Roll Call: Mayor Larry Fournier; Councilmembers: Vern Heidner, Virginia Wendel, Jerry Struthers and Dan Scharber. Staff: Judy Hudson, City Clerk/Zoning Administrator, Ron Wagner, City Engineer and Shane Nelson. 2. Discussion of Engineering Manual with City Engineers. The Engineers went over the changes to the Engineering Manual which included the as builts for new construction, increasing the aggregate base and curb cuts. 3. Any other Council Items. There were no comments from the public or the applicant. City Staff noted that we are not recommending that a concept plan for the subdivision of the property be provided as the parcel is in the rural residential preserve area designated by the Comprehensive Plan. Ghost platting is only to be required for parcels in the urban service reserve area where urban services are more likely to occur in the near future. The Planning Commission also discussed the issue of the 85th Street parkway. This roadway would end approximately one-quarter mile east of the subject site. Staff raised the issue as to whether the parkway should be planned to extend further west. The recommendation of the Planning Commission is to adhere to the current transportation plan. After closing the public hearing, the Planning Commission voted 5-0 to recommend approval of the application. The request will be considered at the City Council meeting on 12 May 2002 at 6:30 PM. Decision 1: Zoning Map Amendment A. Motion to approve a Zoning Map amendment rezoning the 74.4 acre site from the A-1 District to the A-2 District based on a finding that the request is consistent with the Comprehensive Plan. B. Motion to deny the application based on a finding that the request for rezoning from A-1 to A-2 is inconsistent with the direction of the Comprehensive Plan. C. Motion to table the application until further review. Decision 2: Conditional Use Permit A. Motion to approve a CUP allowing for a residential parcel to be less than the minimum 20 acre lot requirement based on a finding that the proposed parcel meets the requirements listed in the Zoning Ordinance, subject to the following conditions: Parcel B is to be redesigned in a manner that will increase its width to 260 feet and extend the northern lot line 389 feet north to the section line to the north, thereby eliminating the need for further irregular lots. 2. All lots are found capable of accommodating a private well and septic system, subject to approval of the City Building Official. 3. Parcel A shall be deed restricted to not more than six development rights subject to the requirements of the A-2 District. Parcel B shall be deed restricted prohibiting further subdivision unless the property is rezoned. 4. Park dedication requirements are to be satisfied with a cash fee in lieu of land equal to $2,100 to be paid prior to release of the minor subdivision. 5. Right-of-way is to be dedicated for 85th Street in accordance with the Transportation Plan. 6. The minor subdivision is subject to review and approval of the Zoning Administrator and recorded with Wright County. 7. Comments from other City Staff. B. The Planning Commission and City Council must take into consideration the possible effects of the Zoning Map amendment with their judgement based upon (but not limited to) the criteria outlined in Section 20-3-2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. The project requires preparation of a mandatory EAW pursuant to Minnesota Rules 4410.4300 Subp. 19 and Subp. 36.A. E. G. The EAW prepared by MFRA Inc. is incorporated herein. H. The planning reports dated 30 April 2003 prepared by the City Planner, Northwest Associated Consultants, Inc., are incorporated herein. The engineering reviews dated 14 April 2003 and 28 April 2003 prepared by the City Engineer, Hakanson Anderson Associates, Inc., is incorporated herein. The Otsego Planning Commission conducted a public hearing at their regular meeting on 21 April 2003 to consider the application, preceded by published and mailed notice. Upon review of the application and evidence received, the Otsego Planning Commission continued the public hearing to their meeting on 5 May 2003. K. The applicant submitted revised plans that were reviewed by the Planning Commission at their meeting on 5 May 2003. In that letter she indicates her belief that there has been some misunderstanding regarding valuation of the Church property and that it should be valued as "improved" property. I will respond to that later in the letter, but first I would like to make it clear that the City Council is currently evaluating what credit ,if any, should be given for an easement that the City already has in hand. The City has no obligation to make any payment or give any credit for the easement. The City Council has discussed giving some credit to the church for the easement. The rationale for the credit is that the easement is an open ditch along the property line between the two lots owned by the church rather than a typical easement with buried facilities. At the public hearing, the church submitted an appraisal indicating a per acre value for the property exceeding $100,000.00 per acre. This appraisal was done with an effective valuation date approximately one year after the easement was conveyed. In other words the appraisal valued the property with municipal sewer and water services extended to its boundaries and in operation. At the time that the easement was conveyed it was for purposes of extending the street, storm sewer and delivering sanitary sewer and water services to the church all in one project. The issues that would later confront the church due to its location were discussed at the time that the church sought its first expansion. The church was on notice that it would be required to hook up to City sewer and water service upon further expansion. The City commenced condemnation actions to obtain easements on various parcels for the City sanitary sewer and water project in 1998. The City appraisals obtained for the Letter to Otsego City Council May 8, 