BACKGROUND:
A. See a copy of the attached Resolution No. 2000-15. This an Addendum to the
original resolution passed on August 14, 2000 Council Meeting. Only one other election
judge is being added.
B. Approve Resolution No. 2000-17 Setting Truth -In -Taxation Hearing Dates for the
2001 Tax Levy. Resolution is attached. There are a limited number of dates available to us
so we picked a date and alternate date within the timeframe allowed.
RECOMMENDATION:
These are for Council Approval. If discussion is needed, please move this to 9.2. portion
of the Agenda.

Please be advised that the Planning Commission held a public hearing at their meeting on
August 21, 2000 to consider the above referenced applications. At the meeting, the
applicant presented a revised site plan intended to address the comments outlined in the .
staff reports regarding access, street layout and overall site design. The Planning
Commission discussed further modification of the site plan including the need for the
second access to 851' Street being a public street, elimination of the proposed cul-de-sac,
driveway issues and the need for landscaping along the existing trail corridor to be paid
for with the cash fees in lieu of land paid in combination with dedication of Outlot A:
Several residents from the adjacent Country Ridge subdivision spoke regarding the
request saying that most of their concerns expressed to the City Council had been
addressed by the revised plan. Several still questioned the need for 83`d Street to be
extended between the two subdivisions. Staff explained that this street has been planned
to be extended since Country Ridge was platted and that it is the City's policy to
encourage such intra -neighborhood connections. Staff also noted that this street
extension is similar to the one approved for Palmgren Avenue, which will connect Country
Ridge and a future addition of Pheasant Ridge.
The applicant is expected to provide revised plans based upon the discussion at the
Planning Commission meeting. However, these plans have not been received to date and
an opportunity for staff review prior to the City Council meeting may not be feasible. As
such, findings of fact have been prepared that are consistent with the recommendation of
the Planning Commission, which voted unanimously to approve the Comprehensive Plan
amendment, rezoning and PUD -CUP concept plan/preliminary plat applications.

Findings of Fact
& Decision
Request: Consideration of a Zoning Map amendment to rezone property located at the
southwest quadrant of CSAH 42 and 85' Street from A-1 District to R-4 and R-6 District to allow
for development of single family and townhouse uses of the Stonegate Estates Preliminary Plat.
City Council Meeting Date: 28 August 2000
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
1. The legal description of the property is described by attached Exhibit A.
2. The 34.2 acre property lies within the Sanitary Sewer Service District and is guided for low
density and medium to high density residential land uses by the 1998 Comprehensive Plan
Update.
3. The property is zoned A-1, Agricultural Rural Service District; The applicant is requesting
the property be rezoned to R-4, Residential Urban Single Family District and R-6, Low
Density Multiple Family District to allow for development of the preliminary plat entitled
"Stonegate Estates"; Single family uses and townhouse uses are permitted uses of the R-4
and R-6 Districts, respectively.
4. The Planning Commission and City Council must take into consideration the possible
effects of the Zoning Map amendment with their judgement based upon (but not limited to)
the criteria outlined in Section 20-3-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The Comprehensive Plan calls for development of a range of urban
housing options addressing the lifecycle needs of the City including single family and
townhouse units, which supplement the City's existing housing stock consisting
almost exclusively of large lot single family dwellings. The location of single family
and townhouse elements of the project are generally consistent with the intent of the
Comprehensive Plan's Land Use Plan. The following policies may be cited in support
of the proposed use:
Whenever possible, changes in types of land use shall occur either at the
center or rear, mid -block points so that similar uses front on the same street,
or at borders of areas separated by major man-made or natural barriers.
(Policy Plan, p. 39)
Transitions between distinctly differing types of land uses shall be
accomplished in an orderly fashion which does not create a negative impact
on adjoining developments. (Policy Plan, p. 39)
A balance in the availability of quality housing choices throughout the City
shall be maintained.
B. The proposed use's compatibility with present and future land uses of the area.
Finding. The proposed uses have been anticipated by the Comprehensive Plan as
a transitional area at the edge of the Sanitary Sewer Service District. The proposed
single family lots are intended to be a transition between the existing large lot
dwellings to the west and planned medium-high density and industrial uses adjacent
to CSAH 42. The existing trail corridor further separates the proposed development
from existing residences.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: The proposed development plan will be required to be consistent with all
applicable performance standards.
D. The proposed use's effect upon the area in which it is proposed.
Finding: Development of the subject project represents infill of a vacant parcel within
the Sanitary Sewer Service District. As the development provides a transition
between large unsewered residential lots and planned medium-high density and
industrial uses, no negative impacts are anticipated.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values as it is consistent with the Comprehensive
Plan and applicable development regulations.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: The proposed development is adequately served by 85"' Street, which is
designated as a collector street based upon the City's functional classification
system. This street has adequate capacity to carry the potential traffic generated by
the proposed development.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.

