City staff has identified that an Off -premises sign advertising your business has been erected just south of the noise wall on the east side of Trunk Highway 101. Please be advised that such signs are specifically prohibited by Section 20-37-3.B. 1 and 20-37-3.8.2 of the Zoning Ordinance. Further, the erection of this sign violates condition 6.a of the interim use permit allowing the use of the subject site: 6.a [signs] Are located only on the private property of the farm/owner operator and are no more than 100 feet from the point of sale. These plans have been submitted following review of the application at a public hearing by the Planning Commission, but prior to City Council consideration to address the comments of our office and the City Engineer as documented in the planning report dated April 26, 2000 and the engineering review dated April 26, 2000. This memorandum reviews only the alterations to the preliminary plat and related plans relative to the comments of the previous staff comments. The Planning Commission has recommended against rezoning the subject parcel from A-1 to R-4 District and subsequently took no action on the proposed plat. As the changes to the subdivision plans are not germane to the zoning issue, it is staff's opinion that the application did not need to return to the Planning Commission for further review. Attached for Reference: Exhibit A: Site Location Exhibit B: Revised Site Plan Exhibit C: Findings of Fact (revised) ANALYSIS Access. The preliminary plat will have one access to CSAH 36 until such time as the parcel to the east develops and a second access is provided via Street C. The easement that presently provides access to the WW -FP cannot be developed as a local street under 5775 VVAYZATA BOULEVARD. SUITE 555 ST. LOUIS PARK. The provision of only one access does raise concern for traffic management and traffic volumes passing the houses near the intersection. The preliminary plat does provide a three lane, divided access at CSAH 36 to ensure that access is maintained. Rights-of-way. The revised plans have a number of right-of-way changes addressing comments of City Staff as follows: • Access to the exception parcel at the southeast corner of the plat has been provided off of Street B. This access will allow for future subdivision of the exception parcel with urban lots fronting a cul-de-sac. • The previous submission proposed an eyebrow street adjacent to Lots 14-15 of Block 1. This eyebrow or bump -out has been removed. • Street G has been extended to provide access to the WWTP. A cul-de-sac needs to be provided at the terminus of Street G, subject to review and approval of the City Engineer. Lots. The preliminary plat includes 144 total lots, three more than the previous development plan. The additional lots can be accounted for by two additional lots in the northwest corner of the project on Block 8 and one additional lot in the area of Block 5. All of the proposed lots conform with the minimum standards of the R-4 District in terms of lot area and width. Further, all of the proposed lots have an adequate building envelope within applicable required setbacks. Block 8. The revised preliminary plat includes two proposed lots in the northwest comer of the project as Block 8. This block was previously shown as an outlot on the preliminary plat. Staff raised an issue with long term ownership and maintenance of this parcel and had recommended that Street I not be extended past Lot 44, Block 7 because of the topography issues in the area which require construction of a retaining wall. While the current development plan illustrates two conforming lots, the lots are of irregular shape and there is the question of access to Lot 2 Block 8. Phasing Plan. The applicant has provided a phasing plan for the build -out of the project as requested. While not binding, phasing plans can assist the City anticipate the rate of development within the community and plan necessary facilities and services. The phasing plan anticipates five stages of development with approximately 30 lots per phase. Planning Commission Recommendation. The Planning Commission held a public hearing on May 1, 2000 to consider the above referenced request. The Planning Commission voted 4-2 against rezoning the property from A-1 to R-4 District. Some of those voting against the request expressed a concern about starting a second development node away from the School area as being inconsistent with the Planning Report Addendum - Riverpointe Page 2 Comprehensive Plan's growth strategy. Those in favor of the rezoning found that the project was consistent with the Comprehensive Plan because of the location of the parcel in between existing development and the WWTP and that the applicant had addressed the concerns identified at the concept plan review. Because the rezoning request failed to pass, the Planning Commission did not make a recommendation on the preliminary plat application. CONCLUSION AND RECOMMENDATION The revised plans dated July 11, 2000 submitted by the applicant have addressed several of the technical issues identified by City staff as part of previous reviews. The City Council must still address the policy question of the rezoning application. If the City Council approves the rezoning application, our office would recommend approval of the preliminary plat subject to the conditions outlined below. The City Council has the following options for action on the