2003 Page 2 condemnation were dated July 24, 1998. There were a number of them in the area of the church going southward along County 42. The appraisals were in the range of $8,000.00 per acre for unsewered land, guided for commercial and industrial development. Some of these easements were conveyed for the appraised price, some were further negotiated, and some went to Commissioner's hearings. The comparison becomes complicated because some easements were typical easements along the roadway while other easements bisected properties. In no case was a case either going to hearing or settled paid more than $30,000.00 per acre, in fact the vast majority of the cases, including those that went to Commissioner's hearings, were far below that. value in the range of $9,000.000 to $10,000.00 an acre, appraised as un-sewered. In entering into negotiations regarding the storm water easement required by MNDOT after the extension of 88th Street, the City offered $70,000.00 per acre as a bare land sale, since there was property in the immediate area with sewer availability which had arguably better and more direct access which sold in that range. In the course of those negotiations the City offered to consider payment for all or a portion of the easement already in hand in order to settle the matter. It was understood that the figures thrown out for the church were for the sake of negotiation since at that time neither party had an appraisal of that specific property. However, the idea that compromised payment could result in an amount in the hundreds of thousands of dollars caused the City to resolve the problem in another way. I do disagree with the assertion that somehow the Council was not being given accurate information. What was conveyed to the Council is what took place in the negotiations. The numbers that were relayed to the Council were obviously conveyed as a high end position, and it was clearly conveyed that it was a part of the negotiation process, and that the church was willing to reasonably negotiate. I believe that the $30,0000 dollar figure is a fair figure in light of the circumstances. I also believe that the Council has the discretion to adjust that number up or down within a reasonable range. The argument for raising the value would be related to the difference in the date of our appraisals, and the better access to Highway 101 that the church property has relative to those appraised. However, even if a higher per acre value for the property would be used, the resulting credit may include only credit over and above the value of the easement conveyed by the bank (a 25% take vs a 100% take), which may put the credit in the same range. Letter to Otsego City Council May 8, 2003 Page 3 It is my understanding that the Council will review the correspondence from the church, this letter, and the information previously provided by Ron Wagner and will arrive at a decision as to whether or not the church will be provided a credit, and what the overall storm water charge per acre will be. NAC prepared a report which was forwarded to our office for further action. On April 26, 2003 pursuant to Section 20-11-1.B of the Zoning Ordinance a notice letter was sent to the property owner identifying the Zoning Ordinance violations and requiring abatement within 30 days. This winter our office did contact the dealer unit at the Minnesota Department of Commerce to determine whether or not the property owner was a licensed automobile dealer. Legal Does not include any right-of-way or easement acquisition costs as all required easements were granted by petitioning parties who are the Bank of Elk River (Bank) and Christ Lutheran Church (Church). , The study completed in February of 2000 and revised in July of 2000 estimated the storm water impact fee for the South Sub District to be $4,100/acre. There are several options, which we would like the Council to review concerning how much the impact fee will be and how the storm water impact fee will be instituted. Option 4 includes the existing developed properties, but gives them credit for easements granted. The Bank, which has 2.5 acres developed within the South Sub District, would be required to pay 2.5 acres @ $5,000/acre or $12,500, but would receive $2,000 back from SAC and WAC funds \\HaO I \Shared Docs\Municipal\AOTSEGO\418\ot418hmcc.doc for easements granted and would be allowed to expand their building or parking with no further storm water impact fee. This could be given as a credit for any future expansion or given in cash. An additional $1,295 for other easements would be forth coming from SAC and WAC funds. This letter describes an issue MPCA is raising with regards to the environmental assessment and the permit application for Phase III of the East Otsego wastewater treatment plant. The issue pertains to mercury in the plant effluent. At this time, the mercury issue appears to be the last to resolve before MPCA proceeds with the permit process. Description of the Issue MPCA is concerned about the increased mercury loading to the Crow River resulting from the plant expansion. In general, MPCA policy for all treatment plant expansions is to attempt to limit future mercury discharges to the level that is allowed under the current permit. In a letter to Gary Kimball of MPCA dated April 10, 2003, I proposed that the Otsego East plant would comply with this policy by a combination of two solutions: treatment at the plant and decreased loadings coming to the plant in the future. Gary did not approve of these solutions as a way to comply with MPCA policy. Instead, he offered the options that I will describe in this letter. Link Between Mercury and TSS Because the discharge permit does not contain a specific mercury limit, it is difficult to establish a current permitted mercury loading beyond which no increases are allowed. Instead, MPCA has declared that an association exists between mercury and total suspended solids (TSS) in treatment plant effluents. 