Please be advised that the Planning Commission held a public hearing to consider the
application of Ken and Julie Nathe for a rezoning, PUD Development Stage Plan, and
preliminary plat to construct a new 6,000 square foot retail center.
The applicants were in attendance at the meeting and stated that they are eager to move
ahead with construction of the use this year. In response to a question raised about
storage of equipment, Mr. Nathe said that equipment would be Umited to a bobcat tractor
and occasional use of tractors or implements for the field areas for a few days. So long
as this equipment is kept within the screened sales area, it would be considered incidental
to the use and not present an issue.
No comments were received from the public. After closing the public hearing, the Planning
Commission voted 5-0 to recommend approval of the applications, subject to the
conditions as outlined below. The applications will be considered at the City Council
meeting on 12 August 2002 at 6:30 PM.
A. Motion to approve a rezoning to PUD District, PUD Development Stage Plan, and
Preliminary Plat subject to the following conditions:
Approval of the applications are subject to approval of the DNR in
accordance with Section 20-95-22 of the Zoning Ordinance.
2. The use of Lot 1, Block 1 shall be subject to the standards of the B-3 District,
except as modified on the approved development plan. The use of Outiots
A and B shall be limited toraising produce, landscape plantings, or other
crops.
3. A 75 -foot no disturb zone from the OHWM or 30 -foot no disturb zone from
the bluff line (whichever is greater) shall be with a conservation easement.
4. The total area of impervious surface on Lot 1, Block 1, Outlot A, and Outlot
B shall not exceed 25 percent of the land area.
5. All outdoor sales areas shall be fully screened from view from the public
rights-of-way, subject to approval of City Staff.
6. The surface of the sales areas shall control dust and drainage subject to
review and approval of the City Engineer.
7. The building elevations shall be revised to increase the amount of stone on
the north building facade and specify rock face block on the west elevation.
The use of wood lap siding in excess of 10 percent of the wal I area shall be
subject to review by the Planning Commission and approval of the City
Council.
8. A landscape plan is submitted that provides boulevard plantings along
Quantrelle Avenue, foundation plantings adjacent to the buildings, plantings
along the side lot lines to screen parking and loading,areas, subject to
approval of City Staff.
9. The landscape plan shall include an inventory of vegetation within the 75 -
foot conservation easement along the Mississippi River. Any open areas or
breaks within the vegetation shall be planted with trees to add to the quality
of the proposed Mississippi River buffer.
10. All parking and circulation drives shall be surfaced with asphalt or concrete
with perimeter concrete curb. An appropriate transition from the driving
surface to the outdoor sales area must also be provided, subject to approval
of the City Engineer.
11. Sanitary sewage treatment shal I be provided on an interim basis with holding
tanks in a location that would facilitate pending connection to municipal
services. Water service shall be provided by an on-site well on an interim
basis for the principal building until municipal utilities are extended to the
property. The well may be maintained for irrigation purposes of the
landscape stock and growing fields as necessary. Terms specifying
required connection to the municipal system shall be included in the
development contract, as well as provisions for documenting regular
pumping of the holding tanks.

12. All signs shall conform to Section 37 of the Zoning Ordinance. Off -premises
signs are strictly prohibited.
13. A photometric light plan showing the type and location of all proposed
exterior light fixtures shall be submitted, subject to approval of City Staff. All
light sources shall be fully hooded with a horizontal cutoff.
14. Trash conta ' iners must be kept within the building or in dumpster that are
fully enclosed and screened from view, subject to City Staff review and
approval.
15. All grading, drainage, utilities, and easements are subject to review and
approval of the City Engineer per their Engineering Review of July 31, 2002.
16. Park and trail dedication requirements shall be satisfied at the time of final
plat approval, subject to review of the Parks Commission and approval of the
City Council.
17. The applicant shall enter into a development contract outlining the conditions
of approval and terms of the PUD District and pay all fees and securities
provided for by it, subject to review and approval of the City Attorney.
18. Comments of other City Staff.
B. Motion to deny the application based on a finding that the request is inconsistent
with the policies of the City's Comprehensive Plan and provisions of the Zoning and
Subdivision Ordinance.