Finding: The subject parcel is within a planned service area directly adjacent to
neighborhoods already served by public facilities, public works, police and fire
services. As such, proposed use is not anticipated to have a negative impact to the
City's service capacity.
5. The planning report dated 15 August 2000 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.
6. The letter dated 18 August 2000 prepared by the City Engineer, Hakanson Anderson
Associates, Inc., is incorporated herein.
7. The Otsego Planning Commission conducted a public hearing at their regular meeting on
21 August 2000 to consider the application, preceded by published and mailed notice.
Upon review of the application and evidence received, the Otsego Planning Commission
closed the public hearing and recommended by a 7-0 vote that the City Council approve
the Zoning Map amendment based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested Zoning
Map amendment is hereby approved based on the most current plan and information received to
date.

A RESOLUTION AMENDING THE COMPREHENSIVE PLAN - LAND USE PLAN MAP
TO ALTER THE DESIGNATION OF LAND USES SUGGESTED FOR PROPERTY
PROPOSED TO BE DEVELOPED AS STONEGATE ESTATES PRELIMINARY PLAT
BASED UPON THE SUBMITTED DEVELOPMENT PLAN.
WHEREAS, the property in question ("the property") is legally described by
attached Exhibit A; and,
WHEREAS, the property is within the Sanitary Sewer Service District established
by the 1998 Comprehensive Plan Update; and,
WHEREAS, the approximate west half of the property is guided for low density
residential uses and the approximate east half of the property is guided for medium and
high density residential land uses; and,
WHEREAS, the developer has submitted a preliminary plat and PUD -CUP
development application consisting of single family and townhouse uses; and,
WHEREAS, the developer is requesting an amendment of the Comprehensive Plan
Land Use Plan Map such that the guided land uses generally mirror that of the proposed
development plan; and,
WHEREAS, the planning reports dated August 15, 2000 prepared by the City
Planner, Northwest Associated Consultants, Inc., is incorporated herein; and,
WHEREAS, the comments from the City Engineer, Hakanson Anderson Assoc.,
Inc., dated August 18, 2000 are incorporated herein; and,

AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF OTSEGO
TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FOR PROPERTY
INCLUDED AS PART OF THE STONEGATE ESTATES PRELIMINARY PLAT.
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. The official Zoning Map of the Otsego Zoning Ordinance is hereby
amended to change the zoning classification of the property described by attached Exhibit
A(the "property").
Section 2. The portion of the property described by attached Exhibit B is hereby
rezoned from an A-1, Agricultural -Rural Service District designation to an R-4, Residential -
Urban Single Family District designation.
Section 3. The potion of the property described by attached Exhibit C is hereby
rezoned from an A-1, Agricultural -Rural Service District designation to an R-6, Residential -
Low Density Multiple Family District designation.
Section 4. The Zoning Administrator is hereby directed to make appropriate
changes to the official Zoning Map of the City of Otsego to reflect the change in zoning
classification set forth above.
Section 5. This Ordinance shall become effective immediately upon its passage
and publication.

Upon review of the application and evidence received, the Otsego Planning Commission
closed the public hearing and recommended by a 7-0 vote that the City Council approve
the PUD -CUP concept plan and preliminary plat based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested PUD -
CUP concept plan and Preliminary Plat of Stonegate Estates is hereby approved based on the
most current plan and information received to date, subject to the following conditions:
Approval of the preliminary plat shall not guarantee access to sanitary sewer service. The
City shall only guarantee sanitary sewer service to approved final plats with signed
contracts or through a financial commitment for such services to assure the City of timely
development.
2. The preliminary plat is revised to provide lot, block and outlot designations for the entire
development.
3. The preliminary plat is revised to improve orientation of the townhouse structures and
eliminate the proposed private cul-de-sac as part of a development stage application.
4. The street layout is revised to provide a second public access 85' Street and revise the
intersection of Streets A and B with an 83`d Street extension such through traffic to the west
is discouraged. The design of all public streets and private drives shall be subject to review
and approval of the City Engineer.
5. Individual or shared access points to private drives and public streets shall not exceed 24
feet.
6. Flexibility from the front yard setback requirement for the townhouses may be considered
as part of a development stage application in consideration of site design improvements
including (but not limited to) building orientation, setbacks and landscaping.
7. Verification is made that the separation between individual townhouse structures is at least
one-half the sum of adjacent building heights.
8. The landscaping plan is revised to specify the type, size and quantity of proposed
plantings.
9. The site plan is revised to provide off-street guest parking for the townhouse structures at
a ratio of one-half stall per unit.
10. Scaled building elevations, floor plans and materials list are provided for the proposed
townhouse structures with a development stage application.
11. Park and trail dedication requirements are satisfied through combination of cash fee in lieu
of land to be used to remove the existing barb wire fence and provide landscaping along
the existing trail corridor and dedication of Outlot A subject to review and approval of the
Parks and Recreation Commission and City Council.
12. Documentation is provided regarding vacation of the Great River Power easement.
13. Drainage and utility easements are provided at the perimeter of all single family lots and
over the townhouse base lots. All grading, drainage and utility issues are subject to review
and approval of the City Engineer.
14. A homeowners association is provided for as part of the development stage application,
subject to review and approval of the City Attorney.
15. The 40 foot easement conveyed to the John LeFebvre Loving Trust in the agreement dated
April 16,1990 is terminated.
16. Upon approval of a final plat, the applicant shall enter into a development contract with the
City, pay all fees and post required securities, subject to review and approval of the City
Attorney.

