The Council earlier approved the basic Agreement wherein Jerry is to receive 40% of the permit fees. At that time the Council asked me to look at the existing Agreement and make any revisions in form that I deemed appropriate. I have reinforced the language regarding the Building Official's Independent Contractor status, have added language regarding insurance, and have added language to insure the City's insulation from the Independent Contractor's employees or Subcontractors. I have given copies of my initial draft to Mike Robertson and Jerry Olson for their review. Since that initial draft I have incorporated Mike's comments and have made some other minor adjustments. I will be available to further discuss this matter at the City Council meeting on Monday evening. Very yours, A rew J. cArthur`' OURI ACARTHUR Encl. cc: Jerry Olson, Building Official DRAFT- JANUARY 16, 2001 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA CONTRACT FOR BUILDING OFFICIAL SERVICES THIS CONTRACT entered into this day of January, 2001, by and between the City of Otsego, a municipal corporation (hereinafter "CITY") and Kermit ("Jerry") G. Olson, hereinafter referred to as the INDEPENDENT CONTRACTOR. BUILDING INSPECTOR DESIGNATED: The CITY hereby appoints the INDEPENDENT CONTRACTOR as the Building Official as that term is defined under Minnesota Statutes and Rules, for the CITY OF OTSEGO. The INDEPENDENT CONTRACTOR represents that he is certified by the State of Minnesota as a building official and shall undertake at his own expense to remain so certified throughout the term of this Contract. INDEPENDENT CONTRACTOR understands and acknowledges that continued certification is a material condition of this contract. TERMS OF CONTRACT: This Contract shall commence on the day of January, 2001 and shall continue in effect until December 31, 2001; unless there is a material breach of the terms and conditions of the Agreement (which material breach will be determined solely by the CITY) or the Agreement is terminated by the CITY for cause during that time period. Thereafter, the contract shall continue in effect upon the same terms and conditions for the calendar years of 2002 and 2003 unless 90 days written notice of termination thereof, or changes therein, is given by either party to the other. In the event of termination by CITY, for either a material breach or for cause, no notice period is required. For purposes of this Agreement, cause is defined as any violation of law by the INDEPENDENT CONTRACTOR, his employees or Subcontractors occurring while CITY work under this Agreement is being performed, or any other actions by the INDEPENDENT CONTRACTOR, his employees or subcontractors deemed to be detrimental to the CITY by, and at the sole discretion of, the City Council. SCOPE OF THE CONTRACT: The INDEPENDENT CONTRACTOR agrees to provide building inspection services, plan review, and inspection of individual sewage treatment systems for the CITY in accordance with the State Building Code as adopted by the CITY and amended from time to time, Minnesota Rules for Individual Sewage Treatment Systems and as they are amended from time to time, and applicable City Ordinances. The INDEPENDENT CONTRACTOR agrees to make any and all necessary inspections to insure compliance with the State Building Code, Minnesota Rules and applicable City ordinances. ADDITIONAL WORK UNDER THE CONTRACT: The INDEPENDENT CONTRACTOR shall at the request of the Mayor, City Council, City Administrator or City Zoning Administrator perform additional work not involving building permits. Additional work shall include, but not be limited to, such matters as the evaluation of dilapidated or hazardous buildings or structures, hazardous excavations, the preparation of reports for enforcement of City Code violations or abatement proceedings, as well as the service of documents, drafting of letters and testimony related to the same, and any other investigations, inspections, or testimony reasonably deemed to be necessary by the Mayor, City Council, City Administrator, City Zoning Administrator, City Attorney or Code Enforcement Attorney in order to promote and protect the health, safety and welfare of the citizens of the CITY. ATTENDANCE AT CITY COUNCIL MEETINGS: Within the scope of this Contract, and without additional compensation, the INDEPENDENT CONTRACTOR shall attend City Council meetings and public hearings where required by this contract or as requested by the Mayor, City Council or City Administrator. KEEPING OF RECORDS: Within the scope of this Contract, the INDEPENDENT CONTRACTOR shall maintain and keep secure an adequate set of records, correspondence and memoranda from which can be determined the date, number, status, factual observations, findings and conclusions of all inspections and building permit applications together with any other information deemed necessary by the parties hereto. The original records maintained hereto are deemed the property of the CITY, and the CITY shall have access to said records at any time and for any purpose. Upon termination of this Contract all original records shall be turned over to the CITY. INDEPENDENT CONTRACTOR may retain copies for his files. INDEPENDENT CONTRACTOR STATUS: INDEPENDENT CONTRACTOR shall furnish all equipment of whatever nature necessary to fulfill the terms and conditions of this Contract including vehicles and any and all equipment, tools, materials