FINDINGS & DECISION
WRIGHT COUNTY, MINjNESOTA REZONING/PUD DEVELOPMENT PLAN
APPLICANT: Ken and Julie Nathe.
APPLICATION: Request for a Zoning Map amendment, PUD Development Plan, and Preliminary plat for
a 6,000 square foot retail garden center.
CITY COUNCIL MEETING: 12 August 2002
FINDINGS: Based upon review of the application, the recommendation of the Planning Commission, and
evidence received, the City Council of the City of Otsego now makes the following findings of fact:
A. The legal description of the property is described on Exhibit A.
B. The property lies within the Sanitary Sewer Service District and is guided for commercial land uses
by the Otsego Comprehensive Plan, as amended.
and Recreational River Overlay District; The applicants are requesting rezoning to PUD,
C. The property is zoned A-11, Agriculture Rural Service District and is also within the WS, Wild Scenic
Unit Development District to allow for development of a retail garden center use. Planned
D. The Planning Commission and City Council must take into consideration the Possible effects of the
PUD District and PUD Development Plan with their judgement based upon (but not limited to) the
criteria outlined in Section 20-3-2.F of the Zoning Ordinance:
The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding - The Comprehensive Planincludes the subjectparcel within the east sanitary
sewer district and guides it for commercial uses based on its Proximity and access to
Trunk Highway 101. The designation of this parcel for commercial uses is consistent
with the City's position that the Wild and Scenic management plan is overly restrictive
in this area due to the fact that vegetation has been cleared for agriculture production
and because T. H. 10 1 has visual and noise impacts that would do more to impact the
Mississippi River than a carefully planned development of the subject property.
The DNR is working to revise the Mississippi Wild Scenic and Recreational River
Management Plan. The initial working draft plans would designate this area of the
City as a 'river town" district acknowledging more intensive land uses are to be
allowed based upon existing characteristics. The DNR is currentlyin the process of
finalizing a draft plan for public comment and the final plan would not likely be
adopted for one to two years.

The proposed use of the property provides a proper balance for protecting the
Mississippi River by using the growing areas of outlots A and B as a transition from
the more intensive uses developing adjacent to T.H. 101. In an effort to ensure
protection of the Mississippi River and maintain consistency with the purpose of the
Wild and Scenic Recreational River District, it is recommended that a 75 -foot no
disturb zone from the OHWM or 30 -foot no disturb zone from the bluff line (whichever
is greater) be established along the east edge of the property with a conservation
easement.
2. The proposed use's compatibility with present and future land uses of the area.
Finding: The retail sales element of the proposed use is located at the northwest
comer of the property nearest to the intersection of CSAH 39 and TH 101. Thisarea
has been planned for a range of commercial uses, which a garden store would be
compatible.. The growing areas on Outlots A and B and the proposed conservation
easement willprovide foran appropriate transition to the Mississippi Riverand the RV
campground located to the south of the subject site.
3. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: The proposed use will conform to all applicable Zoning and Subdivision
Ordinance requirements.
4. The proposed use's effect upon the area in which it is proposed.
Finding: The proposed use will result in commercial development guided by the
Comprehensive Plan to expand retail services and increase tax base, while at the
same time enhancing protection of the Mississippi River corridor consistent with the
WS Overlay District.
5. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed� the proposed use is not anticipated
to negatively impact area property values.
6. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: The proposed use is well served for local and regional patrons by access to
CSAH 39 and T.H. 101 via Quantrelle Avenue. Traffic generated by the proposed
use is within the available and planned capacities for these roadways.
7. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the Citys service
capacity.