The Planning Commission held a public hearing on August 21, 2000 to consider the
request of Darren and Dana Olson for. a conditional use permit to allow a second curb cut
to serve their single family property.
There were no comments received from the public and no comments from the applicants.
The Planning Commission voted 7-0 to recommend approval of the application subject to
the conditions outlined in the staff report.
A findings of fact consistent with the Planning Commission recommendation is attached
for your consideration at the August 22, 2000 City Council meeting.

Findings of Fact
& Decision
Request: Consideration of a conditional use permit to allow a second curb cut to be
constructed to serve a single family property at 15460 88h Street NE.
City Council Meeting Date: 28 August 2000
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
1. The legal description of the property is described as Lot 1, Block 1 Country Ridge Estates.
2. The subject property lies within the Long Range Urban Service Area and is guided for low
density residential land use by the 1998 Comprehensive Plan Update.
3. The property is zoned R-3, Residential - Long Range Service District; Single family uses
are permitted uses of the R-3 District.
4. Section 20-22-4.H of the Zoning Ordinance limits single family properties to one curb cut,
unless a conditional use permit is approved.
5. The Planning Commission and City Council must take into consideration the possible
effects of the conditional use permit with their judgement based upon (but not limited to)
the criteria outlined in Section 20-4-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The standards adopted by the Zoning Ordinance are intended to implement
a functional transportation system that provides adequate access to properties. In
that a second access to a single family property is not a necessity for reasonable
use, the conditional use is only approved based upon consistency with the following
policy:
Proper visibility, design and control of all intersections shall be required to
promote safety. (Policy Plan, p. 56)
B. The proposed use's compatibility with present and future land uses of the area.
Finding: Given the large lot character of the area and temporary cul-de-sac status
of 886 Street, the second access is not likely to create any issues presently.
However, future subdivision of the property would require an additional access to
serve a new lot. As such, the proposed second access serving the subject property
should be removed if the property is subdivided creating a new lot to prevent any
negative impacts to traffic on 881' Street.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding. The proposed second access satisfies all applicable performance standards
pertaining to location and width either as illustrated on the site plan or by condition
of approval.
D. The proposed use's effect upon the area in which it is proposed.
Finding: Due to existing site conditions including building design and location, utilities
and site topography, the proposed second access may be a preferred alternative.
In that a second access would be allowed along the same frontage if the lot were
subdivided, no negative impacts would be anticipated.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: The principal concern with the proposed second access is the addition of
a new intersection along 881' Street. This street currently exists as a temporary cul-
de-sac serving five houses. As such, traffic on this street is likely minimal and a
secondary driveway would not be anticipated to have any negative effects.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Finding: The proposed use is not anticipated to have a negative impact to the City's
service capacity.
6. The planning report dated 14 August 2000 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.

7. The Otsego Planning Commission conducted a public hearing at their regular meeting on
21 August 2000 to consider the application, preceded by published and mailed notice.
Upon review of the application and evidence received, the Otsego Planning Commission
closed the public hearing and recommended by a 7-0 vote that the City Council approve
the conditional use permit based on the aforementioned findings.
Decision: Based on the foregoing information and applicable ordinances, the requested
conditional use permit is hereby approved based on the most current plan and information
received to date, subject to the following conditions:
1. The second access serving a single lot shall be removed if the subject property is
subdivided to create one additional lot.
2. The second access shall be not less than 40 feet from the existing curb cut serving the
subject property and not less than five feet from a side lot line.
3. The maximum width of the second access shall be 24 feet as defined by the Zoning
Ordinance and Engineering Manual.
4. The second driveway shall be surfaced with asphalt, concrete, cobblestone or paving
bricks.
PASSED by the Otsego City Council this 28th day of August, 2000.

