09-14-09 CCITEM 3-1 OTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL SEPTEMBER 14, 2009 7:00 PM 1. Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 7 PM. Roll Call: Mayor Jessica Stockamp, Councilmembers Vern Heidner and Mark Thorsted. Absent: Councilmembers Dan Scharber and Tom Darkenwald. Staff: Gary Groen, Finance Director; Tami Loff, City Clerk; Andy MacArthur, City Attorney; Dan Licht, City Planner, Ron Wagner, City Engineer and Brad Belair, Public Works Supervisor. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2. Consider agenda approval. City Planner Licht requested to add item 8.2 Great River Centre VA Clinic. CM Heidner motioned to approve as amended. Seconded by CM Thorsted. All in favor. Motion carried. 3. Consider the following minutes. 3.1. August 13, 2009 City Council Workshop. CM Heidner motioned to approve as written. Seconded by CM Thorsted. All in favor. Motion carried. 3.2. August 24, 2009 City Council Minutes. CM Heidner motioned to approve as written. Seconded by CM Thorsted. All in favor. Motion carried. 4. Open Forum: (5 minute limit Otsego Festival Coordinator Rose Cassady introduced the Candidates for the Otsego Festival Royalty. 5. Consent Agenda. (Non -controversial items). 5.1. Approve Claims List. 5.2. 2010/2011 Police Contract. 5.3. Res. 2009-29 setting a Public Hearing on proposed assessments for unpaid utility billing accounts, escrow accounts, and fees and charges related to code enforcement. 5.4. Approve Pay Request to Honda Electric in the amount of $312.92 for Otsego Pressure Station #1. 5.5. Resolution 2009-30 relating to parking restrictions on Randolph Avenue. 5.6. Approve Pay Estimate #3 to Hardrives, Inc in the amount of $86,953.23 for 75th Street Improvements. 5.7. Approve Final Pay Estimate #3 to Hennen in the amount of $8,141.95 for Riverpointe Trunk Watermain Extension. City Council Meeting September 14, 2009. Page 2. CM Heidner motioned to approve. Seconded by CM Thorsted. All in favor. Motion carried. 6. Unfinished Business. Mayor Stockamp asked City Engineer Wagner for an update on the issue with the bike path crosswalks by Otsego Elementary. City Engineer Wagner said he looked at costs for installing solar school zone flasher beacons. Three to six would be needed and they are around $1,800 each. City Planner Licht suggested additional signage instead; an advisory sign could be used. Mayor Stockamp suggested maybe working with the School District. City Engineer Wagner said that we could look at adding to the Safe Routes to School fund. This will be brought back to a staff meeting to discuss. 7. Public Works. 7.1. Adopt -A -Street application. Public Works Supervisor Brad Belair reviewed the application from the Police Commission to adopt Nashua Ave from County Road 39 to 85th Street. Mayor Stockamp motioned to approve application. Seconded by CM Thorsted. All in favor. Motion carried. 7.2. Sealcoath . CM Heidner motioned to approve as described in the amount of $18,663.20. Seconded by Mayor Stockamp. All in favor. Motion carried. 7.3. Crack sealing streets and paths. CM Heidner motioned to approve crack sealing 4000 linear feet of paths in the amount of $ 3200 and additional crack sealing of streets in the amount of $16, 200. Seconded by Mayor Stockamp. All in favor. Motion carried. 8. Dan Licht, City Planner. 8.1. Consider allowing golf carts on City trails and streets. City Planner Dan Licht presented the Planners Report. A Resident inquired about use of golf carts upon trails and streets which is currently prohibited. City Planner Licht is recommending no action be taken. CM Heidner motioned to take no action and for staff to send a letter to the resident. All in favor. Motion carried. 8.2. Great River Centre VA clinic. City Planner Licht presented. CM Heidner motioned to approve. Seconded by CM Thorsted. All in favor. Motion carried. 9. Ron Wagner, City Engineer. 9.1. Approve plans and specs for Davis Mississippi Coves. City Engineer Wagner updated the Council that last week city staff pulled the Letter of Credit. City Council Meeting September 14, 2009. Page 3. CM Heidner motioned to approve Resolution 2009-31 approving Plans and Specifications for Mississippi Coves 1st and 2nd Addition Wear Course Paving. Seconded by CM Thorsted. All in favor. Motion carried. 10. Andrew MacArthur, City Attorney. City Attorney MacArthur updated the City Council on the meeting with the Monticello Hospital District. He is asking the Council to authorize him to request tapes and records and to have transcribed. CM Heidner asked cost. City Attorney MacArthur said between $800-1200 to get the tapes and have items transcribed. Mayor Stockamp said that a correction letter needs to be sent- at the meeting they were stating Otsego spent $200,000 so far. Should be clarified. CM Heidner motioned to request necessary information. Seconded by Mayor Stockamp. All in favor. Motion carried. 11. Council Items. 11.1. Sherri Le HR status report. Mayor Stockamp said that a meeting should be set when the rest of the Council is present to review. CM Heidner said that all the minutes from the meetings with Sherrie Le should be provided to Council and staff. CM Thorsted motioned to approve invoice for $2,317.00. Seconded by Mayor Stockamp. All in favor. Motion carried. 11.2. Res 2009-28 setting a Preliminary Tax Levy for 2010. A Budget meeting for October and November should be set at next City Council meeting when all City Council is present. CM Heidner motioned to approve Resolution 2009-28 setting a Preliminary Tax Levy for 2010. Seconded by CM Thorsted. All in favor. Motion carried. 11.3. Scharber & Sons invoice. CM Thorsted motioned to approve. Seconded by CM Heidner. All in favor. Motion carried. 12. Mike Robertson, City Administrator. 13. Tami Loff, City Clerk.
