City with a letter of credit of the same amount upon notification of expiration. If the
letter of credit is drawn down, the proceeds shall be used to cure the default. Upon
receipt of proof satisfactory to the City that work has been completed and financial
obligations to the City have been satisfied, with City approval, the security may be
reduced from time to time by ninety percent (90%) of the financial obligations that
have been satisfied. Ten percent (10%) of the security shall be retained until all
improvements have been completed, all financial obligations to the City satisfied, and
the required "as built" plans have been received by the City.
20. Landscaping. The Developers shall plant five (5) trees on every lot in the
plat not already containing five (5) trees. Trees shall be selected from among the
following specie, or other species of tree which meet the approval of the City Building
Inspector:
Maples Basswood
Linden Birch
Ash Ginkgo (male only)
Honey Locust Kentucky Coffee Tree
Hackberry
The minimum tree size shall be four (4) inches caliper, either bare root in season
or balled and burlapped. The trees may not be planted in a boulevard. Any trees
which can cause a public nuisance or public hazard, such as bug infestation or weak
bark are specifically prohibited.
Additional plantings and/or landscaping shall also be provided within the plat
in the following areas:
A. Along the western boundary of Lot 1, Block 3. Such plantings shall be
spaced and of a size and variety (coniferous) determined by the City
Building Official to be similar to plantings currently provided along
County Road 37.
B. Along the periphery of drainage ponds. The size variety of such
plantings shall be determined by the City Engineer to be water tolerant.
All yards shall be sodded or seeded. Not less than six (6) inches of topsoil in
required front yards or side yards abutting public rights-of-way. Where slopes lie in
excess of ten (10) percent, sodding (staked) shall be required. Weather permitting,
the trees, grass seed and sod shall be planted before Certificates of Occupancy are
issued. All grass seed shall be maintained so that turf is established within one (1)
year of planting. At the time of application for a building permit on each individual lot,
a one thousand dollar ($1,000.00) cash escrow shall be posted with the City to
guarantee compliance with the landscaping requirements on that individual lot. If the

landscaping is not timely completed, the City may enter the lot, perform the work, and
apply the cash escrow toward the cost. Upon satisfactory completion of the
landscaping, the escrow funds, without interest and less any draw made by the City,
shall be returned to the person who deposited the funds with the City. The person or
depositing the funds and/or subsequent purchasers shall warrant to the City that all
trees, grass seed, and sod shall be maintained and warranted to be alive, of good
quality and disease free for twelve (12) months from the time of planting.
21. Park and Trail Dedication. The Developers shall pay a cash contribution
of $28,900 in satisfaction of the City's park dedication requirements. The charge
was calculated as follows: 34 new dwelling units (lots) at $850 per dwelling unit.
The Developers shall also pay a cash contribution of $4,250 in satisfaction of the
City's trail requirements. This charge was calculated as follows: 34 new dwelling
units at $125 per dwelling unit. These contributions shall be paid before the City
approves the final plat or said final plat approval shall be contingent upon full payment
of said fees. In the event that the City determines that credit should be allowed for
any contribution of land made, the above figure shall be adjusted to reflect any such
credit.
22. Performance Standards. The proposed subdivision shall be subject to
standard City R-3 zoning standards for any issue which are not specifically addressed
i this Agreement for Planned Unit Development. If an issue is addressed in this
Agreement, and within the R-3 Zoning District, the conditions herein contained shall
prevail.
23. Storm Water Drainage Fee. As per adopted City policy, the Developers
of the plat shall pay a fee, as established by the City Engineer, for the effect of the
subdivision upon trunk drainage facilities within the City, minus any additional on site
mitigation of storm water beyond the normal requirement (that the Developer maintain
proper facilities on-site to contain runoff, as approved by the City Engineer). In
satisfaction of such requirement, the Developers shall pay a total of $13,938.91.
Since the Developers have constructed additional storage facilities within the plat,
they have met or exceeded the amount of the required fee through the value of
additional work undertaken and therefore the fee has been dissipated as set forth in
that correspondence from the City Engineer, Hakanson Anderson Associates, Inc.
dated May 6, 1997.
24. Street Light Construction. The Developers shall pay for the operation and
maintenance of the street lights for a period of one (1) year or until such time as the
plat is ninety percent (90%) built out, whichever occurs first. The first year of
operation and maintenance shall not commence until such time as the final plat is
accepted by the City and it is formally recorded.
25. Street And Traffic Control Signs. Before the City signs the final plat, the

to be measured. (see attached info.). After short discussion the
Planning Commission motioned as follows:

FINDINGS OF FACT
AND DECISION
Application of Robert and Rachel Cullinen for a conditional use permit to allow the total
accessory storage space associated with a detached single family residential to exceed
2,000 square feet.
On 13 October 1997, the Otsego City Council met at its regularly scheduled meeting to
consider the application of Robert and Rachel Cullinen for the aforementioned conditional
use permit. Based on the application, the recommendation of the Planning Commission,
and evidence received, the City Council now makes the following findings of fact and
decision.
FINDINGS OF FACT
1. The applicants are requesting a conditional use permit to allow total accessory
storage space associated with a single family residential use.
2. The subject property is zoned A-1, Agricultural Rural Service.
3. The subject property lies within the City's Rural Service Area, as illustrated in
Otsego's duly adopted Comprehensive Plan.
4. The legal description of the property is found on attached Exhibit A.
5. Section 20-4-2.17 of the Zoning Ordinance directs the Planning Commission and
City Council to consider seven possible adverse effects of the proposed conditional
use. The seven effects and findings regarding them are:
a. The proposed action's consistency with the specific policies and
provisions of the official City Comprehensive Plan.
The proposed use will be compatible with adjacent properties. As such, the
use is consistent with the intent of the Comprehensive plan and the
property's A-1 zoning designation.
b. The proposed use's compatibility with present and future land uses of
the area.
The proposed accessory storage building will be compatible with present
and future uses in the area.
C. The proposed use conforms with all performance standards contained
herein (i.e., parking, loading, noise, etc.).
The proposed use will conform to all applicable performance standards.
d. The proposed use's effect on the area in which it is proposed.
The proposed use will not tend to or have an adverse effect upon the area
in which it is proposed.
e. The proposed use's impact upon the property values of the area in
which it is proposed.
While no detailed study has been conducted, similar situations dictate that
the proposed use will not tend to depreciate area property values.
f. Traffic generated by the proposed use in relation to capabilities of
streets serving the property.
Traffic generated by the proposed use is within the capabilities of Odean
Avenue which serves the property.
g. The proposed use's impact upon existing public services and facilities
including parks, schools, streets and utilities, and its potential to
overburden the City's service capacity.
The proposed use can be accommodated by existing public service facilities
and will not over burden the community's service capacity.
6. The planning report dated 22 September 1997, prepared by Northwest Associated
Consultants, Inc., is incorporated herein.
7. On 1 October 1997, the Otsego Planning Commission conducted a public hearing
to consider the proposed conditional use permit application preceded by published
and mailed notice. Upon review of the conditional use permit application and

evidence received, the Otsego Planning Commission closed the public hearing and
recommended that the City Council approve the conditional use permit based on
the aforementioned findings.
DECISION
Based on the foregoing considerations and applicable ordinances, the applicants' request
for a conditional use permit to allow total accessory storage space associated with a
detached single family residential use to exceed 2,000 square feet is approved in its
present form subject to the following conditions:
1. Neither the proposed accessory structure or existing attached garage is used for
commercial or home occupation activities (unless specifically approved in
accordance with City home extended business/home occupation requirements) or
the keeping of animals.
2. The proposed accessory building match the principal building in color.
3. The height of the proposed accessory building not exceed 16 feet. Such height
compliance shall be demonstrated via the submission of a building elevation.
4. Utility and drainage easements are provided as determined necessary by the City
Engineer.
5. All recommendations of the City Engineer relating to site grading and drainage are
satisfactorily met.
6. A revised site plan is submitted which accurately illustrates existing and proposed
site features including the footprint of the residence (following recent addition), the
proposed accessory building, driveways, well and septic system locations. This
issue should be subject to further comment by the City Engineer.
ADOPTED by the Otsego City Council this 13th day of October 1997.

