Attached is information from Scott Dahlke, Meyer Rohlin, Engineers. Scott and Don Jensen from Pilot Land Development will be present to explain what they are asking for from the Council and answer any questions. Andy will also be available to speak to this -ssue . Recreation Programs/Activity Volunteers C. Project Oriented Activities e.g. Old Town Hall Picnic Shelter Water Supply D. Other 2) Organization A. Identify organizations who may be interested: ► historical preservation society ► gardening clubs ► soccer association ► softball organizations ► snowmobile clubs ► civic organizations ► church groups ► PTA ► high school drama club, others ► any others B. Invite representatives to an informational/organizational meeting 1 . Present goals, ide9s, action plan 2. Determine if interest is there (probably reps will need to go back to their organizations) to set up formal or informal structure. 3. An effective fund raising arm will necessarily require a more formal structure setting up a non-profit 501(c)3 organization. e.g. receive donations receive bequests receive land receive lottery proceeds develop fundraiser(s) C. Contact other communities or associations - what works, doesn't e.g. Columbia Heights - Parks/PTA for playground development Andover - Field of Dreams Athletic Complex Lakeville - Bike patrol St. Francis - Senior High baseball field D. Invite participants from organizations for second meeting to discuss ideas, concerns of their organizations. E. Any plan or intention to temporarily or permanently close Kadler Avenue has not been reviewed by or approved by the City of Otsego. If you wish the City to consider any full or partial road vacation or to consider making any temporary or permanent revisions or improvements to the road, please make application to the City for appropriate action. A permanent closure suggests that you are requesting vacation of the public rights to the road. Such a vacation requires a public hearing. Please make application for such action if you desire it. Your client Will be responsible for costs of the process. If you are not seeking road vacation by Otsego, it appears that you are intending to eliminate the potential for through traffic between county highway 37 & 118. That _ action would turn Kadler within Otsego into a 2600 ft long cul-de-sac which length is in excess of the maximum permitted by Otsego Subdivision Ordinance. A review and ordinance variance would be required. We suggest that your desire to close Kadler Avenue on January 26th is premature and that such action is not permitted. NIN 55330 RE Kadler Avenue vacation over time adoption of road access ooinrs biro Comoreltensive Plan Dear Mayor & Council Members: This letter serves to inform Otsego of Pilot Land Development Company's pending golf course housing PUD plans. The project is currently located solely in Albertville for housing and in a portion of St. Michael to accomplish 18 holes of golf. Plans have been submitted to Albertville showing a variety of housing and golf hole relationships. The Planning Commission is preparing to approve the project at their first meeting in August. At this time, Pilot has worked with Albertville to eliminate the need for Kadler to exist as a major north south road. We have petitioned St. Michael to vacate their portion of Kadler as well to accommodate the best (7olf course layout possible from our consultants. Vacation of Kadler Ave. is a benefit to both communities because it removes a joint jurisdiction road from current and future maintenance obligations. It would also allow for subdivision design to use rear yards on the political boundary versus front yards. Since drainage already exists on both side of the road today, minimal_ drainage problems would occur in the future to affect joint City approvals for development of the Becker farm in Otsego. I have attached a small and large copy of our master plan and a sketch plan of the David Becker site for your information. The residents and uses you will need to consider are as follows: 1. Comer residential use at Kadler and Hwy. 37. Solution: Can use Kadler vacated as a 75' drivevAay extension. This would not need to be plowed by the City. 2. A second residential use, suspected home machine shop; Solution: would use same joint driveway for about 200 feet. 3. The David Becker farm is 120 acres with access to both Kadler and Hwy. 37. We propose vacation of Kadler when proposed 63rd Avenue is complete. This will contain sewer and water if Albertville and Otsego can solve revenue issues. Regardless, access is publicly provided. Since both communities use the same planning consultant, there is not a rational planning reason that the proposed plans do not meet the mutual benefit of both communities. NAC has been supportive of the circulation component as designed for over the last two years. We would be pleased to explain the project at a workshop format if that would be of benefit to the Council. I had previously discussed this matter with him. Also attached please find signed agreements from the property owners along 62nd Street indicating that they will dedicate the northerly one rod as a portion of a half street. In exchange for his proposed dedication Mr. Emmerich seeks use of the City topography in areas he presently has under contract. Previously the City had indicated that they would consider acceptance of such a dedicated half street as a resolution to the matter. It was my recommendation to the City that they proceed with interim maintenance of the street based upon the representations of both the property owners and the developer that they would make these dedications. Letter to Otsego City Council January 21, 1998 Page 2 