04-27-09 CCOTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL APRIL 27, 2009 6:30 PM 1. Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 6:30 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Dan Scharber and Mark Thorsted. Councilmember Tom Darkenwald arrived at 6:34 PM. Staff: Mike Robertson, City Administrator; Tami Loff, City Clerk; Andrew MacArthur, City Attorney; Dan Licht, City Planner; Ron Wagner, City Engineer and Gary Groen, Finance Director. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2. Consider agenda approval. Mayor Stockamp requested to move item 10.1 to Open Forum. City Engineer Wagner requested to add item 9.2 Quote for Water Tower No.3 Bike Path. CM Heidner motioned adoption as amended. Seconded by CM Scharber. Motion carried 4-0. CM Darkenwald absent. 3. Consider the following minutes. 3.1. April 13, 2009 Council Workshop Minutes. CM Heidner motioned to approve. Seconded by CM Scharber. Motion carried 4-0. CM Darkenwald absent. 3.2. April 13, 2009 City Council Minutes. CM Heidner motioned to approve. Seconded by CM Scharber. Motion carried 4-0. CM Darkenwald absent. 4. Open Forum: (5 minute limit) Rose Cassady, Otsego Festival Chair, asked the City Council for a donation for the Otsego Festival scheduled September 19, 2009 from 10AM-5PM. CM Scharber motioned to donate $5000 out of Council Contingency Fund, the same as last year. Seconded by CM Thorsted. All in favor. Motion carried. Gary Knisley, Knisley Construction, said there is a drainage issue on his vacant lot in Riverwood National and he wants the city to fix it. City Engineer Wagner said the property owner is responsible. Mr. Knisley said a pile of dirt was pushed on to his lot from the builder on the property next to him. City Admistrator Robertson said this is between you and your neighbor. The Council confirmed this issue is between Mr. Knisley and the adjacent builder. 10.1. Partial vacation of existing drainage and utili!N easement to allow construction of an attached deck on an existing single family dwelling. City Attorney MacArthur reviewed the vacation request. Mayor Stockamp opened the Public Hearing at 6:51 PM, hearing no public comments Mayor Stockamp closed the Public hearing at 6:52 PM. City Engineer Wagner reviewed the Engineers report. Applicant is requesting a reduction to a 10 foot easement to construct a deck. CM Heidner motioned to allow partial vacation of existing drainage and utility easement. Seconded by Mayor Stockamp. All in favor. Motion carried. City Council directed City Planner Licht to revise the City Ordinance. 5. Consent Agenda. (Non -controversial items). 5.1. Approve Claims List. 5.2. Property Maintenance Ordinance 09-03. 5.3. Resolution 09-09 to include Municipal Boundaries as part of the Wright County Multi -Jurisdictional Hazard Mitigation Plan. 5.4. Received March 10, 09 Police Commission Minutes. 5.5. Received March 11, 09 Park & Rec Minutes. CM Scharber motioned approval. Seconded by CM Thorsted. All in favor. Motion carried. 6. Unfinished Business. 6.1. Hospital District Submittal. City Attorney MacArthur reviewed his proposed memo. This will be submitted by Thursday. The submission will also include the letters received. 7. Public Works. No items. 8. Dan Licht, City Planner. 8.1. Pawn Shop Ordinance 09-04. City Planner Licht presented the Planners Report. CM Thorsted asked about the daily transaction fee of $50. This fee is the same no matter how many transactions in a day. The city collects the fee and then transfers it to Wright County. CM Heidner said a friend who is a Police Chief in another community said that there is a cost to having the Police check daily to be certain none of the items are stolen and the fee is intended to recover this cost. CM Heidner motioned to approve of Ordinance 09-04 establishing regulations on the operation of pawn shops within the City. Seconded by CM Darkenwald. All in favor. Motion carried. City Council Meeting April 27, 2009. Page 3. 9. Ron Wagner, City Engineer. 9.1. Resolution 09-08 Approving Plans & Specs and ordering Ad for bids for 2009 Street Maintenance Project. City Engineer Wagner reviewed the 2009 Street Maintenance Project estimated at $276,025.18. Mayor Stockamp asked if the local townhome associations have been contacted. City Engineer Wagner said that they will be contacted by Public Works Supervisor Brad Belair or assistant City Engineer Joe Macpherson once they have the bids. CM Heidner motioned to approve Resolution 09-08. Seconded by CM Scharber. All in favor. Motion carried. 9.2. Quote for Water Tower No. 3 Bike Path. City Engineer Wagner reviewed the quote in the amount of $9825. Project will be done early June. CM Scharber motioned to accept quote in the amount of $9825. Seconded by CM Heidner. All in favor. Motion carried. CM Heidner said that there is no street sign in the Pheasant Ridge Development off of 76th street where there is a small cul-de-sac. City Engineer Wagner said it was a private driveway. City Administrator Robertson said he would contact the developer. CM Heidner asked if MRWA is putting pipes in ground. City Engineer Wagner said that he sent over his comments and has not heard back from MRWA. City Council directed the City Engineer to contact them. 10. Andrew MacArthur, ON Attorne Public Hearing: 10.1. Aaron Corrick: A. Closed Meeting for Attorney/Client privilege. Mayor Stockamp motioned to close the meeting at 7:52. Seconded by CM Darkenwald. All in favor. Motion carried. The Council heard an update on a legal case from City Attorney MacArthur. Mayor Stockamp motioned to re -open the meeting at 8:16 PM. Seconded by CM Thorsted. All in favor. Motion carried. 11. Council Items. 11.1. Set Workshop for Salary System Review. Council set a Workshop for June 1St at 5:30 PM. City Council directed that Sherri Le should be present. City Council Meeting April 27, 2009. Page 4. 11.2. Set Joint Workshop with St. Michael City Cc This was set for July 20th at 5:30 PM at Otsego City Hall. 11.3. Approve E -Scan Deposit Process. Finance Director Groen reviewed. The E -Scan Deposit would cost $240 a month with a onetime fee of six to nine hundred for the machine. It would save trips to the bank during each week. By depositing daily it would also increase the interest earnings of the City. They would scan checks for deposit and then retain for the checks for 60 days.
