Please be advised that the Planning Commission held a public hearing on the above
referenced application on April 16, 2001, which was continued to May 7, 2001 to allow for
proper notice to be made and for the applicant to correct technical issues with the plat
design.
Several property owners surrounding the proposed plat spoke at the public hearing. Most
were supportive of the changes in overall density made to the plat from the original
concept plans. Concerns raised by these persons included storm water capacity in the
northeast comer of the parcel, the range in lot sizes and potential extension of 87"' Street.
The City Engineer will need to provide additional information on the storm water issue,
otherwise the issues were satisfactorily addressed.
The Planning Commission discussion focused on the elimination of the common septic
system that was part of the previous concept plans. Several Planning Commissioners
stated that they would not support the project including individual septic systems were it
not for the regional storm water improvements being provided by the applicant. The
Planning Commission also discussed the access issue, recommending that the proposed
easement be widened to a width determined by the City Engineer to provide adequate
access and maintenance area.
After closing the public hearing, the Planning Commission voted in separate motions to
recommend approval of a Comprehensive Plan amendment, rezoning and PUD-
CUP/preliminary plat by 6-0 votes. Resolutions and findings supporting the Planning
Commission's recommendations are attached for consideration at the May 14, 2001' City
Council meeting at 6:30 PM.

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
A RESOLUTION AMENDING THE COMPREHENSIVE PLAN TO INCLUDE THE ENTIRE
PARCEL DESCRIBED BY ATTACHED EXHIBIT A WITHIN THE LONG RANGE URBAN
SERVICE AREA AND DESIGNATE IT FOR FUTURE LOW DENSITY RESIDENTIAL
USE.
WHEREAS, the parcel legally describe by attached Exhibit A is within the Urban
Service Area Reserve established by the 1998 Comprehensive Plan Update; and,
WHEREAS, the City has received a request from S&Z Investments and Bulow
Incorporate for approval of a PUD -CUP and preliminary plat for development property with
43 single family residential uses; and
WHEREAS, the developer has requested a Comprehensive Plan amendment to
expand the Long Range Urban Service Area to include the entire parcel described by
Exhibit A; and,
WHEREAS, the 1998 Comprehensive Plan Update outlines polices for further
development that must be satisfied for the Planning Commission and City Council to allow
for additional development within the Long Range Urban Service Area, which may also be
applicable in evaluating the present request:
Unsewered residential development within the long range urban service area shall
be allowed when the City determines that such development will result in at least
one of the following:
a. Completion of an unfinished street network.
Finding: The project as presented does not provide for extension of any
local street network, although a future connection to 8r Street may be
possible.
b. Such development shall have the result of the correction or improvement of
a demonstrated area drainage problem.
Finding: A drainage problem exists during high rainfall seasons where the
lake on the subject property overflows and floods existing residential areas
to the east. As part of this project, the applicant is proposing to correct this
issue by paying for and installing storm water drainage facilities on the
subject property and Nashua Avenue.
C. The dedication of lands to a legitimate public purpose (i.e., desired parks,
public facility structures, right-of-way dedication, etc.).
The project provides for the dedication of necessary storm water drainage
facilities.
WHEREAS, the Otsego Planning Commission conducted a public hearing, at their
regular meeting on 7 May 2001, to consider the request, preceded by published notice
and, upon review of the application and evidence received closed the public hearing and
recommended by a 6-0 vote that the City Council approve the amendment of the 1998
Comprehensive Plan Update to include the entire parcel described by Exhibit A within the
Long Range Urban Service Area and guide it for future low density residential use, based
upon a finding that the amendment is consistent criteria established by the Comprehensive
Plan.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OTSEGO THAT; the request to amend the 1998 Comprehensive Plan Update to include
the entire parcel described by Exhibit A within the Long Range Urban Service Area and
guide it for future low density residential use is hereby APPROVED.

& Decision
Applicant: S & Z Investments and Bulow Incorporated
Request: Consideration of a Zoning Map amendment to rezone property located northeast of
Nashua Avenue and 85th Street from A-1 District to R-3 District to allow development of single
family uses as part of the Meadowlands Preliminary Plat.
City Council Meeting Date: 14 May 2001
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact.-
The
act:
The legal description of the property is described by attached Exhibit A.
2. The 99 acre property lies within the Long Range Urban Service Area and is guided for low
density residential land uses by the 1998 Comprehensive Plan Update, as amended.
3. The property is zoned A-1, Agricultural Rural Service District; The applicant is requesting
the property be rezoned to R-3, Residential Long Range Urban Service Area to allow for
development of the preliminary plat entitled "Meadowlands"; Single family uses are
permitted uses of the R-3 District.
4. The Department of Natural Resources has designated a natural environment lake within
the subject property. As such, portions of the property are also within the Shoreland
Overlay District.
5. The Planning Commission and City Council must take into consideration the possible
effects of the Zoning Map amendment with theirjudgement based upon (but not limited to)
the criteria outlined in Section 20-3-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The proposed Zoning Ordinance amendment is found to be consistent with
the following policies of the Comprehensive Plan.

The development of suburban single family lots on the subject site would be
compatible with these existing and planned uses.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: The proposed project will be required to conform to all applicable
requirements of the City's Zoning and Subdivision Ordinances.
D. The proposed use's effect upon the area in which it is proposed.
Finding: The proposed development may have a positive effect on the area by

8. The Otsego Planning Commission conducted a public hearing at their regular meeting on
16 April 2001 to consider the application, preceded by published and mailed notice, which

Otsego Planning Commission closed the public hearing and recommended by a 6-0 vote
that the City Council approve the Zoning Map amendment based on the aforementioned
findings.

