applications have been requested:

6.2. Applicant Greg Ebert, for John and Susan Kranitz, is proposing to construct a 6,000 sq. ft (100x60)
structure with post and beam foundation and metal siding at 16401 - 60TH St for light industrial mfg.
The subject property is approximately 2.0 acres in size and is zoned I-1, Limited Industrial District. The
construction of a second principal structure on the property requires approval as follows:
1. A Planned Unit development/Conditional Use Permit (PUD -CUP)
a. Flexibility from the foundation and building standards of the Ord.
for Industrial uses as part of the PUD -CUP
b. Consideration of allowing a non -bituminous or concrete outdoor
storage in the I-1 District as part of the PUD -CUP
6.3. Applicant Leander Schlosser, Nailbender Corporation, Inc., for Brian Schultz, is proposing to move
in a building to Lot 7, Block 2, Vasseur's Oak Grove Estates. The subject property is zoned residential.
The movement of a building requires approval as follows;
1. A Conditional Use Permit (CUP) to allow a move in building (relocation of a
double -wide mobile home).

BACKGROUND:
6.1. This item was on the P.C. Meeting of August 19, 1998 and
continued to September 2, 1998 P.C. to allow Staff to gather further
information. The Planning Commission continued the Hearing on Sept.
2, 1998 and the Council was provided copies of the minutes of that
meeting in the P. C. Packet for September 9, 1998. See attached
minutes of that meeting. P.C. Approved the CUP and denied the three
variances. (See attached letter dated 9/3/98 from Greg Hayes,
Shingobee Builders, Inc. canceling and withdrawing the application by
Thein Well Co. for CUP and variances requested on Lot 2, Block 1,
Otsego Industrial Park 2ND Add.
6.2. The Planning Commission met on August 19, 1998 and held a Public
Hearing on this item. The minutes are attached for your review and
the P.C. recommended approval of the PUD and a. and b.

6.3. The Planning Commission met on September 2, 1998 and held a
Public Hearing on this item. The minutes are attached for your review
and the P.C. recommended approval of the CUP.

Otsego - Elk River Collision PUD/CUP: Findings of Fact

Attached please find findings of fact applicable to the above referenced application, which
is to be considered by the City Council at their meeting on 7 September 1998. The
attached findings are reflective of the recommendation of the Planning Commission
following the Public Hearing held on 19 August 1998. The Planning Commission voted 5-0
to approve the requested PUD subject to 14 conditions.
The Planning Commission discussed the appropriateness of the proposed building
foundation, building materials and open outdoor storage area that was requested as part
of the PUD, which also is required to accommodate the second principal structure on one
lot. The Planning Commission concluded that these building standards were appropriate
given the existing development that had occurred in the area under Frankfort Township
jurisdiction. This discussion is highly relevant in that it establishes a basis for an
anticipated third industrial district to be established for this area, as suggested by the draft
Comprehensive Plan update.

FINDINGS OF FACT
AND DECISION:
Application of Greg Ebert, on Behalf of Elk River Collision, for approval of a Planned Unit
Development/Conditional Use Permit to allow construction of a second principal structure
with post and beam construction, metal siding and a Class 5 storage area shared with the
existing structure at 16101 60th Street NE. The Otsego City Council met at its regularly
scheduled meeting on 7 September 1998 to consider the aforementioned application.
Based upon the application, the recommendation of the Planning Commission and
evidence received, the City Council now makes the following findings of fact and decision.
FINDINGS OF FACT
The applicants are requesting approval of a planned unit development/conditional
use permit to allow the following:
A. More than one principal structure on a lot.
B. Post and beam foundation versus continuous foundation requirement..
C. 100 percent metal siding.
D. Class 5 surfacing of an open and outdoor storage area in the 1-1 District.
2. The legal description of the subject property is as follows:

3. The subject property is zoned 1-1, Limited Industrial District
4. Section 20-4-2.F of the Zoning Ordinance directs the Planning Commission and
City Council to consider seven possible adverse effects of the proposed conditional
use The seven effects and findings regarding them are:
A. The proposed action's consistency with the specific policies and provisions
of the official City Comprehensive Plan.
Finding. Section 20-36-1-A of the Zoning Ordinance states that a purpose
of PUD is to provide flexibility in development "to the end that the growing
demand for all styles of economic expansion may be met by greater variety
in type design and sighting of structures...".
The 1991 Comprehensive Plan discusses the need to accommodate a range
of industrial uses in the community by providing several industrial locations
that have alternative performance standards. Allowing development of lower
standard industrial sites provides an opportunity for small businesses to
locate in the community or existing home extended businesses to relocate
to more appropriate areas. Therefore, the proposed PUD flexibility is
consistent with the 1991 Comprehensive Plan.
2. The proposed use's compatibility with present and future land uses of the
area.
Finding. The area south of 60th Street and west of Queens Avenue
developed with industrial uses under Frankfort Township jurisdiction. The
type of development, including the existing structure on the subject site, is
typically post and beam foundations and metal siding. Some sites have
bituminous parking, loading and storage areas, while others do not.
Therefore, the proposed type of building is consistent with existing
development in the area.
The draft Comprehensive Plan update suggests that this area may be
appropriate for a lower standard industrial area with a specific zoning
designation and unique performance standards. If the Planning Commission
and City Council find that these types of uses are acceptable in a "lower
standard" area, such a finding would be the basis of the anticipated zoning
ordinance that will be prepared for this area. As such, the proposed type of
building is consistent with planned uses in the area..
3. The proposed use's conformity with all performance standards contained in
the Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding: Except for performance standards addressed by the PUD, the
proposed use conforms to all applicable performance standards.
4. The proposed use's effect upon the area in which it is proposed.
Finding: Provided that the property is developed in conformance with Zoning
Ordinance standards except as modified by the PUD, the proposed use will
not have a negative impact to the area.

5. The proposed use's impact upon property values of the area in which it is
proposed.
Finding. Although no study has been completed, the proposed use is not
anticipated to negatively impact area property values.
6. Traffic generation by the proposed use in relation to the capabilities of
streets serving the property.
Finding_ The proposed use has access via 60th Street/Queens Avenue,
which has sufficient capacity for traffic generated by the proposed use.
7. The proposed use's impact upon existing public services and facilities
including parks, schools, streets, and utilities and its potential to overburden
the City's service capacity.
Finding: The proposed use is not anticipated to have a negative impact to the
City's service capacity.
6. The planning report dated 12 August 1998 prepared by Northwest
Associated Consultants, Inc. is incorporated herein.
7. The Otsego Planning Commission conducted a public hearing, at their
regular meeting on 19 August 1998, to consider the proposed planned unit
development / conditional use permit, preceded by published and mailed
notice. Upon review of the application and evidence received, the Otsego
Planning Commission closed the public hearing and recommended that the
City Council approve the conditional use permit based on the
aforementioned findings.
DECISION
Based on the foregoing considerations and applicable ordinances, the applicants' request
for a planned unit development / conditional use permit to allow construction of a second
principal structure with post and beam construction, 100 percent metal siding and a Class
5 open outdoor storage area is approved subject to the following conditions:
1. The subject site is developed in substantial conformance with the following plans
on file with the City of Otsego, as may be amended herein:

Site Plan - dated 7-15-98
Building Elevation - dated 7-22-98
Building Floor Plan - dated 7-22-98
2. The applicant positively establish the location of the property line adjacent to 60th
Street and provide a revised site plan illustrating conformance with all applicable
setback requirements, subject to review and approval of the City Council.
3. The location of a second access be subject to review and approval of the City
Engineer.
4. The parking area west of the existing structure be striped per Section 20-22-4.13
of the Zoning Ordinance.
5. One disability stall be designated adjacent to the existing structure.
6. The parking and circulation areas north of the proposed structure be revised to
allow on-site circulation of a tractor trailer with access to the large overhead doors
of the proposed structure, subject to review and approval of City Staff.
7. No outside storage occur on any portion of the site other than the designated area
including client automobiles for repair or boat trailers.
8. Existing and new fence sections comply with the provisions of Section 20-16-7.A.2
of the Zoning Ordinance (required screening fences).
9. A landscape plan be submitted specifying the quantity, type and size of all existing
and planned landscaping, subject to City Council review and approval.
10. All site lighting is hooded and directed so as to reflect light away from adjacent
properties or the public right of way, subject to review and approval of the City
Building Official.
11. Any outside storage of trash or trash containers be screened from view within a
wood fence enclosure or enclosure of material similar to the principal structure,
subject to review and approval of the City Building Official.
12. All grading, drainage and utility issues be subject to review and approval of the City
Engineer.
13. On site waste disposal systems, including existing septic systems, be subject to
review and approval of the City Building Official.

14. The applicant enter into a development contract with the City and post all required
escrows, subject to review and approval of the City Attorney.

Fact

Attached please find findings of fact applicable to the above referenced application, which
is to be considered by the City Council at their meeting on 14 September 1998. The
attached findings are reflective of the recommendation of the Planning Commission
following the Public Hearing held on 2 September 1998. The Planning Commission voted
4-1 to approve the requested PUD subject to eight conditions.
One Planning Commissioner raised the issue as to the need for the project escrow. These
escrows are required as part of any building relocation to ensure the City that the project
is completed in a timely manner in accordance with approved plans. In the case of
building relocations, the escrow also provides insurance for damages that may occur with
the moving of the structure. The recommendation of the Planning Commission was to
require that the applicant post the appropriate escrow.

Application of Leander Schlosserof Nail Bender Corporation Inc., on behalf of Brian
Schultz to locate a double wide mobile home to a single family lot at 8303 Oakwood
Avenue. The property is legally described as Lot 7, Block 2 of Vasseur's Oak Grove Third
Addition.
The Otsego City Council met at its regularly scheduled meeting on 2 September 1998 to
consider the aforementioned application. Based upon a review of the application and of
established City policies and ordinances, the City Council now makes the following
findings of fact and decision.
FINDINGS OF FACT
1. The applicant is requesting approval of a conditional use permit to allow the
relocation of a double wide mobile home to a single family lot.
2. The legal description of the subject property is as Lot 7, Block 2 of Vasseur's Oak
Grove Third Addition.
3. The subject property is zoned R-3, Multiple Family Residential.
4. Section 20-4-2.17 of the Zoning Ordinance directs the Planning Commission and
City Council to consider seven possible adverse effects of the proposed conditional
use The seven effects and findings regarding them are:
A. The proposed action's consistency with the specific policies and provisions
of the official City Comprehensive Plan.
Finding: The subject site and area are designated for low density residential use by
the 9991 Comprehensive Plan. Provided all performance requirements are met, the
proposed conditional use would be considered consistent with the Comprehensive
Plan.
B. The proposed use's compatibility with present and future land uses of the
area.
Finding. The relocated structure will be compatible provided that the mobile home
complies with all applicable standards of the Building Code and Zoning Ordinance.
C. The proposed use's conformity with all performance standards contained
[within the Zoning Ordinance] (i.e., parking, loading, noise, etc.)
Finding: Performance standards will be evaluated in subsequent paragraphs.
D. The proposed use's effect upon the area in which it is proposed.
Finding: Provided all applicable performance standards are satisfied, the proposed
relocation of the mobile home is not anticipated to adversely affect the area.
E. The proposed use's impact upon property values of the area in which it is
proposed.
Finding: Although no specific study has been completed, the relocation of the mobile
home is not anticipated to negatively impact area property values, provided all
applicable performance standards are satisfied.
F. Traffic generation by the proposed use in relation to capabilities of streets
serving the property.
Finding: The relocation of the mobile home to the subject site is not anticipated to
create any negative traffic impacts.
G. The proposed use's impact upon existing public services and facilities
including parks, schools, streets, and utilities and its potential to overburden
the City's service capacity.
Finding: The relocation of the mobile home to the subject site will not negatively
impact the City's service capacity.
5. The planning report dated 25 August 1998 prepared by Northwest Associated
Consultants, Inc. is incorporated herein.
6. The Otsego Planning Commission conducted a public hearing, at their regular
meeting on 2 September 1998, to consider the proposed conditional use permit,
preceded by published and mailed notice. Upon review of the application and
evidence received, the Otsego Planning Commission closed the public hearing and
recommended that the City Council approve the conditional use permit based on
the aforementioned findings.
DECISION
Based on the foregoing considerations and applicable ordinances, the applicant's' request
for an conditional use permit to relocate a double wide mobile home to a single family lot
is approved subject to the following conditions:
1. Issuance of a building permit, subject to review and approval of the City Building
Official.
2. An occupancy permit be issued within six (6) months from the date of location on
the site subject to review and approval of the City Building Official.
3. Compliance with Section 20-17-11.A (Single Family Dwellings) of the Zoning
Ordinance, subject to review and approval of the City Building Official.
4. Conformance with applicable setback requirements, subject to review and approval
of the City Building Official.
5. All existing or proposed septic system or water wells be subject to review and
approval of the City Building Official.
6. All grading and drainage issues be subject to review and approval of the City
Engineer.
7. The applicant post a performance security equal to the estimated costs of materials
and labor for the project, subject to review and approval of the Zoning Administrator
and City Attorney.
ADOPTED by the Otsego City Council this 14th day of September 1998.