and supplies, except for nominal office supplies, 2 necessary for properly making and recording required inspections. INDEPENDENT CONTRACTOR shall be free to keep whatever hours he sees fit so as long as he fulfills the terms and conditions of this Contract. INDEPENDENT CONTRACTOR may subcontract out portions of the work under this Agreement to other suitably qualified individuals and the City will have no obligation for payment or liability of any kind to any such Subcontractor. INDEPENDENT CONTRACTOR shall not request or receive, and is not qualified to receive, any retirement benefits, health or dental insurance benefits, life insurance benefits, PERA benefits, workers compensation benefits, unemployment benefits, or any other fringe benefit or other incentive offered by the CITY. Further, INDEPENDENT CONTRACTOR forever waives any present or future claim to any such benefit and acknowledges that he is, in fact, an INDEPENDENT CONTRACTOR, and will make no claim either now, or anytime in the future, that his status with the CITY is or was that of an employee. The INDEPENDENT CONTRACTOR shall carry all insurance necessary to operate as an Independent Contractor and with coverage limits adequate to protect the CITY, including liability insurance for the benefit of the CITY and with coverage acceptable to the CITY. The acceptability of all insurance and the limits of coverage of such insurance will be determined by the CITY, at its sole discretion. INDEPENDENT CONTRACTOR shall be deemed solely liable for any acts or omissions of his employees or Subcontractors which affects the CITY's interests. It shall be the responsibility of the INDEPENDENT CONTRACTOR to make sure that his employees and/or Subcontractors have at all times sufficient insurance coverage to insure the protection of the CITY's interests. Due to the nature of the work to be performed and the convenience to citizens of having the Independent Contractor readily available, the CITY shall provide the INDEPENDENT CONTRACTOR with use of a work area within the CITY offices, including the use of usual furnishings. LOCATION OF THE WORK TO BE PERFORMED: The INDEPENDENT CONTRACTOR agrees that the work shall be performed within the CITY, except that inspections of buildings to be moved into the CITY shall be made at the location of such building prior to it's removal. A special inspection fee, to be paid by the applicant, will apply of $47.00 per hour/ 2 hour minimum plus _per mile mileage reimbursement. 3 EXPENSES: The INDEPENDENT CONTRACTOR agrees that it will seek no reimbursement for out-of-pocket expenses incurred in the performance of his obligations under this Contract, unless such expenses are specifically set forth in this Contract. CONTRACT PRICE: The Contract price shall be 40% of the fee schedule set forth in the 1994 Uniform Building Code, or any subsequent updated version of the Building Code adopted by the CITY, for the issuance of building permits, plus 40% of each plan review fee (including Commercial, Industrial and Multiple) charged by the CITY, and 50% of any septic permit fee. The respective fees shall be paid by the applicant directly to the CITY, and the INDEPENDENT CONTRACTOR'S share thereof pursuant to this Agreement shall be payable to the INDEPENDENT CONTRACTOR once a month on a date to be mutually agreed upon. PAYMENT FOR ADDITIONAL WORK: As compensation for additional work as set forth in this contract, the INDEPENDENT CONTRACTOR shall be paid $30.00 per hour, payable with other verified accounts at a regularly scheduled City Council meeting. BOND: The parties agree that no fiduciary bond shall be required and the INDEPENDENT CONTRACTOR agrees to remain at all times licensed by the State of Minnesota as a certified Building Official, as well as any other licenses required to make any and all inspections required by this Agreement. CONTROL: The INDEPENDENT CONTRACTOR retains the sole and exclusive right to control or direct the manner or means by which the work described herein is to be performed. The CITY retains only the right to control the ends to insure its conformity with proper completion of the tasks set forth herein. PAYROLL OR EMPLOYMENT TAXES: No payroll or employment taxes of any kind shall be withheld of paid with respect to payments to the INDEPENDENT CONTRACTOR, his employees or Subcontractors. The payroll or employment taxes that are the subject of this paragraph include, but are not limited to, FICA, FUTA, federal personal income tax withholding, state personal income tax withholding, state disability insurance tax and state unemployment insurance tax. The INDEPENDENT CONTRACTOR is responsible for payment of any and all taxes related to compensation received under this Agreement. WORKER'S COMPENSATION: No Worker's Compensation insurance has been or will be obtained by the City on account of the INDEPENDENT CONTRACTOR or any employees or Subcontractors of the INDEPENDENT CONTRACTOR. SEVERABILITY: Should any term or condition of this Agreement be found invalid by a court of competent jurisdiction, such finding shall not affect or invalidate the remaining terms and conditions of this Agreement. MERGER: Any previous agreements between the parties, either written or oral, are hereby merged into this Agreement. IN WITNESS WHEREOF, the INDEPENDENT CONTRACTOR and CITY have executed this Agreement this day of January, 2001. Section 20-27-2.13 of