Swenson called the meeting to order at 8PM.
The following Members were present:

Roskaft motioned to approve the minutes of 8/19/92. Arleen
Nagel seconded the motion. Motion carried unanimously.
Hearing for Ernest and Jane Davis for a Conditional Use
Permit to construct a 1,440 sq ft (48X30) accessory structure
on their 2.3 acre property S of 87TH and W of O'Dean Avenue.
(A single family detached accessory building can not exceed
750 sq ft) The property is zoned R-2. Lot 14, Block 1,
Vasseur's Oak Grove Estates.
Swenson explained how the Hearing would be conducted and
asked Beatty if the proper notices had been mailed, posted
and published. Answer: Yes Swenson turned the meeting over
to Kirmis to present NAC's Report of August 18. 1992.
Kirmis noted there are several vehicles at this site.
Davis noted that they are not there anymore. Kirmis read
recommendations on Page 2 of NAC's report (See attached #1-8)
In regards to #.5. in the past week Ms Davis has painted
existing structures to match.
Kirmis noted he has not gotten comments from Koshak or
Radzwill's office
Davis noted that all vehicles hav,e been taken out of
there, except a demolition derby vehicle and the others the;
have are licensed. The lot next door has evergreens and
doesn't mow the area. Mrs Davis doesn't see how planting
trees there would help as they would not be able to be seen.
There was no one else in the audience except Councilman
Larry Fournier.
It was brought back to the Commission.
Wallace asked about type of roof for the building.
Davis answered metal roof tan the same as sidewalls.
Wallace had a question for Kirmis. We have required
asphalt shingled roofs and we are not allowing metal roof
except in the Ag areas. Olson was allowed a pole building
with a metal roof and everyone in the neighborhood has pole
buildings said Davis.
Goenner stated that in this particular area there have
been a lot of pole buildings constructed and he feels he is
seeing a pattern here.
Wallace said he remembers the Olson building and the
trees there hide the building. Davis disagreed.
Roskaft's concern is that they can'* guarantee the

Black asked what is the current pitch of the roof on the
principal structure? Kirmis answered he thinks it is 6/12.
Black said maybe we should require more of a standard
pitch than the typical pole barn.
Swenson said he noticed that Kirmis Hadn't recommended
the pitch.
Kirmis said he did recommend it be the same as the
principal structure (See Item #6). Based on the elevation it
looks like a 5/12.
Black said maybe we should make the requirement of the
accessory structure be at a certain pitch.
Swenson asked if the Ordinance does not allow a metal
roof?
Kirmis said building materials should be the same as the
principal structure.
Nagel asked if there is a reason for screening on the S
and not the W side of the lot?
Kirmis said because of the distance on the South is so
great, it would not be required.
Black commented he did drive by to look at the site and
looked at Olson's buildings. It is a policy issue, but he
questioned the 14' sidewalls. He has a camper and truck in
this said Davis.
Black said he seriously questions the 14' sidewalls in a
residential area. Personally, he can understand storage
space. but doesn't understand the high storage building.
After discussion, Rask said he thinks 13'6" is the road
clearance. Some discussion was had on height.
Swenson said we should consider that there is an ongoing
use for this building and should fit the residential use of
this neighborhood.
Rask asked if the existing building is lap siding.
Kirmis said yes.
Wallace has a problem with the height he stated.
Ordinance says we should be in accordance with height of
other structures. The house has regular shingles. She has
the paint matched with the garage. She went to neighbors and
got signatures that they don't have a problem with it. All
the neighbors have trailers she stated.
Roskaft motioned to grant a CUP upon recommendation of
NAC, however the sidewalls will be 10' in height. Rask
seconded the motion_
Goenner said he believes that 10' might be too small for
a recreational vehicle. You need clearance. Maybe at 12'
they:• would be able to have clearance.
Swenson said he has a 10' door and his RV does fit in.
Kirmis said there are scissor trusses which would allow
you to -get larger vehicles in.
Rask asked if Roskaft would add asphalt shingles for
constituenc,/? Davis said neighbors are tin roof.

Beatty looked up the Olson Minutes for clarification.
Roskaft did not accept the change.
Wallace seconded the amendment for the change having
roof shingled. Bruce Rask and Mark Wallace voted for the
amendment.
Roskaft, Goenner, Swenson and Nagel voted no. Amendment was
defeated.
Roskaft's motion carried with Rask and Wallace opposing
it.
Black said we may wish to consider amending the
ordinance.
Black said the Council's concern is that the Commission
is addressing the Street Lighting Contract and felt they
should review this.
Kirmis explained he had reviewed it and does not see any
conflicts.
Roskaft Motioned September 16, 1992 P.C. Agenda we will
add the Street Lighting Contract. Goenner seconded the
motion. Motion carried unanimously.
Black said some issues he has:
1. Consider Cities interest
2. Consider emergency repairs to traffic control
devices particularly.
3. Who will determine the location of the particular
lights.
4. When units installed by utility a typical easement
required.
Item: 6, 7 & 3 you should pay particular attention.
Please look at it from prospective of the City and
what's the best interest does not necessarily consider with
the drafter- of the document.
The Subdivision Ordinance Amendment stipulated the City
may assess applicant or landowner for unpaid fees. MacArthur
drafted this document said Kirmis.
Wallace motioned to set the Hearing date for October 7,
1992 at 8PM for this Amendment. Roskaft seconded the motion.
Motion carried unanimously.
Wallace would like to see the Ordinance be changed in
regards to the accessory buildings.
Black explained more about asking for more than allowed
by the Ordinance- It has to be constructed in the same or
similar manner as the principal structure. They larger you
get the higher the quality should be said Black.
Swenson said one of the objections to this size building
is the size.
Roskaft said he didn't like the 750' accessory building.
He doesn't have a problem with a pole building that is

Cond Use Permits for accessory buildings? More discussion
was had on a moratorium.
Black said have commission members review the Ordinance
and come with their proposed amendment.
Enforcement issue maybe needs to be addressed with the
Council.
Black brought up that it is the City policy that the
only member that is to be contacting the City Engineer, City
Planner or City Attorney is the Chairman of the Planning
Commission. Just a friendly reminder from the Council.
Goenner asked if the members that were absent could be
called to •review Section #16 of the Ordinance and write down
changes as they would like to see.
Roskaft motioned to Adjourn the meeting. Rask seconded
the motion. Motion carried unanimously.