Request: Consideration of a PUD -CUP and preliminary plat entitled uMeadowlands" for
development of 43 single family and one outlot on a 99 acre property located northeast of Nashua
Avenue and 85' Street.
City Council Meeting Date: 14 May 2001
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
1. The legal description of the property is attached as Exhibit A.
2. The 99 acre property lies within the Long Range Urban Service Area and is guided for low
density residential land uses by the 1998 Comprehensive Plan Update, as amended.
3. The property is zoned R-3, Residential Long Range Urban Service Area District; Single
family residential uses are permitted uses of the R-3 District.
4. The Department of Natural Resources has designated a natural environment lake within
the subject property. As such, portions of the property are also within the Shoreland
Overlay District.
5. The Planning Commission and City Council must take into consideration the possible
effects of the PUD -CUP with their judgement based upon (but not limited to) the criteria
outlined in Section 20-4-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The proposed Zoning Ordinance amendment is found to be consistent with
the following policies of the Comprehensive Plan:
Unsewered residential development within the long range urban service area
shall be allowed when the City determines that such development will result
in at least one of the following.-

a. Completion of an unfinished street network.
The project as presented does not provide for extension of any local
street network, although a future connection to 8r Street may be
possible.
b. Such development shall have the result of the correction or
improvement of a demonstrated area drainage problem.
A drainage problem exists during high rainfall seasons where the lake
on the subject property overflows and floods existing residential areas
to the east. As part of this project, the applicant is proposing to correct
this issue by paying for and installing storm water drainage facilities
on the subject property and Nashua Avenue.
C. The dedication of lands to a legitimate public purpose (i.e., desired
parks, public facility structures, right-of-way dedication, etc.).
The project provides for the dedication of necessary storm water
drainage facilities.
B. The proposed use's compatibility with present and future land uses of the area.
Finding: The subject property is surrounded to the east and northeast to by one
acre, non-sewered development, which are in the Long Range Urban Service Area.
Properties to the north and south are designated for continued agriculturaUrural land
uses as part of the Urban Service Area Reserve. City Hall is west of the subject site.
The development of suburban single family lots on the subject site would be
compatible with these existing and planned uses.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: The proposed project will be required to conform to all applicable
requirements of the City's Zoning and Subdivision Ordinances.
D. The proposed use's effect upon the area in which it is proposed.
Finding: The proposed development may have a positive effect on the area by
correcting the existing drainage problems. Potential negative impacts to the area

The developer install storm water improvements shown on the submitted plans to correct
area drainage problems, as approved by the City Engineer.
2. The design and construction of all streets is subject to review and approval of the City
Engineer.
3. Secondary access to the subdivision is provided as determined by the City Council with
recommendations from the Planning Commission and approval of the City Engineer.
4. Notation is made on the deeds to Lots 8-10, Block 2 that no provision for resubdivision of
the lot has been made if sanitary sewer and water services are made available.
5. Side yard setbacks for the principal buildings shall be ten (10) feet
6. Documentation of a cemetery site on the property is subject to further review and comment
regarding significance by the Historic Preservation Commission.
7. Easements are provided over the lake, no -mow zone and 150 foot shoreland impact area
and all easements are subject to review and approval of the City Engineer.
8. All grading, drainage and utility plans are subject to review and approval of the City
Engineer.
9. Park and trail dedication shall be subject to review and approval of the City Council.
10. Application for final plat approval shall be made within 100 days and approval of the final
plat shall require execution of a development contract.

MN Fine Rules state that any fire access must be a 20' all weather road. This will be

access for the public safety of the proposed plat. An option to this would be to
construct the 87THStreet connection (southeast corner) to Vasseur's Oak Grove

have a skimmer structure. The water quality ponds and skimmer structures must
meet the standards in the Otsego Engineering Manual. Design calculation showing
how the pond sizes were obtained is required.

3. The peak flow & runoff volume should be checked for both impervious area only &
the weighted curve number for each drainage basin. in many instances with large
lots, the peak flow & runoff volume is larger using only the impervious area and curve
number. The larger runoff volume/peak flow must be used in the storm water design.

EXECUTIVE SUMMARY
Background
Ulmer Construction, Inc. has submitted an application for final plat approval of Prairie
Creek 5th Addition consisting of 35 single family lots. The subject parcel is currently
platted as Outlot A of Prairie Creek 3`d Addition and is zoned R-4, Residential Urban Single
Family District. The proposed final plat would represent the final phase of single family
lots within the Prairie Creek Subdivision.

ANALYSIS
Preliminary Plat Consistency. The proposed final plat is generally consistent with the
approved preliminary plat for Prairie Creek. There have been minor adjustments to the
various lot lines as illustrated on the preliminary plat, which do not significantly alter the
character of the plat or conformance with applicable development regulations. The
changes do result in one additional lot. All of the lots conform to the minimum R-4 District
lot area and width requirements, so the additional lot does not cause any concern.
Park/Trail Dedication. No park land is to be dedicated as part of this phase of the final
plat. A trail corridor is provided between Blocks 1 and 2 to provide access to Otsego
Elementary. In satisfaction of park dedication requirements, the applicant must pay$1,075
per lot cash fee in lieu of land or $37,625.
Sewer Capacity. The proposed final plat is to be served by municipal sanitary sewer and
water services. This parcel was specifically exempted from the subdivision moratorium
currently in place based upon available capacity to service existing preliminary plats.
Construction Plans. The applicant has previously submitted construction plans for
Prairie Creek 5th Addition along with grading and drainage plans. Said plans are subject
to review and approval of the City Engineer.
Development Contract. With approval of the final plat, the applicant is to enter into a
development contract with the City. At the time the development contract is executed, all
required securities and fees must be paid. The development contract is subject to review
and approval of the City Attorney.
CONCLUSION AND RECOMMENDATION
The proposed final plat of Prairie Creek 3rd Addition is generally consistent with the
approved preliminary plat and provisions of the City's Zoning and Subdivision regulations
and the Comprehensive Plan. As such, our office recommends approval of the application
subject to the following conditions:
The applicant pay appropriate cash fees in lieu of land in satisfaction of park and

