and additional effort for handling water from lift station testing in the collection system. These issues were discussed in our January 27, 2000 letter to the City. A copy of the letter is attached. This change order requires formal approval by the City Council. Change Order No. 3 is for a total amount of $4,585. Attached are the change request forms submitted by Gridor Construction documenting the costs of the requested changes. We recommend approval of Change Order No. 3. A discussion is provided below: • $1,080 is for additional Contractor effort to fill concrete tanks with water for winter protection and for additional effort to handle water received at the treatment facility from lift station testing in the sanitary collection system. The Contractor anticipated completing construction in January 2000 and turning the project over to the City. When it became known that the WWTF would not be in operation until October 2000, it was necessary to fill the tanks with water to insure protection against the possibility of frost heave. Had the WWTF been placed in operation in January, the concrete tanks would be full of wastewater and the potential for frost heave would not have been an issue. Lift station testing involved the pumping of water from the collection system to the treatment facility. You will note that our January 27, 2000 letter showed a cost of $9Q0 for this change order item. The increase in cost of $180 is due the second lift station testing event which occurred after the letter was written. $3,505 is for a temporary well pump and its associated temporary electrical power. The purpose of the temporary well pump was to insure a source of water for winter protection of concrete tanks. The permanent well pump had not yet been installed and was not available for use in November 1999 because of the on-going issue with the Department of Health concerning aquifer formations. It was not until late winter year 2000 that the DOH granted approval for the well. Please note that our January 27, 2000 letter indicated a cost of $2,736 for this change order item. The $2,736 figure did not include the cost to remove the pump, nor did it include the rental cost of the pump. The $3,505 includes these costs. WI Websire: www.bonestroo.com As you know, we have asked Gridor Construction to delay the substantial completion date for the wastewater treatment facility (WWTF) from April 15, 2000 to September 30, 2000. The delay is necessary because the sewer system will not be generating enough wastewater to operate the WWTF until October 2000. It was Gridor's intent to reach substantial completion by January 2000, about three months ahead of schedule. Because of the delay to September 30, Gridor will incur some added costs. The purpose of this letter is to summarize these costs to date. Temporary '%yell Pump When below -grade concrete tanks are empty of water during winter, there is a remote possibility of damage from frost heave. To fully protect the tanks at the treatment facility throughout the winter season, it was necessary to partially fill them with water. The permanent well pump had not been installed because of the issue with the Minnesota Geological Survey concerning aquifer formations. Thus, the contractor had to install a temporary well pump and associated temporary electrical hookup to insure a source of water for filling the tanks. The cost of this change is 52,736. Tank Filling and Temporary Pumping Gridor has expended 16 hours of labor to fill all concrete tanks with water for winter protection. The cost for this change is 5720. More labor will be required to pump the water out of the tanks in spring. Gridor has also expended four hours of labor to deal with water pumped to the treatment facility from pipe testing for the Barbarossa project. The contractor needed to pump this water out of the screen room channel, splitter box and oxidation ditches to prevent the possibility of damage to buried piping. The cost for this effort is S 180. The total for both the tank filling and temporary pumping is S900. Sincerely, ey ty Admm�,strator CC: City Council Mark Hanson, City Engineer JUN -07-2000 15:13 CITY OF DAYTON P.03 ASSESSMENT AGREEMENT CITY OF OTSEGO AND CITY OF DAYTON WHEREAS, the City of Otsego (hereinafter "Otsego") and the City of Dayton (hereinafter "Dayton") have previously entered into a Sewer Use Agreement dated 1%a-.lV�(hereinafter "Agreement'); and WHEREAS, the Sewer Use Agreement provides that Otsego and Dayton shall have exclusive ownership and control of all sewer lines lying within their respective jurisdictions; and WHEREAS, areas shown on attached Exhibit "A" are lots within the municipal boundary of Otsego, but will receive service through connection with the Dayton system of sewer lines; and WHEREAS, pursuant to the Agreement, Dayton is obligated to provide service to the lots shown on attached Exhibit "A' only in the event that Otsego levies assessments against all said lots in an amount requested by Dayton and all lots waive in writing appeal of the assessment, or no appeal has been filed from said assessment or any appeal filed has been dismissed. NOW THEREFORE, it is hereby agreed by and between the parties as follows: Otsego agrees to levy assessments against all lots shown on Exhibit "A" by 1 V. in the amounts and manner described in Exhibit "B", as requested by Dayton pursuant to the Sewer Use Agreement and obtain written waivers by the property owners of all rights to appeal the assessments. 2.