Finding.- The proposed use is not anticipated to have a negative impact to the City's
service capacity.
E. The planning report dated I August 2002 prepared by the City Planner, Northwest Associated
Consultants, Inc., is incorporated herein.
F. The engineering review dated 31 July 2002 prepared by the City Engineer, Hakanson Anderson
Associates, Inc., is incorporated herein.
G. The Otsego Planning Commission conducted a public hearing at their regular meeting on 5 August
2002 to consider the application, preceded by published and mailed notice. Upon review of the
application and evidence received, the Otsego Planning Commission closed the public hearing and
recommended by a 5-0 vote that the City Council approve the request based on the aforementioned
findings.
DECISION: Based on the foregoing information and applicable ordinances, the request for a Zoning Map
amendment, PUD Development Stage Plan, and preliminary plat is hereby approved based on the most
current plan and information received to date, subject to the follo%ving conditions:
Approval of the applications are subject to approval of the DNR in accordance with Section
20-95-22 of the Zoning Ordinance.
2. The use of Lot 1, Block 1 shall be subject to the standards of the B-3 District, except as
modified on the approved development plan. The use of Outlots A and B shall be limited
to raising produce, landscape plantings, or other crops.
3. A 75 -foot no disturb zone from the OHWIVI or 30 -foot no disturb zone from the bluff line
(whichever is greater) shall be with a conservation easement.
4. The total area of impervious surface on Lot 1, Block 1, Outlot A, and Outlot B shall not
exceed 25 percent of the land area.
5. All outdoor sales areas shall be fully screened from view from the public rights-of-way,
subject to approval of City Staff.
6. The surface of the sales areas shall control dust and drainage subject to review and
approval of the City Engineer.
7. The building elevations shall be revised to increase the amount of stone on the north
building facade and specify rock face block an the west elevation. The use of wood lap
siding in excess of 10 percent of the wall area shall be subject to review by the Planning
Commission and approval of the City Council.
8. A landscape plan is submitted that provides boulevard plantings along Quantrelle Avenue,
foundation plantings adjacent to the buildings, plantings along the side lot lines to screen
parking and loading areas, subject to approval of City Staff.

9. The landscape plan shall include an inventory of vegetation within the 75 -foot conservation
easement along the Mississippi River. Any open areas or breaks within the vegetation shall
be planted with trees to add to the quality of the proposed Mississippi River buffer.
10. All parking and circulation drives shall be surfaced with asphalt or concrete with perimeter
concrete curb. An appropriate transition from the driving surface to the outdoor sales area
must also be provided, subject to approval of the City Engineer.
11. Sanitary sewage treatment shall be provided on an interim basis with holding tanks in a
location that would facilitate pending connection to municipal services. Water service shall
be provided by an on-site well on an interim basis for the principal building until municipal
utilities are extended to the property. The well may be maintained for irrigation purposes
of the landscape stock and growing fields as necessary. Terms specifying required
connection to the municipal system shall be included in the development contract, as well
as provisions for documenting regular pumping of the holding tanks.
12. All signs shall conform to Section 37 of the Zoning Ordinance. Off -premises signs are
strictly prohibited.
13. A photometric light plan showing the type and location of all proposed exterior light fixtures
shall be submitted, subject to approval of City Staff. All light sources shall be fully hooded
with a horizontal cutoff.
14. Trash containers must be kept within the building or in dumpster that are fully enclosed and
screened from view, subject to City Staff review and approval.
15. All grading, drainage, utilities, and easements are subject to review and approval of the City
Engineer per their Engineering Review of July 31, 2002.
16. Park and trail dedication requirements shall be satisfied at the time of final plat approval,
subject to review of the Parks Commission and approval of the City Council.
17. The applicant shall enter into a development contract outlining the conditions of approval
and terms of the PUD District and pay all fees and securities provided for by it, subject to
review and approval of the City Attorney.

Please be advised that the Planning Commission considered the request for a nine-month
extension for implementation of the CUP approved for Hoofbeats and Heartbeats, Inc. at
their meeting on 5 August 2002.
Ms. Linda Kreuser was present to update the Planning Commission on their efforts at
rasing funds for construction of the riding arena. A representative of Habitat for Humanity
was also present to describe their involvement with the project.
After hearing the staff report and Mrs. Kreusers' comments, there was no further
discussion of the CUP extension. The Planning Commission voted 5-0 to recommend
approval of the nine month extension of the CUP to 23 April 2003, subject to the seven
conditions attached to the original CUP.
This planning item will be on the City Council agenda for 12 April 2002 at 6-.30PM.

