Special Presentation by Leo Offerman, Wright Hennepin Electric Lighting Improvement and Cost Savings Proposal for Otsego Hall BACKGROUND: Mr. Offerman, from Wright Hennepin visited with me regarding the different options they have Re: Economic Development Moines and lighting for our City Hall, off-peak air, etc. came up. I asked him to put information together as to savings and how it would work for Otsego. He worked on this project with Mike Kirscht on Electric issues. Attached is a report as to lighting improvements and cost saving information. Mr. Offerman will be here to give an overview of this report and bottom line to the Council and will ask that the Council approve this change. RECObRdENDATION : This is a Council decision. AC COMMUNITY PLANNING • DESIGN • MARKET RESEARCH PLANNING REPORT TO: FROM: DATE: RE: FILE NO: EXECUTIVE SUMMARY Background Otsego Mayor and City Council Otsego Planning Commission Bob Kirmis 11 June 1996 Otsego - Levenson/Grote Comprehensive Plan Amendment/ Rezoning 176.02 - 96.10 Mr. Paul Levenson and Mr. and Mrs. Jerome Grote have expressed a desire to subdivide (split) their 5.2 and 5.5 acre properties located south of 62nd Street and west of Highway 101. As part of the Highway 101 improvement plan, a new segment of Quam Avenue is to be constructed which will lie between the two properties in question. If allowed, the newly created lots would be provided access via new Quam Avenue. To accommodate the proposed future land division (splitting) of the parcels, the following approvals are necessary: 1. A Comprehensive Plan Amendment to: a. Include the subject property in the Immediate Urban Service Area. b. Change the suggested use of the subject properties from agricultural to low density residential (Land Use Plan amendment). 2. A rezoning of subject properties from A-1, Agricultural Rural Service to R-3, Residential Immediate Urban Service. 5775 Wayzata Blvd. - Suite 555 - St. Louis Park, MN 55416 - (612) 595 -9636 -Fax. 595-9837 Should the City approve the necessary Comprehensive Plan amendment and rezoning requests, the applicants would then pursue subdivision of their properties. Attached for reference: Exhibit A - Site Location Exhibit B - Detailed Site Location Exhibit C - Urban Service Districts Exhibit D - Land Use Plan Exhibit E - Conceptual Subdivision Plan Recommendation It is the opinion of our office that a decision regarding the requested Comprehensive Plan amendment (and rezoning) relates directly to the City's pending sewer study and the subject properties possible inclusion within a sanitary sewer service district. While inclusion of the properties within such district may occur at some future point, their current exclusion may constitute the applicants' request as "premature". Decisions regarding land use appropriateness are, however, considered policy matters to be determined by City officials. Acknowledging that the Comprehensive Plan provides justification for rezoning actions, our office would recommend approval of the requested rezoning only upon condition that the City approve the requested Comprehensive Plan amendments. ISSUES ANALYSIS Comprehensive Plan Amendment: As shown on Exhibit C, the subject property currently lies within the City's Rural Service Area. The intent of the rural service designation is to identify areas where a continuation of rural use is proposed and where urban development and associated services is not desired. Reflective of the subject properties inclusion within the Rural Service District, the City's Land Use Plan suggests agricultural use of the subject property. While the subject property may (or may not) be included within a newly designated sanitary sewer service district (as part of the pending sewer study), such revised district boundary has not, to date, been established. The sewer service designation establishes a basis for the City's Urban Service Area boundaries and resulting decisions regarding land use appropriateness (i.e., rezoning requests). 4 The fact that the subject properties are not at this time, included within a sanitary sewer service district may establish the requested amendment (service district boundary and Land Use Plan) to be premature. If, however, the City chooses to approve the necessary Comprehensive Plan amendment, the following findings should be made: The area is planned to be and may be adequately served by future sanitary sewer. 2. The land does not qualify as premature development in that: a. The land holds adequate storm water drainage capacity. b. The land has a safe water supply. C. Adequate roads serve the subject property. d. The sites in question hold the ability to accommodate a safe sewage disposal system. Rezoning: R-3 District. As noted previously, the applicants have requested a rezoning of the subject properties from A-1, Agricultural Rural Service to R-3, Residential Immediate Urban Service. The properties existing A-1 zoning designation allows a maximum density of one dwelling per 40 acres of land. Thus, the proposed lot subdivisions (splits) cannot be accommodated under the properties' existing zoning designation. The requested R-3 designation would provide a mechanism for the applicants to subdivide their property. Judgement Criteria. Section 20-3-2.F of the Zoning Ordinance states that the City Council and Planning Commission shall consider possible adverse effects of the rezoning. Their judgement shall be based upon, but not limited to, the following criteria: The proposed action's consistency with the specific policies and provisions of the City Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. 