11-29-01 CCCITY OF OTSEGO CITY COUNCIL MEETING NOVEMBER 29, 2001 COUNCIL CHAMBERS OTSEGO CITY HALL 6:30 PM Please note the regularly scheduled City Council Meeting scheduled for November 26, 2001 was cancelled due to inclement weather and was rescheduled for November 29, 2001. 1. Mayor Larry Fournier will call the meeting to order. Mayor Fournier called the meeting to order at 6:30 PM. Roll Call: Mayor Larry Fournier; Councilmembers: Virginia Wendel, Suzanne Ackerman, Vern Heidner and Jerry Struthers. Staff. Mike Robertson, City Administrator: Judy Hudson, City Clerk; Andrew MacArthur, City Attorney, Dan Licht, City Planner; Ron Wagner, City Engineer. Pledge of Alle iance Mayor Fournier led in the Pledge of Allegiance. 2 Consider agenda approval. CM Wendel requested to add Community Rec. and Otsego Creek Meeting under Item 9. Mike Robertson requested to add under Item 9 the Aslagson property, under Item 8.3, along with the East Sewer Expansion Contract. Mayor Fournier requested to remove Item 8.2. The Sheriffs Contract and place on the next City Council Agenda, and under Item 9.h. To set a Workshop to discuss law enforcement, and under Item 7.1. Set a workshop to discuss the West Sewer Treatment Plant. CM Wendel motioned to adopt the November 29, 2001 City Council Agenda as amended. Seconded by CM Heidner. All in favor. Motion carred. 3. Consider the following minutes: 3.1. November 13 2001 City Council Meeting Mayor Fournier motioned adoption. Seconded by CM Struthers. All in favor. Motion carried. 4. Open Forum• Steve Wiltermuth, 8937 Obrian Avenue. Mr. Wiltermuth stated concern with the pond in Meadowlands on the east side. He was told the water would be directed to Otsego Creek. There is currently water in the pond and the water is directed to Obrian Avenue. Mr. Wiltermuth said he was told this density for Meadowlands was allowed because the developer would eliminate the water problem and doesn't feel this was done. ylayor Fournier directed the City Engineer to report back to the Council within a month and to give )vir. Wiltermuth a copy of the report. City Council Meeting of November 29, 2001. Page 2. 5. Consent A_enda. 5.1. Approve Claims List. CM Wendel motioned to adopt. Seconded by CM Struthers. All in favor. Motion carried. 6. Dan Licht, City Planner: 6.1. Amendment to Zoning Ordinance Section 37 re arding_allowed signage Dan Licht presented the Planner's Report. CM Struthers motioned to approve the Zoning Ordinance Amendment. Seconded by CM Heidner. All in favor. Motion carried. 6.2. Rezoning. Preliminary and Final Plat for Autumn Woods III Addition Applicant has requested to move this to the December 10, 2001 City Council Meeting. 6.3. Vintage Golf Course Concept Plan. Mayor Fournier stated that although he feels this is a good project he has two issues he would like the Planning Commission and City Council to discuss before addressing this request. He would like the densities with sewer and water in the Ag. Area discussed, along with the Resolution regarding no more townhouse development. CM Ackerman motioned to table this application. Seconded by CM Wendel. All in favor. Motion carried. CM Heidner motioned to set December 17, 2001, 7 PM, as a joint workshop with the City Council and Planning Commission. Seconded by Mayor Fournier. All in favor. Motion carried. Mayor Fournier directed Dan Licht to prepare a report for this workshop. 7. Ron Wagner. City Engineer: 7.1. Discuss Preliminary West Sanitary Sewer Report December 6, 2001, 4 PM was set for a workshop to discuss the Report. After Council discussion the following motion was made. CM Wendel motioned to support Site No. 2 (Duerr/Slavik) and for the Sewer Sub- committee to start negotiating with the landowners. Seconded by CM Struthers. All in favor. Motion carried. 7.2. Consider approval of Final Pay Estimate for 1999 Otsego Overlays. CM Heidner motioned to approve the Final Pay Estimate of $198,582.95. Seconded by CM Wendel. All in favor. Motion carried. 7.3. Other Engineering Items. Ron Wagner said that the 77`h Street Culvert Project is completed. The Bike Path on Kadler Avenue and the overlay is completed. 8. Andrew MacArthur, City Attorney: 8.1. Update on Court Filings on Nuisance actions Mr. 1V1acArthur updated the Council on the Nuisances he is working on. Mr. MacArthur also went over his attached memos on Police Service and a Gravel tax. City Council Meeting of November 29, 2001. Page 3. 8.2. 202/2003 Sheriffs Contract. This Item was removed from the Agenda to be discussed at the Workshop. 8.3. Any other Legal Items 8.3.1. East Sewer Plant Expansion Contract. CM Heidner motioned to approve the Resolution No. 2001-36 approving the contract between the City of Otsego and Gridor Construction for Expansion of City Wastewater Treatment Facility. Seconded by CM Ackerman. All in favor. Motion carried. 9. Council Items: A. East & West Sewer Plant Update Previously discussed under Engineering and Legal Items. B. Consider canceling the December 17 2001 Planning Commission Meeting C. Consider canceling the December 24 2001 City Council Meeting_ CM Heidner motioned to cancel the December 17, 2001 Planning Commission Meeting and the December 24, 2001 City Council Meeting. Seconded by Mayor Fournier. All in favor. Motion carried. D. Consider the joint commission brainstorm session for January 22 2002 at 6 PM. Mayor Fournier motioned to accept the recommendation. Seconded by CM Ackerman. All in favor. Motion carried. E. Discussion of changing_police hours CM Struthers motioned to start Otsego's own Police Department. Motion failed for a lack of a second. January 10th, 2002, 7 pm Thursday was set for a City Council Workshop to discuss a potential Police Department. F. Discussion of Albertville Fire Contract Mayor Fournier motioned to accept the 2002 Albertville Fire Contract and $65.00 per parcel for 2002. Seconded by CM Struthers. All in favor. Motion carried. G. Community Rec. Meeting and Otsego Creek Authority Meeting_ CM Wendel updated the Council on these recent meetings. 9.1. Mike Robertson City Administrator: No items. 9.2.
