I have enclosed a copy of Pete Merges' contract. Pete
has proposed a payment of $8.00 per parcel for
assessing services, an increase from $7.50 per parcel.
I spoke with Wright County and they said they charge
$8.50 per parcel.
PART-TIME EMPLOYMENT
CONTRACT BETWEEN
THE CITY OF OTSEGO, MINNESOTA
AND
ANDREW B. MERGES, ASSESSOR
THIS AGREEMENT is made and entered into this day of of 2001, by and between
the Citi of Otsego, a municipal corporation under the laws of the State of Minnesota
(hereinafter"City") and Andrew B. Merges, Real Estate Assessor. (hereinafter "Employee"
RECITALS:
WHEREAS, the City is in need of property valuation services for ad valorem property tax
purposes; and
WHEREAS, the Employee has previously provided the City with this service for over twenty
(20) years; and
WHEREAS, the Employee has substantial experience with real property valuation, and is
qualified to assist the City as an assessor; and
WHEREAS, the City desires to contract with the Employee for the performance of certain
employment tasks more fully described herein; in
WHEREAS, the Employee's principal place of business is located at the following address: 6748
Kadler Avenue Northeast, Albertville, MN 55301; and
WHEREAS, the City intends to hire Employee on a part-time basis only, with said
employment being reviewed and renewed, or not, annually; and
WHEREAS, the Employees declares that he is fully qualified and has all necessary credentials to
provide the City with the services set forth herein.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained,
it is agreed between the parties as follows:
1. Services to be Performed. The City engages the Employee to perform the following
described employment tasks and services. Employee is responsible for appraising and valuing
described employment tasks and services. Employee is responsible for appraising and valuing
each and every parcel of real property within the City of Otsego. Employee shall personally view
a proportion of the taxable parcels within the City consistent with and as required by state law.
Employee will keep accurate and complete records of the work performed, including
documentation of the basis for all appraisals done. Employee will cooperate and confer with the
Wright County Assessor. Employee shall attend any sectional meetings called by the Wright
County Assessor. Employee will use generally accepted standards and methods in determining
property values within the City of Otsego. In performing these services, Employee will meet all
deadlines set by law and all reasonable deadlines, in any, either the Wright County Assessor;pr
Auditor or the City.
2. Legal Qualification, Proof and Continuation Thereof. The Employee represents that he is
legally qualified to perform the duties above-described and, further, that he has obtained all
necessary licenses, permits or certifications, including a license from the State Board of Assessors,
and has%otherwise fulfilled all legal obligations requisite to providing assessor services and
performing assessor functions. Within ten (10) days of executing this Agreement and prior to
commencing service, the Employee shall provide proof of proper licensure to the City and shall
remain legally qualified to perform the duties described in this contract throughout its term.
Failure by Employee to provide in section ten (10) below.
3. Terms of Payment. The Employee shall be compensated at the rate of $8.00 per taxable
parcel actually appraised and valued by Employee. It is estimated that there are 2305 taxable
parcels within the City. Payment shall be made based upon an estimate of the proportionate
number of parcels appraised monthly. Any adjustment to this estimate, either higher or lower,
shall be made once a year on or about September 1.
4. Instrumentalities. The Employee shall provide for his or her own vehicle, and any necessary
equipment, tools, materials and supplies, except for nominal office supplies, for the performance
of the obligations specified herein. The City may provide the Employee with periodic access to a
work area within the City offices, including use of a computer and usual furnishings.
5. Training and Expenses. The City shall pay for any training required by the State, including
tuition, mileage, lodging and meals while Employee is attending the required training. Expenses
shall be submitted by Employee as a written claim, to be audited and allowed by the City Council.
6. Insurance Coverage. Employee shall be covered under any and all applicable liability
insurance coverage, including coverage provided through the League of Minnesota Cities
Insurance Trust, while performing the duties of assessor as a part-time employee of the City. The
City shall pay all premiums and keep such coverage current at all times.
7. Exemption from Certain Benefits. The parties and the Employee acknowledges that, as a
part-time, contract employee, under Sec. 1-5.2 of the City's personnel policy Employee is exempt
from that personnel policy, including, but not limited to, paid leave, paid vacation and
disability benefits and other privileges conferred by the personnel policy, but not provided for by
this Agreement. Any and all benefits received by Employee shall be provided pursuant to this
Agreement or as required under applicable state or federal law.
8. Payroll Withholding. The City shall make all necessary withholdings from the monthly
payments made to Employee throughout the term of the Agreement. These include
withholdings for state and federal income tax, social security and PERA.