The Planning Commission, at a special meeting on September 9, 1998, continued the public
hearing of the draft Comprehensive Plan Update, which was opened on September 2, 1998. The
Planning Commission discussed changes to the draft plan as outlined in memorandums from our
office dated 3 September 1998 and 9 September 1998. Following a review of the proposed
changes, the Planning Commission voted 6-0 to accept the changes as written.
Public comments on the Comprehensive Plan were taken at the meeting September 2, 1998 as
indicated in the approved minutes. The Chairman again asked for public comments at the meeting
on September 9, 1998. Mr. Paul Levenson spoke to ask that the Planning Commission consider
commercial use of his property. Mr. Wally O'Dell spoke on a number of issues and asked that the
Planning Commission delay action on the Comprehensive Plan to allow more public input. These
changes were discussed by the Planning Commission, but no additional changes to the document
were directed.
The Planning Commission recommended approval of the Policy Plan chapter of the
Comprehensive Plan by vote of 6-0. The Planning Commission then voted 5-1 to recommend
approval of the Development Framework chapter of the Comprehensive Plan. Planning
Commissioner Eugene Goenner opposed the Development Framework due to the provision for four
per 40 acre divisions within the Agricultural Preserve area.
Based upon the recommendation of the Planning Commission, we have prepared a resolution
adopting the Comprehensive Plan Update. This resolution has been attached as Exhibit A for
consideration and action by the City Council at their meeting scheduled for September 14, 1998.

WHEREAS, the City of Otsego has the authority and responsibility under Minnesota
Statutes to prepare and adopt comprehensive plans for the purpose of guiding and

WHEREAS, new planning, development, and growth management issues have

WHEREAS, a duly noticed public hearing on the Otsego Comprehensive Plan

WHEREAS, the Otsego Planning Commission, following formal public hearing, has
recommended approval of the Otsego Comprehensive Plan Update of the City Council.

