Re: Eileen Kvarnlov's Request for a "No Jake
Brakes" Sign
Eileen Kvarnlov of 16580 58th Street will be attending
the City Council meeting to request a "No Jake Brake"
sign be installed on State Highway 101 at its
intersection with County Road 36. Ms. Kvarnlov has
been disturbed by the sound of trucks breaking for the
stoplight at County Road 36. This disturbance peaks
during the summer when her windows are open.
Ms. Kvarnlov has spoken with both me and MNDOT for over
a year. I spoke with MNDOT last summer and they told
me that a local government could put up a sign on a
State Highway as long as it met State specifications.
They also said that they were revising their
regulations regarding Jake Brake signs and that they
could not give me any information or allow the
installation of any signs until those revisions were
complete. I asked them to send me a copy of the new
rules when they were completed but I did not receive
them until I called them again recently.
I also asked MNDOT to examine what I felt was an unsafe
design element at the intersection and probably the
source of Ms. Kvarnlov's complaint. When a vehicle is
south bound on Highway 101 approaching the stoplight at
County Road 36, the stoplight is visible for a long
distance, then goes out of view briefly due to a hill.
If the light has changed from green to red during the
brief interval it is out of sight, there is enough time
for a car to stop without much effort but a truck
traveling 65-70 miles an hour must really hit the
brakes hard, as anyone can tell from the long streaks
of black rubber on the road. I'm sure this is the
source of most of the sound that is disturbing Ms.
Kvarnlov.
With regard to Ms. Kvarnlov's request, MNDOT's new
rules no longer allow "No Jake Brake" signs. Even if
they did, I don't think that a trucker trying
desperately to stop before going through a red light is
going to worry about complying with such a sign. The
signs now allowed by MNDOT are entitled "Vehicle Noise
Laws Enforced". The City would have to make written
request for the sign to receive a permit to install it.
The City would also have to pass a resolution stating
that it would enforce the State statute governing
vehicle noise limits. The City will be responsible for
the purchase cost, installation, and maintenance of the
sign.
I tried to get MNDOT to look at installing one of those
signs where the lights flash when the signal ahead is
about to change. They just told me verbally that the
intersection did not meet criteria for such a sign. I
asked them to send me a written response about this but
I never received one. I will write another letter to
MNDOT, copying our legislators, asking for an official
written response. I think given the recent truck
accident at that intersection that perhaps we can get
some truckers groups involved pushing for this as well.

In Carl Swenson's absence, Chair Richard Nichols called the July 3, 2000 Planning
Commission Meeting to order at 8 PM.
Roll Call:
Planning Commission: Richard Nichols, Ken Fry, Arleen Nagel, Pat Moonen, and Steve
Schuck. Christian Mbanefo arrived at 8:03 p.m. Absent: Carl Swenson, Eugene
Goenner, and Jim Kolles had excused absences.

Commissioner Nagel motioned to accept the June 19, 2000 Planning Commission
Minutes. Seconded by Commissioner Schuck. Carried 5-0.

3 Public Hearing - Christ Lutheran Church, 15849 NF 98th Street. Otseg%n o Request for

Assistant Planner Sherman summarized the staff report. Carey Lyons of VanMan
Companies, architect for Christ Lutheran, stressed that the exterior material will be
durable, maintenance free, and will not have exposed fasteners. They intend to re -do the
siding on the first building with the same material if approved.
Richard Nichols asked if the trim would be a contrasting color? Lyons said yes it will.
Christian Mbanefo asked about the durability of the siding. Lyons said it has a lifetime
warranty covering fading.
Richard Nichols opened the hearing for public comments. Hearing no comments the
public hearing was closed at 8:17 p.m.
Christian Mbanefo said that since the Church was at the entrance to the City's commercial
area, he did not support 100% metal siding and would prefer more brick or stone on the
exterior. Richard Nichols said that he shared those concerns, but would support the
request because it is allowed by the ordinance. Councilmember Heidner requested more
information on the type of metal and the warranty.
Commissioner Moonen, seconded by Commissioner Fry, moved to recommend
approval of the Conditional Use Permit. Carried 5-1, Mbanefo opposed.

