Mayor Stockamp called the meeting to order at 6:37 PM. Roll call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Doug Schroeder, Tom Darkenwald and Dan Scharber and Lori Johnson, City Administrator. 2. Long Range Planning. The Council discussed long range planning specific to the following: Recreation Programming: The Council discussed options for providing recreation programming and the types of recreation programming desired. City Administrator Johnson reviewed past Community Education programs and financial data, the 2012 proposed recreation budget, and the benefits of each of the proposed options for future recreation programming. The Council directed staff to continue research on a City recreation department. Fire Service: The Council discussed the possibility of a substation in Otsego for fire and ambulance service. Improving the response time for the ambulance is a high priority. The Council directed staff to continue to explore options to improve the response time for the ambulance. City Hall Long Term Use: This item was carried over from a previous meeting during which the Council agreed to further discuss the long term use of the building before proceeding with repairing the roof. In addition, repairs may be needed in HVAC systems, ADA, and other areas and those should be addressed at the same time as the roof. The Council authorized City Administrator Johnson to spend funds to determine if the HVAC system needs to be replaced and the cost to move it from the roof. City Administrator Johnson indicated she would report back with replacement and repair costs at a future meeting. Logo: The Council selected Concept C Option 1. The tag line will be removed for now. Tax Lew: City Administrator Johnson briefly updated the Council on the upcoming truth in taxation meeting at which property owners have an opportunity to provide input on the 2012 budget and tax levy. Personnel: The Council discussed employee recognition programs. Internship: City Administrator Johnson presented an update on the internship previously discussed. Motion by CM Scharber, Second by CM Darkenwald to authorize an internship at a cost of $2,400 as proposed. Motion approved 5-0. Public Works Organizational Structure: City Administrator Johnson presented information on the current structure of the department and the need for change that comes as a city grows. She indicated she is working with the Public Works Supervisor to define options for the Council including an interim option for a lead worker in the absence of the Public Works Supervisor. Special City Council Meeting November 28, 2011. Motion by Mayor Stockamp, Second by CM Darkenwald to approve an interim Lead Worker assignment in the Public Works department when the Maintenance Supervisor is absent; the Lead Worker will be paid $1.00 per hour. Motion approved 5-0. Staffing Development: City Administrator Johnson updated the Council on staff matters. Use of Old City Hall: City Administrator Johnson indicated that she received a request for use of the Old City Hall. She further stated that the Council could offer the space to the Arts Alliance as they are currently in temporary space. The Council concurred that the Arts Alliance could use the space at no cost to the City. The Arts Alliance would be responsible for costs associated with the use. Economic Development: Discussion took placed on various economic development activities and incentive programs. The importance of a good transportation system was discussed including the economic benefits of upgrading 70th street. Mayor Stockamp questioned if the Council was in agreement that consultants would no longer be required to be at Council meetings if there were no issues pertaining to them. The Council concurred. Mayor Stockamp asked about the recent water issue at Riverwood National development. The signs would be be MNDoT standard specification designs and are proposed to be installed at Queens Avenue/CSAH 37 and at Queens Avenue/CSAH 36. Mr. Warehime also wants to install the same signs within the right-of-way of TH 101 and CSAH 36 and CSAH 37 and has been advised that those locations require approval from MNDoT and Wright County, respectively. The City has collaborated with Metro Appliance Recycling to promote a clean-up week in May for the past two years. Metro Appliance Recycling provides Otsego residents a discount on disposal fees for various items as part of this program. Preliminary discussions for a clean-up week for 2012 have included the possibility of expanding the list of items accepted. The established relationship between the City and Metro Appliance Recycling does create an opening to allow the recycling center signs as official signs with a public purpose to eliminate junk/debris nuisances within Otsego. NOW, THEREFORE, IT IS AGREED between the Parties as follows: 1. CITY agrees to install the proposed signs within its public right-of-ways at locations agreed to by the Parties. 2. The signs remain the property of the CITY and shall be installed, maintained and removed in accordance with any law, ordinance, policy or practice of the CITY now in effect or adopted in the future. 