Background:
This item was added to the Agenda by the request of Judy and Bernard Roden, who has retained Rod
D'Aigle as their Attorney. This is a formality said Judy Roden. They are asking for Otsego to approve
their Annexation request.
For the Council's information, I talked to Gary Hale, Administrator from Albertville on 1/3/96
(Wednesday) and I informed him that we are appealing the annexation of D'Aigle and Roessler (Kenco)
properties to District Court. He in turn informed me that the Albertville City Council approved the
annexation requests for Bernard Roden, the Vetches (Bridget, Daniel, Marlene and Bernard) and
Belfany Corp. properties. See attached map. Rod D'Aigle is the attorney for all of these properties.
I called Judy Roden today to get more information. She said that she and Bernard are asking for the
Council's blessing on the 90.45 acres which is PID 4118-800-352100. Rod D'Aigle will probably
address the other properties also.
Today, 1/4/95 I contacted Jerry VonKorff, Atty. to let him know the above information. I asked him
how he feels we should handle this. His advice is to let them know are position is that we are
committed to working with Albertville and if they want this to get done they should work towards
working together. He also thought we should ask them what they have in mind as to use of property,
and inform them that we have appealed the D'Aigle and Roessler (Kenco) Annexation order.

WHEREAS, the Elk River Star News is a qualified newspaper of general circulation
within the City of Otsego:
BE IT RESOLVED that the City of Otsego designates the ELK RIVER STAR NEWS as
the City's official newspaper effective immediately.
BE IT FURTHER RESOLVED that all ordinances and any other matters which are
required by law to be published in an official newspaper, and all other matters which the City
Council shall deem advisable and in the public interest to be published, shall be published in the
ELK RIVER STAR NEWS.

NOW, THEREFORE, BE IT RESOLVED, that the City of Otsego designates the

in investment securities that are insured by the Federal Deposit Insurance Corporation or
other United States Government Agencies. Investments shall be in accordance with
investment securities allowable under the State of Minnesota investment guidelines for
municipalities. The City Treasurer shall deposit all or any part of the City's funds into the
approved depositories and withdraw the same when necessary, or when directed by the
City Council.
The motion for the adoption of the foregoing resolution was duly seconded by
Councilmember and upon vote being taken thereon, the following voted in favor thereof:

of living increase for employees

Background:
At Budget time a 3% increase for employees was figured into the budget for all employees.
I have added this to the Consent Agenda.
We are in a transition period as far as Flow Charts, Job Descriptions, Regular Employee Interviews
etc. We decided when the Personnel Policy was adopted, that we would have no more contracts as we
have had in the past. Due to the re -organization of the City I recommend that we not have contract
reviews by Council this year, but have employee reviews in October or November of 1996 when we
have the re -organization in place.
Staff Recommendation:
My review of Otsego Employees is that we have hard working, dedicated employees who care about the
City of Otsego and deserve this 3% increase in wage to become effective January 1, 1996 and my
recommendation is to approve 6.3. cost of living increase for employees.

Background:
The Home.Occupation /Home Extended Business portion of the Ord was brought forward for
amendment by the EDAAC. The Council voted the amendment with changes on 12/11/95 and
asked that Andy MacArthur, with NAC's help rework the Ordinance to incorporate the amendment and
bring it back to the City Council.
STAFF RECOMMENDATION:
Andy MacArthur has had a hard time working with the information he was given on the Ordinance
Amendment and is bringing it back to the Council with some changes and some proposed changes and
needs to have more information from the Council on how to handle certain aspects of the Amendment
to the Ordinance. Discussion of same will hopefully clarify the problems and the solutions.
8.2.
BACKGROUND:
Discussion of Andy MacArthurs Proposed Legal Services Contract. The Council had this at the last
Council Meeting, but asked to have more time to review it. Attached is a copy of the contract proposed
for legal services and the Council may wish to have some discussion of same with Andy.