Plan and Building Plan Review for S c r d. Self Mini -Storage Units
Assistant Planner Sherman summarized the staff report. Brenton Kent, Secure Mini -
Storage, indicated that the storage units were aimed more at higher end residential than
commercial users. He said the units would be brick faced and the site would be
surrounded by a security fence. He stated the gate will be locked with a keypad, and that
he will be able to code the lock for users automatically from St. Cloud, and that there
would be no office or employee on site. Because of this, he does not feel any parking
would be needed on site.
In response to commissioners' questions, Kent noted that the building was approximately
15-20 feet tall, that the area around the buildings would be blacktopped, that the units
varied in size but that the average was 10x20, and that he would build four buildings in his
first phase.
Commissioner Mbanefo asked staff why the requirement for parking spaces. Cindy
Sherman said the requirement was based on the square footage of the buildings and that
the spaces could be put on the corner of the lot without changing the buildings. She noted
that the requirement was based on the possibility that the use of the property could change
in the future.
Richard Nichols opened the hearing for public comments. Hearing no comments the
public hearing was closed at 9:10 p.m.
Commissioner Mbanefo, seconded by Commissioner Fry moved to recommend
approval of the site plan subject to the conditions in the staff report, with Condition
Two requiring off-street parking being deleted contingent upon the use not
changing in the future, and Condition Four being modified to state 75% Non -
Opaque fence. Carried 6-0.
5. Discussion of Sewer Capacity
Staff Report:
Assistant Planner Sherman summarized the staff report. City Administrator Robertson
discussed the financing plan, and the current number of building permits pulled in the
sewer area. Councilmember Heidner said that Dayton could request up to 49% of any
future expansion of the sewer plant, and that the report should note that.
Commissioner Schuck, seconded by Commissioner Mbanefo, moved to recommend
that the City borrow ahead from the commercial/industrial reserve capacity, based
on the eventual expansion of the sewer plant to a 400,000 gallons per day capacity.

EXECUTIVE SUMMARY
Background
Arcon Development, Inc. has submitted an application for final plat approval of Pheasant
Ridge Second Addition. The second addition consists of 42 lots within four blocks. The
preliminary plat of Pheasant Ridge was approved by the City Council on July 23, 1999.
The final plat of the first phase of Pheasant Ridge was approved by the City Council on
September, 1999. The subject site is within the Sanitary Sewer Service District and is
zoned R-4, Residential Single Family - Urban District. A PUD -CUP also regulates
development of this parcel establishing a front yard setback based upon the building pad
location as part of a coving design concept. Flexibility for 10 foot/5 foot side yard setbacks
and minimum lot size was also approved as part of the PUD -CUP.

Recommendation
The submitted Pheasant Ridge Second Addition Final Plat is consistent with the approved
preliminary plat, including all applicable conditions of approval and adopted City
Ordinances and policies. As such, our office recommends approval of the Pheasant Ridge
Second Addition Final Plat, subject to the following conditions:

The City Engineer review and approve of all proposed street right-of-way and street
section designs.
2. A revised grading plan is submitted for the second addition with lot boundaries that
are consistent with the second addition final plat and include lot numbers, building
pads, and drainage arrows. Grading and drainage plans are subject to review and
approval by the City Engineer.
3. The applicant shall submit construction plans as required by the Subdivision
Ordinance and Engineering Manual, subject to review and approval of the City
Engineer.
4. A park dedication fee in lieu of land in the amount of $45,150 is paid.
5. The applicant enter into a development contract with the City and post all required
escrows and securities, subject to review and approval of the City Attorney.
6. Comments of other City Staff.
ISSUES ANALYSIS
Consistency with Preliminary Plat. The proposed final plat is generally consistent with
the approved preliminary plat for Pheasant Ridge. The following summarize any changes:
Lots. The submitted final plat includes 42 lots, which is one less than the
preliminary plat. The lot designs are consistent with those of the preliminary plat,
except lot lengths are lengthened along the existing power line easement and one
lot is eliminated on the south side of Palmgren Avenue to allow greater width of lots
in this area. Lots 6 - 7, Block 2 (Preliminary Plat Lots 45 - 46, Block 6) have been
lengthened, as required. All lots are at least 11,000 square feet in area and all lots
measure at least 75 feet wide at the proposed front yard setback, which was
indicated by the building pad location on the preliminary grading plan. Lot area and
width flexibility was approved as part of the PUD -CUP and preliminary plat.
Street Design. The street design is consistent with the preliminary plat; however,
the City Engineer had noted concern with the curve radii as part of the preliminary
plat review. Street design and names are subject to City Engineer review and
comment.