3. OTSEGO ON THE GREAT RIVER ROAD TO: Otsego Mayor and City Council FROM: Lori Johnson, City Administrator DATE: December 7, 2011 RE: 2012 Tax Levy and Budget On December 12 the Council will adopt the 2012 tax levy and budgets. This is the culmination of many public meetings at which the City's revenues and expenditures were reviewed and discussed in detail. In September the Council adopted a preliminary levy that is the maximum amount the City may levy. The final levy may be reduced by the Council, but it may not be increased. The final levy must be certified to the county auditor by December 28. This memo is an overview of the highlights and significant changes to the levy and budget. Please refer to the proposed budget for detailed information. Finance Director Gary Groen has compiled the draft 2012 budget as previously discussed; it is attached for your review. A resolution to set the final 2012 tax levy at $4,261,000, the same amount as the preliminary levy, is also attached. Staff will present the budget and levy at Monday's Council meeting and will be prepared to answer questions from the public and the Council. Property Tax Levy The 2012 preliminary levy adopted in September is $4,261,000. This includes a levy for fire services. By comparison, the 2011 levy plus fire assessments totaled $4,445,325. The 2012 levy represents a decrease of 4.15 percent or $184,325 from the final 2011 levy. As previously discussed, in 2012 the method in which the revenue to pay for fire services is collected will change from an assessment to a tax levy. The $480,000 assessed for fire services in 2011 will be levied as a tax in 2012. Therefore, in order to make an accurate comparison of the total amount each property owner paid for city services in 2011 and 2012, $75.50 needs to be added to the 2011 estimated City tax. This change is not clearly identified on the truth in taxation statements property owners received in November. Homestead Credit and Homestead Exclusion Due to the State's decision to withhold approximately $237,000 of homestead credit from the City in 2011, the 2011 net revenues will total $4,208,325, not the $4,445,325 levied. Recent legislation will eliminate the homestead credit program in 2012 thus ending local governments' dependence on the State for payment of a portion of the local property tax levy; although, that same legislation has created a new issues. The repeal of the previous homestead credit program and the implementation of a new homestead exclusion program approved by the Legislature and Governor generated a great deal of publicity due to the significant impacts of the law change. See the attached excerpt from the League of Minnesota Cities publication titled "What's Going on With My Tax Bill?" As the document explains, property tax rates will increase in most cities even if tax levies stay the same as the previous year. Additionally, the distribution of taxes will shift away from residential homestead property valued below $413,800 to other property, mainly commercial and industrial. The shift will vary in each city depending upon the amount and value of residential property. The one positive outcome of this legislation is that cities will now receive the entire amount they levy. Local property owners will pay the total amount levied; cities are no longer dependent upon the State for paying its share of the local property tax. Net Tax Capacity In addition to the decrease in value due to the Homestead Exclusion program, property values once again decreased for taxes payable in 2012. Even with new home construction continuing, albeit at a much slower pace than before, the City's net tax capacity decreased 11.61 percent for taxes payable 2012. Homestead property values decreased by 15.19 percent. Commercial and industrial property that accounts for just over 18 percent of the total valuation decreased 2.94 percent. General Fund Budget The 2012 General Fund budget is proposed at $3,571,172 including fire services of $345,000. Previously, fire services were accounted for in a special revenue fund. Excluding fire services, the General Fund budget is proposed to increase $201,144 or 6.7 percent. Part of the increase, $113,800 or 3.8 percent of the increase, is attributed to costs that were previously charged to the Community Development and Building Safety Fund. That leaves an increase of $87,344 or 2.9 percent. In addition to covering increased operating costs, the $87,344 increase includes $15,000 to update the comprehensive plan that was last updated in 2004, $11,000 for enhanced recreation programming, $10,000 for elections, and $7,135 to expand economic development activities. Summary The actual 2011 revenue that the City expects to receive is $237,000 less than levied due to the State's decision not to pay homestead credit in 2011. The City has made reductions and carefully reviewed the budget to absorb as much of the loss of homestead credit as possible. As a result of carefully monitoring and reducing expenditures, the proposed levy for 2012 is projected to increase only 1.25 above the 2011 net levy. Conclusion As noted above, staff will present the tax levy and budget information and be prepared to answer questions from both the Council and the public at the Council meeting. Following the presentation, the Mayor must open the meeting to for public comment on the levy and budget. After taking public comment, the Resolution setting the 2012 tax levy must be approved and the budgets must be adopted by motion. By eliminating the credit, the state was able to save roughly $260 million each year. This was one cost saving measure the state used to close the $5 billion two-year state budget deficit. • Under the old credit law, the state was reducing the taxes paid by homesteaded property and instead the state was promising to pay that portion of the tax to the local taxing districts (i.e., your city, county, school, and other local taxing districts). However, in seven of the last eight years, the