City Council Meeting Date: 13 August 2001 Findings of Fact: Based upon review of the application, the recommendation of the Planning Commission and evidence received, the City Council of the City of Otsego now makes the following findings of fact: 1. The legal description of the property is described by attached Exhibit A. 2. The property lies within the Agriculture Preserve Area and is guided for agricultural land use by the 1998 Comprehensive Plan Update. The property is zoned A-2, Agricultural - Long Range Urban Service District (General); Single Family dwellings are a permitted use in this District. 4. The relocation of existing structures to lots within the City of Otsego requires consideration of a conditional use permit pursuant to Section 19 of the Zoning Ordinance. 5. The Planning Commission and City Council must take into consideration the possible effects of the conditional use with their judgement based upon (but not limited to) the criteria outlined in Section 20-4-21 of the Zoning Ordinance: A. The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. Finding: The following policies may be cited in support the applicant's request: • The character of individual neighborhoods shall be reinforced, maintained and upgraded. (Policy Plan, pg. 40) B. The proposed use's compatibility with present and future land uses of the area. Finding. The area is small neighborhood developed with low density single family residential homes within a generally rural area. The existing character of this area is planned to continue by the Comprehensive Plan. As such, the proposed use will be compatible with present and future land uses. C. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Finding: As noted above, the subject site and relocated structure will conform to all applicable performance standards. D. The proposed use's effect upon the area in which it is proposed. Finding: The relocated dwelling and single family use of the property will not have a negative impact to the area. E. The proposed use's impact upon property values of the area in which it is proposed. Finding: Although no detailed study has been completed, the proposed use is not anticipated to negatively impact area property values. F. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Finding: The relocated structure will not generate traffic beyond the capabilities of streets serving the subject property. G. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Finding: The proposed use is not anticipated to have a negative impact to the City's service capacity. 6. The planning report dated 1 August 2001 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. 7. The Otsego Planning Commission conducted a public hearing at their regular meeting on 6 August 2001 to consider the application, preceded by published and mailed notice. Upon review of the application and evidence received, the Otsego Planning Commission closed the public hearing and recommended by a 6-0 vote that the City Council approve the conditional use permit based on the aforementioned findings. Decision: Based on the foregoing information and applicable ordinances, the requested conditional use permit is hereby approved based on the most current plan and information received to date, subject to the following conditions: 1. The applicant submit a survey of the property identifying the building, septic system and well locations, in conformance with applicable performance standards of the A-2 District. 2 2. A building permit is approved by the Building Official prior to relocation of the structure. The relocated structure shall be ready for occupancy within six (6) months from the date of location on site, subject to approval of the Building Official. 4. The design of an on-site septic system and well are subject to review and approval of the Building Official. 5. A security as required by Section 20-19-3 of the Zoning Ordinance as determined by the building official is posted. PASSED by the Otsego City Council this 13' Day of August, 2001. No comments were received from the public. The applicant was present to explain the operation of the plant. The applicant also raised the following issues: Use of metal lap siding in place of the all block facades presented on the plan. Although allowed by the Ordinance, metal siding has only been allowed as an accent material. This building was compared with the JK Storage building which used all block. As such, the Planning Commission unanimously recommended the elevations as submitted. Allowance of the gravel loading areas shown on the site plan to allow installation of concrete surface by employees as time allows within a two-year period. The City has previously allowed a one-year deferment of parking surface requirements based mostly on the need for construction grades to settle. The Planning Commission recommended that the surface meet requirements within one year. Following discussion, the Planning Commission voted unanimously to recommend approval of the site and building plans and CUP for height in excess of the 1-2 District allowances. Findings consistent with this recommendation are attached for review at the August 13, 2001 City Council meeting. PC. The subject property is legally described as Lot 1, Block 2 of the Otsego 1-94 West Industrial Park Addition. 