Re: Long Haul Trucking, Financing Incentives
Mayor Fournier informed me that Dino Buege of Long
Haul Trucking will be speaking during the Open
Forum portion of the meeting tonight to discuss
financing incentives for the warehouse building
that Long Haul is proposing to construct. Dino
told the Mayor that Long Haul has received a
financial incentive offer from Albertville to
locate in their industrial park.
The City of Otsego currently has a financial
incentives agreement with Long Haul that has never
been signed and never been implemented. That
agreement calls for the City of Otsego to pay Long
Haul $6,500 a year for ten years as long as Long
Haul pays 100% of their property taxes. The
rational for the agreement was based on rebating to
Long Haul a portion of their costs for street and
storm sewer construction. The agreement is much
less complicated and requires less financial
information from Long Haul than a tax increment
financing (TIF) agreement would.
This same agreement also calls for the City to pay
Long Haul an additional $500 a year for any lots in
the industrial park that it develops. This
agreement has not been implemented because John
Daniels has never signed the agreement because he
was going through a divorce. In addition, it was
not until September, 1997 that Long Haul became
fully compliant with the terms of its Conditional
Use Permit, which was also a condition for
receiving the rebate.
When and if Long Haul ever signs the agreement, the
issue may come before the City Council whether they
are due a payment for 1997 because that is when
their property came into compliance with the CUP.

BACKGROUND:
5.1. Attached is the supporting information for Traut Wells
for Invoice #97870 for City of Otsego potable water test holes, Waiver
of Lien, Withholding Affidavit For Contractors and Final Payment for
approval. We have added this to the Consent Agenda
as a routine item. The City Engineer has recommended payment as
noted.
5.2. Attached is a letter from Richard Marquette, Engineering
Assistant from Wright County Highway Department which is self-
explanatory. He is asking the City to approve a Resolution which the
County Board of Wright County has already adopted. This Resolution
regarding County Road No. 118, having a basic right of way width of 66
feet, and described in the Resolution was revoked as County Road No.
118 and was redesignated and to be known as County State Aid Highway
No. 18. They are asking The Otsego City Council to adopt this
Resolution. Mr. Marquette has also sent along the resolution as
adopted by the Wright County Board.
RECOMMENDATION :
.1. This is for Council decision. Recommendation is to approve this
recommended final payment for $6,280.00 as work has been
completed and all the documents are in order.
3.2. This is for Council decision. Recommendation is to adopt the
Resolution as written if Council agrees with this change form
118 to State Aid Highway No. 18.

Re: Approval of City Resolution to Redesignate County Road (CR) 118 as a County State Aid
Highway (CSAH).
Dear Elaine:
As you know, CR 118 is on the Wright County Highway Department's 5 -Year plan for
improvement work to include grading base and bituminous. The project is scheduled for
improvement in two phases. The portion from Fenning Ave. in Monticello to CSAH 37 would be
improved in 1999. The remaining portion from CSAH 37 to CSAH 19 in Albertville would be
improved in 2000.
In order to use state aid funds for the project funding, it will be necessary to redesignate CR 118 as
a County State Aid Highway. I have enclosed two resolutions regarding this action. The enclosed
county resolution which was approved on April 21, 1998, redesignates CR 118 as CSAH 18. The
state requires city concurrence from all cities adjacent to a roadway being redesignated as a CSAH
route. I have an approved resolution form enclosed which can be used for city concurrence relating
to the redesignation of CR 118.
I respectfully request that your city council act on this item at their next regularly scheduled

WHEREAS, the existing alignment of County Road No. 118 is located in an area of Wright County experiencing a
tremendous amount of growth, and
WHEREAS, this growth has created a large increase in the annual daily traffic on this highway resulting in the need to
upgrade the deficient cross section and loadbearing capacity to a 10 ton roadway meeting state aid standards, and
WHEREAS, the respective governing bodies of the adjacent cities of Monticello, Otsego, St Michael and Albertville, concur
in the need to upgrade County Road 118 and designate it as a County State Aid Highway, and
WHEREAS, the state aid mileage required for this 7.42 mile roadway can be obtained from other state aid routes within
Wright County with lesser amounts of traffic, and the State Aid Bank,

