Re: Discussion of Concept Plans
Given the amount of discussion that has gone on at
Concept plan presentations the last few months, I
thought we should discuss where staff is coming from on
these concept plans, and see if Council is in agreement
or feels there should be a change.
Concept plans are typically plans that are presented
without much detail. They are done to see if the
Planning Commission and Council agree with the overall
concept of the plan. If the concept plan is approved
then the developer will go ahead and prepare formal
preliminary plats and site plans. These plans will be
subject to formal hearings before the Planning
Commission and need approval by Council before any
building can take place. It's important to note that
Concept plan approval does not bind the Council into
automatically approving the follow-up plans.
The Concept Plans considered in the past year are;
(1) Otsego's Waterfront; Commercial development at
Highway 101 and County Road 39 - Approval of design
guidelines.
(2) Mississippi Pines; Cluster Housing Development on
County Road 39 - Approval of Planned Unit Development
and proposed housing density.
(3) Riverboat Landing; Apartments, Townhomes, and
Commercial development southeast of Highway 101 and
County Road 39 - Approval of Comprehensive Plan
Amendment.
(4) Darrell Farr; Senior Housing PUD on River Road -
Approval of Comprehensive Plan Amendment.
(5) Meadowlands; Single Family Housing on Lu Luconic's
land - Approval of housing density.
Three of these five concept plans were approved, one
was rejected, and one is pending.
In discussion of the last three plans, Council has
requested information that is usually not part of a
Concept Plan but is provided when there is an
application for site plan approval or preliminary plat.
Staff has encouraged developers to apply for Concept
plan approval when they are seeking either a land use
or a density of development which is different from
what the Comprehensive Plan allows.
Does Council wish staff to continue encouraging Concept
plan applications for uses that are problematic, i.e.,
require a "tough selling job", or, would Council wish
to prohibit or discourage Concept plan applications?

Concept Plan
Dear Chris:
We have the following comments on the Concept Plan for Meadowland;
P.U.D. in Otsego, Minnesota:
1. The cul-de-sac in the northwest corner of the plat must have the
roadway centered on the bulb of the cul-de-sac.
2. Both connections toward the existing development should be
shown. The 87th Street connection in the southeast corner of
the plat should be dashed in and labeled as a possible future
connection. The 90th street connection must be shown as a
road to be constructed as part of this plat by the developer of
Meadowland.
3. Wetland issues were addressed in my letter to you dated
January 24, 2001.
4. The wastewater treatment system will need to be reviewed to
determine compliance with City Ordinances and MN PCA
Permit Conditions.
The concept appears to be acceptable, however, the secondary
site location is a considerable distance from the proposed
treatment site. Failure of the ##1 site would cause additional
infrastructures to be installed for the relocate. We assume that
only a drain field would be necessary for the alternate site.
Distance set back from the DNR wetland needs to be
considered in placing the system,

Otsego - Mississippi Wild and Scenic Plan Update

City Administrator Mike Robertson asked that we attend a meeting held by the DNR on
February 13, 2001 regarding their Mississippi Wild Scenic Recreation River (MWSRR)
Management Plan update. DNR held this meeting with local city and county officials to
review proposed changes to the District boundary, land use districts and land use controls
that would be made part of the draft management plan update. The purpose of this
memorandum is to advise the City Council of these proposals as they relate to Otsego's
objectives for the DNR's planning process.

Analysis
Proposed Boundary. DNR staff is recommending changes to the MWSRR District
boundary within Otsego based upon recommendations made by the City. These changes
would remove from the MWSRR area lands south of CSAH 39 near Nashua Avenue, most
of the planned commercial/industrial area west of T. H. 101 (City Staff is still reviewing the
exact north boundary with DNR staff) and the areas south of CSAH 42 that are east of T.H.
101. The City has disputed these lands from being included within the MWSRR District
because they are separated from the River corridor by major roadway.
These boundary changes achieve the City's minimum objectives for changes to the
MWSRR District. However, DNR staff is not recommending a major revision to the
MWSRR boundary that would change it from the arbitrary designation based uporl section
and/or property lines to one based upon an equidistant measurement from the waterway
or the bluff line. Otsego has recommended this approach in the past as it provides for a
means to relate the regulations to the natural features of the Mississippi River. Staff
encountered problems with the current boundary in applying the regulations to the
Mississippi Pines subdivision. Changes had to be made to the plat involving shifting of
lots in order to meet the density requirements because the current boundary included
areas far from the Mississippi River that had no impact to the corridor.
Part of the City's comments to the DNR is that they should take this opportunity to overhaul
the boundary designation to eliminate these problems. Their reply has been that such
changes to the boundary would include lands within the District not presently included..
We have noted that the changes would also remove lands from the present District. It may
be suggested in both cases that changes to the boundary results in the regulations being
applied based upon natural characteristics that actually have impacts to the River.
Land Use Districts. The DNR is proposing that the MWSRR Area be divided into four
land use districts. Three of these Districts are proposed to be designated over areas of
Otsego, including River Town, River Town Expansion and Rural Residential.
The River Town District is intended to accommodate areas of existing urban scale
development along the Mississippi. It is proposed to overlay that area of Otsego extending
from Otsego County Park to the south edge of Riverside Evergreens, east of T.H. 101 and
north of CSAH 42. The draft proposal is that local government will be allowed to
determine the appropriate land uses and performance standards within the River Town
District. Standards intended to protect the River are not anticipated to be more restrictive
than current shoreland district regulations. Based upon the information provided, a
development such as the Waterfront commercial development conceptually approved for
the area east of T.H. 101 would be allowed.
River Town Expansion has been designated over the area in Otsego locally designated
as the long range urban service area. DNR anticipates that future development of River
Town Expansion areas would consist primarily of single family residential, with
performance standards again similar to those of a shoreland district. These standards
would allow for future resubdivision of the existing acreage lots, should sanitary sewer
service ever be made available in these areas of Otsego.
The remaining areas of the City have been designated a Rural Residential District. This
land use district is more similar to the existing MWSRR regulations in character. These
standards, however, do not conflict with the City's plans for these areas, which are
designated as the Rural Residential Preserve and Urban Service Area Reserve by the
City's Comprehensive Plan.