9. Worker's Compensation. Worker's Compensation insurance has been or will be obtained by
the City on account of hiring the Employee. .
10. Termination, Employment At -Will. The parties intend that this contract create an at -will
employment relationship. Either party may terminate this Agreement at any time for any reason
or no reason at all, with or without cause or notice. In any event, this Agreement shall terminate
on September 1, 2002, on its own accord. All provisions related to termination for cause or any
additional related privileges, as set forth in the City's personnel policy, are specifically not
available to the part-time Employee. Upon termination of this Agreement, Employee will furnish
copies of all records made in performance of the duties specified in the Agreement to the City,
including the basis for and values assigned to each parcel of property appraised and assessed.
11. Option to Extend. Upon written agreement of the parties, the Agreement may be extended
to any other future date mutually acceptable to the parties.
12. Integration, Merger, Modification. This Agreement represents the full and complete
understanding of the parties and both parties represent that they are not relying on any prior
Agreement of statements, whether oral or written. This Agreement may be modified only if in
writing and signed by both parties.
13. Severability. Should any term, provision, section or other lesser part of this Agreement be
found by a Court of competent jurisdiction to be invalid, then said term, provision, section or
lesser part is hereby severed from this Agreement and the remaining provisions of this Agreement
shall remain in full force and effect and shall be binding upon the respective parties hereto.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the day and
year written above.

The City received and opened bids for Project 01-01 on Tuesday, May 29, 2001. A total
of 5 bids were received .as shown on the attached tabulation. The bids ranged from
$113,000.00 to $139,504.78. The three low bids and the engineer's estimate were as
follows:

completed previous projects in the City of Otsego. We, therefore, recommend that the
project be awarded to Buffalo Bituminous in the amount of $113,000.00.

This letter is written in follow-up to the conversations we had last week regarding the
above -referenced matter. As we discussed, my client was in the process of repairing his
garage, which was damaged by heavy snow this past winter, when he received a STOP
WORK notice from the City Building Inspector. My client has asked me to review this
matter because he has been advised by the City Building Inspector that he may have to tear
down his entire garage.
Mr. Fietek has a detached garage, the roof of which was damaged from the weight
of the snow this past spring. He contacted his insurance company and the adjuster
determined that the roof should be torn off and rebuilt. The estimate from the adjuster was
$5,069.15 to replace the roof. Mr. Fietek rebuilt the roof with new trusses and plywood.
While he was at it, my client decided that because the detached garage was old he would
replace the siding so that it would match his house located on the property. He used the old
plywood from the roof to strengthen the sidewalls of the garage and so he would not have
to dispose of that wood. He did not tear down the sidewalls. The sidewalls are the original
walls, and the slab is original. He did add a half block (6 inches) underneath the walls to
protect the siding from water damage.