2. The property lies within the Long Range Urban Service Area and is guided for industrial land use by the 1998 Comprehensive Plan Update. 3. The property is zoned 1-2, General Industrial District, Concrete plants are a permitted use of said District. 4. The height of structures may not exceed 35 feet within the 1-2 District. The proposed height of the concrete mixing silo is approximately 85 feet. Section 20-17-3.A allows structures to exceed the maximum height limits of the respective Zoning District by CUP. 5. The Planning Commission and City Council must take into consideration the possible effects of the conditional use with their judgement based upon (but not limited to) the criteria outlined in Section 20-4-2.F of the Zoning Ordinance: A. The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. Finding: The subject site is planned for industrial uses. Concrete plants and their necessary equipment are consistent with the guided land use of the property. B. The proposed use's compatibility with present and future land uses of the area. Finding. The area surrounding the subject parcel is of rural or agricultural character. The MNRoad facility exists to the west and south of the subject parcel. Areas north of the site are agricultural fields. The principal concern in terms of area impact would be to the existing residential units to the east, which also front 70"' Street. These parcels are also planned for future industrial or commercial uses, although no time line has been established. The potential impact to these residential properties is likely limited to traffic to and from the subject site. C. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Finding: The proposed use of the subject site will conform to all of the applicable performance standards of the 1-2 District, including increased setbacks for the structures in excess of District height limits. D. The proposed use's effect upon the area in which it is proposed. Finding: Increased height of the silo structures may not be expected to have any negative effects to the area based upon conformance with applicable performance standards. E. The proposed use's impact upon property values of the area in which it is proposed. Finding: Although no study has been completed, the proposed use is not anticipated to negatively impact area property values. F. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Finding: Jalger Avenue170th Street adjacent to the subject property have been designed to the level of the City's collector/arterial street standards by MNDoT as part of the MNRoad facility. Jalger Avenue170th Street is also connected to the City's higher order Streets to move traffic from the site out of the community. This was one reason that the subject parcel was designated for industrial use by the Comprehensive Plan. As such, these streets have adequate capacity to handle traffic generated by the site. G. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Finding: The proposed use is not anticipated to have a negative impact to the City's service capacity, provided adequate provisions are made for on-site septic and water services. 6. The planning report dated 1 August 2001 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. 7. The Otsego Planning Commission conducted a public hearing at their regular meeting on 6 August 2001 to consider the application, preceded by published and mailed notice. Upon review of the application and evidence received, the Otsego Planning Commission closed the public hearing and recommended by a 6-0 vote that the City Council approve,the CUP based on the aforementioned findings. Decision: Based on the foregoing information and applicable ordinances, the requested CUP for structure height greater than 35 feet and site and building plans are hereby approved based on the most current plan and information received to date, subject to the following conditions: 1. The applicant apply for a final plat amendment to replat Lots 1 and 2, Block 1 as a single parcel. 2. The existing access to 70' Street is closed and the driveway restored. The location and width of all access points to 71" Street are subject to review and approval of the City Engineer. 3. All off-street circulation, parking, and loading areas are to be surfaced with bituminous or concrete surrounded by perimeter concrete curb within one (1) year from the date of occupancy. 4. One van accessible disability parking stall is provided. The building exterior is to be of brick or split face concrete block. 6. The landscape plan is revised to provide additional boulevard trees along the 71 st Street frontage, subject to review and approval of the City Planner. 7. Signage is limited to one wall sign per street frontage not to exceed 100 square feet per sign. Installation of any signs requires issuance of a sign permit by the Zoning Administrator. 8. Any exterior trash containers must be kept within an enclosure as required by Section 20- 16-15 of the Zoning Ordinance. 