Timetable. DNR staff anticipates completing an internal review of the draft management
plan by mid-March of this year. The draft plan then goes to a public review period, which
will last through August 2001 with a final draft completed by September 2001. The draft
plan must then go through a rules drafting process, which includes additional public
hearings. This process is not anticipated to be completed earlier than December 2002.
Local governments would then need to amend their local ordinances based upon the new
rules.
Conclusion
The City of Otsego's participation in the planning processes to update the MWSRR
management plan appears to be resulting in a positive outcome. The proposed changes
to the MWSRR management plan appear to be consistent with Otsego's minimum
objective's for changes to the District boundary and land use controls so as to allow the
City to have greater control at the local level and implement its Comprehensive Plan. Staff
will remain involved in the planning process to ensure that theseproposals get carried
through the next stages and are included in the final document and rules.

Dear Mike:
As requested, I have reviewed the entire existing sewer serviced properties and
all final platted lots. I have also reviewed all of the areas that are either
preliminary platted or in sketch plan phase.
This was completed to better understand where the city stands in regards to the
number of sanitary sewer services available.
Currently, the city has a wastewater treatment plant capable of handling 200,000
gpd, of this 200,000 gpd; Otsego has allocated 40,000 gpd of the capacity to the
City of Dayton. This leaves 160,000 gpd or 640 residential equivalent
connections (REC's). The City of Otsego has either final platted or connected
sewer service to a total of 644.6 REC's (see table 1).
Although the total REC's is slightly greater than the Wastewater Treatment
Plants capacity, this should not pose a problem because a majority of the 644.6
REC's are not live. The City of Otsego Wastewater Treatment Plant has a
permit to discharge up to 400,000 gpd and the City has approved the go ahead
on constructing the expansion of the Wastewater Treatment Plant. This means,
in less than 2 years the city should have the capacity of 360,000 gpd or 1440
REC's.
The city has approved several preliminary plats and/or is planning to assess
property for sanitary sewer service. These properties total 837 REC's (see table
2). Combining this with the 644.6 REC's from Table 1, gives a total of 1481.6
REC's. Again, this is slightly more than the 1440 REC's provided after the
Wastewater Treatment Plant expansion.

In addition, there are a few properties, which have sketch plans in and will be
requesting sanitary sewer service in the near future. These are Otsego's
Waterfront and Farr Senior Housing. These have been approximated at 309
REC's (see table 3).
The city has expressed an interest in reserving 30% of the initial 200,000 gpd
plant (60,000 gpd) for commercial/industrial use. This is equivalent to 240 REC's.
Currently the city has used 16.6 REC's for commercial/industrial or roughly 2.5%
of the reserve. An additional 123 REC's of commercial/industrial have been
preliminary platted or property assessed for sewer service. Sketch plans of an
estimated 184 REC's have also been received by the city. This would bring the
total REC's of probable commercial/industrial to 323.6 REC's. The East portion of
the Otsego Waterfront project may be many years away. Subtracting this from
the total commercial/industrial REC's leave 227.6 REC's. This is very close to
the city's sewer capacity reserved for industrial/commercial. If the city would like
to reserve sewer service for proposed industrial/commercial, we suggest the
residential properties should not exceed a total of 1210 REC's.
In conclusion, we are quickly approaching the maximum number of final plats the
city can approve and additional preliminary plat applications should be informed
of the imminent ceiling on final plat approvals for serviced lots.
