08-22-00 SCCCITY OF OTSEGO WRIGHT COUNTY, MINNESOTA CITY COUNCIL SPECIAL MEETING FOR 88TH STREET IMPROVEMENT HEARING FOR SANITARY SEWER, WATER, STORM SEWER AND STREET IMPROVEMENTS TUESDAY, AUGUST 22, 2000, 5 PM 1. Mayor Fournier will call meeting to order, Mayor Fournier called the meeting to order at 5:02 PM. Rol Call. Mayor Larry Fournier; Councilmembers: Virginia Wendel, Vern Heidner, Suzanne Ackerman, Richard Nichols. Mike Robertson, City Administrator; Elaine Beatty, City Clerk/Zoning Administrator; Judy Hudson, Deputy Clerk; Larry Koshak, City Engineer, Ron Wagner, Assistant City Engineer; Andrew MacArthur, City Attorney. 2. Explanation of Hearing Process by Andrew MacArthur. City Attorney. Mr. MacArthur explained the City received a petition for the public improvements of sanitary sewer, water, storm sewer and street improvements and explained the procedure and process for the Hearing as required by State Statute. The City Council will make a decision if they want to proceed with the project from the input received at this hearing. 3. City Engineer Larry Koshak will review the 12rQpocalc for the project - Larry Koshak explained the purpose of the Feasibility Report, which is to determine if the project is feasible and if there is a benefit to the area. Mr. Koshak said the project was feasible. Mr. Koshak also went over the existing conditions, Municipal State Aid Consideration and the proposed improvements. Ron Wagner went over the four construction options for the public improvements as described in the attached Feasibility Report dated July 2000. Mr. Wagner also reviewed the Assessment Schedule as outlined in Exhibit 8. CM Heidner noted these numbers in Exhibit 8 do not include the WAC and SAC hookup fees or water usage fees. 4. Hearing op .nevi to the Public for Comments Mayor Fournier opened the Hearing for public comment at 5:24 PM. Wally Kluse, representing Mary Dare, asked for a copy of the assessment schedule and the Feasibility Report, and asked if the petition was made available to Ms. Dare. Larry Koshak stated the petition was initiated by Christ Lutheran Church and the Bank of Elk River. The law states as long as 35% of the property owners sign the petition, the City Council can order the Feasibility Study. Pastor Greg Pagh, Christ Lutheran Church. Pastor Pagh stated they are required to hookup to water and sewer because they are expanding their facilities and currently are using holding tanks. He said that without studying the report he would prefer Option 3 at this time. Any Council discussion Mayor Fournier opened the Public Hearing up for Council discussion at 5:36 PM. CM Wendel asked about future use of this area, and flood plain, which Larry Koshak described the floodplain and Mike Robertson noted the area was guided commercial by the City's Comp Plan. The Council discussed the assessment schedule numbers and the ditch options. Mayor Fournier opened the Public Hearing back up for public comment at 6:15 PM. Pastor Pagh discussed the ditching with staff. He supports Option 3 with shifting the storm sewer from Option 4 to Option 3. Wally Kluse would like to review the Feasibility Report before making any more comments. 6. Close Hearine. Mayor Fournier closed the Public Hearing at 6:31 PM Mike Robertson stated to the Council they can make a decision now or place it on the August 28, 2000 City Council Agenda. CM Heidner stated the Church is currently using a holding tank so a decision should not be delayed very long. Mayor Fournier suggested placing this on the next City Council Agenda giving Wally Muse time to review and give his feedback. Mike Robertson said he has talked to the Bank of Elk River and they support the project. CM Heidner motioned to direct the City Engineer to start the preliminary topography immediately at the City's expense if the project doesn't go through. Seconded by CM Nichols. All in favor.