At the last Planning Commission Meeting the direction
from the Chair and Commissioners was for us to clarify the
issue of how the building height was measured. (We were
looking at 16' height limit on accessory buildings).
SECTION 2, RULES AND DEFINITIONS 20-2-2: B.
On page 11 of the Zoning Ordinance, last paragraph it
states as follows:
Building Height: The vertical distance above a reference datum measured to the
highest point of the coping of a flat roof or to the deck line of a mansard roof or to
the average height of the highest gable of a pitched or hipped roof. The reference
datum shall be selected by either of the following, whichever yields a greater height
of building:
1. The elevation of the highest adjoining sidewalk or ground surface within a
five (5) foot horizontal distance of the exterior wall of the building when
such sidewalk or ground surface is not more than ten (10) feet above lowest
grade.
2. An elevation ten (10) feet higher than the lowest grade when the sidewalk
or ground surface described in item a above is more than ten (10) feet above
lowest grade.
The height of a stepped or terraced building is the maximum height of any
segment of the building.

8.2 PUBLIC WORKS UPDATE - ODEAN AVENUE CRACK REPAIR
Buffalo Bituminous began crack repair work on Monday, October 7, 1997.
The work is proceeding as planned. A 2" deep by 12" wide mill is being
performed over the cracks. The cracks are then cleaned with high pressure
air and a tack coat is being applied to the exposed bituminous surface. Type
41 A wear mix is being placed in the opening and compacted with a steel
drum roller.
The amount of cracking has worsened through the spring and summer. The
budget will over -run on this project. We feel there will be adequate funding
available in the public works maintenance budget to cover the over -run. We
have attached a 9/18/97 letter to Gary Groen, City Accountant, which
represents our understanding of the maintenance budget.
8.3 CONSIDER RESOLUTIONS ORDERING PREPARATION OF PLANS AND
SPECIFICATIONS
a. Sanitary Sewer Collection System
Enclosed is a resolution ordering preparation of plans and specifications
for the sanitary sewer collection system anticipated to be constructed in
1998. The facilities are trunk and sub -trunk improvements and will not
be assessed against property owners.
The prime reason for ordering the work at this time is to allow for fall
surveying work to be completed. Also, an Environmental Assessment
Worksheet (EAW) will have to be completed to obtain State Revolving
Funds for the improvement. This is a long lead item and requires MPCA
review and approval.
The preliminary construction cost estimate for the work is 52,134,000.
Based on the City's fee curve, this relates to engineering design and
construction administration fees of 5.7% or $121,638.

BACKGROUND:
The storage building at City Hall formerly had Fire Engines and a
tractor stored there. The fire engines have been removed, but the
tractor still remains. We should be treating everyone in this City
alike and fairly. This is for Council discussion and action.
RECOMMENDATION:
This is a City Council decision. This tractor has been in the shed
quite some time and our maintenance people have to move it whenever
they need to get some equipment out of the shed. Staff is loosing
formal direction from the Council.

CM Berning called me after he noticed in the Crow River News, that the City of
Albertville passed an ordinance pertaining to false emergency alarm calls for Albertville's
Fire Department.
Attached is Otsego's Ordinance No. 97-1. I called Linda at Albertville and she faxed
Albertville's Ordinance 1997-13, An Ordinance Regulating The Use Of Burglar and Safety
Alarms, Establishing A Users' Fees and Establishing A System of Administration and
Ordinance 1997-14, Establishing Fees For Fire Protection Service and/or Emergency
Response. Also attached is Albertville's Resolution No. 1997-43 Establishing Charges,
Fees and Penalties Authorized by Ordinance 1997-13 and Ordinance 1997-14.
There are differences between the two cities' ordinances and fee schedule.
I will leave this up to you for any discussion with Council and/or City Attorney.

CM Black motioned to adopt the Planning Commission's Recommendation to
rezone this property from A-1 (General Agricultural) to R-3 (Residential Immediate
Urban Service Area). Seconded by CM Fournier. All in favor. Motion carried.
It was noted this was just approval of the rezoning and not the platting.

CM Heidner motioned to adopt the Ordinance pertaining to defective or
malfunctioning emergency alarm systems within the City of Otsego but to include all
Fire Departments serving the City of Otsego. Seconded by CM Ackerman.

The Council directed the City Attorney to review this change.
CM Black motioned for the Mayor and City Clerk to enter into a Joint Fire
Agreement with the City of Monticello and Monticello Township. Seconded by CM
Fournier. All in favor. Motion carried.

the next council meeting.