According to my client and his insurance adjuster, the total value of the work he is
doing does not exceed 50% of the value of the garage. This is a 32 foot by 24 foot by 8 foot
garage. My client has been advised by building contractors that to replace this garage, he
would have to spend at least $15,000.00 to $20,000.00.
I have reviewed Otsego Ordinance Section 15, a copy of which you courteously
provided to me and I appreciate that. It appears that pursuant to Section 20-15-3 C my client
would have the right to perform normal maintenance on this structure. That would seem to
include residing it as well as installing the half block underneath the walls. I do not believe
that either of those items of maintenance constitutes a structural repair or extends or
intensifies the non -conforming structure. It is my client's position that the value related to
the siding and installing the half block should not be included in the overall valuation of the
roof work.
With regard to the new roof that was constructed, it appears that Section 20-15-3 J
would apply. That section states that if a structure is destroyed or damaged to the extent of
more than 50% of its fair market value then it may not be rebuilt. Under this section, if the
building is damaged to an extent of less than 50% of its value, it may be restored as long as
that is done within 12 months of the date of the damage. I believe the new roof construction
that was completed on this detached garage by my client was authorized under this section.
Clearly he performed these repairs within the required time frame, since the snow damage
just occurred a few months ago. The roof damage itself, both in my client's opinion, the
opinion of his insurance adjuster and contractors he has talked to, is less than 50% of the
value of the garage itself.
The end result of all this will be a garage that is more structurally sound, since the roof
has been repaired from the snow damage, and will be more aesthetically pleasing once new
siding is fully installed. It is beneficial both for my client's property and for his neighbors
who look at this building.
My client is hoping that the city will understand his position and will agree that the
work that he has performed and would like to complete is authorized by the pertinent Otsego
ordinances.

BACKGROUND
The City Council considered rezoning, PUD -CUP and preliminary plat applications for
Pheasant Ridge 51' Addition at their meeting on March 26, 2001. The PUD -CUP and
preliminary plat applications were tabled at the applicant's request to allowthem to review
issues of single family lot width and setbacks, and private street design. The applicant has
submitted a second revision to the plat design intended to address these concerns after
withdrawing their first revision.

ANALYSIS
Density. The previous site design had a density of 2.8 units per gross acre. The revised
site plan includes 116 units, an increase of five from the original site design. The density
of the project is 3.0 units per gross acre as currently proposed. The density of the site
plan is within the allowances for low density development guided for the subject site by
the Comprehensive Plan.
Single Family Lots. The proposed R-6 District allows for a more compact, higher density
single family dwelling development pattern than the City's R-4 or R-5 Districts. The
proposed R-6 District requires single family lots to have a minimum width of 60 feet and
ten foot side yard setbacks, or at least 20 feet between structures. Lot width and setback
standards address qualities of visual and practical open space and building massing. In
reviewing the previous site plan that provided 50 foot lot widths and 10 foot building
separation, the Planning Commission and City staff were concerned that the design would
a crowded street appearance and poor separation between dwellings.
The site plan and preliminary plat have been revised to provide the single family units with
55 foot wide lots, with side yard setbacks of 10 feet on one side of the building and five
feet on the other and at least 15 feet between buildings. The changes to the site plan and
preliminary plat has resulted in elimination of two single family units. The applicant
indicated that conformance with the R-6 District standards would result in a loss of four
units from the original site plan.
The structures have been laid out such that the garage side of one structure abuts
another. This creates a larger green area between buildings than if the garages were all
on the same side of each unit. The applicant indicates that there would be more than one
potential building facade for the single family unit, although no additional plans have been
provided. Variation in the building design would serve to mitigate the monotony of having
20 of the same structures in a tightly designed row. We would recommend a minimum of
four different facades be used, with no single facade located closer to the same than every
three units. Such a requirement would serve to prevent the same building face every other
unit along the block or a stretch of the block.
Allowing the five foot reduction in lot width and building separation as part of a PUD should
only be allowed if a finding can be made that the flexibility is consistent with the purpose
and intent of the requirement. The City Council may consider that the dwellings are all
to be a single story, which will have less visual mass than a taller structure. In using one
story structures, the proposed separation between the buildings is approximately the same
as the height of the building.
The previous site plan had also proposed 25 foot front yard setbacks to Street A for the
single family units, whereas 35 feet is required. The revised site plan illustrates a 35 foot
setback for all of the single family lots.
Townhouse Units. The applicant has significantly revised the layout of the townhouse
portion of the project to conform with the City's requirement that private streets serving four
or more of the townhouse units be at least 28 feet wide with concrete curb. The revised
site plan provides a second looped private street from which individual driveways are
accessed. The townhouse units are setback 25 feet from the private street and adequate
space is provided between structures.

