BACKGROUND
Arcon Development, Inc. has submitted a requestforfinal plat approval of 12 single family
and 50 townhouse dwelling units as part of the first phase of the Pheasant Ridge 5t'
Addition.
The subject parcel is guided by the Comprehensive Plan for low density residential uses
and is zoned R-5 District. The preliminary plat for this parcel was approved by the City
Council on May 29, 2001.

ANALYSIS
Preliminary Plat Consistency. The proposed final plat is generally consistent with the
approved preliminary plat and conditions of approval thereof. The final plat includes the
same number of lots/units within the given area. Also, the single family lots within Blocks
2 and 3 all are at least 55 feet wide measured at the front setback line.
Outlots. The final plat includes three outlots. Outlots A and B include unbuildable or
wetland areas. The purpose of Outlot B is not clear in that it is outside of the delineated
wetland. Lot 51 of Block 1 is the common area between the townhouse structures.
Consistent with City practice, this area should be designated as an outlot and overlaid with
a drainage and utility easement.
Phasing Plan. The preliminary plat is being constructed in stages. The City Engineer has
identified some concerns regarding the installation of utility lines based upon the proposed
phasing plan. Also, provision must be made for temporary cul-de-sacs at the dead -ends
of the public and private streets, subject to approval of the City Engineer.
Construction Plans. The City Engineer has made a preliminary review of the final plat
and has some concerns regarding the proposed construction plans. These issues will
need to be resolved based on the comments in the City Engineer's memorandum of July
10, 2001.
Park and Trail Dedication. No land is proposed to be dedicated for park and trail
facilities as part of the final plat. As such, the applicant must pay a cash fee in lieu of land
equal to $1,075 per unit. Based upon 62 units, a total fee of $66,650 is to be provided for
this initial phase.
Development Moratorium. The proposed final plat will be served by municipal sanitary
sewer and water services. This parcel was specifically exempted from the current
subdivision moratorium based upon available capacity to service the anticipated
development approved with the preliminary plat.
Development Contract. The applicant must enter into a development contract with the
City and pay all required securities and fees, upon approval of the final plat. The
development contract is subject to review and approval of the City Attorney.
CONCLUSION
Subject to resolution of the utility and grading plan issues identified by the City Engineer,
the proposed final plat is generally acceptable based upon the approved preliminary plat.
As such, our office recommends approval of the final plat subject to the following
conditions:
1. Lot 51, Block 1 is designated as an outlot with an overlying drainage and utility
easement.

constructed as part of this phase, which will eventually be extended as through
streets.
3. All grading, utilities, easements and other construction plans are subject to review
and approval of the City Engineer.

trail dedication requirements.

securities and fees, subject to review and approval of the City Attomey.

The legal description of the property (the "property") is described as Outlot B, Pheasant
Ridge.
The property lies within the Sanitary Sewer Service District and is guided for low density
residential land use by the 1998 Comprehensive Plan Update.
The property is zoned R-5, Residential - Single and Two Family District; Single family and
townhouse uses are allowed uses within said District.
The Pheasant Ridge 5th Addition Preliminary Plat was approved by the Otsego City Council
on May 29, 2001.
The property is subject to the conditions of a PUD -CUP approved by the Otsego City
Council on May 29, 2001.
The proposed final plat consists of 12 single family residential lots, 50 townhouse unit lots
and three outlots.
The planning report dated July 17, 2001 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.

GRADING PLAN — SHEET 1
1. Garage floor elevation must be a minimum of 18" above center of street. Numerous
lots do not meet this requirement.
2. Wood fiber blanket is required at inlets.
3. Normal level, 2 -year, 10 -year, and 100 -year flood water levels shall be depicted on
the plan for each basin.
4. Detention basins should include a shelf with a minimum width of 10 feet and a slope
of 10:1 starting at the normal water level (see Appendix C, pg. 4, Section 5.0.E.4).
5. 1.5' of freeboard is required for non -landlocked basins from 100 -yr elevation to lowest
opening. (see lot 14 of Block 2)
6. Call out garage floor, lowest opening, and lowest floor elevations for all structures.
We are concerned with SOG/SE backing up to the storm pond.

