6.1. This item came before the Otsego Planning Commission on January 18, 2000
and approval was recommended by the P.C. with the Engineers OK before
it is sent to Council for final approval. (Both Dan Licht and Larry hoshak
will be present to explain and answer questions.)
6.2. This item came before the Planning Commission for Hearing on February 22,
2000. The Hearing was closed on this date and it was continued to the March 6,
2000 P.C. for futher discussion and decision/recommendation to Council. The
Planning Commission Recommended Approval to the Council(Attached is a
Memorandum from Dan Licht of explanation dated March 7, 2000. Dan will be
present at the Council Meeting for review and questions on this issue.)

recommended to the Council unanimously that it be denied.(See attached demo

The Planning Commission during their meetings on February 22, 2000 and March 6,
2000 considered the above referenced application as part of a public hearing. The
Planning Commission received a detailed presentation from the applicant as part of the
first meeting. Public comments were also received on February 22, 2000 as stated in
the Planning Commission minutes.
The application was tabled from the February 22, 2000 meeting to the meeting on
March 6, 2000 to allow staff to present options for amending the Comprehensive Plan.
The intent of the Planning Commission was to provide flexibility to allow this project at
the density proposed while maintaining a specific density limit that was low enough to
discourage any development beyond what is intended by the Comprehensive Plan and
Zoning Ordinance. Based upon the options outlined in our office's memorandum from
February 24, 2000, the Planning Commission voted 7-0 to recommend that the City
Council approve option B. This option would remove the specific density cap from the
Comprehensive Plan, while maintaining the current 10 per 40 limit within the Zoning
Ordinance. This method allows flexibility to accommodate density increases for
projects such as Mississippi Pines through a PUD -CUP.
Following the action on the Comprehensive Plan and Zoning Ordinance text
amendment, the Planning Commission voted 7-0 to recommend that the property be
rezoned from A-1 to R -C District. Regarding the PUD -CUP and preliminary plat
applications, the Planning Commission discussed requiring that Lots 1-7 be relocated
to the area currently designated as Outlot G, if the City does not accept that parcel as a
public park. This change would respond to concerns of Mr. Doug Lindenfelser, who
owns the property to the southwest of the subject site and was concerned about the
impact of the proposed lots adjacent to his property. After discussing the issue and

noting that the applicant opposed the modification, the Planning Commission did not
include that condition as part of its motion. The motion to recommend approval the
PUD -CUP and preliminary plat was approved by a 6-1 vote. The final motion to
consider vacation of a portion of Jambor Avenue was also recommended for approval
by a vote of 7-0.
In consideration of the Planning Commission's recommendations and comments of the
City Attorney, we have prepared the appropriate resolutions, ordinances and findings
for approval of the application. For reference, approval of the applications may follow
the format outlined below.
1. Motion to approve amendments to the Comprehensive Plan and Zoning
Ordinance Section 20-77-6 as outlined by Option B of the City Planner's
memorandum dated 24 February 2000 based upon consistency with the
following policies:
The use of concentrated and cluster development concepts shall
be encouraged where protection of natural features is important to
the community and vital to development desirability.
Design and planning innovations in housing units and land
development shall be encouraged.
Innovation in subdivision design and housing development through
the use of devices such as cluster unit development concept shall
be encouraged.
2. Motion to approve an Ordinance amendment rezoning the subject site from A-1
District to R -C District based upon a finding that such amendment is consistent
with the Comprehensive Plan.
3. Motion to approve a PUD -CUP to allow cluster development within the Wild and
Scenic Overlay District and design flexibility and the Preliminary Plat of
Mississippi Pines, subject to the following conditions:
A. The applicant undertake, complete and provide proof of final court order
quieting title to property and curing defects in description. The final legal
description shall substantially conform with prior representations of the
property to be platted and the actual parcel is consistent with all
applicable performance standards, subject to review and approval of City
Staff.

