05-29-01 CCCITY OF OTSEGO CITY COUNCIL MEETING MAY 29, 2001 COUNCIL CHAMBERS OTSEGO CITY HALL 6:30PM 1. Mayor Larry Fournier will call the meeting to order. Mayor Fournier called the meeting to order at 6:34 PM. Roll Call: Mayor Larry Fournier; Councilmembers: Vern Heidner, Virginia Wendel, Jerry Struthers. Suzanne Ackerman arrived at 6:36 PM. Staff. Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Administrator; Andrew MacArthur, City Attorney; Cindy Sherman, Assistant City Planner; Ron Wagner, City Engineer, Jerry Olson, Building Official. Pledge of Allegiance: Mayor Fournier led in the Pledge of Allegiance. 2. Consider agenda approval. Mike Robertson requested to add under Item 9. Appointment of a Councilmember to the Transportation Committee. Mayor Fournier requested to remove Item 5. Lfrom the Consent Agenda and pu: under Item 9.1. CM Wendel motioned to approve the agenda as amended. Seconded by CM Ackerman. All in favor. Motion carried. 3. Consider the following minutes: 3.1. April 26, 2001 Board of Review Minutes CM Heidner motioned adoption. Seconded by CM Ackerman. All in favor. Motion carried. 3.2. May 14, 2001 Board of Review Minutes CM Wendel motioned adoption. Seconded by Mayor Fournier. All in favor. Motion carried. 3.3. May 14, 2001 City Council meeting CM Wendel motioned adoption. Seconded by CM Struthers. All in favor. Motion carried. 4. Open Forum: No one appeared on Open Forum. 4.1 Special Presentations - Approval of City Assessor Contract Mayor Fourneir motioned to raise the City Assessor's compensation to $8.50 per parcel for Year 2001. Seconded by CM Wendel. All in favor. Motion carried. 4.2. Daniel Fietek, 14305 S 1' Street - Reauest to rebuild a non -conforming accessory building_ Mr. Fietek explained how the roof of his garage collapsed under the weight of snow this past winter. He started the rebuilding without a building permit. His insurance company advised him to put up trusses. He stated this is the same slab, same walls and same height City Council Meeting of May 29, 2001, cont'd. Page 2. except for the roof. He lifted the building to place an additional course of block on the% foundation. This is the garage he uses to park his vehicles. Mr. Fietek feels that tearing this garage down would decease the value of his property and also would make his property look ridiculous. The Building Official, Jerry Olson, stated the ordinance allows for one attached garage up to 1,000 square feet and one detached garage up to 1,000 square feet for Mr. Fietek's one acre lot zoned residential. There is a 1,200 square foot building located in the back yard and a storage shed of 10 x 16. The building being rebuilt is also detached and is 720 square feet. Mr. Olson said attaching this garage to the house is not a possibility since this is a mobile home and the garage is on a floating slab. It is Mr. Olson's opinion that this garage was structurally rebuilt and the reconstruction was of a nonconforming use. Mayor Fournier asked Mr. Fietek if he would consider tearing down the 1200 sq. ft. building. Mr. Fietek responded that he hadn't considered this because it has a lot of storage but will look at other alternatives. Mayor Fournier suggested the City Council take this information as advisement and directed the Building Official to bring this back to the next Council Meeting with options. 5. Consent Ai ea nda 5.1. Approve Claims List This Item was removed and placed under Item 9. 6. City Planner Dan Licht ( Cindy Sherman from NAC attended for Dan Licht). 6.1. Pheasant Ridge 5t' Addition - Preliminary Plat & PUD/CUP Cindy Sherman presented the Planner's Report. Ron Wagner presented the Engineering comments. CM Heidner motioned to approve the PUD -CUP and preliminary plat entitled "Pheasant Ridge 5`h Addition" for development of 116 residential units on property legally described as Outlot B of Pheasant Ridge subject to the eight conditions listed in the Findings of Fact modifying Condition #3 revising single family lots to 55 foot widths with 10 and 5 foot setbacks and no single fagade located closer to the same than every three units and single story. Seconded by CM Struthers. All in favor. Motion carried. 6.2. Trudell Trailers Site Plan Cindy presented the Planner's Report. Ron Wagner went over the Engineer's remarks. Mayor Fournier expressed concern with used trailers being stored on the lot and wants to make sure the CUP addresses this issue. Mike Robertson suggested a condition addressing used trailers. CM Wendell motioned to approve the site and building plan review for an industrial use to be located on Lot 1, Block 1 of the Otsego I-94 West Industrial Park subject to the ten conditions listed in the Findings of Fact. Ron Wagner reviewed the Engineering Comments. Joyce Michelson, applicant, distributed an alternate plan After Council discussion, the following motion was made. CM Heidner motioned to approve a Zoning Map amendment rezoning the subject site (Parcels 118-500-184100 and 118-500-184100) from A-1 District to A-2 District. Seconded by CM Wendell. All in favor. Motion carried. Mayor Fournier motioned to approve a PUD -CUP and the first design the applicant presented for the Preliminary Plat for Hidden Trails, subject to the nine (9) conditions listed in the Findings of Fact with the following changes: Change Condition #1 to ten (10) lots Change Condition #3.c. a manure management plan, if applicable Change Condition #8 to include language in the Developer's Agreement, by the City Attorney, addressing the 90`h Street reimbursement from property owners north of 90a' Street upon development of their land. Change the curve in 90ThStreet at the intersection of Naber Avenue as directed by the City Engineer. Include a fence along CSAH 39. Seconded by CM Heidner. All in favor. Motion carried. 6.3. School Knoll Park Plan. Mike Robertson went over the plan for School Knoll Park. The Council liked the plan and directed staff to hold this plan for a year at which time the adjoining property owners will be invited to comment. 7. City Engineer Ron Wagner 7.1. Accept and Award Bids for 88`h Street Construction Ron Wagner reviewed the bids received for this project. CM Heidner motioned to adopt the Resolution 2001-18 accepting the bid from Buffalo Bituminous for $113,000 for the 88" Street Improvement Project. Seconded by CM Ackerman. All in favor. Motion carried. 8. City Attorney Andrew MacArthur. Mr. MacArthur updated the City Council on W -H Link's request for open video systems. 9. Citv Council A. River Rider Update CM Wendel went over the attached proposed increases for 2002. The City Council agreed to participate for at least one more year. B. Report on Joint Recreation Commission City Council Meeting of May 29, 2001, cont'd. Page 4. Mayor Fournier motioned that the City inform the Community Recreation Board that Otsego will not be a participate in 2002 because of high costs. Seconded by CM Ackerman. All in favor. Motion carried. C. Other Council Business 1. Appointment to I-94 Transportation Committee CM Heidner motioned to appoint CM Ackerman and CM Wendel. Seconded by Mayor Fournier. All in favor. Motion carried. 5.1. Consider Claims List. Mayor Fournier asked a question regarding the Bonestroo Invoice. Staff stated this was for the Phase II of the East Sewer Plant. CM Heidner motioned adoption of the Claims List. Seconded by CM Ackerman. All in favor. Motion carried. The Council directed Mike Robertson to send a letter to the City of Dayton informing them there is no capacity available for them in the Phase II East Sewer Plant expansion. 9.1. City Administrator A. False Alarm Char es Mike went over his memo. The Council took no action. 9.2. City Clerk The Council directed staff to review the City's Kennel Ordinance for the next City Council Meeting. Also, to review Municipal Liquor and advertisements in the Otsego View. 10.