The changes to the townhouse layout have also changed the unit configurations as well.
Rows of four or five townhouse structures have been provided along 78th Street and the
east property line in place of the back to back arrangement. The type and size of the unit
does not appear to have changed, just its configuration. There are seventeen fewer of
these larger townhouse units proposed as part of the revised plan. There are also six
more of the structures containing the four of the smaller townhouse units. Overall, there
are seven more townhouses than previously proposed.
Landscaping Plan. The applicant has provided a revised landscaping plan based upon
the revised layout. The revised landscaping plan generally maintains the intensity and
emphasis areas of the original. The landscaping plan includes two boulevard trees per lot
for the single family units, foundation plantings for all of the units, berming and plantings
along 78"' Street and Page Avenue and gateways at the street intersections. As with the
previous plan, the overall landscape plan is an excellent enhancement of the site design.
Guest Parking. The site plan provides 47 guest parking stalls within the townhouse area
and six stalls for the single family units on the north side of 78"' Street. Based upon a
ratio of one-half stall per unit, 48 stalls should actually be provided for the townhouse
uses. There is sufficient area to add an additional stall to one of the guest parking areas
along Streets B, either between units 44 and 45 or 67 and 72. The provision of five stalls
at the curve in Street B may be problematic for visibility and should be reviewed further by
the City Engineer.
Homeowners Association. The applicant indicates that the townhouses will be subject
to a homeowners association for maintenance of common opens space and architectural
control. The single family units are being marketed as "detached townhomes" and also will
be subject to a separate homeowners association for similar issues. Homeowners
association documents should be provided prior to application for final plat and are subject
to review and approval of the City Attorney.
Grading and Utilities. The applicant has provided revised grading and utility plans based
upon the revised site design. These plans are subject to review and approval of the City
Engineer.
CONCLUSION
Overall, the project appears to be an appropriate land use for the area given the wetland
and collector street impacts. The increased number of units results in a slightly higher
density, but it is still within what is considered to be low density. The arrangement of the
townhouse units may actually be preferable, except that the changes result in more of the
smaller units. And, the revised site plan and preliminary plat address the original concern
regarding private street width. The width of the single family lots is still a matter of review
for allowing a five foot reduction in lot width and building separation.

Our office believes that performance standards of the R-6 District allow sufficiently smaller
lots and higher densities for this type of use, which is also consistent with the
recommendation of the Planning Commission. However, the applicant's one level building
design, proposal to mix the building designs and landscaping plan may offset any negative
effects of the width reduction. Based upon the revised site plans and recommendations
of the Planning Commission, our office would recommend approval of the application as
outlined below. Please note that the City Council approved the rezoning application on
March 26, 2001. Therefore the only action that needs to be considered is the PUD -CUP
and preliminary plat.
Decision 1 - PUD -CUP and Preliminary Plat
A. Motion to approve a PUD -CUP and Preliminary Plat for Pheasant Ridge 5t' Addition
based upon the current plan and information received to date, subject to the
following conditions:
Preliminary plat approval does not guarantee access to sanitary sewer
service. The City shall only guarantee sanitary sewer service to approved
final plats with signed contracts or through financial commitment for such
services to assure the City of timely development.
2. The design and construction of all public or private streets and the location
of guest parking stall is subject to review and approval of the City Engineer.
3. The single family lots are revised to a 60 foot width with 20 feet between
structures.
4. A total of forty eight guest parking stalls are provided within the townhouse
portion of the project.
5. A homeowners association is established for the single family an townhouse
units, subject to review and approval of the City Attorney.
6. Park and trail dedication is made by cash fee lieu of land at the time of final
plat approval, subject to recommendation of the Parks and Recreation
Commission.
7. All grading, easement and utility issues are subject to review and approval
of the City Engineer.
8. The applicant must enter into a development contract with the City and pay
all applicable fees and securities upon approval of a final plat, subject to
review and approval of the City Attorney.