FLOODPLAIN MANAGEMENT MEETING FOLLOW UP
Thank you for meeting with Area Hydrologist Patty Fowler and Cell Strauss of my staff
regarding the city's floodplain management on April 23, 2002- A copy of the monitoring form
we submit to the Federal Emergency Management Agency (FEMA) for the "community
assistance visit" is enclosed.
In general, the city is doing a good job of administering its floodplain ordinance. Inaddition,
the city has been exploring the possibility of obtaining grant monies to help with acquisition of
up to 19 residences in the Parrish Street area, which have experienced Mississippi River flooding
numerous times. A neighborhood meeting was scheduled for April 25, 2002 to present the idea
of pursuing the grant money and to get an idea of how many of the residents would be interested
in being acquired. Ms. Strauss forwarded a PowerPoint presentation with basics on substantial
damage/improvement definitions, the related zoning regulations, and the implications of not
meeting the city's zoning regulations for the costs of flood insurance premiums.
As was discussed, due to annexations in Frankfort Township the city needs to amend its general
floodplain ordinance to add reference to Wright County's Flood Insurance Rate Map. Section
20-73-4 of the city's "FP", Floodplain Overlay District Ordinance (Section 73) needs to be
amended as follows:

together with all materials attached thereto is hereby adopted by reference and
declared to be a part of this Chapter. The attached material shall include the

NAC serves as the City planners for Albertville, Buffalo, Clearwater, Delano, Hanover,
Howard Lake, Monticello, Montrose, Otsego, and Rockford.
The City of Albertville is looking to improve traffic conditions on County Road 19 within its
boundaries, Increased traffic congestion near the Albertville Outlet Mall, as well as traffic
accidents, push the need for these County Road 19 improvements. The County has
indicated that this project is not in their five year capital improvement project and funds are
not available for the improvement. The cost of this project exceeds the City's ability to fund
it, independent of the County.
To expedite improvement of this stretch of County Road 19, the City has come up with an
alternative means of financing for this County road improvement project. The attached
memo outlines the use of tax abatement for improvements to County roads. Through tax
abatement, the City and County can cooperatively share the costs and write down needed
improvements that would not otherwise be available for funding.
In a memo prepared by the City Engineer, Pete Carlson of SEH, he outlines how the past
use of tax abatement by Steele County has been effective in bringing new develop nent
into the County and resolving traffic and utility issues that exist with new economic
development or community growth. Mr. Carlson's memo outlines some guidelines for tax
abatement resolutions to insure that tax abatement is utilized for public improvements and
is not a subsidy directly to a private land developer. The memo also explains that the use
of tax abatement would not necessarily present a hardship related to other County
services.
We are sending this outline to the individual Wright County communities with the
understanding that each of the communities face unique problems of its own with regard
to rapid municipal growth. The ability to address utility and transportation issues is
essential in the proper planning of each community.

In areas where the County has jurisdiction over County highways and the need for
improvements is being pushed by new development, both the County and the City must
look at innovative and new funding opportunities. Tax abatement offers this unique
funding opportunity without dramatic impact on the County. By isolating the tax abatement
district to a specific new economic development project, the City/County can control the
amount of tax abatement being utilized, directed to specific projects, and limit the number
of projects throughout the County based on need and County perceived importance,
Additionally, the City's contribution to the tax abatement district helps fund County projects,
extending the County's transportation budget to upgrade other areas of the County road
system.
In looking at the issues that each of the Wright County municipalities face, there is a need
to establish some County policy as to how the municipalities will be treated to address the
growth that is naturally occurring. Without County support, municipalities are left to their
own solutions, resulting in higher taxes for each of the individual communities and
requiring municipal residents pay for a greater share of services both locally and County-
wide.
It becomes more and more apparent that the Wright County municipalities need to speak
to each other regarding the various issues related to growth and the needs that this growth
spurs as far as County services and infrastructure. Collectively, the municipalities must
approach the County and ask for alternative means for financing and addressing these
various County -wide services.
In conclusion, we ask that you review the Albertville tax abatement proposal and determine
whether there is any benefit to your individual community either now or in the future related
to the use of tax abatement for County road improvements. The City of Albertville would
appreciate a letter of support if deemed appropriate from each of the Wright County
communities as a means of convincing the Wright County Board of Commissioners that
this is the time to examine the County's position on municipal growth issues. Any letters

