Pledge o_ f Allegiance. Mayor Fournier led in the Pledge of Allegiance. Consider Agenda Apnroval" CM Berning requested the additions of the following: Under Item 9.3. City owned property on 80th Street, Jerry Olson, Building Official. Under Item 9.1. Community Rec. Meeting Under Item 6.3.1. Comp. Plan Update Mayor Fournier requested the following additions: Under Item 7.4.1. Letter from John Lefebvre dated 4-14-97 Under Item 9.3. Discussion of Joint EDA/EDAAC Meeting Under Item 9.3.1. Discussion of Otsego Membership with the Wright County Economic Partnership. Under Item 9.3.2. Resignation of Duane Fielder - discussion. CM Heidner motioned to adopt the April 14, 1997 City Council Agenda as amended. Seconded by CM Ackerman. All in favor. Motion carried. 3. Consider Minutes- a - in rtes -a_ March 12, 1997 Sewer and Water Workshop with Dayton- CM a onCM Berning motioned to amend these minutes on Page 5 by eliminating beginning with - after Mayor Fournier opened to the public to Page 6 up to Mayor Fournier announced .... and to replace with - include discussion among citizens in attendance and city councils of both Dayton and Otsego. There was no second to this motion CM Berning motioned to add Mayor Fournier's response on Page 5 to John Darkenwald - Did you want the 200 acres included in the sewer study? March 17, 1997 Workshop Re: Water and Sewer CM Wendel motioned to approve with the following corrections - Page 2, should be .124 and by 2006 should be .23 mgd. Seconded by CM Ackerman. All in favor. Motion carried. C. March 24, 1997 Regular Council Meeting. CM Heidner motioned to approve the minutes. Seconded by CM Ackerman. All in favor. Motion carried. 4. Open Forum_ Wallace Odell, resident, disagreed with the minutes of the March 12, 1997 City Council Workshop. Also stated concern about not being informed of the March 17, 1997 City Council Workshop. Mr. Odell also acknowledged receiving a letter from the City Engineer dated April 11, 1997. Paul Dahlheimer and Don Huss, residents of 87th Street, requested dust control for 87th Street. Elaine Beatty explained the City's policy regarding dust control. 5. Consent Agenda. 5-1- Approve Resolution for Authorization Execution of Sub -Grant Agreement for FEMA 1158 -DR -Minnesota - CM Heidner motioned adoption of the Consent Agenda. Seconded by Ackerman. All in favor. Motion carried. 6. Bob Kirmis, Assistant City Planner. Mr. Kirmis presented the Planner's Report. 6.1. Consider Vernon and Celine Greeningerr, 1044 70th Street NE requ= as follows: a. Conditional Use Permit to allow a oneep r forty subdivision of more than 2.5 acres. CM Heidner motioned to approve the Conditional Use Permit subject to the conditions outlined in the Findings of Facts and to change the date the council met to April 14. Seconded by CM Ackerman. All in favor. Motion carried. h. A variance to allow a oneep r forty split of more than ten acres. CM Heidner motioned to approve the variance allowing a one per forty split of more than ten acres subject to the conditions listed in the Findings of Fact, change the date the Council met to April 14, 1997 and approval of the CUP. Mayor Larry Fournier as follows., Mr. Kirmis presented the PC recommendation which was to table this until the State Historical Society completes their survey of the community. a Conditional use Permit to allow relocation of a locally significant historic structure (Old town Site). b_ A Variance for rear yard setback from 50 feet to 35 feet CM Wendel motioned to table this issue until the study is completed by the State Historical Society. Seconded by CM Ackerman. All in favor. Motion carried. 6.3. Any other Pl nningBusiness. 6.3.1 Update on Comp Plan Mr. Kirmis reported the Tactics Report was completed and basically everything has been put on hold until a decision is made regarding water and sewer services. Mr. Kirmis discussed the time frame and information meetings and the process. 7.1. Consider Elk River Fire Service on rac _ The City Attorney recommended approval. CM Berning motioned to approve the Elk River Fire Service Contract. Seconded by CM Wendel. All in favor. Motion carried. 7.2_ Consider 62nd Street ( Private Road ) Petition - CM Heidner motioned to refer this issue to the City Engineer and City Planner for their comments as to the conditions the Council should consider in accepting this street. Seconded by Mayor Fournier. All in favor. Motion carried. 