At your direction, the Planning Commission discussed the existing provisions within the
Zoning Ordinance prohibiting off -premises signs and those signs allowed for seasonal
produce sales uses. The Planning Commission had been asked to review if any changes
to the present regulations was appropriate in consideration of comments received from Mr.
Kenneth Nathe of the Highway 101 Market at the July 24, 2000_ City Council meeting
during open forum.
The Planning Commission's discussion on the issue was brief. The members did not wish
to see an allowance for billboards made in the community due to the aesthetic issues
involved. The Planning Commission was also not inclined to allow the Highway 101
Market any additional on-site signage, other than to allow the signs to be displayed full
time during season.
Based upon these comments, the Planning Commission took no action to change the
existing Zoning Ordinance provisions.

The final payment is $5,285.15 to Maguire Iron, Inc.
The touch up painting was completed by the contractor last week and
AEC, our inspection company, inspected the work and reported the
satisfactory completion. We have received the necessary lien waivers and
statement of "no further claims". The warranty bond is also included.
A motion would be in order to make the final payment and accept the
facility.
Item 7.4 Consider accepting the Feasibility Study and ordering the Improvement
Project for the Sanitary Sewer, Watermain, Storm Sewer and Street
Construction for 88th Street and Quaday Avenue.
Find accompanying this item a revised cost schedule showing ditch only
across the north line of outlot B in lieu of a 24" RCP and overflow ditch as
requested by council.

Mason Avenue was paved on May 12th and May 15th. On May 18th the shoulder was
placed. Sometime in June, Mr. Ken Davis stopped in at the City shop and spoke to
Dave Chase about some work his neighbor (Mr. Beckman) had done that had caused
some road damage. The work being done was removal of some trees. The damage
was apparently caused by the dragging of the downed trees up onto the roadway. A
tractor pulled the trees up the ditch on the road and along the roadway for several
hundred feet then off the road by field entrance to a field.
The scars in the road caused by the tractor are not extremely deep and do not concern
us as to the strength and integrity of the roadway but it does affect the aesthetics and
rideability of a brand new roadway. It does however, make the roadway hold water/ice
in the gouges and will cause the roadway to prematurely crack or scale in this area.
I have included photocopies of photographs of the damage.
There really is not a corrective action that can make the road look better except for a
future overlay or seal coat. Routing out the gouges and filling with asphalt fines or crack
sealing should prevent water from accumulating and worsening the problem.
The damage occurred approximately/2 mile south of CSAH 39 on the east side of the
road.

RESOLUTION ADOPTING FEASIBILITY STUDY AS A BASIS FOR
STORM WATER IMPACT FEES, LEVIES OR ASSERSSMENTS WITHIN
A PORTION OF THE ESTABLISHED NORTH MISSISSIPPI
WATERSHED DISTRICT DESIGNATED AS THE EAST COMMERCIAL
AREA
WHEREAS, the Otsego City Council directed the City Engineer, Hakanson
Anderson, to undertake a Feasibility Study regarding trunk storm water facilities
required within that portion of the North Mississippi Watershed District as
previously established by the City as a Storm Sewer District, and described within
the report as the East Commercial Area of the North Mississippi Watershed
District as described on the attached Exhibit A; and
WHEREAS, the report, dated February 2000, was presented to and reviewed by
the Otsego City Council; and
WHEREAS, the report contains valuable data from which can be computed fair
and equitable charges, assessments and levies to pay for needed trunk storm
facilities within the District; and
WHEREAS, the Council is currently considering a street, sanitary sewer, water
and storm sewer project within the East Commercial Area which will require
imposition of storm sewer fees for trunk facilities, in addition to assessments for
local improvements.
NOW THEREFORE, IT IS HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF OTSEGO AS FOLLOWS:
1. The Feasibility Study for Trunk Storm Water Facilities for the East Commercial
Area of the North Mississippi Watershed District is hereby adopted as the basis for
any charges, levies or assessments for trunk storm water facilities within the
described area.
2. The City Engineer is hereby directed to utilize said feasibility study as the basis
for calculating any fees, levies or assessments related to trunk storm water
facilities within the described area, and.to report back to the Council at any time if
it appears that the basis for said fees should be revised or recalculated.
ADOPTED this day of August, 2000 by the Otsego City Council.

RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF
PLANS- SANITARY SEWER, WATERMAIN, STORM SEWER AND
STREET EMPROVEMENTS TO PORTIONS OF 88" STREET AND
QUADAY AVENUE .
WHEREAS, a resolution of the Otsego City Council adopted the 2 8 tray of
August , 2000, fixed a date for a council hearing on proposed improvements to
portions of 88th Street and Quaday Avenue from Highway 42 eastward along 88th
Street and Quaday, to be constructed within existing right of way along said 88th
Street and Quaday Avenue . At the time of the hearing four options (and proposed _
assessments for the same) were presented for Council and public consideration as
set forth on the Notice of Hearing attached hereto as Exhibit A.
AND WHEREAS, public input was received and discussion was had of an
additional option (Option 3.5) which was a modification of Options 3 and 4
contained within the original feasibility report.
AND WHEREAS, ten days' mailed notice and two weeks published notice of the
hearing was given, and the hearing was held thereon on the 22nd day of August,
2000, at which all persons desiring to be heard were given an opportunitty to be
heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF OTSEGO, MINNESOTA:
1. Such improvement is necessarry, cost effective , and feasible as detailed in the
feasibility report and addendum.
2. Such improvement, specifically Option 3.5 which calls for construction of
street, sanitary sewer, watermain and storm sewer improvements from Highway
42 eastward to Station 9+40 and ditching only across the north line of Outlot B
Lot 1, and the south lot line of Lot 1, Block 1, MRD Christ Lutheran is hereby
ordered. The project includes a drainage structure under Highway 42. The project
is set forth in addendum to the Feasibility Study.
3. Hakanson Anderson Associates, Inc. is hereby designated as the engineer for
this improvement. The engineer shall prepare plans and specifications for the
making of such improvement.
4. Minnesota State Aid (MSA) funds available to the City, if any, shall be utilized
on this project. The City Engineer and City Administrator shall take all steps
necessarry to secure use of MSA funds for this project, if available.

Dear Council Members:
I have reviewed the proposed settlement agreement faxed to Otsego from the School
District and have discussed it with the School District Attorney. The changes made
reflect a desire on behalf of the School District to make it clear that the claims waived
only relate to the well issues occurring prior to execution of the settlement and would not
affect the ability to make a future claim. This is consistent with my understanding of the
proposed settlement.
Base upon the above, I would recommend that the Council approve the Agreement as
drafted and already executed on behalf of the School District.
I will be available to further discuss this matter and answer any questions at the City
Council meeting on Monday evening.

AGREEMENT BETWEEN THE CITY OF OTSEGO AND ELK RIVER
INDEPENDENT SCHOOL DISTRICT NO. 728
WHEREAS, the City of Otsego ("City") has constructed a municipal well upon
property located within the City and owned by Elk River Independent School District
No.728 ("ISD 728"); and
WHEREAS, the municipal well was constructed on ISD 728 property, in part, so
that it could be used to provide water service to the Otsego Elementary School; and
WHEREAS, a contract was entered into between the City of Otsego and ISO 728
regarding delivery of water service from the municipal well to Otsego Elementary School;
and
WHEREAS, said contract required that the City deliver sand free water to the
elementary school; and
WHEREAS, the well was constructed and completed by Traut Well under the
supervision of the City Engineer, Hakanson Anderson Associates, Inc,; and
WHEREAS, ISD 728 constructed Otsego Elementary School, which included an
internal water system, utilizing the services of KK&E Architects, Inc., Stahl Construction
Company, and Michaud, Cooley, Erickson Consulting Engineers; and
WHEREAS, ISD 728 has alleged that excess sand within the elementary school
waterlines was present within the elementary school water lines as a result of negligent
construction of the municipal well or delivery system by the City, it agents, employees
or contractors; and
WHEREAS, the City has denied that any excess sand within the elementary school
waterlines was the result of any failure to perform by the City pursuant to the contract
between the two entities, or any other action or failure to act by the City, its agents,
employees or contractors; and
WHEREAS, the City has alleged that the sand found within the elementary school
water lines was there because of inadequacies within the school's internal water and
storage system; and
WHEREAS, the City and ISD 728 wish to settle any and all disputes between the
parties relating to the contract clause which requires the City to provide ISD 728 with
sand free water arising prior to execution of this Agreement; and
WHEREAS, the following is a full and complete agreement between the parties