Sewer Capacity. At this time the City has final platted 427 lots. With the addition of the
42 proposed lots, the City will have final platted 469 lots, which is just over the reserve
capacity of the sewer plat. To accommodate the proposed 42 lots, the City will need to
either borrow from the commercial/industrial reserve or allow development based on the
permitted capacity of the plant, which is 400,000 gallons.
Easements. The final plat illustrates all drainage and utility easements required by the
Subdivision Ordinance. This includes easements around the perimeter of individual lots
as well as easements overlaying ponding areas and wetlands. All proposed easements
are subject to review and approval of the City Engineer.
Grading and Drainage. A final grading plan was submitted with the first phase final plat.
This grading plan includes the second phase area; however, lot lines have been revised
and building pads for the second addition are not shown. A revised grading plan must be
submitted for the second addition with lot boundaries that are consistent with the second
addition final plat and include lot numbers, building pads, and drainage arrows. Grading
and drainage plans are subject to review and approval by the City Engineer.
Construction Plans. The applicant will need to submit construction plans for elements
of the project such as utilities, grading and drainage, sewer and watermain, storm sewer
and street construction. All of these plans are subject to review and approval of the City
Engineer for consistency with the provisions of the Subdivision Ordinance and Engineering
Manual.
Park Dedication. The applicant is required to dedicate $1,075.00 as combined park/trail
dedication in lieu of land per new lot. Based upon 42 new lots, the total dedication will be
$45,150.00 as part of this second phase of the Pheasant Ridge.
Development Contract. The applicant is required to enter into a development contract
with the City and post all securities, as well as provide the financial commitment for
sanitary sewer and water service as part of that contract. The development contract is
subject to review by the City Attorney and approval of the City Council.
CONCLUSION
The proposed Final Plat of Pheasant Ridge Second Addition is generally consistent with
the approved preliminary plat of the project, including all applicable conditions of approval.
Our office's specific recommendation regarding the application is outlined in the executive
summary of this report.

The Planning Commission conducted a public hearing at their meeting on July 3,
2000 to consider the above referenced application. There were no comments
received from the general public.
The Planning Commission discussion focused on type of siding proposed and
the appropriateness of an all -metal sided building at this location.
Councilmember Heidner requested additional information be provided to the City
Council regarding the materials proposed and related warranty information.
The Commission voted 5-1 to recommend that the Council approve the CUP as
requested.
The application is scheduled for City Council review at the July 10, 2000 meeting.
Findings of Fact consistent with the Planning Commission's recommendation are
attached for Council consideration.

Findings of Fact
& Decision
Request: Consideration of a conditional use permit to allow use of metal exterior siding for
more than 50 percent of any one wall within the INS, Institutional District for Christ Lutheran
Church located at 15849 NE 901h Street (southeast of CSAH 39/CSAH 42).
City Council Meeting Date: 10 July 2000
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
The legal description of the subject property ("the property") is Lot 1, Block 1 MRD
Commercial Development.
2. The property lies within the Sanitary Sewer Service District and is guided for institutional
land uses by the 1998 Comprehensive Plan Update.
3. The property is zoned INS, Institutional District; The existing religious facility is a permitted
use within said District.
4. The City Council approved an application for site and building plan review on October 25,
2000 to allow a 11,200 square foot expansion of the applicant's building. The applicant is
proposing to use a metal exterior finish siding for the building expansion;