B. All streets and street names shall be subject to review and approval of the
City Engineer and the access to CSAH 39 shall be subject to review and
approval of the City Engineer and Wright County.
C. The preliminary plat is revised to provide Lot 72 access to the internal
street.
D. The planned uses for the open space outlots is specified for recording
deed restrictions on the titles.
E. The preliminary plat is revised to locate Lot 62 so that it abuts Lot 61 and
the common side lot line of Lots 40 and 50 intersects the right angle of the
at the rear of the lots.
F. Front yard setback requirements for Lots 7, 17, 19, 28 and 73 shall be
measured from the nearest point from the public right-of-way that the lot
width measures 100 feet.
G. The preliminary plat is revised to illustrate all required setbacks.
H. a. The applicant dedicated Outlot G in satisfaction of park land
dedication requirements; or,
b. The applicant pay $1,075 per residential lot in lieu of land to satisfy
of park land dedication requirements.
I. The applicant provide an inventory of trees 4 -inches in diameter or larger
for all residential lots within the WS District. Individual homebuilders
and/or buyers will be required to submit a tree preservation plan in
accordance with Section 21-7-22 of the Subdivision Ordinance prior to
any grading or issuance of a building permit of individual lots.
J. The applicant provide detailed landscape plans for the CSAH 39
intersection and cul-de-sac islands, and tree preservation plans for
construction of the street through the existing vegetation stand.
K. The homeowners association documents shall provide for a program for
inspection and maintenance of individual septic systems, subject to
review and approval of City Staff.
L. All grading, easement and utility issues shall be subject to review and
approval of the City Engineer.

M. The applicant enter into a development agreement with the City, subject
to review and approval of the City Attorney,
N. Comments of the DNR or other City Staff.
4. Motion to vacate approximately 365 feet of Jambor Avenue based upon a
finding that the right -or -way easement no longer serves a public purpose.

A RESOLUTION AMENDING THE COMPREHENSIVE PLAN AS IT PERTAINS TO THE
DEVELOPMENT DENSITY ALLOWED WITHIN THE AREA DEFINED AS THE RURAL
RESIDENTIAL PRESERVE.
WHEREAS, the Comprehensive Plan describes the maximum development density
within the area defined as the Rural Residential Preserve as four (4) units per forty (40)
acres with additional density of up to ten (10) units per forty (40) acres allowed through
cluster development techniques; and,
WHEREAS, the City has received a request from AEJ Companies, Inc. for approval
of a preliminary plat with a density of twelve (12) units per (40) acres; and
WHEREAS, the developer has requested a Comprehensive Plan amendment to
allow for the proposed density of twelve (12) units per forty (40) acre in the Rural
Residential Preserve; and,
WHEREAS, the necessary text and map changes to accomplish the developer's
request are illustrated by Exhibit A; and,
WHEREAS, the Otsego Planning Commission conducted a public hearing, at their
regular meeting on 22 February 2000, to consider the request, preceded by published and
mailed notice; and,
WHEREAS, the Otsego Planning Commission tabled the application until their
meeting on 6 March 2000 to allow staff to outline alternatives for amending the
Comprehensive Plan; and;
WHEREAS, the Otsego Planning Commission Upon review of the application and
evidence received closed the public hearing and recommended by a 7-0 vote that the City
Council approve the amendment of the Comprehensive Plan outlined as Exhibit A, based
upon a finding that the amendment is consistent with the following policies:
> Design and planning innovations in housing units and land development shall be
encouraged.
Innovation in subdivision design and housing development through the use of
devices such as cluster unit development concept shall be encouraged.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OTSEGO THAT; the request to amend the 1998 Comprehensive Plan Update, as
illustrated on Exhibit A, is hereby APPROVED.

2. Rural Residential Preserve. The rural residential preserve
overlays that area of the community where a long term rural
character is to be maintained via the imposition of 'lour per forty"
residential densities. This designation is intended to be applied to
areas of the City where large scale, long term agricultural activities
are not to be encouraged due to innate amenities (i.e., river views,
forested areas, etc.). A maximum density of le units pei 4e acies
may be allowed thiough development concepts that piotect a
specif med portion of a p, oject area as permanent open space.
The City Council may approve increases in density as an incentive
to encourage developments in this area to be Manned in
accordance with the principals of open space preservation and
clustering. It must be emphasized that any density allowed above
four units per 40 acres should be considered a bonus and will
determined at the discretion of the City Council in consideration of
a proposed development's consistency with the City's goals for this
unique area of the community.

