The variance application is necessary because Section 20- 33-4. B.2.c of the Zoning Ordinance limits the height of a tower to 75 feet. The applicant has done additional research since the CUP and variance applications were submitted and now says that a set of three antennas on the Otsego watertowerwould also meet their service coverage needs. Qwest is expected to submit a letter requesting that the City lease them space on the water tower for their antennas. If that proposal is accepted, a new tower structure does not need to be built. The Zoning Ordinance allows antennas on the water tower with approval of an Administrative Permit. Locating the antennas on the water tower has the advantages of not creating additional structures that may be visually disruptive to residents, of creating revenue for the City through the terms of the lease, and of reducing construction costs for the applicant; therefore, the Zoning Ordinance is intended to encourage the use to the water tower for supporting antenna uses. At this time the City Council has two options for dealing with this situation: The Council may negotiate or accept the terms Qwest offers for leasing the water tower site and allow an administrative permit to be processed. In this case, the applicant will withdraw the applications for CUP and variance for a tower at the school site. 2. ITEM 7.1 March 7, 2001 Mike Robertson, Administrator City of Otsego 8899 Nashua Avenue NE Otsego, MN 55330 Re: Otsego Wastewater Treatment Capacity Issues Dear Mike: As requested, I have reviewed the entire existing sewer serviced properties and all final platted lots. I have also reviewed all of the areas that are either preliminary platted or in sketch plan phase. This was completed to better understand where the city stands in regards to the number of sanitary sewer services available. Currently, the city has a wastewater treatment plant capable of handling 200,000 gpd, of this 200,000 gpd; Otsego has allocated 40,000 gpd of the capacity to the City of Dayton. This leaves 160,000 gpd or 640 residential equivalent connections (RFC's). The City of Otsego has either final platted or connected sewer service to a total of 644.6 REC's (see table 1). Although the total REC's is slightly greater than the Wastewater Treatment Plants capacity, this should not pose a problem because a majority of the 644.6 REC's are not live. The City of Otsego Wastewater Treatment Plant has a permit to discharge up to 400,000 gpd and the City has approved the go ahead on constructing the expansion of the Wastewater Treatment Plant. This means, in less than 2 years the city should have the capacity of 360,000 gpd or 1440 REC's. The city has approved several preliminary plats and/or is planning to assess property for sanitary sewer service. These properties total 726 REC's (see table 2). Combining this with the 644.6 REC's from Table 1, gives a total of 1370.6 REC's. These are Otsego's Waterfront and Pheasant's Ridge 5th Addition. These have been approximated at 295 RFC's (see table 3). The city has expressed an interest in reserving 30% of the initial 200,000 gpd plant (60,000 gpd) for commercial/industrial use. This is equivalent to 240 REC's. Currently the city has used 16.6 RFC's for commercial/industrial or roughly 2.5% of the reserve. An additional 123 REC's of commercial/industrial have been preliminary platted or property assessed for sewer service. Sketch plans of an estimated 184 REC's have also been received by the city. This would bring the total REC's of probable commercial/industrial to 323.6 REC's. The East portion of the Otsego Waterfront project may be many years away. Subtracting this from the total commercial/industrial REC's leave 227.6 REC's. This is very close to the city's sewer capacity reserved for industrial/commercial. If the city would like to reserve sewer service for proposed industrial/commercial, we suggest the residential properties should not exceed a total of 1210 REC's. In conclusion, we are quickly approaching the maximum number of final plats the city can approve and additional preliminary plat applications should be informed of the imminent ceiling on final plat approvals for serviced lots. Based upon the information in Ron Wagner's letter of February 17, 2001, we believe thore are two options to be considered. The main distinction between the two options is whether the present 200,000 gpd capacity or planned 400,000 gpd capacity is used to determ ne the cap_ According to Table 1 of Mr. Wagner's letter, the City has already final platted all of ;he available capacity for the 200,000 gpd waste water treatment plant. These developments have signed development contracts and paid the applicable SAC/WAC fees reserving sanitary sewer capacity in accordance with the City's