9. Any light fixtures that are to be installed must have a 90 -degree horizontal cut-off and not illuminate more than one foot-candle at the property line. 10. In general, the design of the final plat is consistent with the approved preliminary plat. The number of lots proposed for this fourth addition is one less than for the same area of the preliminary plat. Whereas the preliminary plat had five lots fronting the cul-de-sac on Padre Circle, the proposed final plat has only four. All of lot widths and lot sizes within this fourth addition are consistent with the R-4 District requirements of 75 feet and 12,000 square feet. Approval of the preliminary plat included the requirement that the intersection of Padget Avenue and 85' Street be off -set to the west to discourage through traffic and minimize headlight glare to the homes on the north side of 85"' Street. Padget Avenue has been shifted 260 feet west on the final plat. Sadowski Farmstead. The final plat includes Outlots A and B, which are provided to allowforfuture resubdivision of the Sadowski farmstead (Lot 1, Block 7 of Crimson Ponds 1' Add.) into three lots consistent with the preliminary plat. Section 21-7-4. L of the Subdivision Ordinance requires that these remnants be combined with the farmstead parcel for future use. Construction Plans. The applicant has provided construction plans for the project, addressing streets utilities, grading and drainage. All construction plans are subject to review and approval of the City Engineer. Park and Trail Dedication. No land has been dedicated for park and trail facilities as part of the final plat. As such, the applicant must pay a cash fee in lieu of land equal to $1,075 per unit. Based upon 43 lots, a total fee of $46,225 is to be provided for this addition. Development Moratorium. The proposed final plat will be served by municipal sanitary sewer and water services. This parcel was specifically exempted from the current subdivision moratorium based upon available capacity to service the anticipated development approved with the preliminary plat. Development Contract. The applicant must enter into a development contract with the City and pay all required securities and fees, upon approval of the final plat. The development contract is subject to review and approval of the City Attorney. CONCLUSION The proposed final plat of Crimson Ponds 4th Addition is consistent with the applicable provisions of the City's Comprehensive Plan and development regulations, as well as the approved preliminary plat and applicable conditions. I would like to comment on some of the policy and financial issues raised. 88 th STREET Christ Lutheran Church has asked for a reduction in their assessment of an unspecified amount because they are a church and it is a financial hardship on their members to pay the assessment. I do not recommend any reduction. I recommend that they be treated like any other property owner. The Church was informed when they sought permission to build on their land that they were building on a prime piece of commercial land. They have stated, publicly and privately, that they gain a benefit from being located on such a visible and accessible piece of property. A similar piece of property located just north of them recently sold for $70,000 an acre. The church could at any time sell their property to a commercial developer and relocate. Because of this, they should be assessed the same way that the existing and future commercial properties around them are assessed. ODEAN AVENUE Reduction of Assessments has made a case for having I don't believe that anyone their assessments reduced. The poor state in which our frontage property was left after the completion of the project. We can no longer use a riding mower in that area because of the slope and roughness. 20+ years prior to this project, we were able to use a riding mower. We had to remove the large staples used to hold down the netting, as well as cut the netting by hand in order to begin mowing in that area. The roughness of that area makes even using a push mower extremely difficult. We also now have a washout area that runs down between our bushes when it rains. 3. We do not live on Odean Avenue. A) Driveway slopes going in & out. Review showed nothing severe. I believe 1 or 2 loads of CL 5 will improve the ride. This could be accomplished by city crews from city stockpiles. As part of the project several loads were installed for Mr. Miles (much more than any other driveway). B) Culvert elevation under driveway Review showed no need for change, culvert was dry & clear of debri and silt. C) Silt fence Silt fence will be removed. D) Driveway width 11' to 15' Review of plans showing prior width reveals a majority of Mr. Miles driveway was 11' wide. At the last 20', the driveway widened to 45' at the road edge. All residential driveways along O'dean Avenue were given 16' wide curbcuts with 3' on either side for tapering. Our opinion was that 22' wide curb opening plus the extra 10' shoulder of the new road provided more than enough turning radius. We suggest no change. A) Does not want assessment as road improvement does not extend across entire length of property. The road improvement does not extend the entire length of her property. It is, in fact, less than 50%. It does, however, include her driveway & storm improvements. In our opinion, it has benifitted her property considerably. We leave this to Council decision. B) Steep slopes for mowing. A review of the slopes show no excessive slopes for mowing. I would estimate a 3.5:1 or flatter. 