To encourage the clustering of residential units, it is suggested that
density incentives be provided. In this regard, it is recommended
that a base density allowance of four per forty acres be established
in the district. Via clustering, howevei, densities of up to 1
dwelling units per 4e acres of !an I is -t- L - a"owed. The allowance
of additional density above four units per 40 acres will be at the
discretion of the City Council based upon their iudgement of a
project's consistency with the City's open space preservation and
cluster development obiectives. Actual implementation of this
concept would require a Zoning Ordinance amendment which
would establish various performance standards for clustering
developments, most likely through a rural cluster zoning district. In
developing a rural cluster zoning district, assurance should be
made that proposed standards are consistent with all applicable
wild and scenic requirements.

THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. Section 20-77-6 of the Otsego Zoning Ordinance (R -C District - Density)
is hereby amended to read as follows:

Plan and Section 20-77-1.
A. All development within the R -C District shall be subject to planning for
cluster development as defined in Section 2 of this Chapter and
regulated by this section.
B. The subdivision is processed according to the City's Subdivision
Ordinance.
Section 2. This Ordinance shall be in full force and effect upon its passage and
publication.

Mississippi Pines preliminary plat, based upon the principals of open space cluster development.

Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
The legal description of the property is described by Exhibit A.
2. The property lies within the Rural Residential Preserve Area and is guided for rural land
use by the 1998 Comprehensive Plan Update.
3. The property is zoned A-1, District; Residential development based upon the principals of
rural cluster development requires consideration of an amendment to designate the
property as being within the R -C District.
4. The Planning Commission and City Council must take into consideration the possible
effects of the amendment (map) with their judgement based upon (but not limited to) the
criteria outlined in Section 20-3-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The subject property is within an area of the City specifically identified for
residential development that preserves open space and protects woods, wetlands,
shoreland and other natural features through utilization of a cluster development
concept. The open spaces proposed to be protected as private common open
space include the shoreline of the Mississippi River, large fields and existing
vegetation stands. A large 30 acre parcel has also been proposed for a public park.
The purpose of the R -C District is not only to preserve these type of natural areas,
but to integrate them in a cohesive pattern with residential neighborhoods. The
preservation of this open space is generally consistent with the purpose of the R -C
District and the following policies from the Comprehensive Plan Update:

C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: The development proposal is subject to City and DNR review for
consistency with applicable performance requirements.
D. The proposed use's effect upon the area in which it is proposed.
Finding: The proposed subdivision is anticipated to have a positive impact by
preserving the rural character of this area of the City through limited residential
development and preservation of open space, including important natural elements
such as the Mississippi River shoreline.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: The proposed use will not generate additional traffic beyond the capabilities
of the streets serving the property.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.

Finding: The proposed use is not anticipated to have a negative impact to the City's
service capacity.
5. The planning report dated 16 February 2000 and memorandum date 24 February 2000
prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated
herein.
6. The Otsego Planning Commission conducted a public hearing at their regular meeting on
22 February 2000 to consider the application, preceded by published and mailed notice.
Action regarding the application was tabled until the Planning Commission's regular
meeting on 6 March 2000 to allow additional information to be provided. Upon review of
the application and evidence received, the Otsego Planning Commission closed the public
hearing and recommended by a 7-0 vote that the City Council approve the Zoning Map
amendment based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested Zoning
Map amendment is hereby approved based on the most current plan and information received to
date.

THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. The official Zoning Map of the Otsego Zoning Ordinance is hereby
amended to change the zoning classification of the property legally described on attached
Exhibit A (the "property").
Section 2. The property is hereby rezoned from an A-1 District designation to a
R -C District designation.
Section 3. The Zoning Administrator is hereby directed to make appropriate
changes to the official Zoning Map of the City of Otsego to reflect the change in zoning