$90,000 and $135,000, to pay off the debt on the infrastructure. 15 -year arrangement

2. Sample Guidelines for Abatement Resolution to Ensure Practical Use of Tax Abatement
Minnesota Statute 469.1813 requires the governing body of a political subdivision to enact an
abatement resolution that specifies the terms of the abatement. Some sample provisions include:
• The road in question must be a County State Aid Highway'and the improvements must be
included in the County's 10 -year Transportation Plan-
• Taxes that are abated must be new developments that have direct access to the road in question
and whose taxes are not currently part of the municipalities' general budget.
• The County will only abate 75% of the taxes of the properties that meet criteria in item b).
e The local unit of government (city or township) making the request must commit to abating the
maximum possible under Minnesota Statutes 469.1812 to 469.1815 ($ 100,000 or five percent of
its current levy).

Dear Honorable Mayor and City Council:
We have reviewed the Heritage Hills Storm Pond issue and have determined the following:
Currently the primary outlet is a 6" Ductile Iron Pipe. This pipe restricts the flow out of the pond until
the pond reaches the overflow elevation of 924. At this elevation, the overflow dumps into the 15"
concrete pipe outlet until the inflow into the storm pond is less than what the 6" DIP is outflowing.
This restriction causes the Heritage Hills storm pond to stay at flood elevations for extended periods of
time before slowly receding. Hydrographs show that after a 100 -year storm, the pond does not begin
to recede until approximately 36 hours after the storm and then at a very slow rate of approximately
1.5 cfs; so it would take several days before it returns to normal water levels.
This restriction was put in place prior to many improvements to the Halls Pond Drainage District.

We propose to install a 12" concrete pipe to replace the 6" DIP. This would significantly reduce the
high water detention time after a I 00 -year storm event. With a 12" pipe, the pond would begin to
recede approximately 13 hours after the storm event. The difference for smaller, more recurring events
would show an even more proportional improvement.
We estimate the cost for this change at less than $ 1000.

Re: 1-94 Industrial Park Storm Pond Flooding
Dear Honorable Mayor and City Council:
Last spring flooding problems arose with the storm pond in the 1-94 Industrial Park. These problems
were directly related to the downstream culvert under the Burlington Northern Railroad and the ditch
connecting the BNRR culvert to the culvert under 1-94 eastbound.
The culvert under BNRR is a 12" concrete pipe and was virtually plugged and the downstream ditch
was also filled in. We called and wrote BNRR several times. In the meantime, City crews used pumps
to lower the storm pond. The storm pond has reached elevations, which inundated a septic drain field
and partially covered two parking lots.
BNRR did finally come out and clean out the culvert, but did not clean the ditch. This helps, but does
not completely resolve the problem. The storm pond is designed with a certain amount of storage and
a certain amount of outflow. In its present state, a good portion of the storage is used due to the water
backing up from the plugged ditch and the outflow is also slowed due to the plugged ditch.
With the recent rain, the culvert could not drain quickly enough and the pond is again flooding. City
crews attempted to pump the pond down again, but the landowner to the east of K"'adler Avenue has
requested the City not to pump water across her property.
We recently sent another letter to BNRR and made another round of phone calls. Mn/DOT District 3
and the City crews are working together to clean the Mn/DOT right-of-way portion of the ditch and
BNRR is bringing some equipment via railroad, which will be able to clean the railroad right-of-way
portion. BNRR is also in the process of replacing numerous culverts under the railroad and this culvert
is slated for replacement within a month. BNRR will be installing a 24" concrete pipe replacing the
12" pipe.