3:1 is considered the steepest that is still mowable. Alcoholic Anonymous 9231 O'dean Avenue Alanon has 1 construction issue. A) Driveway slopes too great Reviewed driveway & can find no problems. Frank Morrisette 7460 O'dean Avenue No construction issues; only issue was on deferred assessments Gary Inman 7262 O'dean Avenue One Construction issue. A) Seeding; lack of good growth. We have contacted the seeding subcontractor and he has agreed to meet with us & review seeding of project. We anticipate having him reseed portions of O'dean Avenue. This should occur after August. We suggest to the landowners water when necessary. Most of the soils are very sandy and dry quickly. RESOLUTION ADOPTING ASSESSMENT WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment for the improvement of Odean Avenue from CSAH 37 to CSAH 39. NOW THEREFORE, BE IT RESOLVED BY THE. CITY COUNCIL OF OTSEGO MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included in hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January, 2002 shall bear interest at the rate of 6 per cent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2001. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certifications of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city clerk, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the city clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. No reservations can be made without a $200.00 non-refundable deposit. Down payment is not refundable unless the hall can be rented for the same date. Full rental fee is due 60 days in advance of the event and is not refundable unless the hall can be rented for the same date. It is the renters responsibility to set up tables and chairs: arrangements may be made with the building supervisor. Clean off tables, do not put away. Clean chairs, pick up containers, but it is not necessary to sweep the floor. All garbage is to be removed from the building and placed in the dumpster located outside in the parking lot. It will be the building supervisor/custodians discretion whether additional clean up is necessary, and if so, the cost of same will be deducted from the damage deposit. If the building or any equipment is damaged, the cost of repair/replacement shall be charged to the renter. Kitchen facilities, dinner plates, cups and silverware are available. The caterer shall provide serving dishes, linens, towels, dish soap, etc. Absolutely no dishes, cups, silverware, chairs, tables, etc., may be removed from the building. If any such items are removed, the cost of same shall be charged to the renter. When liquor is served, a licensed Wright County peace officer must be on duty for the duration, until the premises is vacated. The cost of the peace officer must be paid in advance. Applicant and/or renter is responsible for maintaining order at the function. Applicant/renter shall carry liability and dram shop insurance coverage in amounts acceptable to the City. If alcoholic beverages at the function are provided by a caterer, said caterer must hold a valid license for dispensing alcoholic beverages and shall provide, upon request, proof to the City of dram shop coverage complying with the limits set forth in the Otsego City Ordinances. If the function is a private gathering and alcoholic beverages are served applicant/renter agrees that there shall be no sales, either direct or indirect, at said function. Applicant/renter further agrees that in no case will he sell or furnish alcohol to persons under 21 years of age. The music and serving of liquor is to be stopped by 11:45 PM. The premises is to be vacated in an orderly manner by 1 AM. No adhesive tapes, tacks, or nails are allowed on any walls, ceilings, tables or other painted and/or varnished surfaces. No smoke producing equipment. City does not supply linens. Table decorations are allowed. Balloons are not allowed prior to the day of the day of the. -event. Absolutely no confetti is allowed. Candles may be used if flame is enclosed in a non-combustible chimney. Such chimneys shall be securely attached to the open -flame device in accordance with the 1988 Edition of the Uniform Fire Code. If walls or ceilings are damaged by the placement of decorations a charge shall be deducted from the damage deposit. The City Hall Assembly Room occupant load is 300 people. Use of the Hall prior to the date of rental for setting up, decorating, etc., may be done only by approval of authorized City Staff. Absolutely no alcoholic beverages allowed. Applicant/renter agrees to abide by all of the above terms and conditions. It is specifically understood that upon violation of any of those terms and conditions as set forth above, the City may, at its discretion, terminate this agreement and permit and may at any time terminate the function