Request: Application for a 73 lot single family residential preliminary plat entitled "Mississippi
Pines" based upon the principals of rural cluster open space development, which requires
consideration of a PUD -CUP for design flexibility concerning density, cluster development within
the Wild and Scenic Overlay District, lot design and open space outlot uses.
City Council Meeting Date: 13 March 2000
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
1. The legal description of the property is described by Exhibit A.
2. The property lies within the Rural Residential Preserve Area and is guided for rural land
use by the 1998 Comprehensive Plan Update.
3. The property is zoned R -C, District; Single Family uses based upon the principals cluster
development are a permitted use in this District.
4. The proposed preliminary plat requires consideration of a PUD -CUP to allow the following:

7. The Otsego Planning Commission conducted a public hearing at their regular meeting on
22 February 2000 to consider the application, preceded by published and mailed notice.
Action regarding the application was tabled until the Planning Commission's regular
meeting on 6 March 2000 to allow additional information to be provided. Upon review of
the application and evidence received, the Otsego Planning Commission closed the public
hearing and recommended by a 6-1 vote that the City Council approve the PUD -CUP and
preliminary plat application based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested PUD -
CUP for cluster development within the WS District and design flexibility and Mississippi Pines
Preliminary Plat is hereby approved based on the most current plan and information received to
date, subject to the following conditions:
1. The applicant undertake, complete and provide proof of final court order quieting title to
property and curing defects in description. The final legal description shall substantially
conform with prior representations of the property to be platted and the actual parcel is
consistent with all applicable performance standards, subject to review and approval of City
Staff.
2. All streets and street names shall be subject to review and approval of the City Engineer
and the access to CSAH 39 shall be subject to review and approval of the City Engineer

The Planning Commission held a public hearing at their meeting on March 7, 2000
regarding the above referenced application. The pubic hearing was closed after no
comments were received. In reviewing the application, Planning Commission
acknowledged the long term plans of the applicant for development of the subject
property with high performance standard industrial uses. The Planning Commission
was concerned, however, that the lack of a development plan for the subject parcel and
a use that would meet the performance standards of the B -W District could result in
compatibility issues if the site is ultimately not improved due to unforseen
circumstances. The Planning Commission also discussed alternatives for deferring the
required improvements, but decided that such arrangements are problematic to
enforce. Based upon these factors, the Planning Commission voted 6-1 to recommend
denial of the requested rezoning and subsequently voted to deny the proposed site
plan 6-1.
A related issue that was discussed was the appropriate action for the Planning
Commission to take. Generally, rezoning applications are considered legislative
actions that the Courts will allow cities greater discretion in approving or denying,
whereas applications such as site plan review are more judicial and subject to
overturning by the Courts. As such, the 1998 Comprehensive Plan Update includes
specific language that states that the land use plan is the anticipated ultimate land use
for the planning period. In the interim period, land is to be maintained in A-1 District
Zoning until the property owner or developer can demonstrate that it is eligible to be
rezoned. The criteria for determining if a parcel is eligible to be rezoned to allow a
more intensive land use is outlined in the Comprehensive Plan. Because the Planning
Commission was not inclined to approve the proposed site plan becuase of the
performance standard issues, the appropriate action is to recommend denial of the
rezoning application until a suitable development plan is produced.

In explaining this approach to the Planning Commission, staff used the Otsego
Industrial Park as an example of how the City should approach a rezoning request.
The development of the Otsego Industrial Park involved applications for rezoning,
preliminary plat and site plan review to accommodate a truck terminal use, as well as
several other planned industrial lots. The concurrent application for rezoning and
preliminary plat approval provided the City with the necessary information to
comprehensively evaluate issues such as site grading, storm water drainage, building
suitability, septic system locations, well locations, and access in addition to specific site
and building plan review. With this present application, the City lacks this level of
detailed information pertaining to the long term development of the site, in addition to
the issues with the proposed substandard use of the site. As such, the appropriate
action is to not rezone the property until a suitable development plan is submitted.
A findings of fact consistent with the Planning Commission recommendation has been
prepared and is attached for review at the March 13, 2000 City Council meeting. We
have also prepared an alternative findings for approval of the application, should that
be the direction the City Council chooses to pursue.

Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
The legal description of the property is described on Exhibit A.
2. The property lies within the Sanitary Sewer Service District and is guided for industrial land
use by the 1998 Comprehensive Plan Update.
3. The property is zoned A-1, District; Consideration of a Zoning Ordinance amendment (map)
to designate the Site as being within the B -W District is necessary to allow for the proposed
use of the site as a contractor officelwarehouse.
4. The Planning Commission and City Council must take into consideration the possible
effects of the amendment with their judgement based upon (but not limited to) the criteria
outlined in Section 20-3-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The subject site is within the Sanitary Sewer Service District designated by
the Comprehensive Plan and is guided for industrial development. The
Comprehensive Plan anticipates that this area is to develop with industrial uses that
take advantage of the visibility and accessability of the area. These industrial uses
are to be developed with high performance standards and connect to municipal
sanitary sewer and water service.
As the applicant's proposal does not include bringing the site up to conformance with
the performance standards for industrial uses or connecting to the sanitary sewer
and water systems, the requested amendment may be inconsistent with the
Comprehensive Plan. The Planning Commission and City Council must consider the
following policies discourage rezoning the parcel at this time:
Discourage
Standards governing industrial development shall be established and
enforced. (Policy Plan, p. 51)
Industrial development which maximizes the return on City investments in
public facilities and services shall be promoted. (Policy Plan, p. 51)
Existing industrial development shall be encouraged to hook up to municipal
sanitary sewer and water service when available. (Policy Plan, p. 51)
B. The proposed use's compatibility with present and future land uses of the area.
Finding. It may be suggested that the conversion of the existing site from residential
to industrial use would eliminate potential compatibility problems as other properties
in the area develop with planned industrial uses. Conversely, allowing utilization of
the existing site may ultimately be an impediment to the City's long term goals for the
area by removing incentive for redevelopment that would result in higher valued
construction and connection to the sanitary sewer and water system. Allowing the
industrial use of a substandard site may prove to be uncharacteristic and
incompatible with the City's planned industrial uses over time.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: As outlined in the paragraphs that follow, the proposed use of the subject
site does not satisfy performance standards for development within the B -W District.
The level to which this project meets the required performance standards is even
less than those projects approved in the "special" Industrial District. Any approval
of the requested rezoning should be conditioned upon all applicable performance
standards being satisfied.
D. The proposed use's effect upon the area in which it is proposed.
Finding: Approval of a zoning amendment to accommodate a reuse of the site in a
manner that does not meet the required performance standards and does not
connect to sanitary sewer and water service at such a highly visible location may
establish undesired precedencies for the area including, similar reuse of other
properties or make it more difficult to require adherence to existing performance
standards for new or redeveloped sites.
The applicant has indicated that the substandard conditions would exist no longer
than five years. The primary concern of the City should be that there is no
guarantee the site will be redeveloped and/or brought into conformance with
applicable standards. The City has in the past allowed deferments of performance
standards with property owners along the T.H. 101 corridor based upon the
construction of T.H. 101 and planned extension of sanitary sewer and water

services. The expectation was that the sites were to be improved to meet the Zoning
Ordinance requirements at such time as these projects were complete. Such
deferments are outside of the Zoning Ordinance and have proven problematic to
enforce. Where these past deferments were based upon the T.H. 101 and sewer
projects, no such justification exists today.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values. The City would receive additional
property tax revenue based upon a change from residential to industrial tax ratios.
However, because the proposed use of the site does not include required
improvements for industrial uses, the substandard site would not be expected to
have the value of an industrial development that conformed to these standards.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: The subject site has direct access to CSAH 42 which is designated as a
minor arterial by the Comprehensive Plan. The capacity of this road should be
sufficient to accommodate the conversion from residential to industrial use.
However, the access location is offset with the CSAR 42 and 85"' Street intersection.
The City Engineer and Wright County Highway Department should review the
location of the present access and its design for potential conflicts with the CSAH
42185th Street intersection.
The Comprehensive Plan calls for eliminating direct access to CSAH 42. To this
end, it is anticipated that 85"' Street will be extended east of CSAH 42 to connect to
a future north -south frontage road through the planned commercial/industrial area,
which would provide local access. Eighty-fifth Street would extended along the north
property line of the subject site and would provide an opportunity to divide the parcel
into two or three sites, allowing full development potential.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Finding: The proposed use is not anticipated to have a negative impact to the City's
service capacity. However, because connection to the sanitary sewer and water
system is not proposed, the re -use of the site does not support the financing of these
systems as anticipated by the Comprehensive Plan. The change to a more intensive
use of the site does provide an opportunity to require connection to municipal utilities.