According to the Sewage Disposal Ordinance Section 3.2, alternative sewer
systems may be permitted in the City. Generally, the only alternative systems
allowed have been mound systems to my knowledge. Other systems have not
been considered due to the lack of experience in this area on their operation.
To approve a system that is experimental would cause acceptance of certain
responsibility by the City. If the system was installed and immediately the house
sold to another party, could these conditions of installation set by the City be
transferred? Has this homeowner tried to acquire land or easement that a normal or
mound system could be placed on adjacent to the lot? If other land disposal sites
are available, it would appear that this should be explored.
Our opinion would be that if the lot soils are in such a condition to not allow a
normal or mound system, then perhaps it should be unbuildable and not habitable.
The conditions, if the experimental system is allowed by City Council as a last
resort, would be monitoring the system by the City every 2 years with an escrow
account for inspection and City Administrative service deposited at the City. If the
experimental system failed, a condition would be to declare the site unbuildable or
uninhabitable.

In recent months several alternative systems have been proposed to the City as
replacement systems. The alternative systems proposed were not the traditional
mound systems. Drainfields meeting the requirement of the Section 2.5 of the
Ordinance are considered standard system.
Mound systems where they can meet the requirements of an alternative system
have been approved without the imposition of special conditions. Mound systems
design have for the most part been standardized and standards are set for them in
Minnesota Rules Chapter 7080. Otsego has numerous mounds in place as
replacements for failed drainfields.
In plats like Island View, mound systems were allowed on new construction
because the lots were of record. I assume there are other locations of new
residential construction with mound systems.
The proposed systems that we are concerned with are not mound systems, but
sand filters and/or modifications of that type of treatment. In some cases the
location on the lots for any treatment system is limited.
Replacement systems for failed drainfields or systems upgrading to meet the home
sales requirement in Wright County must either install a drainfield or a mound
system.
Holding tanks are prohibited in Otsego except by granting a variance for temporary
use for short periods of time.

If neither a mound or standard system cannot by code be placed on an existing
residential lot, should that lot be declared unbuildable and the home not suitable for
occupation? Holding tanks are only temporary systems according to the ordinance.
If these alternative systems are approved (other than drainfield or mounds) how
can the City be assured that the system will not fail again therefore setting up a
situation where no alternative will solve the problem and occupation of the home is
not possible.
Mike Robertson, Jerry Olson and I have discussed this situation recently and felt
this is an issue that needs to be discussed at council level.
I suggest some considerations be made in an immediate sewer service area where
the possibility of hookup to the municipal sewer system is possible in the short
term, say 2 years or less. Holding tanks or alternative systems could be approved
in this case with the only condition being to hook up when sewer is available.
In other sewer service areas where timing of sewer service is not predictable at the
time of failure and in non -sewer service areas, allowing alternative systems (not
drainfields or mounds) could be allowed only when the following conditions are
met:
1) That other suitable land be purchased or leased outside the property for a
standard drainfield or mound system. All efforts should be taken to
attempt to obtain a new location for treatment.
2) If that fails and is not viable in the City's opinion, then an alternative
system can be considered with these conditions:
a) Maintenance agreement be signed between owner and City on how
the system will operate.
b) Inspection of the system periodically by City staff or those
designated by the City.
c) An escrow account paid to the City for costs incurred due to
inspections and other administrative services.

d) That the dwelling occupants be limited to the capacity of the
alternative system.
e) That should the system fail, that is pollution is evident, the City
will declare the dwelling uninhabitable and the lot not buildable.
f) The Maintenance, Inspection and Occupants agreement may be
revoked by the City due to failure of the owners to meet any of the
conditions above.
We would suggest that the building inspector check with other communities and
Wright County on how this issue is handled elsewhere. The proposed alternative
systems considered under this discussion that are pending with the Building
Inspector should be acted on as soon as possible.
I will be available to the Council to discuss this matter at the 9/14/98 Council
meeting.

On September 8, 1998 at 11:00 a.m., the City Administrator and myself received
bids for the water tower as per the advertisement in the Construction Bulletin and
in the local newspaper.
We received four (4) bids, and these are listed below with the lowest base bid first:

Our pre-bid Engineer's Estimate for the base bid was $626,962.50. The base bid
is for a spheroid tank & tower and the alternate is for a fluted section. The
Alternate Bid is a good bid under our estimate for that style of tower.
The Council could award to the Alternate Bid of Pitt -Des Moines and still receive a
good price for a quality tank and tower. Maintenance costs for painting a fluted
section tower are more costly than a spheroid due to the larger surface to paint.
The fluted system does have a better appearance.
Our recommendation is to award the contract to Maguire Iron, Inc. for the base bid
in the amount of $521,000 for the spheroid tank and tower.