PART-TIME EMPLOYMENT
CONTRACT BETWEEN
THE CITY OF OTSEGO, MINNESOTA
AND
ANDREW B.MERGES, ASSESSOR
THIS AGREEMENT is made and entered into this day of , 1998, by and
between the City of Otsego, a municipal corporation under the laws of the State of Minnesota
(hereinafter "City") and Andrew B. Merges, Real Estate Assessor. (hereinafter "Employee")
RECITALS:
WHEREAS, the City is in need of property valuation services for ad valorem property tax
purposes; and
WHEREAS, the Employee has previously provided the City with this service for over
twenty (20) years; and
WHEREAS, the Employee has substantial experience with real property valuation, and is
qualified to assist the City as an assessor; and
WHEREAS, the City desires to contract with the Employee for the performance of certain
employment tasks more fully described herein; and
WHEREAS, the Employee's principal place of business is located at the following address:
6748 Kadler Avenue Northeast, Albertville, MN 55301; and
WHEREAS, the City intends to hire Employee on a part-time basis only, with said
employment being reviewed and renewed, or not, annually; and
WHEREAS, the Employees declares that he is fully qualified and has all necessary
credentials to provide the City with the services set forth herein.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein
contained, it is agreed between the parties as follows:
1. Services to be Performed. The City engages the Employee to perform the following
described employment tasks and services. Employee is responsible for appraising and valuing
each and every taxable parcel of real property within the City of Otsego. Employee shall
personally view a proportion of the taxable parcels within the City consistent with and as
required by state law. Employee will keep accurate and complete records of the work
performed, including documentation of the basis for all appraisals done. Employee will
cooperate and confer with the Wright County Assessor. Employee shall attend any sectional
meetings called by the Wright County Assessor. Employee will use generally accepted
standards and methods in determining property values within the City of Otsego. In
performing these services, Employee will meet all deadlines set by law and all reasonable
deadlines, if any, set by either the Wright County Assessor or Auditor or the City.
2. Legal Qualification, Proof and Continuation Thereof. The Employee represents that he
is legally qualified to perform the duties above-described and, further, that he has obtained all
necessary licenses, permits or certifications, including a license from the State Board of
Assessors, and has otherwise fulfilled all legal obligations requisite to providing assessor
services and performing assessor functions. Within ten (10) days of executing this Agreement
and prior to commencing service, the Employee shall provide proof of proper licensure to the
City and shall remain legally qualified to perform the duties described in this contract
throughout its term. Failure by Employee to provide such proof or maintain such
qualification will result in termination of this Agreement as provided in section ten (10)
below.
3. Terms of Payment. The Employee shall be compensated at the rate of $ per taxable
parcel actually appraised and valued by Employee. It is estimated that there are taxable
parcels within the City. Payment shall be made based upon an estimate of the proportionate
number of parcels appraised monthly. Any adjustment to this estimate, either higher or lower,
shall be made once a year on or about September 1.
4. Instrumentalities. The Employee shall provide for his or her own vehicle, and any
necessary equipment, tools, materials and supplies, except for nominal office supplies, for the
performance of the obligations specified herein. The City may provide the Employee with
periodic access to a work area within the City offices, including use of a computer and usual
furnishings.
5. Expenses. The Employee shall be responsible for his or her own expenses, except that the
City will reimburse him or her for any necessary photocopies, mileage and meal or lodging
expenses as usually approved by the City in the normal course of business. Expenses shall be
submitted by Employee to the City as a written claim, to be audited and allowed by the City
Council. Expense claims shall be submitted monthly and, if allowed by the City Council,
paid monthly. Additionally, the City shall pay for any training required by the State,
including tuition, mileage, lodging and meals while Employee is attending the required
training.
6. Insurance Coverage. Employee shall be covered under any and all applicable liability
insurance coverage, including coverage provided through the League of Minnesota Cities
Insurance Trust, while performing the duties of assessor as a part-time employee of the City.
The City shall pay all premiums and keep such coverage current at all times.
7. Exemption from Certain Benefits. The parties agree and the Employee acknowledges
that, as a part-time, contract employee, under § 1-5.2 of the City's personnel policy Employee
is exempt from that personnel policy, including, but not limited to, paid leave, paid vacation
and disability benefits and other privileges conferred by the personnel policy, but not
provided for by this Agreement. Any and all benefits received by Employee shall be provided
pursuant to this Agreement or as required under applicable state or federal law.
8. Payroll Withholding. The City shall make all necessary withholdings from the monthly
payments made to Employee throughout the term of the Agreement. These include
withholdings for state and federal income tax, social security and PERA.
9. Worker's Compensation. Workers' Compensation insurance has been or will be obtained
by the City on account of hiring the Employee.
10. Termination, Employment At -Will. The parties intend that this is contract creates an at -
will employment relationship. Either party may terminate this Agreement for any reason or no
reason at all, with or without cause or notice. All provisions related to termination for cause or
any additional related privileges, as set forth in the City's personnel policy, are specifically to
not available to the part-time Employee. Agreement shall terminate no later than September
1, 1998. In any event, upon termination of this Agreement by either party, Employee will
furnish copies of all records made in performance of the duties specified in the Agreement to
the City, including the basis for and values assigned to each parcel of property appraised and
assessed.
11. Option to Extend. Upon written agreement of the parties, this Agreement may be
extended to any other future date mutually acceptable to the parties. It is agreed that the value
of any such extension will be at the same per parcel rate as set forth in section three (3) above.
12. Integration, Merger, Modification. This Agreement represents the full and complete
understanding of the parties and both parties represent that they are not relying on any prior
Agreement of statements, whether oral or written. This Agreement may be modified only if
in writing and signed by both parties.
13. Severability. Should any term, provision, section or other lesser part of this Agreement
be found by a Court of competent jurisdiction to be invalid, then said term, provision, section
or lesser part is hereby severed from this Agreement and the remaining provisions of this
Agreement shall remain in full force and effect and shall be binding upon the respective
parties hereto.