Notwithstanding more restrictive provisions, metal siding is an allowed exterior finish per
Section 20-17-4.A of the Zoning Ordinance.
Section 20-17-4.B.1 of the Zoning Ordinance limits the use exposed metal siding within the
INS District to not more than 50 percent of any one wall.
Section 20-17-4.0 of the Zoning Ordinance allows for exceptions to the provisions of
Section 20-17-4.13 of the Zoning Ordinance provided that:
A. The proposed building maintains the quality and value intended by the Ordinance.
B. The proposed building material is compatible and in harmony with other existing
structures within the district and immediate geographic area.
C. The provisions of Section 20-4-2.F of the Zoning Ordinance are considered and
determined to be satisfied.
8. The Planning Commission and City Council must take into consideration the possible
effects of the conditional use permit with their judgement based upon (but not limited to)
the criteria outlined in Section 20-4-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The CSAH 391CSAH 42 area is one of the primary gateways into the
community and is intended to be the principal commercial center. The
Comprehensive Plan states that the City will encourage high quality development in
this area, as well as promote cohesive design (quality, scale, building uniformity) for
new development. The requested CUP is considered to be consistent with these
guidelines. The following policies of the Comprehensive Plan further support
approval of the applicant's request.
Standards for development quality shall be established for all land
uses to insure an enhancement of community character All such
standard shall be strictly adhered to and enforced. (Policy Plan, p. 40)
The Character of individual neighborhoods shall be reinforced,
maintained and upgraded. (Policy Plan, p. 40)
B. The proposed use's compatibility with present and future land uses of the area.
Finding: From a material standpoint, the proposed metal siding would be compatible
with existing or future land uses. Aesthetically, the proposed architectural theme is
consistent with the intent to achieve cohesive building designs within the area.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: Not applicable.
D. The proposed use's effect upon the area in which it is proposed.
Finding: As this site is one of the first uses developed in the area, the church design
may be viewed as a benchmark for which other development proposals will be
evaluated. The use of the proposed material over more than 50 percent of anyone
wall area is considered appropriate for this site and establishes an appropriate
design standard as described by the Comprehensive Plan.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values as the intent to require quality and
aesthetically compatible building materials is upheld.

F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: Not applicable.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Finding: Not applicable.
9. The planning report dated 28 June 2000 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.
10. The Otsego Planning Commission conducted a public hearing at their regular meeting on
3 July 2000 to consider the application, preceded by published and mailed notice. Upon
review of the application and evidence received, the Otsego Planning Commission closed
the public hearing and recommended by a 5-1 vote that the City Council approve the
application based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested
conditional use permit is hereby approved based on the most current plan and information
received to date.

Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
1. The legal description of the subject property (the "property") is Lot 2, Block 1, Otsego
Industrial Park 4th Addition.
2. The +/- 6.0 acre property lies within the Long Range Urban Service Area and is guided for
industrial land uses by the 1998 Comprehensive Plan Update.
3. The property is zoned 1-2, General Industrial District; Warehousing uses are a permitted
use within said District.
4. Development of the property is subject to site and building plan review subject to Section
21, Site/Building Review, of the Otsego Zoning Ordinance.
5. The planning report dated 28 July 2000 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.
6. The Otsego Planning Commission considered the application at their regular meeting on
3 July 2000. Upon review of the application and evidence received, the Otsego Planning
Commission recommended by a 6-0 vote that the City Council approve the site and
building plans based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested site and
building plans for development of a warehousing use for Lot 2, Block 1, Otsego Industrial Park 41h
Addition is hereby approved based on the most current plan and information received to date,
subject to the following conditions:
1. The site plan is revised to setback the parking/circulation surface at least 15 feet from the
front lot line.
2. A landscaping plan is provided indicating seeding or sodding of all unsurfaced areas and
provide for boulevard trees along Jensen Avenue, subject to review and approval of City
Staff.
3. Proposed fencing shall be at least 75 percent non-opaque and shall be limited to a
maximum height of eight feet. The location of the gate shall be revised to provide sufficient
stacking space off of Jensen Avenue, subject to review and approval of the City Engineer.
4. All site lighting shall be a shoebox design with 90 degree cut-off, subject to review and
approval of the City Engineer.
5. Proposed signage is revised to conform the area and height limitations required by Chapter
37, must be setback 12.5 feet from the rear property line and shall require approval of a
signage permit by the Zoning Administrator.
6. The City shall reserve the right to require that trash dumpsters and enclosures be provided
if trash or rubbish becomes an nuisance issue in the future.
7. All grading and drainage plans shall be subject to review and approval of the City Engineer.
8. The site plan is revised to provide a potential location for on-site septic systems, subject
to review and approval of the City Engineer.
9. The Zoning Administrator verify that the Preliminary and Final Plat of Otsego Industrial
Park 4th Addition has been recorded prior to issuance of any building permit.