If an award is made, we will need to make the site available to the Contractor on
November 1, 1998.

A RESOLUTION RECEIVING A PETITION
FOR THE IMPROVEMENT OF QUADAY AVENUE AND
72ND STREET WITH BLACKTOP SURFACING AND CALLING
FOR THE CITY ENGINEER TO CONDUCT A FEASIBILITY
STUDY ON THE PROPOSED IMPROVEMENT
WHEREAS, the Otsego City Council has received a
petition from property owners located along Quaday
Avenue and along 72nd Street requesting that those
streets be improved with blacktop surfacing, and;
WHEREAS, it is the City Council's intent to assess
some or all of the benefit of blacktop surfacing to
the benefiting property owners per Minnesota State
Statute 429, and;
WHEREAS, to assess benefiting property owners it is
necessary to have a qualified civil engineer
perform a study of the feasibility of the proposed
improve.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF OTSEGO, MINNESOTA:
1. That the City Council hereby directs the City
Engineer, Hakanson, Anderson, to perform a study of
the feasibility of improving Quaday Avenue and 72nd
Street with blacktop surfacing.

Re: Residential Property Valuations
Along Bike Trails
I spoke with City Assessor Pete Merges about the
question raised by a resident as to whether bike
trails tend to devalue adjacent residential
properties. Pete says that they do not do this.
He said that it is generally accepted among
assessor's that bike trails will increase the
market value of adjacent residential property.
Pete noted that any increases in market value would
have to be based on actual sales of properties
adjacent to the bike trail, and so any effect on
market value of the bike trail would take several
years to show up.

RESOLUTION NO. 98-23
CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
A RESOLUTION DESCRIBING THE USE OF FUNDS FROM THE
1998 SEWER & WATER BOND, ESTABLISHING RESERVES,
AND THE POLICIES GOVERNING THEM
WHEREAS, the City of Otsego bonded for $4,500,000,
in July, 1998 with the purpose of using those funds
to improve the health, safety, and welfare of the
community by constructing a water system and
sanitary sewer system, and;
WHEREAS, the City of Otsego General Fund has
previously incurred costs of $71,020.93 as of
01/01/98 in planning, engineering, land
acquisition, and legal expenses related to
establishing the sanitary sewer and water systems,
which will be re-imbursed by proceeds from this
bond, and;
WHEREAS, the City of Otsego General Fund has
previously incurred costs of $84,408 as of 01/01/98
with regard to the establishment of Well #1 which
will be re-imbursed by proceeds from this bond.
All future debt service payments for Well #1 will
be paid for from these bond proceeds, and;
WHEREAS, the City of Otsego has determined that the
following policies shall govern the use of bond
funds.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF OTSEGO, MINNESOTA:
1. That the account for paying the debt service on
these bonds shall be known as the 1998 Sewer &
Water Bond Fund.
2. Revenues received from trunk sanitary sewer &
water access charges shall be deposited in the 1998
Sewer & Water Bond Fund in an amount sufficient to
pay the yearly debt service.
3. That the money re-imbursed to the General Fund
to pay expenses occurred prior to 01/01/98 shall be
set aside in an account known as the Sewer & Water
Reserve Account. Said account shall be a back up
source of financing in the event that there are not
enough funds in the 1998 Sewer & Water Bond Fund to
pay the yearly debt service on the bonds.
4. That the City Hall Construction Fund, which has
a balance of $1420511.00 as of January 1, 1998,
shall be a second source of backup financing in the
event there are not enough funds in either the 1998
Sewer & Water Bond Fund or the Sewer & Water
Reserve Account to pay the debt service on the
Sewer & Water bonds.