Bids were received and opened on August 8, 2002, for Construction of School Knoll Park. A
total of 3 bids were received as shown on the attached Bid Tabulation.
We recommend Award of the Contract to the low bidder, Koolmo Construction, 13' ) 4 146 1h Lane
NW, Andover, NIN 55304-7711.
With the aggressive timeframe for completion, the bid was above the Engineer's Estimate. A
Change Order to a lesser project cost could be issued. Options include eliminating the doubling
up of both the basketball courts and the tennis courts. Providing one of each saves
approximately $20,000. Another option is to Change Order out the landscaping work and
complete this at a later time (maybe next spring) and bid it in conjunction with another park.
This would save an approximate $70,000 now although future costs would be incurred.
Koolmo Construction specializing in park equipment installation. The company has worked in
Otsego in the past, including park equipment installation (i.e. picnic table, bike rack) as a part of
the 1998 bike path project.

Re: Future of the EDAAC
I have enclosed the minutes of the recent EDA-EDAAC
meeting. As you can see, there was discussion of
eliminating the EDAAC and replacing it with various
special project task forces which would work on
specific projects and not have regular meetings.
This will take an action of the City Council and
City Attorney MacArthur will be present to explain
any legal issues.

1. CALL TO ORDER.
EDA President Larry Fournier called the meeting to
order at 6:38 p.m.
ROLL CALL: EDA: Mayor Fournier, Councilmember Struthers and
Councilmember Heidner.
EDAAC: Leroy Lindenfelser and Vince Peterson.
Staff: City Administrator Mike Robertson.
2. DISCUSSION OF EDAACIS FUTURE
Mayor Fournier discussed the history of the EDA and the
EDAAC. The EDA was formed as a financing mechanism to
finance City Hall cheaply. The EDAAC was formed in the
hopes that it could attract businesses to build in
Otsego. He asked everyone if they thought the EDAAC
should continue.
Commissioner Lindenfelser said that the developers,
builders, and realtors that he sees all know where
Otsego is and know that things are going on. The
market demand is here and everyone knows it. He does
not think the EDAAC needs to continue as it has been.
He thought small special tasks forces should be formed
for specific projects. He mentioned continuing the
annual marketing meeting and updating the Community
Profile as two possible special tasks.
Commissioner Peterson said he thought the group should
continue because there are things to do. He said that
he drew up a list of possible projects but forgot to
bring the list along. He stated that if the name was
changed he still wanted it to be a commission with
regular meetings and by-laws.
Commissioner Lindenfelser stated that he was thinking
of the new group as more of a series of task forces
rather than a regular commission. Mayor Fournier said
that it would not need a regular monthly meeting.
Commissioner Peterson said that it should meet
regularly so each task force can make a report.
Commissioner Lindenfelser indicated that he thought
such reports would be made to the Council or the City
Administrator and would not need a regular meeting.
Councilmember Struthers asked what other communities
EDA's or EDAAC's do?
Councilmember Heidner said that a lot of cities have
had long established EDA's that were started with State
grants and did Tax increment Financing (TIF) back when
more things could be done with TIF. Those grants and
TIF monies were often used to start revolving loan
funds which have continued to generate a Pot of money
that those communities can put to work today. Otsego
doesn't have anything like that and has no money other
than tax dollars.
Councilmember Struthers said he would like to see a
task force formed to try and help start up a service
organization in Otsego such as the Lions or the
Jaycees.
Administrator Robertson was directed to check with the
City Attorney on the proper procedure for disbanding
the EDAAC and replacing it with a series of special
task forces which would not have regular meetings.
This will be presented at the August 12, 2002 City
Council meeting. Mayor Fournier thanked everyone for
their hard work on the EDAAC.
With no further business, the meeting was adjourned at
7:43 p.m.

Re: Discussion of Council Special Meeting Pay
Pursuant to discussion at the Council budget workshop
of Tuesday, August 6, 2002, 1 have the following
recommendation. That the Policy regarding payment to
Councilmembers for special meetings, commission
meetings, and workshops be amended to read as follows.
"The Mayor and Councilmembers will not be paid for
attendance at Special meetings, workshops, and
Commission meetings if they do not attend the entire
meeting."

