RESOLUTION 99 46
RESOLUTION VACATING PLATTED DRAINAGE AND UTILITY EASEMENTS ON LOT 1 AND
LOT 2, BLOCK 1 OTSEGO INDUSTRIAL PARK.
WHEREAS, Otsego Industrial Park, Inc. has submitted a request to vacate platted
drainage and utility easements on Lot 1 and Lot 2, Block 1 Otsego Industrial Park; and
WHEREAS, the vacation of the platted drainage and utility easements legally described
in attached Exhibit A is necessary to allow for expansion of the Apex Business Center; and
WHEREAS, the City Engineer has reviewed the proposed grading and drainage plan
and has found the proposed site improvements to be adequate for controlling stromwater runoff
within the Otsego Industrial Park plat and that the platted drainage easement described in
Exhibit A serves no useful public purpose; and
WHEREAS, the Planning Commission considered the request at its meeting on 6
December 1999 and voted 7-0 to recommend approval; and
WHEREAS, the City Council held a public hearing on 13 December 1999 to consider
the request and receive evidence; and
WHEREAS, the planning report dated 1 December 1999 prepared by the City Planner,
Northwest Associated Consultants, Inc., is incorporated herein; and
WHEREAS, the memorandum dated 2 December 1999 prepared by the City Engineer,
Hakanson Anderson Associates, Inc., is incorporated herein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF OTSEGO RESOLVES THAT the
platted drainage and utility easements legally described by Exhibit A are hereby vacated
subject to the conditions outlined in the planning report dated 1 December 1999.
ADOPTED by the Otsego City Council this 13th day of December, 1999
