09-24-01 CCCITY OF OTSEGO CITY COUNCIL MEETING SEPTEMBER 24, 2001 COUNCIL CHAMBERS OTSEGO CITY HALL 6:30 PM 1. Mayor Larry Fournier will call the meeting to order. Mayor Fournier called the meeting to order at 6:30 PM. Roll Call: Mayor Larry Fournier; Councilmembers: 'Vern Heidner, Virginia Wendel and Jerry Struthers. Suzanne Ackerman arrived at 6:35 PM. Staff. Judy Hudson, City Clerk/Zoning Administrator; Andrew MacArthur, City Attorney; Daniel Licht, City Planner; Larry Koshak, City Engineer; Carol Olson, Deputy Clerk; and Jerry Olson, Building Official. Absent: City Administrator Mike Robertson. Pledge of Allegiance. Mayor Fournier led in the Pledge of Allegiance. 2. Consider agenda approval. CM Wendel requested to add: Update on the following meetings: EDAAC, River Rider, Drug Task Force, and Community Rec. Mayor Fournier requested to add under 9.2., Election Precinct Count Optical Scan Systems; under Item 7. Signs for Odean Avenue Bike Path; and under Item 4.b. Presentation by Jerry Olson, Building Official. CM Heidner motioned to adopt the Agenda as amended. Seconded by CM Struthers. All in favor. Motion carried. CM Ackerman arrived at this point. 3. Consider the following, minutes: A. September 10, 2001 City Council Meeting_ CM Heidner motioned adoption. Seconded by CM Wendel. All in favor. Motion carried. 4. Open Forum: A. Continuation of Slabtown Assessment Public Hearin Mayor Fournier re -opened the Public Hearing at 6:37 PM. Mr. MacArthur explained the assessment and appeal process. Mayor Fournier opened the Hearing for Public Comment. Bruce McAlpine, Richardson Avenue. Mr. McAlpine questioned why Otsego is charging a higher assessment than Dayton since Otsego was also eligible for the grant Money. CM Heidner replied that Otsego didn't qualify for State grant money because it did not have any pollution problems. Mayor Fournier closed the Public Hearing at 6:40 PM. Earl Schulenbura, Rawlings Avenue. He feels he should not be assessed for the street since his driveway is off Rawlings Avenue and not 62d. He is in the process of getting permanent access to Rawlings. City Council Meeting of September 24, 2001. Page 2. Mr. MacArthur stated the street construction is a benefit to his property since Mr. Schulenburg has the capability accessing 62"d Street. Mayor Fournier directed Mr. Schulenburg to give the City proof of his permanent access within 30 days. Mayor Fournier directed staff to place adopting the Slabtown assessment on the October 22, 2001 City Council Agenda. B. Special presentation b�rry Olson Building Official Building Inspector Olson reported on the 7976 Odean Avenue property. C. Open Forum. Bruce McAlpine, Richardson Avenue. No one has contacted him regarding the storm water pooling on his property. Mayor Fournier directed City Engineer Koshak to contact the Dayton Engineer to get in touch with Mr. McAlpine. 5. Consent Agenda. (Non -controversial items) 5.1. Approve Claims List. 5.2. Approve Resolution 2001-28 Adopting the State Building Code 1997 Fee Schedule for Calculating Building Permit Fees CM Heidner motioned adoption. Seconded by Ackerman. All in favor. Motion carried. 6. Dan Licht, City Planner: A. Consideration of Amendment to Zoning Ordinance regarding detached Accessory building area within the rural service area Dan Licht presented the Planner's Report. CM Heidner motioned to approve an Ordinance No. 2001- amending the residential accessory structure provisions of the Otsego Zoning Ordinance for detached accessory structures within the rural service area. Seconded by Mayor Fournier. All in favor. Motion carried. B. Parks and Trails Plan. Dan Licht presented the Planner's Report. Mayor Fournier recommended identifying an area in the west for a park. Mike Day, Chair of the Parks Commission, stated the Parks Commission felt that before they can select an area for a park they need to see a plan depicting residential growth, type of recreation for park, etc. CM Heidner motioned to adopt the Comprehensive Park and Trail Plan and to include the map showing a search area in western Otsego and include language regarding sidewalks on both sides of through streets in residential areas in the sanitary sewer district. Seconded by Mayor Fournier. Voting For the Motion: Mayor Fournier, CM Heidner, CM Struthers, and CM Ackerman. Voting Against the Motion: CM Wendel. Motion carried four (4) to one (1). CM Wendel objected to the requirement of placing sidewalks on both sides of through streets and suggested requiring sidewalks on only one side. City Council Meeting of September 24, 2001. Page 3. 