PID # 118-037-001140 described as Lot 14, Block 1, Walesch Estates, Second
Addition in Section 21, Township 121, Range 23. right o m CMN Request is as
follows:
A Conditional Use Permit to allow relocation of a home (move in to replace
single wide mobile home.)
Mr. Kirmis - Mr. Charles Klein requested a CUP to allow a relocated singe family
residence. Property is zoned R-3, Res. Immediate Urban service area. Driveway surface
requirements are to be in accordance with existing ordinance or pending amendment. NAC
recommends approval of the requested building relocation contingent upon the fulfillment
of ten conditions in report dated May 15, 1997, which Mr. Kirmis read. Larry Koshak,
City Engineer, had recommendations in letter dated May 19, 1997, wetlands need to be
delineated, septic tank drainfield setback requirements need to be met. Also
recommended the movers be responsible for any damage to the streets.
Chair Swenson opened the Hearing to the public for any questions or comments. None
Brought discussion back to the Planning Commission.
Richard Nichols - Regarding Hakanson Anderson's letter dated May 19, 1997, had
questions on septic systems that don't meet current wetland setbacks.
Mr. Kirmis - Typically a CUP request with a non -conforming septic system is an issue for
the Building Official or City Engineer. In this case the applicant plans to upgrade his
system.

Eugene Goenner - Did not feel the mover should be responsible for road damage N,-ca
the road is in such poor condition there.
Mr. Kirmis - Mover is responsible for road damage. This is always the case just hasn't
gotten into the reports before. Recommended adding a condition that there is no adverse
impact. State permit may require insurance be in place to correct any damage.
Elaine Beatty - In the past the mover has been required to be licensed and bonded.
Eugene Goenner recommended adding the word excessive to the Engineers report.
Chair Swenson - Asked the applicant if he wished to comment:
Charles Klein - He will be having a new mound septic system put in by Dan Reed. The
mover is licensed and bonded and does carry insurance. Also, he can provide any other
information the city may need.

Lot 3, Block 7, Country Ridge Development Request is as follows*
A Conditional Use Permit to allow more than one Residential Driveway
(curbcut) for a single family dwelling:
Mr. Kirmis - Gregory and Linda Strommen have requested approval of a CUP to allow for
a second curb cut for their lot located south of 85th and west of Palmgren Avenue NE.
Access to the detached garage via the property's existing curb cut would present
significant difficulties due to the location of a well and tree within the front yard of the lot.
The City Engineer, in letter dated May 19, 1997, expressed concern with obstruction in
the flow line of the ditch, possible precedent being set. The City Engineer objects to the
second curb cut. (see attached) The ordinance does allow a second driveway with a
CUP. NAC recommends approval of the CUP request to allow a second curb cut subject
to 4 conditions listed in NAC's report dated May 12, 1997, which Mr. Kirmis read.
Chair Swenson opened the hearing to the public for questions and comments. None
Brought hearing back to Planning Commission for discussion.

Richard Nichols asked the applicant if there was a culvert under the existing driveway and
if the proposed garage could be accessed.
Mr. Strommen - Yes there is a culvert, but if pulling a trailer it wouldn't make the turn
with the well and a tree so close.
Chair Swensnon - The City Engineer commented that it violates the subdivision overlay
plans.
Mr. Kirmis - Didn't see this as a major impact, however, if sewer comes they will be
responsible for those costs.
Richard Nichols - This would be the first 2nd curb cut, but there are limits to how close
you can get to a well. He wouldn't object to allowing the 2nd curb cut..
Eugene Goenner - There is 17 feet from the ditch to the well. It appears could make that
corner without a second curb cut. Could the paving be deleted?
Mr. Kirmis - Accessory buildings housing mowers etc. do not require a driveway,
however, vehicular accesses require paving.
Richard Nichols - This is a newer development. Allowing the second curb cut with the
driveway paved would be best.
Arleen Nagel - Item #3, Recommendations, ne proposed driveway is surfa Pd it asphalt+
concret ., cobblestone, or a i g brick- Would this be subject to the proposed
amendment?
Mr. Kirmis - Except on gravel roads. It is intended to bring developments to current
standards. Since 1992 if development is platted it needed to be paved.
CM Berning - At the last City Council meeting it was brought to our attention that any
upgrade (septic system, deck, etc.) over $2,500.00 a driveway upgrade is needed. This
seems extreme.
Eugene Goenner - Could it be required that the second curb cut be placed in such a way
that at the time of re -subdivision it would become their driveway?
Mr. Kirmis - It would be appropriate to consider where the second house would be built.
Also asked if applicant intended to pave the driveway.
Mr. Strommen - Yes.
Chair Swenson - Went back to public for comment. None. Closed public hearing and
brought discussion back to the Planning Commission.

drainage patterns.
Chair Swenson - Opened the Hearing to the public and asked if anyone wished to be
heard. No one did. Brought discussion back to the Planning Commission.
CM Berning asked if Item # 2, 3, and 4, under Recommendation are required.
Mr. Kirmis - Whatever is decided by the City Council regarding the amendment will apply.

This item came to P.C. for Hearing on May 21, 1997. NAC recommended
approval of the request with five conditions from their report. After
Hearing and discussion the following recommendation was made to the
Council:

ection 20-4-2.F of the Zoning Ordinance directs the Planning Commission and
amity Council to consider seven possible adverse effects of the proposed conditional
use. The seven effects and findings regarding them are:
a. The proposed action's consistency with the specific policies and
provisions of the official City Comprehensive Plan.
The proposed use of the subject property will be compatible with adjacent
properties. As such, the use is consistent with the intent of the
Comprehensive Plan and the property's R-3 zoning designation.
b. The proposed use's compatibility with present and future land uses of
the area.
The proposed accessory storage building will be compatible with present
and future uses in the area.
C. The proposed use conforms with all performance standards contained
herein (i.e., parking, loading, noise; stc.).....
The proposed use will conform to all applicable performance standards.
d. The proposed use's effect on the area in which it is proposed.
The proposed use will not tend to or have an adverse effect upon the area
in which it is proposed.
e. The proposed use's impact upon the property values of the area in
which it is proposed.
While no detailed study has been conducted, similar situations dictate that
the proposed use will not tend to depreciate area property values.
f. Traffic generated by the proposed use in relation to capabilities of
streets serving the property.
Traffic generated by the proposed use is within the capabilities of 78th Street
which serves the property.
g. The proposed use's impact upon existing public services and facilities
including parks, schools, streets and utilities, and its potential to
overburden the City's service capacity.
The proposed use can be accommodated by existing public service facilities.
The proposed use will not overburden the City's service capacity.
6. The planning report dated 7 May 1997, prepared by Northwest Associated
Consultants, Inc., is incorporated herein.

7. On 21 May 1997, the Otsego Planning Commission conducted a public hearing to
consider the proposed conditional use permit application preceded by published
and mailed notice. Upon review of the conditional use permit application and
evidence received, the Otsego Planning Commission closed the public hearing and
recommended that the City Council approve the conditional use permit based on
the aforementioned findings.
DECISION
Based on the foregoing considerations and applicable ordinances, the applicant's request
for a conditional use permit to relocate a single family residence to an existing lot of record
is approved in its present form and subject to the following.stipulations:
1. The subject site's driveway is surfaced in accordance with the directives of the City
Council, either in compliance with existing ordinance requirements or pending
amendment. If the City Council proceeds with the processing of an amendment,
final CUP approval shall coincide and respond to the requirements of such approval
(or denied) amendment.
2. The proposed accessory building is not used for home occupation/commercial
related activities or the keeping of animals.
3. A building elevation (or elevations) is submitted which demonstrates compliance
with City building height requirements.
4. The proposed accessory building match the site's principal building in color
5. Ten foot wide drainage and utility easements are provided along side and rear lot
lines.
ADOPTED by the Otsego City Council this 9th day of June 1997.

Recommendation
Based on the following review, our office recommends approval of a conditional use permit

family dwelling subject to the following conditions:

final CUP approval shall coincide and respond to the requirements of such
approved (or denied) amendment.
2. The proposed accessory building is not used for -home occupation/commercial
related activities or the keeping of animals.
3. A building elevation (or elevations) is submitted which demonstrates compliance
with City building height requirements.
4. The proposed accessory building match the site's principal building in color.
5. Ten foot wide drainage and utility easements are provided along side and rear lot
lines.
6. Comments from other City staff.
ISSUES ANALYSIS
CUP Review Criteria. As noted previously, the applicant has requested a conditional use
permit to allow more than one detached (or second) accessory building upon his property.
According to Section 20-16-4.1 of the City Zoning Ordinance, a conditional use permit for
an accessory storage structure may only be granted provided that:
There is a demonstrated need and potential for continued use of the structure and
the purpose stated.
2. In the case of residential uses, no commercial or home occupation activities are
conducted on the property. This prohibition shall include the storage of materials
and equipment which are unrelated to the on-site residential use and facility.
3. The building has an evident re -use or function related to the principal use.

4. The accessory building shall be maintained in a manner that is compatible with the
adjacent uses and does not present a hazard to public health, safety, and general
welfare.
5. The provisions of Section 20-4-2.F of the Ordinance shall be considered and a
determination made that the proposed activity is in compliance with such criteria
(listed below).
a. The proposed action's consistency with the specific policies and provisions
of the official City Comprehensive Plan.
b. The proposed use's compatibility with present and future land uses of the
area.
C. The proposed use conforms with all performance standards contained herein
(i.e., parking, loading, noise, etc.).
d. The proposed use's effect upon the area in which it is proposed.
e. The proposed use's impact upon property values of the area in which it is
proposed.
f. Traffic generation by the proposed use in relation to capabilities of streets
serving the property.
g. The proposed use's impact upon existing public services and facilities
including parks, schools, streets, and utilities, and its potential to overburden
the City's service capacity.
Existing Accessory Storage Space. Currently, a total of approximately 1,072 square feet
of accessory storage space exists upon the subject property as summarized below:
Square Footage
Two Stall Garage (28' x 36) 1,008 square feet
Utility Shed (8'x 8') 64 square feet
1,072 square feet
Including the proposed 832 square foot accessory building, approximately 1,904 square
feet of accessory storage space would exist upon the subject property.

Building Use. The CUP review criteria states that there should be a demonstrated need
for the continued use of the structure and the stated purpose. The proposed garage is to
be used for the storage of the applicant's personal recreational vehicles and equipment.
As such, there appears to be a demonstrated need for the continued use of the structure.
In accordance with Ordinance requirements, the structure may not be used for home
occupation/commercial related activities or the keeping of animals.
Building Type. According to Section 20-16-4.G of the Zoning Ordinance, the same or
suitable quality exterior building materials (as determined by the Building Inspector) shall
be used in all accessory buildings over 150 square feet as the principal building. The
proposed detached garage is to be finished in 12 inch lap siding similar to that used upon
the single family residence and existing detached garage.
To ensure structure compatibility, it is recommended that the proposed accessory building
be of a color which matches the site's principal structure.
Setbacks. According to Section 20-16-4.B.5 of the Ordinance, accessory buildings may
encroach into the required side and rear yard of a lot, except however no such
encroachment may occur upon a required easement or within 10 feet of any lot line. As
shown on the submitted site plan (Exhibit C), the proposed accessory building would lie
32 feet from the site's southern property line and 34 feet from the lot's western boundary.
Thus, the proposed garage meets applicable setback requirements.
Access. The subject property is currently provided access via a single driveway ± 24 feet
from 78th Street. No change to the access is proposed as a result of the accessory
building construction.
Driveway Surfacing. The submitted site plan does not indicate whether a driveway is to
be constructed to access the proposed detached garage. According to Section 20-22-
4.1-1.12.(b).2 of the Zoning Ordinance, detached single family uses within residential
developments platted prior to 1 January 1992 must adhere to the following surfacing
requirement:
(b) Any residential use which undertakes an improvement requiring a
building permit and the value of such improvement exceeds $2,500
shall be required to upgrade the driveway and parking area surfacing
to asphalt, concrete, cobblestone, or paving brick.
The City Council is currently reconsidering its driveway improvement policy and the
aforementioned ordinance requirement. As a condition of CUP approval, the applicant
shall be required to adhere to City's driveway improvement requirements either as they
presently exist or in accordance with a pending amendment. In this regard, approval of

the applicant's request should coincide and comply with formal City action on the cited
driveway surfacing requirements.
Building Height. According to Section 20-16-4.F of the Zoning Ordinance, an accessory
building within an R-3 Zoning District may not exceed 16 feet in height except via
conditional use permit. As a condition of CUP approval, a building elevation should be
submitted which demonstrates compliance with the maximum height standard.
Easements. According to Section 21-7-15.A of the Subdivision Ordinance, 10 foot wide
easements should be provided along lot lines to accommodate drainage and public/private
utilities. It has not been indicated whether such easements have been established upon
the site in question.
As a condition of CUP approval, 10 foot wide drainage and utility easements should be
provided along side and rear lot lines.
Compatibility/Screening. According to CUP evaluation criteria, the proposed use must
be judged to be compatible with surrounding uses. As shown on the submitted site plan,
the proposed accessory building is to lie more than 30 feet from the subject site's southern
and western lot lines. Considering that these setbacks are triple that required by
ordinance and that a row of trees (species not identified) exists to the west (of the
structure), the proposed use is considered compatible with the area in which it is proposed.
CONCLUSION
Based on the preceding review, our office recommends approval of the requested
conditional use permit subject to the conditions listed in the Executive Summary of this
report.

This item came to P.C. for Hearing on May 21, 1997. Access to the

significant difficulties due to the location of a well and tree within
the front yard of the lot. NAC recommended approval of the request
with 4 conditions from their report.
The City Engineer, in letter dated May 19, 1997 expressed concern with
obstruction in the flow line of the ditch and possible precedent being
set and objected to the second curb cut.
After Hearing and discussion the following recommendation was made to
the Council:

AND DECISION
Application of Gregory and Linda Strommen for a conditional use permit to allow the
construction of a second curb cut access to a single family residential lot.
On 9 June 1997, the Otsego City Council met at its regularly scheduled meeting to
consider the application of Gregory and Linda Strommen for the aforementioned
conditional use permit. Based on the application, the recommendation of the Planning
Commission, and evidence received, the City Council now makes the following findings
of fact and decision.
FINDINGS OF FACT
1. The applicant is requesting a conditional use permit to allow the construction of a
second curb cut access to their single family residential lot.
2. The subject property is zoned R-3, Residential -Immediate Urban Service Area.
3. The legal description of the property is as follows:
Lot 3, Block 7, Country Ridge, City of Otsego,
Wright County, Minnesota
4. Section 20-4-2.F of the Zoning Ordinance directs the Planning Commission and
City Council to consider seven possible adverse effects of the proposed conditional
use. The seven effects and findings regarding them are:
a. The proposed action's consistency with the specific policies and
provisions of the official City Comprehensive Plan.
The City's Comprehensive Plan specifically discourages direct lot access to
major streets (i.e., arterials). Palmgren Avenue, from which the subject
property is provided access, is classified as a "local" street. As a result,
access limitations referenced by the Comprehensive Plan are not considered
applicable to the lot in question.
b. The proposed use's compatibility with present and future land uses of
the area.
Single family residential development in the area has been platted consistent
with an approved resubdivision plan. Thus, homes have been placed upon
lots so as to accommodate future division as desired. While the majority of
lots in the area do not have "second" driveways, the proposed "second" curb
cut access is considered a necessary response to unique site conditions and
is compatible with present and future uses in the area.
C. The proposed use conforms with all performance standards contained
herein (i.e., parking, loading, noise, etc.).
As a condition of CUP approval, the proposed second curb cut and
associated driveway shall be required to comply with all applicable
performance standards.
d. The proposed use's effect on the area in which it is proposed.
Provided proper steps are taken to respond to site drainage issues (culvert
sizing, etc.) the proposed second curb cut will not tend to or have an
adverse effect upon the area in which it is proposed.
e. The proposed use's impact upon the property values of the area in
which it is proposed.
While no detailed study has been conducted, the proposed use is not
anticipated to depreciate area property values.
f. Traffic generated by the proposed use in relation to capabilities of
streets serving the property.
The amount of traffic generated by the proposed use will not increase as a
result of the second curb cut. Thus, traffic generated by the proposed use
is within the capabilities of Palmgren Avenue which serves the property.
g. The proposed use's impact upon existing public services and facilities
including parks, schools, streets and utilities, and its potential to
overburden the City's service capacity.
The proposed use can be accommodated by existing public service facilities
and will not over burden the community's service capacity.

5. The planning report dated 12 May 1997, prepared by Northwest Associated
Consultants, Inc., is incorporated herein.
6. On 21 May 1997, the Otsego Planning Commission conducted a public hearing to
consider the proposed conditional use permit application preceded by published
and mailed notice. Upon review of the conditional use permit application and
evidence received, the Otsego Planning Commission closed the public hearing and
recommended that the City Council approve the conditional use permit based on
the aforementioned findings.
DECISION
Based on the foregoing considerations and applicable ordinances, the applicant's request
for a conditional use permit to allow the construction of a second curb cut access to a
single family residential lot is approved in its present form subject to the following
conditions:
1. The applicant recognize that future sanitary sewer service to the property and
implementation of the resubdivision plan could necessitate relocation or removal
of the proposed detached garage (proposed in conjunction with second driveway
construction).
2. A determination is made that the proposed curb cut is not located less than 40 feet
from the driveway of the abutting northerly lot.
3. The proposed driveway is surfaced in asphalt, concrete, cobblestone, or paving
brick.
4. The City Engineer provide comment and recommendation in regard to drainage
issues.

Existing Conditions. As shown on the submitted site plan (Exhibit C), the applicants'
home is located on the southern one-half of their lot (consistent with resubdivision plan).
The home currently includes a two stall attached garage located alongside the property's
southern boundary. Expansion of the existing garage (with access from existing driveway)
is not possible due to the side yard setback limitations and the floor plan of the home
which prohibits northerly expansion. Recognizing these limitations, a detached garage
has been proposed to the northwest of the existing residence. Access to the detached
garage via the property's existing curb cub would present significant difficulties due to the
location of a well and tree within the front yard of the lot (see Exhibit C).
Driveway/Access Policy. The City's Comprehensive Plan includes various policies
related to street access. Specifically, the plan states the following:
• Vehicular access onto all types of arterials shall be minimized and limited ensuring
adequate distance between intersections and utilization of appropriate traffic control
methods and devices.
• Wherever possible, access to property shall be prohibited from major streets.
Detached frontage roads are to provide property access for properties "fronting"
such streets and roads.
Palmgren Avenue, from which the subject property is provided access, is classified as a
"local" street. As such, access limitations addressed by the Comprehensive Plan are not
necessarily applicable. The City's Zoning Ordinance does, however, include various
regulations related to curb cut placement. These standards will be addressed in following
sections of this report.
Curb Cut Spacing. Section 20-22-4.H.7 of the Zoning Ordinance states that driveways
for single family dwellings may not be located less than 40 feet from one another. With
a spacing of ± 70 feet, the proposed curb cuts upon the applicants' property conform to
this requirement. As a condition of CUP approval, a determination should be made that
the proposed curb cut does not lie less than 40 feet from the driveway of the adjacent
northerly lot.

Resubdivision Plan. As noted previously, the applicants' home has been sited on the
southern one-half of the lot, consistent with the Country Ridge resubdivision plan. The
purpose of the resubdivision plan is to provide property owners with a means to lessen
financial burdens (i.e., assessments) associated with possible future sanitary sewer
service. In this regard, the applicant should recognize that future sanitary sewer service
could necessitate relocation or removal of the proposed detached garage. This is of
course a decision to be made by the property owner.
Setbacks. According to the Zoning Ordinance, curb cut openings must be a minimum of
five feet from the side property line in all districts. As shown on the submitted site plan,
the second curb cut is proposed to lie 30 feet from the lot's northern property line and
conforms to the Ordinance requirement.
Driveway Surfacing. In accordance with Ordinance requirements, the proposed driveway
should be surfaced in asphalt, concrete, cobblestone, or paving brick.
Drainage. Construction of the proposed second driveway will require the installation of
a second culvert. As part of the conditional use permit consideration, a finding should be
made that the proposed curb cut will not adversely impact site and area drainage patterns.
This issue should be subject to further comment and recommendation by the City
Engineer.
Curb Cut Width. According to the Ordinance, no curb cut may exceed 24 feet in width
unless approved by the City Engineer. The proposed "second" curb cut measures 15 feet
in width and conforms with the Ordinance requirement.
CONCLUSION
Based on the preceding review, our office recommends approval of the requested
conditional use permit to allow a "second" curb cut upon a single family residential lot
subject to the conditions listed in the Executive Summary of this report.

8.1 Consider Quotes for Dust Control/Gravel Surface Conditioning Chemical
A Quote for application of Magnesium Chloride was received from Dustcoating,
Inc. in the amount of $0.49/gallon. The quote includes five miles of roadway
21' wide. The total cost would be $9,065.
We have solicited a quote from Thermo Gas and had not received that as of this
writing. We had estimated 20' wide roads at $0.50/gallon for a total costs of
$8,800.
We recommend awarding this work to Dustcoating, Inc. and proceeding with
the application of the Magnesium Chloride. We have attached the Quote
received for reference.
8.2 Approve City Engineer Selection of Sewer Plant Site in Eastern Area of City
Hakanson Anderson Associates, Inc. would analyze treatment plant sites based
on our preliminary analysis and with input from Bonestroo. We would select
three potential sites and rank them according to best fit for the treatment plant.
We will prepare a brief report, with exhibits, discussing our findings. Our
proposed cost to complete this work is $750. We can proceed with the work
immediately upon Council approval.
8.3 Louis Szenay Pond Site
Louis Szenay currently owns Lot 3, Block 1 of the Otsego Acres 2nd Addition.
The property lies within subdistrict 4D of the Hall's Pond Watershed District.
Mr. Szenay has requested that the City consider purchasing the property.
The lot was considered unbuildable by staff as it is presently configured. Our
firm had recommended purchasing the lot if a reasonable price was agreed upon
and if funds were available. There are presently no funds available in the Hall's
Pond Watershed District account. General funds would be required.
Any potential stormwater storage area within the Hall's Pond Watershed District
would be of value. The City could purchase the property at this time and

construct a pond at a later date. The attached Exhibit N depicts the property
in question.
A building, which had set vacant on the property, has been removed. If the
City does purchase the property, we recommend that the landowner perform
the following tasks prior to sale:
1. Remove or bury the remainder of the building and foundation. This
should be coordinated with the City Building Inspector.
2. Seal and abandon the well.
3. Pump out and fill in the septic tank.

RE: CHANGES IN THE CERTIFICATION OF LOCAL PERFORMANCE
MEASURES FOR LOCAL PERFORMANCE AID PAYABLE IN 1998
Laws 1997, Chapter 231, Article 11, Section 7 provides for changes to the local
performance aid (LPA) statute (Minnesota Statutes, Section 477A.05). In order to qualify
for LPA in 1998, a city must affirm that (1) the aid will result in a reduction in property
taxes at least equal to the amount of aid received, and (2) the city will spend the aid on
programs for which it has developed a system of performance measures and that these
measures will allow for the measurement of continuous improvement and will be
regularly compiled and presented to the city council at least once a year. The city must
identify the program or programs that are to be funded with the aid. The city is eligible
for aid if it affirms that it is in the process of developing and implementing a system of
performance measures for the program or programs for which the aid is being sought.
However, the aid may not be spent on the program or programs until the performance
measurement system has been instituted, unless the aid is being used to establish the
performance measurement system.
Local performance aid will be determined as follows for calendar year 1998: Laws 1997,
Chapter 231, Article 11, Section 7 provides for $440,000 in addition to $4,107,673 (the
amount paid in 1997) plus an inflation adjustment based on the implicit price deflator. A
per capita aid amount will be determined by dividing the total aid available by the total
population of all cities that qualify for the aid. Each qualifying city then receives an aid
amount based on its population times the per capita aid amount.
Distribution of LPA is based on yearly certifications for each qualifying city. Cities are
required to submit an annual certification in order to receive LPA payable in calendar
year 1998 and subsequent years.
LPA will be paid in two equal installments on July 20 and December 26 of 1998.
Qualifying cities will receive a certification of their 1998 LPA by July 31, 1997. As
mentioned above, your city may qualify for LPA by (1) affirming that this aid will result
in a reduction in property taxes equal to the amount of aid received and that (2) your city
will spend the aid on programs for which it has developed a system of performance
measures and that these measures will allow for the measurement of continuous
improvement and will be regularly compiled and presented to the city council at least
once each year.