WASTEWATER TREATMENT SITE The appraiser has indicated that he will verbally provide me with a preliminary appraisal of the proposed site acquisition on Monday. I am requesting that the Council authorize Mike Robertson to begin negotiations for acquisition of the land as soon as possible based upon the appraised value of the property. Mike could report to the existing sub- committee regarding these negotiations. Depending upon the course of the negotiations, the City may have to consider proceeding with eminent domain shortly. SEWER SERVICE AGREEMENT WITH DAYTON It is my understanding that the City of Dayton recently passed a resolution indicating that they wished to proceed to receive sewer service from the Otsego plant. I also understand that Ted Field will be at the meeting to discuss plant capacity. I need direction from the Council as to whether or not I am to proceed to try and negotiate an agreement with the City of Dayton for delivery of sewer service by contract. EXTENSION OF MORATORIUM As previously discussed, the present moratorium will soon expire. Prior to that expiration, an extension of the moratorium must be considered if we are to complete revision of the Comprehensive Plan. I need direction from the Council to bring a proposed revised moratorium to the Council for consideration at the next regular Council meeting. ELEMENTARY SCHOOL WELL I have been contacted by the attorney representing the Elk River School District. He has requested certain documents related to the school well. I will provide him with the documents he has requested. He indicated that he will contact me shortly with the school district's position in this matter. Utilizing the Wright County Enterprise Revolving Loan fund, the Partnership assisted in the expansion of Eden Electronics in Montrose and Product Technologies in Maple Lake, creating nearly 45 new jobs for Wright County. Additionally, the Partnership expanded its services this year to include grant writing assistance, site location and promotion, seminars and workshops, and technical and resource assistance. The Partnership has also developed relationships with regional and state economic development entities, held discussions with our elected officials concerning development issues, and increased awareness of the Partnership substantially. The New Year appears to hold even more promise for the Partnership. Within the first full week of 1998 I received two requests for assistance from new businesses looking to start-up operations in Wright County. Harwood, Otsego Engineer DATE: January 26, 1998 RE: City of Dayton Resolution 1-98 Sewer Capacity in Otsego I received a copy of the referenced resolution. Part I, Review of the Resolution 3601 Thurston Avenue Anoka, Minnesota 55303 612/427-5860 Fax 612/427-34a1-- 0520 The resolution contains 5 "whereas" clauses, all of which are factual and accurate. The resolution requests inclusion of 40,000 gpd Otsego treatment capacity and identifies this as serving an estimated 200 residential units. The 40,000 gpd capacity is consistent with all past discussions. Based on the facilities plan data, this serves 400 people or 160 residential units. Resolution, Part A, estimated cost to Dayton is listed as $470,000. This appears to be 40/240 or 16-2/3% of the current estimated $2,800,000 project costs for a 240,000 gpd facility. Resolution, Part B, the planned discharge pipe route to the plant is identified. At this point, easements have not been identified and are not currently being acquired. Costs are not currently included in the WWTF project cost for these easements. Resolution, Part C - The intent in this statement is for the sewer line from Dayton to the WWTF to be constructed for maximum joint Otsego and Dayton use potential. The line could be partially paid for by Otsego properties, to the extent the line would benefit those properties. Part II, Recommendation I recommend: 1) The reference to an estimated 200 Dayton residential units be deleted. The reference to 40,000 gpd capacity is the key agreement figure. 2) That the cost of all facilities that can vary due to the location of the WWTF be added to the cost of the WWTF with those costs split or shared by an agreed formula. The total costs data will be developed by cost evaluations that will occur while applying for loans to fund the treatment facility. The cities have the responsibility to guarantee debt retirement. Dayton's share of that responsibility (40/240 = 162/3%) should be part of an agreement. 4) The acquisition of an easement as described in Resolution Part B and the sharing of costs within both communities to get sewage flow to the facility as described in Resolution, Part C, need to be further evaluated with appropriate costs included in a sharing formula. 5) The City of Otsego will own the facility and provide Dayton with capacity via agreement and license. The plan was discussed at the December 8th Council meeting with a question raised on the relative costs of maintaining gravel versus bituminous roads. We have not been able to provide a satisfactory response to the question on historical cost of gravel vs. bituminous road maintenance, in part because the data is not readily available and in part because the past bituminous road maintenance has not been consistent enough to establish a valid comparison. We recommend council action to accept and utilize the management plan with a commitment to develop relative cost data for review prior to the next assessment for bituminous road overlay or reconstruction. The primary purpose of the Roadway Management Plan was to develop and implement a reasonable and consistent procedure for evaluating, prioritizing and performing bituminous