Findings of Fact
& Decision
Request: ; Consideration of a PUD -CUP and preliminary plat entitled "Pheasant Ridge 5'
Addition" for development of 116 residential units on property legally described as Outlot B of
Pheasant Ridge (the "property").
City Council Meeting Date: 26 March 2001 and tabled to 29 May 2001
Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact:
1. The legal description of the property is described as Outlot B of Pheasant Ridge.
2. The 38.7 acre property lies within the Sanitary Sewer Service District and is guided for low
density residential land uses by the 1998 Comprehensive Plan Update.
3. The property is zoned R-6, Low Density Multiple Family District; Single family and
townhouse residential uses are permitted uses of the R-6 District.
4. The Planning Commission and City Council must take into consideration the possible
effects of the PUD -CUP with their judgement based upon (but not limited to) the criteria
outlined in Section 20-4-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The Comprehensive Plan designates the property forlow density residential
development. Low density development is defined for local purposes as less than
five units per acre. Although "low density" is typically realized as single family
development, it is possible to develop other housing types within the context of this
land use classification. In this case, approximately 21 percent of the subject parcel
is undevelopable wetland areas or right-of-way. The concept plan proposes 116
units on approximately the gross 38.65 acres, or 3.0 units per acre. As such, the
concept plan is consistent with the direction of the Comprehensive Plan in terms of
density.
The Comprehensive Plan also encourages development of alternative housing
designs or different sizes and costs to supplement existing conventional single family
development in response to market forces. The proposed single family units and
may be distinct from other single family options within the City, which may make
them attractive to specifically to empty nest households. Therefore, within the
parameters of density and performance standards of the R-6 District, the proposed
uses may be considered to be consistent with the Comprehensive Plan.
B. The proposed use's compatibility with present and future land uses of thb area.
Finding. The areas surrounding the subject parcel is planned for low density
residential development. Only the area to the north and northwest has been
preliminaryor final platted with single family residential. Due consideration has been
given to this issue in the layout of the site plan for the townhouses with one story
structures arranged at the perimeter and two story units within the center of the this
area of the project. Further, the majority of the townhouse units on the east
perimeter are setback double the minimum requirement to increase separation from
planned low density uses to the east.
C. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: As a new subdivision, the project will be required to conform to all applicable
provisions of the Zoning Ordinance and terms of the PUD -CUP.
D. The proposed use's effect upon the area in which it is proposed.
Finding: This proposal is within the scope of development anticipated by the
Comprehensive Plan and therefore is not likely to have a negative impact to the
area.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding. The proposed will be served by Page Avenue and 7e Street for primary
access. Secondary access will be provided for most of the units with a future
extension of Street A to the east when the adjacent parcel develops. These streets
will have adequate design capacity to accommodate the proposed development.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Finding. The proposed use is not anticipated to have a negative impact to the City's
service capacity as it is anticipated by the Comprehensive Plan within a designated
service area.
5. The planning reports dated 14 March 2001, 4 April 2001 and 23 May 2001 prepared by the
City Planner, Northwest Associated Consultants, Inc., is incorporated herein.
6. The engineering review dated March 20, 2001 prepared by the City Engineer, Hakanson
Anderson Associates, Inc., is incorporated herein.
7. The Otsego Planning Commission conducted a public hearing at their regular meeting on
19 March 2001 to consider the application, preceded by published and mailed notice.
Upon review of the application and evidence received, the Otsego Planning Commission
clos,ed the public hearing and recommended by a 7-0 vote that the City Council approve
the PUD -CUP and preliminary plat based on the aforementioned findings.
8 The City Council at their meeting on March 26, 2001 tabled consideration of the application
at the applicant's request to allow the applicant an opportunity to meet with City Staff and
attempt to resolve outstanding design issues with the site plan and preliminary plat.
Decision: Based on the foregoing information and applicable ordinances, the requested PUD -
CUP and Pheasant Ridge 5t' Addition Preliminary Plat is hereby approved based on the most
current plan and information received to date, subject to the following conditions:

The Planning Commission considered the CUP and site plan applications for Trudell
Trailers at their meeting on May 21, 2001. No public comments were received during the
public hearing. Mr. Grady Kinghorn, representing the applicant, said that they would meet
all of the conditions recommended in the staff report.
An issue raised at the meeting is that the applicant requires significantly more outdoor
sales area than is currently allowed under the CUP provisions of the 1-2 District. The
applicant's business is essentially a semi -trailer retail sales and leasing dealer. As part
of their business, they also service trailers and deal in some used equipment.
The Planning Commission was generally in favor of accommodating the use based upon
the industrial character of the equipment, existing uses allowed in the 1-2 District and
visibility to 1-94. The applicant was seeking some confidence as to the City's likely hood
to accommodate this use. As noted at the meeting, the proposed building generally meets
all of the standards of the Zoning Ordinance, except for the outdoor storage issue.
Therefore, the Planning Commission recommended approval of the site plan and tabled
the CUP application while directing staff to prepare possible Ordinance amendments for
their July 2, 2001 meeting. This would allow the applicant to proceed with development
of the site while the outdoor sales issue is processed. The motions were passed by a 6-0
vote.
The site plan will be considered by the City Council at their meeting on May 29, 2001.
Findings consistent with the Planning Commission recommendation are attached for
reference.

3. Temporary gravel surfacing as shown on the site plan shall be allowed for a period not to
exceed two (2) years from the date of approval and shall require a performance security
for the cost of installing a bituminous surface as determined by the City Engineer.
4. Outdoor sales and/or storage is to be allowed only as provided for within the 1-2 District.
5. The site plan is revised to illustrate 12 proof -of -parking stalls, subject to a development
agreement as approved by the City Attorney.
6. Perimeter concrete curb is provided at the edge of all bituminous surfaces, excluding the
transition between the circulation area and temporary gravel surfaces.
7. All signage shall conform to Section 37 of the Zoning Ordinance and must have a permit
issued by the Zoning Administrator prior to construction.

Upon Review of the Trudell Trailers Site Plan, we have the following comments:
The legal description on drawings 1 of 2 states "Bauerly Companies
Industrial Park". This should be "Otsego 1-94 West Industrial Park"
2. The Stormwater Pond approved under the Otsego 1-94 West Industrial
Park Final Plat must be shown on drawing 2 of 2 and the future
contours shown on how the matching of grades will occur. Rip Rap
may be needed where the ditches flow into the Stormwater Pond.
3. The future access is shown off of Jalger Avenue is approximately 470'
from 71St Street. This is too steep as shown. 14' drop from Jalger
Avenue to the parking lot in approximately 120' gives a 12% slope.
4. The two driveways off of 71St Street are located 300' and 150' from
Jalger Avenue. The driveway 300' from Jalger Avenue appears to be
a full access while the driveway 150' from Jalger Avenue is an exit
only. Both driveways are in the 1St lot. Our concern is, if there will be
more driveways into the area shown as lot 2 in the future. We would
like to review the volume and type of traffic anticipated in and out of the
property and future plans for lot 2 and possible additional driveways.
Please send us information on anticipated full -development of both lots
and traffic.

The City Council tabled action on the above referenced application at their meeting on
May 14, 2001. This action was taken to allow the applicant to explore alternative
subdivision designs that would not involve the extension of 901 Street to Nashua Avenue.
The applicant submitted revised plans on May 22, 2001. We have made a preliminar
review of these plans and offer the following comments:
Density. The number of lots within the subdivision has been reduced to ten, which is the
maximum number allowed by the Comprehensive Plan under 4 per 40 density rules.
Subdivision Layout. The revised plan provides for a loop street that extends
approximately 2000 feet back into the property with a 450 foot cul-de-sac extending further
south to provide access to the rear portions of the property. The western street is shifted
near the center of the property to circumvent the designated lake, placing it 200 feet from
the eastern street. While the revised subdivision design addresses the need for two
accesses to the subdivision it also raises more issues:
The proposed subdivision would have two accesses to CSAH 39. The two access
points are 800 feet apart, which is less than the quarter mile separation distance
required for accesses onto arterial roadways. The applicant has not reviewed this
design with Wright County.
The looped street causes several double frontage lots and one lot with streets on
all sides, with an average street frontage per lot of 630 feet.