the Zoning Ordinance outlined the process for registration. Feedlot registration was to be processed as an administrative permit with a specific listing of information to be provided. Staff has reviewed City files on the feedlot operations that did attempt registration to determine the extent of information provided to date. Exhibits: A. Application Form Analysis Information Requirement. Section 20-27-2.6 of the Zoning Ordinance outlines the process for registering existing animal feedlots within the Rural Service Area designated by the Comprehensive Plan. Registration was to be processed as an administrative permit by the procedures established by Section 7 of the Ordinance. City staff prepared a specific application form that operators were to complete by October 1, 2000 (the second deadline) in order to register. Along with the application, the feedlot operators were to provide specific information regarding their uses as listed by Section 20-27-2.B.1.a. The information requirements were to be basic information about the use that would commonly be required by the MPCA as part of their permitting process. The direction to City Staff was to accept this information over time so long as there was consistent progress made to complete the application. The information required to be submitted is as follows: 1. Owner's and operator's name and address. 2. Location of the animal feedlot including quarter, section, range and township. 3. Animal types and existing number of animals of each type confined at the feedlot and maximum number of animal units allowed in conformance with MPCA permits and guidelines. 4. A scale drawing clearly indicating the dimensions of the feedlot and showing existing homes, buildings, existing manure storage areas and/or structures, lakes, ponds, water courses, known wetlands, dry runs, rock outcroppings, roads and wells within one thousand (1,000) feet of the feedlot. 5. Plans for buildings and structures as required by this Ordinance and/or other County and State ordinances and regulations. 6. A manure and waste management plan as required by the MPCA. 7. Leases or agreements allowing disposal of manure on land other than that of the feedlot owner/operator. No land may be subject to more than one (1) such lease agreement. 8. Documentation of all MPCA rules and regulations and approval of MPCA permits, as may be applicable. Submitted Information. As the table indicates, the information provided for application of an administrative permit necessary to register a feedlot has been very inconsistent. The Vetch situation demonstrates that even the information provided with the most complete application is inadequate to implement and administer the Ordinance. The City will need to consider those that submitted an application as having approved administrative permits registering these feedlots due to the time limitations imposed by Minnesota Statutes 15.99 on notification for incomplete applications and formal action on any request. The Lloyd Beaudry and Tony Berning applications are problematic in that there is documentation that the City accepted information intended for application for a feedlot registration. The existence of the City receipt may be considered evidence of an application and therefore subject to the same time limits. Staff is reviewing this issue further and will provide additional comments. For those operations that have no application on file, the City must determine how to proceed. The deadline for registering a feedlot has expired, after being extended once already. The Ordinance is specific that applications for an administrative permit to register a feedlot are to be processed in accordance with the procedures established within the Zoning Ordinance. On this basis, we would recommend that those operations for which no application was received should not be considered registered. 3 The City Council may elect to pursue another application period to allow these operations the opportunity to complete an application. This action would require another amendment to the Zoning Ordinance. When the Ordinance was amended to establish the second application period, it was strongly recommended that it be a one-time occurrence. The Vetch situation demonstrates why registration must be a limited opportunity due to the impact to surrounding properties development plans. PC. This is a Wright County Road so access is controlled by Wright County. Verification on the number of entrances and proper spacing must come from Wright County. A culvert under the access will be required. 2. Water City water is located on the west side of Wright CSAH 42. The water main is a 16" ductile iron main located approximately 8' below grade. 