04-28-97 CCCITY OF OTSEGO WRIGHT COUNTY, MINNESOTA CITY COUNCIL MEETING WITH ISD 728 APRIL 28, 1997 1 Mayor�y Fournier will call meeting to order - Mayor Fournier called the meeting to order at 5:30 PM. Roll 11: Mayor Larry Fournier; Councilmembers: Virginia Wendel, Vern Heidner, Mark Berning. Absence: Suzanne Ackerman, Staff: Kevin Kielb, Assistant City Engineer; Larry Koshak, City Engineer; Andrew MacArthur, City Attorney; Elaine Beatty, City Clerk/Zoning Administrator; Judy Hudson, Deputy Clerk. School: Mark Strator, Patricia Scharber, David Flannery, Ron Bratlie, I Discuss Otsego Municipal Well regarding: Otsego Elementary School Mayor Fournier made introductions gave a brief history and requests from the last meeting and turned over to Kevin Kielb, Assistant City Engineer. Mr. Kielb went over the attached General Timeline, Pressure Switch Correspondence and the Agreement for Construction of a Municipal Well. Mr. Kielb went over the pressure switch concerns which were stated in a letter from his firm to KKE expressing concerns over the pressure switch as being a weak link in the system. Mr. Kielb also went over the pressure switch correspondence time line. Ron Bratlie, ISD 728, presented their time line. Mr. Bratlie said the School's position is: 1. Well wasn't properly developed which caused sand to be pumped causing problems. 2. Concern that well may pump sand and is a danger to the motor which could result in no water and therefore no fire protections. The school wants an agreement with the City to provide a back up pump. He introduced Ron Erickson, KKE; Craig Worm, Engineer, Roger Renner, Renner Wells. Dr. Flannery gave the following comments: 1. Clear indication from Traut Wells that well needed further development. 2. Every time the school talked to the City Engineer they said the problem was the tanks. Roger Renner, Renner Wells, went over his background and a brief over -view of what his company does. Page 2. development of well is usually done by air lift method sandblasting would not have been required not clear how much sandstone was removed explained about cavity pumping more than 360 gpm will produce sand timing is critical factor - look for sand when starting etc. visit to school last week there was still sand (1 cup each month) hard to determine if sand is coming from the line or from the pump discussed the computer program at the school, registering water usage etc. and sand is getting less explained the soft start confident well is not producing sand now but would have initially. identified as sandstone and not sand. views the problem sand was in the start up frequency has a real factor in this pressure switch starts at 40 and shuts off at 100 flow control device in drop pipe set at 360 gpm if there is a fire that demands more, pressure will drop and some rooms may not see fire protection - false sense of fire protection. making sure well is not being over pumped and need a larger reserve such as a water tower the school needs 80 to 85 gallons per minute and doesn't need 360 gpm. doesn't know what is needed to correct this well. feels the size of tanks serve the purpose and explained some particles come from the scaling from the pipes doesn't know if sand is actually coming from well, it was the initial kick in that did the initial damage, tanks won't hold sand may have a problem with pressure switches, there is an elaborate switch, sand build up or iron build up and this should be dealt with. tanks are very appropriate Kevin Kielb noted a pressure cut-off was put in manhole. There was further discussion and questions from the council. David Traut, Traut Wells. initially when well was put in, met the obligation of less than 5 parts per million testing was done on more than one occasion met at school and immediately recognized sand would be a problem, upon drilling in soft sand, discussed with Kevin Kielb and new location looked like could meet specification and explained removed 36 additional yards of sand, not much crust on soft formation and good decision not to go further with development 50 yards of sand was removed City Council/ISD 728 Meeting of April 28, 1997 contd. Dr. Flannery responded saying both - additional costs, further development of well, or what Renner has discussed, a variable drive that would pump 80 gpm when we need it can switch to more if needed, assurance to work together that we have constant source of water to school. Based on facts from experts that the well is still pumping sand and has caused motor problems. CM Heidner feels the City is meeting the 5 ppm and that some of the school equipment can't deal with this. There was also discussion on a report done by Traut Wells which Mr. Traut went over. Mayor Fournier requested Mr. Traut to send Dr. Flannery a copy of his