state did not pay the full credit amount to at least some local governments, due to its budget problems. This meant each year many local governments were left with a deficit in their budgets because of the state's inability to pay the amount it owed. What is the Impact: The impact of this state change will vary for each property depending on a variety of factors. However, in general, the elimination of the homestead credit and replacement with a homestead exclusion is going to mean higher property taxes for most property owners, even if property tax levies adopted by local governments do not increase. The bullets below explain the most significant impacts of this change: • The state is no longer providing a homestead credit and instead the entire levy is being paid by local property taxpayers. • The new homestead exclusion lowers the tax base, which has led to increases in the property tax rates of most local taxing jurisdictions. A property tax rate is calculated by dividing the property tax levy by the total tax base. • For properties that are non -homestead, including commercial and industrial property, the higher property tax rates are likely to mean higher property tax bills even if their values have declined. • For properties that are homestead, the new homestead exclusion may not be enough to offset the increases in tax rates and the elimination of the homestead credit, thus many homestead properties as well will experience tax increases. Currently, all of the survey has been completed. Some changes have occurred since the previous Feasibility Study was prepared and the report should be updated to reflect these. The two major changes are: 1. 70th Street from Marlowe Avenue to Martin Farms Avenue is a stand alone project and is schedule for completion in 2012/2013. This changes the road termini for the project and the cost estimate. 2. The Council has stated the desire for the project to include an off street trail to start at MacIver Avenue and end at Oakwood Avenue. An off street trail would change right-of-way needs & the cost estimate. RECOMMENDATION We recommend the Council authorize the preparation of the Feasibility Study. CITY OF oTSEGO ON THE GREAT RIVER ROAD ot901-2011 Request for Action - 70th Street Page 1 of 3 BACKGROUND — GRANT APPLICATIONS It is our opinion the 70th Street Project is an even more attractive Region 7W Federal Grant project this year, than it was last year, for several reasons: The non -existing portion of the project is '/4 mile less in length going from % mile to '/2 mile with the exclusion of the portion from Marlowe Avenue to Martin Farms Avenue. This will lessen fears amongst TAC (Technical Advisory Committee) members of the need for an environmental study. 2. This is the second year it is being brought forth. Multiple year applications seem to fare better than first year applications. 3. The application scored the highest of all projects last year, proving justification for the project. 4. The project is planned to be constructed in 2013/2014 with 2016 money. Project completion in advance of Federal Grant dollars is looked upon very favorably. Otsego must submit an application to Region 7W by January 13, 2012. Another grant opportunity that the 70th Street Project would align itself well with is the funding for Routes of Regional Significance. The project meets all of the criteria and is eligible for up to $500,000. The key component to this grant is that the project must be approved for construction letting by June of 2013. This timeline would require design to start very soon as right-of-way acquisition, especially condemnation proceedings, can take several months if not closer to a year to complete. The application must be submitted prior to February 3, 2012 to Mn/DOT State Aid for $500,000. RECOMMENDATION We recommend Council authorization preparing and submittal of this application for a Region 7W Federal Grant in the amount of $1 million. We recommend the Council authorize preparation and submittal of an application for funding from the Routes of Regional Significance to Mn/DOT State Aid for $500,000. To show State Aid Otsego's commitment to the required timeline, we also recommend the Council authorize final design of the 70th Street Project for the purpose of obtaining right-of-way. Wright County has amended their code to adopt new regulations consistent with the updated Minnesota Rules. Minnesota Rules 7082.0050 Subp. 1 and 2 requires that Otsego adopt septic regulations to be at least as restrictive as the Wright County regulations. Wright County has adopted an updated SSTS Ordinance, which has been reviewed by the City Engineer and Building Official. City staff has drafted the attached amendment to Chapter 4, Section 3 of the City Code to this end. ■ Section 4-3-2.G of the Ordinance requires a management plan with all new SSTS requiring documentation of pumping/inspection every three years. ■ Section 4-3-2.1-1 outlines City practices regarding use of holding tanks that had previously been processed as a variance. ■ Section 4-3-2.J references compliance with the Wright County Point -of -Sale Ordinance. ■ Section 4-3-2.K requires submission of documentation to the City for all abandoned septic systems. ■ Section 4-3-3 includes more specific design requirements than the City had previously outlined in the City Code but which are consistent with those in the Wright County Ordinance. ■ Section 4-3-4 regarding failing or systems threatening public health are carried over with timeframes for corrective actions consistent with those established by the Wright County Ordinance. This Section is adopted pursuant to the authority granted under Minnesota Statutes Chapters 115 and 145A and Minnesota Rules 7080 through 7083, pertaining to sewage and wastewater treatment, as the same may from time to time be amended. 