road maintenance. We recommend that the City Council, by motion, adopt the Roadway Management Plan and refer that plan to the City Public Works Committee for use in developing the annual Public Works Budget for Roadway Maintenance. The result will be a program for crack sealing, pavement repair and seal coating that is more consistently performed and is better directed at preserving and extending the useful life of the bituminous streets. We also recommend that the City collect data on costs for properly maintained City roads and use that data to equalize expenditures from general city taxation for gravel versus bituminous road maintenance. The basic city policy question and issue is that all costs to maintain gravel roads are paid from City general tax revenues while costs related to paved roads are separated into maintenance and reconstruction components with reconstruction costs being assessed to properties. If the City does not provide adequate annual bituminous road maintenance, the result can be an accelerated need for road reconstruction. Once a road is accepted as a public road it is maintained by the City for use of all the public. Maintenance costs are paid from a City Road Maintenance Fund or the City budget, primarily supported by general taxation. For bituminous roads, the policy recognizes that paved roads have a finite useful life and that in addition to maintenance, the road will ultimately require replacement. The general City policy for paved roads is to differentiate maintenance from construction. The policy defines work that adds to or replaces the bituminous road structure as a construction improvement, to be assessed against properties. Bituminous road overlays and bituminous road reconstruction therefore is construction work and is assessed. Bituminous road crack filling, road patching, road seal coating and road markings are maintenance operations and are paid from City funds. The result is that properties on gravel roads never pay any assessment related to roads. All gravel road work is maintenance and is paid from the Road Maintenance Fund which is general tax supported. Properties on bituminous roads pay for initial road construction, usually within a development, and pay for road overlays and ultimately for reconstruction costs, usually through assessments. The added cost for bituminous construction or reconstruction is the benefit to the property from being on a bituminous road. There is no problem with the disparity of assessed cost for bituminous roads versus no assessment for gravel roads. Property values and sales support the added cost and benefit. There is however a question on how much should be spent to maintain bituminous road with the premise being if the bituminous road maintenance expenditures are increased, possible up to the level of annual expenditures that are made for gravel roads, then the need for reconstruction will be delayed. Engineers Landscape Architects Surveyors X 2, Mayor and City Council Page 2 January 21, 1998 The maintenance needs for gravel and bituminous roads are very much different with gravel requiring very frequent low cost work and bituminous requiring infrequent high cost work. The scheduling of work on gravel roads is fairly intuitive. The rutting, washboarding and need for added gravel are in general clear and obvious. Gravel road maintenance is variable based on a number of factors including subgrade, traffic volumes and weather. The maintenance of gravel roads is constant. It has to be regularly performed or the road will become impassable. The scheduling of work on bituminous roads is less intuitive. Maintenance can be postponed or can even be non- existent with little day to day impact on the public. Postponing or eliminating maintenance will accelerate the need for replacement. Proper scheduling of maintenance will prolong pavement life. A firm city policy for road maintenance is recommended, primarily to assure that bituminous paved streets receive proper and timely maintenance so as to prolong pavement life and protect the investment that the city and its property owners have in the paved streets. Once the road maintenance policies are in place and all roads, gravel and bituminous, are receiving appropriately scheduled maintenance, a full review of the cost should be made with the specific intent of equalizing the level of funding from general taxation dollars that are expended for gravel and bituminous roads. It may be that roger road maintenance for gravel and bituminous roads has an equivalent annual cost. It is likely however that the expenditures for maintaining bituminous roads are less than for gravel roads, even when the maintenance effort on bituminous roads is increased to the recommended plan. If this turns out to be true, it may be appropriate to equalize the general taxation supported road maintenance by paying some portion of the bituminous road overlay costs from road maintenance funds. At this point, data is not available to support any specific maintenance related cost participation policy. I presume that the Otsego City Council will be discussing the 200,000 gallon per day versus 240,000 gallon per day issue at the 1/26/98 meeting. Attached for general or background information is a summary sheet dated January 14th that contains the cost data used at the public hearing. The $7,729.00 total connection charge for sewer and water in Otsego is not proposed to be revised regardless of initial treatment plant sizing. Any reduction in initial WWTF expenditures will be reflected in a corresponding increase in the year 2010 projected expenditures. Overall, no significant revision in total costs over the planning period is expected. I