10. Additional pavement removal is needed at intersection of Page Avenue NE and 78th
Street NE.
DETAIL SHEET — SHEET 2
1. Typical section for 78th Street shall show Bike Path, B618 curb, 6" Class 5 (100%
crushed), 2 % " Non -wear, and 2" Wear. Please revise.
2. Specify widths of approved subgrade and aggregate base in typical sections.
3. All class 5 aggregate base shall be 100% crushed.
4. It appears that the wear course is not depicted in the typical sections.
HYDROLOGY REVIEW
1. The outlet for the storm pond appears to be incorrectly modeled. The outflows
bounce between positive outflow and no outflow as the pond depth increases. The
outflow should continually increase as the depth increases.
2. We would prefer a second outlet structure rather than a riprapped overflow.
3. Rate control storage appears minimal in comparison to the outflow volume. It does
appear some additional volume was created due to wetland mitigation areas. Please
provide us with total live storage volume created.
4. The positive outflow elevation of pond 881 L must be provided. This elevation may be
outside of the plat boundaries but is critical in setting a correct 100 -year elevation on
the 881 L pond.
5. The curve number of 77 appears low. Provide justification for the use of curve
number 77. A curve number of 85 would more closely represent the townhome type
of development proposed as shown in the Otsego Engineering Guidelines Manuel.
WETLAND CONSERVATION ACT COMMENTS
1. The City of Otsego has not implemented a stormwater maintenance program,
therefore, Public Value Credits for stormwater pond creation cannot be granted.
2. The upslope buff area can only be counted when adjacent to a wetland or wetland
mitigation area.
3. Excavation of a wetland to create a storm pond is questionable and may be an issue
for the Technical Evaluation Panel.

BACKGROUND
Mr. Rod Winter has submitted an application to revised the final plat of the Winter
Addition, a two lot and one outlot subdivision approved by the City Council on September
11, 2000. The purpose of the replat is to organize ownership of the property based upon
a divorce settlement between Mr. Winter and his former spouse.
The subject plat is approximately 54 acres in size and is located north of 65th Street, west
of T. H. 101. The Comprehensive Plan guides the east half of the property for medium-high
density residential land uses and the west half for low density residential uses. The
property is currently zoned A-1, Agricultural Rural Service District consistent with the
interim land use plan element of the Comprehensive Plan.
As a minor revision of the approved final plat, the application is being processed in
accordance with Section 21-3-3 of the Subdivision Ordinance. The application does not
require a public hearing or Planning Commission review.

ANALYSIS
Lots. The proposed final plat includes two buildable parcels consistent with what was
approved previously. Lot 1 is developed with an existing single family dwelling and
accessory buildings. A new residential dwelling is to be constructed on Lot 2. Conditional
use permits were approved with the previous plat to allow lot sizes within the A-1 District
between 2.5 acres and 10.0 acres in size. Although Lot 1 is now 7.0 acres larger, it is still
within the allowances of the CUP.
Outlots. The revised final plat includes two outlots, whereas the previous plat included
one. Outlot B is located in the northwest comer of the property and will be retained by the
applicant. Outlot A will be owned by a Family Limited Partnership. The division of the
property ownership does raise the issue of howthe area may ultimately develop. As such,
the City may require that a concept plan for subdivision of the property be provided
showing the logical division of the property.
Existing Barn. Approval of the original final plat was conditioned upon Lot 1 being
revised such that the existing barn on the property be setback from the east property line
by at least 30 feet. Based upon the site survey, the east lot line of the revised plat must
be shifted an additional 20 feet east in order to meet the setback requirement. The final
plat should be revised such that the existing barn meets all applicable setbacks and that
the area of Lot 1 is not greater than 10 acres.
Easements. The revised final plat shows drainage and utility easements at the perimeter
of the buildable lots and overlying the creek running through the property. The plat also
shows a drainage and utility easement over an existing gas pipeline that crosses the
property. An easement was to be provided over Lot 1 allowing access from the
constructed portion of 65' Street to Lot 2. All easements are subject to review and
approval of the City Engineer.
Utilities. Installation of well and septic systems for the new dwelling to be constructed on
Lot 2 is subject to review and approval of the Building Official as part of the permit process.
Park and Trail Dedication. The original final plat did not require park and trail dedication
as the number of buildable parcels was not increased. As a replat of the existing final plat,
no park and trail dedication is required.