4-3-2: GENERAL PROVISIONS: A. Adopted By Reference: The City hereby adopts by reference Minnesota Statutes 115.55 and Minnesota Rules 7080 and 7081 along with any future amendments thereof. B. Permit Required. No person shall engage in the evaluation, inspection, design, installation, construction, alteration, extension, repair maintenance or pumping of an SSTS without first obtaining a permit as provided for in Section 4-3-5.13 of this Section. C. License Requirements: 1. No person shall engage in the evaluation, inspection, design, installation, construction, alteration, extension, repair maintenance or pumping of an SSTS without first obtaining a license to perform such tasks from the Minnesota Pollution Control Agency (MPCA) except as provided for under Minnesota Rules 7080.0700. 2. Property owners may only install a gravity fed Type 1 system serving an single family dwelling and only under the supervision of a person having the qualifications setforth by Section 4-3-2.B.1 of this Section. D. Scope. All sewage generated in areas of the City where sanitary sewer is not available, as determined by the City, shall be treated and dispersed by an approved SSTS that is sited, designed, installed, operated and maintained in accordance with this Section or by a system that has been permitted by the MPCA. E. Prohibitive Discharge: It is unlawful for any person to construct, maintain or use any SSTS regulated under this Section that results in raw or partially treated wastewater seeping to the ground surface or flowing into any surface water. Any surface discharging system must be permitted under the National Pollution Discharge Elimination System (NPDES) program by the MPCA. F. Floodplain. SSTS shall not be located in a floodway and whenever possible, location in a floodplain shall be avoided. If no option exists to locate a SSTS outside of a floodplain, location within the flood fringe is allowed if the requirements in Minnesota Rules 7080.2270 and the requirements of the Zoning Ordinance are met. G. Management Plans: Kj 1. Management plans are required for all new or replacement SSTS. The management plan shall be submitted by the designer to the Building Official before issuance of a SSTS permit. Management plans shall include requirements as listed in Minnesota Rules 7080.0600, Subp. 1(B) and any other requirements as determined by the Building Official. 2. SSTS specified in parts Minnesota Rules 7080.2290, 7080.2350, 7080.2400 and 7081 require an operating permit sand shall include Minnesota Rules 7082.0600, Subp. 2 and other requirements as determined by the Building Official. The operating permit for new SSTS and MSTS will be issued in tandem with the construction permit for the new system. Operating permits when needed for existing systems and/or system repair will be issued as separate permits. 3. SSTS not operated under a management permit or operating permit must have treatment tanks inspected every three (3) years. Solids must be removed when their accumulations exceed the limits described in Minnesota Rules 7080.2450. 4. Septage shall be pumped, managed, land applied and disposed of in accordance with applicable State and Federal laws. 5. With septic tank pumping, the service manhole(s) shall be brought to within one (1) foot of finished grade and secured as needed. With the pumping, maintaining or certification of a lift tank, the pump riser must be brought to grade. H. Holding Tanks: 1. The use of holding tanks for new residential dwellings is prohibited. 2. Use of holding tank(s) may be approved by the City Council for existing structures or uses other than new residential dwellings only when: a. Physical conditions upon the property make construction of a SSTS meeting the requirements of this Section not possible. b. The property does not have access to municipal sewer as determined by the City. C. For residential structures, the property owner shall agree that the existing structure shall not be expanded or altered by way of 3 kitchen, bathrooms, bedrooms or other improvements in such a way as to require additional holding tank capacity. 3. When allowed, holding tanks shall be subject to the following requirements: a. A level alarm shall be installed within the tank that includes an audible horn and strobe light visible from a public street. b. The property owner shall maintain a contract on file with the Building Official for pumping the holding tank(s) with a licensed maintenance business and shall submit to the Building Official records of required pumping and other maintenance. New Systems. All lots shall have a minimum of two (2) soil treatment and dispersal areas that can support trenches, seepage beds, mounds and at -grade systems as defined by Minnesota Rules 7080.2200 through 7080.2300 or site conditions described in 7081.0270, Subp. 3 through 7. J. Point of Sale. No owner of a tract of land on which a structure that is required to have an SSTS is located shall sell or transfer to another party said tract of land unless the requirements as stated in the Wright County Point of Sale Certification Ordinance for On -Site Septic Systems are met. K. Abandonment: SSTS must be property abandoned in accordance with Minnesota Rules 7080.2500: 1. If the individual abandoning a SSTS is not a licensed SSTS professional, the abandonment must be inspected by a licensed SSTS inspector. 