3. The proposed use's conformity with all performance standards contained herein (i.e., parking, loading, noise, etc.). 4. The proposed use's effect upon the area in which it is proposed. 3 5. The proposed use's impact upon property values of the area in which it is proposed. 6. Traffic generation by the proposed use in relation to capabilities of streets serving the property. 7. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities, and its potential to overburden the Cit's service capacity. Comprehensive Plan. The City's Land Use Plan, as shown on Exhibit D, proposes agricultural use of the subject property. While the subject properties are acknowledged not to be "agricultural" in use under the common definition of the term, an intent of the suggested agricultural designation is to discourage further "urban" development in the area. While the Land Use Plan does not specifically support the proposed low density residential use, the Comprehensive Plan's policies provide justification both for a change in land designation and denial of the rezoning request. From these guidelines, City officials must determine which are the most important considerations and weigh most heavily on the request at hand. Policies encouraging the proposed use include: • All development proposals shall be analyzed on an individual basis from a physical, economic and social standpoint to determine the most appropriate use within the community as a whole. • Once established, geographic land use designations and related zoning classifications shall be changed only when it can be demonstrated that such modifications are in the best interest of the community on a long range perspective and such changes will promote land use compatibility and pre -determined goals and policies and the Comprehensive Plan. Policies discouraging the proposed use include: • Permit growth on a phased basis providing for a logical extension of urban growth and community services. • All development proposals shall be analyzed on an individual basis from a physical, economic and social standpoint to determine the most appropriate use within the community as a whole. El Immediate, short range market potential and demands for activities which are not suggested for a site or area by the Comprehensive Plan or allowed by the Zoning Ordinance shall not be the sole justification for a change in activity. Urban and rural service areas shall be clearly designated with appropriate density and use controls to facilitate staged and substantially utilized service systems. Land Use Compatibility. The subject properties are bounded on the north, south and west by large lot single family development (i.e., three to five acres). Such properties are zoned A-1, Agricultural Rural Service. Approximately 400 feet to the northwest of the subject properties lie the Christian Acres single family subdivision which holds an R-3 zoning designation (approved under Wright County). The subject properties are bounded on the east by the Highway 101 corridor. While the proposed use (i.e., 2.5 acre lots) may be compatible with surrounding uses, question exists in regard to the promotion of urban development in this area of the City (prior to adoption of a sanitary sewer plan) and the precedent related to such decision. Performance Standards. As part of any future subdivision of the properties, all applicable R-3 District standards must be satisfactorily met. Property Values. Although no detailed study has been conducted, the proposed creation of two additional single family residential lots would not be expected to lower area property values. Traffic Generation. The ultimate creation of two additional single family residential lots would result in a slight increase in area traffic. Such dwellings likely would be provided access via a newly created segment of Quam Avenue. While anticipated traffic could likely be accommodated by area streets, question exists as to whether the introduction of additional traffic in this area of the City will economize service delivery. Public Services. If the requested R-3 zoning designation is approved, findings should be made that the resulting use will not overburden the City's service capacity. Although the introduction of two additional dwelling units will likely not overburden the City's service capacity. The allowance of "urban" development in this area of the community and the resulting precedent is of some concern, unless determined to be consistent with the land use planning objectives. 