A. Pledge of ll giance Mayor Fournier led in the Pledge of Allegiance. B_ Roll Call: Mayor Larry Fournier; Councilmembers: Suzanne Ackerman, Mark Berning, Vern Heidner and Virginia Wendel. Mayor Fournier requested the additions under Item 9. Consideration of placing the Otsego Cemetery on the National Historical Preservation List and Selection of Public Works positions. CM Heidner motioned to adopt the June 30, 1997 City Council Agenda as amended. Seconded by CM Ackerman. All in favor. Motion carried. 3 Consider Minutes - A. May 28, 1997 City Council Workshop with Ron Anhorn, Develoler. CM Berning motioned approval of these minutes. Seconded by CM Heidner. All in favor. Motion carried. Voting For the Motion: CM Berning, CM Heidner, Mayor Fournier Abstaining: CM Wendel and CM Ackerman (They were not in attendance). Motion carried. B Tune 9, 1997 - Regular City Council Meeting CM Ackerman motioned adoption. Seconded by CM Wendel. All in favor. Motion carried. C Tune 101997 - Workshop with 62nd Street Residents Mayor Fournier motioned adoption of the minutes. Seconded by CM Heidner. All in favor. Motion carried. CM Heidner motioned adoption of the minutes. Otsego City Council Meeting of June 30, 1997, cont'd. Page 2. 4_ Open Forum. 4.1. Special Presentations: A Darlene Solberg,, tsego Parks and Rec (Commission Promotion of Family Fun Day. Darlene Solberg gave a update on the Family Fun Day Events and invited everyone to attend. She presented the Parks and Rec. new logo, and asked for City Councils blessing. Ms. Solberg also expressed her gratitude to the City Council and City for all the help during the Spring Flood. B Gary Groen, Review of May Financial Statements Mr. Groen presented the May Financial Statement. He informed the Council the audit is done and will be presented to the Council in July. Mr. Groen also reminded the Council that Budget Workshops FY98 need to be set and will have suggested dates for these on the next City Council Agenda. Barb Kolb, 15046 NE 92nd St ,tsego,Appeal violation of City Ordinance. Barb Kolb went over her complaint of not being allowed to live in her garage while her house is being remodeled. Andrew MacArthur, City Attorney, stated to Ms. Kolb there is an appeal process to follow and she could call him tomorrow. D Joan and Brian Lindquist. 8420 Packard Ave NE, Anneal violation of Zoning Ordinance, Joan Lindquist acknowledged they extended the roof on their current metal pole building without obtaining a building permit and requested a variance. Mayor Fournier and staff informed Mrs. Lindquist to work with City Staff on this process. 4.2=Open Forum, Joy Swenson, Heritage Commission, informed the Council the Heritage Commission has the necessary forms and information for application for the Otsego Cemetery to be placed on the National Registry Historic Preservation. She encouraged the Council to approve this application process. Wallace Odell, on behalf of the Darkenwald Family, requested a City Council Workshop for July 14 or 15. They are ready to present their PUD plans. Mayor Fournier set July 15, 1997 at 4 PM for this workshop. 5. (Consent Agenda 5-1. Annroval of Juran and Moody (Tom Triss inski) as financial advisors for the City of_Ot�_ Mayor Fournier motioned for adoption of the Consent Agenda. Seconded by CM Heidner. All in favor. Page 3. 6 Bob Kirmis, Assistant City Planner - 6 -1- nner_6 1 Considerrip •nt Spectrum (Ron B Gunderson) request re: A Conditional Use Permit to co -locate an enna for Rnrint Spectrum L P on U P A Tower located at 6155 Kadler Ave. Bob Kirmis presented the planner's report. Kevin Kielb, City Engineer, went over his letter dated June 3, 1997. Mr. MacArthur advised to get additional information from UPA. CM Wendel noted that currently there is interference with television reception. CM Heidner motioned to approve the Conditional Use Permit subject to ten conditions listed the Findings of Fact. To be noted to include Condition 8 from the NAC Report dated May 20,1977 regarding the applicant demonstrating (via a coverage/interference analysis prepared by a registered professional engineer) that the location of the antennas are necessary to provide adequate personal wireless system coverage. Seconded by CM Berning. All in favor. Motion carried. F Consider an Amendment to Otsego Zoning Ordinance 4 22-12b Re• Driveway surfacing upgrade req uir m n s (Applicable to R-3 7_onel- atted prior to 19921. Bob presented the Planner's Report. CM Heidner motioned to accept the Planning Commission's recommendation for amendment of Zoning Ordinance Section 22-12. Seconded by CM Wendel. Voting For the Motion: CM Heidner, CM Wendel, Mayor Fournier Voting Against the Motion: CM Berning, CM Ackerman Motion failed three (3) two (2). CM Berning motioned to remove 2.(b) from 4.H.12.b. from the Zoning Ordinance, Section 20-22. (pertaining to any residential use which undertakes an improvement requiring a building permit with value of improvement over $2,500 requiring upgrading the driveway) and just to use surface material to control dust as outlined in 20-22.4.H.12b.(2) (a). Seconded by CM Ackerman. Voting For the Motion: CM Berning, CM Ackerman, CM Wendel, Mayor Fournier. Voting Against the Motion: CM Heidner Motion carried four (4) to one (1). 