NOW THEREFORE IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS:
1 . After discovering excess sand in ISD 728's water system, ISD 728 took
steps designed to remedy the excess sand problem. To correct the problem, ISD 728
installed a filtering system which cost ISD 728 in excess of $60,000.00. Although the
City denies that it was responsible for the entry of excess sand into ISD 728's water
system, in order to avoid a claim by ISD 728 for all costs it incurred in remedying the
excess sand problem by installing a filter system (in excess of $60,000.00), the City
agrees to credit ISD 728 with credits totaling $15,000.00 (to be used in accordance with
paragraph 3 below) and in exchange for receiving those credits, ISD 728 will not seek
further contribution from the City for the costs it incurred in installing the filtering
system.
2. The City agrees that it shall take no action or in any other way attempt to
require Otsego Elementary School to hook up to City sewer services until the existing
on-site septic system fails or ISD 728 requests hook-up to the City sewer facilities. If
possible, ISD 728 shall provide the City with one year's notice of its intent to utilize city
sanitary sewer.
3. The City shall credit ISD 728 with credits totaling $15,000.00 to be used
at the discretion of ISD 728, but specifically limited to payment of any of the following
municipal charges: city assessments of any nature upon the Otsego Elementary School
or elementary school property, payment of water bills incurred by Otsego Elementary
School, or future sewer and water hook up charges incurred at the Otsego Elementary
School. ISD 728 shall specifically notify the City when and to what extent credits are
being used. ISD shall yearly submit to the City for confirmation a statement as to what
credits have been used and the balance of credit remaining.
4. That both parties specifically reserve the right to seek compensation for any
amounts expended in this matter from their own agents, employees, or contractors.

WHEREAS, the City of Otsego proposes to construct, operate and maintain a
trunk sanitary sewer; storm sewer; and watermain along and within Quaday
Avenue from 78h Street South to the plat of the Pointe, and restore and improve
the existing roadway; and
WHEREAS, the City requires the parcels of land legally described on the
attached Exhibit A for construction, operation and maintenance of said project;
and
WHEREAS, the City has authority to acquire the necessary land parcels and
easements by eminent domain pursuant to Minnesota Statutes § 117.011 and
§ 117.042; and
WHEREAS, the City has attempted to and will continue to attempt to negotiate
acquisition of said parcels; and
WHEREAS, as of this date, the City has been unable to successfully negotiate the
acquisition of the required easements; and
NOW THEREFORE BE IT RESOLVED, that the Otsego City Council hereby
authorizes the acquisition of the lands described in Exhibit A by eminent domain.
The apparent owners of said property are set forth on the attached Exhibit B. The
City further authorizes, if necessary, that title and possession of the land be taken
prior to the filing of an award by the Court-appointed Commissioners pursuant to
Minnesota Statutes § 117.011 and § 117.042 by the so-called 90 -day "quick take"
process; and
BE IT FURTHER RESOLVED, that the City of Otsego City Council hereby
authorizes the condemnation of the required temporary and permanent easements
and land parcels; and
BE IT FURTHER RESOLVED, that the City Attorney is authorized and
directed to prepare, serve and file the necessary Petition and all other necessary
papers, and to prosecute such action to a successful conclusion or until it is
abandoned, dismissed, or terminated by the City or the Court.

Re: Discounting Water Bills
The City's water bill consists of two parts; a
Water Usage Charge of $1.50 per 1,000 gallons of
water used, and a Sewer Usage Charge of $4.50 per
1,000 gallons of water used. Our ordinance says
that we will compute the sewer charge based on
water usage during the winter months. This is done
because only during the winter months is it assumed
that all water used ends up going down the sewer.
Our ordinance does not address how to charge people
for sewer usage who move into a new house during
the summer, before they have built up a track
record of winter water usage which can be used to
determine a sewer rate. Particularly people who
move into a new house, put up a sod lawn, and spend
all summer watering it to keep the sod alive.
Obviously it would be unfair to charge these people
a sewer rate on all their water usage when the
large majority of their water did not go down the
sewer.
I recommend that to fairly treat these people would
be to charge them a sewer rate based on an average
water user for a single family home. The average
single family home uses somewhere between 10,000-
15,000 gallons of water a month. I recommend that
we charge all residents of brand new homes a sewer
rate based on 15,000 gallons of water use per
month, until they have established a rate through
winter usage.