if the applicant/renter fails to control the actions of those at the function so as to maintain reasonable order or allows the terms and conditions of this agreement to be violated. The applicant/renter agrees to indemnify and hold harmless the City and Owner from any and all claims, demands, costs, damages, losses, actions, causes of action or judgments arising out of use of the premises and all costs and disbursements related to enforcement of this provision, including reasonable attorney's fees. Further, applicant/renter agrees to indemnify and hold harmless the City and Owner from any and all claims, demands, costs, damages, losses, actions, causes of action or judgments arising out of the dispensation of use of alcoholic beverages on the premises and all costs and disbursements related to enforcement of this provision, including reasonable attorney's fees. City sponsored events and governmental elections and caucuses. 2. All others on a first come first served basis. Occasionally, non -city scheduled activities may conflict with events planned by a City program. If a conflict occurs, every effort will be made to find an alternate facility for the non -city group. City of Otsego programs have priority of facility use at all times. "City Premises": as referred to in this document, will include all City owned facilities, buildings, structures, grounds, parking lots, athletic fields, and vehicles. HOW TO APPLY TO USE FACILITIES All use of City facilities before and after the normal work day, on weekends, vacations and holidays, is scheduled through the City Clerk's Office. To make application: 1. Obtain a Facility Use Application by calling the City Hall at 441-4414 or stop by the City Hall, 8899 Nashua Ave NE, Otsego, MN. 2. Your completed Facility Use Application must be received by the City Clerk at least ten business days prior to planned use. 3. Requests for use of City equipment (i.e. audio visual, extra chairs, tables) as well as set up times and needs, must be included on the Application. 4. Upon receipt of a Facility Use Application, the City Clerk will verity space availability and estimate applicable costs. 5. The City Clerk will arrange for custodial services and/or building supervision if use of the facility occurs at a time when custodians are not on duty, additional services are needed, and/or the nature of the activity dictates such staffing. Staffing costs are the responsibility of the user. LIABILITY - City of Otsego assumes no responsibility or liability for damage, loss, or personal injury resulting from non -city use of City facilities. The individual named on the permit and the group in whose name the permit is issued are. jointly responsible for their use of the facility, and will accept responsibility for the payment of rent and/or other charges including any damages. The individual named on the permit and the group in whose name the permit is issued are jointly required to assume full responsibility for personal injury to any participants or spectators. RULES AND GUIDELINES FOR USE Rules and regulations exist to protect the public's investment in Otsego's facilities. The following rules must be observed by all groups using the buildings/grounds. Failure to do so may be cause for cancellation of the Use Permit and/or denial of future use privileges. 1. A permit will not be granted for any facility use application, which, in the judgment of Otsego may be in any way prejudicial to the best interests of the City. The City of Otsego may modify, deny, cancel or revoke any or all facility use applications or permits at any time. If violations occur during the course of any event and are not immediately remedied by the applicant and/or the applicant's agents or representatives, the City's representative at the function may immediately terminate the event and revoke the use permit. 2. All local and state ordinances and laws pertaining to use of public buildings and facilities must be observed. The City also enforces the policies below: - The use of tobacco in City buildings is strictly forbidden at all times. - The possession and/or use of alcohol or controlled substances on City premises is prohibit at all times, except as specifically authorized by permit. - Proof of insurance must be provided prior to the issuance of any use permit. 3. Adequate adult supervision (21 years or older) must be provided by the group during the entire use. The group supervisor(s) will be held responsible for compliance with rules, general behavior and safety. Use is limited to those areas of the building that are specifically approved and includes the nearest drinking fountain and lavatories. 4. A custodian and/or city building supervisor are present for the protection and safety of the building and City. Cooperation with these staff members is essential. 5. Equipment brought in and its manner of use is subject to approval by the City Clerk or the Building Supervisor. 6. The City of Otsego assumes no liability or responsibility for loss or damage to equipment or personal items belonging to the facility user. Applicant shall indemnify and hold harmless both the City and the Owner from any such claims. 