EXECUTIVE SUMMARY
Background
Backes Companies, Inc. has submitted an application for final plat approval of Crimson
Ponds 3rd Addition_ The final plat consists of 50 lots within two blocks and three outlots.
The Crimson Ponds Preliminary Plat included 180 lots of which, 75 have already been final
platted as part of the first and second additions. The subject site is guided for low density
residential development within the Sanitary Sewer Service District by the Comprehensive
Plan and is zoned R-4, Residential Single Family - Urban District.
Applications for final plats are processed in accordance with Section 21-3-3 of the
Subdivision Ordinance. Consideration of a final plat application does not require a public
hearing and does not require review by the Planning Commission. As such, this
application is presented to the City Council without review and recommendation of the
Planning Commission.

The submitted final plat application is generally consistent with the approved preliminary
plat as well as the City's Comprehensive Plan, Zoning Ordinance and Subdivision
Ordinance. As such, we recommend approval of the Crimson Ponds 3rd Addition Final
Plat, subject to the following conditions:
1. All construction plans are subject to review and approval of the City Engineer.
2. The applicant pay $53,750 to satisfy park dedication requirements in lieu of
dedicating land.
3. The applicant enter into a development contract with the City, post appropriate
securities and pay applicable fees, subject to review and approval of the City
Attorney.
4. Comments of other City Staff.
ANALYSIS
Preliminary Plat Consistency. The number of lots proposed and the design of this third
addition is consistent with that for the area approved as part of the preliminary plat and in
conformance with the conditions of approval. Further, the lot widths and sizes proposed
as part of the second addition are consistent with the approved preliminary plat and R-4
District requirements of 75 feet (94 feet on a cul-de-sac bulb) and 12,000 square feet.
Outlots. The final plat includes thee outlots. Outlots A and B are provided as part of
wetland/ponding areas. Oudot C represents the balance of the approved preliminary plat
reserved for future final plats and development.
Streets. The internal streets to be constructed as part of this final plat are consistent with
the layout of the preliminary plat. A potential issue in the nearfuture is the need to provide
a second outlet from the subdivision, which currently only has access to Page Avenue at
80"' Street_ A second access to Page is provided within the Second Addition at 81,0 Street.
However, Page Avenue is not intended to be constructed between 80th and 81 st Street
until such time as the second phase of Pheasant Ridge develops with an east intersection
at 81 st Street. With 125 lots within the initial three additions of Crimson Ponds, the need
for a second access is important for traffic management and safety.
Construction Plans. The applicant is required to provide construction plans for the
project, addressing utilities, grading and drainage. The final plat also includes proposed
drainage and utility easements consistent with those shown on the preliminary plat. The
required construction plans are subject to review and approval of the City Engineer.

Sanitary Sewer. The City has approved final plats for 284 residential units as of the date
of this report. Within the City's present policies for allocation of sanitary sewer capacity,
a total of 448 residential units may be allowed as part of the initial capacity. As such, there
is adequate capacity available to service the proposed final plat_
Park Dedication. No park land was dedicated to the City as part of this development.
As such, the applicant must pay a fee in lieu of land equivalent to $9,075 per lot to satisfy
park dedication. Based upon 50 lots, the total park dedication fee in lieu of land for this
final plat is $53,750.
Development Contract. If the proposed final plat is approved, the developer will be
required to enter into a development contract with the City, post all required securities and
pay applicable fees. The development contract is subject to review and approval of the
City Attorney.
CONCLUSION
The proposed final plat of Crimson Ponds 3rd Addition is consistent with the approved
preliminary plat and applicable conditions of that approval. The proposed final plat is also
consistent with the applicable provisions of the City's Comprehensive Plan and
development regulations. Our specific recommendation for action by the City Council is
outlined in the executive summary of this report.

required to expand the plant when it becomes necessary.

