Please be advised that the Planning Commission held a public hearing February 4, 2002
to consider the above request. There were no comments from the public. The Planning
Commission discussed the area of Parcel B, which must be reduced approximately 1.05
acres to meet the maximum lot size requirement within the A-1 District. This issue was
resolved when the applicant suggested transferring the necessary land to another parcel
at the southwest corner of Parcel B, which is also owned by one of their children. The
Planning Commission incorporated this solution as part of their recommendation, voting
5-0 to recommend approval of the request.
The City Council will consider the application at their meeting on February 11, 2002 at
6-30 PM. The following options are provided for action by the City Council based upon the
recommendations of City Staff and the Planning Commission -
A. Motion to approve a conditional use permit for lots sizes larger thatn 2.5 acres
within the A-1 District and a preliminary/final plat based upon the submitted survey
subject to the following conditions:
A preliminary and final plat in the form required by the Subdivision

3. Parcel B is revised so as not to be more than 10 acres In size by transferring
the necessary amount of land to PID#323301 as part of the preliminary and

4. A deed restriction is placed on the balance of the property outside of Parcels
A and B prohibiting further residential development until such time as the
property may be rezoned.
5. All easements as required by the Subdivision Ordinance are provided for on
the preliminary and final plats.
6. The need to dedicate additional right-of-way for CSAH 37 is subject to
review and approval of Wright County and the City Engineer.
7. Ail grading. drainage and utility issues are subject to review and approval of
the City Engineer.
B. Motion to deny the request based upon a finding that the request is inconsistent
with the Comprehensive Plan, Zoning Ordinance, and Subdivision Ordinance.
C. Motion to table the application.

Request: Consideration of a conditional use permit for A-1 District lot sizes between 2.5 acres
and 10.0 acres and a preliminary/final plat for division of an existing farmstead and detachment
of 2.28 acre and 1.05 acre parcels from an existing 150. 10 acre parcel located along 60'h Street,
west of Oakwood Avenue.

Findings of Fact: Based upon review of the application, the recommendation of the Planning
Commission and evidence received, the City Council of the City of Otsego now makes the
following findings of fact -
1 . The legal description of the property is described by attached Exhibit A.
2. The 150.10 acre property lies within the Urban Service Area Reserve and is guided for
agriculture land uses by the 1998 Comprehensive Plan Update, as amended.
3. The property is zoned A-1, Agricultural Rural Service District- Residential divisions within
the A-1 District must have a minimum area of one (1) acre and a maximum area of two and
one-half (2.5) acres.
4. The Planning Commission and City Council must take into consideration the possible
effects of the Zoning Map amendment with theirjudgement based upon (but not limited to)
the criteria outlined in Section 20-3-2.F of the Zoning Ordinance:
A. The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding.- The Comprehensive Plan allows for limited divisions of existing parcels
within the A -I to accommodate land transfers and maintain large contiguous parcels
for continued agricultural activities until the area urbanizes. The proposed division
does not result in any additional buildina sites and is consistent with the densi�
prescribed by the Comprehensive Plan for the Urban Service Area Reserve.
B. The proposed use's compatibility with present and future land uses of the area.
Finding.- The proposed division will not greatly alter the character of the area in that
no new dwelling sites are being established. The division also has the effect of
11 squaring" the parcel configurations in the area.
C� The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding.- The need for lot sizes greater than two and one-half acres is the result of
existing building locations on the farmstead and property configurations in the area.
Further, the proposed project will be required to conform to all applicable
requirements of the City's Zoning and Subdivision Ordinances.
D. The proposed use's effect upon the area in which it is proposed.
Finding.- The division Is not anticipated to have any perceptible effect to the area.
E. The proposed use's impact upon property values of the area in which it is proposed.
Finding.- Although no study has been completed, no negative impact to area property
values is anticipated to be caused by the project.
F. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding.- The proposed subdivision will not result in any traffic increases as no new
dwelling sites are being established.
G. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Finding: No impact to City services will result from the proposed subdivision.
S. The planning reports dated 31 January 2002 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.
6. The Otsego Planning Commission conducted a public hearing at their regular meeting on
4 February 2002 to consider the application, preceded by published and mailed notice.
Upon review of the application and evidence received, the Otsego Planning Commission
closed the public hearing and recommended by a 5-0 vote that the City Council approve
the CUP and preli m , iinary/fi. n -al based on the aforementioned findings.