2. A State abandonment document must be submitted to the Building Official within ninety (90) days of abandonment. 4-3-3: SITE EVALUATION AND DESIGN REQUIREMENTS: A. Soil Observations: A minimum of three (3) soil observations are required for each site unless sites are adjacent. For adjacent sites, a minimum of three (3) soil observations are required with a minimum of two (2) soil observations in the primary site and one (1) observation in the secondary site. B. Site Identification. Benchmarks, borings, perolation sites and dispersal area must be staked and labeled in the field with the elevations of each on the submitted design. C. Septic Tank: 1. A minimum one thousand five hundred (1,500) gallon split tank is required although split tank capacity may be achieved with multiple tanks. 2. For a new dwelling, burial of the top of the tank greater than four (4) feet is allowed only with approval of the Building Official and a statement from the manufacturer as to the maximum designed depth for the tank. D. Pump Tank: A minimum one thousand (1,000) gallon pump tank is needed for lifting the effluent to the soil treatment area. E. Percolation Tests. When conducting percolation tests, soil texture shall be logged and accounted for. If there is a discrepancy between the soil texture and the percolation rate, the smaller soil loading rate shall be used. F. G. Sewer Pipe: 1. The building sewer pipe extending from the building to the tank shall not be less than four (4) inches in diameter and must meet the strength requirements of Schedule 40 plastic pipe. The pipe shall be supported in such manner so that there is no deflection during backfilling and subsequent settling of the soil between the building foundation and the inlet to the septic tank. Construction of the line shall provide a grade of not less than one-eighth (1/8) inch per foot for minimum grades. No ninety (90) degree ells shall be permitted. 2. All sewer pipe lines, manholes, and other appurtenances shall be constructed in accordance with the State Plumbing Code and MPCA requirements. H. The setback from the treatment area to a public right-of-way may be reduced by approval of the City Engineer. Setbacks to other property lines shall be processed in accordance with the variance procedures established by the Zoning Ordinance. 4-3-4: FAILING SYSTEMS: A. Modification or Discontinuance Required. If upon inspection, an SSTS is found to be a failing system or a system posing an imminent threat to the natural environment or the public health, safety and welfare then the SSTS shall, if possible, either be modified or repaired to comply with this Section or its use discontinued within the time periods specified in this subdivision. B. Failing Septic Systems. A failing SSTS as defined in Minnesota Rules 7080.1500 Subp. 4b shall be upgraded, replaced, or its use discontinued within the six (6) months of issuance of the notice of non-compliance. C. SSTS System Posing an Imminent Threat. Any SSTS posing an imminent threat to the natural environment or public health, safety, or welfare as defined in Minnesota Rules 7080.1500 Subp. 4b shall be abated within ten (10) days. The system shall be upgraded, replaced or repaired, or its use discontinued, within a reasonable period of time, not to exceed six (6) months. D. Remediation. A permit shall be required when an operational component is added or a method employed to an SSTS to recover a failing treatment area. Required information for this permit will be a description of what is wrong with the existing SSTS, an inspection/compliance of the components of the system, a lab sample of the existing effluent to determine abnormalities and a preliminary site evaluation of what the upgrade options will be on the property if the remediation fails to correct the problem. A management plan/operating permit will also be required. 7 E. Emergency Actions: 1. Notwithstanding the provisions of this Section, the Building Official or City Engineer may require pumping of a septic system not more than twenty four (24) hours of issuance of a notice of Failing System or SSTS System Posing an Imminent Health Threat being issued and compliance with the following additional requirements: a. Install a level alarm within the tank that includes an audible horn and strobe light visible from the public street. b. Seal the septic tank outlet converting the tank to a holding tank. C. Expose the service manhole for pumping the septic tank. d. Seal all outlets within the basement of the structure served by the septic system. e. The property owner shall provide the City a right -of -entry to the property to allow for any needed inspection, maintenance, repair or replacement of the failed system with all costs incurred by the City being the responsibility of the property owner. 2. Actions as may be required by the Building Official or City Engineer to immediately abate a threat to public health, safety and welfare shall not exempt the property owner from providing for a compliant system in accordance with this Section. 4-3-5: ADMINISTRATION: A. Ordinance Administration. The City Clerk, Building Official, and City Engineer shall be responsible for the administration of this Section. 