3. Sanitary Sewer City sanitary sewer mains are located on the east side of Wright CSAH 42. Connection to that main is probably prohibitive due to cost associated with jacking under CSAH 42 and drop structure that would be required. More viable options would be: a. The applicant addressed the Planning Commission with a presentation on the proposed senior center facilities, operations and market. The applicant indicated that they agree with the issues raised in the staff report and would seek to address them as the development process moves forward. The applicant said that they would also seek to ensure that the building designs relate well with the surrounding area, primarily the school, in response to a question from the Planning Commission. The applicant also clarified that they will be requesting "pay as you go" tax increment financing for their project. Council Member Heidner noted that such assistance is dependent upon the operation not becoming a non-profit. The applicant indicated that they would work with the City to ensure property taxes and minimum site improvements. The only comments from the public were from Merilee Asleson who said that nursing home facilities in Elk River have at least a seven month waiting list so there is a need for these uses in the area. At the present time, the Well #1 is being used as an alternate to Well #2, which is the lead pump. Our recommendation is to consider re -developing Well #1 in the next 6 months before the usage water increases to a point where its necessary to have a back- up service full time. This may be the best time to consider doing the work with daily consumption under 20,000 GPD. There are several items in the wells' operation and makeup that need improvement and there are some equipment changes that need to be upgraded. History In 1994, the well was constructed under a time line set by the school district's construction management team. As was the case, the well water turned out to carry some sand, which was objectionable by the School District. Some experts contend that the development of the well cavity was not completed as would be most desirable. We agree that based on the short time the driller had to develop the well and considering that the formation was soft may have contributed to high sand yields in the water. Also, the school's requirement to have the well meet the fire protection pressures and capacity of 90PS1 and 360 GPM made the pumps to recycle every 1 '/4 minute based on the pressure tank capacity of only 400 Gallons. The pump was equipped with a soft start devise that would reduce to impact on the cavity when the pump started. The soft start allowed the pump motor a time delay before reaching full capacity. This devise protected the pump and motor. Except for a pump failure with a lightning strike, the pump has not been pulled for Civil 'Municipal �� Engineering Land Surveying for repairs in five years. The school is now on the municipal water system with the water tower providing pressure, fire flow and potable water. Proposal 1. Pull the pump and remove the flow control devise. 2. Re-evaluate the pump curve for the new tower system. 3. Remove the "soft -start" and in its place install a Variable Frequencies Drive (VFD). The VFD allows for the hertz to be varied and therefore the pump output. 4. Remove any sand in the well cavity. 5. Re -develop by using high pressure and surging. 6. Construct a small building to house the VFD and other electrical components of the well. 7. Minor SCADA signal modification to the local PLC and master control panel. As long as the pump is out of the well, the sand should be removed in the cavity. The pump curve also needs to be reviewed since there is a possibility that the capacity of the existing pump is higher than needed and one set of bowl will need to be removed. This work may be about $5,000 to $7,000. The soft -start can continue to be used. However, versatility of the VFD would be a benefit to the system. Well #2 is operated with a VFD. The VFD is a more expensive item than the soft -start but can save energy costs. The proposed building required will house the VFD. The housing is required to control the temperature of the VFD. We are probably considering a 6' X 8' Building with a three foot metal lockable door. Ventilation and heat will be provided in the building. The building will need to look like the school buildings, some brick, etc. as per the agreement between the School District and the City. The building would only house the VFD and the other electrical equipment presently on the site. If the City decides to proceed with this work it may be necessary to advertise in the local and Construction Bulletin as it is close to the $50,000 limit for quotes. A study MnDOT is doing regarding I-94 between Maple Grove and St. Cloud and Wright County's future plans for county road spending in our area. 1) MnDOT Study MnDOT has just hired BRW to do a corridor study of Interstate 94 between Maple Grove and St. Cloud. This study is to focus on the growth in that area and what the State will need to do to upgrade I-94 in the next 20 years. The fear of those at the meeting is that MnDOT's biggest concern is to move traffic as fast as possible and they might try to reduce the future number of intersections and overpasses in our area to do that. The consensus was that the three communities should send a joint letter signed by the Mayors to MnDOT asking for our cities to be involved in the study. A draft of that letter is attached. 2) Wright County Highway Spending There was much discussion about how Wright County sets its priorities for highway spending. The feeling of all communities at the meeting was that the County is not driven by traffic safety or population growth. The County seems to feel that its the individual communities' fault that population is growing in this area and that they do not feel they have to do any upgrading of County roads due to growth. St. Michael's experience in lobbying the County is that it is ineffective to send a staff member or consultant to talk to them, that the County Board only listens to elected officials.