No connections are provided for future street extensions to adjacent properties to
the east, south or west isolating the neighborhood and limiting future access and
circulation in this area.
The amount of streets constructed within the parcel under this scenario would likely
be disruptive to the desired rural open space character of the neighborhood.
• The amount of streets constructed would require a disproportionate amount of
maintenance relative to the number of units making it financially inefficient.
Based upon these concerns, we would not recommend approval of the revised preliminary
plat design. The proposed extension of 90'hStreet would be a better alternative, although
this street would also likely be under utilized and somewhat disruptive to the western
portions of Prairie Park. Extending 901' Street at least provides possible future benefit for
development of the City Hall campus, Prairie Park and Begin property north of City Hall.
Another alternative to what has been proposed is to provide for a street extension to
Mason Avenue through either the Specht, Benson or Beckman properties.
The final option is to construct the original street layout without the extension of 90' Street
to the east. In order to conform with intent of the Comprehensive Plan, future streets
would need to be stubbed to the east, south, and/or west property lines that would allow
for future connections. While the neighborhood would exist as a long cul-de-sac, a
permanent connection would be possible in the future. This option may be adequate as
a given the low number of units and that it the would avoid potential negative impacts and
inefficiencies of the two present proposals. However, this is obviously a less stringent
interpretation of the Comprehensive Plan regarding the ability to develop back 40 acre
parcels than was discussed during the process. Not requiring a connecting street within
the project would have a broad implications for allowing increased development within the
agricultural preserve area with a less efficient land use pattern.

Re: Hidden Creek Trails — Concept Plan
We have reviewed the revised layout for Hidden Creek Trails and have the
following comments:
The general layout has excessive roadway for servicing the number of lots
(approximately 500' of roadway/lot). Many lots have double frontage.
This will require more maintenance (plowing, crack sealing, seal coating,
etc.) per lot than usual and higher assessments when and if an overlay or
reconstruction is required. Streets skirting the edges of the property with
no frontage of leave to the adjacent property owners are discouraged.
The roadway skirting the east edge of the property has little value to the
eastern properties due to a creek crossing being needed.
2. The entrances off of CSAH 39 are approximately 820' apart. The existing
driveways are 170' to the west of the westerly proposed entrance and 290'
east of the eastly proposed entrance. The spacing and site distances
would need to be approved by the county, but appear adequate.
3. The private trail crosses the DNR waterway, Otsego Creek, only once and
does not cross the DNR environmental lake. These are improvements
from the previous plat and may help facilitate the DNR approving the plat
and also removes potential constrictions on Otsego Creek.
The City Council should consider the long-term maintenance costs of the amount
of roadwa� involved for the limited number of lots serviced. Our recommendation
is for a 2" access to come from the west via Mason Avenue. Mason Avenue

was recently upgraded to a 9 -ton road and is only % mile away from the plat. No
road crossings of the DNR Waterway Otsego Creek would be required. If the
applicant has exhausted all means to accomplish this alternative, which would be
acceptable to us, the next best alternative would be a wide entrance split by an
island at CSAH 39. A temporary cul-de-sac could be placed at a location in the
southern portion of the plat at the western plat line to facilitate a future
connection to Mason Avenue. Although this would constitute allowing a 3000'
temporary cul-de-sac, it is our opinion that due to the limited number of lots and
the removal of roadway crossings of Otsego Creek, this would also be an
acceptable alternative.

Listed below are the communities that responded to my request for
information on false alarm charges. As no one charges for the
first false alarm, I have started the list with the second false
alarm in a calendar year. $50/Per means a $50 charge per
incident. $50+/per means that the charge goes up $50 for each
succeeding incident. Some communities varied their charges
depending on whether it was a fire or police false alarm. No one
charged for false alarms filed by someone than the property owner
or renter, for example, a false alarm called in by a passerby
with a cell phone who saw smoke.