5 CONCLUSION While justification exists for both approval and denial of the requested Comprehensive Plan amendment and rezoning, the expansion of the Immediate Service Area at this time (prior to establishment of a new sanitary sewer service district) may suggest that the proposed development is premature. Decisions regarding land use appropriateness are, however, considered matters of City policy to be determined by City officials. The proposed 38 lot subdivision overlays approximately 64.5 acres of land. The subject site is zoned R-3, Residential Immediate Urban Service. Attached for reference: Exhibit A - Site Location Exhibit B - Approved Preliminary Plat Exhibit C - Final Plat Exhibit D - Final Grading Plan Recommendation Based on the following review, our office recommends approval of the Heritage Hills final plat subject to the following conditions: 5775 WAYZATA BOULEVARD, SUITE 555 ST. LOUIS PARK, MINNESOTA 554 1 6 PHONE 6 1 2-595-9636 FAX 6 1 2-595-9637 1. A temporary cul-de-sac is provided at the southern terminus of O'Day Avenue N.E. 2. The City Engineer determine that wetland delineations will not adversely impact the plat design and buildable area. 3. The southern side lot line of Lot 9, Block 4 is adjusted to lie at a right angle to Ochoa Court. 4. All restrictive covenants applicable to the subject subdivision are subject to review and approval by the City Attorney and minimally include the following: a. All houses and buildings constructed on property within the plat shall be sited consistent with the submitted resubdivision plan. b. The home on Lot 11, Block 4 shall be designed and oriented in a manner conductive to future interior street access (from the north). At such time as a northerly access is available, driveway access to Odean Avenue shall terminate. C. Direct driveway access to 85th Street NE shall be prohibited. In the event that restrictive covenants are not to be provided as part of the subject subdivision, the above conditions shall be made part of and enforced by the subdivision's development agreement. 5. Outlot A is formally dedicated to the City. 6. All park land dedication requirements are satisfactorily met. 7. The submitted grading plan is subject to review and approval by the City Engineer. 8. The developer enters into a development agreement with the City and post all the necessary securities required by it. 9. Comments of other City staff. ISSUES ANALYSIS Consistency with Approved Preliminary Plat. The lot, block and street design illustrated on the final plat is consistent with the preliminary plat which was approved by the City Council on 24 March 1997. K Lots. The 38 lots illustrated upon the final plat are identical in configuration to those illustrated upon the approved preliminary plat. All lots meet or exceed R-3 District lot area requirements and demonstrate an ability to meet applicable R-3 District setbacks. Streets. The streets illustrated upon the final plat are likewise identical to that illustrated upon the approved preliminary plat. As a condition of final plat approval, a temporary cul- de-sac should be provided at the southern termination of O'Day Avenue NE. It is envisioned that such street will be extended through the undeveloped property to the east at some future point. Considering that Odean Avenue is a designated collector street, as a result, the orientation of the home upon Lot 1, Block 4 and driveway design should be in a manner conducive to future street access from the north. At such time an alternative access is available, direct access to Odean Avenue should terminate. This condition will be imposed through the subdivision's development agreement. In order to ensure that Outlot A is retained for a future roadway extension, such outlot should be dedicated to the City. All proposed street names have been found to be acceptable. Wetlands. As a condition of previous preliminary plat approval, it was stipulated that a determination must be made by the City Engineer that the required wetland delineation does not adversely impact the plat design and buildable area. This issue should be subject to comment by the City Engineer. Side Lot Lines. In consideration of the preliminary plat, it was stipulated (as a condition of approval) by the City Council that the southern side lot line of Lot 9, Block 4 be adjusted to lie at a right angle to Ochoa Court. The submitted final plat has not responded to this condition. As a condition of final plat approval, the cited site lot line should be adjusted to lie at a right angle to Ochoa Court. Restrictive Covenants. If restrictive covenants are to be provided for the subject subdivision, they shall be subject to approval of the City Attorney and should include, but not be limited to, the following conditions: 1. All houses and buildings constructed on property within the plat shall be sited consistent with future subdivision and shall be typical for urban development with regard to future lot lines and shall meet City and County standards for existing lot lines. K7 2. The home on Lot 11, Block 4 shall be designed and oriented in a manner conductive to future interior street access (from the north). At such time as an interior street access is available, driveway access to Odean Avenue shall terminate. 