6-3. Consider Kenneth and Janet Dewitt 8748 Palmgren Avenue NE tel: A Conditional Use Permit to allow more than one detached garage/single, family dwelling CM Berning motioned to accept the Planning Commission's recommendation and approve Conditional Use Permit to allow more than one detached garage subject to the nine conditions listed in the Findings of Fact. Report to City Council re: 62nd St. Mr. MacArthur presented his report and recommendation as outlined in attached letter dated June 6, 1997. Mr. Kielb recommended the cul-de-sac be constructed to City Standards with regards to public safety issues. Mayor Fournier motioned to accept the City Attorney's recommendation with City Council consider acceptance of the dedication of a half street in this instance with the understanding that no building permits are allowed on land having frontage on or obtaining access solely from the half street. The dedication should include a temporary cul-de-sac. Seconded by CM Wendel. All in favor. Motion carried. 72_ Letter to City Council research re: entity for This will be discussed under Item 8.3. None S_ Kevin Kielb,City Engineen 9.1. Consider Sewer and Water System Reports. Mr. Kielb recommended the Council set a Workshop to discuss in more detail these reports. He gave a brief presentation as outlined on the attached. Mr. Kielb was asked for additional information regarding a typical charge for annual water and sewer fees, O&M costs and from the planner on how much income or loss created per residential units/mobile home park, costs to City on so much per acre verses what City will take in. Mayor Fournier set July 9, 6:30 PM for City Council Workshop. 8.2. Consideration of Sewer and Water Information (Timeline from Ted Field/Bonestrool, Mr. Ted Field, Bonestroo, went over his memo dated June 18, 1997. In addition, he recommended the City Council tour a couple of plants to view some options the Council may want in order to include those costs in the non -capacity figures. Larry Koshak went over his letter dated June 25, 1997 which included his recommendation for a mechanical treatment plant with capacity of 400,000 gpd. CM Wendel motioned to adopt the Bonestroo Time Line Schedule. Seconded by Mayor Fournier. All in favor. Motion carried. Otsego City Council Meeting of June 30, 1997, cont'd. Page 5. Mr. MacArthur asked for Council consent for him, City Planner and City Engineer to research the different sewer district and address possible ordinance changes. The Council asked for an estimated cost for this research prior to July 10. Mayor Fournier set the Workshop Meeting with Dayton for July 10, 7 PM at the Dayton Senior Building. 8.3. Any other gineering Business. Larry Koshak presented his report on the Treatment Site Selection. Mayor Fournier requested this item be placed on the July 9, 1997 City Council Workshop. Mr. Kielb, suggested he and City Planner work on a Connection Schedule for completion by July 15. Mayor Fournier motioned to give authorization to the City Engineer to develop a Connection Schedule by July 15, 1997. Seconded by CM Ackerman. After Council discussion, Mayor Fournier withdrew his motion and CM Ackerman withdrew her second. Mr. Koshak also reported on the ISTEA FY 2000, Area Transportation Improvement Program. This would provide for reconstruction of Odean Avenue from CSAH 39 to 37. There is a two year window on this and money would be available July 1, 1999. Mr. Kielb reported on what streets had Dust Control applied to and stated this process worked well. There was also asphalt patching completed today. • • • Items- 9-1- aboveSee 9-2. July 23. 1997 - 7 PM for Albertville/Otsego Meeting regarding- Wastewater Treatment for }posed race track_ CM Wendel motioned to meet with Albertville on July 23, 1997 at the City of Albertville to discuss wastewater treatment services. Seconded by CM Ackerman. All in favor. Motion carried 92.a_ Otsego Cemetery CM Wendel motioned to authorize the Heritage Commission to submit application for the Otsego Cemetery to be placed on the National Registry of Historical Preservation Listing. Seconded by CM Ackerman. All in favor. Motion carried. 9-2.b- Heritage Commission Rem CM Wendel questioned the moving of the old City Hall. Page 6. 92_c_ Public Works Positions CM Heidner motioned approval of the selection process of Pete Thorn (first ranking) and for Terry Robeck (second ranking). Seconded by CM Wendel. All in favor. Motion carried. CM Wendel motioned for the salary range of $12 to $14.75 per hour for these positions. Seconded by CM Berning. All in favor. Motion carried. 9.2_d_ City Administrator Position Mr. MacArthur reviewed his memo and NAC's memo (attached) in regards to an interim City Administrator position which has been recommended by the City Administrator committee. CM Wendel motioned to accept the recommendation of an Interim City Administrator position and for staff to prepare a job description, draft contract and advertisement. Seconded by CM Heidner. All in favor. Motion carried. Mr. MacArthur will have this information prepared a week ahead of the next council meeting for review, keeping it flexible and for the Council to fill in the blanks. 9.3_ Cit; Clerk's Update, Elaine Beatty referred to the attached information on the Minnesota Association of Small Cities. The Council agreed not to take any action on this. 9.4. Consider Claims List for Aj) rh CM Heidner motioned for adoption of the Claims List as presented. Seconded by CM Ackerman. All in favor. Motion carried. 9.5. Adjourn by 10 PM. Mayor Fournier announced he will not be able to attend the EDAAC Meeting July 7th. CM Berning will attend. CM Heidner motioned to adjourn.