The Parks and Recreation Commission reviewed the proposed park dedication of land and
trails for the Hidden Creek Trails project at their meeting on May 9, 2001
Trails. The developer stated that they now wish to keep the trails private in order
to maintain the 10 foot design width and ensure permanent access to the trails by
residents of the subdivision for horseback riding. The Parks and Recreation
Commission agreed to keep the trails private on a 4-0 vote based upon
compatibility issues, the trails not providing a destination and the trails not being a
necessary element for Prairie Park.
Outlot A. The Parks and Recreation Commission voted 4-0 to accept the 7.08 acre
outlot as partial satisfaction of park dedication requirements. The Commissioners
believed that adding this area to Prairie Park would add a potential destination to
the area around Otsego Creek and offset the detachment of wetlands from the
balance of the park caused by the extension of 90th Street.
90"' Street. The Parks and Recreation Commission also discussed the effects of
the proposed extension of 90'hStreet to Prairie Park. The conclusion was that the
street would allow greater access to the active portions of the park developed on
the eastern two-thirds of the parcel. However, the street extension could also be
viewed as detrimental to the western portions that are maintained as restored
prairie. The Commissioners noted that the desired access could be provided from
a private driveway and that a street was not necessarily critical for development of
the park. Overall, they believed that obtaining access via this street would be
positive and voted 4-0 to support the project.
Again, the extension of 900' Street is required so that the project conform with the
Comprehensive Plan for allowing four units per forty acre density on the back
parcels currently without street frontage. The developer had suggested as part of
the Parks and Recreation Commission discussion that an alternative loop street
could be provided on their property. We would view such a street as problematic
given the location of the designated lake on the property and access spacing
requirements to CSAH 39. Such a street would also absorb more land within the
project for rights-of-way and there would likely not be significant cost savings as the
length of the parcel north to south is greater than the distance from the property to
Nashua Avenue. Construction of 90th Street is a better alternative for the project,
with the added benefit to the City's park facilities.

At their meeting on May 7, 2001, the Planning Commission discussed the issue of
continued townhouse development within Otsego. A story in the Star News about Elk
River establishing a moratorium on additional townhouse development raised the question
among the members as to whether Otsego has had enough of this type of land use in
terms of providing a balanced housing supply. This issue had been raised initially during
their discussion of Pheasant Ridge 5th Addition. At that time, staff provided information
that the total number of townhouse units preliminary plated represented 50 percent of the
total units preliminary platted within the sanitary sewer district and 25 percent of the total
housing stock at full build out.
The Planning Commission discussed factors that have influenced the level of townhouse
development in the community to date including changing population, location and access
to utilities and the variety of townhouse styles. The main concern of the Planning
Commission was for the long term marketability of these units for the numbers being
developed within the area and maintenance given their transient nature.
Staff noted that all of the available sanitary sewer capacity for residential uses has been
allocated for both the first and second phase of the waste water treatment plant and that
no new preliminary plats are likely to be accepted. Staff also noted that townhouse units
often provide the most property tax "bang for the buck" because their higher densities
offset slightly lower unit costs and private streets reduce City expenses. Long term
maintenance issues can be addressed by adoption and implementation of housing
maintenance codes to address blight problems if they occur.
Following their discussion, the Planning Commission adopted a motion to recommend to
the City Council and staff that there is an adequate supply of townhouse units within the
City and that additional townhouse development should be discouraged within the
immediate future in consideration of the Comprehensive Plan policy to maintain a balance
in the availability of quality housing choices throughout the City, existing townhouse units
preliminary platted and available sanitary sewer service capacities. This motion was
adopted by a 6-0 vote.
The City Council should vote either to accept or decline the Planning Commission's
recommendation. If the Council supports the recommendation, City Staff can use this
information in responding to development questions and inquiries in advance of formal
applications. Should a townhouse project proceed to an application, the interim land use
plan maintaining A-1 District zoning and Comprehensive Plan policies would provide
adequate support to deny the necessary rezoning application. The advantage is that City
Staff can provide the City's present policy position upfront to a developer, saving them time
and expenses in preparing an application.
It should also be noted that such a policy statement is not necessarily binding. The City
could evaluate and approve specific development proposals that in some measure
provided additional balance to the housing stock. Specific examples would be senior
housing projects or higher density uses such as apartment buildings.

A RESOLUTION ESTABLISHING A POLICY ON ADDITIONAL TOWNHOUSE UNIT
DEVELOPMENT WITHIN THE CITY TO MAINTAIN A BALANCE IN THE SUPPLY OF
HOUSING CHOICES.
WHEREAS, the City adopted a Comprehensive Plan in 1998 guiding areas for
development of medium-high density residential uses; and,
WHEREAS, since adoption of the Comprehensive Plan, the City has preliminary or
final platted 664 townhouse units within the sanitary sewer service district ; and
WHEREAS, City staff estimates that the number of townhouse units preliminary or
final platted within the sanitary sewer service district represents fifty (50) percent of the
total units preliminary or final platted within the sanitary sewer service district and twenty
five (25) percent of the total housing units within the City; and,
WHEREAS, the Comprehensive Plan includes the following policy:
A balance in the supply of quality housing choices throughout the City
shall be maintained. (Policy Plan, p. 46)
WHEREAS, the Otsego Planning Commission discussed the issue of housing
choice within the City at their meeting on May 7, 2001, expressing concern regarding the
number of townhouse units within the City relative to other housing choices and issues of
long term marketability and maintenance.
WHEREAS, based upon the number of townhouse units presently preliminary or
final platted relative to other housing choices, available sanitary sewer capacity and
available locations, the Planning Commission voted 6-0 to recommend establishing a
policy of discouraging additional townhouse preliminary plats for the immediate future
except in unique circumstances to provide a balanced housing supply consistent with the
policies of the Comprehensive Plan.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OTSEGO THAT; additional townhouse unit preliminary plats are to be discouraged for the
immediate future, except in unique circumstances, based upon the number of units
presently preliminary platted, available sanitary sewer service capacity and the
Comprehensive Plan policies encouraging a balance of housing choices.