1. Duties of the City Clerk. The City Clerk shall be responsible for the administration and issuance of orders, permits and notices required by this Section. The Clerk is authorized and directed to cooperate with local and state officials and personnel in the enforcement of this Section, Minnesota Rules Chapter 7080 and applicable state laws. 2. Duties of the Building Official. The Building Official shall be responsible for site and system inspections, compliance determinations, investigation of failing systems and permit review and any other duties necessary to .11 ensure compliance with the provisions of this Section, Minnesota Rules Chapter 7080 and applicable state law. 3. City Engineer Duties. The City Engineer shall be responsible for review and system design analysis on all holding tanks, drainfield site requirements for new subdivisions and any variance from the requirements of this Section. B. Permit Application Requirements: Each permit application shall be presented as follows and contain all of the following information: 1. Application Form. Applications for permits shall be made on forms approved and furnished by the City. The applicant must be signed by the applicant and shall be submitted to the City Clerk. 2. Legal Description, Name and License Data of SSTS Professional. Each permit application shall contain the legal description of the property for which the permit is requested. The application shall also disclose the name of the SSTS professional who will perform the work for which the permit is required and provide all license data required by Minnesota Rules 7080. 3. Site Plan. Each permit application shall be accompanied by a site plan, prepared by an SSTS professional or professional land surveyor, showing the following, unless such requirements are specifically waived, in whole or in part, in writing by the City's Building Official: a. The location of any proposed or existing building on the subject property. b. The boundary lines of the subject property. C. The location of water supply facilities. d. The location and ordinary high water mark or any streams, ponds, or lakes located on or within one hundred fifty (150) feet of the subject property. e. That the proposed SSTS meets all setbacks as required by Minnesota Rules Chapter 7080. E f. Topographic contours at two (2) foot intervals. Topographic contours and elevations shall be drawn to scale on the site plan using common engineer's scale. g. The location of any SSTS or wells on adjoining lots within one hundred fifty (150) feet of the subject property. h. Each site plan shall be accompanied by a certificate of accuracy from the SSTS professional or land surveyor who prepared the site plan. 4. System Design Data. Each permit application shall include a complete design plan showing the size and location of all parts of the SSTS and provide a design certification from a licensed SSTS professional as to the adequacy and location of the SSTS in relation to the requirements imposed by Minnesota Rules 7080. 5. Other Data. Each permit application shall contain any and all additional information, as may be required by the City, necessary to show that the conditions of Minnesota Rules 7080 and this Section will be met. 6. Permit Fees. The amount of fees to be collected at the time of application for permits required by this Section shall be established in Section 2-4-2 of the City Code. C. Permit Approval Procedures: Permits shall be approved or denied as hereinafter provided in this subdivision. 1. Submission of Application. Permit applications shall be submitted to the Building Official, along with the permit fee. The Building Official shall, within fifteen (15) days, determine whether a submitted application is complete. Incomplete applications shall be rejected and returned to be applicant along with a written explanation as to why the application has been rejected. 2. Technical Review. Once a complete application is received, the Building Official shall review the application to determine whether it meets the requirements and standards of this ordinance and of Minnesota Rules 7080. The Building Official may, at their sole discretion, submit the permit application to the City Engineer for review, comment, and/or a determination as to whether the application meets the requirements of this Section and Minnesota Rules 7080. 10 3. Approval by Building Official: a. Once a determination is made that the application meets all applicable requirements the SSTS permit shall be issued. The Building Official and/or City Engineer may impose any and all conditions to ensure compliance with the requirements of State law, Minnesota Rules 7080, this Section and other applicable local ordinances. b. If it is determined that the application does not meet the requirements of this Section or Minnesota Rules 7080, then the Building Official shall give notice to the applicant that the application has been rejected and state the reasons for such rejection as provided by the Building Official and/or City Engineer. C. The decision to approve or deny the application permit should occur within ten (10) days of the Building Official's receipt of a complete application. Failure to approve an application within ten (10) days shall not be construed as an approval or otherwise allowing an SSTS that would not be approved under this Section, Minnesota Rules 7080 or other applicable law. 4. A permit issued under this Section shall be valid for one (1) year from the date of approval. D. Inspections: 1. General Inspection Requirements. The Building Official shall make such SSTS inspections as are necessary to determine compliance with this Section, Minnesota Rules 7080 and/or any conditions contained in permits issued hereunder. The following events shall trigger an SSTS compliance inspection: a. A permit is granted under Section 4-3-5.0 of this Chapter. b. A building permit is granted for new construction or the addition of a bedroom or bathroom on property served by an SSTS. C. For all new SSTS construction, or any SSTS replacement, repair, alteration, maintenance, or operation. d. Granting of request for change in system design or change in permit conditions. 