WHEREAS, the City of Otsego has initiated the necessary steps to construct a wastewater
treatment facility; and
WHEREAS, the City has also ordered plans and specifications for the establishment of a
City sanitary sewer collector system, water system, and facilities to hold and deliver water
service; and
WHEREAS, additional road right-of-ways will need to be acquired in some instances to
facilitate placement of pipes; and
WHEREAS, the general location of the necessary road easements, land parcels, utility
easements, and temporary construction easements is set forth on attached Exhibit A; and
WHEREAS, the takings are legally described by individual parcels and graphically depicted
on attached Exhibit B; and
WHEREAS, the construction of the above described facilities constitutes a public purpose;
and
WHEREAS, the City has authority to acquire said land and easements by eminent domain
pursuant to Minn. Stat. 117.011 and 117.042; and
WHEREAS, the City has the right to acquire the land and easements prior to the filing of an
award by the court appointed commissioners, pursuant to Minn. Stat.117.011 and 117.042;
and
WHEREAS, the land upon which the facilities will be constructed is owned by the following
persons listed on attached Exhibit C; and
WHEREAS, pursuant to its adopted policy, the City will simultaneously negotiate with the
land owners and pursue eminent domain in order to insure timely construction of the project.
NOW THEREFORE BE IT RESOLVED, that the Otsego City Council hereby authorizes
the acquisition of said land and permanent and temporary easements as described on attached
Exhibit C by eminent domain and to take title and possession of that land prior to the filing of
an award by the Court appointed commissioners, pursuant to Minn. Stat. 163.02, Subd. 2,
117.011 and 117.042; and
BE IT FURTHER RESOLVED, that construction of the facilities as set forth herein
constitutes a public purpose; and
BE IT FURTHER RESOLVED, that the City attorney is requested to file the necessary

within 50 feet of the well.
2. The City of Otsego's Zoning Ordinance requires the following setbacks for the
Agricultural - Long Term Cuban Service District:

Rear yard - 50 feet
Front yard — 35 feet from the Right of Way, 65 feet from Centerline of local roads

Otsego Park Commission Member
I am submitting my resignation from the Otsego Park and Recreation
Commission effective after the May 13th commission meeting.
I have enjoyed working with the other members of the Park
Commission and Area Recreation. However, I feel my time and efforts
will be better served in my other volunteer activities.
I am pleased to have been involved since the formation of the park
commission in 1990. In that time, much has been accomplished by park
members. Getting Prairie Park up and running, the Haunted House, the
Winter Fest, and other events helped out by Area Recreation have been a
real plus. On the other hand, I am disappointed with the slow progress of
getting major projects completed, such as our city park, other
neighborhood parks, bike trails, and more community and council
involvement in major community events. I am also hopeful that budget
concerns get straightened out in the near future.
I wish the Park Commission and City Council well, and I will still be
around to help out at events in the community.

April 30 EDAAC meeting
1. We discussed the adjoining communities activities:
St. Michael is working on their new city hall and fire department and hundreds of new houses
Albertville will be holding their Friendly City Days June 12-14 and the golf course is being built
with their new housing.
Elk River has a new profile sheet out explaining their business and industry, etc
Nothing from Dayton or Rogers
2. Visioning Session was discussed. Some years ago they had a college intem do some research work for
them and they are thinking about having another one. Last time they did work on all the new businesses
in the city and they would like to have staff find that report and maybe do a follow up on it. They feel
the city isn't really "small business friendly" and maybe we can improve on that, we need to encourage
new small business. It was also decided that maybe the vision session should wait until the comp plan is
finished as they would like all the committees to attend, I suggested that the council has enough meeting
right now with the comp plan and would appreciate waiting until after that.
3. Can the members of the EDAAC have a copy of the comp plan so they have a chance to go over it
before the public meeting so they know what we are planning.
4. They would also like to have an updated 1998 copy of the city council, committees and staff, phones,
etc.
5. We talked about the sewer and water issue. Wally also had hand outs on alternative wastewater
treatment systems. They talked about the cluster housing north of 39 and the possibility of not having the
Crow River to dump in when we need expansion later on.
6. Affordable housing was discussed. We all agreed we need some kind of affordable housing,
apartment building or senior housing or mobile, they were all discussed. The read concern with low cost
housing is the number of children added into the school system. It was agreed that the senior housing
needs to be near the stores, churches, etc not in the program right now but something that the city should
be thinking about. There again the vision committee should be working on something like that.
7. The size of lots was discussed with the comment that we need 1200 sq. feet and Albertville has lots at
9000-11000 which brings the costs of the lot down, we much be competitive.
The next meeting will be the third Monday in May