The Parks and Recreation Commission discussed the following items at their meeting on
May 9, 2001:
• Mighty Kicks Grant. Mike Roden of the area soccer association' attended the
meeting to discuss a grant application for funds to install irrigation systems for the
soccer fields at Prairie Park. Mr. Roden submitted a similar grant application for
facilities at the VFW fields last year, but did not receive funding. Mr. Roden hopes
to improve the chances of receiving funds by including City facilities. If awarded a
grant, the City must provide matching funds for the cost of improvements. A
summary of grant funds awarded in the last cycle is attached for reference.
The Parks Commission discussed installing an irrigation system for the soccer
fields and baseball diamonds, as well as adding an "under -10" soccer field that
would improve the application's qualifications. The Parks and Recreation
Commission voted 4-0 to recommend that the City Council authorize the City
Engineer to prepare an estimated cost for a irrigation system for Prairie Park and
that City staff prepare the formal application. Applications are required to be
submitted by June 15, 2001, although Mr. Roden would like to provide a copy
earlier in order to get feedback from an individual involved in the review process
and allow time for changes.
School Knoll perk. The Parks and Recreation Commission voted 4-0 to
recommend that the City Council authorize the seeking of bids for development of
School Knoll Park based upon the present concept plan and City Engineer's cost
estimates. Prior to seeking bids, City staff is to investigate the cost of adding
bathroom facilities, a drinking fountain and kitchenette facilities on one end of the
large shelter. Staff is also to review on-site parking to determine if it will be
adequate in consideration of the expanded shelter and report back possible design
changes.

At the last Council meeting the Council had directed
the City Attorney to recommend a few dates at which he
could hold a meeting with all City Commissioners to go
over the legal requirements of their position, what
they can and can't say, and answer any questions they
might have. Since the Commission with the most
authority is the Planning Commission, we looked at
holding this meeting as part of a Planning Commission
meeting.
The dates Andy has free in the next few months would be
Monday, June 18, 2001, Monday, July 16, 2001, and
Monday, August 20, 2001. We could hold the meeting
either at the start of the Planning Commission meeting
or a little earlier.

Agreement for the Day property. As you may recall, at the time of approval of this
Preliminary Plat staff was directed to bring the developer's Agreement to the Council
prior to final plat approval because of the unique nature of the approved deferred
performance standards.
The draft has been transmitted to the developer. Myself and Mike Robertson met with the
Days and went over the Agreement and they had no substantial objections to the
Agreement as written.

DEVELOPMENT AGREEMENT
OTSEGO BUSINESS PARK
AGREEMENT entered into this day of , 2000 between the City
of Otsego ("City"), a municipal corporation organized under the laws of the State of
Minnesota, and TMH Development ("Developer").
1. Request for Plat Approval. The Developers have requested that the City
approve a plat entitled OTSEGO BUSINESS PARK referred to in this Agreement as "the
Plat") and legally described as follows:
(See attached Exhibit A)
With regard to such parcel of land, Developer has requested approval of the plat of OTSEGO
BUSINESS PARK which is zoned B -W, consisting of 5 lots and 1 Outlot.
2. Conditions of Plat Approval. The City hereby approves the plat on condition
that the Developers enter into this Agreement, furnish the security required by it, and record
the plat with the Wright County Recorder or Registrar of titles within one hundred (100) days
after the City Council approves the final plat. Any restrictive covenants for the subject
subdivision shall be submitted to the City Attorney for approval and shall be recorded prior to
sale of any lots within the plat.
3. Right to Proceed. Within the plat or land to be platted, the Developers may
not grade or otherwise disturb the earth, remove trees, construct sewer lines, water lines,
streets, utilities, public or private improvements, or any buildings until all the following
conditions have been satisfied: 1) this Agreement has been fully executed by both parties and
filed with the Zoning Administrator, and all conditions contained in the Agreement have been
met, 2) the necessary security has been received by the City, 3) the plat has been recorded
with the Wright County Recorder's Office, 4) Developers have initiated and attended a pre -
construction meeting with the City Engineer, and 5) the Zoning Administrator has issued a
letter that all conditions have been satisfied and that the Developers may proceed; or until
such time as approval to commence earlier construction is specifically approved by the City,
and Developers have fully complied with all conditions set forth by City staff.
4. Changes in Official Controls. For two (2) years from the date of this
Agreement, no amendments to the City's Comprehensive Plan, or official controls shall apply
to or affect the use, development density, lot size, lot layout or dedications of the approved
plat unless required by state or federal law or agreed to in writing by the City and the
Developers. Thereafter, notwithstanding anything in this Agreement to the contrary, to the
full extent permitted by State law, the City may require compliance with any amendments to
the City's Comprehensive Plan, official controls, platting or dedication requirements enacted
after the date of this Agreement.
5. Development Plans. The plat shall be developed in accordance with the plans
attached to this Agreement and the conditions stated below. If the plans vary from the written
terms of this Agreement, the written terms shall control. The plans are:
Plan A Final Plat, OTSEGO BUSINESS PARK dated 2001,
prepared by Ulteig Engineers, Inc.
Plan B Grading, Drainage, Erosion Control Plan, dated , 2001,
prepared by Ulteig Engineers, Inc.
At the end of the deferment period granted herein Developer shall supply all needed plans for
road and infra -structure completion for review and approval by the City Engineer. Developer
shall comply fully with all such required and approved plans, and shall enter into additional
agreements, if necessary to insure completion of all required facilities both on and off the Plat.
6. Improvements. The Developers shall ultimately install and pay for the
following:
A. Streets (including portions not within the Plat)
B. Street lights
C. Site grading and ponding
D. Underground utilities

E. Setting of lot and block monuments
F. Construction surveying and staking
G. Traffic control signs
Improvements shall be installed in accordance with City standards, ordinances, and the
plans finnished to the City and approved by the City Engineer. The Developers shall obtain
all necessary pen -nits before proceeding with construction. The City shall provide adequate
field inspection personnel to assure acceptable quality control, which will allow certification
of the construction work. The City may, when reasonably required to do so and at the
Developer's expense, have one (1) or more City inspectors and a soil engineer inspect the
work. Within thirty (30) days after the completion of the improvements and before any
security is released, the Developers shall supply the City with a complete set of reproducible
"as built" plans and two (2) complete sets of blue line "as built" plans prepared in accordance
with City standards. Before the security for the completion of utilities is released, iron
monuments shall be installed in accordance with Minnesota Statutes 505.02. The
Developer's surveyor shall submit a written notice to the City certifying that the monuments
are installed.
7. Time of Performance and Deferment. The Developers shall install the
following improvements by January 1, 2004; removal of existing building from Lot 3, Block
1, construction of a commercial building meeting all then existing requirements of the City
and subject to City approval, construction of all improvements necessary to meet
performances standards related to the B -W district including, but not limited to, construction
of parking facilities adequate for the use proposed including any required paving and curb and
gutter, connection to City sewer and water and proper abandonment of existing septic system
and well, construction of driveway meeting all City standards from the newly constructed
building to the required constructed extension of &' Street and abandonment of existing
gravel driveway. Developer must also at that time, or prior to that time if early development
occurs, construct the entire extension of 85th as set forth in the Plat.
Until January 1, 2004 or further development of the Plat, whichever occurs first, Developer
may use the existing house and driveway in their present condition and with no substantial
improvement for purposes of conducting its business. Outside of the immediate performance
standards specifically identified and deferred in this Agreement, Developer must fully comply
with all applicable City Ordinances, State statutes and rules, and all applicable federal laws
and regulations.
8. Construction of Extension of 85"' Street and Related Improvements by
City, and Assessment and Reimbursement for Related Costs. At the end of the Deferment