7. Larry Koshak City Engineer: 7.1. Consider acceptance of the Feasibility Report for 85`h Street (Today Empert Larry Koshak presented the Feasibility Report. Andy MacArthur recommended that the Council accept the Feasibility Report tonight and order a Public Hearing. Robert Day commented that the cul-de-sac in the Feasibility Report is longer than the one approved at Preliminary Plat and would go through a wetland. Jim Kolles and Julene Brant, representatives of the Vernon Kolles Estate, were present and they supported the Council ordering a Public Hearing. CM Heidner suggested using a higher estimate for easements and land. CM Heidner motioned to accept the Feasibility Report, subject to possible revision of the estimate upward to cover additional land acquisition costs. Seconded by CM Ackerman. All in favor. Motion carried. CM Wendel motioned to set the Public Hearing for the 85`h Street. Extension Improvement on October 22, 2001, 6:30 PM. Seconded by CM Ackerman. All in favor. Motion carried. 7.2. Set date for vacation hearing and closure of Parsons Avenue from Quaday Avenue to 70`h Street Council set October 29, 2001, 6:30 PM Public Hearing for vacating Parson Avenue 7.3. Consider acceptance of the Feasibility Report and order the improvement Project for Page Avenue 79`h Street to 85`' Street CM Heidner motioned to rescind the motion previously made at the September 10, 2001 City Council Meeting to do the graveling of Page Avenue from 79`h Street to 85a' Street this fall and to direct City Administrator Robertson to contact IDS 728 regarding a transportation plan for the neighborhood. Seconded by Mayor Fournier. All in favor. Motion carried. Mayor Fournier motioned to accept the Feasibility Report dated September 6, 2001 and approve Resolution ordering Plans and Specs for the Page Avenue Improvement from 79`h Street to 85`a Street with construction starting in 2002. Seconded by CM Struthers. Construction will start in 2002. All in favor. Motion carried. 7.4. Update on Regional Transportation Planning Committee Mayor Fournier will attend the October 26, 2001 Meeting at the Stearns County Public Works with either Larry Koshak or Ron Wagner. 7.5. Any other engineering business Council directed staff to order the "no motorized vehicles signs" for the Odean Avenue Bike Path. City Council Meeting of September9, 2001. Page 4. 8. Andrew MacArthur City Attorney A. Snowmobile Ordinance Mr. MacArthur reviewed the changes. The Council made the following changes: Remove B. on page 3 regarding minors. Leave the hours as written. No map requirement. Go with Option 2 on page 5. Include language to stay within 6 feet of the roadway edge. Directed staff to prepare a map designating areas with more stringent regulations. B. Facility Use Policy. The Council tabled this until the next City Council Meeting. 9. Council Items: A. Discussion of curbside recycling. Mayor Fournier asked staff to provide the Council with information from other cities regarding their recycling programs and organized garbage service. B. Update on West and East Sewer Plants. Larry Koshak informed the Council the soil borings on the Duerr property won't be done until after the corn crop is removed. C. Community Recreation Meeting CM Wendel recently attended a Community Recreation meeting where handouts were distributed regarding finances. D. Drug Task Force Advisory„ CM Wendel asked staff to check how much money has been given to Wright County Drug Task Force in the past few years and if it is a budgeted item in 2002. E. EDAAC A joint meeting with the City Council has been set for October 15, 2001, 6 PM. F. River Rider CM Wendel stated they will be looking at a joint powers agreement with Sherburne County. 9.2. Judy Hudson City Clerk City Clerk Hudson recently attended a demonstration on a new Elections System Tabulator and recommended purchasing two systems at $4,450 plus tax. CM Ackerman motioned to approve the purchase of two Elections System Tabulators and to apply for a grant from the State. Seconded by CM Struthers. All in favor. Motion carried. Closed meeting for Attorney/Client privilege CM Ackerman motioned to close the City Council Meeting for the purpose of attorney/client privilege. Seconded by CM Wendel. All in favor. Motion carried.
