90-12RESOLUTION N0. 90-12 A RESOLUTION ESTABLISHING PROCEDURE AND FEES FOR REZONINGS, CONDITIONAL USE PERMITS, VARIANCES, APPEALS AND SUBDIVISION WHEREAS, the City Council of the City of Otsego may establish procedures and fees for administering rezoning applications, conditional use permits, variance/appeals, and subdivision, and WHEREAS,. a review of procedures and fee schedules of surrounding cities has been completed to establish a basis for Otsego. NOW THEREFORE, be it resolved by the City Council of the City of Otsego that the following procedure and fee schedule is hereby established for the City of Otsego: 1. The applicant completes an application and submits all required information as specified by ordinance to the City Clerk. 2. The applicant pays a non-refundable base fee of $150.00 and escrow deposit to be charged against the time and materials necessary to process the request. Fees must be paid at time of application. A schedule of fee amounts is as follows: Escrow Item Base Fee Deposit* Total Rezoning or Text Amendment $150 $250 $400 Conditional Use Permit-' and Variance: Single Family $150 -0- $150 Other $150 $250 $400 Appeal $150 $150 $300 Subdivision: Administrative $150 $150 $300 Major $150 $750 $900 r 3. If the review and consideration of the request exceeds the cost covered by the escrow deposit as a consequence of lack of information, site problems, or questions raised by the staff, Planning Commission, or City Council, all processing of the request will be terminated until an estimation of completion is determined and new deposit made. *For time and expense devoted to the request by the City Planner, City Engineer, and City Attorney. EXHIBIT "B" 4. Following the City Council's decision on the request, the City Clerk will notify the applicant of the decision and refund any portion of the escrow deposit remaining or bill the applicant for the balance due. All fees shall be paid before issuance of a building permit. BE IT FURTHER RESOLVED by the City Council of the City of Otsego that the aforementioned fees shall take effect the date of passage of this resolution.