11 e. The City learns or receives a complaint that a particular SSTS may be a failing system or poses an imminent threat to public health, safety, and welfare. 2. Time and Manner of Inspection: a. Inspections shall be made by the Building Official and/or City Engineer to ensure compliance with the requirements of this Section, Minnesota Rules 7080 and any permit conditions. b. It shall be the responsibility of the permit applicant to notify the Building Official in writing that the project is ready for inspection. Inspections shall be made within seven (7) days of written notification by any SSTS permit holder that the SSTS for which the permit was issued is ready for inspection. C. No part of the SSTS shall be covered until it has been inspected and accepted by the Building Official and/or the City Engineer. d. Inspections shall be made prior to the issuance of a building permit or variance for new construction or the addition of a bathroom or bedroom on property served by an SSTS. 3. Certificate of Compliance and Notice of Non -Compliance: a. No newly constructed, installed, altered, repaired, extended or relocated SSTS shall be placed in operation until it has received a certificate of compliance as hereafter provided. b. Upon completion of the SSTS inspection as described in Section 4- 3-5.C.2 and 4 of this Section, the Building Official and/or City Engineer shall make a determination as to whether or not the SSTS has been constructed, repaired, extended or relocated in compliance with the requirements of this Section, Minnesota Rules 7080 and any permit conditions. (1) If the SSTS is found to be compliant, then a certificate of compliance shall be issued to the property owner within thirty (30) days of inspection. (2) If the SSTS is found to be out of compliance, then a notice of non-compliance shall be issued. The notice of non - 12 M compliance shall state which portions of the SSTS are not compliant and shall further state a reasonable period for the property owner to bring the system into compliance. Once the necessary changes are made or the period specified in the notice of non-compliance has run, whichever occurs first, then the SSTS shall be again inspected as provided above. If upon re -inspection, the SSTS is not compliant, then a notice of non-compliance shall be issued to the property owner. The notice of non-compliance shall state why the SSTS is non-compliant. A copy of the certificate of non- compliance shall be forwarded to the City Attorney for enforcement as provided in Section 4-3-6 of this Section. Inspection Protocol. a. In the event that the Building Official cannot complete an inspection or perform all required inspections in a timely manner, the Building Official is authorized and directed to develop and inspection protocol. b. The inspection protocol shall establish the order and priority of inspections. For any SSTS required to be inspected for which the Building Official is unable to actually physically inspect the SSTS, the Building Official shall require that evidence of compliance be submitted. Evidence of compliance includes, but is not limited to, the following: (1) Affidavits from the SSTS professional who performed any construction, installation, repair, alteration, or relocation of the SSTS. (2) Video, electronic or photographic images of certain components and/or work performed. (3) "As built" drawings. (4) Any other data, as may be required by the Building Official in lieu of an actual inspection, evidencing compliance with this Section, Minnesota Rules 7080 and applicable state law. C. The Building Official shall review such evidence and issue either a certificate of compliance or notice of non-compliance accordingly. 13 5. No Warranty or Guarantee of Operation. Neither the issuance of an SSTS permit or certificate of compliance, nor any inspection of an SSTS shall constitute any warranty or guarantee that said SSTS will operate or function properly. 4-3-6: ENFORCEMENT: A. Any person who violates any of the provisions of this Section or who makes any false statement on a Certificate of Compliance shall be guilty of a misdemeanor punishable by imprisonment, a fine or both as defined by State law. B. The Building Official may issue stop work orders and repair orders at such times and upon such terms and conditions as are necessary to prevent violations of this ordinance from occurring or to eliminate existing ordinance violations. C. In the event of a violation of this Section, in addition to any other remedies, the City Attorney may institute appropriate actions or proceedings to prevent, restrain correct or abate such violations. 4-3-7: SUBJECT TO CHANGE: The requirements of this Section are intended to be comparable to the Environmental Protection Agency (EPA) and Minnesota Pollution Control Agency (MPCA) standards. Should this Section differ from the standards of the EPA, MPCA or other agencies or should the standards of these agencies change, the more strict requirements shall apply. 4-3-8: CONNECTION TO MUNICIPAL SEWER: A. When Required: When municipal sanitary sewer is available, in the City's sole discretion, a property is served by an SSTS shall be required to discontinue such use and connect to municipal sewer upon the first occurrence of any of the following events: 1. Upon application for an SSTS permit. 