7. City equipment may be used if advance arrangements have been made with the City Clerk. Charges for staff time may be assessed, depending on the extent of set- up and/or take-down needed. 8. All groups shall leave the City facility in the same or better condition in which they found it, returning all furniture, equipment, etc. to its original order. Charges for staff time may be assessed, depending on the extent of clean-up needed. 9. If food and/or drink are to be served, this is to be indicated on the Facility Use Application, and will be permitted only in designated areas. 10. All required permits must be secured in advance of any events at which alcoholic beverages are served or present. Prior to any function where alcohol beverages are served applicant must acknowledge that he is aware of possible statutory dram shop liability or common law liability that may arise due to property damage, personal injury, death or other damages resulting from the sale of furnishing of alcoholic beverages. Applicant shall agree, in writing to fully indemnify and hold harmless the City and owner from any such liability and shall provide proof of both general liability and dram shop insurance coverage acceptable to the City. 11. A licensed peace officer is required to be present at all functions where alcoholic beverages are available. At all functions where alcoholic beverages are available and are not sold or furnished by a person or persons holding a valid liquor, beer, or wine license, there shall be no sales, either direct or indirect, of alcoholic beverages at that function. There shall be absolutely no sale or furnishing of any beverages to any person under 21 years of age. 12. "Guidelines For Use of City Kitchens" will be followed in the event of any kitchen use. 13. City facilities may be rented to churches for worship purposes. 14. Groups or individuals approved to use City facilities may not assign, sublet, transfer, or charge a fee for the use of the facilities. 15. Groups or individuals using the facilities may display banners, signs, streamers or any materials of an advertising nature on City premises only during the hours scheduled. These displays/signs may not cause damage to or deface City premises; and must meet all requirements imposed by other governmental agencies. No decorations may be tacked, stapled, or in any way adhered to walls, ceilings, tables or windows except with an all - mounting removable adhesive. A supply is available in the City Clerk's office. 16. No event may extend beyond 10:00 PM unless approved in advance by the City Clerk. CANCELLATIONS OR CHANGES In the event of cancellations or changes in use, the applicant shall notify the City at least 2 business days prior to the scheduled use. The City reserves the right to charge a non-refundable deposit for activities located in the City Hall. RATES FOR FACILITY USE Rental rates will apply to groups and activities as listed in Categories below. All groups using facilities are responsible for staff costs (building supervision, and peace officer). In addition, groups and individuals are responsible for the repair and/or replacement of damage, theft or loss to the premises resulting from their use. STAFFING Groups/individuals using city Facilities are responsible for staff charges resulting from their use. 1. Custodial - could include opening or closing a building, set-up, cleanup or presence during a time when not otherwise staffed. A two hour minimum charge will be assessed if a custodian is called to the building beyond normal work hours. Custodial time is charged at the current hourly rate, including overtime and holiday pay, if applicable. 2. Building Supervision - placed by the City to protect and oversee the facility and represent the City. A two hour minimum will be charged. The 1997 fee for Building Supervision is $10.00 per hour.(Subject to change) CATEGORIES Determination of rental charge for use of City facilities is based on these groupings: GROUP A CITY THESE GROUPS WILL NOT BE CHARGED RENTAL FEES City sponsored events, concerts, board or commission meeting, special hearings and Community Park Board. These groups will not be charged for regular meetings but any other event a staff/supervisor fee will be charged. GROUP B Local tax supported public agencies THESE GROUPS WILL BE CHARGED A MINIMUM OF $25.00 plus any Clean Up Fees (see C below) District 728 (Elk River), 885 (St. Michael -Albertville) 882 (Monticello) Local tax supported public agencies (at least 75% of participates reside in Otsego). Local civic, service and charitable groups (at least 75% of participants reside in Otsego). GROUP C THESE GROUPS WILL BE CHARGED RENTAL FEES UNDER CATEGORY I All groups in B above, when an admission is charged or a donation requested (at least 75% of participants reside in Otsego). Local groups of a religious nature for worship, instruction, or admission or donation events. City residents or groups for private meetings or activities to promote, educate or entertain. GROUP D THESE GROUPS WILL BE CHARGED CATEGORY H RENTAL FEES Individuals, private agencies, companies, vendors, business or special interest groups, and non- profit groups with a regional or statewide clientele, for activities of a commercial, business or revenue generating nature. Non -local (originating outside Otsego) youth, civic, service, charitable and religious groups. Date: August 8, 2001 To: Mayor & Council From: City Administrator Mike Robertson Re: Plan for Snowmobile Use Education & Enforcement As directed, I have prepared a plan for discussion on snowmobile use, focusing on education and enforcement. I have listed all of those items discussed during snowmobile workshops along with suggested times and media sources for each. After discussion with staff there are two areas of concern. 