Comprehensive Plan. If the City Council chooses to base the ceiling for residential sewer allocations on the 200000 gpd capacity of the waste water treatment plant, it has already been exceeded. Therefore, the City would have to stop approving applications for residential preliminary and final Dat applications until such time as the planned waste water treatment plant expansion was complete. The other option is to assume that the waste water treatment plant will be expanded to 400,000 gpd and base the residential REC ceiling on that number. With expansion of the waste water treatment plant to 400,000 gpd, as many as 1210 RECs may be available For residential development The timing of the expanded wastewater treatment plant capacity being on-line is a critical issue for this option to ensure that service is available to all fi,-Ial platted developments. Wagner's letter, the City has preliminary plats or concept approval for commercial c:,nd industrial development in excess of the initial reserve. Because of the econor lic importance of commercial and industrial development, the City may want to consi,.ier reserving additional capacity within the 400,000 gpd waste water treatment plant for thicse uses. The potential allocation of additional sanitary sewer capacity to Dayton or for commercial and industrial uses would reduce the ceiling for additional residential REG:s. Therefore, in order to establish a ceiling for residential sewer capacity of a 400,000 gpd. waste water treatment plant, it may be necessary to resolve these two outstanding issu :s. If the City Council elects to use a 400,000 gpd waste water treatment plant as the basis for available capacity and the issues of service allocated to Dayton end commercial/industrial development are resolved, there may be opportunities for additio+-1al residential final plats. Additional residential preliminary plats may also be allowad provided that the City continue its policy of only allocating plant capacity to approved tial plats with executed development contracts. It should also be noted that there is a policy within the Comprehensive Plan that final plats are only to be approved for developmeints that are likely to occur within two years. One reason for this policy is to ensure that E,ie development improvements occur in a timely manner because of the potential impact:: to surrounding parcels. II. PROJECT LOCATION The roadway portion of the project is located within Sections 20, 21, and 22, Township 121 N, Range 23W, in Otsego, Minnesota. The project area and roadway location is depicted on Exhibit A at the back of this report. lll. ROADWAY IMPROVEMENT PROJECT A. Existing Conditions The project consists of improving 85th Street from Page Avenue to approximately 650 feet east of Odean Avenue, then from approximately 500 feet west of Odean Avenue to approximately 700 feet east of Nashua Avenue. The project termini are the extents of previous MSA projects which improved 85th Street to MSA Standards. 85th Street is a 24 foot wide paved rural design street with ditch sections and culverts to provide drainage. The existing shoulders consist of 0.5' to 2' of topsoil in some areas, and are non-existent in others. Odean Avenue traverses 85th Street, separating it into east and west segments. The west segment is located between Nashua Avenue and Odean Avenue and is designated as MSA route 217-102-015. The east segment is located between Page Avenue and Odean Avenue and designated as MSA route 217-102-020. The west segment is approximately 4,410 lineal feet. The east segment is approximately 3,655 lineal feet. Both segments of roadway have exhibited signs of pavement distress in recent years. The western segment has required patching in recent years to replace areas of severe alligator cracking. The alligator cracking is caused by structural failure of the roadway section, and may be attributable to the poor subgrade materials. Page 1 \\Ha01\Shared Docs\Municipal\AOTSEGO\332\OT332RevisedFEAS.doc The soils in the project area appear to vary from fine sands, to sandy foams, to loams. Inclusions of silty clay foams were noted in the section of 85th Street between Nashua Avenue and Odean Avenue and at the intersection of Odean Avenue and 85`h Street. The subgrade soils are thought to be generally unsuitable for roadway construction. Test borings must be performed during the design phase of the project to determine the exact subsoil characteristics. The National Wetland Inventory (NWI) Maps indicate that some of the low areas within the existing right-of-way may be Wetland Conservation Act of 1991 (WCA) wetlands. These areas may require special attention during the project design phase. The wetland areas must be delineated and work must be performed within the guidelines