Associated Consultants, Inc., is incorporated herein.

criteria outlined in Section 20-4-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The following policies may be cited in support the applicant's request:
• The character of individual neighborhoods shall be reinforced, maintained and
upgraded. (Policy Plan, pg. 40)
B. The proposed use's compatibility with present and future land uses of the area.
Finding. The area is developed with low density single family residential uses, which
are planned to continue by the Comprehensive Plan. As such, the proposed use will
be compatible with present and future land uses.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: As noted above, the subject site and relocated structure conform with all
applicable performance standards.
D. The proposed use's effect upon the area in which it is proposed.
Finding: The relocated dwelling and single family use of the property will not have
a negative impact to the area.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: The relocated structure will not generate traffic beyond the capabilities of
streets serving the subject property.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Finding: The proposed use is not anticipated to have a negative impact to the City's
service capacity.
6. The planning report dated 24 February 2000 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.
7. The Otsego Planning Commission conducted a public hearing at their regular meeting on
6 March 2000 to consider the application, preceded by published and mailed notice. Upon
review of the application and evidence received, the Otsego Planning Commission closed
the public hearing and recommended by a 7-0 vote that the City Council approve the
conditional use permit based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested
conditional use permit is hereby approved based on the most current plan and information
received to date, subject to the following conditions:
1. A building permit is applied for and approved by the Building Official prior to relocation of
the structure.
2. The relocated structure shall be ready for occupancy within six (6) months from the date
of location on site, subject to approval of the Building Official.

3. The applicant submit a certificate of survey identifying the building, septic system and well
locations.
4. The design of an on-site septic system and well are subject to review and approval of the
Building Official.
5. A security as required by Section 20-19-3 of the Zoning Ordinance as determined by the
Building Official is posted.

Item 7.2 . Groundwater Monitoring Well Results
The City has monitored the water quality of three groundwater wells
placed in the northeast area of the city approximately once a year. Recent
results taken by Minnesota Valley Testing Service are attached.
Indications are that the groundwater still does not show parameters that
exceed limits of pollution indicators, except that the chlorides are high in
the well at the Otsego County Park. This indicates that septic
tank/drainfields in the area are influencing the level at that well.
These results are from only three wells located randomly in the northeast
of the City. Find attached for your information a letter from Ron Wagner
on the subject.

The approval for this change included cost to provide an alternative method of erection and structure redesign of the water tank and
tower to accommodate the new site. The method of erection in the original bid was to weld the shells of the tank and tower on the
ground surface and then lift the large sections; stem, lower bowl and under bowl into place with a stand-by crane. The Change Order #1
allowed the method of erection to change by using a central gantry crane and weld each shell in place on the tank and tower. The
additional cost of resign and erection was $7,730.

Enclosed are the results of the testing monitor wells performed on the three (3)
groundwater monitoring wells in Otsego. The results indicate that the groundwater near
all three wells meets potable water standards set by both the United States
Environmental Protection Agency (US EPA) and the Minnesota Department of Health
(MDH).

The parameters above are used as indicators when looking for pollutants in
groundwater due to failure of septic drainfield systems.
The results indicate a failing result in the nitrate and nitrite. Maximum allowable is 0.2
mg/I and in the well in Otsego County Park well the level was 0.98 mg/L. Nitrate can
come from overfertilization in agricultural regions. Health hazards from ingesting nitrate
and nitrites in water is primarily to infants 0-3 months. Nitrates interfere with the infant's
ability to transfer oxygen in the blood. Infants in homes using well water should be
given bottled water for this reason. Adults have no problem with much higher doses of
nitrate and nitrite intake.
I have compiled all of the previous data on to charts with a trend line. This can be
updated yearly and should be useful to quickly see if there are any trends we should be
aware of. Trend lines show that the groundwater quality appears to be decreasing, but
still is within safe drinking water standards.