1) Mass Mailings - Mass mailings to everyone in town require a lot of time and we do not have the information to be accurate. The last mass mailing we did was in 1998 for the Comp Plan meetings. That took the entire office staff an entire day to copy, fold stuff, and address over 2,000 envelopes. We have added several hundred households and are much busier since then. In addition, our mailing labels come from Wright County. The County does not guarantee accuracy because they are always months behind when it comes to updating property information. Further, staff is wondering why do this for this issue. Despite the vehemence of all parties on this issue, we actually receive a lot more calls about dogs, road conditions, weeds, burning permits, junk & blight, and other issues than we do regarding snowmobiles. 2) Recruiring snowmobilers to carry a map - It's very easy for someone who doesn't have to administrate it or enforce it to suggest this provision, but we see a lot of problems with it. When 200-300 people come to City Hall and ask someone to draw a route on a map for them, who is going to do it? What other duties are they going to give up while they do it? To say nothing of the fact that since this is a new requirement most people who come to City Hall are going to be angry about it and want to complain, which will make the process of completing the map even longer. As for enforcing it, what if several snowmobilers are meeting at a friend's house, are they in violation of the map requirement if they travel to the friend's house and not straight to the trail? The fact is that enforcing the speed limit on snowmobilers is much easier to do. It's easy for people to understand and easier for the police to enforce. And as most people have noted, if a snowmobile is traveling the speed limit it does not create a noise or traffic problem. snowplan.wps 2 SNOWMOBILE USE EDUCATION & ENFORCEMENT PLAN CITY OF OTSEGO, 2001 EDUCATION Public Meeting City Newsletter (Mailed?) Ads/Ordinance Summary in Star News Trail Maps Training Public Meeting - Schedule a public meeting in early November, inviting all people with snowmobile licenses within the area (obtain list from State?). Note in invitation that compliance with City ordinances is necessary or a ban on snowmobiles may result. Invite Sheriff's Deputy (Joel Mackerath) to meeting to explain fines and enforcement. Publish Ordinance Summary - Publish Ordinance summary in the Star News. Aim for first two weeks in November unless snow is not eminent, then delay until after Thanksgiving. Note in ads that if the ordinance is not followed, pressure for a ban on snowmobiles will grow. City Newsletter - Mail City newsletter with ordinance summary to all postal patrons in town (easier said than done) in an attempt to warn everyone (approximately beginning of November), OR, mail ordinance to residents. This would require obtaining address list from Wright County, (always months behind) and at least 40-45 man hours of folding, stuffing, sealing etc. (beginning of November). Trail Maps - Produce trail maps, have available at City Hall by November 1, 2001. Training - The Snowmobile Club is setting up a training session at City Hall for early December. k ENFORCEMENT Ordinance Update Sheriff's Office Manpower Surplus over Christmas Break? Stress Tickets, Not Warnings Enforce Ditch Barrier Removal County Agreement on Parrish Avenue Ordinance Update - Pass revised ordinance. The revised ordinance is easier to follow and read. Continue to make an effort to make everyone aware of the ordinance. Sheriff's Office - We will ask the Sheriff's office to do the following; 1) Stress tickets, not warnings! 2) Especially target Christmas vacation. 3) Look at obtaining/leasing a patrol snowmobile to be stored at City Hall 4) Target main complaint areas - Parrish/County Road 39/Nashua, etc. Enforce Ditch Barrier Elimination -If we are going to increase enforcement on snowmobiles, we must also increase enforcement on ditch barriers. We will put information on ditch barriers in the same newsletter as the other snowmobile information. The only issue is whether enforcement should be through the Sheriff's office or through City Hall. Countv Agreement on Parrish Avenue (County Road 42) - County Commissioner Pat Sawatzke contacted the County Attorney on our request. Pat said that we will be receiving a written opinion from the County Attorney on what we can do on Parrish Avenue. The opinion is expected to be here by Monday, August 13, 2001. DI