period set forth above, or at such time as earlier development of the plat occurs, Developer
shall timely petition the City for construction of the extension of 85`h Street and related
improvements (including storm sewer, sanitary sewer, water lines, street lighting etc.) as
shown on the Plat, including that portion lying off of the Plat to the north. Prior to the petition,
Developer shall obtain from the owner of the property to the North all necessary easements,
including all permanent right of wy and temporary construction easements needed for City
construction of the extension of 85 Street and related improvements. If, prior to January 1,
2004, or within a reasonable time prior to application for early development, Developer is
unable to obtain easements for the extension of 85`x' from the property owner to the North he
shall inform the City and request that the City proceed to attempt to negotiate an easement or
commence eminent domain proceedings in order to obtain the necessary parcels. In the event
that it becomes necessary for the City to become involved in land acquisition, Developer
shall pay any and all costs, including, but not limited to engineering fees, appraisal fees,
attorneys fees and all actual costs paid for the acquisition of the property necessary to extend
85th Street. All land acquisition costs will be added as a portion of the project cost for the
extension of 85`x' Street and related improvements.
Developer agrees to waive any and all claim for irregularities in assessment procedures and
further waives any and all appeal rights of any kind or any nature, including any and all
Constitutional claims relevant to assessment of the property herein described for costs related
to the required extension of 85th Street and related improvements. Further, Developer agrees
to execute and present to the City prior to City approval of a City project, if deemed necessary
by the City, a similar waiver in the specific amount of assessment against the subject property
as determined by the City.
The Security provided for in this Agreement may be drawn down at any time at the sole
discretion of the City, to pay any assessment against the subject property, and any costs
related to construction of the extension of 85`h Street and related improvements off of the Plat,
but subject to reimbursement as set forth in the following paragraph
City shall cause that portion of the costs related to the constructed extension of 85th Street and
related improvements to be assessed against any other property benefited by the
improvements and subject to City ordinances and State law. City shall reimburse Developer
for any costs expended by Developer related to construction of the extension of 85th Street not
assessed against the subject property, up to the amount actually received by the City. Said
reimbursement will be made within a reasonable time period after actual receipt of said funds
by the City from the assessed property owners.

9. Right of Entry. The Developers hereby grant to the City, its agents,
employees, officers and contractors a right of entry to enter the plat to perform any and all
work and inspections necessary or deemed appropriate by the City during the installation of
improvements by Developers or the City, or to make any necessary corrective actions
necessary by the City. Except in emergency situations, as defined by the City, the City shall
give the developers five (5) business days notice stating the deficiencies and necessary
corrections prior to making any corrective action. Said right of entry shall continue until the
City finally accepts the improvements.
10. Erosion Control. After the site is rough graded, but before any utility
construction is commenced or further building permits are issued, the erosion control plan,
Plan B, shall be implemented by the Developers and inspected and approved by the City. If
the City Engineer determines that it would be unreasonable to require full implementation of
the erosion control plan prior to utility construction or issuance of certain building permits, he
shall state in writing what construction can take place and what particular building permits
can be issued prior to full implementation. The City may impose additional erosion control
requirements if, in the opinion of the City Engineer, they would be beneficial. All areas
disturbed by the excavation and backfilling operations shall be reseeded forthwith after the
completion of the work in that area. If the Developer does not comply with the erosion
control plan and schedule or any supplementary instructions, the City may, with reasonable
notice, take action as it deems appropriate.
11. Grading Plan. Plat grading shall be in accordance with the grading plan.
Ponds, swales, and ditches shall be constructed on public easements or land owned by the
City. Within thirty (30) days after completion of grading and before any security release, the
Developers shall provide the City with an "as built" grading plan including certification by a
registered land surveyor or engineer that all ponds, swales, and ditches have been constructed
on public easements, or land owned by the City. "As built" plans shall include field- verified
elevations of the following:
A. Cross sections of ponds
B. Location and elevations of swales and ditches
C. Lot corners and house pads
Occupancy pernlits shall not be issued until the grading and drainage plan is certified
as set forth above.
12. Clean Up. The Developers shall promptly clean any and all dut and debris
from streets resulting from construction work by the Developers, their agents or assigns.