Background:
This drug testing policy was brought up and tenatively approved at the last Council Meeting. I was to
bring a Resolution back of a drug policy. This was continued to the 1/8/96 Council Meeting. I have the
material I received from the Association of Minnesota Counties MEDTOX which I will copy for the
Council. I have not had time to do a Resolution, but we are signed up with MEDTOX.
I request that the Council gives me time to thoroughly review this information and present a Resolution
on same at the January 22, 1996 Council Meeting.

The letters have been sent out to the prospective committee members and chair candidates for the
Committee to consider consolidation. We have received a resume from Bob McEachern, who agreed he
would like to chair the committee. (Albertville also received only one resume back and turned only one
name in to the Municipal Board) We received resumes back from the following for committee

To: Mayor Norman Freske, and Council Members, City of Otsego:
I am sure you are aware of my interest in the City of Otsego, as well
as the surrounding communities.
The year of 1996 will be my 49th year as a resident of Otsego. Some
of my accomplishments have been:
1) Helped organize and build the Elk River golf course, and served on
the Board of Elk River Country Club for 23 years.
2) Helped build the present Masonic Hall in ilk River.
3) Served on the Otsego Township Planning and Zoning Board since it
started, and on the City of Otsego Planning and Zoning 3oard.
4) Served 12 plus years on the Wright County Planning and Zoning Board.
5) Am a member of the Wright County Historical Society Board.
To go back a few years, I would like to mention that my favorite classes
at the University of Minnesota were Accounting, Cost Accounting, Auditing
and Transportation as concerned with Interstate Commerce rates.
In the 501s, I was a delegate to a convention in Chicago with delegates
from all 48 states, as well as from Canada. The U.S.delegates totaled
around 1,000 and about 300 from Canada.
After about 5 days of business, It had reached an impass over a certain
issue creating two factions. I convinced some delegates to hold a caucus
to discuss a resolution I had regarding the matter, and to appoint some-
one to present it to the full membership. It was agreed that the
resolution would be presented by me, which made me a bit nervous as I had
never addressed an audience over 150 before.
With "knees a knocking" and standing before the "mike" explaining reasons
for and reading the resolution which would end the impass - a vote was
called for and it passed. Sure was a good experience.
I am intensely interested in Otsego and the area as well �E AlbertYille.
I feel it would serve the citizens well to combine the two cities.
It would not be fair to Otsego to keep handing piece meal annexations
to Albertville. Many years ago I felt there should have been unification.

by the League of Minnesota Cities and was shown at our 1995 Regional Meetings. It is yours to

The number of employment claims and lawsuits involving Minnesota Cities has increased
significantly in the last few years. Employment law can be very complicated and it is important
for city officials to recognize issues and to know when they need help. This videotape is designed
specifically to show city officials what is involved in an employment discipline situation. It
focuses on the fictional Minnesota City of Mosquito Heights and what happened when the city
council wanted to fire the Park and Recreation Director.

THE COMPLEXITIES OF EMPLOYMENT LAW
Questions to Answer Before Beginning Any Employment Action
♦ Does your city have a personnel policy?
♦ Is the employee a veteran?
♦ Is there a union contract, civil service system or employment agreement in effect?
♦ What is the employee's work history?
♦ Does your city have records to support the proposed employment action?
♦ What has been your city's past practice in similar employment issues?
♦ Does the employee have any injury or condition that affects their ability to do the job?
♦ Has the employee made any complaints against the city?
Document! Document! Document!
You must be able to support your actions. Generally, the best way to do this is to have
written records showing the employee's work history, evaluations, and any complaints made against
the employee. Written documentation can show what you have told the employee and the
procedure that you have followed. Records can also support the idea that you have treated other
employees the same way in similar situations and that you have complied with other state and
federal laws.
Specify why a person is being terminated.
If you cannot specify why the person is being terminated, it may be possible to infer an
illegal reason such as discrimination or retaliation against the employee. Discrimination is illegal
under both federal and state law on the basis of such things as race, religion, gender, disability, and
age. Employers can't retaliate against an employee under the Whistle Blowers statute. Nor can
employers retaliate against employees who have filed workers compensation and human rights
claims.
Know your process and follow it.
One of the hardest things to defend is a city failing to follow its own personnel procedures
provided in a personnel policy, civil service system or agreement. It is important to know what your
city's procedures are and to use them.