CONCLUSION
The proposed replat of the Winter Addition does not substantially chango the
circumstances of the original plat. No additional buildable lots are established and the
modifications conform with the requirements of previous approvals. The only potential
issue is the resubdivision of Outlots A and B based upon the land uses guided by the
Comprehensive Plan. This issue may be addressed with submission of a concept plan for
resubdivision of the properties within the plat. As such, our office recommends approval
of the revised Winter Addition Final Plat subject to the conditions outlined below.
1. A concept plan is provided illustrating potential resubdivision of the property based
upon the direction of the Comprehensive Plan, subject to approval of City Staff.
2. The final plat is to be revised such that the existing barn meets all applicable
setbacks and that the area of Lot 1 is not greater than 10 acres.
3. All easements are subject to approval of the City Engineer.
4. Installation of on-site septic and well utilities for Lot 2 is subject to review and
approval of the Building Official.
5. Comments of other City Staff.

Request: Consideration of a revised final plat for the Winter Addition consisting of two single
family residential lots and two outlots.
City Council Meeting Date: 23 July 2001
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
1. The legal description of the property is described by attached Exhibit A.
2. The 54 acre property lies within the Sanitary Sewer Service District and is guided for a mix
of urban low density and medium to high density residential land uses by the 1998
----
Comprehensive Plan Update.
The property is zoned A-1, Agricultural Rural Service District, which allows residential
development at a density of one unit per forty acres, with a maximum lot size of 2.5 acres.
4. The size of the residential lots are 3.0 acres and 10.0 acres. Section 20-51-5.17 of the
Zoning Ordinance allows for residential lot sizes larger than 2.5 acres but less than10.0
acres as a conditional use. The City Council approved such a CUP on September 14,
2000.
5. Section 20-22-4.1-1.2 of the Zoning Ordinance requires all properties to have direct access
to a public street unless a CUP is approved. Proposed Lot 2 of the revised final plat does
not have direct access to a public street, but will share a driveway with Lot 1 until such time
as 65th Street may be improved. The City Council approved a CUP for access other than
directly to a public street on September 14, 2000.
6. The preliminary and final plat of the Winter Addition was approved by the City Council on
September 14, 2001.
7. The planning report dated July 18, 2001 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.
8. The application to revise the final plat is processed in accordance with the provisions of
Section 21-3-3 of the Subdivision Ordinance.
Decision: Based on the foregoing information and applicable ordinances the requested revision

AN ORDINANCE AMENDING OTSEGO CITY ORDINANCE NO. 97-1
PERTAINING TO DEFECTIVE OR MALFUNCTIONING EMERGENCY
ALARM SYSTEMS WITHIN THE CITY OF OTSEGO.
THE CITY COUNCIL OF THE CITY OF OTSEGO ORDAINS AS
FOLLOWS:
Section 1. Otsego Ordinance No. 97-1 is amended to read as follows:
"Section 1. Any false alarm call to an individual, or business that, in the
opinion of the Fire Chief having jurisdiction over the area, the County
Sheriff or the City Administrator, was the result of a defective or
malfunctioning alarm system will receive a notice outlining the terms and
conditions of this Ordinance.
Section 2. A second false alarm call within the calendar year will subject
the property owner to a $100.00 charge. Three or more false alarm calls
within a calendar year will result in the property owner being charged
$250.00 for each additional false alarm.
Section 3. The City may use discretion in enforcing this Ordinance, taking
into account any unique circumstances that may exist in a particular case
and history of false alarms coming from a particular property, business or
residence.
Section 4. Any service charge against a property or individual not paid in
full within thirty days of the date of billing shall be placed as a special
assessment against the property pursuant to Minn. Stat. 429.101, after
proper notice and hearing.
Section 2. This Ordinance Amendment shall be in force and effect after its
passage and publication.
ADOPTED by the Otsego City Council this day of July, 2001.