The following statement jointly prepared by representatives of the City of Otsego and the American National Red
Cross is a guide, both in planning for and in the conduct of emergency operations necessitated by war or natural
disasters. The objective is to make more effective cooperative efforts of both organizations during disaster
operations and to prevent misunderstanding, confusion, or duplication of effort.
I. Responsibilities In Natural Disasters
Definition of Natural Disaster:
A National Disaster is the destruction and damage to property, injury and death to humans caused by
windstorm, tornado, fire, flood, blizzard, explosions, building collapse, transportation accident, or other
cataclysm of natural cause.
B. American National Red Cross
The American National Red Cross is the responsible agency for assistance to disaster victims during the
emergency or mass care and the rehabilitation periods.
Mass Care includes:
(a)
Provision of food
(b)
Provisions of shelter
(c)
Provisions of clothing
(d)
Provision of welfare inquiries
(e)
Provision of transportation
(f)
Provision of food to emergency workers
2. Rehabilitation includes assistance to individual families by casework procedures on a
basis of need for:
(a) Food, clothing, and other maintenance
(b) Building and repair
(c) Household furnishings
(d) Medical and nursing
(e) Occupational supplies and equipment
3. The American Red Cross also assists City of Otsego when lives are threatened in its
responsibility of.
(a) Warning
(b) Evacuation
(c) Rescue
II. Responsibility In a National Emergency
Definition of a National Emergency:
A National Emergency is a situation caused by enemy attack upon the United States resulting in crisis
requiring extraordinary measures and so declared by the President or Congress.
A. City of Otsego
The responsibility for the development and execution of a plan of the City of Otsego for the protection of
life and property in the United States has been designated by the Congress to be a joint responsibility of the
federal government, the several states and their political subdivisions. Accordingly, during a national
disaster City of Otsego:

1. Will utilize all governmental and non-governmental organizations, including the Red
Cross in carrying out this responsibility.
A. American National Red Cross
The American National Red Cross recognizes that in a national emergency the protection and care of
families and individuals is a basic responsibility of government. In this connection, Red Cross Chapters
have agreed to assist, to the extent of their ability in the development and operation of a program of City of
Otsego on national, state and local levels. This assistance consists of:
1. Training City of Otsego workers and the general public first aid.
2. Training in home care of the sick and injured, and nurses aid activities.
3. Participation in a wartime nation-wide blood program.
4. Making available its existing organized chapter volunteers and resources for participation
in City of Otsego activities.
III. Coordination of Efforts
A. City of Otsego and the Wright County Chapter of American Red Cross shall coordinate and
cooperate in the use of their existing facilities, equipment and personnel in support of disaster
operations.
B. City of Otsego volunteer communications personnel shall be utilized by the Red Cross to maintain
and operate two-way radio equipment.
C. City of Otsego volunteers assigned to the Red Cross in natural disasters will serve under Red
Cross direction.
D. City of Otsego and Red Cross have a joint responsibility to keep the public fully informed
concerning the disaster. Accordingly it is agreed that:
Direct liaison between City of Otsego and Red Cross will be maintained during all
natural disaster operations for the exchange of information concerning the activities of
each.
2. In a National Emergency, City of Otsego has the responsibility for dissemination of
public information.
IV. Planning and Training
It is further agreed, that the names of trainees in City of Otsego functions will be furnished by the Red Cross to City
of Otsego upon completion of this training. Survey of local mass care facilities shall be coordinated and kept
current jointly by City of Otsego and American Red Cross representative who will be a member of the Wright
County Fire Department's Advisory Committee, whose function would be to assist in the planning and organization
needed to meet emergency demands following a natural disaster.
V. This understanding, having been approved by the following is hereby made a part of the City of Otsego.

CONTRACT BETWEEN
THE CITY OF OTSEGO, MINNESOTA
AND
ANDREW B. MERGES, ASSESSOR
THIS AGREEMENT is made and entered into this day of , 2000, by
and between the CITY OF OTSEGO, a municipal corporation under the laws of the
State of Minnesota (hereinafter "City") and Andrew B. Merges, Real Estate Assessor,
(hereinafter "Employee")
RECITALS:
NNUEREAS, the City is in need of property valuation services for ad valorem property tax
purposes; and
NNUEREAS, the Employee has previously provided the City with this service for over
twenty (20) years; and
WHEREAS, the Employee has substantial experience with real property valuation, and is
qualified to assist the City as an assessor; and
WHEREAS, the City desires to contract with the Employee for the performance of
certain employment tasks more fully described herein; and
WHEREAS, the Employee's principal place of business is located at the following address:
6748 Kadler Avenue Northeast, Albertville, NENT 55301; and
XVHEREAS, the City intends to hire Employee on a part-time basis only, with said
employment being reviewed and renewed, or not, annually; and
WHEREAS, the Employees declares that he is fully qualified and has all necessary
credentials to provide the City with the services set forth herein.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein
contained, it is agreed between the parties as follows:
1. Services to be Performed. The City engages the Employee to perform the following
described employment tasks and services. Employee is responsible for appraising and
valuing each and every taxable parcel of real property within the City of Otsego. Employee
shall personally -view a proportion of the taxable parcels within the City consistent with and
as required by state law. Employee will keep accurate and complete records of the work
performed, including documentation of the basis for all appraisals done. Employee will