Stick to the subject.
There have been cases where it has been claimed that the city did not really terminate an
employee for the reason that the city has provided. This type of claim may be provenby comments
or written materials from city officials that suggest that there are other reasons for the action. Often
these other reasons may be illegal such as discrimination or retaliation. You should also be
concerned over possible claims stemming from an employment decision, such as defamation
(defamation --slander or libel.) It is important that you discuss only the facts and issues and avoid
innuendos and rumors.
Be aware of many potential issues involved.
There are many issues in employment that may affect how a city handles a particular
' situation. Some of these include Veteran's Preference, discrimination laws, Open Meeting Law,
Data Practices Law, procedural requirements, and the Family Medical Leave Act.
Get good advice.
Contact your city attorney and the League of Minnesota Cities for advice on what to do in an
employment situation. In some situations, you may also want to contact an attorney who specializes
in employment issues for advice. It may cost time and trouble to pay an attorney at the beginning of
an incident, but it can be less expensive than going through the costs of litigation.
There are costs involved.
Getting advice and following procedures can be expensive. If a situation becomes a lawsuit,
there are not only legal costs but also other expenses for the city. City employees and officials will
have to take time from city work to provide information to attorneys. In many cases, the morale and
working relationships of other employees can also be affected.
Slow down.
There is usually no rush to make employment decisions. You can take the time to obtain
advice and follow your procedures. Even if you consider it an emergency and a matter of public
safety to remove the employee from the job, you can take time to make serious decisions. You may
put an employee on paid leave in order to complete an investigation. This would remove the
employee from the position without putting the city at risk for a hasty ill-advised decision.
Do what you need to do, just be cautious.
Employers should not be afraid to deal with employment issues. However, since these
matters can often be complicated, you should proceed with caution and start by getting help. Call

taking any action.

Earlier this year I contacted you in reference to forming a
Citizens Committee to provide input as to the law enforcement needs
of specific areas and communities. Information garnered from this
and future meetings would be passed on to the patrol officers and
detectives working that area. We will also use this input to help
prioritize the use of the two officers who are working under the
COPS Federal grant program. These officers have been hired and are
currently receiving specialized training in Community Policing
techniques.
I have set the date for the first meeting of the Citizens Committee
to take place on Wednesday, January 24th. It will be held in the
Community Room of the County Courthouse Annex at 7 p.m.. As I
mentioned in my previous letter, if you do not wish to attend,
please choose a alternative representative from your schools,
churches, civic groups, of your local government unit.
The agenda will tentatively be as follows:
1. An overview of the present configuration of the Sheriff's
Department, its different units, and how it is structured to serve
you.
2. The Committee members will then break up into smaller groups by
geographic area. They will then meet with patrol deputies,
supervisors, and detectives that work that area of the County. Law
enforcement problem problems specific to that area, as well as
general problems, can be discussed. (These officers will then bring
the issues, and suggestions for addressing them, back to the
Sheriff's Department Administration for action).
3. The Committee will reform as a whole and critique the usefulness
of the process, as well as the possible scheduling of a future
meeting.
4. Adjourn.

Mayor Freske called the Workshop Meeting to order at 6:30 PM.
Roll Call: Mayor Norman F. Freske; Councilmembers; Suzanne Ackerman, Ron Black,
Larry Fournier and Vern Heidner.
Staff: David Licht, City Planner; Larry Koshak, City Engineer; Elaine Beatty, City
Clerk/Zoning Administrator; Judy Hudson, Deputy Clerk.
Larry Koshak reviewed the preliminary study for sewer and trunk facilities proposed in the
Bonestroo Study. The elements are: Trunk Facility, Treatment Plant and Lateral System.
Mr. Koshak will be discussing the trunk facility.
He focused on what was discussed previously, which was the area the City wants to
service in Phase I. The general boundaries for Phase I - Serving the commercial property
along 101 from CSAH 42 North to 96th Street; serve future residential needs in the
present urban service area. Mr. Koshak's concept is to first service the area he outlined as
Phase I, suggesting a lift station at CSAH 42 and 101 and trunk lines up along CSAH 42.
In the Bonestroo Study, the majority of the trunk facilities are along the river down to
Dayton, then to the treatment plant. This plan would primarily be servicing the eastern
end of the City. Mr. Koshak pointed out trunk lines going along the river appear to be
more expensive because of an additional lift station. Also, if lines go along the river, that
area would be the first to develop. Mr. Koshak had understood the City's priority is for
development along 101 first.
CM Fournier asked if trunk lines are being sized large enough to be able to service the
populated area. Mr. Koshak said there are oversized lines and he recommended to also
size the lift station to handle the future flow.
David Licht said a concern of focusing in the Southeast Corner, is it would be a long way
away from serving the existing populated area.
Larry Koshak said a typical 40 acre parcel of residential could produce 100 REC units,
which would be able to pay for trunk facilities in Phase I for one year. He also said that it
would make sense to start in the CSAH 42 and 101 area with City Water being there.

