06-08-09 PHITEM 3_7 CONTINUATION OF PUBLIC HEARING QUANTRELLE AVENUE IMPROVEMENTS MONDAY, JUNE 8, 2009 5:30 PM 1. Mayor Stockamp will open the Continued Public Hearing. Roll Call: Mayor Stockamp; Councilmembers: Vern Heidner, Tom Darkenwald, Mark Thorsted and Dan Scharber. Staff: Mike Robertson, City Administrator; Tami Loff, City Clerk; Ron Wagner, City Engineer; Dan Licht, City Planner; Andy MacArthur, City Attorney; Gary Groen, Finance Director. Mayor Stockamp opened the continued Public Hearing at 5:31 PM. 2. Continued discussion of Quantrelle Avenue Improvements. City Attorney MacArthur said he meet last Thursday with Mississippi Riverwood Association (MRWA) and came up with the draft agreement in front of City Council. CM Darkenwald asked why #10 states "opinion". CM Darkenwald said he does not agree with that statement. City Attorney MacArthur said part of the agreement is they are dropping their appeal of the assessment. The alternative would be they would go ahead with the appeal and then at some point we would have to go over the Sewer Access Charges (SAC) fees. CM Heidner said he is not willing to give a 50 percent discount, that is less than residential and commercial properties have paid. CM Heidner said he still feels the deal offered last fall was the best. CM Darkenwald said from beginning he thought it was to be monitored. City Administrator Robertson said we have monitored how much water they use but we have not inspected the septic to see if it meets code. City Planner Licht said that we are discounting them twice, once for seasonal usage and once for 210 days versus 180 days. Perry Edwards, MRWA, said there are two separate assessment charges and that they have not disputed the Sewer Access Charges (SAC) fees but they feel they were given the wrong number in the first place. Mr. Edwards said they looked into the test to monitor their septic system and it was very expensive. CM Darkenwald asked how much would that have cost. Mr. Edwards said around $50,000 to do first test and then every year after that it was around $20,000. CM Heidner said the amount we are assessing them is the cost we actually occurred installing the pipes and the lift station. CM Scharber said even with the new figure we are still discounting some. City Administrator Robertson said that's correct. 3. Close the Public Hearing. CM Heidner motioned to close the Public Hearing at 6:28 PM. Seconded by CM Scharber. All in favor. Motion carried.