A RESOLUTION PROVIDING DEFINITION OF THE CITY OF OTSEGO'S GROWTH
MANAGEMENT POLICY FOR RESIDENTIAL DEVELOPMENT AS OUTLINED BY THE
1998 COMPREHENSIVE PLAN UPDATE.
WHEREAS, the City of Otsego has constructed a waste water treatment plant
("WWTP") and sanitary sewer collection system with a 200,000 gallons per day capacity
(gpd); and,
WHEREAS, the permit issued by the Minnesota Pollution Control Agency for the
Otsego WWTP in 1998 allowed for a maximum 400,000 gpd capacity; and,
WHEREAS, the City of Otsego has sold the City of Dayton 40,000 gpd capacity for
service of areas within the City of Dayton leaving 160,000 gpd capacity available to serve
areas within the City of Otsego Sanitary Sewer Service District based upon the 200,000
gpd capacity of the WWTP, as constructed; and,
WHEREAS, the City of Otsego adopted a Comprehensive Plan Update in
September 1998 which established the following policies:
• A minimum of 30 percent of waste water treatment plant capacity shall be reserved
for industrial (or commercial) development with a maximum of 60,000 gallons per
day capacity reserved for the forthcoming 20 year planning period. (Policy Plan p.
50)
• Preliminary plat approval by the City shall not guarantee access to sanitary sewer
service. The City shall only guarantee such service to approved final plats with
signed contracts which assure the City of timely development. (Policy Plan, p. 63)
• Sanitary sewer allocation will be provided on a "first come, first serve" basis.
(Policy Plan, p. 63)
WHEREAS, implementation of these policies based upon the constructed and
permitted capacity of the WWTP would limit potential final plats for residential
development to 448 dwelling units; and,
WHEREAS, the City of Otsego, as of July 1, 2000, has approved preliminary plats
for 929 residential units and final plats for 248 residential units within the Sanitary Sewer
Service District; and,
WHEREAS, the memorandum dated 28 June 2000 prepared by the City Planner,
Northwest Associated Consultants, Inc., is incorporated herein; and,
WHEREAS, the City of Otsego promotes continued residential development within
the policies and plans of the 1998 Comprehensive Plan Update to expand the housing
supply to meet demand and generate revenues for the financing of the City sanitary sewer
and water systems; and,
NOW THEREFORE BE IT RESOLVED THAT, the City of Otsego shall interpret its policies
for the allocation of sanitary sewer capacity to residential, commercial and/or industrial
land uses within the Sanitary Sewer Service District to be based upon the MPCA permitted
capacity of 400,000 gallons per day.

Re: Estimated Assessment for Proposed
"Slabtown" Neighborhood Improvements
I have reviewed the estimated assessments for the
Dayton Utility/Street Improvement with Dayton City
Engineer Mark Hanson. I will lay out below how
Dayton made those estimates, and how those
estimates would be changed for "Slabtown" residents
because of the differences between Otsego and
Dayton's Assessment policies.
I have also enclosed a copy of page 3, Paragraph 4,
of our contract with Dayton, which spells out
Otsego and Dayton's obligations to each other.
Dayton has broken the proposed improvement and
assessment into four parts. Part I -Sanitary Sewer;
Part II -Street Eligible; Part III -Water; Part IV -
Street Non -Eligible. The difference between Street
Eligible and Non -Eligible costs are that the State
Grant Dayton received pays for street restoration
but not for the addition of curb & gutter and storm
water pipe. There are some severe stormwater
problems that Dayton intends to correct through
installation of curb & gutter and stormwater pipe.
Some of those problems are in the Otsego portion of
the "Slabtown" neighborhood. In accordance with
Dayton's financial plan, Otsego residents will
benefit by $43,860 from reduced assessments due to
the State Grant that Dayton received.
Assessments are determined on a per lot basis.
Those lots capable of being subdivided are assessed
for more than one lot. All property owners in
Otsego are assessed for one lot, with the exception
of Rick Grupa, who is assessed for six lots.
However, two of Rick Grupa's lots located along
County Road 36 are assessed only for trunk sewer
and trunk water. Service stubs to these lots are
presently not included in the Dayton project.
Services can be added as a change order to the
present project or constructed at some point in the
future, depending on the timing of development in
the subdivision. Because these lots will front on
County Road 36, they will not be assessed for the
street improvement.
PART I - SANITARY SEWER
The total Dayton Sanitary Sewer assessment is
estimated at $6,300 per lot. That breaks down to
$1,640 for the Sewer Treatment Plant, $2,170 for
the Trunk Sanitary Sewer line, and $2,490 for the
Lateral Sanitary Sewer lines.
Otsego residents would not pay the Sewer Treatment
Plant charge, but would pay Otsego's Treatment
Plant fee, which is $2,766 per lot, so their total
would be $7,426 per lot.
PART II - STREET ELIGIBLE
The Street Eligible assessment is $3,025 for
residential lots. That reflects Dayton's policy of
assessing only 50% of street costs.
Otsego's policy of 100% assessment would mean a
cost of $6,050 for this portion of street costs.
PART III - WATER
The total Water assessment is $6,900. That breaks
down to a $1,550 for Trunk Water facilities
(Well/Pumphouse) and $5,350 for Lateral Water
lines. This assessment would be the same for both
communities.
PART IV - STREET NON -ELIGIBLE
The Street Non -Eligible assessment is $1,750 for
residential lots. That reflects Dayton's policy of
assessing only 50% of street costs.
Otsego's policy of 100% assessment would mean a
cost of $3,500 for this portion of street costs.