2335 West Highway 36 ■ St. Paul, MN 55113 ■ 651-636-4600 ■ Fax: 651-636-1311 One way to limit mercury discharges in the future is to accept a TSS "freeze" and control TSS in the effluent at levels no greater than the existing TSS mass limits. MPCA calls this option the "No Non -Degradation Demonstration Needed" option. The second option—referred to as "Non -Degradation Demonstration Needed"—requires a demonstration that mercury itself is being limited. The following is a description of how the two options may be applied to the East Plant. Option 1—TSS Freeze The current permitted flow at the East plant is 400,000 gallons per day (gpd). The effluent TSS limit is 30 milligrams per liter (mg/1). We are seeking an expanded capacity to 1,500,000 gpd, a 275% increase. To "freeze" TSS loadings, the plant must discharge decreasing TSS concentrations as flow increases. Ultimately, when the plant is treating 1,500,000 gpd, the effluent TSS must be no greater than 8 mg/l. MPCA draws a distinction between a "freeze" and a "limit". With a freeze, the permit does not necessarily include an 8 mg/1 effluent TSS limit. If we choose, we could accept a limit, but a preferable approach—accepted by MPCA—is to install a treatment technology that MPCA recognizes will control TSS down to the effluent concentration we need to achieve. Demonstration compliance with 8 mg/1 is not required. MPCA accepts specific treatment technologies for TSS freezing on the basis of their demonstrated performance at other plants around the state. Without mercury concerns, we are proposing that the East plant be upgraded with a biological phosphorus removal process. It will replace the existing chemical process for phosphorus removal. The reasons for the change include less costs and significantly less sludge quantities generated by bio -P. However, MPCA accepts chemical phosphorus removal as a technology that limits TSS down to the 8 mg/1 range, but not bio -P. In a telephone conversation on April 28`h, Gary Kimball of MPCA stated that chemical phosphorus removal—in combination with the activated sludge process employed at the plant—would be approved by MPCA as an equivalent TSS freeze at the East plant. In addition, if we were to select this option, the plant would be subject to quarterly effluent mercury monitoring. But there would be no mercury limit specified in the discharge permit. If we keep bio -P in the project, in order to satisfy MPCA with respect to the equivalent TSS freeze, the plant must be supplemented with a sand filtration process that will consistently reduce TSS to 5 mg/1 and below. A rough cost estimate for the process is $800,000. 2 Option 2—Mercury Non -Degradation If we do not choose to accept a TSS freeze as described above, then we must accept the mercury non -degradation route, including a mercury limit and mercury monitoring. The mercury limit would be 10 nanograms per liter on a monthly basis. Effluent monitoring to confirm that the limit is being met would be twice per month. Mercury testing is not cheap. Monitoring costs could be several thousand dollars a year. In addition, there are strict procedures to follow in taking samples to assure the validity of the results. An important question is whether or not the plant can meet the limit without installing treatment for mercury removal. According to MPCA, the median effluent concentration of municipalities in the state is 3 to 4 ng/l. There are several cities in the state that have chosen this option and are consistently below the limit. Generally, municipalities with higher than average mercury in their wastewater plant effluents are serving one or more industries that discharge mercury. To date, no municipal treatment plant in the state includes treatment for mercury removal. If we accept a limit and find in the future that it cannot be met, it is highly likely that a specific source or sources are responsible and steps to limit their discharges can be initiated. There is a third option to consider. Option 3: Permit for Phase I Only This option essentially delays final resolution of the mercury issue until Phase II. If the flow capacity of the permit were reduced to the Phase I capacity of 900,000 gpd, the TSS mass freeze is based on an effluent concentration of 13 mg/1. MPCA recognizes bio -P as a process capable of achieving this effluent concentration. So, with this option, we can install bio -P at the plant without any mercury concerns. However, the issues described above with respect to the need for sand filters or conversion to chemical phosphorus removal must be addressed in Phase II. By the time the Phase II became necessary, some conditions may be more favorable. MPCA policies may have changed or effluent mercury data collected after initiation of Phase I may show continuous compliance with the 10 nanogram/liter limit. Put another way, the issue may not have to be approached the same way it must be approached now. Discussion of Options Rather than selecting a particular option, it is easier to rule out the options that we definitely do not want to consider. Any option that results in the installation of effluent sand filters is highly unattractive and should be avoided. Sand filters will add considerable costs to the project. Also, the option of seeking only a 900,000 gpd capacity now will create the need to repeat the environmental and permitting process in the future. The remaining options to consider are (1) switching from bio -P to chemical phosphorus removal or (2) accept a mercury limit. Recommendation Of the two, accepting a mercury limit will allow us to install the preferred phosphorus removal technology. If we are to accept a limit, the next step would be to complete the environmental review for the project with our stated preference. From my perspective, it is the preferred option, as long as the city understands what is involved with accepting a limit. In my opinion, switching to chemical phosphorus removal just to satisfy the mercury issue is a "tail -wagging -dog" solution. This perhaps is an issue for which the wastewater committee should meet.