A trunk line all the way up and around TH101 and CSAH 42 area and a lift station is
approximately $2,200,000 for trunk facilities in Phase I.
The cost of trunk and treatment should be around $5,000 per REC when the trunk is
$2,100 per REC.
A REC is a residential home with an average 2.5 people per house with an average of 250
gallons per home.
Commercial property would yield about 500 gallons per day per acre or 2 REC'S per acre.
Industrial property is higher.
It appears that Phase I would accommodate about a 1000 REC.
CM Heidner questioned what the next step would be, in letting Bonestroo continue along
even though Otsego might want to change the trunk lines.
Mr. Koshak suggested not to have them stop but just to send Bonestroo a memo to put in
the study what area to service first, which is focus along 101 and CSAH 42 as Phase I.
CM Heidner was concerned with Bonestroo asking for more money for any changes.
Larry Koshak explained that this is a study, they are trying to develop some costs studies.
David Licht pointed out this information was provided for reaction. CM Black agreed and
his concern that Phase I is Otsego's Focus and if this plan doesn't get done, then
Bonestroo has failed to take in Otsego's Long and Short Range Plans.
Mr. Licht stated it is critical to get your reaction on record and what should go in the
report and that the study addresses what Otsego's wants.
CM Fournier asked about the Met Council involvement.
David Licht discussed the Met Council involvement in this and basically they would only
address transportation. The Met Council will see that Otsego is addressing the problems.
Larry Koshak reported he has a report from the Met Council stating they can't serve the
NW Corner of Dayton and they will have to do some thing on their own.
CM Black mentioned that Dayton is very flexible and all they want is to sewer one area
and probably could buy the service and not own it.
CM Fournier said several residents have called him as to where the treatment plant is
going. Everyone told him to just remind the residents that this is just a study.
CM Fournier asked how much money is saved by three communities going jointly and not
going on our own. Mr. Koshak and Mr. Licht said there is a certain amount of savings the
way you are going, the group can get more bonding with three jurisdictions and grants.
CM Black suggested to have the City Council put together a memo outlining the concerns
as discussed at this workshop and tell Bonestroo Otsego's Plans. The Council agreed and
advised the City Clerk to do this along with input from the City Engineer.

Mayor Freske brought up that SKB Demolition asked about putting in a Demolition
Landfill in Otsego. The Council discussed this and agreed there would be huge residential
resistance.
The Council expressed concerns with what is going on with Albertville and a potential
project by Riverwood and is this keeping in focus with Phase I area.
David Licht said the focus is the Sewer Study. He said to view the Riverwood Project as
an opportunity that comes along to address some environmental concerns in this area.
Mr. Licht said a meeting was scheduled previously to discuss the Southwest Corner of
Otsego and we need to reschedule to discuss this area.
The Comprehensive Plan for along 101 will need to be adjusted but won't be major.
Mr. Licht advised that the City is in a lull right now, which is a great opportunity to
prepare and continue to address priority issues.
He said that professional involvement with planning is needed and City needs direction in
terms of what it needs to look at.
CM Heidner thought maybe a workshop meeting with Council and Staff first.
Mr. Licht said the Planning Commission is advisory and not technical, but Carl Swenson
needs to be there for factorial information.