of the WCA. The existing ROW is 66 feet along the length of the roadway. There are no known drainage and utility easements located adjacent to the ROW. The roadway profile exhibits sharp vertical curves, reducing site distances in some areas. Site distance is also limited at several roadway intersections along the project length due to horizontal obstructions, primarily tree growth. The average daily traffic along the roadway is expected to increase in the near future due to proposed development work. An executive style golf course has recently opened in the NW '/4 of the SE '/4 of Section 20. Heritage Hills is continuing to add homes in the NW '/4 of the SW '/4 of Section 21. Crimson Ponds will add an access onto 85`h Street. All of these developments, when completed, will cause an increase in traffic to 85th Street, and may burden the capacity of the roadway as it exists. 85`h Street at the intersection of Odean Avenue, has been improved to MSA standards and will reduce the cost for 85`h Street improvements and lessen the amount of traffic disruption the reconstruction of 85`h Street will cause. Also, major trunk stormwater improvements have been completed reducing 85`h Street costs. These improvements include the regional pond in Heritage Hills, the regional pond on Wilson-Berge's property south of Hall's Pond, and storm sewer with the capacity to handle the runoff from ultimate development of the Hall's Pond watershed. B. Proposed Improvements The project involves constructing the roadway to Municipal State Aid (MSA) Standards. 85th Street is proposed to be a 44 foot wide urban design section with concrete curb and gutter. A 10' bike -path on the south side of the road is included in the proposed typical section. Page 2 \\Ha01\Shared Docs\MurncipalWOTSEGO\332\OT332RevisedFEAS.doc The typical design section will consist of a minimum 4'/2" bituminous surface over a minimum of 7" of Class 5 aggregate base course (identical to Odean Avenue). A 2' layer of clean sand will be placed below the aggregate base to provide structural support where subgrade soils are determined to be inadequate for roadway construction. Exhibit B depicts a typical MSA urban design section with bike path. Right-of-way purchase will be required to expand the ROW from 66' to 80'. Slope easements and temporary construction easements will be required to allow for roadway construction. The extents of the ROW and easements required will be determined during the preliminary design phase of the project. ROW acquisition will occur during the final design phase of the project. ROW acquisition must be initiated soon to insure that construction can begin in 2001. C. Estimated Costs Costs for street construction were analyzed for each segment of the proposed 85th Street. Financing and Assessments MSA Account The portion of 85th Street studied is currently on the City of Otsego's MSA system. The MSA segment designations are 217-102-015 (Odean Avenue to Nashua Avenue) and 217-102-020 (Page Avenue to Odean Avenue). The roadway qualifies for MSA funding for construction, ROW acquisition, and engineering services. The City receives MSA allotments annually, 25% of which is allocated for maintenance. The remaining 75% is designated for construction. The 2001 MSA construction allotment was approximately $240,000. MSA allotments are determined based upon population and roadway mileage within the City. The estimated allotment for MSA construction funds in the near future (2 years) is estimated to remain the same. The lesser of three years allotment or $750,000 can be advanced to Municipalities for construction projects. The maximum the City of Otsego could advance is $720,000. This is approximately 3 years of construction funds. As a result of this advance, the City would not receive future construction allotments until the advancements are paid back (approximately 2004). The advance in funds would not affect the maintenance allotment. 2. Assessment Policy The City of Otsego's Assessment Ordinance sets guidelines for determining assessment amounts for properties which abut MSA designated and eligible streets. The ordinance indicates that abutting properties shall be assessed for the costs of a typical street and any additional costs shall be paid for by the City. The typical roadway section would consist of a 33 foot wide roadway with concrete curb and 5' wide boulevards. Projected Roadway Assessments Potential roadway assessments were determined based upon property access to 85th Street. Table IV, V, and VI were generated based upon front footage from half -section maps and costs described in Table IV. The benefiting properties for the roadway construction portion of the project are depicted on Exhibit A. Based upon a front foot cost of $27.89 and a