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
A RESOLUTION DECLARING INTENT TO REIMBURSE
WHEREAS, the Otsego City Council has determined to
proceed with certain capital projects (as
specifically described in Exhibit A hereto,
collectively referred to as the "'Project"), and
intends to obtain financing with respect to the
Project at least in part through proceeds of tax
exempt bonds issued by the state of Minnesota; and,
WHEREAS, the Otsego City Council desires that all
permitted costs of the Project paid prior to the
issuance of tax-exempt bonds qualify for
reimbursement from the proceeds of issuance of such
tax-exempt bonds under applicable Treasury
regulations.
NOWI THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF OTSEGO, MINNESOTA:
1. It is desirable that certain expenditures for
or relating to the Project be incurred and paid
prior to the issuance of tax-exempt bonds to
finance such expenditures;
2. Such expenditures are expected to be made in
the foreseeable future with respect to the Project;
3. The City reasonably expects to reimburse the
above described expenditures by incurring debt in
the form of one or more tax exempt bonds, in one or
more series, in an aggregate amount not exceeding
$4,750,000-00, and reasonably expects that actual
costs of the Project to be reimbursed from such
bond proceeds will probably be less, depending on
the date on which such bonds are issued and the
completion schedule for the Project;
4. No funds (from sources other than such debt)
are, or are reasonably expected to be, allocated on
a long term basis, reserved or otherwise set aside
pursuant to the City's budget or financial policies
for such expenditures at this time; and
5. In connection with the Project, authority is
hereby specifically conferred on the Mayor or any
other officer of the City to make such further
declarations of official reimbursement intent on
behalf of the City as may be necessary or desirable
and as may be consistent with then existing

I have addressed this letter to both Of You because You have
both called with complaints about the pond in Your back
yards. In addition, you have both said that your neighbors
around the pond are also upset about the height of the pond
and want something done to change it. Please feel free to
share this letter with your neighbors so that everyone can
have the same information.
The pond in Your back yards is an official delineated
wetland, rather than a regular stormwater Pond. The City of
Otsego cannot take any action to change this wetland without
replacing it by creating twice as much wetland somewhere
else. Consequently, when Dennis Ulmer Proposed to develop
Prairie Creek subdivision, he was told -to design around this
wetland. Because it is a wetland, it will be there
permanently, and will grow and shrink in size depending on
the amount of rainfall.
This pond in Your back yards is surrounded by a City
stormwater easement. The width of this easement on your
lots varies in size from 40 feet to lio feet, depending on
the shape Of Your lots. This stormwater easement was
granted by the developer as part of the process Of Platting
Your lots. There is an overflow swale leading out of the
pond to the street. This swale was built at such an
elevation that water will flow through it before it will
reach such a level as to threaten your homes.
I am aware that each Of You, and Your neighbors, feels that
they were not adequately informed by either their builder or
realtor of what a stormwater easement is used for. I am
very sorry for this, but the City of Otsego neither
supervises, nor is responsible for, any statements made by
builders or realtors regarding property in the City.
I am also aware that this type of stormwater system is
different from what most People grew up with. I also grew
up in a developed community where all the stormwater
traveled underground in concrete Pipes to holding ponds or
lakes that were often blocks away. State laws regulating
stormwater run off, which were passed in the early 199o,s,
no longer allow this type of stormwater treatment in
subdivisions built since the law was passed. Under these
laws, stormwater must not flow off the land at a faster rate
than it did before the land was developed. This means that
every new subdivision has to have holding ponds constructed
within it to control the rate of stormwater runoff. In Your
Prairie Creek subdivision, there are approximately 35 single
family lots that have some sort of pond in their back yard
or side yard.
This means that the City can do very little to change the
stormwater system in your backyard. The pipes, holding
ponds, and swales have already been built both upstream and
downstream from your development. Altering Your back yard
pond and easement to make them smaller would mean altering
the stormwater systems both upstream and downstream from
You. This would be very expensive. YOU would have to
Petition for this improvement, and the City would assess you
for it because your properties would be the ones that
benefit.
I understand that some of You have sodded the areas that are
now being flooded due to recent rains. Water will probably
cover these areas whenever it rains. Recent inspections by
the City Engineer have found that this water is still well
within the stormwater easement. Whether You want to mow up
to the edge of the water and try and grow'grass there or
whether you want to encourage the growth of wetland plants
along the edge of the ponds is up to each homeowner.

answered by this letter, please give me a call.