2. When a notice of non-compliance is issued in relation to the SSTS serving the property. 3. Upon the expiration of a certificate of compliance. 14 4. Nothing in this Section shall be construed as limiting the City's ability to specially assess, levy a sewer access charge (SAC) or otherwise bill properties served by an SSTS for the availability of municipal sanitary sewer and the public improvements associated therewith. B. Condition of Approval: The issuance of an SSTS permit may be conditioned upon the property connecting to municipal sewer when it becomes available. C. Cause for Denial: The future availability of municipal sewer, in the City's sole discretion, may be cause for denial of an SSTS permit. Section 2. This Ordinance shall become effective immediately upon its passage and publication. As part of their program, TRSA utilizes playfields at Prairie Park. TRSA provides the goals for use in their games and practices, which are kept at Prairie Park throughout the season. Public Works Department staff has also moved the goals to the Youth Athletic Complex in Elk River after the summer season and returned them to Otsego. TRSA providing the goals and keeping them at Prairie Park encourages use of the playfields as part of their program and general park users. City staff has drafted the attached agreement regarding the use and storage of the TRSA equipment by the City to protect both organizations and formalize the arrangements that have been in place for several years. WHEREAS, the CITY provides playfields on CITY property for recreational use; and, WHEREAS, TRSA provides a recreation program of organized youth soccer; and, WHEREAS, TRSA is a recognized community recreation program under the CITY's Playfield Use Policy; and, WHEREAS, TRSA uses playfields at Prairie Park for regularly scheduled activities in association with their program. WHEREAS, the CITY provides maintenance of the playfields at Prairie Park for use by TRSA in accordance with the adopted playfield use policy; and, WHEREAS, TRSA provides goals/net equipment at Prairie Park for use in association with their program. NOW, THEREFORE, IT IS AGREED between the Parties as follows: 1. CITY agrees to allow the goals/nets owned by TRSA to remain at Prairie Park during the playing season. 2. TRSA agrees that CITY may move the equipment as needed to allow for the playfields to be maintained. 3. TRSA agrees that the equipment will be available for use by the general public while at Prairie Park when not in use by TRSA in accordance with their scheduled field use. 4. CITY agrees to transport the equipment at the request of TRSA to the Youth Athletic Complex (YAC) in Elk River for fall league purposes and return it to Prairie Park subject to approval of the City Administrator. 5. CITY agrees to provide non -season storage of the equipment within its buildings or facilities. Access to the equipment by TRSA will be pursuant to the City's adopted facility access policy and subject to approval by the City Administrator. 6. TRSA agrees that CITY is not liable for any damage to the equipment resulting from normal wear from it's intended use, from moving the equipment for maintenance or storage purposes, transporting the equipment when requested by TRSA, vandalism, weather or other any other causes. The Retroreflectivity Program has been specifically written to coincide with Otsego's type of sign inventory. Since Otsego has developed in stages and a good portion of that very recently, the blanket method of replacement was chosen. This ensures that during each year's street maintenance project or reconstruction type project, the signs in that particular area will be reviewed for age of sign, retroreflectivity of the sign, and appropriateness of the sign. If a sign's retroreflectivity life expectancy will expire prior to the next time the street is scheduled for maintenance or reconstruction, the sign will be replaced. A sign will also be replaced if the sign has already lost its retroreflectivity. If the sign does not comply with the MN/MUTCD (Manual for Uniform Traffic Control Devices), it will be evaluated by the City Engineer and likely requested to be removed as a liability reducing measure and a cost savings measure. All signs proposed for removal will be presented first to the Public Works Subcommittee and secondly to the Council for approval. Some signs, such as "Slow Children" or "Watch for Children" or "Children at Play" do not comply with MN/MUTCD and removal of these ineffective signs can become controversial. Discussions at the Public Works Subcommittee regarding these types of signs concluded with the recommendations to flag them for removal when replacement is required. The request will be forwarded to the City Engineer for review to see if it meets criteria set forth in the MN/MUTCD. When the resident applies they will be handed a pamphlet describing issues associated with the sign request and the procedure so they understand the process. Once the City Engineer has evaluated the sign, the evaluation will be presented to the Public Works Subcommittee for concurrence. If the sign is denied, notice will be sent to the resident with the evaluation. If the sign is approved by the Public Works Subcommittee, it will be added to the next Council meeting for approval by the Council. The goal of both the Retroreflectivity Program & Sign Policy is to provide the traveling public in Otsego with a safe, uniform, and readable signage system in the most cost effective way.