total assessable front footage of 6909 the total potential revenue from street assessments was determined to be $192,692.01 (see Table IV). Table V depicts the proposed assessments for constructing 85th Street from 700' east of Nashua to 1/8 mile west of Odean Avenue & Table VI shows the proposed assessments for construction of 85th Street form 1/8 mile east of Odean Avenue to Page Avenue. Looking back at similar and recent roadway projects that were assessed, the city has lowered the assessment depending upon the situation or the classification of the road. In Odean Avenue's case the actual assessment was approximately 50% of that determined using the assessment policy. The City council's reason for the reduction was because of Odean Avenue's status as a major collector street. 85th Street has a road designation as a minor collector. STORM SEWER IMPROVEMENT PROJECT The proposed roadway improvements will occur primarily in the Hall's Pond Watershed area. The long range watershed improvements must be considered for the design of the 85th Street improvements. The 85th Street storm sewer will serve as a facility to convey stormwater from the Hall's Watershed to the Hall's Pond area. Exhibit C depicts the Hall's Pond Watershed. We estimate that the trunk and lateral storm sewer for the west portion of the project would be MSA funded at 55% and the east portion of the project would be MSA funded at 100%. MSA funding of storm sewer is determined by the percentage of land being drained from road right of way versus the amount of total land being drained through the proposed storm sewers. V. PROJECTED FUNDING BALANCE The existing Otsego MSA funds available for road construction are assumed to be encumbered due to pending right-of-way on Odean Avenue and 78t�' Street. PROJECT SCHEDULE The schedule for this project will be effected by the date the Council holds a public hearing and orders the preparation of Plans and Specifications. A project schedule will be prepared for the public hearing by our office. VII. CONCLUSIONS AND RECOMMENDATIONS This report analyzed the feasibility of reconstructing 85th Street from Page Avenue to Nashua Avenue to meet Municipal State Aid (MSA) Standards. Stormwater drainage within the Hall's Pond watershed was also reviewed. A portion of the 85th Street storm sewer will serve as a trunk facility for that watershed. The improvement is technically feasible as described in this report. The storm sewer system improvements to be made in conjunction with this project include oversizing the 85th Street storm sewer to serve as a trunk facility The storm sewer improvements would be best made in conjunction with the 85th Street reconstruction project. Reconstruction of 85th Street is necessary due to the recent structural deterioration of the existing pavement section. Potential development in the area may tax the capacity of the existing roadway, which makes the improvement desirable. The project would be funded by assessments and by MSA funding. The project appears to be cost-effective if an advancement of MSA construction funds is obtained by the City. The estimated MSA funds available are less than estimate construction cost. The MSA funds available were estimated and may exceed the amount listed. We recommend that this study be forwarded to an appraiser for review of the assessment amounts recommended in this report. The appraiser should determine if the proposed assessment amounts are equivalent to or less than the benefit of the improvement. Below is a list of possibilities. ASSESSMENTS I agree with the City Engineer's recommendation that the entire cost of the improvement cannot be assessed to the landowners on 85th Street. I would also agree with the Mayor's statement that the assessment for 85th Street should be very similar to the assessment for Odean Avenue, which I expect to be in the neighborhood of $3000 a unit. Assessments do not provide upfront financing. The money for that must be obtained from some other source. The assessments assist in paying back or reimbursing another source(s) of funds. MSA FUNDS Minnesota State Aid (MSA) is money that the State gives local governments to maintain a road system which serves the entire state. The City receives approximately $240,000 a year for construction of its MSA roads. The City had allowed its MSA money to accumulate for a few years, but all of its MSA money was spent in the last two years on the Odean Avenue, 78th Street, and Quaday Avenue road improvement projects. At this point the City has no MSA money available. As City Engineer Koshak described in a recent workshop, the State will allow the City to borrow ahead for three years worth of MSA road construction money. This would be worth approximately $720,000 to Otsego. The money