Decision: Based on the foregoing information and applicable ordinances, the requested CUP and

The County has completed the realignment of the intersections of CSAH 18 and CSAH ' )7 in the
southeast comer of the City.
The realignment was a necessary safety improvement to remove bad site lines. As part of the
realignment, the County relocated the connection point of Jaber Avenue to the east of the
intersection.
The County is now in the process of turning over the acquired right-of-way and Jaber Avenue
back to the City of Otsego and Monticello Township.
Jaber Avenue is on the line between the two local governments, but this portion is maintained by
the City of Otsego as part of a mutual agreement.
I have reviewed the site and found it acceptable. I spoke to Mr. Chase and he stated they are
currently maintaining it and it is acceptable. There are clumps of grass, which have been rolled
over into the ditch. This is a common occurrence during the first snow plowing after
reconstruction of a rural section as the boundary between grass and gravel is not yet established.
The clumps will be mulched during the first mowing.
We recommend approving the turnback of the right-of-way for Jaber Avenue from the County to

At the last Council meeting, * I was asked to verify whether or not it was possible under
State statute to have non- Council EDA members stand for election rather than be
appointed. Enclosed please find a copy of Minn. Stat. 469.095. Subdivision I of the
statute clearly states that commissioners are appointed by the Mayor, with the approval of
the City Council. Initial terms depend upon the size of the EDA, but appointments after
the initial appointment are for six- year ternis.
An appointed Commissioner can only be removed for cause during his term. Removal
must be based upon the reasons listed in the statute and can only be accomplished after
notice of charges and a hearing. Minn. Stat. 469.095, Subd. 5 (attached).

The current moratorium on residential subdivisions within the sanitary sewer district will
expire on March 26. State statutes allow the moratorium to be extended one time for an
additional 18 months. It appears that the City has no choice but to extend it. The
moratorium issue is raised at this point in order for the Council to consider where the City
is at this point relative to capacity, and whether the extension should be under the same
terms and conditions as the original interim ordinance.
I have enclosed for your information a copy of the current interim ordinance. Both Ron
Wagn - er and Dan Licht may have additional information regarding platted lots and plant
capacity.

Re: Otsego Wastewater Treatment Capacity Issues
Dear Mike:
As requested, I have reviewed the entire existing sewer serviced properties and
all final platted lots. I have also reviewed all of the areas that are either
preliminary platted or in sketch plan phase.
This was completed to better understand where the city stands in regards to the
amount of sanitary sewer service available.
Currently, the city has a wastewater treatment plant capable of handling 200,000
gpd, of this 200,000 gpd; Otsego has allocated 40,000 gpd of the capacity to the
City of Dayton. This leaves 160,000 gpd or 640 residential equivalent
connections (REC's). Currently, the City of Otsego has either final platted or
connected sewer service to a total of 1153.6 REC's (see table 1).
Although the total REC's is greater than the Wastewater Treatment Plants
capacity, this should not pose a problem because a majority of the 1153.6 REC's
are not live. The City of Otsego Wastewater Treatment Plant has a permit to
discharge up to 400,000 gpd and the City has approved the go ahead on
constructing the expansion of the Wastewater Treatment Plant. This means, in a
few months, the city should have the capacity of 360,000 gpd or 1440 REC's.
The city has approved several preliminary plats and/or has assessed property for
sanitary sewer service. These properties total 314 REC's (see table 2).
Combining this with the 1153.6 REC's from Table 1, gives a total of 1462.6
REC's. This is slightly more than the 1440 REC's provided after the Wastewater
Treatment Plant expansion.
In addition, there are two properties, which have sketch plans in and will be
requesting sanitary sewer service in the near future. These are Otsego's
Waterfront (east and west). These have been approximated at 184 REC's (see
table 3).

In conclusion, we are near the maximum number of final plats the city can
approve and any new developments (commercial, industrial or residential) should
be informed of the lack of sewer capacity and a moratorium on any new
developments in the east sanitary sewer district is recommended. The danger is
that continued development beyond the 400,000 gpd threshold could over
burden the treatment plant and cause effluent to not meet MPCA Permit
Standards. This could have a negative impact on the City's chance for a MPCA
Permit to a 1 M GPD Plant.