1) Temporary culvert under entrance to site needs to be shown.
A permit from Wright County Highway will be required for this access. The city
will require a copy of the permit or like confirmation that the County has acted on
this entrance.
2) Temporary topsoil storage areas are not shown. Is there a reason for not
showing them?
3) The final perimeter slopes show the grade at 1 1/z:1, which is extremely steep.
The concern is safety and our ordinance requires 5:1 maximum. Please justify
the slope grades shown with safety issues in mind.
4) A written Right of Entry is required for City officers and agents.
5) Comment letters appear to be available to the extent necessary. An NPDES
permit is required if the exposed area is over 5 acres. City must see evidence of
this permit.
6) It is assumed that the gate is lockable and will be locked when operations are
completed each day.
RECOMMENDATION:
We find the application has sufficiently addressed our comments in Review #1 except
for the items stated above. A letter responding to the above comments must be
presented to the City before the mining operation can begin.
The letter of credits for the first phase is based on the site restoration should the
applicant fail to complete the restoration of the site. The amount is calculated below:
Area 1
Restoration 9.75 acres x $3,000/acre $29,250
Erosion and Sediment Control 9.75 acres x $200 11950
Total Letter of Credit for Area 1 (Phase 1) $31,200
When Area 1 is completed and restored, the letter of credit will be adjusted to the Area
2 restoration and Erosion and Sediment Control. This will happen is each of the
phases.
The applicant must pay the City $0.05/CY, removed from the site. The amount will be
due in January 2001 and in each succeeding January until the operation is complete.
The Ordinance 94-4 shall apply to the entire mining operation except as modified or
varied herein.
We recommend to the City Council on 3/13/2000, approval of the Mining Permit #7 to
applicant AJE Companies and owner North Pine Aggregate.

AJE Companies is proposing an alternative mining and restoration plan that would leave
the NortherN Natural Gas line in its present location on the subject property. John Jackels
said that they have had difficulty in dealing with Northern Natural Gas documenting the
approvals necessary to relocate the existing pipeline that bisects the property. This issue
has caused them to reexamine their proposed excavation and reclamation of the site.
The applicant has prepared a revised mining plan and concept for how this alternative
could ultimately be developed. This mining and restoration plan proposes to leave the gas
line at its present location and excavate the site on either side, leaving a berm across the
center of the parcel. The restoration concept plan anticipates a smaller medium-high
density development on the northwest side of the gas line and a parcel that could be
potentially subdivided with lots fronting the planned frontage road to the east with
residential or potentially commercial uses.
If the uses on the southeast portion of the property were residential, there would be
concern that the units would be segregated from other neighborhoods. If commercial land
use were ultimately proposed, it needs to be noted that there is little market support in this
area presently and that the Comprehensive Plan guides commercial uses in the area to
be lower intensity neighborhood oriented uses. However, commercial uses on the west
side of the frontage road would be desirable from a marketing standpoint to serve home
bound traffic to neighborhoods anticipated to develop southwest of CSAH 37 and T. H. 101.
The berm itself may provide trail opportunities while serving as a buffer between the
frontage road uses and residential uses to the west. In general, the revised concept plan
would address many of the concerns we noted regarding the first concept plan that was
submitted.

In terms of processing, it is our opinion that the application may proceed to the City
Council at such time as any outstanding engineering issues have been addressed. A
second review and hearing before the Planning Commission should not be necessary
because the parameters of the mining use have not been increased and any changes that
have been made, including the alternative restoration plan, are in response to the City
Engineer's comments. Further, the concept plan is required mostly to demonstrate that
the property can be developed following restoration and does not convey any land use
approval that would be required to develop the property. However, the City Council does
have the option to send the application back to the Planning Commission for further
comment.

Our Head Start center, located in the old Otsego city hall building, is due to be relicensed soon by the MN
Department of Human Services, licensing division. The licensor will be looking at the classroom and
building to make sure that everything is safe and in good repair. Any walls, floors, fixtures, etc. that are
worn or broken may be cited by the licensor as a violation, and if there are many violations or even one
serious violation, our center could be forced to close.
The teaching staff at the center, in preparation for this licensing visit, have gone through the building and
noted items that may be of concern. These items are as follows:
