RESOLUTION NUMBER 2000-07
RESOLUTION VACATING APPROXIMATELY 365 FEET OF RIGHT-OF-WAY
EASEMENT OF JAMBOR AVENUE THAT OVERLAYS PROPERTY INCLUDED AS
PART OF THE.MISSISSIPPI PINES, PRELIMINARY PLAT.
WHEREAS, AJE Companies has submitted a request to vacate approximately
365 feet of Right -of -Way easement for Jambor Avenue described by Exhibit A; and,
WHEREAS, the existing Right -of -Way easement proposed to be vacated serves
only the property to be platted as part of the preliminary plat entitled Mississippi Pines;
and,
WHEREAS, the proposed preliminary plat includes internal public streets of
adequate design to provide access to individual lots within the development; and,
WHEREAS, the Planning Commission considered the request at a public
hearing held during its meetings on 22 February 2000 and 6 March 2000, received
evidence and voted 7-0 to recommend vacation of the Right -of -Way as described by
Exhibit A; and,
WHEREAS, the planning report dated 16 February 2000 prepared by the City
Planner, Northwest Associated Consultants, Inc., is incorporated herein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF OTSEGO RESOLVES
THAT the Right -of -Way easement legally described by Exhibit A is hereby vacated.