(8) inch lateral lines with four (4) inch services.
Water Lines - The water lines will consist of six
(6) and eight (8) inch lateral lines with one (1)
inch services.
streets - Streets will be twenty-four (24) and
thirty (30) feet wide with curb and gutter. The 30
foot wide streets will have insurmountable curb and
the 24 foot wide streets will have surmountable
curb. 62nd Lane from County Road 36 to Richardson
Avenue is proposed to be 30 feet wide.
Storm S wer- To satisfy stormwater requirements,
its proposed that there would be a stormwater
holding pond in the Grupa subdivision with a 30
foot drainage swale running from there south to the
Crow River. This will handle water running off
both 62nd Lane and Richardson Avenue. If this
system is not constructed, the alternative would be

punching a 20 foot pipe under 62nd Lane which would
run north and outlet directly into the Crow River.
Either system would eliminate a bad situation where
stormwater will occasionally run through the garage
of a homeowner on the north side of 62nd Lane.
If Grupa's subdivision goes ahead, Dayton could add
the stormwater work on his property by change order
to their project. The easements would have to be
acquired by Otsego as part of the platting process.
The Dayton City Engineer has estimated that this
alternative would be $5,000-$10,000 cheaper than
the stormwater pipe.

Lefebvre Creek Storm Sewer System
At the city council meeting on 6/26/00, our office was instructed to complete preliminary
cost estimates for the Lefebvre Creek Storm Sewer System in Sections 22 and 23,
Township 121 N, Range 23W.
The council chose to see 3 different options, which all follow the Alternate A route.
Alternate A closely followed the south side of the sanitary sewer easement. A change
was made on the Zachman property placing the route along the north side of the
sanitary sewer easement for a few hundred feet.
The three options were:
1. The entire length as a ditch;
2. The entire length as pipe -sized for 100 -year event; and
3. The Lefebvre Creek portion as pipe and the remainder as a ditch.
The ditch option cost was approximately at $360,000. The all pipe option cost was
approximately at $1,817,000. The partial pipe and partial ditch option cost was
approximated at $1,127,000 (see attached preliminary cost estimates). All options
included an estimate for easement and 30% for contingency.
A special note on the pipe options is that many areas do not have sufficient cover over
the pipe (even after using two lines of arch pipes to reduce height) therefore, material
would need to be borrowed and there would be a berm to cover the pipe.
The ditch option is far less expensive and is the most feasible.

At the city council meeting on June 12, 2000, the council approved a resolution to apply
for $500,000 advance encumbrance of MSA money. The said MSA loan would take
just under two years to repay using the city's $260,000 ± allowance per year of MSA
money.
The council requested the City engineer update the cost estimates for the
reconstruction of 85th Street from Nashua Avenue to Odean Avenue (approximately
4,200 LF), and from Odean Avenue to Page Avenue (approximately 3,480 LF).. The
preliminary cost estimates have been completed and are shown in Exhibit A.
Also to be considered is the rough grading of Page Avenue from 79th Street to 83rd
Street to facilitate trunk utility placement for looping purposes in new developments. We
have contacted the District State Aid office, and they stated a road could be partially
completed as long as the city makes a firm commitment in writing that the remaining
portion of the road would be completed as soon as MSA funds become available.
To actually encumber the $500,000, the City would need to order and design the
project. State Aid approval of the plans will also be required.
We have updated the MSA monies ledger depicting the city receiving the $500,000
advance encumbrance, and attached for your information as Exhibit B.