applications: Decision 1 - Zoning Ordinance Amendment A. Motion to approve a Zoning Ordinance amendment to rezone the subject site from A-1 District to R-4 District based upon a finding that the request is consistent with the policies of the Comprehensive Plan (Exhibit B) and Zoning Ordinance. B. Motion to deny a Zoning Ordinance amendment to rezone the subject site from A-1 District to R-4 District based upon a finding that the request is inconsistent with the policies of the Comprehensive Plan (Exhibit B) and Zoning Ordinance. C. Motion to table the application. (Specific direction should be provided to the applicant and/or staff regarding additional information) Decision 2 - Preliminary Plat A. Motion to approve the Riverpointe Preliminary Plat subject to the following conditions: Approval of the preliminary plat does not guarantee access to sanitary sewer service. The City shall only guarantee such service to approved final plats with signed contracts or through a financial commitment for such service to assure the City of timely development. 2. The applicant provide a landscape plan for the median within Street A, subject to review and approval of City Staff. Planning Report Addendum - Riverpointe Page 3 3. A cul-de-sac is provided at the terminus of Street G. The layout and design of all rights-of-way and streets shall be subject to approval of the City Engineer, and Wright County where applicable. 4. All utility plans shall be subject to review and approval of the City Engineer. Ownership and management of water service for the preliminary plat shall be specified by the Development Contract, subject to approval of the City Attorney. 5. Satisfaction of park and trail dedication requirements shall be subject to review by the Parks and Recreation Commission and approval of the City Council. 6. All grading, drainage and erosion control issues are subject to review and approval of the City Engineer. 7. The applicant enter into a development contract with the City, post appropriate escrows andpay applicable fees, subject to reviewand approval of the City Attorney. 8. Comments of other City Staff. B. H. 101 along CSAH 36 from A-1, Agriculture Rural Service District to R-4, Residential Single Family Urban District for the purpose of developing a single family residential subdivision entitled Riverpointe. City Council Meeting Date: 24 July 2000 Findings of Fact: Based upon review of the application, the recommendation of the Planning Commission and evidence received, the City Council of the City of Otsego now makes the following findings of fact: The legal description of the property is described by attached Exhibit A. 2. The property lies within the Sanitary Sewer Service District and is guided for low density residential land use by the 1998 Comprehensive Plan Update. 3. The property is zoned A-1, Agricultural Rural Service District; The applicant is requesting that the subject site be zoned R-4, Residential Urban Single Family District which allows for single family uses as a permitted use. 4. The applicant previously submitted a concept plan for development of the subject parcel, which was approved with conditions by the City Council on October 11, 2000 by a 3-2 vote, following a 3-2 recommendation by the Planning Commission in favor of said plan. 5. The Planning Commission and City Council must take into consideration the possible effects of the rezoning with their judgement based upon (but not limited to) the criteria outlined in Section 20-3-2.F of the Zoning Ordinance: A. The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. Finding. From a policy standpoint, potential developmentofa single familyresidential project on the subject site represents initiating a second node of urban development. While the project is within the sanitary sewer service district, a prerequisite of development is that there are adequate service capabilities available to accommodate the project based upon the City's interim land use plan and growth management policies. As municipal water is not is not presently available to the subject site, access to CSAH 36 is limited and there are potential negative impacts to the City's service capabilities in terms of parks, street maintenance, police and fire EXHIBIT C-1 protection, the proposed rezoning is considered inconsistent with the policies of the Comprehensive Plan attached as Exhibit B. B. The proposed use's compatibility with present and future land uses of the area. Finding: The land uses to the west, north and east are all agricultural or open parcels. The City's WWTP , located at the northeast corner of the site, was constructed in this area because of the undeveloped character. As the Comprehensive Plan anticipated urban development of this parcel at sometime and given the low intensity use of surrounding parcels, no compatibility issues are anticipated. As for compatibility with the WWTP, an existing wetland and vegetation create some separation between the building locations and the facility to minimize impacts. C. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Finding: The preliminary plat and uses within the proposed development would be required to meet applicable performance standards of the City's development regulations. D. The proposed use's effect upon the area in which it is proposed. Finding: The proposed use represents an expansion of urban development to a second area of the City. While the subject property is within the Sanitary Sewer Service District, such a development increases pressure on surrounding parcels. To prevent unnecessary urban expansion, the City must recognize the limits of the Sanitary Sewer District and find that development of the subject parcel is consistent with the interim land use plan and growth management policies of the Comprehensie Plan to avoid negative service delivery impacts. E. The proposed use's impact upon property values of the area in which it is proposed. Finding: Although no study has been completed, the proposed use is not anticipated to negatively impact area property values. F. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Finding. CSAH 36, which will provide primary access to the development is designated as a collector street by the Comprehensive Plan and should have adequate capacity to serve the proposed development. This access will be the only access to the project until a future collector street can be constructed and additional access provided. The limitation of one access to the subdivision raises potential negative traffic management and public safety concerns. Finding: CSAR 36, which will provide primary access to the development is designated as a collector street by the Comprehensive Plan and should have adequate capacity to serve the proposed development. G. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Finding: The proposed development represents the start of a second urban development area within the City, although it is within a 1/4 mile of existing unsewered suburban neighborhoods. Initiating development of a second urban growth area increases the need for service delivery to the area including park facilities, street maintenance, fire and police service in a manner less efficient than the concentrated development surrounding the school area. The use may not negatively impact the City provided that these impacts are acknowledged, facilities and services are adequately planned and resources are allocated. 6. The planning report dated April 26, 2000 and addendum report dated 18 July 2000 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. 7. The engineering review dated April 26, 2000 prepared by the City Engineer, Hakanson Anderson Associates, Inc., is incorporated herein. 8. The Otsego Planning Commission conducted a public hearing at their regular meeting on May 1, 2000 to consider the application, preceded by published and mailed notice. Upon review of the application and evidence received, the Otsego Planning Commission closed the public hearing and recommended by a 4-2 vote that the City Council deny the zoning amendment based on the aforementioned findings. Decision: Based on the foregoing information and applicable ordinances, the requested Zoning Map amendment is hereby approved based on the most current plan and information received to date. The Planning Commission and City Council must take into consideration the possible effects of the rezoning with their judgement based upon (but not limited to) the criteria outlined in Section 20-3-2.F of the Zoning Ordinance: A. The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. Finding: The Comprehensive Plan calls for low density urban residential use of the subject property. The proposed development has an overall density of 1.90 units/per acre consistent with the Comprehensive Plan. Decision: Based on the foregoing information and applicable ordinances, the requested Riverpointe Preliminary Plat is hereby approved based on the most current plan and information received to date, subject to the following conditions: EXHIBIT C-3 The proposed development of this project has been reviewed for consistency with the criteria for rezoning property to allow a higher, more intense use. The findings of a 3-2 majority of the City Council was that the project was consistent with these provisions provided that 1) an adequate water service was provided, 2) adequate storm water facilities are provided, 3) future park facilities are planned for, 4) Adequate access is provided via CSAH 36 and 5) the design and layout of the subdivision does not impair development of surrounding parcels. As addressed in the staff reports, the applicant has provided additional information that adequately addresses these issues. B. The proposed use's compatibility with present and future land uses of the area. Finding: The land uses to the west, north and east are all agricultural or open parcels. The City's WWTP , located at the northeast corner of the site, was constructed in this area because of the undeveloped character. As the Comprehensive Plan anticipated urban development of this parcel at sometime and given the low intensity use of surrounding parcels, no compatibility issues are anticipated. As for compatibility with the WWTP, an existing wetland and vegetation create some separation between the building locations and the facility to minimize impacts. C. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Finding: The preliminary plat and uses within the proposed development will be required to meet applicable performance standards of the City's development regulations. D. The proposed use's effect upon the area in which it is proposed. Finding: The proposed use represents an expansion of urban development to a second area of the City. While the subject property was within the Sanitary Sewer Service District, such a development increases pressure on surrounding parcels. To prevent unnecessary urban expansion, the City must recognize the limits of the Sanitary Sewer District and find that development of the subject parcel is consistent with the interim land use plan and growth management policies to avoid negative service delivery impacts. E. The proposed use's impact upon property values of the area in which it is proposed. Finding: Although no study has been completed, the proposed use is not anticipated to negatively impact area property values. F. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. G. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Finding: The proposed development represents the start of a second urban development area within the City, although it is within a 9/4 mile of existing unsewered suburban neighborhoods. Initiating development of a second urban growth area increases the need for service delivery to the area including park facilities, street maintenance, fire and police service in a manner less efficient than the concentrated development surrounding the school area. The use may negatively impact the City if these impacts are not acknowledged, facilities and services are adequately planned and resources are allocated. 6. The planning report dated April 26, 2000 and addendum report prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. 7. Elk River, MN 55330 Re: Otsego — WH LINK, LLC and Right -of -Way Management Dear Council Members: I am writing with regard to the above -referenced matter. As you know WH LINK is requested a permit to install telecommunications equipment in the public right-of-way. By letter dated June 26, 2000, the attorney for WH LINK correctly points out that the City cannot require a right-of-way franchise fee or otherwise charge a telecommunications user for use of the right-of-way. However, the City may require a telecommunications to obtain appropriate permits and to pay right-of-way management and degradation costs. The permit and other requirements are set forth in the City's right-of-way ordinance. The following is a brief outline of the major requirements of the City's right-of-way ordinance: 1. Registration WH LINK must register with the City before it may install any telecommunications equipment in the public right-of-way. Registration requires the right-of-way user to submit certain information to the City. The information to be provided includes, among other things, certain applicant identifying. information and insurance information. The specific requirements are contained in section 1.06 of the City's ordinance. 2. Permit Requirement In addition to registering, a right-of-way user must obtain either an `Excavation' or `Obstruction' permit before any telecommunications equipment is installed in the right- of-way. In this case an excavation permit is required. Again certain information must be submitted, including showing the location of the proposed project, extent of excavation, etc. 3. Right -of -Way Restoration After completion of the project, WH LINK bears the burden of restoring the right-of-way to its original condition. This is accomplished in one of two ways. First, the City may perform the restoration and bill WH LINK for the actual cost of restoration. Second, the City may require WH LINK to perform the restoration itself and at its expense. If WH LINK performs the restoration, then it will be required to post security to ensure performance. 4. Payment of Certain Costs by Applicant The applicant may be required to pay both "Management Costs" and "Degradation Costs". Management costs generally include the cost of processing an application, as well as administering the City's ordinance. Such costs may include engineering and legal fees. For example, the cost of inspecting a project would be included in management costs. Degradation costs means the loss on useful life of the right-of-way caused by the excavation. 5. Additional Information and Duty to Update. Right-of-way users, in addition to registration and permit information, are required to submit detailed "mapping data" showing the location of their facilities, as well as future project information. The future project information is designed to allow the City, to the extent feasible, to coordinate different projects so that less excavations are required. Right-of-way users are also under a continuing obligation to update information submitted to the City. At this point WH LINK should register with the City and make an application for an excavation permit. A more detailed list of required information will have to be provided to the applicant. Also, the City should enter a "Memorandum of Understanding and Fee Agreement" with applicants for right-of-way permits. This agreement should set forth the fees that the must be paid, address right-of-way restoration issues, degradation costs, security requirements, etc. I hope this information has been useful. Time to start the process of establishing a budget for 2001. I would recommend that the first budget workshop be set up for Monday, August 7, 2000 at 6:00 p.m. That would allow two hours for discussion before the start of the Planning Commission meeting. I have spoken to Gary Groen and he will be at the meeting if the time works out for Council. We will have a preliminary 2000 budget to Council at least several days before the workshop. I will be gone on vacation from Thursday, July 27 through Monday, August 7 and so will not be able to attend any workshop on August 7.