3. Direct driveway access to 85th Street NE shall be prohibited. In the event that restrictive covenants are not to be provided as part of the subject subdivision, the above conditions shall be made part of and enforced by the development agreement. Park/Trail Dedication. As a condition of final plat approval all park and trail dedication requirements as recommended by the Park and Recreation Committee must be satisfactorily met. Grading and Drainage. In conjunction with the final plat submittal, a final grading and drainage plan has also been submitted for review (see Exhibit D). As a condition of final plat approval, such plan must be subject to review and approval by the City Engineer. Development Agreement. As a condition of final plat approval, the applicants will be required to enter a development agreement with the City and post all necessary securities required by it. CONCLUSION Review of the a Heritage Hills final plat finds that the final plat is substantially identical to the previously approved preliminary plat. Based on the preceding review, our office recommends approval of the final plat subject to the conditions listed in the Executive Summary of this report. The proposed 34 lot subdivision overlays 45 acres of land located north of County Road 37 and east of Odean Avenue. The subject site has been zoned PUD, Planned Unit Development to accommodate the proposed use and development density. Attached for reference: Exhibit A - Site Location Exhibit B - Approved Preliminary Plat Exhibit C - Final Plat Exhibit D- Re -subdivision Plan RECOMMENDATION Based on the following review, our office recommends approval of the Lin -Bar Estates 2nd Addition final plat subject to the following conditions: 1. Temporary cul-de-sacs are constructed at the northern terminus of Odell Avenue and at the eastern terminus of N. E, 71st Street. 5775 WAYZATA BOULEVARD, SUITE 555 ST. A landscape buffer, similar to that proposed along County Road 37 (i.e., spruce plantings) be provided along the western boundary of Lot 1, Block 3. 4. Landscape plantings be provided along the periphery of the subdivision's drainage ponds. The size and variety of such plantings shall be determined by the City Engineer to be water tolerant. 5. Each lot within the subdivision contains at least five trees having calipers not less than four inches. 6. A final grading and drainage plan is submitted subject to review and approval by the City Engineer. 7. The siting of homes within the subdivision is consistent with the resubdivision plan except in cases where the City Building Official finds that the width of a proposed home exceeds provided building pad widths. 8. All park and trail dedication requirements as recommended by the Park and Recreation Committee and approved by the City Council are satisfactorily met. 9. The applicants enter into a development agreement with the City and post all the necessary securities required by it. 10. Comments of other City staff. ISSUES ANALYSIS Planned Unit Development. In December of 1996, the City Council approved a rezoning of the subject property from A-2,Agricultural Long Range Urban Service to a PUD, planned unit development zoning designation. The PUD zoning designation was, however, approved contingent upon approval of the final plat now under consideration. Consistency with Approved Preliminary Plat. The lot, block and street design illustrated on the final plat is consistent with the preliminary plat which was approved by the City Council on 24 March 1997. One minor modification does exist in the renaming of former N. E. 72nd Street to N. E. 71 st Street. Pa Lots. The 34 lots illustrated upon the final plat are identical in configuration to those illustrated upon the approved preliminary plat. All lots have been found to exceed minimum R-3 District area, width and depth requirements (standards applied to PUD zone). Streets. The streets illustrated upon the final plat are likewise identical to those illustrated upon the approved preliminary plat. Temporary Cul -de -Sacs, As a condition of final plat approval, a temporary cul-de-sac should be placed at the northern terminus of Odell Avenue and eastern terminus of 71 st Street. 71 st Street. In consideration of the preliminary plat, question was raised as to the need to construct 71 st Street (72nd Street renamed 71 st Street on final plat). Such street segment would provide a connection to future development to the est. The City Engineer has recommended that the 71 st Street segment be constructed immediately (in conjunction with other streets within the plat. Street Names. All proposed street names have been found to be acceptable. Access. As a condition of final plat approval, direct single family lot access to both County Road 37 and Odean Avenue (designated collector streets) should be prohibited. Landscaping. As a condition of preliminary plat approval, it was stipulated that a landscaping buffer similar to that provided along the plat's northern and eastern borders (spruce trees) also be provided along the western boundary of Lot 1, Block 3, to lessen adverse impacts associated with traffic along Odean Avenue. It was further specified by the City Council that each lot within the subdivision contain at least five trees having calipers not less than 4 inches. Additionally, it was stipulated that landscaping be provided along the periphery of drainage ponds. The size and variety of drainage pond plantings should be determined by the City Engineer to be water tolerant. Grading and Drainage. As a condition of final plat approval, a final grading and drainage plan must be submitted and subject to review and approval by the City Engineer. Resubdivision. In accordance with the conditions of preliminary plat approval, a resubdivision plan has been submitted (attached as Exhibit B). The siting of homes within the plat should be consistent with such plan except in cases where the City Building Official finds that the width of a proposed home exceeds provided building pad widths. Details of such requirement will be specified in the subdivision's development agreement. 3 Parks and Trail Dedication. As a condition of final plat approval, all park and trail dedication requirements as recommended by the Park and Recreation Committee and approved by the City Council must be satisfactorily met. Phasing. The previously submitted preliminary plat indicated that the subdivision was to be developed in two phases. According to the applicant's engineer, it is now the intent of the developers to plat the entire property at this time and disregard the previous phased concept. Development Agreement. As a condition of final plat approval, the applicants will be required to enter into a development agreement with the City and post all the necessary securities required by it. CONCLUSION Review of the Lin -Bar Estates 2nd Additional final plat finds that the final plat is substantially identical to the previously approved final plat. Based on the preceding review, our office recommends approval of the final plat subject to the conditions listed in the Executive Summary of this report. Of specific issue are driveway surfacing requirements applied to single family residential uses within plats approved prior to 1 January 1992. According to Section 20-22-4.H.12 of the Zoning Ordinance, any residential use (within an R-3 District and in plats of five or more lots) which undertakes an improvement requiring a building permit and the value of such improvement exceeds two thousand five hundred ($2,500) dollars is required to upgrade the driveway and parking areas to meet surfacing standards for new construction. Specifically, existing graveled driveways must be upgraded to be surfaced in asphalt, concrete, cobblestone or paving brick (see attached Exhibit A for exact ordinance excerpt). Uses which front upon graveled public streets are, however, exempt from this requirement. The intent of such surfacing requirement is to provide a mechanism to implement the eventual "upgrade" of properties to "new" subdivision standards. This requirement was specifically discussed and endorsed by the Town Board/City Council as part of the Zoning Ordinance's initial adoption and reflects the policies of the Comprehensive Plan. As you are likely aware, numerous, and possibly the majority of single family residential subdivisions within the City (platted prior to 1 January 1992) currently have driveways surfaced in gravel and front upon hard surfaced (asphalt) streets. 5775 WAYZATA BOULEVARD, SUITE 555 ST. This requirement could thus potentially apply to applications for the following: - Home additions - Accessory buildings - Porches - Septic systems - Fences - Interior remodeling - Swimming pools As a matter of standard City practice, this requirement has not been enforced. Staff has raised concern that the $2,500 permit requirement may be excessively low and may in fact discourage property improvements. According to a representative of Pioneer Blacktop of St. Michael, a two inch overlay of asphalt will cost between $1.20 to $2.00 a square foot depending on soil conditions. Thus, an overlay of a 1,000 square foot gravel driveway could be expected to cost between $1,200 and $2,000. At this time, staff requests that the Council either confirm its previous policy (reflected in existing ordinance language) or direct modifications as it feels appropriate. Number of Curb Cuts: Each property shall be allowed one curb cut access and may be allowed upon City Council approval, additional curb cuts for each one hundred twenty-five (125) feet of street frontage. All property shall be entitled to at least one curb cut. Single family uses shall be limited to one curb cut access per property unless a conditional use permit is approved pursuant to Section 4 of this Chapter. 12. Surfacing: a. Farmsteads, farming operations, and detached single family residential uses in unplatted areas or plats of less than five lots in other than R-3 Zoning Districts: Driveways and parking area shall be surfaced with materials suitable to control dust and drainage. b. Detached single family residential uses in the R-3 Zoning District and in all residential plats of five lots or more: (1) In any plats approved after 1 January 1992, all detached single family residential uses shall have driveways and parking stalls surfaced with asphalt, concrete, cobblestone or paving brick. Since this situation is complex, it is a difficult issue for all of us. Based on the information presented, it is evident that two issues exist. The first issue is that sand was introduced into the geothermal, domestic, and fire protection systems and caused damage and expense. The second issue is that a large volume demand may cause deficient water pressure and, therefore, leave the building, or parts, unprotected. The Otsego Elementary School was impacted with problems of sand from the initial startup of the new municipal well. This initial startup included the following problems: The soft start was not in use at the time which caused a hard "across the line" start up of the system. This is probably when the bulk of the sand was introduced into the systems. 