cooperate and confer with the Wright County Assessor. Employee shall attend any
sectional meetings called by the Wright County- Assessor. Employee will use generally
accepted standards and methods in determining property values within the City of Otsego.
In performing these services, Employee will meet all deadlines set by law and all reasonable
deadlines, if any, set by either the Wright County Assessor or Auditor or the City.
2. Legal Qualification, Proof and Continuation Thereof. The Employee represents that
he is legally qualified to perform the duties above-described and, further, that he has
obtained all necessary licenses, permits or certifications, including a license form the State
Board of Assessors, and has otherwise fulfilled all legal obligations requisite to providing
assessor services and performing assessor functions. Within ten (10) days of executing this
Agreement and prior to cornmencing service, the Employee shall provide proof of proper
licensure to the City and shall remain legally qualified to perform the duties described in
this contract throughout its term. Failure by Employee to provide such proof or maintain
such qualification will result in termination of this Agreement as provided in section ten
(10) below.
3. Terms of Payment. The Employee shall be compensated at the rate of $7.50 per
taxable parcel actually appraised and valued by Employee. It is estimated that there are
24255 taxable parcels within the City. Payment shall be made based upon an estimate of the
proportionate number of parcels appraised monthly. Any adjustment to this estimate,
either higher or lower, shall be made once a year on or about September 1.
4. Instrumentalities. The Employee shall provide for his or her own vehicle, and any
necessary equipment, tools, materials and supplies, except for nominal office supplies, for
the performance of the obligations specified herein. The City may provide the Employee
with periodic access to a work area within the City offices, including use of a computer and
usual furnishings.
5. Training and Expenses. The City shall pay for any training required by the State
including tuition, mileage, lodging and meals while Employee is attending the required
training. Expenses shall be submitted by Employee as a written claim, to be audited and
allowed by the City Council.
6. Insurance Coverage. Employee shall be covered under any and all applicable liability
insurance coverage, including coverage provided through the League of Minnesota Cities
Insurance Trust, while performing the duties of assessor as a part-time employee of the
City. The City shall pay all premiums and keep such coverage current at all times.
7. Exemption from Certain Benefits. The parties agree and the Employee acknowledges
that as a part-time, contract employee, under S 1-5.2 of the City personnel policy
Employee is exempt from that personnel policy, including, but not limited to, paid leave,
paid vacation and disability benefits and other privileges conferred by the personnel policy,
but not provided for by this Agreement. Any and all benefits received by Employee shall

be provided pursuant to this Agreement or as required under applicable state or federal
law.
8. Payroll Withholding. The City shall make all necessary withholdings from the
monthly payments made to Employee throughout the term of the Agreement. These
include withholdings for state and federal income tax, social security and PERA.
9. Worker's Compensation. Workers' Compensation insurance has been or will be
obtained by the City on account of hiring the Employee.
10. Termination, Employment At -Will. The parties intend that this contract create an
at -will employment relationship. Either party may terminate this Agreement at any time for
any reason or no reason at all, with or without cause or notice. In any event, this
Agreement shall terminate on September 1, 2000 on its own accord. All provisions related
to tennination for cause or any additional related privileges, as set forth in the City's
personnel policy, are specifically not available to the part-time Employee. upon
tennination of this Agreement, Employee will furnish copies of all records made in
performance of the duties specified in the Agreement to the City, Including the basis for
the values assigned to each parcel of property appraised and assessed.
11. Option to Extend. upon written agreement of the parties, the Agi-eement may be
extended to any other future date mutually acceptable to the parties.
12. Integration, Merger, Modification. This Agreement represents the full and complete
understanding of the parties and both parries represent that they are not relying on any
prior Agreement of statements, whether oral or written. This Agreement may be modified
only if in writing and signed by both parties.
13. Severability. Should any teen, provision, section or other lesser part of this
Agreement be found by a Court of competent jurisdiction to be invalid, then said term,
provision, section or lesser part is hereby severed from this Agreement and the remaining
provisions of this Agreement shall remain in full force and effect and shall be binding upon
the respective parties hereto.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the
day and year written above.

At the June Annual Conference, the League launched its Building Quality Communities
initiative. This program is a two-year effort in part to change how legislators, the media, and
citizens look at local government. As you know all to well, the dialogue often focuses
exclusively on the level of taxation without recognition that those taxes have a direct bearing on
the quality of life in our communities.
We are now in the process of preparing our legislative agenda for the coming session. As part of
that effort, our policy committees will be reviewing all of our policies in the context of the
Building Quality Communities initiative. Our hope, of course, is that by framing policies in this
way it will help to make that important connection between cities and quality of life.
Another important step, and the purpose of this letter, is to be able to demonstrate to legislators
and the media that we have widespread support among Minnesota's cities. Your city manager,
administrator, or city clerk was recently sent a resolution inviting your city to express its support
