1. Mayor will call meeting to order_
Mayor Norman F. Freske called the meeting to order at 6:30 PM
Roll Call: Mayor Norman F. Freske; Councilmembers: Suzanne Ackerman, Ron Black,
Larry Fournier and Vern Heidner.
Staff: Andrew MacArthur, City Attorney; Bob Kirmis, Assistant City Planner, Larry
Koshak, City Engineer; Elaine Beatty; City Clerk/Zoning Administrator; Phyllis Cokley,
Director of Business and Finance; Judy Hudson, Deputy Clerk; Jerry Olson, Building

2. Consider Agenda Approval,
CM Black motioned to adopt the October 28, 1996 City Council Agenda. Seconded
by CM Ackerman. All in favor. Motion carried.
3. Consider Minutes:
A. October 14, 1996
CM Black motioned to adopt the minutes. Seconded by CM Fournier. All in favor.
Motion carried.
B. Workshop of October 21, 1996
CM Fournier motioned to adopt the minutes. Seconded by CM Black. All in favor.
Motion carried.
4. Open Forum_
CM Heidner arrived at this point.
Paul Levenson stated he feels the Lin -Bar's request is similar to his previous request and
would there be any change in decision for his request.
Mayor Freske replied there have been no changes in the decision but that he may submit
something in writing.

Jeff Bartheld reviewed the report prepared by Merland Otto. The Parks Commission
anticipate the move of the old Township Hall to be done Spring of 1997. He also thanked
CM Ackerman for all her work and cooperation at the recently held Hay ride and Haunted
House Event.

Bob Kirmis updated the Council as did Thor Meyer of Meyer-Rohlin, Inc., presented the
Statement of Intent regarding sewage treatment for Lin Bar Estates.
After Council and City Engineer discussion, the Council direction was for the applicants,
applicant's engineer, City Staff (including City Engineer) to get together and review the
alternatives and come up with a recommendation.
CM Black motioned to continue this matter until the next City Council Meeting.
Seconded by CM Ackerman. All in favor Motion carried.

CM Fournier motioned to accept the Planning Commission recommendation for
approval of a Conditional Use Permit for more than one detached accessory
building subject to the conditions listed in the Findings of Fact. Seconded by CM
Black. All in favor. Motion carried.

Bob Kirmis presented the planning report.
CM Black motioned to accept the Planning Commission recommendation for a
Conditional Use Permit for more than one detached accessory building and for over
2,000 square feet of accessory space subject to the six conditions listed in the
Findings of Fact. Seconded by CM Fournier. All in favor. Motion carried.
6.6. Consider Rezoning certain portion of newly annexed Frankfort Territory
from A-1, Gener al to designations similar to previous zoning
under Frankfort Township jurisdiction (before the annexation)
Bob Kirmis presented the Planning Report.
CM Fournier motioned to approve the adoption to same or similar zoning for the
former Frankfort area that previously existed with B3 Zone to be used in place of
the B1 Zoning. Seconded by CM Black. All in favor. Motion carried.
7. Andy MacArthur, CityAttorney:
7.1_ Consider proposed Amendment to Animal Feedlot Regulations and
Comprehensive Plan Amendment (Cont'd from 10-14-96)
Mr. MacArthur presented the proposed Resolution approving an amendment to the
Otsego Comprehensive Plan and the Ordinance addressing Animal Feedlots.
CM Fournier noted 20-38.1. I. suggested to delete at the Present scale and a period
after intense agricultural uses. -Under 20-38-2. delete at the Present level
CM Black motioned adoption of Resolution 96-29 approving an amendment to the
Otsego Comprehensive Plan related to City Agricultural Policy and to the rural uses
portion of the City Land Use Plan. Seconded by CM Heidner. All in favor. Motion
carried.
CM Fournier motioned adoption of Ordinance 96-10 as amended, addressing
Animal Feedlot Operations with the City of Otsego. Seconded by CM Black. All in
favor. Motion carried.
CM Fournier motioned approval of Summary of Ordinance 96-10 for Publication
Seconded by CM Ackerman. All in favor. Motion carried.

7.2. Discussion of the addressing change on Palmgren Avenue in
Country )midge Develol)ment (Cont'd from 16-14-96)-

CM Black motioned to re -number the house numbers on the north end of Palmgren
Avenue to be consistent with the North/South numbering system existing on the
southern end of Palmgren Avenue. Seconded by CM Fournier. All in favor Motion
carried.
Andy presented his letter.
CM Fournier motioned to accept City Attorney's recommendation as outlined in his
attached letter dated October 24, 1996. Seconded by CM Black. All in favor.

R_ Larry Koshak, City Engineer:
8.1. Consider approval of final payment to Buffalo Bituminous for
CASH 37 Odean Avenue Imnr_ prof_ 94-2_
CM Heidner motioned to approve the final payment of $27,093.41 to Buffalo
Bituminous, the contractor. Seconded by CM Fournier. All in favor. Motion
carried.
8.2. Consider Odean Avenue Culvert repair pn .
CM Black motioned to move ahead with the Odean pipe replacement project.
Seconded by CM Ackerman.. All in favor. Motion carried.
Council would like to see a notice in the paper and to call the school and sheriffs'
department and fire department.
8.3. 85th Street/Halls Stormwater District Feasibility Study
a. Cost for surveying of drainage, projects.
Mr. Koshak presented the hours and costs involved.
CM Fournier motioned to table this project until next Spring. Seconded by CM
Black.
Voting for the Motion: CM Fournier and CM Black
Voting Against the Motion: CM Heidner, CM Ackerman, Mayor Freske
Motion failed three (3) to two (2).
CM Heidner motioned that the issue for additional surveying for the lateral lines be
revisited next Spring. Seconded by CM Fournier.
Voting For the Motion: CM Ackerman, CM Heidner, CM Fournier
Voting Against the Motion: CM Black, Mayor Freske

CM Fournier motioned to set the 1997 Albertville Fire Service at $51.00 per parcel.
Seconded by CM Black. All in favor. Motion carried.

CM Black motioned to adopt the Claims List. Seconded by CM Ackerman.