letter. Kevin Kielb asked Dr. Flannery if he trusts his consultants to takes samples and their results. Dr. Flannery replied yes. Mr. Kielb noted those samples came back with the same results as the City's tests. There was additional discussion on testing. Adjourned at 6:50 PM. Consider Agenda Approval. CM Berning requested an addition under Other Council Business: Discussion of City Property located on 80th Street. CM Wendel requested an addition under Other Council Business: Heritage Commission Budget. Mayor Fournier requested an addition under Item 9.6. Set workshop date with Darkenwalds for discussion of development on 101 and 42. CM Berning motioned to accept the amended April 28, 1997 City Council Agenda. Seconded by CM Ackerman. All in favor. Motion carried. 3_ Consider Minutes: a March 12,_] 997 Sewer and Water Workshop with Dayton regarding Joint Services. Mayor Fournier motioned to adopt the minutes as written. Seconded by CM Wendel. Discussion: CM Heidner stated he listened to the tape and read the verbatim transcript and suggested to include this as part of the minutes. Mayor Fournier and CM Wendel agreed. All in favor. Motion carried. h_ April 14, 1997 Regular Council Minutes. CM Heidner motioned to adopt the minutes. Seconded by CM Berning. Discussion: Mayor Fournier requested a change on Page 5, Item 9.7. recommendation was made by the Public Works Sub -committee rather than the City Clerk regarding part time maintenance pay increase. OMn Forum: 4-1- Special Zpresentation by Julie Salina of Salina Salon in Elk River (,Fund for Flood rel_iefl. Cynthia Sandborn of Salina Salon, presented a check for $448 to the Council. They held a cut-a-thon on the Salon's day off and all proceeds went towards flood relief. It was the their decision to donate all the proceeds to Otsego. Mayor Fournier, on behalf of the citizens of Otsego and especially the flood victims, thanked Ms. Sandbom and the employees of Salina Salon. CM Heidner requested to bring disbursement of these funds under Other Council Business. Mr. Groen went over the attached financial statement and also the investment schedule. He noted he will be attending the Park Budget sub -committee Tuesday, April 29, 1997. 4.3_ Barb Kolb - Regarding deck Was not in attendance. Rod Bengtson, resident, noted to the Council letters his wife has received from David Licht, the city's planner. Mike Emberton, Allied Mortgage, representing the Don Greninger property, 283 acres. Noted he received a letter from the city attorney. He asked for recommendation from the Council on his next step in regards to this development. Mayor Fournier set a workshop for May 13, 1997 4 PM with Council, Mr. Emberton and Sienna Corporation. 5_ Consent Agenda. 5-1- Approve increase in pay for Otsego Building Supervisors. CM Heidner motioned adoption of the Consent Agenda. Seconded by CM Ackerman. All in favor. Motion carried. 6. Bob Kirmis, Assistant City Planner. David Licht, Senior Planner, was in attendance. Mr. Levenson noted his original request and requested Council reconsideration. After Council discussion with Mr. Levenson and Mr. Licht the following motion was made. CM Wendel motioned for staff to prepare a map locating this site and bring back to the Council on May 12, 1997. Seconded by Mayor Fournier. All in favor. Motion carried. 6.2_ Discussion building relocation for replacement mobile homes_ Mr. Licht went over the planning report. There was discussion of this with the Council, Jerry Olson (Building Official) and Mr. Licht. Otsego City Council Meeting of April 28, 1997, cont'd. Page 3. CM Heidner motioned to change this procedure through an Administrative Process and for staff to start the amendment process. Seconded Mayor Fournier. All in favor. Motion carried. 6.3. Any other Planning business. Mr. Licht reported the Planning Commission has reviewed the one per forty density transfer and clustering and suggested no change. CM lleidner motioned to accept the Planning Commissions recommendation and leave the Ordinance pertaining to the one per forty density transfer and clustering as is. Seconded by CM Ackerman. All in favor. Motion carried. CM Berning questioned that in regards to the Comprehensive Plan Update would it be better to start the public meeting (for public input) now rather than later. After Council and staff discussion it was decided that although the public meetings are very important and will be held the Council will need to know beforehand all the facts and figures in order to give the public answers. 