13. Ownership of Improvements. Upon completion of the work and construction
required by this Agreement, improvements lying within public easements shall become City
property without further notice or action.
14. Streets. The Developers agree to maintain the streets in the plat until the
bituminous surfacing has been accepted by the City. Should the City be required to grade the
street prior to paving, the cost of such grading shall be paid by the Developers and drawn
from the Developer's letter of credit. Should snow plowing be necessary prior to street
paving, the Developers shall be responsible for such plowing. If, upon the Developer's
request, the City agrees to plow the street prior to acceptance, such work will be done upon
agreement that the Developers will hold harmless and indemnify the City from any and all
liability claims related to such work and pay all costs associated with that work. Any plowing
undertaken by the City will constitute no acceptance or evidence of acceptance of the street(s)
in question. Upon final completion of streets and acceptance by the City, the Developers
shall guarantee to the City for a period of one year that the streets have been constructed to
City standards. The warranty period shall not commence until such time as street
construction is completed and the streets are accepted by the City.
15. Sewage Treatment and Water Service. No occupancy permit for any newly
constructed building in the plat will be issued by the City unless the City Building Official has
inspected and approved the sewer and water hookups to the building.
16. City Engineering Administration and Construction Observation, And
Legal And Administrative Fees Escrow. The Developers shall pay a fee for consulting
engineering administration. City engineering administration will include monitoring of
construction, observation, consultation with Developers and their engineer on status or
problems regarding the project, monitoring during the warranty period and processing of
requests for reduction in security. Fees for this service shall be three percent (3%) of the
estimated construction cost of the improvements to be inspected, assuming normal
construction and project scheduling. The Developers shall pay for construction observation
performed by the City's consulting engineer. Construction observation shall include part or
full time inspection of proposed street construction and will be billed on hourly rates
estimated to be five percent (5%) of the estimated construction cost of the improvements to be
inspected. In the event of prolonged construction or unusual problems, the City will notify
the Developers of anticipated cost overruns for administration and observation services. The
escrow account shall include estimated fees for Administrative and Legal expenses and Signs
and shall be established at the time that improvements are commenced. No further use of the

lots within the plat may commence or continue until escrow in an amount approved by the
City is posted with the City.
The escrow amount shall be submitted to the City at the time that further development within
the plat is undertaken or at the date that the deferment granted herein terminates, whichever is
sooner. All administrative and legal fees related to plan review, drafting of the Developer's
agreement and any other necessary items shall be paid to the City prior to execution of the
plat and Developer's Agreement. Any amounts not utilized from this escrow fund shall be
returned to the Developers, with interest, when all improvements have been completed, all
financial obligations to the City satisfied, and the required "as built" plans have been received
by the City.
An estimate of the proposed escrow is set forth. The estimate is based upon current
engineering and fee projections and is a minimum estimate. The City reserves the right to
increase the proposed escrow amount at the end of the deferment period if prices for materials
or other items rises above the amount projected, or if City established fees are raised or
lowered.

17. Immediate Escrow During Deferment Period. In order to provide the City
with Security to insure immediate and complete development of the site after the deferment
period and to insure that the interim use is promptly, completely, and fully abandoned at the
end of the period Developer shall provide the City with an Interim Escrow to be held through
the deferment period in the amount of $ . Said interim escrow is also to insure
that existing and newly created uses within the Plat connect to municipal sewer and water
immediately at the end of deferment period. In the event that Developer fails to develop the
property immediately at the end of the deferment period the City may use the Interim Escrow
to take any action that the City, at its sole discretion, determines will accomplish the purpose
of the City approval and the goals of this Agreement. The City may require either cash escrow
or posting of an Irrevocable Standby Letter of Credit, in a form and for a term acceptable to
the City.
18. Drainage. The Developers shall fully comply with the Grading, Utility and
Erosion Control Plan (Plan B). The City has established a fee for the impact of the Plat upon
storm water drainage within the watershed. The fee is based upon engineering studies
completed by the City. The established fee for Storm Water Management within the Plat will
be determined and paid at the time of further Plat development or the end of the deferral
period, whichever occurs first.
Construction of the retention pond and related improvements located upon the Outlot within
the Plat will be constructed by Developer in phases or at one time as determined by the City
Engineer. In the event of failure by the Developer to timely construct such facilities, the
Security established in this Agreement may be drawn down by the City and used to construct
the facilities. In the event that sufficient Security is not available, the City may require and
Developer agrees to make timely payment for the retention pond or post additional Security to
insure construction of the pond and related improvements.
19. Security. To ensure compliance with the terms of this Agreement and
construction of all public improvements, the Developers shall furnish the City with "security"

The issuer and form of the security shall be subject to City approval, and shall be
substantially in the form(s) attached hereto as Exhibit B. The security shall be for a term
ending December 31, 2004. The City may draw down the security for any violation of the
terms of this Agreement, or upon receiving notice of the pending expiration of the security. It
shall be the responsibility of the Developers to inform the City at least thirty (30) days prior to
expiration of the security of the impending expiration and the status of the project relative to
the security and this Agreement. If, for whatever reason, the security lapses prior to complete
compliance with this Agreement, the Developers shall immediately provide the City with
either an extension of the security or an irrevocable letter of credit of the same amount upon
notification of the expiration. If the required improvements are not completed at least thirty
(30) days prior to the expiration of the security, the City may also draw down the security. If
the security is drawn down the proceeds shall be used to cure any default. Upon receipt of
proof satisfactory to the City that work has been completed and financial obligations to the
City have been satisfied, with City approval, the security may be reduced from time to time
down to the amount of any warranty security required by the City Engineer and based upon

estimates of the actual costs of improvements required to be constructed. It shall not be
reduced below this amount until such time as an Irrevocable Letter of Credit in the amount of
the warranty as determned by the City Engineer shall be posted with the City as set forth in
paragraph 19 of this Agreement. Notwithstanding the posting of warranty security, the
security shall not be reduced below twenty five percent (25%) of the actual cost of all
improvements to be constructed. Said twenty five percent (25%) shall be retained until all
improvements have been completed, all financial obligations to the City satisfied (which
includes posting of warranty security), and the required "as built" plans have been received by
the City.
This security amount shall be submitted to the City prior to execution of the plat and
Developer's Agreement. All administrative and legal fees related to plan review, drafting of
the Developer's agreement and any other necessary items shall be paid to the City prior to
execution of the plat and the Developer's Agreement.
The security for this Agreement shall be an Irrevocable Letter of Credit in the amount of
$268,880.00.
20. Interim Security. In order to insure compliance with this Agreement,
conditions of approval and conditions of deferment, at the signing of this Agreement
Developer shall submit to the City in the form of an Irrevocable Standby Letter of Credit in
form and for a term acceptable to the City, in the amount of $ . Said Letter of
Credit may be used to cure any default in the terms and conditions of this Agreement the
same as the Security provided in Paragraph 18 above. This Interim Security and Interim
Escrow established in Paragraph 16 of this Agreement may be combined into one Letter of
Credit, at the sole discretion of the City.
21. Landscaping. The Developers shall submit to the City for approval, prior to or
at the time the deferment period ends a Landscaping Plan. Said plan shall be reviewed and
approved by the City and thereafter the Developer shall be responsible for full and complete
implementation of the plan. In order to insure compliance with the Plan, Developer shall
submit to the City security to insure implementation of the Plan in an amount, term and form
to be determined by the City at the end of the deferment period and based upon the ultimate
plans for development of the site. Said security may be used to cure any deficiency in the
Landscape Plan, and to insure any warranties required by the City. Developer shall enter
subsequent Agreements, if necessary, to insure that such security is established. If the
landscaping is not timely completed, the City may enter the lot, perform the work, and apply
the security toward the cost.