73. Consider Maintenance Agreement between Otsego/Albertville- Mr. MacArthur recommended adding his recommendation per his letter. After Council discussion staff was directed to include a list of rates with rights of modification each year, who will be the decision maker, address planning issues to coincide with both cities, address provisions for damage issues to the streets, cost sharing for drafting this agreement. (Andy MacArthur and Larry Koshak will revise and bring back to the City Council). 7.4. An, other egal Business - 7 4- 1. usiness_7.4.1. John T of bvr .'s letter. After Council discussion, it was the consensus not to change any of the conditions of the purchase agreement between the City and John Lefebvre. CM Heidner motioned for the City Attorney to write a letter to John Lefebvre relating the consensus of the Council. Seconded by CM Ackerman. Motion carried three (3) to two (2). Both CM Berning and CM Wendel voted against the motion since they felt the City Clerk and not the City Attorney should write the letter. 8. Joint FDAIEDAAC Meeting - Mayor e ing_Mayor Fournier set May 1, 1997, 7 PM for a joint EDA/EDAAC Meeting for discussion of development and grants for sewer. 9.3.1. Otsego's Membership with the Wrighto n Economic Development PP ership- CM Heidner motioned for the City not to continue their membership with the Wright County Economic Development Partnership at this time. Seconded by CM Ackerman. All in favor. Motion carried. 9.3.2. Resignation of City Employee. Duane Fielder. The Council acknowledged Duane's resignation and requested Dave Chase, Maintenance Supervisor to attend the next council meeting. 9.3.3_ City Property located on 80th Street (Section 25, R24)„ Jerry Olson, Building Official, reviewed this site with the Council as outlined in his attached memo. The Council requested a price to abandon the septic system. CM Berning motioned to have the well, located on this site, sealed for $450.00. Seconded by Mayor Fournier. All in favor. Motion carried. 9.1. Consider Certification of Local Performance Measures for Local Performance Aid payable in 1998. CM Heidner motioned to certify this document for Local Performance Measures for Local Performance Aid payable in 1998. Seconded by CM Wendel. All in favor. Motion carried. 9.2. Discussion of Peavey House Rental Prosy at 13620 95th Street NE. Mayor Fournier motioned to accept the Deputy Clerk's recommendation that all rent is due as of May 1, 1997 or this will be turned over to the City Attorney as outlined in the attached memo. Seconded by CM Wendel. All in favor. Motion carried. 9-3- Community Rec. Program_ CM Beming attended a Board meeting today and went over some issues with the Council and asked for Council input. Some the issues discussed: three communities withdrawing from this joint powers, budget concerns, staffs salaries, possible increase assessments, population figures, event fees and possibly the school district cutting costs. CM Berning replied he should know more about this budget by the next council meeting. 9.4. Consider changing City Reorganization Workshop on 4-21-97 to 4 PM from 7 PM. The Council directed to leave the workshop scheduled for 7 PM. 9.5. Consider Otsego Bike Plan - Does Council want Park and recs. to continue with this. Darlene Solberg, Park and Rec. member, asked for Council direction on this issue. After Council discussion, it was decided to consider this at budget time and for the Park and Rec. Commission to discuss this at their 1998 budget meeting. 9.6. Discussion of guidelines for usage of outdoor play fields -possible adoption - The consensus of the Council was to send this to the Park and Rec. Commission to change the language appropriate to Otsego. 9.7. Consider approval of merit raise for Public Works part-time em14ee. CM Heidner motioned to approve this merit raise as recommended by the Public Works sub -committee. Seconded by CM Ackerman. All in favor. Judy Hudson will be the contact person. 9.9. City Clerk's U da e. Elaine Beatty went over her list of items which included bringing the Council up to date on the 101 Grand Opening and the recent flooding in Otsego. Mayor Fournier motioned for Otsego to participate in donating $100.00 for the 101 Grand Opening, taking this amount out of the City Council Contingency Budget. Seconded by CM Heidner. All in favor. Motion carried. 9.10. Consider Claims List fora approval, CM Heidner motioned to adopt the Claims List as presented. Seconded by CM Ackerman. All in favor. Motion carried.