Participation Numbers
City Clerk Elaine Beatty, Deputy Clerk Judy Hudson,
and I have reviewed the recreation participation
names supplied to us by the Community Recreation
Board. Those numbers are for two periods, Fall
1997 and Winter/Spring 1998. Elaine and Judy have
checked the names and addresses to find out how
many of the participants live in Otsego.
FALL 1997
There are 786 participants listed for Fall, 1997
recreational activities. 93 of those participants
gave their address as Otsego, which would be 11.8%
of the total. Examination of the addresses by
staff showed that the actual number of Otsego
residents was 84, or 10.7%. There were 15
participants who gave their address as Otsego when
they lived in St. Michael or Albertville. There
were 6 participants who gave their address as
either Albertville or Elk River who actually lived
in Otsego.
Of the 84 Otsego names there were several
individuals who participated in more than one sport
and so are listed more than once. After accounting
for those people listed more than once there were
69 individuals from Otsego who participated in
Fall, 1997 recreational activities. I did not
count the number of individuals from other
communities who were listed more than once so I did
not determine what percentage Otsego's 69
individuals are compared to the total number of
participants. The 69 individuals came from 60
different families or households.
WINTER/SPRING 1998
There are 1090 participants listed for
Winter/Spring, 1998 recreational activities. 121
of those participants gave their address as Otsego,
which would be 11.1% of the total. Examination of
the addresses by staff showed that the actual
number of Otsego residents was 97, or 8.9%. There
were 27 participants who gave their address as
Otsego when they lived in St. Michael or
Albertville. There were 3 participants who gave
their address as Elk River who actually lived in
Otsego.
Of the 97 Otsego names there were several
individuals who participated in more than one sport
as so are listed more than once. Accounting for
those people listed more than once there were 91
individuals from Otsego who participated in
Winter/Spring, 1998 recreational activities. I did
not count the number of individuals from other

Re: Heritage Preservation Commission (HPC) Study
At the previous City Council meeting, a question had come up
about the status of the study being done for the HPC and
whether or not it was on budget. I spoke with Robert Vogel,
the consultant who is doing the study.
Vogel said that the study is currently a little bit over the
budget but that this is part of the plan. The grant from
the State of Minnesota which funded the study requires
matching funds from the City. Vogel will donate the portion
that is over budget to the City. This will then be used as
part of the City's matching funds.
Mr. Vogel and I also discussed the status of the study. He
said the study is due to be completed in the next two months
and suggested a joint meeting of the HPC and Planning
Commission to review the study. I suggested that the HPC be
invited to the informational hearings on the Comprehensive
Plan, and that after the hearings are complete that the
Planning Commission could hold its meeting with the HPC to
discuss how heritage preservation fits into the City's
Comprehensive Plan.
Mr. Vogel said that was an excellent idea and said that he
had previously recommended to the HPC that they should
recruit a planning commissioner to attend their meetings and
that one or more of them should attend Planning Commission
meetings so that there would be better knowledge and
coordination between the two groups.
I suggest this idea be discussed with the Planning
Commission at its next workshop on the Comprehensive Plan.

Although the tonnage reports haven't been received I do have some preliminaries.
Demcon hauled away 10 - 30 yard containers of household junk.
Corrow hauled away 8 - 30 yard containers of scrap metal.
We registered 299 residents
Collected 638 tires with 2.65 tons of steel from the rims which we get credit for
Collected 155 appliances
We had a wonderful group of volunteers. We will be giving them special attention in our next
newsletter.
As numbers are received and finalized I will compile all information.
It seems like we had more people than usual dumping before and after hours this year. The
problem is the appliances - the appliance recyclers have already picked up and now the city has to
store appliances until next year's clean up day unless we arrange for a special
pickup. You would think these people would at least have the courtesy of throwing their junk
into the containers rather than just dumping it on the ground.
We collected a lot of scrap metal - but there will be about one container load of rejects. This
includes bikes with tires and lawn mowers with tires. We will need to work on getting the
residents informed that tires must be removed from these items.