Upon satisfactory completion of the landscaping, the security, without interest and less any
draw made by the City, shall be returned to the Developer or any other person who
established the security for the benefit of the City. The Developer, or owner of each lot
providing any trees, grass, seed, and sod shall maintain said plantings and warrant them to
remain alive, of good quality and disease free for twelve (12) months after planting. Any
replacement shall be warranted for twelve (12) months from the time of planting. The
Developer or owners shall post security, as set forth above, to the City to secure these
warranties.
22. Warranty. The Developers warrants all work required to be performed by it
against poor material and faulty workmanship for a period of one (1) year after its completion
and acceptance by the City. The amount of posted warranty security for public improvements
to be posted by the Developers shall be in the amount of $52,500.00 (estimate). The amount,
has been determined by the City Engineer, and is based upon the costs of the raw materials
and labor, which would be necessary to correct the most common deficiencies in such public
improvement. Calculations for the Warranty Letter of Credit and other Escrow and Security
are set forth on the attached Exhibit B.
23. Claims. In the event that the City receives claims from labor, materialmen, or
others that perform work required by this Agreement, and the sums due them have not been
paid, and the laborers, materialmen or others are seeking payment from the City, the
Developers hereby authorizes the City to commence an interpleader action pursuant to Rule
22, Minnesota Rules of Civil Procedure for the District Courts, to draw upon the letters of
credit in an amount up to one hundred twenty-five percent (125%) of the claim(s) and deposit
the funds in compliance with the Rule, and upon such deposit, the Developers shall release,
discharge, and dismiss the City from any further proceedings as it pertains to the letters of
credit deposited with the District Court, except that the Court shall retain jurisdiction to
determine attorney fees pursuant to this Agreement. In the event that the Developer desires to
make a cash deposit instead of drawing down the letter of credit if a claim is made as stated
above, they shall immediately notify the City of this intent at the time the claim is made and
shall delivery one hundred twenty-five percent (125%) of the claim to the City within ten (10)
days of such notice in the form of cash or certified check.
24. Restrictions. The following restrictions apply to the property and all lots
thereon shall be held, sold and conveyed subject to the following conditions and restrictions
which are for the purpose of protecting the value and desirability of the plat and insuring that
all conditions imposed by the City in this Agreement are properly recorded against the
property. Said conditions shall run with the real property and be binding on all parties having

a right, title or interest in the plat or any part thereof, their heirs, executors, representatives,
successors and assigns:
None.
25. Park and Trail Dedication. The Developers shall pay a cash contribution of
$ in satisfaction of the City's park and trail dedication requirements. This
charge is calculated as follows: ( Park and trail dedication to be determined and paid upon
further development of the Plat or by the end of the deferment period, whichever occurs first.)
26. Street and Traffic Control Signs. Before the City signs the final plat, the
Developers shall pay to the City $600.00 for installation of traffic control signs (stop signs,
street signs, dead-end signs). The said amount was calculated as follows: 4 signs at $150.00
per sign. Using these funds, the City shall purchase and install the street and traffic control
signs.
27. Street Light Construction. The Developers shall pay for the operation and
maintenance of the street lights for a period of one (1) year or until such time as the plat is
ninety percent (90%) built out, whichever occurs first. The first year of operation and
maintenance shall not commence until such time as the final plat is accepted by the City and
it is formally recorded.
28. Responsibility for Costs.
A. Except as otherwise specified herein, the Developers shall pay all costs
incurred by them or the City in conjunction with the development of the plat, including, but
not limited to, legal, planning, engineering, and inspection expenses incurred in connection
with development of said plat, the preparation of this Agreement, and all costs and expenses
incurred by the City in monitoring and inspecting development of the plat.
B. The Developers shall hold the City and its officers and employees
harmless from claims made by itself and third parties for damages sustained or costs incurred
resulting from plat development. The Developers shall indemnify the City and its officers and
employees for all costs, damages or expenses which the City may pay or incur in consequence
of such claims, including attorney's fees.
C. The Developers shall reimburse the City for costs incurred in the

enforcement of this Agreement, including engineering fees, attorney's fees, and costs and
disbursements.
D. The Developers shall pay in full all bills submitted to it by the City for
obligations incurred under this Agreement within thirty (30) days after receipt. If the bills are
not paid on time, the City may halt all plat development work and construction, including but
not limited to the issuance of building permits for lots which the Developers may or may not
have sold, until all bills are paid in full. Bills not paid within thirty (30) days shall accrue
interest at the rate of twelve percent (12%) per year.
29. Developer's Default. In the event of default by the Developers as to any of the
work to be performed by it hereunder, the City may, at its option, perform the work and the
City may then draw down the security established in Paragraph 17 to pay for any work
undertaken, provided the Developers are first given notice of the work in default, not less than
seven (7) days in advance. This notice provision does not apply if the work performed by the
City or its contractors is of an emergency nature, as determined at the sole discretion of the
city. Should such emergency work be required the City will make all reasonable efforts to
notify the Developers as soon as possible. When the City does any such work, the City may,
in addition to its other remedies, assess the cost in whole or in part pursuant to any applicable
statutes or ordinances.
30. Miscellaneous.
A. The Developers represents to the City that the plat complies with all City,
County, metropolitan, state, and federal laws and regulations, including but not
limited to, Subdivision Ordinances, Zoning Ordinances, and environmental
regulations except where specifically excluded by this agreement. If the City
determines that the plat does not comply, the City may, at its option, refuse to
allow construction or development work in the plat until the Developers does
comply. Upon the City's demand, the Developers shall cease work until there
is compliance.
B. Third parties shall have no recourse against the City under this Agreement.
C. Breach of any of the terms of this Agreement by the Developers shall be
grounds for denial or revocation of building permits.
D. If any portion, section, subsection, sentence, clause, paragraph or phrase of this
Agreement is for any reason held invalid, such decision shall not affect the

validity of the remaining portion of this Agreement.
E. If building permits are issued prior to the completion and acceptance of public
improvements, the Developers shall assume all liability for the costs resulting
in any delay in completion of public improvements and damage to any public
improvements caused by the City, the Developers, is/her contractors,
subcontractors, materialmen, employees, agents, or third parties. No one may
occupy a building for which a building permit is issued on either a temporary
or permanent basis until the streets needed for access have been paved with a
bituminous surface, unless a specific exception is approved by the City.
F. The action or inaction of the City shall not constitute a waiver or amendment to
the provisions of this Agreement. To be binding, amendments or waivers shall
be in writing, signed by the parries and approved by written resolution of the
City Council. The City's failure to promptly take legal action to enforce this
Agreement shall not be a waiver or release.
G. This Agreement shall run with the land, shall be recorded against the title to the
property, and shall be binding on all parries having any right, title or interests in
the plat or any part thereof, their heirs, successors, and assigns. After the
Developer has completed the work required of them under this Agreement, at
the Developer's request, the City will execute and deliver to the Developers a
release or partial release (s) of this Agreement.
H. The Developers shall take out and maintain until one (1) year after the City has
accepted the public improvements, public liability and property damage
insurance covering personal injury, including death, and any claims for
property damage which may arise out of the Developer's work or the work of
their subcontractors or by one directly or indirectly employed by any of them.
Limits for bodily injury and death shall not be less than $500,000.00 for one
person and $1,000,000.00 for each occurrence; limits for property damage shall
be not less than $200,000.00 for each occurrence. The City shall be named as
an additional named insured on said policy, and the Developers shall file a
copy of the insurance coverage with the City prior to the City issuing further
building permits.
I. Each right, power or remedy herein conferred upon the City is cumulative and
in addition to every other right, power or remedy, express or implied, now or
hereafter arising, available to City, at law or in equity, or under any other

agreement, and each and every right, power and remedy herein set forth or
otherwise so existing may be exercised from time to time as often and in such
order as may be deemed expedient by the City and shall not be a waiver of the
right to exercise at any time thereafter any other right, power or remedy.
J. The Developers shall pay for all local costs related to drainage improvements
required to complete the construction according to the plans and conditions that
are a part of this Agreement.
K. Should development of the plat proceed at a pace slower than anticipated, and
for that reason, specific terms of this agreement become onerous or unduly
burdensome to the Developers, upon his/her application, the City will enter into
negotiations regarding those specific terms and shall not unreasonably withhold
consent to appropriate changes in the terms of this Agreement.
L. A soil report for on-site sewage disposal systems shall be provided.
M. Developers shall demonstrate and maintain compliance with the 1991 Wetland
Conservation Act.
N. Developers shall be responsible for all on site drainage as well as for any
affects that their actions may have on adjoining properties. Specifically,
Developer shall maintain existing drainage tiles on site, and shall be
responsible for any and all drainage problems related to either the site drainage
tiles or problems with on-site drainage facilities to be constructed in accordance
with this agreement and plat approval.
31. Notices. Required notices to the Developers shall be in writing, and shall be
either hand delivered to the Developers, their employees or agents, or mailed to the
Developers by registered mail at the following address: Suite 310, 3200 Main Street, Coon
Rapids, MN 55448 . Notice to the City shall be in writing and shall be either hand delivered
to the City Clerk or Deputy City Clerk at the following address: City of Otsego, City Hall,

Dear Mike:
This report describes the proposed wastewater treatment facility in the western portion of
the City of Otsego to serve figure residential and commercial development in the
surrounding area. The report has been prepared to meet 1r1PCA requirements for a new
treatment facility that is to be constructed without State or Federal funding.
1. Location
Determination of an exact site for the proposed facility was beyond the scope of this
study. The approximate location of the facility is adjacent to or near County Road 19
approximately 1/2 to'/4 mile north of the Otsego/Albertville corporate boundary. Exact
site location is to be established before an Environmental Assessment Worksheet (EAW)
for the facility is to be prepared. After a site is determined, preparation of an EAW is
expected to be the next step in the planning of the proposed facility.
2. Service Area
The service area for the new facility has been established only as an approximation. The
approximate service area is adjacent to the Interstate 94 corridor west of Albertville and
portions of Sections 35 and 36 in T32N, R27W immediately north of Albertville.
3. Capacity
The proposed capacity of the facility is 300,000 gallons per day (gpd) of average flow.
This capacity is expected to serve an equivalent population of 3,000, or 1,200 equivalent
residential units. The exact breakdown of connections in the service area according to

land use is to be established. See Section 5 of this report for other design capacity

The proposed discharge point for treated effluent is Otsego Creek in T32N, R27W,
Section 25, approximately %z mile north of and downstream from Mud Lake.

7. Treatment Process
Based on the capacity and effluent requirements of the facility, it is proposed that the
facility be an activated sludge process with chemical phosphorus removal. The activated
sludge process will be a conventional process without considerations for ammonia

removal. Sludge will be treated by thickening and aerobic digestion, and then stored on-
site for 12 months prior to land application. 12 -month storage is proposed in lieu of less
storage to (1) eliminate the need for spring land application and (2) guarantee vector
attraction and Class B pathogen requirements are met.
Effluent disinfection will by UV -disinfection.

The facility will include:

IO.Estimated Costs
The estimated capital cost of the facility is $4,370,000. The estimated annual operation
and maintenance cost when treating 300,000 gpd is $190,000. The facility labor
requirements are 1 %i full-time people. Laboratory testing for permit requirements is to
be done by an outside lab.
11. Area
The required area for the proposed facility—including space for a future expansion to
600,000 gpd—is 7 %Z acres.
12. Facility Classification
The proposed treatment facility will be a Class B facility.