7. Andy MacArthur, CityAtter
7-1- Discussion of maintenance ofrip 'vately owned streets (62nd St NE) -
Mr. MacArthur went over his January 8, 1997 letter addressed to the City Council
regarding this issue. His recommendation is to continue maintenance this season with a
written agreement and this Spring the residents on 62nd Street may come forward and
dedicate property for a ROW so the City can obtain the street, if they don't, all future road
maintenance will cease.
CM Wendel motioned for the City to continue maintaining 62nd Street with written
approval from all residents and they are to pay for this service. After this season the
residents have to make a decision to keep as private street or a public street and
they will help pay for bringing it up to city standards. Seconded by CM Ackerman.
All in favor. Motion carried.
(Discussion occurred between the motion being made and the actual vote)
Discussion: CM Heidner asked for the record to show that if all residents on 62nd
Street do not all agree to this, the City will cease plowing with a 30 day notice.

EMERGENCY ALARM SYSTEMS WITHIN THE CITY OF OTSEGO.
The City Council of the City of Otsego ordains as follows:
Section 1. Any false alarm call to an individual, or business that,
in the opinion of Fire Chief having jurisdiction over the area, was
the result of a defective or malfunctioning alarm system will
receive a notice outlining this policy, indicating a second false
alarm call within the calendar year will subject the property owner
to a $100.00 charge. The notice will also indicate that three or
more false alarms during the calendar year will result in the
property owner being charged $250.00 for each additional false
alarm.
Section 2. Any unpaid service charge shall be placed as a special
assessment against the property pursuant to Minn. Stat. 429.101,
after proper notice and hearing.

THE USE OF BURGLAR AND SAFETY ALARMS,
ESTABLISHING A USERS' FEES AND
ESTABLISHING A SYSTEM OF ADMINISTRATION
THE CITY COUNCIL OF THE CITY OF ALBERTVILLE, MINNESOTA ORDAINS AS
FOLLOWS:
SECTION 1. SCOPE AND PURPOSE.
Subdivision 1. This section regulates the use of burglar and
safety alarms, established users' fees and establishes a system of
administration.
Subdivision 2. The purpose of this section is to protect the
public safety services of the City from misuse of public safety
alarms and to provide the maximum possible service to public safety
alarm users.
SECTION 2. DEFINITIONS.
For purposes of this ordinance, the terms defined in this
subsection have the meanings given to them.
1. "Alarm System" means an alarm installation designed to be used
for the prevention or detection of burglary, robbery, heat,
smoke and fire on the premises which contain an alarm
installation. Automobile alarm devices are not an alarm
system.
2. "Alarm User" means a person in control of any building,
structures or facility wherein an alarm system is maintained.
3. "False Alarm" means an alarm signal eliciting a response by
fire personnel when a situation requiring a response does not,
in fact, exist, and which is caused by the activation of the
alarm system through mechanical failure, alarm malfunction,
improper installation or the inadvertence of the owner or
lessee of an alarm system.

SECT I Obi 3. USER FEES.
Subdivision 1. A public safety alarm system that reports more
than two (2) false alarms to the City in a twelve month period and
that has received notice of such violations will cause the alarm
user to be charged a user fee. Fees will be established by a
resolution of the Albertville City Council and will be reviewed
annually on the recommendation of the Fire Chief.
Subdivision 2. An alarm user that is required by the City to
pay a user fee as the result of a false alarm may make a written
appeal of the false alarm charge to the Fire Chief within ten (10)
days notice by the City of the false alarm charge. Following
review and determination by the Fire Chief, the decision may be
appealed to the City Council, who will make a final determination
as to whether the user is to be charged with a false alarm.
Subdivision 3. User fees collected from false alarms shall be
credited to the Albertville Fire Department's Youth Education
Programs.
SECTION 4. PAYMENT OF FEES.
Subdivision 1. Payment of user fees are paid to the City
Clerk -Treasurer within thirty (30) days from the date of notice by
the City to the alarm user. Failure to pay the fee will cause the
alarm user to be considered delinquent and subject to a penalty of
an additional one and one half percent (1 1/20) of the unpaid fee
for each additional thirty (30) day period that the fee remains
unpaid.
Subdivision 2. The City Clerk -Treasurer shall prepare an
assessment roll of the delinquent amounts against the respective
properties served and deliver the assessment roll to the City
Council for adoption on or before November 15th of each year. The
assessment roll shall be filed with the Wright County Auditor by
the City Clerk -Treasurer and the County Auditor shall thereupon
enter such amount as part of the tax levy on said premises to be
collected during the ensuing year.
SECTION 5. ALARM REPORT.
If an alarm user has incurred five (5) false alarms within one
calendar year, the alarm user shall submit a written report to the
Fire Chief within ten (10) days after being notified of the fifth
false alarm, describing actions taken or to be taken to discover
and eliminate the cause of the false alarms. Failure to submit the
written report is a violation of this section.
SECTION 6. ADMINISTRATIVE RULES.
Subdivision 1. The alarm user is required to post below the
alarm system control the telephone number(s) of personnel to be
contacted when, or if, the fire personnel cannot reset the alarm
and it must be silenced.

