04-09-01 CCCITY OF OTSEGO CITY COUNCIL MEETING APRIL 9, 2001 COUNCIL CHAMBERS OTSEGO CITY HALL 6:30 PM 1. Mayor Larry Fournier will call the meeting to order. Mayor Larry Fournier called the meeting to order at 6:40 PM. Roll Call: Mayor Larry Fournier; Councilmembers: Suzanne Ackerman, Vern Heidner, Jerry Struthers, Virginia Wendel. Staff. Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Adm. Andrew MacArthur, City Attorney; Dan Licht, City Planner, Gary Groen, City Accountant. Absent: City Engineer. Pledge of Allegiance: Mayor Fournier led in the Pledge of Allegiance. 2. Consider agenda approval. Mayor Fournier requested to move Item 9. LE. to Item 6.4., add 9.1.E. Discussion of City Hall Keys, Item 9. LF. State Representative Bruce Anderson's Letter and Item 9.1.G. Otsego Wastewater Report. CM Wendel motioned to approve the agenda as amended. Seconded by CM Struthers. All in favor. Motion carried. 3. Consider the following minutes: A. Citv Council Meetine Minutes of March 26, 2001. CM Ackerman motioned to accept the minutes as presented. Seconded by CM Wendel. All in favor. Motion carried. 4. Open Forum: 4.1. Open Forum No one appeared on Open Forum. 4.2. Special presentations. A. City Accountant Gary Groen, discussion of Preliminary 2000 Financial fi ug res. Mr. Groen went over Mike Robertson's April 4d'2001 Memo giving a preliminary report on the final 2000 budget figures. B. Discussion of traffic safety for the Asleson property. Merrili Asleson, property owner and her father, Robert Wolf were present. Mr. Wolf stated they feel the perception of Merrili's property that it is unsafe and is unfair and would like the Council to re-evaluate this request. According to Mr. Benshoof of Benshoof and Associates, traffic engineers, they measured all the site distances and found them satisfactory and the accident rate there is low with only two accidents in the last 5 years. City Council Meeting of April 9, 2001. Page 2. Andy MacArthur, City Attorney, stated the decision made by the City Council was made on a specific proposal only. Dan Licht said the Findings of Fact adopted related to the proposed use based on engineering recommendation. The City Engineer did recommend changes to make this feasible at that site. Mike Robertson stated it was a resident and not the City Council that made the remarks in the newspaper. Mr. Wolf said he would talk to the newspaper. C Elk River Arts Area Council Representative will be attending to ask the Council to consider a Grant Request. Dave Bodart and Sharon Tracy, representing the Elk River Arts Area Council, asked for $1,000 donation. Mayor Fournier would like to review this request at a budget workshop for Year 2002. 5. Consent A enda. 5.1. Approve Claims. CM Wendel motioned to accept Consent Agenda. Seconded by CM Ackerman. All in favor. Motion carried. 6. Dan Licht, City Planner: 6.1. Application for Todd Vetsch and Kristy - -r on behalf of owners James F and Judith Vetsch, PID 118-800-243200. A. Rezone from A-1 to A-2. Dan presented the Planner's Report. CM Heidner motioned to rezone Property 118-800-243200 from A-1 to A-2. Seconded by CM Ackerman. All in favor. Motion carried. . 6.2. Final Plat for Stone2ate II Addition. Dan Licht presented the Planner's Report. He noted that there are 104 units rather than the 92 the report states. CM Heidner motioned to approve the Final Plat of Stonegate Estate 2"d addition, subject to the four conditions listed in the Findings of Fact. Seconded by CM Struthers. All in favor. Motion carried. 6.3. Pheasant Ridge 5h Addition. Dan Licht stated the applicant called him and Judy Hudson and requested to table their request as they are thinking of revising their proposal within the next couple of weeks. 6.4. Central MN Housing Partnership, Inc. Since the Comprehensive Plan was just redone, Staff and Council feel this has been addressed. 7. Larry Koshak, City Engineer: 7.1. Consider quotes for Well #1 work. Mike Robertson went over Larry Koshak's quotes. City Council Meeting of April 9, 2001. Page 3. Mayor Fournier motioned to accept Larry Koshak's recommendation to award the quote to E. H. Renner & Sons for $4,750, including cleaning the filter out and the restrictor plate. Seconded by CM Heidner. All in favor. Motion carried. 8 Andrew MacArthur, City Attorney: 8.1. Proposed Joint Powers Agreement for Community Recreation. Mr. MacArthur went over his proposed changes. The Council agreed with his changes and added one more change, add the word sent to Change #7, Page 3, No. 7 "written notice sent to the". Mr. MacArthur will send the Agreement to Community Recreation. 9. Council Items: A Consider Commission Appointments. CM Heidner motioned to appoint David Thompson to the alternate position on the Planning Commission. Seconded by CM Struthers. All in favor. Motion carried. Mayor Fournier motioned to appoint Sharon Carter to the Heritage Preservation Commission. Seconded by CM Struthers. All in favor. Motion carried. Mayor Fournier motioned to appoint Pauline Nelson, Terry Long and Jim Gaikowski to the Parks Commission. Seconded by CM Ackerman. All in favor. Motion carried. CM Heidner motioned to appoint Jon Zack to the EDAAC. Seconded by CM Struthers. All in favor. Motion carried. 9.1. Mike Robertson City Administrator: A 2000 and 2001 Population Estimates. Mike went over the estimates as outlined in his attached memo. B Consider purchase of a snow blower. CM Heidner requested information on the City's liability of keeping the bike trails cleaned and where can the City blow the snow since you can't put it on private property. C Consider purchase of forfeited land. CM Heidner motioned to adopt Resolution No. 2001-12 purchasing Tax Forfeited Land for a Public Purpose Use as a Stormwater Holding Area described as property PID 118-037-005040, Lot 4, Block 5, Walesch Estates 2"a Addition. Seconded by CM Ackerman. All in favor. Motion carried. D Consider Otsego View Editor. CM Heidner motioned to appoint Jacquie Rognlie as the Otsego View Editor. Seconded by CM Ackerman. All in favor. Motion carried. E Discussion of City Hall Keys. Mayor Fournier and others have had trouble with the new keys. Staff will look into this. F Bruce Anderson's letter of April 2, 2001 Mike went over the letter since he had written to Representative Anderson opposing changing local elections to off election years.