2. The pump initially delivered more than 360 gpm. An orifice was later installed in the drop pipe to limit the flow from the pump to 360 gpm. 3. The pressure settings on the pressure switch were set at a narrow range. A wider range was set at the same time that the soft start was installed to allow the pump to ramp up. This eliminated the short cycling. In order for the School District to open school with a reliable, sand free water supply, the Fire Marshal directed the School District to install a sand filtering system. It should also be noted that there were problems meeting the water flow requirements of the State Fire Marshal. The "fault" seems to be with the "fit" of the system, the size of the pump, the well conditions down under, the holding tanks, and the volume of water demands of the School District. The School District has spent over $60,000 for consultant fees, testing, cleanup, water filtration equipment, and other related expenses for the city water supply. These expenditures were absolutely necessary. The water supply is still carrying sand to the system, presently at a much lower rate. We believe that the real problem in this whole mess was communication. The School District asked the City Engineers to help solve this problem in the beginning. It became the burden of the School District to prove to the City Engineers that the well was the source of the sand. It took almost two months before there was any willingness to even admit that the well could be a part of the problem. A lot of time, energy, and expense could have been avoided with more cooperation. This was a joint venture with the School District contributing $35,000 to the City of Otsego to provide a larger well and allow the city to expand its clientele at a later date. Since we were both inexperienced with wells, and since the well arrangement was for the be efi) of both parties, we are asking the City to share in the additional expenses. The initial contract was signed for a six month period. I had originally estimated the position would require approximately 12 to 16 hours per week on a continuing basis. I still believe this is a very reasonable estimate of the time required based on my experience to date. While this has been a relatively short time period, I believe that 1 can report some significant accomplishments to date. The payroll has been contracted out with ADP and will cost the City approximately $1,000 annually. The ADP charges include the automatic deposit of all payroll taxes, quarterly reports and year-end W -2's. The time required to complete this process has been greatly reduced and ADP guarantees the accuracy of the payroll reporting. I have also begun to work on billing all the escrow accounts which in many cases had not been billed since sometime in 1995. The 1997 budget has been integrated into the finance system to provide monthly budget and actual revenues and expenditure reports. There are more challenges ahead and I am looking forward to continuing this working relationship. I am requesting an hourly rate increase to $30 per hour for the next six-month period. At an average of 16 hours per week (which I believe to be the maximum and it has been to - date) the City's annual cost is less than $25,000, which is a savings of $40,000 from the previous finance director position. Reconsider Flood Relief funds from Salina Salon BACKGROUND: At the last Council Meeting the Council determined that we should divide the money equally that was received for flood relief. After looking at the original letters I sent out there are approximately 40 people that we would divide this money with. That does not give each family very much money and I would like the Council to review this and determine how they would like to handle this. I have written out a receipt and placed the money in the general fund for now. I would like some Council direction as how to handle this. The problem I have with this is it probably costs more to write the checks and letters and postage and distribute the money then what the check amount is. Marketing will put together an article introducing Mark Nevinski and one on Product Technology. MEMBERSHIP COMMITTEE REPORT: Judie Rose reported on membership dues. Statements were sent out last week and the mailing list is updated. MEMBERSHIP COMMITTEE REPORT: Neil McMillin explained the Executive Director's compensation package. A motion was made and passed to change vacations to calendar year and have 5 days in 1997 and 10 days in '98. A motion was made and passed to approve the Executive Director's compensation package as amended. Wright Hennepin has offered to work with the Partnership to develop home page. There was discussion on the advantages this offers our smaller cities and townships. Catherine Jackson has our IRS Filing to change our status to 501C-3 completed and is waiting to have a C.P.A. check the figures. She will see that it is sent off.