7. Andy MacArthur, CityAtter 7.1. Consider 62nd Street (private road)etil ition. Both Mr. MacArthur and Mr. Koshak went over their reports. CM Wendel motioned to send letters to the residents outlining the city's specifications such as paving within five years, cul-de-sac and the full Right -of -Way and for City Engineer to review drainage issues. Seconded by CM Berning. All in favor. Motion carried. Mr. MacArthur noted he has not heard anything on the Lef-Co case. S. Larry Kosh Engineer - 8.1. Consider crack sealing quotes for Public Works, CM Heidner motioned for the Public Works Sub -committee to complete a Plan and Policy and is put in place for crack filling on a City wide basis and before any work commences it has Council approval. Seconded by CM Ackerman. CM Berning motioned to amend the motion to also accept the quote from Northwest Asphalt for $23,100. Seconded by Mayor Fournier. Voting For the Amended Motion: Mayor Fournier, CM Berning Voting Against the Amended Motion: CM Ackerman, CM Heidner, CM Wendel Motion failed three (3) to two (2). Mr. Koshak reported on 65th Street - concluded an agreement with the State on the correction, the city has placed material on it and billed the contractor and the State has agreed to put gravel on the top of it for no cost. 8.3_ Any other Engineering Business- a__ usiness. a Dave Chase will he at this meetingfor questions/comments- Mr. Chase requested the need to hire two maintenance staff for a total of three full maintenance staff. Mayor Fournier set a Public Works Sub -committee meeting for May 14, 1997 at 4 PM. 9. Council Items: 9.1. This is deadline date for consideration_ of sewer/water. Mayor Fournier motioned to set June 9, 1997 as the deadline date for consideration for sewer and water. Seconded by CM Wendel. Voting For the Motion: Mayor Fournier, CM Ackerman, CM Heidner, CM Wendel. Voting Against the Motion: CM Berning Motion carried four (4) to one (1). Mayor Fournier set May 15, 1997, 4 PM for a City Council Workshop to go over the Sewer Trunk Line Study. 9.2. Seconded by CM Wendel. All in favor. Motion carried. 9.4. Mayor Fournier a_l)l o'nt a sub -committee to investigate and 12roop ce a Code of Conduct for elected and appointed officials. CM Ackerman and Mayor Fournier volunteered to be on this sub -committee. 9.5. Public Works: anoint a safety officer. CM Heidner motioned to appoint Dave Chase as safety officer. CM Berning motioned to have the Personnel Policy amended to include a no smoking policy in all city buildings and vehicles. Seconded by CM Ackerman. All in favor. Motion carried. Staff was directed to bring this proposed change back to the next meeting. 9.6. Any other Council Business. 9.6.1_ City roperty located on 80th Street. Mayor Fournier motioned to accept staff s recommendation to allow Mr. Ruch to store his wood and use the property for a garden in exchange for maintenance of this property (PID 118-500-251101) and for staff to send a letter to Mr. Ruch as recommended by the City Attorney. Seconded by CM Ackerman. All in favor. Motion carried. 9.6.2. Set Council workshop meeting with the Darkenwald development at 42 and 101. Mayor Fournier set June 3, 1997, 4 PM for this Council Workshop. CM Wendel motioned to identity everyone in the flood plain, except the trailers in the Park and to divide the money equally and to include the Benesh property and to include in the letter where money came from. Seconded by CM Ackerman. All in favor. Motion carried. CM Wendel requested a status report for this commission and to keep them informed. CM Berning asked what budget is the moving of the Old Town Hall (for the Conditional Use Permit) being taken from. Staff will check into this. CM Berning motioned for all personal property of non -city employees be removed from city buildings by Friday, May 2,1997. Seconded by CM Wendel. CM Berning withdrew the motion. CM Wendel motioned for all personal property of non -city employees be removed from city buildings by May 9, 1997. Motioned failed for lack of a second. CM Berning motioned for a letter to be sent to Duane Fielder thanking him for his time and service at the City and wish him well. This should be reviewed by the City Attorney, if appropriate. Seconded by Mayor Fournier. All in favor. Motion carried. Mayor Fournier stated that Council Members authority is at Council meetings, otherwise they don't have any authority unless they have been appointed by the Council. City l rk'sUpdate_ Elaine Beatty reported Congressman David Minge will be reviewing the flood area on May 5, 1997. She also briefly went over the Fehn's Mining Permit regarding crushing. Also noted that the Bike Rodeo was canceled for May 4, 1997. Elaine reported she will be attending the Municipal Clerk's Institute from July 14th through the 18th at the University of Minnesota at a cost of $325, which is a budgeted item. 9.8. Consider Claims List for Approval. CM Heidner motioned to accept the Claims List. Seconded by CM Ackerman. All in favor. Motion carried. 9.9. Adjourn by 10 PM. CM Ackerman motioned to adjourn.