Subdivision 2. The Fire Chief shall prepare other rules as
may be necessary for implementation of this section and present the
proposed rules to the City Council for consideration as an
amendment to this section.
SECTION 7. CONFIDENTIALITY.
Subdivision 1. Information submitted in compliance with this
ordinance will be held in confidence and exempt from discovery to
the extent permitted by law.
Subdivision 2. subject to requirements of confidentiality,

ESTABLISHING FEES FOR FIRE PROTECTION SERVICE
AND/OR EMERGENCY RESPONSE
THE CITY COUNCIL OF THE CITY OF ALBERTVILLE, MINNESOTA ORDAINS AS
FOLLOWS:
SECTION 1. ESTABLISHMENT OF SERVICE FEES- The City
Council shall by resolution establish fees for fire protection
service and/or emergency response which are not otherwise specified
by contract. Said fees shall be established at a fixed rate for
certain specific types of incidents or for actual costs incurred by
the Fire Department in responding to the incident.
Subdivision 1. False Alarms. Fees for response to false fire
alarms and false carbon monoxide alarms shall be charged to the
property owner or tenant for any incident after the second (2nd)
call to the property within a twelve (12) month period.
Subdivision 2. Chemical /Hazardous Materials spills. Fees
incurred by the City of Albertville for response to chemical spills
on roadways and at fixed private facilities within the Albertville
Fire Service Area shall be charged to the owner of the chemical,
the owner of the vehicle in which the chemical is being shipped or
is a part thereof, or to the owner of the facility where the spill
occurred.
(a) Fees shall include, but shall not be limited to, actual
manpower costs for all personnel that respond to the
incident (minimum of one hour) and the cost on a per hour
basis for each fire apparatus or other City mechanical
equipment that responds to the incident (minimum of one
hour per unit).
(b) In addition, the bill for service shall include any cost
of clean-up of any contaminated equipment and/or repair
of any equipment damaged during the incident or its
replacement, along with replacement of any disposable
equipment, supplies, and/or communication equipment, and
administrative costs to be established at ten percent
(10%) of the total bill.

Subdivision 3. Fire watch. Fees for personnel to stand by on
fire watch due to unusual fire hazards, while waiting for property
owner or tenant to respond to the scene following a fire incident
and/or fire alarm, may be billed to the owner of the property or
the tenant on a per hour basis with a one (1) hour minimum. One-
fifth (1/5) of the fee shall be retained by the City for
administrative costs, and four-fifths (4/5) of the fee shall be
paid to fire personnel standing fire watch. If a fire watch is
established at a property, the watch shall be maintained until the
owner of the property, the tenant, or his/her designated
representative arrives at the property and takes over
responsibility for monitoring fire safety.
Subdivision 4. Preventative Fire Watch. When Fire Department
personnel provide fire watch protection, the fees for such
personnel may be billed to the owner of the property or the tenant
on a per hour basis with a one (1) hour minimum. One-fifth (1/5)
of the fee shall be retained by the City for administrative costs
and four-fifths (4/5) shall be paid to fire personnel standing fire
watch. Preventative fire watch is required in any place of
assembly or any place where people congregate where public safety
is at risk due to the number of persons, or the nature of the
performance, exhibition, display, contest, or activity, or due to
unusual fire hazards.
Subdivision 5. At least annually, the Fire Chief shall
recommend to the City Council the fees to be charged.