have attached a sketch of potential initial developments showing 520 acres of undeveloped land, some of which we anticipate to undergo 1999 development. In addition there are 7 potential development "nodes" identified by letters A through G. The immediate development potential from these areas would require an approximate 400,000 gpd treatment facility. The initial 200,000 gpd facility has capacity for about 800 residential equivalent connections. We are hoping for early commercial/industrial development and for over 100 new homes per year. This map indicates that if development goes well, we will be expanding our WWTF, regardless of initial size, within 3 to 4 years. Based on development potential, it would seem that the initial WWTF size does not really matter. If development occurs, any initial size will be too small. If development is slow, any initial size will be too big. The recommendation is to construct as big a facility as comfort allows. The recommendation relative to Dayton is to accept their request for capacity and to assure them that Otsego will guarantee provision of up to 40,000 gpd of treatment capacity to Dayton in exchange for Dayton guaranteeing to collect connection charges Engineers Landscape Architects Surveyors Mayor and Council Page 2 January 21, 1998 or otherwise provide guarantees to fund a proportional share of any annual shortfall in WWTF debt retirement. The key issue is that the WWTF is being constructed with borrowed money and will be paid for by connection charges. With reasonable development and with timely sewer construction, the City of Otsego will not incur any costs. The City of Otsego is however, the guarantor of the bonds. Otsego should welcome the participation of Dayton as a joint and proportionate guarantor of debt retirement. The past discussions have been for Dayton using 40,000 out of 240,000 gallons per day of capacity which is 162/3%. The recommendation is to postpone culvert replacement until fall of 1999. 2) Other culvert work: a) The south to north culvert under 85th Street just east of O'Brian was observed to have bedding and joint problems. This was discovered by field personnel while working on the Heritage Hills Development. Water runs along the outside of the pipe, possibly causing voids. Replacement is programmed with 85th street improvements. Since that project is on hold, we will watch the culvert and do the repair if the problem becomes a threat to the road. b) The culvert under 87th Street at Otsego Creek, west of MacIver has open joints and has settled. It needs replacement, recommended for next fall. In the meantime, the existence of an easement for the 66 ft. public right of way needs review. We should not reconstruct the culvert if the right of way is not of record. This should be referred to Andy MacArthur for Right of Way review. 3) Sewer and Water Project: The design and layout for the Sewer and Water Project is underway. We will be preparing design reports for City Council review at the Feb 9th Council meeting to include: a) Water system: Recommendation for well location and aquifer. Final recommendation for tower location and size. We propose 3 separate contracts, one for the well, one for the tower and one for the pumphouse. The design intent is to minimize costs and maximize flexibility. We can limit 1998 construction to one lift station. A report on exact location and sizing of facilities, with Right of Way and easement needs, will be prepared and reviewed. 4) Odean Avenue A feasibility study and design report is being prepared for submittal to the Council on February 9th. The report will show the proposed section and extent of work. Soil boring data has been ordered. A Right of Way map has been transmitted to Andy MacArthur for determination of ownership. We anticipate a late spring public hearing to review permanent and temporary Right of Way needs and the proposed assessment of equivalent residential street costs. 5) General easements and Right of Way: We have a number of projects underway that require easement and Right of Way. The property need includes land for the WWTF, a site for the water tower, sites for wells and lift station, and the Right of Way for pipe lines or roads. For all projects there are permanent and temporary construction easements as well as slope easements. We must have a consistent and professional approach to Right of Way. We expect to treat people fairly. We however, must have a time certain for any right of way in order to schedule projects. I am requesting that the Council authorize Mike Robertson to begin negotiations for acquisition of the land as soon as possible based upon the appraised value of the property. Mike could report to the existing sub- committee regarding these negotiations. Depending upon the course of the negotiations, the City may have to consider proceeding with eminent domain shortly. SEWER SERVICE AGREEMENT WITH DAYTON It is my understanding that the City of Dayton recently passed a resolution indicating that they wished to proceed to receive sewer service from the Otsego plant. I also understand that Ted Field will be at the meeting to discuss plant capacity. I need direction from the Council as to whether or not I am to proceed to try and negotiate an agreement with the City of Dayton for delivery of sewer service by contract. EXTENSION OF MORATORIUM As previously discussed, the present moratorium will soon expire. Prior to that expiration, an extension of the moratorium must be considered if we are to complete revision of the Comprehensive Plan. I need direction from the Council to bring a proposed revised moratorium to the Council for consideration at the next regular Council meeting.
